Abstract:
On 1 October 1879 the German Imperial Court, the Reichsgericht, was formally opened in a ceremony in Leipzig. Decades of division among the German states, particularly in the years between the end of the Holy Roman Empire in 1806 and the creation of the German Reich in 1871, led to constant demands for national unification on political, economic, social and legal levels. Throughout those years proposals for Rechtseinheit, or legal unity, called for numerous substantive reforms as well as procedural or institutional reforms. Such proposals ultimately led to several important legal reforms, including the adoption of the Imperial Justice Laws of 1877.
This dissertation argues that the successful establishment of the Reichsgericht, as an integral component of the larger movement towards German legal unity, provides an important example of contemporary struggles between centralization and particularism and between liberal political ideals and political realities in the new German Reich. Between 1806 and 1879 several contemporaries recommended the creation of a national supreme court for the German states. The failure of the pre-1867 court proposals contrasted sharply with the successful proposals of the 1867 to 1879 period. Nevertheless, the negotiations and debates which took place between the various German states, between the federal government and the states, and in the legislative organs of the German state itself, were intense and contentious. The creation of the Reichsgericht reflected several important issues, including the comparative abilities of the various states, the federal bureaucracy and the federal legislature to influence the form and substance of national judicial legislation.
The documentary evidence for this dissertation has been gathered from several archival depositories, including relevant holdings in the Bundesarchiv sections in Potsdam and Dahlwitz-Hoppegarten and the Prussian state archives in Berlin-Dahlem, and from published government and contemporary sources. In addition, unpublished and published secondary sources have been utilized.

Abstract:
This thesis explores identity as it was portrayed, constructed, and upheld through court festivals within the Holy Roman Empire of the German Nation in the period between the Peace of Augsburg in 1555 and the coronation of Friedrich V, Elector Palatine, as King of Bohemia in 1619. The thesis is made up of five inter-related thematic chapters. Chapter I analyses the role of ‘Lineage, Legitimacy, and History’. This chapter acknowledges the enduring importance of lineage, genealogy, and history to noble legitimacy, and discusses the threats and questions posed by newly rising families. It demonstrates how competing claims and counter-claims to legitimacy were made as festival occasions attempted to weave their protagonists into the fabric of ‘German’ history together with an associated possession of ‘German’ virtues, and how these claims to legitimacy were buttressed by representations of popular acclaim. Chapter II discusses ‘Mortality, Masculinity, Femininity, and Mutability’. At festivals both the mortality of members of dynasties and gendered roles, ideals, and identities as noble men and women were visible. This chapter argues that the evidence of these festivals complicates any stark delineation between male and female identities, instead stressing the degree of mutability of these categories as well as the centrality of virtue demonstrated, primarily, through skill. The themes of mutability and virtue continue into Chapter III, which addresses ‘Nature and the German Land’. Festivals often incorporated performed claims to possession of, and endorsement from, the German land itself. The land and its topographical features could be represented within cities as part of festival occasions, or the journeys to, and between elements of, festivals could incorporate the landscape into the rhetoric of these spectacles. This rhetoric could be confessionalised and politicised, but representations of nature also served to bolster a universalising rhetoric of virtue through the skilled manipulation of nature to the whim of the ruler. Chapter IV deals with the theme of ‘Religion, Piety, and Confessional Difference’. It discusses the role which displays of piety, including humility before God and the Church, played in these occasions, and draws out elements of confessionalised rhetoric present. However, the analysis shows that directly antagonistic religious imagery and language, seen elsewhere in European festival culture, does not feature. Instead, the emphasis is on non-divisive language and a unifying notion of Christendom. This was, of course, set against the dipole of the ‘Other’ which is addressed in Chapter V, ‘Language, Custom, Othering, and Unity’. Festivals drew attendees from across Europe and often included performed representations of non-Christian ‘Others’ such as Turks, Moors, and inhabitants of the New World. While the foreign, even the Ottoman, could be seen as exotic and luxurious, a rhetoric of superiority nurtured through appropriation and trivialisation of the threat which the Ottomans posed again contributed to the creation of common notions of identity. Finally, far from being an impediment to common identity, the meeting and use of different languages at festivals also served to highlight skill, learning, and virtue in the rhetoric of identity at these occasions.

