Abstract:
L’objectif de la thèse, réalisée dans le cadre du programme HYDRES (2014-2018), est de comprendre les différents modes d’alimentation en eaux des Marais de Saint-Gond, vaste zone humide de 2 500 hectares (Marne, Grand-Est), et d’identifier comment les écoulements se répartissent au sein du bassin-versant. Ces travaux permettront également de comprendre comment les Marais de Saint-Gond s’inscrivent au sein de l’interfluve Marne/Aube. Le croisement d’approches géomorphologiques (cartographie et profils de terrasses alluviales, profils des remplissages alluviaux…) et hydrologiques (analyses hydrologiques aux stations, mesures sérielles de débits et de paramètres physico-chimique, spatialisation des rendements hydrologiques…) met en valeur des conditions d’écoulement hétérogènes au sein de l’interfluve, paradoxalement homogène climatiquement et géologiquement. Une étude des remplissages associée à une étude paléo-environnementale permet quant à elle de retracer la géométrie des remplissages mais également l’évolution de la zone humide sur les 15 000 dernières années. Enfin, l’étude diachronique permet de comprendre l’évolution des Marais de Saint-Gond sur les 200 dernières années et de mettre en évidence les raisons pour lesquelles la superficie de la zone humide diminue au fil des années
The purpose of the thesis, carried out under the HYDRES program (2014-2018) is to understand the different water supply modes of the Marais de Saint-Gond, a vast 2,500 hectare wetland (Marne, Grand-Est), and identify how flows are distributed within the watershed. This work will also make it possible to understand how the Marais de Saint-Gond fit into interfluve Marne/Aube. The crossing of geomorphological approaches (mapping and profiles of alluvial terraces, alluvial filling profiles…) and hydrological (hydrological analyses at stations, serial measurements of flow rates and physico-chemical parameters, spatialization of hydrological yields…) highlights heterogeneous flow conditions into interfluve Marne/Aube, paradoxically homogeneous climatically and geologically. A filling study combined with a paleo-environmental study allows us to trace not only the filling geometry but also the evolution of the wetland over the past 15,000 years. Finally, the diachronic study makes it possible to understand the evolution of the Marais de Saint-Gond over the last 200 years and to highlight the reasons why the area of the wetland decreases over the years

Le Madhya Pradesh offre un cas d’étude particulier, tant par la présence numérique descommunautés classées comme tribales (ādivāsī) que par le panorama culturel et social danslequel elles agissent, enrichissant le tissu des traditions différentes qui habitent cette ceinture du pays. Le témoignage d’une telle fécondité culturelle encadre le scénario socioanthropologique, ainsi que la vivacité historique qui, depuis des siècles, caractérise cette «Terre du Milieu ». L’approche comparative adoptée autour de la ritualité funéraire chez certains groups de Pardhan du Madhya Pradesh oriental a permis le développement de l’enquête dans une alternance continue et stimulante entre le savoir ancien de la tradition et culture royales gond (Rāja Gond) ‒ dont les Pardhan sont les premiers témoins et dépositaires ‒ et le niveau de pénétration de l’hindouisation conçue et qui va modifier les expériences de la dévotion et les pratiques du deuil. Sous cet aspect, la progression de l’enquête a suivi une évolution que nous définirions circulaire : du contexte urbain de Bhopal à celui rural des villages d’origine des districts de Mandlā et Dindori, le cadre ethnologique qui en est dérivé n’a pu se soustraire à la relation entre ces deux implantations. C’est à partir de la « culture funéraire» que nous avons commencé à appliquer notre regard sur les implications sociales mises en action pendant ce«perfectionnement » (saṃskāra) terminal. L’analyse des interrelations Gond-Pardhan dansl’Inde centrale nous a fourni l’occasion pour reconstituer un imaginaire culturel partagé, qui encore résiste, et entamer ainsi une réflexion sur d’autres aspects apparemment moinsévidents : les relations de parenté et de lignage face aux processus de migration etd’urbanisation, ou les changements et les interactions entre les catégories de « tradition » et « modernité », les discours sur l’identité indienne/hindoue et le concept d’indigénéité. Nos terrains se sont enrichis d’un travail comparatif nécessaire, où le dialogue entre les lieux impliqués a tracé des coordonnées significatives dans la lecture de la ritualité funéraire, actualisant la thématique du pluralisme social, celle de la cohabitation avec les formes régionales de ce qui est considéré, dans l’Inde d’aujourd’hui, comme l’hindouisme classique. Des conceptions cosmogoniques et thanatologiques des Pardhan, notre enquête s’étend au rapport caste-tribu dans le contraste de milieux urbain-rural et du concept de «glocalisation » avec les redistributions qu’il pilote
Madhya Pradesh is a singular case, both because of the high number of inhabitants belongingto communities classified as tribal (ādivāsī), and because of the cultural and social variety present and which enriches the fabric of the different traditions occupying this part of the country. What remains of this great cultural fecundity, along with the historical intensity with which this “Middle Land” has been shot through for centuries, both provide a favorable setting for the socio-anthropological scenario. The comparative approach to funerary rituality amongst some Pardhan groups of Eastern Madhya Pradesh has made it possible to pursue the study by constantly switching, in a very stimulating way, between classical knowledge of royal Gond tradition and culture (Rāja Gond) on the one hand ‒ of which the Pardhan are the main witnesses and bearers — and, on the other hand, the level of penetration of Hinduization which will modify the experiences of devotion and the practices of mourning. In this respect, the study developed in a way that would be qualify as circular: from the urban context of Bhopal to the rural context of the home villages in the Mandlā and Dindori districts, the ethnological framework that has been derived was forced to come to terms with the relationship between these two sites. It is from the “funerary culture” that this research started to examine the implications of the social as it is implemented during this final “refinement” (saṃskāra). The analysis of Gond-Pardhan interrelationships in central India provided us with the opportunity to find a shared cultural imaginary, which still resists, and for embarking on a reflection on other aspects which are apparently less obvious : the impact of the migration and urbanization processes on kinship and clan relations, or the changes to and interactions between the categories of “tradition” and “modernity”, the discourses on Indian/Hindu identity and the concept of indigeneity. Our field survey was enhanced by necessary comparative work, in which the dialogue between the places involved traced out significant coordinates in the reading of funerary rituality, by actualizing the theme of social pluralism, that of cohabitationbetween regional forms of what is considered, in today’s India, as classical Hinduism. From the cosmogonic and thanatological conceptions of the Pardhan, our study intersects with thetheme of caste-tribe relation in the contrast of urban-rural environments, as well as with the concept of “glocalization” and the re-distributions that it directs

