Gintis argues that disciplinary models of human behavior are incompatible. However, his depiction of the discipline of anthropology relies on a broad generalization that is not supported by current practice. Gintis also ignores the work of cognitive anthropologists, who have developed theories and methods that are highly compatible with the perspective advocated by Gintis.

Abstract:
With a few incisive (and legitimate) criticisms of crucial experiments in psychology that purported to bring down the foundations of modern economics, together with a broad scholarly review that is praiseworthy, Gintis attempts to build a unifying framework for the behavioral sciences. His efforts fail, however, because he fails to break with the conventional methodology, which, regrettably, is the unifying basis of the behavioral sciences. As a result, his efforts will merely recapitulate the story of the past: interesting, provocative results that are soon overthrown because they are limited to the conditions of the experiment. Gintis is keenly aware of this limitation – and thus meets Brunswik, but fails to recognize him; this we know because he seems unaware of the fact that Brunswik said it all – and provided a detailed defense – a half century ago.

The contemporary behavioral sciences are disunified and could not easily become unified, as they operate with incompatible explanatory models. According to Gintis, tolerance of this situation is “scandalous” (sect. 12). I defend the ordinary behavioral scientist's lack of commitment to a unifying explanatory model and identify several reasons why the behavioral sciences should remain disunified for the foreseeable future.

Būtinoji gintis – tai socialiai reikšmingas reiškinys, įtvirtintas teisės sistemoje ir turintis tam tikrą istoriją. Visų primą, pabrėžtina, kad tai yra žmogaus prigimtinė teisė, pripažinta visame pasaulyje, tai yra istoriškai susiklostęs reiškinys, šiuolaikinėje teisėje įtvirtintas kaip atsakomybę šalinanti, o ribų peržengimo atveju, lengvinanti aplinkybė. Atsižvelgiant į sunkumus ir vienodos praktikos nebuvimą sprendžiant būtinosios ginties buvimo, ar ne faktą bei jos ribų peržengimo vertinimą, šis darbas orientuotas į šio socialiai vertingo reiškinio teisinio reglamentavimo pagrįstumo ir tinkamumo aptarimą, taikymo praktikoje metu kylančių problemų išryškinimą siūlant atitinkamus sprendimo būdus. Darbe, visų pirma, aptariama, kas tai per reiškinys – būtinoji gintis, kokia jo svarba ir reikšmė šiuolaikinėje baudžiamosios teisės sistemoje, raida besikeičiant įstatyminei bazei. Antra, darbe nurodytos ir kiek įmanoma išsamiai išanalizuotos sąlygos, būtinos būtinajai ginčiai atsirasti ir jos ribų peržengimui konstatuoti. Minėtų klausimų gana platus aptarimas darbe yra svarbus ir reikalingas, kadangi tik taip galimas išsamus ir visapusiškas darbo temos – būtinosios ginties ribų peržengimas – atskleidimas. Indispensable defense is a socially important phenomenon, approved in the law system and having its own history. Firstly, it should be noticed that it is a natural human right, acknowledged all over the world and it is a historically developed phenomenon. In contemporary law system it is approved as responsibility eliminating circumstances and if exceeding the bounds it becomes extenuating circumstances. Taking into account to all the difficulties and the lack of the same practice experience while evaluating the fact if it was the indispensable defense or not, and different evaluation if exceeding the bounds, this work is directed to this socially significant phenomenon in law system, its evaluation, discussion and pointing out to the problems that appear in practice and suggesting the most suitable ways of solving them. In the work, firstly, it is analyzed and discussed what indispensable defense is and its importance in contemporary law system. Secondly, in the work all the conditions of indispensable defense and extenuating circumstances are shown, discussed and analyzed in details. The analysis of such problems as indispensable defense and exceeding bounds are widely discussed, because these problems are of great importance in law system and this is the only way to reveal