Abstract:
Egyptian kaolinite was applied in the synthesis of zeolite-A by conventional hydrothermal and alkali fusion methods, resulting in two forms of zeolite-A: the hydrated phase (H.ZA) and the dehydrated phase (DH.ZA). The DH.ZA phase exhibits an enhanced surface area (488 m2/g), total basicity (7.73 mmol OH/g), high sodium content (20.2%), and a narrow particle size distribution (5 to 25 µm) as compared to the H.ZA phase (423 m2/g surface area, 5.88 mmol OH/g total basicity, 13.3% sodium content, and 10 to 45 µm particle size distribution). DH.ZA exhibits enhanced catalytic activity, achieving a biodiesel yield of 96.8% after 60 min at 60 °C, while the application of H.ZA resulted in a 95.8% yield after 120 min at 80 °C. The controlled transesterification mechanism in the presence of H.ZA and DH.ZA involved robust base-catalyzed reactions. The reactions follow the pseudo-first-order kinetics, and the rate constants (Kc) were determined at three different temperature values (40, 50 and 60 °C). The activation energies using H.ZA (35.9 kJ.mol−1) and DH.ZA (32.714 kJ.mol−1) demonstrates their efficiencies in mild conditions. The thermodynamic parameters of enthalpy (33.23 kJ.mol−1 (H.ZA) and 30.03 kJ.mol−1 (DH.ZA)), Gibb’s free energy (65.164 kJ.mol−1 (H.ZA) and 65.268 kJ.mol−1 (DH.ZA)), and entropy (−195.59 J.K−1.mol−1 (H.ZA) and −195.91 J.K−1.mol−1 (DH.ZA)) demonstrate the spontaneous and endothermic behaviours of these reactions. The obtained biodiesel matches the physical properties of the international standards, and the recyclability properties of the two zeolite phases demonstrate their suitability for commercial-scale applications.

Pontianak merupakah Ibu Kota Provinsi Kalimantan Barat yang sangat kental dengan sungai, rawa dan hutan hujannya. Provinsi Kalimantan merupakan salah satu paru-paru dunia karena luas hutannya, yaitu sekitar 40,8 juta hektar. Sayangnya laju deforestasi di Kalimantan demikian cepatnya. Menurut data yang dikeluarkan Departemen Kehutanan, angka deforestasi di Kalimantan pada 2000 sampai dengan 2005 mencapai sekitar 1,23 juta hektare. Pembangunan kota yang terjadi mengakibatkan penebangan pohon yang begitu massive sehingga menyisakan beberapa DNA hutan dan pepohonan yang dahulu pernah ada. Kawasan Sungai Jawi atau jalan H.R.A. Rahman merupakah salah satu yang dahulunya pernah menjadi daerah logging besar di Kota Pontianak yang ditumbuhi berbagai pohon hutan seperti pohon Jawi, pohon Angsana, pohon Trambesi dan pohon Tanjung. Beberapa tatanan pohon hingga sekarang masih dapat dijumpai di koridor jalan H.R.A. Rahman yang memiliki tinggi serta kanopi yang besar. Koridor pada jalan ini juga memiliki peruntukan lahan sebagai kawasan perdagangan dan jasa yang cukup berpengaruh di Kota Pontianak sehingga hal ini yang menjadi ketertarikan penulis untuk meneliti bagimana persepsi tingkat kenyamanan thermal terhadap pengaruh pohon pada segmen jalan H.R.A. Rahman. Penelitian ini nantinya menggunakan bantuan software googlearth untuk mengukur lokasi amatan, observasi wawancara serta aplikasi Rhinoceros untuk mengukur dan visualisasi besar radiasi serta pembayangan sinar matahari terhadap kondisi koridor jalan H.R.A. Rahman.

Con objeto de establecer las bases de un castigo penal justo, H.L.A. Hart propone una visión alternativa a las versiones tradicionales. El planteamiento de Hart muestra que los enfoques principales no han superado problemas de incuestionable importancia: la justificación moral del castigo penal y su aplicación justa. En este sentido, el trabajo de Hart se sitúa entre el consecuencialismo y el retribucionismo. De esta manera, si un castigo está justificado debe tener buenas consecuencias para la sociedad castigando sólo a quien lo merece. Finalmente, la propuesta de Hart conectará con su concepción del Derecho dando a los individuos las capacidades de guiar su propia vida con previsión, confianza, seguridad y libertad. In order to establish the basis of a fair criminal punishment, H.L.A. Hart proposes an alternative view to the traditional versions. Hart’s approach shows that the main approaches have not overcome problems of unquestionable importance: the moral justification of criminal punishment and its fair application. In this sense, Hart’s work is between consequentialism and retributivism. In this way if a punishment is to be justified must have good consequences on society punishing only those who deserve it. Finally, Hart’s approach will connect with his own conception of law giving individuals the capacities to guide their own life with foresight, confidence, security and freedom.