Aufgrund des wachsenden Bedarfs an kohärenter Interaktion zwischen dem Europäischen Gerichtshof für Menschenrechte, dem Gerichtshof der Europäischen Union und den Gerichten der EMRK-Mitgliedstaaten, untersucht diese Arbeit die Problematik von Kompetenzkonflikten, die die Glaubwürdigkeit der europäischen und nationalen Gerichtshöfe untergraben und die Effektivität des gerichtlichen Rechtsschutzes in Europa schwächen, und schlägt die Lösungen vor, um Rechtsprechungskonflikte zwischen den Gerichtshöfen zu verringern. Es erfolgt eine Betrachtung der Fragen, wie Inkonsistenzen der gerichtlichen Rechtsprechung der europäischen und nationalen Gerichte vermieden werden können, wie der Beitritt der EU zur EMRK angegangen werden kann und wie das Piloturteilsverfahren des EGMR und nationalen gerichtlichen Überprüfungsverfahren wirksam funktionieren kann. Die Arbeit kommt zu dem Schluss, dass es für die Koordination der Zusammenarbeit zwischen den Gerichten wichtig ist, ihre Interaktionen zu verstärken, indem bewährte Verfahren auf allen Ebenen ausgetauscht werden. Um eine tiefere Integration der Staaten in die europäische und internationale Gemeinschaft zu erreichen und das Risiko von sich widersprechenden gerichtlichen Entscheidungen zu reduzieren, wird von den Mitgliedstaaten erwartet, dass sie ihre Verpflichtungen aus dem EU-Recht und der EMRK verlässlich erfüllen, und die europäischen Gerichtshöfe werden ihrerseits die Möglichkeit eines Eingriffs in die Souveränität der Staaten ausschlieβen lassen. Nur wenn einvernehmlich beschlossene Lösungen angenommen werden, wird eine größere Kohärenz in Rechtsprechung der europäischen und nationalen Gerichtshöfe erreicht und ein einheitliches System zum Schutz der Menschenrechte gewährleistet.
In light of the growing need to establish a coherent relationship between the European Court of Human Rights, the Court of Justice of the European Union and the courts of the ECHR member states, this study explores the challenges of jurisdictional competition that undermine the credibility of the courts and weaken the effectiveness of judicial protection of fundamental rights in Europe, and suggests ways to reduce emerging judicial tensions between these courts. It examines how to avoid inconsistencies in judicial practices of the European and national courts, how to approach accession of the EU to the ECHR, and how to ensure effective functioning of the pilot judgment mechanism and national judicial review procedures. It concludes that in order to coordinate cooperation between the courts it is important to strengthen their interactions through adhering to best practices at all levels. To pursue deeper integration of states into the European and international community and minimise the chance of rendering contradicting judgments by the courts, member states are expected to comply faithfully with their obligations under EU law and the ECHR, and the European courts shall exclude the possibility of encroachment on state sovereignty. Only if mutually agreed solutions are adopted will a greater consistency in their case law be achieved and a uniform system of protection of human rights ensured.

Abstract:
Diese wissenschaftliche Arbeit untersucht die Befähigung der Lehrkräfte des Orientierungskurses. Laut Integrationskursverordnung müssen die Lehrkräfte ausreichende fachliche Qualifikationen und Eignung nachweisen, um die Ziele des Orientierungskurses zu erreichen. Anders als bei der Qualifizierung für die Vermittlung der Sprache muss jedoch kein entsprechendes Studium oder Zusatzqualifizierung für den Erhalt der Integrationskurslizenz absolviert worden sein. Die Forschungsfrage wird anhand einer Fallanalyse realisiert, die eine multiperspektivische und qualitative Betrachtung der Situation erlaubt. Im Zentrum der Fallanalyse steht die Erhebung qualitativer Interviews, die mit Orientierungskurslehrkräften und Sprachkurslehrkräften in der Landeshauptstadt Sachsens geführt wurden. Die Interviews wurden aufgenommen, transkribiert und nach Vorgaben der qualitativen Inhaltsanalyse nach Mayring untersucht. Der Orientierungskurs folgt im Normalfall als siebtes Modul auf die sechsmonatige Phase des Sprachkurses und schließt mit dem Test Leben in Deutschland ab. Die Position als letztes Modul im Orientierungskurs wurde von einigen Orientierungskurslehrkräften als negativer Einfluss auf die Motivation der Teilnehmenden angeführt. Außerdem verstärkt die organisatorische Überschneidung des Orientierungskurses mit der DTZ-Prüfung, die am Ende des Sprachkursteils steht, diesen Effekt. Die statistischen Daten aus dem Jahr 2016 zeigen, dass in diesem Jahr die höchste Zahl an Asylanträgen seit Bestehen des Bundesamtes für Migration und Flüchtlinge gestellt wurde. Ebenfalls hat sich die Zusammensetzung der Teilnehmenden der Integrationskurse seit 2014 deutlich verändert. Kamen die Teilnehmenden 2014 am häufigsten aus EU-Staaten, stand 2016 mit 50 Prozent der Neukursteilnehmenden Syrien an erster Stelle. Darauf folgte der Irak und Eritrea. Somit besitzt die Mehrheit der Kursteilnehmenden einen ähnlichen kulturellen Hintergrund. Außerdem machten männliche Teilnehmende mit 66 Prozent im Jahr 2016 die Mehrheit im Integrationskurs aus. In Sachsen liegt die Quote mit 72 Prozent über dem bundesweiten Durchschnitt. Entsprechend der bundesweiten Entwicklung stieg auch in Sachsen die Anzahl der Neukursteilnehmenden von 2 auf 4 Prozent im Vergleich zum Vorjahr 2015 an. Somit begannen im Jahr 2016 mit 758 Kursen deutlich mehr Integrationskurse als im Vorjahr. Die Lehrkräfte bestätigen die statistische Analyse durch ihre Aussagen. Der hohe Männeranteil wird ebenso angeführt wie die Homogenität der Herkunft. Einige Sprachkurslehrkräfte merken an, dass durch den einheitlichen Hintergrund der Teilnehmenden ein sprachlicher Austausch und somit der Lernprozess gehemmt ist. Weiterhin führen alle Lehrkräfte die Heterogenität der Vorbildung und der Leistungsfähigkeit als die größte Herausforderung an, die sich auch in den Lernerfolgen niederschlagen würde. Die unter 3.3 und 7.1 ausgeführte hohe Varianz des Sprachniveaus wird von den Orientierungslehrkräften bestätigt und als größte Herausforderung im Kurs benannt. Infolge des variierenden Niveaus sind die Teilnehmenden weniger motiviert, können nicht aktiv am Kurs teilnehmen und verstehen komplexere Themen schlechter. Das Curriculum gibt an, dass der Orientierungskurs auf Sprachniveau A2 ausgerichtet ist. Die Betrachtung der Beschreibung dieser Niveaustufe unter Punkt 7.1 zeigt jedoch eine hohe Diskrepanz zwischen dem Sprachniveau und dem Anspruch des Wortschatzes im Orientierungskurs. Dies bestätigen auch die Aussagen der Lehrkräfte (Punkt. 9.1 Kategorie 8). Außerdem müssen die sprachlichen Fähigkeiten nicht als Voraussetzung für den Orientierungskurs nachgewiesen werden.