the main aspects of this work, thus is, to find the right answer-was it the exceeding indispensable defense or not. Darbe pateikiama būtinosios ginties ribų peržengimo lyginamoji analizė Lietuvos teisinėje sistemoje ir kitų valstybių baudžiamuosiuose įstatymuose. Darbas pradedamas apžvelgiant būtinosios ginties susiformavimo teorijas ir jos istorinę raidą, dėstomas būtinosios ginties ir jos ribų peržengimo reglamentavimas Lietuvos teisinėje sistemoje. Nagrinėjami įvairūs būtinąją gintį ir jos ribas nusakantys požymiai, analizuojama jų sudėtis, kylančios problemos, peržvelgiama Lietuvos teismų praktika, užsienio valstybių baudžiamieji įstatymai reglamentuojantys baudžiamąją atsakomybę už būtinosios ginties ribų peržengimą. Išskiriami teismų praktikoje pateikiami argumentai kvalifikuojant būtinosios ginties situaciją ar jos ribų peržengimą. Darbą sudaro būtinosios ginties teisėtumo sąlygų (pavojingumo, realumo, akivaizdumo) išsami analizė, lyginant teismų praktiką, kitų valstybių baudžiamuosius įstatymus ir reguliavimą Lietuvos teisinėje sistemoje. Aptariama tariamosios ginties kvalifikavimo problema. Kita darbo dalis nagrinėja objektyviuosius būtinosios ginties ribų peržengimo požymius. The self-defence limits comparative analysis of the legal system of Lithuania and foreign states in criminal law is presented in the paper. The work begins with reviewing the emergence of self-defence theory and its historical development. The regulation of self-defence and its limits in the Lithuanian legal system is presented. The various self-defence and its limits attributes are characterized, and analysis of their composition, the problems, reviews the practice of Lithuanian courts, foreign criminal laws governing the criminal responsibility of the excess of limits of self-defence are discussed. The analysis of the arguments of the qualification of self-defence situation or its limits in case law is presented. The work consists of the conditions which describe legitimacy of self-defence (such as gravity, reality and evidence) a detailed analysis, comparing the case law, criminal law of other countries and the regulation in the Lithuanian legal system. The problems of qualification of quasi-self-defence are discussed. In the paper objective attributes of excess of limits of self-defence are researched. Also subjective attributes (as fault, personal emotional state) of excess of limits of self-defence are analyzed. Valstybė, vykdydama nusikaltimų kontrolės ir prevencijos funkcijas, nepajėgi numatyti ir užkardyti kiekvieną konkretų nusikaltimą, taip pat negali padaryti to, kas neįmanoma – apsaugoti kiekvieną individą kiekvienu jo gyvenimo momentu. Asmens teisė į būtinąją gintį yra išvestinė iš Konstitucijoje įtvirtintų žmogaus teisių į gyvybę (21 str.), į laisvės ir asmens neliečiamybę (20, 21 str.), nuosavybės ir būsto neliečiamybę (23, 24 str.), kitų prigimtinių teisių ir yra šių teisių gynimo priemonė. Taip pat teigiama ir Europos Konstitucijoje įtvirtintų žmogaus teisių į gyvybę (2 str.), kiekvienas turi teisę į pagarbą jo fizinei ir protinei neliečiamybei (3 str.), kiekvienas turi teisę į laisvę ir asmens saugumą (6 str.). Kiekvienas mūsų, nepaisant socialinės padėties, esame suinteresuoti gyventi saugioje visuomenėje. Nusipirkti ginklą šiandien nėra labai sudėtinga. Vertinant ginklų gausą, nesunku nuspėti, kad ne visi jų savininkai supranta atsakomybę. Ginklavimasis visų asmens ir turto saugumo problemų neišsprendžia, nors turi neabejotiną prevencinę naudą. Asmuo, įsigydamas ginklą, įgyja ne vien daiktą, jis kartu prisiima ir didelę atsakomybę: įgijęs ginklą, jis privalo užtikrinti, kad su juo bus saugiai elgiamasi, kad ginklas nepateks į svetimas rankas ir, naudojantis įgytu ginklu, bus išvengta nelaimingų atsitikimų. Executing the functions of control and prevention of crimes the state is not able to foresee and prevent each certain crime as well as to do what is impossible, i.e. to protect each individual at each moment in his life. A person’s right to mandatory defence is a derivative from the human right to life (art. 21), freedom and personal immunity (art. 20, 21), property and home immunity (art. 23, 24) established in the