Namun, upaya Hart untuk mendamaikan dua tradisi yang bertentangan tidak bekerja, bukan membuat sistem pemikiran Hart tentang masalah ini tetap ambigu. Di satu sisi, Hart menyatakan bahwa hukum dan moralitas saling terhubung, bahkan sampai ke titik yang hubungan mereka menjadi hubungan alam mutlak, sementara di sisi lain, ia menegaskan bahwa keduanya tidak benar-benar terkait dan harus jelas berdiri terpisah. Hart berpendapat bahwa pemisahan harus dilakukan untuk menghindari konservatisme dan anarkisme. Abstract:
Antinomy is a symptom that is difficult to avoid within the scope of the law. Antinomic symptoms can occur in laws and regulations as well as in law enforcement carried out by judges. To relieve antinomic symptoms, a study of the symptoms of the antinomy and solutions is needed. The preparation of this article aims to examine and describe the intermediate antinomic symptoms in law enforcement in Indonesia between expediency, legal certainty, and justice. In addition, the author will also examine the legal reasoning and the concept of law H.L.A. Hart as a solution to relieve the symptoms of the antinomy. Normative research methods are used for the purposes of compiling this article by prioritizing a conceptual approach to analyze the legal material used. The legal material collected as a support for writing this article is qualitatively constructed and presented descriptively. The results of the study show the antinomic symptoms between legal certainty, justice, and expediency are difficult to avoid in law enforcement in Indonesia. One example of the antinomic symptoms is in law enforcement carried out by judges on cases of illegal fishing in the Indonesia EEZ area. To relieve these antinomic symptoms, legal reasoning and the concept of law H.L.A. Hart can certainly be a solution, but good legal reasoning is needed by the judge in his consideration of deciding the case, while for the concept of law H.L.A. Hart must be clear about the existence in the Indonesian legal system.

Abstract:
Today the concept of "open texture" is better known by works of the legal philosopher, H. L.A. Hart. But he expressly borrowed it from the philosopher of language, Friedrich Waismann. Waismann’s "open texture" had been part of an important challenge to verificationism and phenomenalism, grounded on the simple point that our definitions, our rules for usage, will often fail to guide us when we face the truly unusual. Our rules for language usage assume certain standard background conditions, and do not offer resources when those background conditions no longer prevail. Waismann’s "open texture" thus essentially refers to the potential vagueness of terms when applied in extreme circumstances, rather than their current vagueness under normal circumstances. Hart’s use of "open texture" in his book, "The Concept of Law", was offered as part of his argument for judicial discretion in interpreting and applying legal rules. Hart borrows the label from Waismann and cites to Waismann as a reference. However, Hart’s application of "open texture" was significantly different from Waismann’s understanding, and Hart’s work has been misunderstood in part because those differences have been underestimated. For Hart, the "open texture" of words and rules describes what is usually labeled as "vagueness," the uncertainty of application with borderline cases and novel situations (though novelty that falls short of the truly unexpected — cats that grow to nine feet tall or keep disappearing and reappearing — with which Waismann was concerned). Hart builds an argument for judicial discretion in part on (his understanding) of "open texture." In the borderline or unusual case, one cannot determine if the term (and the rule) should be used.

Caffeine treatment of ovine oocytes increases the activity of maturation-promoting factor (MPF) and mitogen-activated protein kinases (MAPKs) and, in somatic cell nuclear transfer (SCNT) embryos, increases the frequency of nuclear envelope breakdown (NEBD) and premature chromosome condensation (PCC). At the blastocyst stage, caffeine-treated SCNT embryos have increased cell numbers. One explanation for this is that NEBD and PCC release chromatin-bound somatic factors, allowing greater access of oocyte factors involved in DNA synthesis and nuclear reprogramming to donor chromatin. This could advance DNA replication and cleavage in the first cell cycle, resulting in increased cell numbers. Alternatively, increased MAPK activity may affect localisation of heat shock proteins (HSPs) and reduce apoptosis. To investigate these possibilities, we investigated chromatin accessibility, the timing of DNA synthesis and first cleavage, the localisation of HSP27 during early development and the frequency of apoptotic nuclei at the blastocyst stage. Compared with control SCNT (non-caffeine treatment), caffeine treatment (10 mM caffeine for 6 h prior to activation) increased the accessibility of DNase I to donor chromatin (P < 0.05 at 1.5 h post activation (h.p.a.)), advanced DNA synthesis (43.5% v. 67.6%, respectively; P < 0.01 at 6 h.p.a.) and first cleavage (27.3% v. 40.5% at 20 h.p.a., respectively) and increased nuclear localisation of HSP27. Although development to the blastocyst stage was not affected, caffeine increased total cell numbers (98.5 v. 76.6; P < 0.05) and reduced the frequency of apoptotic nuclei (11.27% v. 20.3%; P < 0.05) compared with control SCNT group.