Syftet med denna uppsats är att undersöka hur religiösa teman manifesterar sig i TV-serien Supernatural (2005 ff.), och i vad mån dessa teman motsvarar en "banal religion". Fyra scener ur serien har analyserats med avseende på dess tematik och estetik för att fastställa hur Supernatural har anpassat berättelsen om Kain och Abel samt skapelseberättelsen till en modern miljö med övernaturliga inslag. Studien påvisar att serien använder sig av religiösa berättelser för att skapa narrativ som inte behöver beaktas som religiöst av åskådaren. Supernatural har hämtat fragment från bibliska berättelser och anpassat tematiken till seriens handling och genre men en viss symbolik finns fortfarande kvar och på sätt kan dess tematik och estetik kopplas till en banal religion.

Abstract:
Recent trends in crusade historiography depict the Frankish participants of the First Crusade as acting out of piety, while their Norman counterparts remain as impious opportunists. This thesis challenges this prevailing point of view, arguing that the Norman crusaders met the same standard of piety as the Franks. To support my theory, I looked at four different facets on the question of Norman piety, dividing them up into chapters of my thesis. In the first chapter, there is a brief discussion of the current portrayal of the Normans in modem crusade historiography. In the next chapter, I established what piety meant and how it was demonstrated by Christians of the 11th and 12th centuries. This includes an examination of relevant monastic charters, which provide evidence that the Normans had strong ties to the Papacy prior to the expedition to the East. The third chapter is a short summary about the developments leading to the First Crusade, and the standard of piety set by Pope Urban II. In the fourth chapter I examine the chronicles of the First Crusade and their characterization of the crusaders, both Norman and Frank, to see if the crusaders met the pontiff's standard. I conclude that the primary accounts depict the Normans as no different from their Frankish co-religionists, with both groups acting out of piety as well as ambition. The actions of a Norman knight, Bohemond, and a Frankish crusader, Raymond of Toulouse, exemplify this fact. The comparison of these two, as well as the rest of the crusade leaders, demonstrate that the Norman crusaders were driven by a complex and sometimes conflicting mix of pious and secular motivations, no different from their Frankish counterparts. The armies of soldiers fighting in the First Crusade in response to Pope Urban II's call to retake Jerusalem were composed of a variety of cultural groups from Western Europe. The argument over what motivated these men to become armed pilgrims, to travel long distances to strange lands, to fight and most likely die, began with the accounts of the eyewitnesses and continues to the present day. Early on the distinction was made between the pious Franks and the materialist Normans. Some Medieval chroniclers portrayed the Norman crusaders as interested only in amassing land and power, rather than fulfilling their religious vow. Even in recent historiography, the traditional interpretation of the Norman role in the First Crusade is not one of piety, but rather of opportunism - to use the conflict as a springboard for expansion into Byzantine and Muslim lands. This depiction is in stark contrast to the ongoing reexamination of the Frankish crusaders, who some crusade historians see as having a deep religious motivation. The Normans remain as the standard bearer of the pre-revisionist interpretation of crusader motives - for gold and glory, but not for God. However, examination of the evidence does not bear this distinction out. Instead of greed, a pattern of pious acts emerges performed by the families of the prominent Norman crusaders or in the case of Bohemond of Taranto, the crusaders themselves. The Normans who took up the cause for crusade were as conventionally pious as the Franks and other Europeans, exposing the falsehood of their historical portrayal as impious opportunists.

Teaching Excellence Awards have raised the profile of teaching as a scholarly project. There are however a number of questions about what constitutes teaching excellence and how ‘excellence’ is understood in current higher education. In a post-colonial South Africa, where significant injustices permeate our society, we question whether excellence can be understood in a generic manner. Furthermore, we argue that as universities are a public good, teaching excellence needs to explicitly attend to the ways in which universities contribute to broad goals of transformation and inclusivity. We analysed data from the national Teaching Excellence Awards and 13 South African universities’ awards to interrogate the discourses that underpin ‘excellence’ in this context of social inequality. We found that while the awards have gone some way to enhancing the position of teaching in institutions, ‘excellence’ was largely articulated in fairly generic ways which failed to take into account the enablements and constraints of the discipline and the institution. Furthermore, the guidelines and criteria privilege a decontextualised notion of excellence that seeks a ‘gold standard’ and validates performativity, rather than a contextualised response to the needs of the students.

The surviving fragments of Numenius' On the Good show the progression of a discernable argument; the dialogue as a whole deals with the search for a deeper understanding of the Form of the Good that is discussed in Plato's Republic. Fragment 1a provides a statement of method that governs Books 1-3. Book 1 attempts to use dialectical reasoning to reconstruct the "arguments" (logoi) of Pythagoras. Book 2 attempts to find confirmation of these arguments in the Platonic dialogues. Book 3 attempts to find further confirmation in the traditions of the "peoples of good repute." Fragment 9, taken from Book 3, gives a novel telling of the Jewish story of the Exodus, and is carefully constructed so as to be in conformity with Plato. It is best read as an allegory for the interaction of God and Matter. Book 4 is lost, but likely treated the necessity of a lower creator god beneath the highest god who is "free of labor." Book 5 introduces the Three Gods, who should be understood as the highest god, and two aspects of the lower god: a contemplative aspect and a creative aspect. Book 6 ties together the themes of the dialogue as a whole, and concludes that the Good is God.