Constitution, other natural rights and is the means of defence of these rights. It is also stated by the human rights to life established in the European Constitution (art. 2), that everybody has a right to respect of his physical and mental immunity (art. 3), everybody has a right to freedom and personal safety (art. 6). Regardless of the social status each of us is interested in living in a safe society. To buy a gun nowadays is not very complicated. Evaluating the abundance of guns it is not very difficult to guess that not all of their holders understand the responsibility. The armament does not solve all the personal and property safety problems even though it has undeniable preventive benefit. A person obtaining a gun obtains not only a thing, he also takes a great responsibility: obtaining a gun he must ensure that it shall be used safely, the gun does not get into the other hands and using a gun accidents shall be avoided. Magistro baigiamajame darbe atlikta teisinė analizė mokestinių ginčų dėl PVM atžvilgiu bei iškeltos problemos ir pateiktos išvados dėl PVM reglamentavimo Lietuvoje ir jo atitikimo šiandienos aktualijoms, kadangi būtent dėl PVM kyla daugiausia mokestinių ginčų. Teisinė analizė atlikta pasinaudojus egzistuojančia mokestinio ginčo nagrinėjimo struktūra, t.y. ikiteismine bei teismine stadijomis. Minėta analizė atlikta mokestinius ginčus dėl PVM suskirsčius į tris rūšis: ginčus dėl PVM atskaitos; ginčus dėl PVM atskaitos tikslinimo; ginčus dėl lengvatinio 0 PVM tarifo taikymo. Pirmojoje darbo dalyje teoriniu aspektu nagrinėjama mokestinio ginčo samprata, mokestinio ginčo stadijos, mokestinius ginčus nagrinėjančių institucijų reikšmė. Antroje darbo dalyje aptariami pagrindiniai PVM elementai, PVM reglamentavimas ir PVM reikšmė Lietuvoje. Trečioje darbo dalyje pateikiama mokestinių ginčų statistika 2010 metams, bei atliekama teisinė analizė mokestinių ginčų dėl PVM Lietuvoje atžvilgiu.
In a final master‘s work, there is presented a legal analysis of fee disputes due to VAT. There are revealed the problems and given the conclusions due to regulation of VAT in Lithuania too. Exactly for this reason of VAT, rise many disputes of the fees. The juridical analysis was accomplished using the research structure of existing taxable disputes, it means: pre-juridical and juridical stage. In the first part of the work there is written about the concept of the taxable disputes in a theoretical aspect, their stages and the importance of pending institutions. In the second part there are disputed the main elements of VAT, its regualation and importance in Lithuania.

Dvidešimtas amžius atnešė žmogaus teises ir jų apsaugos idėją, kaip jas būtų galima puoselėti. 2001 metais Tarptautinė komisija dėl intervencijos ir valstybės suverenumo parengė projektą “Pareiga ginti” (Responsability to protect). Ši doktrina paremta valstybės pareiga saugoti ir gerbti jos piliečių žmogaus teises bei tarptautinės bendruomenės pareiga įsikišti, jeigu valstybė padaro didelio masto žmogaus teisių pažeidimus. Šis darbas siekia atsakyti į klausimą, ar doktrina “Pareiga ginti” yra tarptautinės paprotinės teisės norma. Tuo remiantis, pirmoje baigiamojo darbo dalyje analizuojama, kas yra tarptautinė paprotinė teisė ir kaip ji gali būti pritaikyta realioje situacijoje. Antroje dalyje pateikiamas doktrinos “Pareiga ginti” aprašymas, bei nurodomi pagrindiniai šios doktrinos elementai. Trečioje ir ketvirtoje dalyse analizuojami jėgos panaudojimo prieš valstybę teisiniai aspektai ir pateikiamas naujausias doktrinos pritaikymo atvejis Libijoje. Išvados darbo pabaigoje pateikia atsakymą į darbo pradžioje išsikeltą hipotezę, jog doktrina “Pareiga ginti” dar nėra tarptautinės paprotinės teisės norma, nors toks statusas padėtų išvengti politinio akligatvio ir Jungtinių Tautų Saugumo tarybos veiksmams suteiktų lankstumo. Pažymėtina, kad baigiamajame darbe taipogi pateikiama idėja, kad pirmasis doktrinos elementas, t.y. valstybės atsakomybė saugoti ir gerbti žmogaus teises yra tarptautinė paprotinė teisė. The rise of human rights in 20th century brought the idea of minimal international standard to ensure and protect those rights. In 2001 the International