The article is devoted to the legal doctrine of the famous New Zealand jurist John William Salmond - one of the most remarkable representatives of Anglo-American legal positivism, who made a significant contribution to its development. The aim is to reconstruct the views of a lawyer about the nature of law and the subject area of jurisprudence. The relevance lies in the fact that the evolution of Anglo-American legal positivism from J. Austin to the teachings of H.L.A. Hart is poorly studied in Russian jurisprudence while prevailing in Anglo-American legal thought. The methodological basis comprises historical approach along with the elements of a biographical approach, techniques and procedures of legal hermeneutics, rules and techniques of formal logic allowing to reconstruct the key ideas of J. Salmond's legal theory and place it in the context of the common law tradition. The main ideological line of the work is the connection between the legal teachings of J. Austin, J. Salmond and H.L.A. Hart. The work reveals features that allow to assert the typological belonging of Salmond's doctrine to the classical legal positivism in England. Particular attention in the article is paid to the study of significant differences between the legal teachings of J. Austin and J. Salmond, as well as the substantial similarities between legal theories of J. Salmond and H.L.A. Hart. The author came to the conclusion that Salmond's legal doctrine was the first in the history of English legal positivism, where the basis for the validity of law lies not in the order of the sovereign, but within the practice of the courts recognizing the rules as legal.

InConcept,Hart argued, amongst other things, that one of two ‘minimum conditions necessary and sufficient for the existence of a legal system’ was that ‘its rules of recognition specifying the criteria of legal validity and its rules of change and adjudication must be effectively accepted as common public standards of official behaviour by its officials’. In this paper, we begin the process of testing that statement empirically. Specifically, we ask whether non-judicial UK officials have a uniform view of what the rules of recognition, change and adjudication are, and whether they uniformly take an internal point of view towards them (i.e. whether they accept the rules and do not merely obey them). By way of a pilot study, thirty non-judicial UK officials were interviewed. Those officials comprised currently serving and retired senior civil servants, senior military officials, chief constables and local authority chief executives. The findings of the pilot study are presented in this paper. They allow us to deduce that Hart's statement might well be an inaccurate and incomplete description of the modern British constitution, and to comment on the implications of that conclusion.

From the affinity coefficient between two discrete probability distributions proposed by Matusita, Bacelar-Nicolau introduced the affinity coefficient in a cluster analysis context and extended it to different types of data, including for the case of complex and heterogeneous data within the scope of symbolic data analysis (SDA). In this study, we refer to the most significant partitions obtained using the hierarchical cluster analysis (h.c.a.) of two well-known datasets that were taken from the literature on complex (symbolic) data analysis. h.c.a. is based on the weighted generalized affinity coefficient for the case of interval data and on probabilistic aggregation criteria from a VL parametric family. To calculate the values of this coefficient, two alternative algorithms were used and compared. Both algorithms were able to detect clusters of macrodata (aggregated data into groups of interest) that were consistent and consonant with those reported in the literature, but one performed better than the other in some specific cases. Moreover, both approaches allow for the treatment of large microdatabases (non-aggregated data) after their transformation into macrodata from the huge microdata.

This article presents an analysis of the views of H.L.A Hart and Lawrence Friedman on the legal system from different perspectives. Through a comparative approach, this article identifies key concepts introduced by both scholars and highlights points of convergence and divergence between them. The research methodology used is a literature review, where primary and secondary sources, including . written works, books, and scientific articles authored by Hart and Friedman, are collected and analysed.. The author then conducts a comparative analysis to gain a deeper understanding of their views. The research findings indicate that H.L.A Hart views the legal system as a combination of primary and secondary rules that play a role in maintaining social order. On the other hand, Lawrence M. Friedman considers it as a product shaped by contextual and historical factors. Their perspectives provide a comprehensive understanding of the nature and function of the legal system. This article has implications for legal theory and serves as a foundation for further research on the legal system within the context of Hart and Friedman's views.

