This chapter examines the application of EU law by national courts and the way in which the CJEU controls national remedies for breach of EU law. Article 19 of the Treaty on European Union contains a new clause added by the Lisbon Treaty, which specifies that ‘Member States shall provide remedies sufficient to ensure effective legal protection in the fields covered by Union law’. Article 47 of the Charter of Fundamental Rights provides that ‘[e]veryone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article’. However, beyond these broad new provisions, EU law does not lay down any general scheme of substantive or procedural law governing remedies for its enforcement. The European Court of Justice has responded to the lack of a harmonized system of EU remedies by requiring national courts, in certain cases, to make available a particular type of remedy (e.g., restitution or interim relief), regardless of whether this would be available under national law.

Abstract:

This chapter considers whether long-run resource scarcity limits economic growth. It distinguishes between renewable and non-renewable resources, as types of natural capital. Using the example of oil, it shows that the depletion of non-renewables is not a binding constraint. It critiques the peak oil concept, and, in particular, notes that it fails to take account of either technical progress or the impact of prices in allocating resources. On renewables there are serious depletion concerns; the chapter advances the aggregate natural capital rule, and sets out how this provides a rigorous asset-base constraint on sustainable economic growth. The operationalization of this rule requires a natural capital balance sheet, a risk register for renewable resources, and the provision of capital maintenance.

This chapter explores the long-standing puzzle of the optimal role and impact of private business in public life based on evidence from a healthcare entrepreneur in India. To realize its goal of delivering affordable, high-quality care to the indigent population in India, Narayana Health (NH) had to address a number of voids created by the absence of supporting market institutions. This was done with entrepreneurial aplomb, sometimes even catalysing governmental action, by becoming a trusted intermediary to providers of all sorts of factor inputs who would otherwise not make their services available. This partial private provision of public infrastructure by NH illustrates how social investments by resource-constrained entrepreneurs in emerging markets can yield both private and public benefits.

The number of challenges facing students at South Africa’s Technical and Vocational Education and Training (TVET) colleges is profound. Many come in with fragile educational foundations, inadequate financial resources, insufficient English proficiency, and a lack of career guidance (Moodley & Singh 2015). Many others try to pursue their studies while already working full- or part-time, or caring for family members at home. Meanwhile, TVET colleges themselves are trying to cope with the changing profile of the students they now serve. In any given classroom, lecturers encounter students from multiple language groups who may have physical or learning disabilities and who occupy several age categories. To deal with the challenges that emerge from this – and the calls for TVET colleges to prepare their students for the Fourth Industrial Revolution – new programmes have been developed requiring higher cognitive investments from students and greater infrastructure and resource allocation from the government (DHET 2020).

This book argues in favor of an approach to global policy priorities that emphasizes the attempt to put a minimal set of basic goods and services into the hands of everyone. This universal provision of basic goods and services includes nutritious food, clean water, sanitation, health services, education services, housing, electricity, and human security services. The book argues that this policy focus is appropriate both for practical and ethical reasons, but that success in this provision will not be easy and therefore is no small hope. Basic goods and services meet central and objective human needs. The basic goods approach tries to form a bridge between the standard growth perspective on development and the capabilities/human development perspective. What really matters about growth is the possibility that growth will lead to an increase in the broad-based provision of basic goods and services, an outcome that is not always guaranteed. The hoped-for expansion of human capabilities and development is predicated on this expanded provision of basic goods, and the expanded provision of basic goods and services also can promote growth. In these ways, basic goods and services are critical link between growth and human development. The book explores each of the identified basic goods and services, the basic rights to them, and the many challenges to be overcome in their expanded provision.

This chapter considers a treaty of peace at Ghent, signed on December 24, 1814 by American and British commissioners. Initially, the British had insisted on creation of a permanent and semi-independent Indian buffer state north of the line drawn by the Treaty of Greenville, within which the United States would be forever barred from demanding further cessions of land. The American commissioners absolutely refused to consider such a proposal, and the British, weary of war after twenty years fighting against the power of Napoleonic France, yielded. Instead, they were able to obtain only a face-saving provision, Article IX of the treaty, which guaranteed their Indian allies all the possessions, rights, and privileges they may have enjoyed, or been entitled to, in 1811, provided they ceased hostilities against the United States.