Abstract:
Germany’s economic dominance in Europe, generous investment incentives, and technical manufacturing prowess has encouraged an influx of Chinese-led inbound activity, concentrated in high-tech sector mergers and acquisitions. A close examination of these M&As yields evidence of systemic Chinese state-financing through both state-owned and private vehicles that likely stems from China’s “Made in China 2025” policy, which hopes to stem capital outflow and to indigenize technological innovation. As Germany braces for what it sees to be continuous attempts by China to take patented German technology through M&As, it worries that Chinese patent law will allow for rampant patent infringement by copycat Chinese entities. This paper presents an overview of the root causes of China’s heavy economic activity in Germany, as well as an analysis of the legal concerns held by German firms based on a close reading of the Patent Law of the People’s Republic of China and strategic recommendations for German companies hoping to work with or in China.

La course aux armements navals anglo-allemande fut un des facteurs clés dans le déclenchement de la Première Guerre mondiale. En particulier, les années comprises entre 1906 et 1912 ont vu une compétition intense entre les deux pays dans la construction de vaisseaux de ligne modernes - des croiseurs lourds blindés - après que le Dreadnought fut lancé par les Britanniques. Tant que l'Allemagne n'était pas prête à accepter la suprématie navale britannique et que la Grande-Bretagne ne voulait pas la céder, la compétition dura jusqu'à ce qu'une des deux parties cède par essoufflement économique. L'Allemagne a essayé de traduire son pouvoir économique en force militaire mais échoua à cause de son système de fiscalité moins efficace qu'en Grande-Bretagne. The Anglo-German naval race was one of the decisive factors in the outbreak of World War I. In particular, the years between 1906 and 1912 witnessed an intense head-to-head competition between the two powers in the building of modern capital ships, that is, battleships and large armoured cruisers, after Dreadnought had been launched by the British. So long as Germany was not prepared to accept British naval supremacy and Britain was not prepared to yield it, the competition was bound to go on until economic exhaustion compelled one side to give up. Germany tried to translate its wealth into military power, but the inefficient nature of its taxation system prevented it from doing so. The fact that Britain's Treasury had the power to both levy and increase direct and indirect taxes, while in Germany only state governments had it shows that Britain's more democratic constitutional system meant that London could react to Germany's naval challenge by punishment, mobilizing a greater share of financial resources for naval spending than Berlin

Abstract:
In the 1850s, many of Indiana's native-born Protestant population perceived the traditions and customs of German immigrants, specifically those concerning drinking alcoholic beverages and beer, as a threat to their "American way of life." They believed that the Germans' public drinking habits and behavior were the source of social problems causing instability and disorder prevalent in many of their communities. Although these problems were caused by Indiana's rapid industrialization and urbanization, older-stock Hoosiers blamed them on the readily identifiable immigrants. During the 1850s, temperance advocates in Indiana sought to force the German immigrants to conform to native-born Anglo-American culture to solve these problems of societal order and control. The temperance movement in Indiana was a fight to impose American cultural values on immigrants. Though temperance was a powerful social and political force in Indiana in the 1850s, it could not alter the tight-knit German Catholic community of Dubois County.The numerical strength of the German community and their strong opposition to assimilation hindered the temperance movement in Dubois County. The prominent role of the local Catholic Church and the Germans' common ethnic and cultural identity were two main factors in keeping temperance out of the county. Other significant factors were the permanent nature of the Germanimmigrants' settlement, the rural isolation of the county, the domination of the local Democratic party, and the prominence of beer in the German-Americans' culture.This study is historically important for several reasons. First, the reaction of this specific community to the antebellum temperance campaign provides a more complete understanding of how German immigrants in Indiana and the Midwest dealt with the problems of assimilation. Second, by focusing on a rural area, the German reaction to the issues of assimilation and temperance can be identified and examined independent of the urban problems of industrialization, overcrowding, and unemployment. Finally, it also constitutes the only known interpretation of the Indiana temperance movement from the perspective of those it most affected: the immigrants themselves.

Abstract:
The representation of a Stuttgart court festival in a fascinating book of prints has received no art historical attention. The cultural production of German lands in a complex and obscure time described by one historian as being particularly bereft of "textbook facts", has not elicited much scholarly interest. In the seventeenth century before confessional disputes within the Holy Roman Empire of the German Nation turned into armed conflict, small German territorial courts modelled themselves on and assumed the courtly style of the larger European courts. The Stuttgart baptism of 1616 presents an interesting case study of the use of a courtly spectacle by a secondary court at a time of great instability. The baptism festival served as a stage to display an alliance of some German Protestant princes that held a promise of international support for the Protestant cause. The Wurttemberg court commissioned lengthy texts and a large number of engravings to represent the event. This study will address the contributions made by printed images to the festival program. The key documents for this study are the texts which complement and at times diverge from the visual representation. The differences between the visual and textual material will serve to locate the function of the visual representation of a festival held at a time of impending conflict. The triumphal procession format of the engravings discloses a strategy of disenfranchisement of a powerful parliament while it serves to assert the rank of the court within and outside the German empire. The complex amalgams of imagery that are interspersed in the paper procession allude, I suggest, to the problems presented to the Wurttemberg court by an uneasy alliance of Protestant courts within the empire. The engravings served to encode references to problematic issues such as the survival of the Holy Roman Empire, the rights of Protestant territorial princes to form an alliance and the hopes for outside help for the Protestant cause.