Commission on Intervention and State Sovereignty made a report which suggested the doctrine of Responsibility to Protect based on the state’s duty to respect its own citizens’ rights and the duty of international community to step in if a state commits mass scale human rights violations. This final paper focuses on answering the question whether R2P has gained the status of customary law. For this reason the first chapter analyzes what defines international customary law and how can it be applied in particular cases. The second part of the paper focuses on presenting the R2P doctrine and its elements. The third and fourth chapters analyze the legal justification of use of force and the most recant example of R2P application in Libya. The conclusions bring the answer to the hypothesis that R2P is not yet an international customary law. Although the status of being one could be very beneficial in order to avoid political dead-end in the United Nations Security Council actions. In addition to this, this paper argues that state’s duty to protect its own people is already an international customary law, on the contrary international community, if needed to cope with failed states, still waits for the UNSC authorization. Magistro darbe „Ginčas dėl Arkties teritorijų: teisiniai, politiniai ir geopolitiniai valstybių interesai“ tiriamas XXI amžiaus pradžioje vykstantis ginčas dėl Arkties teritorijų, kuriame dalyvauja penkios arktinės valstybės: Danija, JAV, Kanada, Norvegija ir Rusija. Darbe atskleidžiama ginčo dėl Arkties teritorijų problematika. Tai daroma aiškinantis penkių arktinių valstybių interesus Arktyje, kurie tiesiogiai susiję su iškylančiais valstybių tarpusavio nesutarimais Arkties regione. Tyrimo pabaigoje apžvelgiami galimi ginčo dėl Arkties sprendimo būdai. Darbo tikslu laikomas siekis išsiaiškinti ar įmanomas greitas ginčo dėl Arkties teritorijų išsprendimas. Tikslas įgyvendinamas atliekant išsikeltus penkis uždavinius, kurių kiekvienas yra tiesiogiai susietas su atitinkamu darbo skyriumi. Pirmoje darbo dalyje analizuojama Arkties regiono geopolitinė kaita. Remiantis Tradicinės geopolitikos teorijomis nustatyta, kad Arktis gali būti traktuojama didžiųjų valstybių kovos dėl galios regionu. Didžiosios galios, JAV ir Rusija, yra labiausiai suinteresuotos Arkties teritorijų panaudojimu savo galios didinimui. In a Master thesis „Battle for the Arctic: Juridical, Political and Geopolitical Interests of States“ is examined the battle for the Arctic in a 21st century, which includes five Arctic states: Denmark, US, Canada, Norway and Russia. The main idea of this research is to examine current situation in the Arctic Region, to discover the main interests of Arctic five in the High North and to foresee possible solutions of current disagreements. The research is implemented through fulfillment of five goals which are the basis of each chapter of this research. First chapter is committed to the analysis of the geopolitical changes in the Arctic Region. By using Traditional geopolitical theories is discovered that Arctic territories plays a huge role in great power politics. Arctic territories are like a playground for US and Russia, where they are struggling for increasing their power. In the mean time, the rest participants of the battle for the Arctic are dominated by Russia‘s and US interests. But it is noticed that Canada has a potential to compete with the great powers, Russia and US. The second chapter is an analysis of legal norms which regulates battle for the Arctic. Ginés de Sepúlveda é um cronista real do século XVI e preceptor do príncipe Felipe II, que se aproxima de uma moderna razão de Estado a qual ele deve servir e para a qual foi formado conforme a sua profissão e status de humanista. Objetiva-se com esse trabalho demonstrar que Sepúlveda apresenta uma proposta civilizatória hegemônica que antecipa de alguma forma o pensamento imperial moderno e, para tal, desenvolve o título de civilização como justificativa do sistema colonial (hoje pós-colonial). Com base nas posições teóricas de Dussel (2006), Mignolo (2003) e Wallerstein (2007), também pretende-se evidenciar que o referido cronista real consegue construir