This chapter examines the fundamental right to property as an important, albeit contentious, provision in the Indian Constitution. It considers Article 19(1)(f) of the Constitution, which guaranteed to all citizens the fundamental right to ‘acquire, hold and dispose of property’. It considers the shifts and continuities concerning this right in India, in both colonial and Independent India. It analyses case law relating to agrarian reform under the First, Fourth, and Seventeenth Amendments (Article 31(4) and (6), Articles 31A and 31B). It also assesses the laws within the scope of Article 31(2) needed to satisfy the requirements of public purpose and compensation. It concludes by commenting on the abolition of the fundamental right to property through the Forty-fourth Constitutional Amendment, as well as attempts to reinstate this right in the Indian Constitution.

Principle 11 guarantees adequate resources in support of a commission of inquiry so that it can comply with its legal mandate without compromising its independence and autonomy. A commission with autonomy means that it has control over its own finances and may make its own decisions in respect of the allocation of its resources. The issue of autonomy is inextricably linked to the independence of a commission. This chapter first provides a contextual and historical background on Principle 11 before discussing its theoretical framework, focusing on international law instruments governing the investigation of human rights violations that oblige state parties to adequately resource the responsible investigative agency. In particular, it considers the role of competent authorities, explicit duty, funding principles, and political will. It also examines how commissions of inquiry have been supported in practice and cautions against proceeding with commissions where adequate support is not guaranteed.

Abstract:

The central aim of this book is to explore the ways in which social categories—especially gender, but also categories like race and religion—interact with and contribute to social solutions to problems of coordination and resource division. In particular, this book uses formal frameworks—game theory and evolutionary game theory—to explore the cultural evolution of conventions that piggyback on seemingly irrelevant factors like gender and race. As I argue, these frameworks elucidate a variety of topics. In particular, these frameworks help show how inequity can emerge from simple processes of cultural change. In groups with gender and racial categories, the process of learning conventions of coordination and resource division is such that under a wide array of situations some groups will tend to get more and others less. One theme that runs throughout the book is that surprisingly minimal conditions are needed to robustly produce phenomena related to inequity that we usually think of as psychologically complex. It takes very little to generate a situation in which social categories (like gender) are almost guaranteed to emerge. The preconditions under which models move toward outcomes that look like discrimination are, again, very minimal. Once inequity emerges in these models, it takes very little for it to persist indefinitely. Thus, we need to think of inequity as part of an ever-evolving process. It is not something we can expect to fix and be done with. Along these lines, the picture I present is ultimately one where those concerned with social justice must remain vigilant against the dynamic forces that push toward inequity.

This chapter focuses on Article 267 of the Treaty on the Functioning of the European Union, which contains the preliminary ruling procedure. Article 267 has been of seminal importance for the development of EU law. It is through preliminary rulings that the European Court of Justice (ECJ) has developed concepts such as direct effect and supremacy. Individuals assert in national courts that the Member State has broken a Union provision, which gives them rights that they can enforce in their national courts. The national court seeks a ruling from the ECJ whether the particular EU provision has direct effect, and the ECJ is thereby able to develop the concept. Article 267 has been the mechanism through which national courts and the ECJ have engaged in a discourse on the appropriate reach of EU law when it has come into conflict with national legal norms.

This chapter focuses on another principal provision concerned with competition policy: Article 102 TFEU. The essence of Article 102 is the control of market power, whether by a single firm or, subject to certain conditions, a number of firms. Monopoly power can lead to higher prices and lower output than would prevail under more normal competitive conditions, and this is the core rationale for legal regulation in this area. Article 102 does not, however, prohibit market power per se. It proscribes the abuse of market power. Firms are encouraged to compete, with the most efficient players being successful.

The chapter also examines the issue of ‘open adoption’, focusing on adopted children's right to information about their birth families and provision for post-adoption contact, and, finally, considers the main alternative to adoption: special guardianship.

Management of the nutritional consequences of disease and its treatment are now acknowledged as a key component of palliative care provision. Factors affecting the ability to eat and the consequent changes in body composition which occur with disease progression often initiate concern in patients and relatives alike. The role of the dietitian is to provide dietary counselling in partnership with the patient where realistic goal setting can be achieved. The evidence base for improvement in nutritional status is equivocal which may be expected in this heterogeneous population. However, achieving recommended energy intakes is viewed as achievable using this strategy but is resource intensive. Nutritional assessment allows for appropriate monitoring of sequential changes in nutritional status and should be the cornerstone of a dietitian’s role. Classifying a patient’s stage of cachexia appropriately may prove useful in identifying when dietetic interventions are likely to be of greatest benefit.

