El Códice XIV de la Biblioteca del Real Monasterio de San Isidoro de León, realizado en vitela finísima,contiene las Decretales de los Papas Gregorio IX (1227-1241) y Gregorio X (1271-1276). El texto principal está escrito a dos columnas en el centro de la página y su letra gótica tiene particularidades propias de la cancillería papal de finales del siglo XIII; alrededor de aquél se colocan las glosas escritas también en letra gótica más pequeña. El aspecto general de la obra nos remite a un manual de Derecho eclesiástico propio de la Europa Mediterránea del citado siglo. La decoración se puede ver en las iniciales que señalan las partes principales del texto, pero la iluminación se coloca únicamente en aquellas que inician el prólogo y los cuatro libros primeros.

Las tareas de descripción documental en los Archivos de la Catedral y del Arzobispado de Sevilla han permitido identificar un documento pontificio original de Gregorio IX, datado en el año 1227, dirigido a las curias eclesiásticas a las que manda proteger y favorecer a la Orden de Predicadores en su expansión y misión evangelizadora, veintiún años antes de la restauración del culto cristiano en Sevilla por Fernando III en 1248, convirtiéndose en el documento original más antiguo conservado hasta la fecha en estos Archivos. En este artículo profundizamos en el análisis del contexto de producción del documento, lo ponemos en relación con otros de contenido idéntico, y trazamos su historia archivística, Todo ello nos permite valorar su interés y destacado papel como testimonio de un proceso histórico de la Iglesia bajomedieval, más allá de su singular antigüedad o de su breve contenido.

Abstract:
La conquista de la ciudad de Baeza en 1226 por las tropas de Fernando III suponía el enclave más avanzado de las tropas cristianas en Andalucía. Tras su conquista daría comienzo la restauración de la primera diócesis episcopal de la Andalucía cristiana. En ésta, la figura del arzobispo de Toledo, don Rodrigo Jiménez de Rada sería clave, pues Baeza formaba parte de la antigua provincia eclesiástica de la Cartaginense, sufragánea de Toledo. Sin embargo, las relaciones entre el arzobispo de Toledo y el restaurado obispo de Baeza no serían cordiales, pues entre 1233 y 1243 se daría un litigio entre ambos para poder identificar los límites de ésta, los cuales deberían de estar basados en la antigua diócesis visigoda. Para ello, el Papa Gregorio IX encargara una serie de comisiones para que busquen estos límites entre los documentos antiguos, haciendo uso, así, del pasado.

L’articolo illustra l’archivio dell’Arca, recentemente riordinato e inventariato.La devozione a s. Antonio da Padova cominciò molto presto, subito dopo la sua morte, avvenuta il 13 giugno 1231. L’anno seguente papa Gregorio IX canonizzò il frate francescano di origine portoghese e così si intensificarono i pellegrinaggi e le offerte dei fedeli. Iniziò la costruzione di una nuova chiesa dedicata al santo, grazie ai finanziamenti del comune cittadino, che si occupò fino al 1310 anche della gestione del denaro offerto per erigere la basilica. In seguito l’amministrazione delle cospicue proprietà immobiliari e del denaro offerti dai devoti fu affidata all’istituzione denominata “Veneranda Arca di s. Antonio” che è attiva e operante tuttora. L’archivio dell’Arca si è conservato quasi inte-gralmente a partire dal XV secolo e documenta non solo le vicende dell’istituzione e della chiesa, ma anche la storia di Padova e del suo territorio, in particolare del paese di Anguillara Veneta, donato nel 1405 dai Carraresi, signori di Padova e rimasta di proprietà dell’Arca fino al 1973.

Un largo itinerario condujo a la separación entre Oriente y Occidente en 1054. El primer choque se produjo en el concilio de Calcedonia (451). A finales del siglo VI, el patriarca de Constantinopla asumió el título de «patriarca ecuménico» frente a los derechos del papa Gregorio Magno. Después vino el serio enfrentamiento por el Filioque, en el siglo IX. Finalmente el cisma de Miguel Cerulario en 1054. Los cruzadas, sobre todo la cuarta, de 1204, contribuyeron más al distanciamiento. Muchos han sido los intentos unionistas en el segundo milenio, pero sin frutos: el II Concilio de Lyon (1274) y el Concilio de Florencia (concretamente en 1439). Con todo, ha habido algunos resultados, aunque parciales, como la Unión de Brest-Litowsk (siglo XVI) o el levantamiento de las excomuniones mutuas al final del concilio Vaticano II. El reciente documento de la Congregación para la Doctrina de la Fe, fechado en el año 2002 y titulado «El Primado del sucesor de Pedro en el Misterio de la Iglesia», puede ser un camino para resolver la cuestión de la primacía romana.