With few exceptions, the Peruvian Civil Code leaves him unprotected. In this article, the author evaluates the specific solutions contained in the Peruvian Civil Code; analyzes the answers that foreign legislations present; and, finally, proposes a solution to protect the third parties in good faith who acquire rights from an apparent owner.

Good grapes are required to make good wine. Quality wines start in quality vineyards. Vineyard design, installation, and operation, including site location, trellis options, vine selection, and canopy management, along with when to harvest are discussed. While winemaking is the final phase in the pursuit of the winemaker's passion, it is but a simple formula. The beginning of a good wine is in a good vineyard. This study includes a financial projection for a 10-acre vineyard as well as for starting an onsite, complementary sized winery. Even though many small-to-medium vineyards-to-wineries have started over the last decade, the reason to enter into this type of business is not profit, but passion. Profits are relatively small for the time and labor investment, but the unique wine creations that result are amazing, for the winemaker and the one who enjoys the result.

This thesis is about a journey that begins as an investigation into "good citizenship", develops into an analysis of the meaning of "good", and then evolves into an exploration of issuesc oncernedw ith the nature of "good research". In essence,t he thesis can be split into two interlinked parts. Both "halves" serve a dual purpose in that they represent findings and data in the journey. The first "half' explores the theme of "good citizenship" within the context of the cross-curricular themes. It adds to our understanding of these issues by demystifying the ideological tensions existing within and between guidance documentation suggested by the National Curriculum Council to deliver the "whole curriculum" for English and Welsh schools after the 1988 Education Reform Act. These findings later serve as data in providing a context from which to reinterpret and advance our understanding of "good research". The epiphany in this journey occured when the meaning of "good" in "GOOD citizenship" was placed under scrutiny. In discovering that "good" has a multifarious meaning, which is not reducible to a single definition, the substantive focus of the thesis changed. This change is reflected in the upper and lower case lettering displayed within the title. By deemphasising the importance of "good" in "good RESEARCH", a paradigmatic shift in thinking is symbolized. The second "half' of this thesis investigates the nature of "good research" and makes two contributions to our knowledge of interpretive research. Using three perspectives of a single set of data as a working apparatus, the philosophy of Gadamerian (1979) hermeneutics is explored and taken beyond our current understanding. Part of this exploration involves applying the criteria of authenticity and coherence to the research. However, in discovering the inadequacy of these predetermined guidelines, the idea of situationally derived criteria is developed. Finally, it is suggested that the criteria for judging the quality of research can never be determined in advance of meaning coming into being. Instead, such criteria are contextually bound and can only be seen as post-hoc rational guidelines.

Abstract:
This thesis discusses the progress made towards a formal total synthesis of triptolide, a naturally occurring diterpenoid triepoxide molecule. Isolated from a Chinese vine, triptolide features some interesting structural characteristics and has demonstrated a broad range of interesting medicinal effects. It has demonstrated remarkable cytotoxicity against a number of cancer cell lines, immunosuppressive activity, and reversible male sterility. This biological activity has made it a target of a number of total syntheses spanning from 1980 to 2010. Gold-catalyzed transformations are an emerging field in synthetic organic chemistry, but their efficacy and potential uses are gaining much recognition among the synthetic organic community. Our research group is extremely interested in the applications of such gold-catalyzed organic transformations in natural product synthesis. Here, we discuss our investigations towards accessing the tetracyclic core of triptolide using a gold-catalyzed cyclization cascade reaction. We explored a number of synthetic routes towards a common linear precursor, and our successes and failures are discussed herein. We also report numerous unsuccessful efforts towards an oxidative gold-catalyzed cyclization cascade to form the tetracyclic core of triptolide. Finally, we investigated the use of a photocatalytic radical cyclization cascade to access the desired core. We report some promising preliminary results, and this study is ongoing in the Barriault group.

Abstract:
This thesis examines conflict within a UK Black Majority Church. It uses personal observation and journals, with the work of academic historians of the Black churches, to establish that Black Majority Churches have a tendency to conflict that is usually unacknowledged yet often pervasive and damaging. The thesis locates this within a Black cultural history (almost entirely untold in the academy until after the present author’s schooling ended) that involves deep-seated past causes for present conflict among post-colonial Christians. The thesis then proposes a model for the pastoral analysis, practical management, and spiritual resolution of conflict. The key methods for this (drawing on psychology and counselling as well as theology) are autoethnography, transpersonal analysis and pastoral journal records. The final stage of the pastoral model is resolution by scriptural teaching and active faith in the Holy Spirit; key passages of scripture show that conflict has been crucible for making Christianity, and has often been integral to the discovery and transmission of God’s word. Finally, the thesis offers a training plan for Pastors in the CoGoP – a plan combining the practicalities of work in that church with the historical and theological conclusions drawn from the present academic research.

