Full textThe doctoral research thesis "The Law in Movement. Hans Kelsen and the Macro-historical Evolution of Legal Orders" is dedicated to the complex problem of the evolutionary nature of the legal phenomenon. It is made up of three chapters. The first chapter, entitled "The Two Faces of Legal Evolution", is dedicated to the proposal and elaboration of a basic metatheoretical thesis, relating to the possibility and need to distinguish between "theories of evolution in law" and "evolutionary theories of law "as lines of research which in essentially different ways deal with legal evolution. The first chapter proceed with a brief historical-critical reconstruction of genesis, developments and success of the so called theories of evolution in law; with the analysis of the reasons that led legal scholars to the rejection of evolutionary theories of law; and, finally, with an attempt to re-evaluate the theoretical and practical-political relevance of evolutionary theories of law. The second chapter, entitled "Macro-historical Evolution of Law: the Story of an idea", is dedicated to the history of evolutionary theories of law. The objective of this historiographic section of the present research is to highlight how attempts to elaborate reconstructions of the macro-historical evolution of law cannot be limited to the nineteenth century as usually claimed by legal scholars, being thei elaboration dating back to classical antiquity and still carried out today by some scholars. The third chapter of this research is dedicated to the detailed examination of the reflections concerning the macro-historical evolution of legal orders that Hans Kelsen proposed in some works of the 1940s. The choice to proceed with this analysis derives, first of all, from the observation that an unitary reconstruction of this side of Kelsen's philosophical reflection has never been attempted. Second, still from the historiographic point of view, the analysis of the Kelsenian theory of the macro-historical evolution of the legal systems certainly proves interesting for a re-evaluation of some assumptions or prejudices related to his legal ontology and legal epistemology. Finally, the choice to proceed with this analysis derives from the belief that Kelsen's theory on the macro-historical evolution of the legal systems turns out to be rich in intuitions that still prove extremely valuable today.

Os teores de fosfato inorgânico em folhas e raízes aumentaram de forma linear em plantas de alfafa cv. Flórida 77 no estádio R8, correspondente a plantas com um a três nós com vagens verdes, quando em cultivo em solução nutritiva contendo fósforo nas concentrações 0,02, 0,10, 0,20 e 1,00 mol m^-3. A menor concentração o fósforo restringiu a expansão de área foliar e a massa seca da parte aérea e dos nódulos e resultou em uma relação entre massa seca das raízes e da parte aérea maior. O nível de suficiência de fósforo para as plantas, considerando-se os parâmetros de crescimento, foi de 0,20 mol m^-3. Os teores de amido em folhas e raízes não foram significativamente alterados pela baixa disponibilidade de fósforo (0,02 mol P m^-3). A essa concentração, a taxa de assimilação líquida do CO2 foi menor do que nas plantas dos demais tratamentos; comportamento similar teve a eficiência fotoquímica do fotossistema II, avaliada pela razão Fv/Fm e Fv/F0. Conseqüentemente, o efeito do fósforo na redução da atividade fotossintética pareceu mais relacionado com a etapa fotoquímica da fotossíntese. Para as variáveis de trocas gasosas e fluorescência da clorofila a, em plantas no estádio R8, a suficiência de fósforo foi atingida com 0,10 mol P m^-3. As plantas que cresceram sob 0,02 mol P m^-3 apresentaram um decréscimo nas atividades totais de sintetase da glutamina (GS) e de sintase do glutamato - dependente de NADH-GOGAT (NADH-GOGAT), tanto nas folhas como nos nódulos. Os resultados indicam que a GS respondeu mais do que a NADH- GOGAT aos aumentos nas concentrações de fósforo, mostrando-se a atividade das duas enzimas maior nos nódulos. A atividade do sistema GS/GOGAT em plantas de alfafa no estádio R8 foi mais pronunciada sob a concentração de 0,20 mol P m^-3, embora a suficiência de fósforo tenha sido alcançada na concentração de 0,10 mol P m^-3.
The inorganic phosphate contents in leaves and roots increased in a lineal way in plants of alfalfa cv. Florida 77 in the R8 stadium, corresponding to the plants from one to three green beans when in cultivation in nutritious solution with phosphorus at the levels of 0,02, 0,10, 0,20 and 1,00 mol m^-3. The smallest phosphorus level restricted the leaf area expansion as well as dry mass of the aerial part and nodules wich resulted in a greater ratio beetwen dry mass of the roots and aerial part. It was reached a phosphorus sufficiency at the level of 0,20 mol m^-3 for the plants being considered the growth parameters. The contents of starch in leaves and roots were not significantly altered by the lowest phosphorus (0,02 mol m^-3), to that level the rate of liquid assimilation of the CO2 was smaller than in the plants of the other treatments, similar behavior was observes about the fotossystem II photochemical efficiency, evaluated by the Fv/Fm and Fv/F0 ratio. Thus, the low phosphorus effect in the reduction of the photosynthesis seemed more related with the fotochemical way of the photosynthesis. The phosphorus sufficiency for the gaseous exchanges and chloropohyll a fluoresce was reached with 0,10 mol m^-3. The GS/GOGAT activities under 0,02 mol m^-3 was smaller in the leaves as in the nodules. The results indicate that GS answered more than NADH-GOGAT to the increases in phosphorus levels, being shown the two enzymes activity in the nodules. The activity of GS/GOGAT system in alfalfa plants in the R8 stadium was greater under 0,20 mol m^-3, although the phosphorus sufficiency has been reached in the concentration of 0,10 mol m^-3.