Abstract:
Blended and online courses can require more student self-regulation than traditional in-person courses. Instructors and course designers can support student motivation and self-regulation in a variety of ways, such as by including motivational strategies in the course materials. The purpose of this study was to explore the relationship between the following three factors: the motivational strategies employed in the online course materials of a blended German language course, student engagement in the course, and student usage of the course materials. Selected course activities were analyzed using a checklist based on Keller's ARCS (Attention, Relevance, Confidence, Satisfaction) model for motivational design to identify the motivational strategies that were present. At the end of each unit, students completed surveys about their level of engagement with the online portions of the blended course and their perceptions of the online activities. At the end of the semester, data about student usage of the online activities was collected from the Canvas Learning Management System. The results of this study show that a wide range of motivational strategies are used in the online materials of this course and that students were highly engaged in this course. Students found the grammar and vocabulary activities to be the most motivating and the most useful for their language learning. The number of Attention strategies in an activity was strongly correlated with how often students used the activity, and the number of Attention strategies also predicted how often students would use the activities, likely because Attention strategies increase ease of use of the materials and encourage student curiosity. The number of Satisfaction strategies in an activity predicted how motivating students would find the activity, likely because Satisfaction strategies allowed students to use their new skills in realistic contexts and experience intrinsic and extrinsic rewards. There was a strong correlation between how motivating students found an activity and how useful they found the activity for their language learning. Including more motivational strategies, particularly Attention and Satisfaction strategies, can enhance the student experience and increase student motivation; however, students are most likely to be motivated by activities that they find useful for their language learning.

Scottish letters and court-records from the late 16th and early 17th centuries give access to a rich variety of conflicts, ranging from international disputes to everyday spats. This thesis investigates verbal offences reported by correspondents or recorded as legal evidence. Current models of (im)politeness (Culpeper, 2011a, Spencer-Oatey, e.g. 2005), which have rarely been tested on historical data, are synthesized with insights from historical pragmatics. The aims are to create qualitative reconstructions of how participants communicated their period- and situation-specific understandings of verbal offences, and how their expressed perceptions were shaped by private and public dimensions of different contexts. This thesis thus addresses three comparatively understudied aspects of (im)politeness research: historical impoliteness, Scottish (im)politeness, and the examination of private-public aspects of social interactions. Regarding the third point, a multi-dimensional framework is developed for systematic descriptions of private-public dimensions of conflict-situations, remodelling an existing pragmatic approach to news discourse (Landert and Jucker, 2011). Letters are drawn from the Breadalbane Collection, 1548-1583 (Dawson, 2004/2007) and James VI’s correspondence. Court-records are selected from editions of Justice Court papers and Kirk Session minutes. Case studies reveal that the vocabulary and discursive structure of conflict-narratives in letters is largely distinct from reported offences in court-records. Differences are presumably influenced by the genres’ contrasting contextual functions of more private versus more public conflict-settlement. However, the language of conflict-letters and court-records also shows shared moral and religious dimensions. Furthermore, verbal offences in the investigated letters and lawsuits refer primarily to collective identity-aspects of group-membership and social roles, while purely individual qualities appear to have been marginal. The perceived gravity of offence could be intensified by participants’ notions of private and public in multiple ways. Concerning comparisons within genres, the Scottish king’s epistolary language in conflicts shows similarities to that of Scottish upper-rank correspondents; nevertheless, it also has some distinct features reflecting James VI’s understanding of his royal status. Criminal and ecclesiastical court-records had largely different, yet semantically related, inventories of verbal offence terms.

This study discusses Felix Mendelssohn-Bartholdy's appointment to the Prussian Court of King Friedrich Wilhelm IV, Mendelssohn's relationship with the Court (both personal and professional) and the numerous difficulties encountered with this appointment. In addition, Mendelssohn's musical responsibilities and personal feelings toward the cities of Leipzig and Berlin, Berlin's choral traditions (including a brief history of the Berlin Domchor) will also be discussed. Mendelssohn's op. 78, op. 79 and Die deutsche Liturgie written for the Berlin Domchor reflect the sometimes competing demands of the traditional liturgical genres (e.g. Masses, psalms, motets), which are more "objective" in nature and the far more "subjective" elements inherent in the Romantic "ideal" of expression. This thesis examines how American and German constitutionalism, as shaped by the U.S. Supreme Court and the German Constitutional Court (Bundesverfassungsgericht), have mediated the tension between threats to stability and the imperative of renewal through occasional or constant interventions in their democratic processes. To do this, it primarily assesses the 1960s U.S. reapportionment cases and the European Parliament electoral threshold cases of 2011 and 2014. It also considers the ideas of four thinkers, theorists and jurists who have wrestled with the dilemma of how to maintain the bond between citizen and state: Ernst-Wolfgang Böckenförde, Hannah Arendt, Thomas Jefferson and Alexis de Tocqueville. Stability and renewal represent the twin orientation points for constitutionalism and the courts against which they must adjust to possible democratic threats, or new political and social forces in need of recognition. Threats to the state can emerge either from a surfeit of illiberal views in politics and society aimed at destroying an existing constitutional order, or when democratic channels become starved of new opinions through the constitutional or unconstitutional exclusion of voters and parties. A distinctive feature of the approach taken is the conceptual division between the ‘legal/institutional' space in which the Supreme Court and Bundesverfassungsgericht interpret constitutional meaning, and the ‘civic space' in which citizens accept or reject constitutional meaning. One central question is how American and German constitutionalism, and the U.S. Supreme Court and Bundesverfassungsgericht shape and influence the vital civic space that is integral to the democratic relationship between citizen and state, and the survival of the state itself. Ultimately it is concluded that without acceptance of the importance of law and constitutionalism by citizens in the civic space, the influence of the Supreme Court and the Bundesverfassungsgericht becomes purely institutional and effectively consigned to the courtroom.