- Hart is one of the most prominent philosophers of law of the last century. Published in 1961, his book The Concept of Law has influenced many of the leading figures in contemporary legal theory. Hart held the Chair of Jurisprudence at Oxford University from 1952 until 1968 and he chose Ronald Dworkin as his successor. In his last book Diritto e natura. H.L.A. e la filosofia di Oxford, Mario Ricciardi takes the uneasy relationship between the two philosophers as the starting point of his inquiry and claims that Dworkin's critique of Hart's legal theory has misinterpreted many relevant aspects of Hart's approach to law. As a result, many scholars have paid little attention to the cultural and philosophical background of Hart's work. In particular, Ricciardi suggests that, in this work, Hart uses a specific notion of analysis, namely connective analysis, which Gilbert Ryle and Peter F. Strawson had opposed to the decompositive one. Such a reading of The Concept of Law generates a new understanding of the role played by the minimum content of natural law in Hart's legal theory.

A juicio del autor, el tratamiento que Hart dio a la polémica entre positivismo jurídico y Derecho Natural estuvo marcada por dos extremos aparentemente contradictorios. Por una parte, se abocó a clarificar las diversas tesis que anidan tras la etiqueta “positivismo jurídico”, así como las posiciones que suelen referirse como tales. Al hacerlo abrió el camino para mostrar en qué sentido no resulta ilógico defender algunas tesis asociadas al mismo o negar otras. Por otra parte, y si bien no asumió una posición que afirmase la conexión necesaria entre Derecho y moral, se ocupó también de mostrar en qué sentido tal conexión existe y es importante. Con dicho objetivo, en el primer apartado se ofrece una reconstrucción detallada sobre el tratamiento que Hart hizo sobre el problema del positivismo jurídico. En el segundo se expone el tratamiento del autor sobre el iusnaturalismo, con la intención de comprender el lugar preciso e implicaciones de su conocida tesis del “contenido mínimo Derecho Natural”. En la tercera parte se aborda la teoría elaborada por Hart sobre el positivismo jurídico, esto es, el “positivismo jurídico hartiano” y las tesis por él defendidas. Importante aquí será su posición respecto a la posibilidad de que la regla de reconocimiento pueda incorporar criterios materiales para la identificación jurídica que nos introduce en una nueva etapa de la nunca acabada polémica. ABSTRACT: The aim of this work is to address H.L.A. Hart’s contribution to the problem of legal positivism. According to the author, Hart’s approach to the controversy of Natural Law/Legal Positivism was characterized by two apparently opposing ends. On the one hand, he clarified the label “Legal Positivism” as well as other approaches that are usually referred as such. In doing so, he paved the way to show in which sense it is not illogical to defend some theses associated with it and in which sense it is not. On the other hand, despite he did not take a stand for the necessary connection between Law and Morals, he did show in what sense such connection may exist and why it is important. To this end, section one offers a detailed reconstruction of Hart’s approach to the problem of legal positivism. In section two the author’s approach to Natural Law is explained so that his well-known thesis of “The Minimum Content of Natural Law”, and what it implies, is properly understood. Section three is devoted to Hart’s theory of Legal Positivism that is “Hartian Legal Positivism”, where his main claims are presented. Hart’s claim on the possibility for the rule of recognition to incorporate material criteria for legal identification or legal validity is particular relevant because it introduces us to a new stage of the never-ending controversy. All positivists hold that law has social foundations. According to H.L.A. Hart, for example, the legal system rests on customary social norms followed by judges and other officials: norms that recognize other norms as belonging to the system and norms that provide for the application and alteration of the system’s primary norms. Even if this view requires amendment, it is likely any plausible account of the nature of law needs some account of social norms. Finding a fully satisfactory one, however, has proved surprisingly difficult.

This article focuses on the Constitutional Court decision no. 90/PUU-XXI/2023 which has attracted a lot of attention from experts and practitioners in the field. So the author is interested in studying the decision using the perspective of Hart and Dworkin's legal philosophy. The method used in writing is normative juridical with a case study approach and statutory regulations. Regarding the data collection method used is literature study. Based on the author's analysis, it can be concluded that if we use H.L.A. Hart's legal philosophy, the Constitutional Court Decision No. 90/PUU-XXI/2023 is in line with his framework of thought. However, if you use Dworkin's concept of thought, Constitutional Court Decision no. 90/PUU-XXI/2023 is contrary to the legal concept of integrity Penulisan artikel ini berfokus pada putusan Mahkamah Konstitusi No. 90/PUU-XXI/2023 yang sempat menarik banyak perhatian dari ahli hingga praktisi di bidang. Sehingga penulis tertarik untuk mengkaji putusan tersebut dengan menggunakan perspektif filsafat hukum Hart dan Dworkin. Metode yang digunakan pada penulisan adalah yuridis normative dengan metode pendekatan studi kasus dan peraturan perundang-undangan. Mengenai metode pengumpulan data yang digunakan adalah studi pustaka.