Article 34 is the central provision and states that: ‘quantitative restrictions on imports and all measures having equivalent effect shall be prohibited between Member States’. Article 35 contains similar provisions relating to exports, while Article 36 provides an exception for certain cases in which a state is allowed to place restrictions on the movement of goods. The European Court of Justice’s interpretation of Articles 34-37 has been important in achieving single market integration. It has given a broad interpretation to the phrase ‘measures having equivalent effect’ to a quantitative restriction (MEQR), and has construed the idea of discrimination broadly to capture both direct and indirect discrimination.

The EU develops policy through regulations, directives, and decisions. Any developed legal system must have a mechanism for testing the legality of such measures. This chapter focuses on access to justice and review of legality by the EU Courts. There are a number of ways in which EU norms can be challenged, but the principal Treaty provision is Article 263 of the Treaty on the Functioning of the European Union (ex Article 230 EC). Five conditions must be satisfied before an act can successfully be challenged: (i) the relevant body must be amenable to judicial review; (ii) the act has to be of a kind that is open to challenge; (iii) the institution or person making the challenge must have standing to do so; (iv) there must be illegality of a type mentioned in Article 263(2); and (v) the challenge must be brought within the time limit indicated in Article 263(6).

How does management make a meaningful contribution to public service performance? This is the overall question of this volume. The sixteen chapters aim to clarify conceptual issues; critically reflect on assumptions underlying public management and public service performance understandings; theoretically explain direct and indirect relationships between management and performance; and outline a research agenda based on a review of the extant literature. In order to achieve these aims, this volume takes a multidisciplinary, critical, rigorous, and context-sensitive approach. The disciplines of public management, leadership, human resource management, and work and organization psychology are combined because they focus differently on aspects of management, public service performance, employee outcomes, and linking mechanisms such as employees’ attitudes and behaviors. Multidisciplinarity is illustrated by the variety of management aspects examined: different types of leadership behaviors, people management, performance management, human resource management systems, diversity management, and change management. Stakeholders often emphasize different public values that influence what they hold desirable in public service provision. The authors critically reflect on which stakeholder interests are included and excluded in empirical studies. The institutional perspective informs critical reflection on public sector context factors that affect the management–performance relationship in democratic societies. By paying attention to distinctive features of the public sector context, the volume contributes to both knowledge growth and the improvement of public services in practice.

Life Cycle Assessment (LCA) has developed in Australia over the last 20 years into a technique for systematically identifying the resource flows and environmental impacts associated with the provision of products and services. Interest in LCA has accelerated alongside growing demand to assess and reduce greenhouse gas emissions across different manufacturing and service sectors. Life Cycle Assessment focuses on the reflective practice of LCA, and provides critical insight into the technique and how it can be used as a problem-solving tool. It describes the distinctive strengths and limitations of LCA, with an emphasis on practice in Australia, as well as the application of LCA in waste management, the built environment, water and agriculture. Supported by examples and case studies, each chapter investigates contemporary challenges for environmental assessment and performance improvement in these key sectors. LCA methodologies are compared to the emerging climate change mitigation policy and practice techniques, and the uptake of ‘quick’ LCA and management tools are considered in the light of current and changing environmental agendas. This chapter discusses the doctrine of supremacy of EU law, which was developed by the European Court of Justice (ECJ) based on its conception of the ‘new legal order’. The ECJ ruled that the aim of creating a uniform common market between different states would be undermined if EU law could be made subordinate to national law of the various states. The validity of EU law can therefore, according to the ECJ, never be assessed by reference to national law. National courts are required to give immediate effect to EU law, of whatever rank, in cases that arise before them, and to ignore or to set aside any national law, of whatever rank, which could impede the application of EU law. Thus, according to the ECJ, any norm of EU law takes precedence over any provision of national law, including the national constitutions. This broad assertion of the supremacy of EU law has not however been accepted without qualification by national courts, and the chapter examines the nature of the qualifications that have been imposed by some national courts.