Les mécanismes moléculaires de l'embryogenèse somatique chez les gymnospermes ne sont pas complètement compris. Parmi les nombreuses études réalisées visant à améliorer les connaissances sur ce phénomène particulier de développement, certaines ont été menées sur l'implication et le rôle des protéines extracellulaires. Parmi elles, certaines sont des germines et GLPs dont les fonctions ne sont pas totalement connues. Elles appartiennent à une superfamille de protéines apoplastiques exprimées à des stades spécifiques de développement ou lors de stress. Dans les rares cas où une fonction enzymatique a pu être associée à ces protéines, il a été montré qu'elle entraînait la production d'H2O2 au niveau pariétal. PcGER1, un gène GLP avait déjà été isolé chez les conifères. Ses homologues chez le mélèze hybride (LmGER1) et le pin sylvestre (PsGER1) ont été caractérisés. Ces gènes GLPs ont une structure très proche et nous avons montré que les protéines correspondantes ont probablement une activité SOD générant du H2O2. Leurs séquences promotrices, conservées ont été soumises à une analyse bioinformatique révélant qu'elles possédaient dans leur partie distale de nombreux éléments cis retrouvés ans les promoteurs de gènes répondant aux hormones et/ou exprimés dans les tissus embryonnaires, ans la graine ou encore lors de la germination. L'activité du promoteur PcGER1 a été évaluée au cours de la culture de cellules BY-2. Celle-ci s'est révélée maximale en présence de 2,4-D et de BA à la fin de phase exponentielle de croissance
Une analyse par cytométrie en flux a montré que 70 à 80 % des cellules avaient un contenu en ADN en 2C. Les cellules dans lesquelles le promoteur était activé étaient en phase G1. Par ailleurs, la comparaison de l'activité du promoteur pleine longueur et de deux fragments délétés dans la partie distale montre que l'activité décroît avec la longueur du promoteur. Enfin, nous avons mis en évidence une corrélation significative entre le taux de parois et l'activité du promoteur. L'activité du promoteur LmGER1 a été évâluée en système homologue à l'aide d'un gène rapporteur au cours du développement. Nous avons pu montré que l'expression du gène était tissu-spécifique et avait lieu tout au long de l'embryogenèse somatique. Cette expression est localisée au niveau de la coiffe racinaire et des procambia vasculaires de l'hypocotyle et des cotylédons de l'embryon somatique. Au niveau des jeunes plants, l'expression de LmGER1 est située dans la nervure centrale des euphylles au niveau du système vasculaire et précisément dans le procambium vasculaire mais nous avons également pu constater une expression au niveau des cellules de garde des stomates. Enfin, une construction provoquant de l'IR-PTGS a été introduite dans des masses embryogènes de mélèze hybride afin d'évaluer l'impact de l'extinction de ces GLPs sur le phénotype embryonnaire. Les lignées embryogènes montrant une forte sous expression du gène se sont montrées incapables de maturer. Nous avons ainsi émis des hypothèses quand au rôle des GLPs dans le contrôle de l'expansion pariétale au sein d'un certain nombre de tissus

This thesis investigates how family–employment reconciliation issues associated with single motherhood affect women’s employment careers. The study fills a gap in the literature, which rarely considers single motherhood and employment as processes in the life course, much less in a cross-country comparative perspective. Patterns of employment trajectories during and after single motherhood are examined as the outcome of individual and institutional circumstances. Great Britain and West Germany are used as contrasting cases that represent relatively different contexts of labour market structures and family policy. Longitudinal individual-level data from the British Household Panel Survey (BHPS) and the German Socio-Economic Panel (SOEP) are analysed, looking at the period between and including 1991–2008. The thesis develops a theoretical model that assumes differential career outcomes for experiencing single motherhood at different life stages. Higher difficulties of family–employment reconciliation are predicted for women experiencing single motherhood at a young age compared to later stages. The acquisition of marketable resources, which stands in the context of education systems, is assumed to be one of the central mechanisms mediating the relationship between age at single motherhood and employment. Moreover, policies directed at single parents affect reconciliation, shaping opportunity structures on which women can draw in single motherhood. Compared to the German context, Britain provides little institutional support securing labour market attachment for women in single motherhood, particularly when their children are young. Although providing more generous family policy measures in comparison, West German maternity leave regulations are often not applicable to women in single motherhood, and childcare is mostly granted on a half-day basis. The findings from three steps of empirical analysis provide new insights and highlight specific facets of established facts. First, fixed effects logistic regression is used, which exposes a negative association between single motherhood and entering full-time employment. No differences are observed between partnered and unpartnered mothers, but effective childcare arrangements support women’s transition in both Britain and West Germany. The second step of the analysis explores employment career patterns during and after single motherhood using sequence analysis. The emerging typical patterns are observed to different degrees in the two country contexts. On average, more employment trajectories dominated by non-employment are observed in Britain and by part-time employment in West Germany. In the last step, these findings are used in an explanatory framework, the results of which provide evidence for the life stage hypothesis. The analysis demonstrates that not only social class but also mother’s age, children’s age and skill levels seem to foster employment stability and labour market attachment during and after single motherhood.

