Full textThis dissertation argues that the successful establishment of the Reichsgericht, as an integral component of the larger movement towards German legal unity, provides an important example of contemporary struggles between centralization and particularism and between liberal political ideals and political realities in the new German Reich. Between 1806 and 1879 several contemporaries recommended the creation of a national supreme court for the German states. The failure of the pre-1867 court proposals contrasted sharply with the successful proposals of the 1867 to 1879 period. Nevertheless, the negotiations and debates which took place between the various German states, between the federal government and the states, and in the legislative organs of the German state itself, were intense and contentious. The creation of the Reichsgericht reflected several important issues, including the comparative abilities of the various states, the federal bureaucracy and the federal legislature to influence the form and substance of national judicial legislation.
The documentary evidence for this dissertation has been gathered from several archival depositories, including relevant holdings in the Bundesarchiv sections in Potsdam and Dahlwitz-Hoppegarten and the Prussian state archives in Berlin-Dahlem, and from published government and contemporary sources. In addition, unpublished and published secondary sources have been utilized.

Full textIn light of the growing need to establish a coherent relationship between the European Court of Human Rights, the Court of Justice of the European Union and the courts of the ECHR member states, this study explores the challenges of jurisdictional competition that undermine the credibility of the courts and weaken the effectiveness of judicial protection of fundamental rights in Europe, and suggests ways to reduce emerging judicial tensions between these courts. It examines how to avoid inconsistencies in judicial practices of the European and national courts, how to approach accession of the EU to the ECHR, and how to ensure effective functioning of the pilot judgment mechanism and national judicial review procedures. It concludes that in order to coordinate cooperation between the courts it is important to strengthen their interactions through adhering to best practices at all levels. To pursue deeper integration of states into the European and international community and minimise the chance of rendering contradicting judgments by the courts, member states are expected to comply faithfully with their obligations under EU law and the ECHR, and the European courts shall exclude the possibility of encroachment on state sovereignty. Only if mutually agreed solutions are adopted will a greater consistency in their case law be achieved and a uniform system of protection of human rights ensured.

Full textThe Anglo-German naval race was one of the decisive factors in the outbreak of World War I. In particular, the years between 1906 and 1912 witnessed an intense head-to-head competition between the two powers in the building of modern capital ships, that is, battleships and large armoured cruisers, after Dreadnought had been launched by the British. So long as Germany was not prepared to accept British naval supremacy and Britain was not prepared to yield it, the competition was bound to go on until economic exhaustion compelled one side to give up. Germany tried to translate its wealth into military power, but the inefficient nature of its taxation system prevented it from doing so. The fact that Britain's Treasury had the power to both levy and increase direct and indirect taxes, while in Germany only state governments had it shows that Britain's more democratic constitutional system meant that London could react to Germany's naval challenge by punishment, mobilizing a greater share of financial resources for naval spending than Berlin

Furthermore, the cost of litigation in South Africa is immense, which prevents the biggest part of the population from access to justice in line with s 34 of the Constitution of 1996. Therefore, alternative methods of dispute resolution are worth looking into. This paper will compare the mediation system of South Africa with that of Germany. This will allow for a better insight in regard to mediation within South Africa, which can help to address the above stated problems.

Full textUne analyse par cytométrie en flux a montré que 70 à 80 % des cellules avaient un contenu en ADN en 2C. Les cellules dans lesquelles le promoteur était activé étaient en phase G1. Par ailleurs, la comparaison de l'activité du promoteur pleine longueur et de deux fragments délétés dans la partie distale montre que l'activité décroît avec la longueur du promoteur. Enfin, nous avons mis en évidence une corrélation significative entre le taux de parois et l'activité du promoteur. L'activité du promoteur LmGER1 a été évâluée en système homologue à l'aide d'un gène rapporteur au cours du développement. Nous avons pu montré que l'expression du gène était tissu-spécifique et avait lieu tout au long de l'embryogenèse somatique. Cette expression est localisée au niveau de la coiffe racinaire et des procambia vasculaires de l'hypocotyle et des cotylédons de l'embryon somatique. Au niveau des jeunes plants, l'expression de LmGER1 est située dans la nervure centrale des euphylles au niveau du système vasculaire et précisément dans le procambium vasculaire mais nous avons également pu constater une expression au niveau des cellules de garde des stomates. Enfin, une construction provoquant de l'IR-PTGS a été introduite dans des masses embryogènes de mélèze hybride afin d'évaluer l'impact de l'extinction de ces GLPs sur le phénotype embryonnaire. Les lignées embryogènes montrant une forte sous expression du gène se sont montrées incapables de maturer. Nous avons ainsi émis des hypothèses quand au rôle des GLPs dans le contrôle de l'expansion pariétale au sein d'un certain nombre de tissus