Abstract:
Global raw material extraction has accelerated since the 1950s, causing resource depletion, ecosystem degra- dation, pollution, and climate change. To reduce such impacts, the economic drivers of material use must be addressed. Although economic growth often drives material use to increase, this increase can be counter- acted by dematerialization. This study explores whether dematerialization can achieve sustainable material footprints in Sweden by 2050, considering different scenarios of economic growth. Environmentally extended multi-regional input-output analysis was used to calculate the Swedish material footprint from 1995 to 2011. Structural decomposition analysis was used to quantify how much dematerialization, economic growth, con- sumption and trade patterns, and population drove the changes in the material footprint. Based on previous literature, 6 tons of materials per person was used as a sustainability target in three backcasting scenarios, reflecting degrowth, growth, and growth with ambitious shifts towards less material intensive consumption and trade patterns, respectively. The Swedish material footprint increased from 211 to 279 Mt from 1995 to 2011. While relative dematerialization did occur, economic growth caused material use to grow. If the economy degrows, the 2050 target can be reached with dematerialization rates of 0.7 times the previous rates. To reach the target under continued economic growth, dematerialization rates must increase by a factor of 1.8-2.7, depending on the extent of shifts to less material intensive consumption and trade patterns. Although further research is needed to examine whether such unprecedented rates of dematerialization are feasible, the results suggest that degrowth must be considered.
Råvaruutvinningen i världen har ökat kraftigt sedan 1950-talet, vilket leder till resursbrist, degraderade ekosystem, föroreningar och klimatförändringar. För att minska den miljöpåverkan behöver drivkrafterna bakom samhällets materialanvändning angripas. Ekonomisk tillväxt driver på råvaruutvinningen, men resurseffektivisering kan minska den. Den här studien undersöker hur resurseffektivisering,dematerialization på engelska, kan uppnå en hållbar materialanvändning i Sverige 2050, beroende på hur den ekonomiska tillväxten utvecklas. Data på nationella och internationella ekonomiska flöden och deras miljöeffekter, environmentally extended multi-regional input-output data på engelska, användes för att räkna ut Sveriges materialanvändning ur ett konsumtionsperspektiv från 1995 till 2011. Strukturell dekomponering användes för att kvantifiera hur mycket resurseffektivisering, ekonomisk tillväxt, konsumtions- och handelsmönster och befolkningsstorlek drev förändringarna i materialanvändningen. Baserat på den befintliga litteraturen användes 6 ton material per person som ett hållbarhetsmål i tre scenarier, som representerade nerväxt, tillväxt och tillväxt där konsumtionen samtidigt blir mindre materialintensiv. Den svenska materialanvändningen ökade från 211 till 279 Mt mellan 1995 och 2011. En viss resurseffektivisering skedde under perioden, men den ekonomiska tillväxten bidrog till att materialanvändningen ändå ökade. Om ekonomins storlek minskar kan hållbarhetsmålet nås 2050 med en resurseffektiviseringstakt som är 0,7 gånger takten från 1995 till 2011. För att nå målet med ekonomisk tillväxt behöver takten i resurseffektiviseringen öka med en faktor mellan 1,8 och 2,7, beroende på hur stora skiftena till mindre materialintensiva konsumtions- och handelsmönster är. Mer forsknings behövs för att undersöka huruvida en så snabb resurseffektiviseringstakt är realistisk, men resultaten visar att nerväxt kan vara ett alternativ.

För att höja kvalitén på vården, bör personalen lyssna på patienterna som är vård konsumenterna. Syftet är att studera god omvårdnad ur ett patient perspektiv, för att kunna anpassa omvårdnaden till patienternas behov utifrån befintliga resurser på en ortopedavdelning. Studien utfördes i samverkan mellan Högskolan i Skövde och ett väst-svenskt sjukhus där ingick studier med sjuksköterskor och undersköterskor på samma ortopedavdelningar. Författaren ville se om de tyckte som patienterna. Denna studie är gjord med kvalitativ ansats metoden är innehållsanalys. Det genomfördes 12 intervjuer med öppen frågeställning om vad patienterna tycker är god omvårdnad. I intervjuerna framkom att personalens attityd och beteende var viktigt för informanterna. Det handlade om att patienterna vill att personalen ska vara hjälpsam, att vara trevliga och humoristiska. De ska också vara omhändertagande, empatiska och engagerade. Dessutom ge kontakt, stöd, uppmuntran och inge förtroende samt ha ett gott handlag. Patienterna uttryckte också att de ville bli tillfrågade, få information, att vården ska vara individuell och se till deras behov. När detta är känt så behöver personalen få denna kunskap. Om patienterna får en god omvårdnad så höjs kvaliteten på vården bara genom att personalen beter sig på ett visst sätt utan extra kostnad.


In order to raise the quality of the nursing care it is important for the nursing staff to listen to the patients described experiences of their care. The aim of this study was to find out what the patients in an orthopaedic ward believe is good nursing care in order to adjust the care accordingly and within the resources. It was a joint study between the Nursing College of Skövde and a local hospital in western Sweden. Licensed practical nurses and registered nurses were interviewed in the same orthopaedic ward. The authors’ intension was to see if the they agreed with the patients. The method chosen was qualitative. 12 patients were interviewed with open ended questions about what they thought was good nursing care. In the result of the study they all described how the attitude and behaviours of the staff was of the utmost importance. They wanted the staff to be helpful, nice and have a sense of humor. They should also be caring, empathetic and involved. They should give support, contact, encouragement, trust and be capable. The patients also stated that they wanted to be consulted about their care, given information and listened to. They wanted the care to be personal, with an understanding of their individual needs. This knowledge about the patients’ views needs to be shared with the nursing staff. Staff's behaviour and ability to give good nursing care, as described by the patients, raises the quality of the care and doesn't have to cost an extra penny.