Purpose – Since April 2014, the alliance of leading German Institutes of Technology (TU9) has been jointly producing and running massive open online courses (MOOCs) on the subject of engineering. On the one hand, the collaborative MOOC@TU9 project aims to combine the unique characteristics and strengths of the engineering courses offered by the TU9 universities, making inter-institute, cooperative, open learning both visible and accessible. This will enhance both local teaching and the national and international marketing of the universities. On the other hand, the project also aims to help build communal experience and develop quality and production standards for the use of different MOOC formats in digital higher education teaching. In this sense, the MOOC@TU9 project contributes to the vital development of sustainable digitalisation strategies at German universities in the form of a feasibility study, which can then be used in other contexts as a valuable example of best practice. Design/methodology/approach – The MOOC@TU9 project has a primarily practical approach. The focus of the collaboration between the TU9 universities is therefore the discussion, exchange and coordination of concrete actions in addition to the evaluation and assessment of the solutions reached and implemented. The collaboration within the TU9 network results in inter-organisation working and learning processes for the parties and institutions involved. These have a particular value, as this is how, through collaboration, we can build an effective, sustainable, multi-dimensional experience. Originality/value – MOOC@TU9 is a joint inter-university project with the aim of strategically testing the possibilities, parameters and benefits of using massive open online courses in higher education teaching, the like of which has never been seen before in Germany. There is, therefore, currently no systematic development of quality and production standards for MOOCs: a gap, which MOOC@TU9 is actively attempting to fill. Practical implications – Results and findings of the project are not only taken from specific practical work, they are also fed directly back into it. In this respect, it can and should provide valuable insights not only for course participants, but also for other universities and/or initiatives.

In the history of labour relations, trade unions have played a major role in protecting the rights of employees and improving their working conditions. They have defended their members against exploitation by employers. They have promoted the establishment of labour legislation, which in some countries is quite comprehensive. They represent the interests of employees in the collective bargaining process. Albertyn describes trade unions as"institutions which advance democracy, co-operation, peaceful resolution of disputes and nonviolent negotiation (and which) are intrinsically worth preserving and protecting".' It is selfevident that a trade union needs strength to achieve these purposes. However, trade unions areweakened by the fact that it is not only union members who enjoy the benefits of their achievements, since non-members do the same and some employees thus try to avoid the burdens of trade union membership. It is therefore understandable that trade unions attempt to decrease the numbers of these so-called "free riders". Besides the pressure that can be brought to bear by fellow employees in the workplace, union security arrangements, such as the closed shop or the agency shop, represent another traditional method of strengthening trade unions. The free rider problem, however, is only one of many arguments used in the debate by those who support the establishment of closed shops.

Childbearing is often associated with employment interruptions in women’s careers. Since 2005, the German federal government has implemented childcare reforms aiming at expanding the suitable infrastructure for children under the age of three, which should facilitate and accelerate the return to employment. The reforms have been a paradigm shift, because they show a shift from a traditional breadwinner family model to a dual earner-carer model. Despite federal leadership in childcare reforms, the characteristics of the care infrastructure in Germany vary by state and over time, which may contribute to different employment-interruption lengths. The study at hand evaluates Germany’s recent childcare reforms regarding the impact on maternal employment by examining relationships between childcare-characteristics -namely quality and availability- and mothers’ employment interruptions. A piecewise-constant exponential model is used to capture the cross-state and over time differences in childcare and their impact on the timing of women’s return to employment within the first three years after birth of their first child. The study uses individual data from the Pairfam 10.0 study and childcare indicators, which are collected by the federal and state’s statistical bureaus. The risk population includes 927 first-time mothers who gave birth between March 2006 and March 2018. Within this period, 525 first-time mothers return to employment within the first three years after childbirth.   A significant positive effect of the childcare reform on maternal employment is revealed. Both the availability expansion and the quality improvements are associated with earlier returns to employment, establishing both institutional and cultural effects of childcare policies. An educational gradient of the effect of childcare quality on maternal employment was tested, but the results were not significant.