Full textIn the history of labour relations, trade unions have played a major role in protecting the rights of employees and improving their working conditions. They have defended their members against exploitation by employers. They have promoted the establishment of labour legislation, which in some countries is quite comprehensive. They represent the interests of employees in the collective bargaining process. Albertyn describes trade unions as"institutions which advance democracy, co-operation, peaceful resolution of disputes and nonviolent negotiation (and which) are intrinsically worth preserving and protecting".' It is selfevident that a trade union needs strength to achieve these purposes. However, trade unions areweakened by the fact that it is not only union members who enjoy the benefits of their achievements, since non-members do the same and some employees thus try to avoid the burdens of trade union membership. It is therefore understandable that trade unions attempt to decrease the numbers of these so-called "free riders". Besides the pressure that can be brought to bear by fellow employees in the workplace, union security arrangements, such as the closed shop or the agency shop, represent another traditional method of strengthening trade unions. The free rider problem, however, is only one of many arguments used in the debate by those who support the establishment of closed shops.

Full textParting from the supposition that beliefs have a considerable impact on language learning and language acquisition and that language teaching has reached a point that can be characterized as a post-methods era, the present work investigates what impacts an intensive and interactive German language course has on the participants beliefs. The language course in question is based on the theory established by Stephen Krashen and concerns in particular the learningacquisition distinction and the affective filter. Furthermore, this basis is amplified through aspects of other language learning theories. Thus, the offered language course focuses on oral skills, provides language acquisition rather than learning and interaction in the classroom. In the framework of such a course the beliefs of the participants are investigated, especially concerning affective variables and beliefs about the German language, language classes in general and autonomy. The investigation was carried out using questionnaires, interviews, learning diaries, achievement tests and audiotapes of class interaction. The participants beliefs held before and after the course were compared. At the same time, possible relations between motivation, expectations about the course and how the participants perceived the course were investigated. Affective variables throughout the course and how these affect learning and the beliefs of the participants were also investigated. The results of the work indicate that the participants beliefs in certain areas change throughout the course. Especially the beliefs about learning German and the German language seem to have changed. Partial changes were noticed in the beliefs about language learning in general. The course seems not to have an impact on the students beliefs on autonomy. The links between alteration of beliefs, motivations and expectations were found to be complex and diverse.

Full textJune 25, 2014, Germain Katanga became the first person to be convicted and sentenced by the International Criminal Court. As his case continued to be cloaked in silence, this congolese villager from the remote province of Ituri became a figure in the early history of a rising institution. Through a deconstruction of each stage of the proceedings against Katanga for war crimes and crimes against humanity at the ICC, this work attempts to understand how an institution built to prosecute the masterminds and those most responsible for the gravest crimes and atrocities targeted a 24-year-old Okapi hunter who never before heard of “The Hague”.Lasking social control, unable to play the role for which it was designed more than ten years ago, the ICC has systematically blamed the States for its numerous failures. The reality is more complex, and this research reveals that the institution has a structural incapacity to act against the interests of the state order, and a fortiori against the dominants of the order, therefore rendering obsolete any of its cosmopolitan pretentions. Following from a description of the ICC “from the inside”, based on the author's experience at the office of the Prosecutor and at the French Ministry of Foreign Affairs, this work assesses the Court through a Hobbesian lens. Relying on field work in Congo and the Central Africa Republic, more than a hundred interviews and a novel analysis of Hobbes Leviathan this work takes a bottom-up approach, starting from the smallest scale - from what was considered a minor case – and ultimately questioning the institution as a whole

Full textThe work of the Swiss writer Peter Stamm is characterized by its diversity. It relies on several literary genres, including novels, plays, youth books, poetological essays and an important set of short stories. The essential themes are classical : the human relationships, love, death. The brief prose of the German-speaking writer, born in 1963, strikes the reader by its powerful effects. The stories of Peter Stamm take place in the contemporary world, in the everyday life. They are told in the terms of a mimetic aesthetic. The specular image of reality is challenged from within by a haunting network of imaginary elements. Hence, the way of things offered to see is subjected to contrary forces. They coexist. The topography in the work also testifies that opposites do coexist. The notions of here and elsewhere meet continuously. In the temporal field also, opposite conceptions or categories are put in tension: linearity and circularity of time, present moment and eternity. The category of the characters is also marked by the coexistence of very varied profiles and brings another testimony of the degree of openness of the work. The logical scheme of the paradox, associating opposites, is the major structuring element of Stamm's short stories production. The genre models of Kurzgeschichte and Novelle, theoretically incompatible, coexist in Stamm’s world. His texts contain, more generally, tangible traces of a double heritage, referring to both Romanticism and Modernity. The poetic orientation of Stamm's short stories, the way the texts go, can be grasped by exploring all these areas in friction