Fientliga företagsförvärv har under en lång tid varit en del av den globala finansmarknaden och är numera inte främmande för de svenska aktörerna. Ett företagsförvärv blir fientligt när bolagets styrelse råder aktieägarna att avslå det framlagda budet. Är budet intressant för aktieägarna, som ofta strävar efter att maximera sin kapitalvinst, kan det dock lätt uppstå en intressekonflikt inom bolaget då styrelsen, till skillnad från aktieägarna, är snarare intresserad av att behålla sin makt och anställning. Detta kan resultera i att styrelsen blir frestad att vidta åtgärder för att förhindra uppköpet.   I samband med fientliga uppköpserbjudanden har det på den amerikanska aktiemarknaden utarbetats en rad försvarsåtgärder som kan vidtas av bolagsstyrelsen i syfte att försvåra eller förhindra ett företagsförvärv. På den svenska aktiemarknaden är vidtagande av åtgärder som har till syfte att förhindra eller försvåra att ett uppköpserbjudande framläggs eller genomförs icke tillåtna enligt 5 kap. 1 §             lagen om offentliga uppköpserbjudanden på aktiemarknaden (LUA). Motiveringen till detta förbud framkommer i bland annat Aktiemarknadsnämndens uttalande AMN 2005:47:”ett offentligt erbjudande anses vara en angelägenhet mellan målbolagets aktieägare och budgivaren, varför målbolagets styrelse inte ska tillåtas försämra förutsättningarna för att ett erbjudande lämnats”. Av denna anledning har styrelsen i ett målbolag som är ett aktiebolag en relativt svag position, då den beslutsfattande makten är hos de enskilda aktieägarna vid exempelvis antagandet av ett framlagt bud och hos bolagsstämman avseende vidtagande av eventuella försvarsmetoder. Dock har det genom AMN:s uttalanden framkommit i en rad praktiska fall att målbolagets styrelse hittat möjligheter att agera och i viss mån kringgå förbudet.   Uppsatsen är en komparativ studie med den svenska och amerikanska rättregleringen i fokus. Paralleller och samband dras även mellan det svenska, europeiska och engelska systemet. Syftet med arbetet är att undersöka svenska företagsledningarnas möjligheter och handlingsutrymme vid tillämpning av internationella försvarsmetoder för att avvärja ett oönskat uppköpserbjudande. I uppsatsen undersöks även de åtgärder som kan vidtas i ett preventivt syfte.   Möjligheten till genomförandet av ett bolagsuppköp är ett nyckelmoment för skapandet av en effektiv värdepappersmarknad där svaga bolag upphör att existera och starka bolag har utvecklings- och tillväxtmöjligheter. Att avgöra vad som stämmer överens med god sed kan dock bli problematiskt, då regleringen på området är oerhört spridd och i viss mån inkoherent. Trots dessa svårigheter har det i praktiken genomförts ett antal företagsuppköp som har visat på att tillämpningen av försvarmetoder är i viss utsträckning möjlig om den går att motivera genom att bolagets eller/och aktieägarnas intressen tillgodoses. Enligt aktiebolagslagen (ABL) är föremålet för aktiebolagets verksamhet att ge vinst till fördelning för aktieägarna. Samtidigt är aktieägarnas förtroende centralt för väl fungerande värdepappersmarknader. En mer omfattande rätt för bolagsstyrelsen i målbolaget att fatta beslut om försvarsåtgärder skulle kunna skada dessa grundläggande ändamål med ABL och den börsrättsliga regleringen. På så sätt skulle en betydligt större makt hos bolagsstyrelsen kunna ha en skadlig effekt, då det är aktieägarnas vinster och förtroende som bör prioriteras. Genom att analysera samspelet mellan de bolagsrättsliga och börsrättsliga principerna och relevanta praktiska avgöranden går det att se att den nationella regleringen är konstruerad på bästa möjliga sätt för att upprätthålla en god sed på den svenska finansmarknaden, trots sina potentiella brister i sammanhanget.
Hostile takeovers have for a long time been a part of the global financial market and are nowadays not an unknown phenomenon on the Swedish stock market. A takeover attempt becomes hostile when the board of directors of the target advises the shareholders to reject the submitted bid. That particular situation can, however, easily become the reason for conflict of interests within the company. The bid can be valuable for the shareholders, who primarily seek ways to maximize their profit at the same time, as the members of the board of directors desire to keep their employment and position within the company. The board can therefore as a result be willing to take action in order to prevent the takeover.   During the mid-20th century, due to a takeover-wave, the American stock market developed a series of defence measures that could be used by the board in order to impede or prevent an acquisition. However, measures that are intended to prevent or impede a takeover offer are prohibited on the Swedish stock market under Ch. 5 § 1 in the Act on Public Takeover Offers. The justification for this prohibition is found in, inter alia, the Swedish Securities Council's (Aktiemarknadsnämnden) statement AMN 2005: 47 where they indicated that a public offer is considered to be a matter between the target company's shareholders and the bidder, why the offeree company should not be allowed to impair the prerequisites for an offer submitted. For this reason, management has a relatively weak position in Swedish corporations, since the decision-making power is not with the board but with the separate shareholders when it comes to accepting a potential bid or the shareholders’ meeting of the corporation when a decision must be made if measures should be enact in order to prevent a bid. However, the boards of directors in some target companies have found opportunities to act and to some extent circumvent the ban posed in the Act on Public Takeover Offers.   The thesis is a comparative study with Swedish and American legal regulations in focus. Parallels are also drawn between the Swedish, European and English systems. The aim is to investigate the ability of the board of directors in Swedish corporations to use different defence methods to fend off an unwanted takeover bid. The paper also examines the measures that can be taken before the bid and as a result have a preventive function.   The possibility of implementing a company takeover is a key element for the creation of an efficient financial market in which weak companies cease to exist and strong companies have development and growth potential. A determination on what actions can be consistent with good practice can be problematic, since the regulations in this area are extremely widespread and somewhat incoherent. Despite these difficulties, the legal practice in this area has shown that the application of the defence methods is to some extent possible if the board of directors focus on supporting the will to defend the company and / or shareholder interests. To give the board of directors extended powers could have a detrimental effect on profits and trust. By analysing the interaction between the principles in company law and securities law as well as some relevant decisions by the Swedish Securities Council, it is possible to see that the Swedish national regulation is designed in the best possible way to maintain good practices on the Swedish stock market despite some shortcomings.