This thesis is a study of the problem of subjectivity and prostitution in the Middle Ages. Three legal case studies of unpublished archival material and one chapter focussing on fictional texts from late mediaeval Germany and Switzerland are used to investigate the conditions of prostitutes' subjectification in law and literature. The thesis takes impetus from Ruth Karras's recent articulation of the problem of prostitution and sexuality, seeking to engage critically with her notion of “prostitute” as a medieval sexual identity that might be applied to any woman who had extra-marital sex. In dealing with trial records, it also aims to make a methodological contribution to the study of crime and the problem of locating the individual. Chapters I-III examine the records of criminal cases featuring the testimony of prostitutes, or women who risked such categorisation, to consider the available subject positions both within and outwith the context of municipal regulation. Whilst acknowledging the force of normative ideas about prostitutes as lustful women, these chapters argue that prostitutes' subject positions in legal cases were adopted according to local conditions, and depended upon the immediate circumstances of the women involved. They also consider trial records as a form of masculine discourse, arguing that an anxious masculine subject can be seen to emerge in response to the phenomenon of prostitution. Chapter IV expands this discussion by drawing on literary texts showing how prostitutes prompted concern on the part of male poets and audiences, for whom their sexual agency was a threat which belied their theoretical status as sexual objects. A partir dos pressupostos de que crenças exercem um papel importante na aquisição e aprendizagem de línguas e de que o ensino de línguas tem chegado a uma fase que pode ser caracterizada como pós-métodos, o presente trabalho investiga em que medida um curso interativo e intensivo de alemão atua sobre as crenças dos aprendizes. O curso é baseado nos conceitos da teoria de aquisição de línguas estrangeiras de Stephen Krashen que apresenta uma distinção entre aquisição e aprendizagem e também demonstra que fatores afetivos atuam como um filtro para o aprendizado. Ao mesmo tempo, esta teoria é ampliada com aspectos de outras teorias de aquisição e aprendizagem de línguas. Desta forma o curso oferecido é focalizado na oralidade, aquisição e interação. Dentro do âmbito deste curso são pesquisadas no presente trabalho especialmente as crenças dos participantes do curso a respeito de autonomia, nas aulas de língua alemã e de língua em geral. A investigação aconteceu mediante o critério temporal, verificando-se quais as crenças os participantes possuíam antes e depois do curso. Ao mesmo tempo, o trabalho propõe a identificação de relações entre motivação, expectativas específicas sobre o curso, decisões programáticas dentro do curso e sua percepção pelos participantes. Também foram observados fatores afetivos que influenciam mudanças nas crenças gerais sobre aulas de línguas. No trabalho, investigam-se os pontos indicados mediante questionários, diários de aprendizagem, entrevistas, testes de desempenho e gravações das aulas. Os resultados do trabalho indicaram mudanças nas crenças dos participantes do curso para algumas determinadas áreas. Destacam-se aqui as crenças sobre a língua alemã e, em parte, sobre aulas de línguas. As crenças sobre autonomia não foram alteradas significativamente. Porém as interdependências das várias crenças se demonstraram complexas e múltiplas.
Parting from the supposition that beliefs have a considerable impact on language learning and language acquisition and that language teaching has reached a point that can be characterized as a post-methods era, the present work investigates what impacts an intensive and interactive German language course has on the participants beliefs. The language course in question is based on the theory established by Stephen Krashen and concerns in particular the learningacquisition distinction and the affective filter. Furthermore, this basis is amplified through aspects of other language learning theories. Thus, the offered language course focuses on oral skills, provides language acquisition rather than learning and interaction in the classroom. In the framework of such a course the beliefs of the participants are investigated, especially concerning affective variables and beliefs about the German language, language classes in general and autonomy. The investigation was carried out using questionnaires, interviews, learning diaries, achievement tests and audiotapes of class interaction. The participants beliefs held before and after the course were compared. At the same time, possible relations between motivation, expectations about the course and how the participants perceived the course were investigated. Affective variables throughout the course and how these affect learning and the beliefs of the participants were also investigated. The results of the work indicate that the participants beliefs in certain areas change throughout the course. Especially the beliefs about learning German and the German language seem to have changed. Partial changes were noticed in the beliefs about language learning in general. The course seems not to have an impact on the students beliefs on autonomy. The links between alteration of beliefs, motivations and expectations were found to be complex and diverse.

In this thesis, a literary historic path on the development of the lyric expression of courtly love will be created. The path will take us from the Provence through Germany and Sicily, and up to the Tuscany of the thirteen's century. The poetic characteristics of the hohe Minne and dolce stil novo will be particularly highlighted in order to facilitate the comprehension of their similarities and differences. It is understood that it will not be possible to offer a complete interpretation of the two lyric expressions. Rather, this thesis wishes to offer a basis for the development of further comparative studies between the German and Italian lyric expressions that were inspired by the Provencal courtly love. As representatives of the evolution of the poetry of love in Germany and Italy, Walther von der Vogelweide and Guido Cavalcanti were chosen for the innovative character of their poetry and the artistic quality of the results they achieved.

