Kamel, Omar. "Mass media & the laws of war : the concept and practice of legal muting." Electronic Thesis or Diss., Paris, Institut d'études politiques, 2024. http://www.theses.fr/2024IEPP0031.
Full textThis thesis introduces the concept of "legal muting" - a set of discursive practices that blunt, subvert, or obscure legal considerations in the media coverage of armed conflicts. Through comparative quantitative and qualitative analysis of three conflicts (Iraq 2003, Ukraine 2022, and Gaza 2023), this study demonstrates how media outlets employ various discursive techniques that shape public understanding of international law.Drawing from James Lorimer's assertion that "the binding force of international law depends on public sentiment and public opinion, as articulated by the press", this research considers the role of the media as primary interpreters of international legal norms. In the absence of institutionalized channels for disseminating international law, the media fills a "communicative gap", thereby shaping public understanding of legal issues. As such, legal muting manifests in their conflict coverage through two main mechanisms: minimization and variable focus. The results of this analysis reveal that legal muting is a persistent process that endures across all three conflicts despite an evolving media landscape, though its manifestations vary. The implications are profound for legal practitioners, whose public communications are subject to continuous transformation, and for scholars, to whom this presents a new source of legal knowledge production. This study ultimately recalls that the binding force of international law depends partly on its ability to be understood and legitimized by the public it is meant to serve

Full textThe co-production of information with the Arab viewer has always been the directive editorial line that distinguished the Qatari channel Al Jazeera since its creation in 1996. Over the years, the recipe has paid off, making Al Jazeera the most watched international news channel in the Arab world. The strategic choice of the channel to make the Arab spectator, long marginalized in the media, an ally is explained by a desire for legitimacy by the emir Hamad ben Khalifa al-Thani especially after the coup against his father in 1995. Nevertheless, cutting off from the old regime imposes substantial changes. With the first political debates on Al Jazeera, the status of the Arab viewer changes dramatically. They become actors and participate with their questions and comments at the cost of a simple phone call. But at the same time, Al Jazeera becomes the enemy of the Arab regimes. Over the years, the Qatari channel won the trust of many viewers, especially during its coverage of major crises in the Arab world, like the second Intifada in 2000 and the American invasion of Iraq in 2003. Through its media coverage from the ground in hot zones, it differentiates itself from other news channels. The year of 2011 was a major turning point in the history of the channel. From day one, Al Jazeera covered the rising demonstrations in the Arab countries. The declared war of autocratic regimes against Al Jazeera does not prevent it from covering stories. Aware of the contributions of digital media, the channel gives spectators the means to participate in the creation and circulation of information. The promotional videos of Al Jazeera are a concrete example. Throuh their short form which enables them to travel from one medium to another; they become an object of media activism. As for the digital platform Sharek, it shows how the channel involves the Arab spectator in the process of spreading and archiving information

Full textThe thesis is focused on two historiographical fields: on the first hand, the historiography of the war and the post-war period, and on the other hand, Cultural Heritage studies. For this research, we intend to follow the fate of several war ruins in the Hauts-de-France area in order to study representative cases of the different political and social uses that are made of war ruins from the destruction of buildings to nowadays. In the 20th century, a renewal took place in the desire to preserve war ruins. During the First World War, debates appeared in France concerning the conservation of certain ruins and the modalities of reconstruction in general. Despite the importance of war ruins and debates about them at the time, few buildings are preserved as “Remains and Memories of War” after the war. During the reconstruction, pilgrims and tourists who came to discover the ancient battlefields and to meditate there were interested in the ruins. Despite this, the list of ruins and war vestiges which were supposed to be preserved was gradually reduced to facilitate reconstruction. At the end of the Second World War, the Ministry of Reconstruction and Urban Planning (MRU) was responsible for the reconstruction of the country. Despite everything, a certain number of war ruins remained in the landscape and experienced variable fates. Some were leveled off or buried under new buildings during the reconstruction or town planning operations of the 1960s and 1970s. Other destructions were abandoned and were naturally covered with vegetation. In most cases, we witness the gradual disappearance of the remains due to abandonment and time. Despite everything, war ruins remain visible in our current landscapes in Hauts-de-France. This raises the question of the evolution of the management and recognition of war ruins during the 20th and 21st centuries, but also the question of the challenge of conserving these ruins in the territories. To understand the different dynamics put in place, we propose to study representative cases of the management of war ruins over the last century: The Weppes bunkers, the "Red château" of Villers-Bretonneux, the ruins of Chemin des Dames and those of the Somme, the case of the war memorials to the deads including Noyon's one, the ruins of Amiens, the abbey of Vauclair, the bunker of Éperlecques and finally the Crèche's coastal battery. These examples allow us to show different types of support, as well as the debates and preservation choices to which they lead and the developments in recognition over the long term