ENGLISH ABSTRACT: This investigation comprised the synthesis and characterisation of new Au(I) phosphonium ylide complexes and other compounds formed during coordination reactions. These complexes could exploit the synergism between two pharmacologically active substances (gold complex unit and phosphorus ylide) to furnish an even more active substance. Four phosphonium salts were prepared, [C6H5CH2PPh3]Br (1), [Ph3P(CH2)3PPh3]Br2 (2a), p-[{Ph3PCH2}2C6H4]Br2 (3a) and m- [{Ph3PCH2}2C6H4]Br2 (4a), by reacting PPh3 with the corresponding alkylbromides. The 13C and 1H NMR spectra of the compounds 1 – 4a indicated that many of the nuclei are magnetically inequivalent. The aromatic units in PPh3 are normally identical, but multiple, overlapping signals proved that the corresponding ortho, meta and para carbon and proton nuclei are in magnetically different environments from each other. Single crystal structures of salts 3a and 4a were determined. Different methods were followed to deprotonate the phosphonium salts to afford the corresponding ylides and to coordinate the ylides to gold precursor compounds. Most of the reactions yielded inseparable mixtures of products and pure compounds could not be isolated in large enough quantities for characterisation by all physical methods. Sufficient crystals for structure determination by X-ray diffraction were obtained. The product mixtures were characterised by 1H, 13C and 31P NMR spectroscopy and mass spectrometry. Characteristic downfield chemical shift changes after coordination of the ylides to Au(I) were observed for the carbon and phosphorus nuclei, while the protons displayed upfield shifts. Reaction of (C6F5)Au(tht) with the salts 1 – 4a, and subsequent deprotonation yielded the gold(I) ylide complexes [C6H5CH(AuC6F5)PPh3] (5), [{Ph3PCH(AuC6F5)}2CH2] (6), p-[{Ph3PCH(AuC6F5)}2C6H4] (8), and m- [{Ph3PCH(AuC6F5)}2C6H4] (9). The crystal and molecular structures of compounds 5 and 9 were determined. Deprotonation of 4a with n-BuLi, followed by reaction with (C6F5)Au(tht) yielded complexes 9 and [{Ph3PCH2}2C6H4][BrAuC6F5]2 (10). The crystal structure of compound 10 was determined. Two aurocyclic compounds, [μ- {(Ph3PCH)2CH2}2Au2][BF4]2 (12) and [μ–{(Ph3PCH)2C6H4}2Au2][BF4]2 (13) were synthesised by deprotonating salts 2b and 3b with n-BuLi and subsequently reacting the corresponding bisylides with ClAu(tht). Reaction procedures in which Ag2O was used as deprotonating agent for the phosphonium salts 2a, 3a and 4a, yielded mixtures of products. Single crystals of complexes m-[Ph3PCH(AuC6F5)C6H4CH3] (14), [C6F5Au(tht)] (15) and [(C6F5)2Au][(Ph3PCH2)2C6H4] (16) were isolated from the reaction mixtures and subjected to X-ray crystal structure determination. The molecular structure of 15 exhibited unusual aurophilic interactions and represents the first example of a linear gold chain in which the gold···gold distances systematically alternate between 3.13Å, 3.31Å and 3.20Å. Salt 2b was reacted with Ph3PAu(acac) to afford the desired compound, [{Ph3PCH(AuPPh3)}2CH2](BF4)2 (19), along with [CH3C(O)C(AuPPh3)2C(O)CH3] (17) and some byproducts. Compound 17 was characterised by single crystal Xray diffraction. The fluorobiphenylgold(I) complexes, 4,4’-[(AuPPh3)2C12F8] (21) and 2,2’- [(AuPPh3)2C12F8] (22) were synthesised by reaction of ClAuPPh3 with the lithiated 2,2’-dibromooctafluorobiphenyl and 4,4’-dibromooctafluorobiphenyl respectively. The molecular structure of 21 revealed that one of the C–Au–P bond angles deviates from linearity by 12.5°, probably as a result of π-stacking of the tetrafluorophenyl rings and steric requirements of the bulky PPh3 units. The other C–Au–P bond angle is linear [177.9(3)°].
AFRIKAANSE OPSOMMING: Hierdie studie behels die sintese en karakterisering van nuwe fosfoniumylied goud(I)-komplekse en ander verbindings wat gedurende koördinasiereaksies vorm. Sulke komplekse kan sinergisme tussen twee farmakologies-aktiewe entiteite (goud(I) en fosfoniumylied) om ʼn meer aktiewe verbinding te vorm meebring. Vier fosfoniumsoute is berei, [C6H5CH2PPh3]Br (1), [Ph3P(CH2)3PPh3]Br2 (2a), p- [{Ph3PCH2}2C6H4]Br2 (3a) en m-[{Ph3PCH2}2C6H4]Br2 (4a), deur PPh3 met die ooreenstemmende alkielbromiedes te reageer. Die 13C- en 1H- KMR-spektra van dié verbindings toon dat ʼn aantal kerne in aromatiese ringe magneties onekwivalent is. Normaalweg is die koolstowwe in PPh3-eenhede ekwivalent, maar meervoudige, oorvleuelende pieke het nou getoon dat die ooreenstemmende orto-, meta- en para-koolstof sowel as die ooreenstemmende protonkerne in verskillende magnetiese omgewings voorkom. Die kristalstrukture van die soute 3a en 4a hierbo is met behulp van X-straal tegnieke bepaal. Verskillende metodes is gevolg om die fosfoniumsoute te deprotoneer na die ooreenstemmende yliede en om die yliede dan aan goud-bevattende uitgangstowwe te probeer koördineer. Die meeste reaksies het nie-skeibare mengsels gevorm en enkelprodukte kon nie in groot genoeg konsentrasies geïsoleer word om hulle afsonderlik te karakteriseer nie. Kristalle vir X-straal kristalstruktuur bepalings is verkry. Die produkmengsels is gekarakteriseer met behulp van 1H-, 13C- en 31P- KMR-spektroskopie en massaspektrometrie. Karakteristieke veranderinge in chemiese verskuiwings na laer veldsterktes vir die koolstof en fosfor kerne is waargeneem na koördinasie van die yliede aan Au(I), terwyl die protone na höer veldsterktes verskuif het. Reaksieprosedures waarin Ag2O vir deprotonering van die fosfoniumsoute 2a, 3a en 4a gebruik is, het tot mengsels van produkte aanleiding gegee. Enkelkristalle van komplekse [Ph3PCH(AuC6F5)C6H4CH3] (14), [C6F5Au(tht)] (15) en [(C6F5)2Au][(Ph3PCH2)2C6H4] (16) is geïsoleer uit die reaksies en kristalstruktuurbepalings is uitgevoer. Historical scholarship has shown how the state and media mobilized women into "men's" roles including soldier and industrial worker during World War II, but little work has been done on the ways in which quasi-state organizations such as the United Service Organizations (USO) mobilized them to perform "women's" work. In the United States, the USO offered wholesome recreation to millions of servicemen outside of camp in their off duty hours. USO hostesses conducted work that helped to maintain the role of the virtuous woman in this time of crisis. Senior hostesses, married women over age 35, mothered servicemen by sewing insignias on their uniforms, and by baking sweets and making sandwiches for them. Senior hostesses also selected junior hostesses and chaperoned their interactions with servicemen. Junior hostesses, single women ages 16 to 25, comforted servicemen by serving as compliant dance and game partners, as well as eager listeners. The USO functioned as a normative force that emphasized women's domesticity and sought to contain female sexual activity to marriage. The USO assumed that white middle-class women were inherently sexually respectable and feminine. It groomed these "good girls" to represent the USO alongside a federal crackdown on female prostitution and the arrest of thousands of pickups girls suspected of passing venereal disease to servicemen. Junior hostesses, in turn, used the USO to explore a safe form of sexual expressiveness at the same time that they contributed their basic sexual services to the federal government and military. These institutions were the primary benefactors of senior and junior hostesses' unpaid morale work. Their work helped to humanize the military experience for servicemen. This project investigates race and class issues within the USO, along with sexuality and gender, because these categories were paramount in the hostess selection process and interactions between servicemen and hostesses. USO publications and government records form the basis of the archival research for this project. This project also draws on 35 oral interviews conducted by the author with former hostesses, and questionnaires from an additional 35 former hostesses.