Le 25 juin 2014, Germain Katanga devenait la première personne définitivement condamnée par la Cour pénale internationale. Dans l'indifférence générale, ce congolais originaire d'un petit village de l'Ituri rentrait ainsi dans l'histoire d'un pouvoir naissant pour avoir fait transiter des armes ayant servi à une attaque contre des populations civiles. A travers une déconstruction étape par étage du cheminement qui a amené cet homme de la chasse aux Okapis à sa condamnation pour crimes de guerre et crimes contre l'humanité, nous avons cherché à comprendre comment une institution créée pour juger les plus grands criminels a pu croiser le chemin de celui qui n'avait auparavant jamais entendu parer de « La Haye ».Dénuée de contrôle social, incapable de jouer le rôle qui lui a été attribué la CPI s'est longtemps défaussée sur les États pour expliquer les échecs de sa première décennie d'exercice. La réalité est plus complexe, et laisse apparaître en creux une incapacité structurelle à agir contre les intérêts de l'ordre étatique et a fortiori des dominants de cet ordre étatique. Après avoir décrit l'institution de l'intérieur, en nous appuyant sur notre propre expérience à la CPI et au ministère des affaires étrangères français, nous avons donc tenté de comprendre de lire la Cour depuis la perceptive hobbesienne ; appuyé sur un travail sur les terrains d'enquête de la CPI en Afrique, plus de cent entretiens avec les principaux protagonistes de l'institution et de l'affaire Katanga, nous avons ainsi suivi le cheminement casuistique inversé, partant de la plus petite échelle de l'institution pour finir par en interroger le sens dans son ensemble
June 25, 2014, Germain Katanga became the first person to be convicted and sentenced by the International Criminal Court. As his case continued to be cloaked in silence, this congolese villager from the remote province of Ituri became a figure in the early history of a rising institution. Through a deconstruction of each stage of the proceedings against Katanga for war crimes and crimes against humanity at the ICC, this work attempts to understand how an institution built to prosecute the masterminds and those most responsible for the gravest crimes and atrocities targeted a 24-year-old Okapi hunter who never before heard of “The Hague”.Lasking social control, unable to play the role for which it was designed more than ten years ago, the ICC has systematically blamed the States for its numerous failures. The reality is more complex, and this research reveals that the institution has a structural incapacity to act against the interests of the state order, and a fortiori against the dominants of the order, therefore rendering obsolete any of its cosmopolitan pretentions. Following from a description of the ICC “from the inside”, based on the author's experience at the office of the Prosecutor and at the French Ministry of Foreign Affairs, this work assesses the Court through a Hobbesian lens. Relying on field work in Congo and the Central Africa Republic, more than a hundred interviews and a novel analysis of Hobbes Leviathan this work takes a bottom-up approach, starting from the smallest scale - from what was considered a minor case – and ultimately questioning the institution as a whole

L’œuvre de l’écrivain suisse Peter Stamm se caractérise par sa diversité. Elle s’adosse à plusieurs genres littéraires. Elle comporte, à côté de romans, de pièces, d’ouvrages jeunesse et de textes poétologiques, une part importante de nouvelles. Classique par ses thèmes essentiels, les relations interhumaines, l’amour, la mort, la prose brève de l’écrivain de langue allemande né en 1963 est intrigante par ses effets, puissants. Les histoires de Peter Stamm ont pour cadre le monde contemporain, la vie au quotidien, présentés sous des traits obéissant à une esthétique mimétique. Cette image spéculaire du réel est contestée de l’intérieur par un réseau obsédant d’éléments imaginaires. Le cours des choses données à voir est ainsi travaillé par des forces contraires. Elles coexistent. La topographie de l’œuvre atteste elle aussi d’une concomitance des contraires. L’ici et l’ailleurs s’y côtoient continûment. Dans le registre de la temporalité, ce sont encore des conceptions ou des catégories opposées qui sont mises en tension : la linéarité et la circularité du temps, l’instant et l’éternité. L’univers des personnages est également marqué par la coexistence de profils très variés et apporte un nouveau témoignage du degré d’ouverture de l’œuvre. Le schéma logique du paradoxe, associant les contraires, figure l’élément structurant majeur de la production nouvellistique de Stamm. Les modèles génériques de la Kurzgeschichte et de la Novelle, théoriquement incompatibles, cohabitent au sein de l’œuvre de la même manière. The work of the Swiss writer Peter Stamm is characterized by its diversity. It relies on several literary genres, including novels, plays, youth books, poetological essays and an important set of short stories. The essential themes are classical : the human relationships, love, death. The brief prose of the German-speaking writer, born in 1963, strikes the reader by its powerful effects. The stories of Peter Stamm take place in the contemporary world, in the everyday life. They are told in the terms of a mimetic aesthetic. The specular image of reality is challenged from within by a haunting network of imaginary elements. Hence, the way of things offered to see is subjected to contrary forces. They coexist. The topography in the work also testifies that opposites do coexist. The notions of here and elsewhere meet continuously. In the temporal field also, opposite conceptions or categories are put in tension: linearity and circularity of time, present moment and eternity. The category of the characters is also marked by the coexistence of very varied profiles and brings another testimony of the degree of openness of the work. The logical scheme of the paradox, associating opposites, is the major structuring element of Stamm's short stories production. The genre models of Kurzgeschichte and Novelle, theoretically incompatible, coexist in Stamm’s world. His texts contain, more generally, tangible traces of a double heritage, referring to both Romanticism and Modernity. The poetic orientation of Stamm's short stories, the way the texts go, can be grasped by exploring all these areas in friction

Der Fokus dieses Beitrages richtet sich auf das 'Erzählen beim Reiten', das hinsichtlich seiner Bedingungen und Funktionalität zu analysieren sein wird. The scope of this thesis in public law discussed the abstract judicial review in Sweden and Germany, which is practiced by a specified organ. In Sweden, the abstract judicial review is practiced by the Council on Legislation, and in Germany by the German Federal Constitutional Court. This study focuses on how the Swedish Council on Legislation and the German Constitutional Court differ in the practice of the abstract norm control. Moreover, a theoretical discussion is applied to regarding whether the Swedish justice system is in need of setting up a constitutional court or whether the Swedish Council on Legislation should be in a stronger position. Throughout this study, we concluded that the Swedish legal system is not in need to establish a Constitutional Court or another organ for the maintenance of an adequate standard norm control in Sweden. To this end, we suggest that the abstract norm control in Sweden by the law's compatibility with the constitution should be strong, but that there may be reason to further strengthen the review of the Council on Legislation. For instance, enhancing the investigation could be done by creating a legal secretariat and subsequently emphasizing the council’s independence from the parliament and government. By reinforcing the council with legal expertise, such as linking draftsmen to the council, can thus make the council’s opinion legally binding.