During his papacy (1227-1241), widely acknowledged by scholars as the key moment for the birth of medieval inquisition, Gregory IX wrote more than 300 letters about heresy, antiheretical tasks and inquisition, collected and edited for the first time all togheter here in the second volume. This preliminary work offered the chance to analyse the devolopment of papal antiheretical efforts and to identify the most concerned areas and years of repression. Therefore, a variety of approaches adopted by the pope derived from different political situations and as a consequence it led to a rich and motley lexicon according to single issues and provinces. Furthermore it is also evident the evolution of the role played by members of the Order of the Preachers: during the 1220s they were involved in antiheretical preaching and reconciliation of those found infamous or guilty; later, during the 1240s some friars were committed as inquisitores haereticae pravitatis in southern France.

As Decretais de Gregório IX (Decretales ou Liber Extra) é uma compilação de direito canônico publicada em 1234, que havia ficado sob incumbência do canonista Raimundo de Penyafort e da qual ainda não existe tradução em português e em outras línguas faladas hoje. Nascida no período de direito canônico clássico e do chamado ius novum ou ius decretalium, ela se caracteriza por incluir principalmente (não apenas) decretais papais desse período, isto é, tanto declarações com o conselho da cúria romana – ou sem a participação da mesma – sobre matérias jurídicas após uma provocatio da hierarquia inferior, como ainda sentenças judiciais, quando estas chegavam à cúria romana, além de outras manifestações papais dadas a particulares. De caráter particular, elas tornaram-se universais ainda antes de serem incluídas nas Decretais. A obra se divide em 5 livros, os quais se subdividem em títulos e capítulos, abordando vários tipos de normas, que de forma excessivamente resumida são: o processo canônico ou ordem de juízo (matéria processual civil eclesiástica e de processo criminal), disciplina do clero secular e regular, a administração eclesiástica, normas sobre o casamento, determinação sobre os vários tipos de crimes, previsão de penas, regras litúrgicas, entre outras. A tradução é feita sobre os dois primeiros títulos do livro 5, tratando de três modos processuais canônicos (acusação, denunciação e inquirição) – que exerceram e ainda exercem uma influência determinante sobre o direito de países da Europa e da América – e das penas aplicadas aos caluniadores no desenrolar dos referidos modos processuais. A tradução é feita ainda sobre parte da Glosa Ordinária, apenas quando se entendeu que ela fosse fundamental doutrinariamente para completar as normas ou quando indispensável para o entendimento de certos trechos. Essa glosa segue a mesma ordem do texto latino, mas é apresentada em notas finais, as quais são interpretativas e fazem uso concomitante de outros tipos de meios bibliográficos. A introdução se divide em duas partes. Na primeira é abordada a natureza da fonte traduzida, os elementos constituintes, o trabalho editorial de Raimundo de Penyafort a partir de coleções de decretais anteriores, e se discute a edição impressa do Corpus Juris Canonici utilizada para a tradução. Na segunda parte se trata de entender a complexidade do material contido na tradução, cuja leitura por si só torna difícil o entendimento da matéria. A sociedade brasileira e aquelas de vários países do Ocidente estão organizadas através de legislações que possuem um desenvolvimento operado há muitos séculos. Apesar de principalmente voltado à estrutura eclesiástica, o direito canônico acabava atingindo a sociedade laica (secular) cristã e isso deixou marcas na atualidade. Tal como o direito contemporâneo brasileiro, o direito canônico, embora assentado em uma firme estrutura original, estava em constante aperfeiçoamento e era adequado ao seu tempo, o que incluíam as regras processuais criminais quando se percebia a impunidade e a constância no cometimento dos crimes, a despeito de ambos os direitos caracterizarem-se pela mitigação na aplicação das sentenças judiciais, excetuando-se determinados crimes, considerados graves em seus tempos.
The Decretals of Gregory IX (Decretales or Liber Extra) is a compilation of Canon Law published in 1234, which had been in charge of the canonist Raymond of Penyafort and from which there is still no translation in Portuguese and in other languages spoken today. Born in the classical Canon Law period and the so-called ius novum or ius decretalium, it includes mainly (not only) papal decretals of that period, namely both statements made by the Roman curia council – or without its participation – on legal matters upon a provocatio of the lower hierarchy, or court rulings, when they reached the Roman curia, as well as on other papal manifestations given to private affairs. Despite having a particular character, they became universal even before being included in the Decretals. The compilation is divided into five books, which are divided into titles and chapters, covering various types of regulations, which are, in sum: The canonical process or ordo iudiciarius (ecclesiastical civil procedural and criminal proceedings), discipline of secular and regular clergy, the ecclesiastical administration, rules about marriage, determination of the various types of crimes, punishment predictions, liturgical rules, among others. The translation was carried out on the first two titles of book 5, dealing with three canonical procedural modes (accusation, denunciation and inquisition) – that exerted and still exert a decisive influence on the laws of countries in Europe and America – and penalties applied to calumniators during the course of these procedural modes. Translation was further carried out on part of the Ordinary Gloss, only when it was understood that it was essential to doctrinally complete the norms or where essential for the understanding of certain passages. This gloss follows the same order of the Latin text, but it is presented in the form of endnotes, which are interpretative notes and make concomitant use of other types of bibliographic resources. The introduction is divided into two parts. The first addresses the nature of the translated source, the elements, the editorial work of Raimundo Penyafort from previous collections of decretals, and discusses the printed edition of the Corpus Juris Canonici used for the translation. The second part deals with the understanding of the complexity of the material contained in the translation, whose reading alone makes it difficult to understand the matter. The Brazilian society and the societies of many Western countries are organized based on laws whose development occurred many centuries ago. Although mainly focused on the ecclesiastical structure, canon law strongly affected the Christian lay (secular) society, whose effects can still be perceived today. Just like the Brazilian contemporary law, canon law, although laid on a firm original structure, was constantly improving and was appropriate to its time, which included criminal procedural rules when impunity and constancy in the practice of crimes were perceived, despite both types of law are characterized by a mitigation in the enforcement of legal judgments, except for certain crimes considered serious offences in their times.