Abstract:
This research examined the moderators of judgement accuracy in three studies. Study 1 tested three moderators of empathic accuracy assessed during close relationship interaction: (1) the ability of the judge, (2) the readability of the target, and (3) the level of acquaintanceship. The design involved multiple perceivers judging multiple targets. Fifty dating couples reviewed videotapes of their prior problem-solving discussions and described both their own on-line cognitions and those of their partners. Fifty friends of the couples and 50 strangers later inferred the on-line cognitions of the same dating couples while observing the videotapes of their interactions. In addition, all three groups observed another videotape of two married couples' problem-solving interactions (strangers to the entire sample) and attempted the same empathic accuracy task. As predicted, the results revealed evidence for the good judge and good relationship, but not the good target. Increased relationship closeness was associated with higher accuracy. Both attributional complexity and verbal intelligence predicted empathic performance (but at different levels of acquaintanceship) and women were consistently superior to men. Several mediational models were tested, the results of which showed that female partners' problem-specific disclosure to the friend mediated the link between (a) female partners' attributional complexity and their empathic accuracy, and (b) friends' closeness to the female partner and their empathic accuracy.

Vården lutar sig mot det nationella vårdprogrammet för palliativ vård samt International Council of Nurses, ICN. Sjuksköterskans roll och uppgifter inom vården beskrivs där även de fyra hörnstenarna belyses. Syfte: Att belysa sjuksköterskornas upplevda svårigheter vid vård av patienter med palliativ diagnos. Metod: Examensarbetet är en litteraturöversikt baserad på Fribergs analysmetod. Denna litteraturöversikt inkluderar tio vetenskapliga artiklar som har sökts i databaserna CINAHL Complete och PubMed. Som en teoretisk utgångspunkt har Patricia Benners teori från novis till expert valts som en diskussion i resultatdiskussionen. Resultat: Sjuksköterskornas upplevda svårigheter av att vårda patienter med en palliativ diagnos resulterade i fyra huvudteman i litteraturöversikten; kommunikation, närstående och relation, vårdteamet samt kunskap och erfarenheter. Diskussion: Resultatet i litteraturöversikten har diskuterats utifrån Benners teori. Sjuksköterskornas upplevda svårigheter belystes genom fyra teman – kunskap och erfarenhet, närståendestöd, kommunikation mellan kollegor och gentemot patienten samt kultur som upplevd svårighet.
Background: Palliative care for health professional means trying to achieve the maximum dying person's quality of life and ease suffering. The palliative care for health professionals means to try to achieve the dying person's maximum quality of life and alleviate suffering. The care inclined towards the Swedish national health care program for palliative care and the International Council of Nurses, ICN. The nurse's role and tasks in health care are described where even the four cornerstones elucidated. Aim: To elucidate the nurses perceived difficulties in nursing patients with palliative diagnosis. Method: The thesis is a literature review based on Friberg's analysis. This literature review includes ten scientific articles that have been searched in the databases CINAHL Complete and PubMed. As a theoretical base, Patricia Benner's theory from novice to expert was selected as a discussion of the results discussion. Results: The nurses perceived difficulties of caring for patients with a palliative diagnosis resulted in four main themes in the literature; communication, family and relationship, the health care team as well as knowledge and experience. Discussion: The results of the literature review are discussed based on Benner's theory. The nurses' perceived difficulties irradiated by four themes – knowledge and experience, family support, communication between colleagues and towards the patient as well the culture as perceived difficulties.

