Abstract:
From May 31 to June 4,1999 over eight hundred participants from al1 levels of government and nongovernmental organisations attended the World Conference on Governance held in the Philippines. It had been organised by the Eastern Regional Organisation for Public Administration (EROPA), the Philippine Civil Service, and the National College of Public Administration and Governance at the University of the Philippines, in cooperation with numerous international and regional organisations, including the Asian Development Bank, the Canadian International Development Agency, the Economic Development Institute of the World Bank, the United Nations Development Programme and the United Nations Department of Economic and Social Affairs. Its theme was From Government to Governance with emphasis on public finance, capacity building and partnerships. But its major concern was promoting good governance, a topic which has been attracting increasing international attention since the late 1980s and has become a key objective of many technical assistance programmes. The World Conference can be seen as a culmination of these efforts to focus on good governance in institutional development and to prepare an agenda for future action by taking account of current ideas and opinions of all those involved. What follows is a brief overview of some major issues that run through the notion of promoting good governance.

Abstract:
The purpose of this paper is to identify and examine the implementation of good governance and its derivatives, namely good amil governance, good enough governance, and good university governance from various writing methods, national to international scope. This paper uses a qualitative method with a literature review approach. The literature used by the author comes from books that are appropriate to the topic, international journals published from 2018 to 2022. The writing results obtained are topics regarding good governance and its derivatives, namely good amil governance, good enough governance, and good university governance which have been discussed in many reviews of methods and viewpoints, with mixed results. The results of research using quantitative methods with significant and insignificant results, when using qualitative methods, there are results of implementation that are appropriate and not in accordance with the rules that should be. The author hopes that there will be other reviews regarding the topic of good governance in general, and good amil governance, good enough governance, and good university governance in particular so that the study on this topic is broader. This issue of the Potchefstroom Electronic Law Journal (PELJ) is entirely dedicated to the concept of good governance. It is the outcome of the first Summer/Winter school on Good Governance which was held at North-West University, Potchefstroom (SA) in January 2006 and at Tilburg University, Tilburg (NL) in January 2007. This Summer/Winter school has now become a yearly event with a bi-annual theme. Academic staff from both universities collaborate in teaching this course. Students from the two universities who participate in the Summer/Winter school have the unique possibility to deepen their knowledge on a particular subject while enjoying a cross-cultural learning environment. The subject of good governance was not selected by chance but was chosen because of its impact in many fields and the many ways in which the concept is used. It was time for a deeper insight into this multiple role of the concept of good governance. The contributions to this journal are the analytical outcome of the research done in preparation for the lectures given during the Summer/Winter school. As the contributions directly apply the good governance concept to various specific fields of expertise, this introduction will be used to give a short reflection on the concept as such.

Abstract:
In many countries, „free and fair‟ parliament elections precede a process of cabinet selection which, in contrast, is often far from transparent. In single party majority rule, the party which wins the election then forms the government, its leader becomes the premier, and he/she then has the power to hire and fire ministers, as it pleases. Where elections result in a number of parties being represented in parliament, none of which has a majority, there invariably follows a very opaque part of the democratic process: inter-party meetings, wherein various parties try to form a majority coalition, with ministries allocated to party functionaries in deals perhaps shady or worse. A third structure relates primarily to conflict zones, all-party power-sharing; in these situations, any negotiations by which a government is formed can be both problematic and protracted. It need not be so. In either a single-party majority rule, a majority or grand coalition, or a unity government, the parliamentary party or parties concerned could use a transparent voting procedure, a tabular mechanism by which every mp can vote, not only for those whom they wish to see in government, but also for each nominee‟s ministerial post. It is called a matrix vote. This article will examine different government structures – one-party, two-party and multi-party states; it will examine the assumptions on which democracy is based, with particular regard to the fact that the right of a majority to rule is often interpreted to mean that political decisions can best be resolved by binary votes; it will consider a hypothetical example of the matrix vote; and finally, it will discuss the feasibility of an inclusive, all-party political structure.

Abstract:
It is proposed that government, being the tangible expression of the legitimate authority within an organised society, has undegone a long transformational journey since its very emergence. The various evolutionary forms and features of the government have been the product of its meaningful and viable responses to the changing expectations of the people as well as to the challenges they faced in an ever-changing environment. The exclusive domain of the state over the period became a shared space with inclusion of other actors and stakeholders, and an era of governance was ushered in since the 1980s. The much celebrated success of the liberal democracy and its market-led open economy heralded as an era of good governance. However, the universal model of good governance fails to take into account the local constraints of a society. Thus, the idea of good governance has to face various types of challenges in the developing as well as underdeveloped societies.