Full textThe conflict in Gaza in the winter of 2008-2009 seems at first primarily as a conflict between Israel and the Palestinian Hamas. But the press has given it regional and international dimensions. The press is more oriented towards the subjects of geopolitics and international relations. The newspapers studied generally explore the same subjects, but do not always share the same conclusions. One of the characteristics by the press is the intervention of the viewpoints in information. Journalists frequently expose their positions. From the point of view of International Relations theory, European, Egyptian and even Iranian action isdictated by a realistic approach to international relations for dialogue and distribution of interests. While the action of the United States (from the time of George BUSH son) is an idealistic approach, ideological and rigid which excludes all actors (state and non-state) from the resolution of this conflict. The conflict took place in an international context deprived from supreme authority that imposes order. UN has an only humanitarian role in that conflict. The conflict takes on a dimension other than political. Part of the authors gives it a religious dimension, even the issue of civilization. Press has an deficiency of perspective and historical analysis. It does not contextualize the events. This is a situation of the Israeli-Palestinian conflict in general. At the end, the press gives an interest in the conflict in Gaza despite the disaffection of a highly increasing number among the French. This observation leads to the release of less visibility to this conflict

Full textI want to study the different aspects of the Russian-Ukrainian conflict between 2003 and 2023. The main goal of this PhD Thesis is to understand the importance and the complexity of this confrontation at the same time local, national, continental and global. The first part is devoted to the geopolitical dimension of the Russian-Ukrainian confrontation. International relations theories are taken into account as explanatory models of the Russian-Ukrainian conflict. The processes of alliance and integration are taken into account as factors of tension. The question of the possible regulation of the conflict is posed. The second part highlights the strategic dimension of the Russian-Ukrainian confrontation. Concepts and activities, armaments and technologies are studied in order to understand the evolution of the armed conflict. The third part presents the economic component of the Russian-Ukrainian confrontation. The control of ressources in the areas of energy and agriculture, the practice of bilateral trade wars and the content of economic sanctions are the three elements of this economic war. The fourth part concerns the human factor in the Russian-Ukrainian conflict. The attitudes of specific groups such as the Ukrainian diaspora, pro-Russian separatists and battalions of volunteers are questioned. People's attitudes towards the conflict are highlighted. The fifth part is devoted to the dimnesion of the identity. This part puts forward the weaponization of culture (language, history, memory, religion) for conflicting purposes. The sixth part aims to study the informational aspect of the Russian-Ukrainian conflict. The different communication strategies are exposed. Many types of media are used by every actor. The Russian-Ukrainian confrontation leads both to a war of ruptures and to a globalized conflict. The uncertainty and variability of this enduring conflict may explain the difficulty of a lasting solution

Full textPresenting himself as an eyewitness of the Trojan war, Dares Phrygius is the reference historian of the Latin Middle Ages when it comes to the war of Troy. In the 13th century, his work, De Excidio Troiæ, wastranslated in many vernacular languages, amongst them French, Welsh and Norse (i.e. Icelandic). But the story of Dares seldom comes alone: it is often associated with the story of Romans or even of Bretons (i.e. Welsh), as they thought themselves then to be of Trojan ascent. In this study, I analyze the textual strategies at work in order to legitimize the transfer of Dares’s story towards vernacular languages and to appropriate this story by a new, unlatinized, textual community. This work presents itself as a compared study of these three corpuses. After a presentation of the context in which they were written and their manuscripts comes an analysis of the sources and their uses by the translators. After analyzing the compilations, I turn towards internal textual strategies, that is the treatment of the story of Dares, the modifications, the explanation of references, the role of the narrator and how history was conceived therefore in these works. In this study, I endeavor to show that appropriating the Trojan matter, even if the process is never made explicit in the texts, came from a specific interest for the story of Dares and more generally for the history of Troy