Syfte: Syftet med studien är att undersöka hur kommuner förhåller sig till god ekonomisk hushållning i deras styrning, om det är någon skillnad mellan Eskilstuna kommun, Nyköpings kommun och Strängnäs kommun i förhållande till kommunallagen. Metod: Deduktiv ansats har använts i studiens framställande. Informationen har samlats in, den har analyserats och av den teoretiska referensramen och empirin har en slutsats dragits. Respondenter valdes ut genom ett strategiskt urval och dessa kontaktades via mejl. Slutsats:  Eskilstuna kommun, Nyköpings kommun och Strängnäs kommun är styrda av de uppsatta mål som kommunfullmäktige sätter. Dessa mål är direkt kopplade till kommunallagen. Genom att arbeta med mål och riktlinjer, och att ha en ekonomi i balans tillämpas god ekonomisk hushållning utifrån kommunallagen. En skillnad som kan ses mellan kommunerna är att de har olika mål vilket i sin tur leder till att en god ekonomisk hushållning uppnås på olika grunder. Gemensamt är strävan efter att uppnå alla de mål som är uppsatta av kommunfullmäktige för att följa god ekonomisk hushållning. Den stora skillnaden som finns mellan kommunerna är att Nyköpings kommun har haft svårigheter under år 2011 och år 2012 med att uppnå en god ekonomisk hushållning i deras verksamhet. Vad konsekvenserna blir av inte uppnådd god ekonomisk hushållning är lite svårare att svara på då det inte finns några riktlinjer om vad som händer. Det som framkom under studien är att det är politikerna som hålls som ansvariga för inte uppnådd god ekonomisk hushållning men att inga repressalier utdelas.
Research questions:  How to apply good financial management in municipalities control based on the Local Government Act? - Are there differences between Eskilstunas Municipality, Nyköpings municipality and Strängnäs municipality? What are the consequences if good financial management is not fulfilled? Purpose:  The purpose of this study is to examine how municipalities are related to good financial management in their management, if there are any differences between Eskilstunas Municipality, Nyköpings municipality and Strängnäs municipality in relation to the Local Government Act. Method: Deductive approach has been used in this study. The information has been collected, it has been analyzed and from the theoretical framework and empirical a conclusion has been drawn. Respondents were selected through a strategic selection and these were contacted by email. Conclusion: Eskilstuna municipality, the municipality of Nyköpings and Strängnäs are guided by the goals that the City Council sets. These objectives are directly linked to the Local Government Act. By working with the objectives and guidelines and to have a balanced economy good financial management is applied by the Local Government Act. One difference can be seen between the municipalities is that they have different goals, which in turns leads to good financial management is achieved on different grounds. The common denominator is striving to achieve all the goals set by the City Council to follow good financial management. The major difference found between municipalities is to Nyköpings Municipality has had difficulties in the year 2011 and 2012 to achieve good financial management in their economics. What consequences are not reached by good financial management is a bit more difficult to answer as there are none guidelines about what will happen. What emerged during the study is that it is the politicians who are held responsible for not achieved a good economic management, but no reprisals inflicted.

In this paper I explore the question ‘can a good manager be a good person?’ the answer is yes, no, or to a greater or lesser degree. Ultimately it depends on the ends at which the business, in which the manager works, aims towards. For these ends underpin what is ‘rational’ for how a manager should behalf. If a business’ end goal is purely profit maximisation then there is no room for a manager to take moral considerations into account, and therefore be a good person. If a business sees itself as a ‘practice’, consciously aiming to promote the social good the answer is yes, a good manager can be a good person. There are those businesses, and their managers, that fall somewhere in between these two ideal-types.

The Peruvian economy has performed extraordinarily over the last 10 years. The 2012 per capita GDP is 66 percent above that of 2002, and more than double its 1992 level. In a long term perspective, the cumulative growth of GDP per capita recorded in the last 10 years has been the strongest since 1900. This is the «Peruvian miracle». This paper aims to find the determinants of the Peruvian miracle. In theory, countries’ macroeconomic performance can be determined by two factors: i) the «good (bad) luck effect» that relates to the international context, which may be favorable or unfavorable, and ii) the «good (bad) policies effects», associated with short-term macroeconomic policies or structural reforms,which are policies that alter the current development model. The hypothesis of this work is that the Peruvian miracle of the last 10 years has much to do with good luck, and, in part, with good short-term macroeconomic policies.
La economía peruana ha tenido un desempeño extraordinario en los últimos diez años. El PBI per cápita de 2012 está un 66% por encima del de 2002 y es más del doble de su nivel de 1992. En una perspectiva de largo plazo, el crecimiento acumulado del PBI per cápita registrado en los últimos diez años ha sido el más vigoroso desde 1900. Este es el «milagro peruano». Este artículo tiene como propósito encontrar los factores determinantes del milagro peruano. En teoría,el desempeño macroeconómico de los países puede estar determinado por dos razones: i) el «efecto buena (mala) suerte» que tiene que ver con el contexto internacional que puede ser favorable o desfavorable; y ii) el efecto «buenas (malas) políticas», asociado a las políticas macroeconómicas de cortoplazo o a las reformas estructurales, que son políticas que alteran el modelo de desarrollo vigente. La hipótesis de este trabajo es que el milagro peruano de los últimos diez años tiene mucho que ver con la buena suerte y, en parte, con las buenas políticas macroeconómicas de corto plazo.

Sodek's Gold is a novel based on individuals the writer has known in the Caribbean who have been placed in fictitious circumstances. Included are social issues, conditions, and dialects found there. The main character, David Sodek, is an Englishman working in the Caribbean who discovers an ancient coin and becomes obsessed with finding more. Sodek's search is impeded by the strongarm Mostyn, but with the help of his friend Elbert he recovers an underwater cache of golden treasure. Elbert is killed. Sodek avenges Elbert's death but ultimately relinquishes the gold and himself to the sea. The theme of the work involves Sodek's obsessive personality as seen in his increasingly pedantic and destructive search, and in his unrealistic belief that money buys freedom. Included between chapters are vignettes comparing the characters and nature, and foreshadowing following events.

Fool’s Gold is a collection of handmade books that illustrate selected Grimms’ fairy tales and offer an unexpected interpretation of the actions of the heroes. Each book displays a unique cover decoration, inspired by medieval European treasure bindings. Treasure bindings incorporate dimensional decorative elements such as gems, gold or other metalwork and often depict Christ's suffering. In a similar way, Fool's Gold beautifies the suffering of the protagonists using gold leaf, glass beads and lush illustrations. A traditional hidden fore-edge painting technique is used to reveal more scenes from each story. When the pages are fanned opened, the fore-edge paintings display the gruesome revenge the perceived heroes take upon the villains.

This thesis and its corresponding art installation, Lessons from Ziggy, attempts to deconstruct the variables prevalent within several complex systems, analyze their transformations, and propose a methodology for reasserting the soap box within the display pedestal. In this text, there are several key and specific examples of the transformation of various signifiers (i.e. media-bred fear’s transformation into a political tactic of surveillance, contemporary freneticism’s transformation into complacency, and community’s transformation into nationalism as a state weapon). In this essay, all of these concepts are contextualized within the exponential growth of new technologies. That is to say, all of these semiotic developments must be framed within the post-Internet sphere.