Abstract The research aims to determine the practice of implementing good governance in the context of administrative law. This writing is a legal writing that uses a conceptual approach. The results of the study show that the legislative body in carrying out the regulatory function must base on good / decent regulatory principles / principles by developing knowledge and skills in the field of legislation as mandated by Law Number 12 Year 2011 along with its attachments. In general, there are two main means used to assess good / decent governance, namely Procedure and Facts used in making decisions, in addition to attention to several legal principles as a manifestation of the implementation of the principle of democracy. Judicial control in overseeing government actions against decisions made, including in Judicial Review, which are repressive and prioritize the legality aspect (rechtmatigheid) of a decision. AbstractGood governance is a concept for governance that should be run. Theoretically, the discourse of good governance reaps its pros and cons since it had been firstly introduced. However, as a concept and a strategic offer it deserves to be appreciated and re-examined. There are principles in good governance that are compatible with Islam such as accountability, transparency, deliberation, and others. Good governance will be achieved when it involves a good communication among the government, civil society, and the business sector. The author uses the perspective of contemporary maqaasid asy-shari'ah to view the discourse with more emphasis on development and right. The perspective is different from the old maqasid which emphasizes more on the protection and preservation. The result of the study shows that good governace needs harmonious relationship among the followers of religion, social justice, organized and equitable education, human rights protection, and the development of civilized law.Keywords : Good Governance, Maqâsid asy-Syaari’ah, DevelopmentAbstrakGood governance merupakan sebuah konsep tata kelola pemerintahan yang seharusnya dijalankan. Secara teoritis, diskursus good governace menuai pro-kontra sejak awal kemunculannya. Meskipun demikian, sebagai sebuah konsep dan tawaran strategis patut untuk diapresiasi dan dikaji kembali. Terdapat prinsip-prinsip dalam good governance yang berkesesuaian dengan Islam diantaranya akuntabilitas, transparansi, musyawarah, dan lainnya. Upaya mewujudkannya tidak hanya dilakukan oleh satu pihak saja, tetapi komunikasi antara pemerintah (goverment), masyarakat sipil, dan sektor dunia usaha. Dalam melihat diskursus ini, penulis menggunakan perspektif maqaasid asy-Syaari’ah kontemporer dengan lebih menekankan pada development (pembangunan; pengembangan) dan right (hak-hak). Berbeda dengan maqasid lama lebih pada protection (perlindungan) dan preservation (penjagaan; pelestarian). Berdasarkan hasil kajian tersebut bahwa dalam mewujudkan good governace diperlukan pembangunan dalam berbagai aspek seperti membangun hubungan harmonis antar pemeluk agama, mewujudkan keadilan sosial, penyelenggaran dan pemerataan pendidikan, perlindungan terhadap hak asasi manusia, pembangunan hukum berkeadaban.. Nowadays governance remains a multi-dimensional concept. It may be termed as a totality of issues reliant on the person concerned about and his/her individual perception of practicality. Good governance cannot be attained, except holding the attention of its vibrant interactions with democratization advantages, the civil rights situation, the state of pro-active improvement and the role of government strategies and programs in a specific nation-state. Here, supposed to be a means of consciousness which seems good governance is beneficial due to its various favourable belongings. Good governance simplifies communal and economic progress and concentrates on its surroundings where social privileges are appreciated. Responsibility, competence, effectiveness, and sustainability can affect people’s involvement, which is subsequently vigorous for good governance. On the local area, shared improvement has been associated with good governance. It is correspondingly understood that participatory growth is not thinkable excluding the existence of a vigorous civil society. Democratization in the logic of providing reasonable chances for taking part in political lifespan may closely relate to good governance also. The mode with which good governance has been represented is evidently lacking in Bangladesh. The views that keep an eye on the essence typically consider looking over the prevailing state of concerns vis-a-vis good governance. In observing the current state of affairs, we inquire the question about how much good governance is at all possible. In reply to this question, the importance is engaged in good governance’s interconnections with the formation of fresh from of democracy, reinforcement of bureaucracy, combating corruption and rising civil society participation viewpoints.

The notion of “good governance” implies the special place given to the State. Such a model is defined by the effectiveness of certain guarantees such as the independence of the judiciary, the correct and fair management of expenditure but also administrative transparency. Indeed, the latter depends on the sincerity of those involved in public action, on the one hand, and the constant dialogue between the public authorities and the public, on the other hand. The purpose of this intervention is to demonstrate that the realisation of the model of “good governance” is based, above all, on the existence of an administration that fully understands the requirements of administrative transparency. The two pillars of “good governance” would thus be the foundations of the principle of transparency: communication with citizens and their participation in the process of the decision-making process.

Dari hasil penelitian ini menunjukan bahwa penerapan prinsip-prinsip good governance di Kantor Distrik Merauke Kabupaten Merauke sudah optimal yang di lihat dari beberapa aspek yaitu akuntabilitas, transparansi, partisipasi, supremasi hukum. Dari segi akuntabilitas menunjukkan bahwa para pegawai Kantor Distrik Merauke sangat mempertanggungjawabkan semua hasil kerjanya. Dari aspek transparansi menunjukkan bahwa Kantor Distrik Merauke dalam hal memberikan informasi sangat terbuka karena masyarakat yang sedang mengurus surat-surat administrasi atau KTP yang belum mengetahui syarat-syarat pengurusan pegawai Kantor Distrik Merauke langsung memberitahukan informasi yang dibutuhkan masyarakat. Dari aspek partisipasi masyarakat sangat antusias dalam ikut berpartisipasi dalam penerapan good governance. Penegakan hukum yang berlaku di Kantor Distrik Merauke yakni berupa teguran-teguran yang langsung diberikan oleh Kepala Distrik. Jika pegawai yang menyalahi aturan tersebut tidak bisa di tangani langsung di serahkan kepada Sekertaris Daerah untuk ditindak lanjuti.

Abstract:
Since the 1990s the concept ‘good governance’ has become one of the most widely used in debates in development, public policy and international relations. Despite its recent prominence the concept ‘good governance’ has frequently used in different meanings and implications. Following an introduction, which includes a historiographic note on development discourse, the first part of this paper is intended to be an overview of diverse definitions, interpretations and measuring problems of good governance. The purport of the second part of this paper is to focus on whether good governance matters in development or not, the performance of good governance in Albania. This paper has argued that good governance is indispensable in Albania, because misgovernance is a great hindrance and predicament to development. The politicization of bureaucracy, judiciary, appointment, transfer and promotion in all most all offices, lack of voice and accountability, inefficiency and satisfying the vested interest fall within the purview of misgovernance