um aparelho ideológico com elementos medievais (agostinismo político) e renascentistas (estoicismo e aristotelismo naturalista) justificador das novas necessidades estatais de expansionismo imperial europeu do ponto de vista ético-filosófico, antecipando, de certo modo, a segunda modernidade, o Iluminismo. Neste trabalho, analisaram-se as principais obras de Sepúlveda: Democrates Alter e Primus, De Monarquia, a Apologia das Justas Causas da Guerra contra os Índios, a Exortação a Carlos V para que faça a guerra aos turcos e as crônicas reais, especialmente De Orbe Novo, nas quais pode-se observar que, na visão de Sepúlveda, a religião, por meio da evangelização, cumpre com os seus fins justificativos, mas sempre servindo a uma ideia abrangente de princípio civilizatório. Ainda se destaca que o autor subsume os princípios cristãos na ética estóica, baseado numa compreensão do mundo sublunar como isento de intervenção divina no cotidiano, seguindo a Pietro Pomponazzi

Abstract This paper discusses a methodology to predict the cost of assembling printed circuit boards (PCB). It is formulated using the flexible assembly system in the Experimental Printed Circuit Board Assembly Facility (EPCBAF) of the GINTIC Institute of CIM. The concept of Boothroyd and Dewhurst is applied in this work. The assembly cost accounts for insertion, test and rework costs only. Evidence from research on infectious diseases suggests that income inequality is related to higher rates of infection and death in disadvantaged population groups. Our objective is to examine whether there was an association between income inequality and the numbers of cases and deaths during the first wave of the COVID- 19 pandemic in European countries. We determined the duration of the first wave by first smoothing the number of daily cases, and then using a LOESS regression to fit the smoothed trend. Next, we estimated quasi-Poisson regressions. Results from the bivariate models suggest there was a moderate positive association between the Gini index values and the cumulated number of infections and deaths during the first wave, although the statistical significance of this association disappeared when controls were included. Results from multivariate models suggest that higher numbers of infections and deaths from COVID-19 were associated with countries having more essential workers, larger elderly populations and lower health care capacities.

Desde la década de los noventa, los ingresos de los trabajadores de América Latina y el Caribe se han incrementado. Sin embargo, seguimos siendo una de las regiones más desiguales del mundo, lo que limita el desarrollo y el crecimiento de nuestros países. Esta octava entrega de la serie “El futuro del trabajo en América Latina y el Caribe” analiza la tendencia de la desigualdad en los ingresos laborales y cómo se evidencia a partir de diferentes dimensiones del mercado laboral. Además, presenta un análisis prospectivo sobre cómo los choques externos inesperados (como la pandemia del COVID-19) afectan los ingresos de los trabajadores y repercuten en la pobreza y la desigualdad. Entre otras conclusiones, se destaca que la crisis podría aumentar la incidencia de pobreza entre un 25% y un 33%, mientras que la distribución de los ingresos podría empeorar, aumentando el coeficiente de Gini de 0,473 a 0,498 en los ingresos promedio de la región. Aquellas personas que ya estaban en situaciones de vulnerabilidad antes de la pandemia son las más afectadas, especialmente los trabajadores informales, independientes y no remunerados y aquellos que trabajan en empresas pequeñas y en sectores que se vieron restringidos por las medidas de confinamiento, como el comercio, los servicios y la construcción. La situación no es fácil. La publicación destaca que los retos para el futuro incluyen una recuperación económica con un enfoque inclusivo, en donde se favorezca la creación de empleo formal, la protección social y la ampliación de programas sociales. La pandemia representa un reto para los países de la región, pero implica también una oportunidad para impulsar reformas en el mercado laboral y en las condiciones de los trabajadores y los hogares.