Abstract:
The Decretals of Gregory IX, promulgated in 1234, was the first collection of canon law for the Catholic Church invested with universal and exclusive authority, and was the culmination of a century and a half process by which the a now papal-led Church came to be the leading institution within medieval European society. The Decretals, also known as the Liber extra - a compilation of 1971 papal letters, constitutions and conciliar canons drawn principally from the century prior to its issuance - has long been understood as a key text for the study of the medieval papacy, the rise of scholasticism within the universities, and the extension of the Church's jurisdiction into almost every area of medieval life. The degree to which the man commissioned to edit the collection, the Dominican Raymond of Penyafort (1175-1275), actively shaped the legal content of the Decretals through eliminating, rewording, or supplementing the individual texts has remained elusive, in part because of the complicated manuscript tradition and in part because of our ignorance of all his sources. This dissertation examines Raymond's editing of the most recent material within the collection, the 195 capitula attributed to the commissioning pope Gregory IX (1227-1241), which in many cases provide definitive statements of the law. This study has determined that Raymond used Gregory IX's papal registers - the official record of papal correspondence and administration - as a source for roughly half of the capitula attributed to this pope in the Decretals. A collation of these capitula with the register originals has been produced, allowing one to see directly how Raymond shaped the material at his disposal into a universal legal framework for the Church. While the collation will serve as the basis for future analyses of the changes Raymond and Gregory introduced into the law, a case study has been conducted for the Gregorian legislation related to the religious orders. The results of this study show the dynamic and contingent nature of papal legislation - how the law at times was crafted in response to specific difficulties faced by legal commentators, but also how certain decisions with a narrow scope were given broad and universal application by Raymond, sometimes with unintended consequences down the road. Such was the case with Gregory's decision to allow women in a southern German province - who had been abandoned by their husbands for having committed adultery - to enter convents set up for former prostitutes (X 3.32.19, Gaudemus in Domino). In Raymond's hands this became a general recommendation that all women convicted of adultery should enter into convents to perform lifetime penance. Aside from legal content, Raymond's editing for the entire collection has been examined from the standpoint of legal rhetoric, and the particular language of law that emerged in the thirteenth century. It is demonstrated how Raymond consistently eliminated references to the counsel given the pope by the cardinals during legal decision making, with the effect of representing the law as a more direct expression of the papal will. Moreover, the ubiquitous invocations of additional sources of authority normally found in papal correspondence to back up pronouncements of the law - whether they be previous legal decisions, scripture, or the holy fathers - were regularly omitted. This suggests an emerging conception of the law, as well as the institutional framework of the papacy, as self-sufficient and self-evident in its authority. As part of examining the papal registers as a source for the Gregorian capitula, a diplomatic study has been produced of the manuscript of the first register volume (Vatican City, ASV, Reg. Vat. 14, covering pontifical years 1-3), which demonstrates how the register functioned as an ongoing and increasingly important administrative record for the Roman Curia. This study contributes to the overall understanding of the place of the written record in medieval administrative practices in the thirteenth century, suggesting that the tools of centralized administration normally associated with the later thirteenth century can be found during Gregory's pontificate. It proposes a new comparative direction for the study of medieval administrative institutions and the tools upon which they were based. This dissertation also contributes to the ongoing efforts to study and classify the almost 700 surviving manuscripts of the Decretals as well as the hundreds of manuscripts of its main sources, the five canon law compilations collectively known as the Quinque compilationes antiquae. By examining Raymond's method of organizing his material, and comparing the early manuscripts of the collection, a working list of important variants has been developed that may be employed going forward to test and categorize manuscripts of the Decretals and the Quinque compilationes antiquae. Although the collection was intended to become the exclusive source for decretal law prior to 1234, with Gregory IX banning the use of all former compilations, a careful study of thirteenth century commentators such as Hostiensis, Sinebaldus Fieschi (Innocent IV) and Bernard of Parma shows that commentators continued to refer back to the earlier sources of the Decretals when doubtful questions about Raymond's editing arose. While an awareness of the historically-embedded nature of the law is normally associated with the Renaissance and Early-Modern periods, this dissertation proposes a reevaluation of medieval canonists as sensitive to the historical and textual-critical dimensions of the legal tradition.
