Abstract:
The present work discusses Geographical Indications, which have increasingly grown in Brazil, becoming of extreme importance for territorial development. With this in mind, this work is aimed at establishing a centrality indicator for municipalities, capable of contributing for Geographical indication, based on the development on the Gross Domestic Product (GDP) of services for promoting local development. The measurement of centrality adopted in this work is based on the arrangement of GDP data on services, according to the Central Place Theory, in which cities are hierarchically organised and some services are only provided by more relevant locations. The database used for assessing the levels of centrality of municipalities were divided into four different groups: participation of the gross value added of services, excluding public administration on the gross value at total current prices; in the state level; in the microregion; in the country. The analysis observed simple structure averages to operationalise the hierarchical ruler, having established that the best route concerned attributing weighting coefficients to the group of indicators through a linear combination algorithm. It is important to point out that the most important tool considered included the Principal Component Analysis (PCA). Accordingly, it was established that a location is an important territory with what concerns the spatial contour, with the service sector (excluding the public service) having an impact on local economy. Therefore, the registration of a Geographical Indication may promote economic development, attributed to the increase in local production, demand and greater added value and, consequently, an upsurge in the generation of jobs and wealth, having a relevant impact in the notoriety of the region.

In addition to the role of government entrepreneurs optimally, proper preparation of human resources is needed. The right human resources will greatly assist in the development of potential geographic indications in Indonesia. As a field of law that is not yet popular among practitioners, academics, and the public, counseling about geographical indications is very important. Academics do not understand and understand about IPR and moreover about geographical indications. Because geographical indication is a new thing in Indonesia. Understanding of geographical indications is new in Indonesia. Understanding of geographical indications requires socialization to prevent violations of these geographical indications. The government's role in increasing geographical indication products in Indonesia is through the government's efforts to increase the utilization of geographical indication products in Indonesia, namely by maximizing the utilization of geographical indications where in this case the government is represented by the Ministry of Industry and Trade (Depperindag), namely by providing guidance and conducting searches and collecting data and forming cross-departmental collaborations that are relevant nationally and internationally. To resolve the unlawful abuse of geographical indications in Indonesia, the government can make its own provisions in the Geographical Indication Law or add articles in the trademark law which explicitly regulates the legal protection of geographical indications which refers to the Monopoly and competition Law. unhealthy business, for fake and misleading goods.

The purpose of this study is to identify the potential of Kahayya coffee so that it can be registered through a geographic indication protection system in order to improve the economy of the local community. Data collection techniques used in this study were observation, interviews and literature study. Then analyzed using descriptive-qualitative technique. The results showed that kahayya coffee has the potential to obtain geographic indication protection because it has the reputation, quality and characteristics required in the protection of geographical indications. Protection of Geographical Indications can improve the economy of local communities and local governments, this can be seen from previous products that have registered geographical indications.

The problem in this research are: 1). Potential geographical indication of what is owned by the District of Demak TambakrotoSayung? 2). What policies adopted to improve the welfare of society through excellence geographical indications in the District of Demak Tambakroto Sayung? This study aims to: 1). Register geographical indications advantages possessed by Tambakroto Sayung District of Demak, 2). Knowing the supporting and inhibiting factors in empowering excellence Tambakroto Sayung geographical indications in the District of Demak, 3). Produce a model of community empowerment based on the superiority of geographical indications in the DistrictTambakroto Demak.This research was carried out by empirical methods juridical approach. The specifications used in this research is descriptive analysis. The location of this research is in DistrictTambakroto sayung Demak. The research data collected by way of interviews, documentation and direct observations in the field.The results of this study is the potential for geographical indications which are owned by the District Sayung the fruit tempe and lontong fruit. Excellence is the product of geographical indication in the form of fruit tempe and lontong fruit known by the name of the tempe and lontong tambakroto. Potential is the potential for geographical indications that have long existed in the district since Tambakroto But this time the potential was nearly extinct where the biggest factor is masyarat nor the relevant local government is not keeping well and not doing it continuously for the potential development of geographical indication. Development and empowerment are preferred to be done in maintaining the geographical indication products Tambakroto District. After that application was made for the protection of geographical indication products. Steps are still far to be done but it is not impossible to do. District policy has not led to concrete Tambakrotoin pengupayaaan, empowerment and development of products of geographical indication Tambakroto District. Initial thing to do is perform on the public understanding of the meaning of Sub Tambakroto importance of geographical indication of products that have been owned by the community such Tambakroto District. Geographical indication of products that have been developed and empowered as optimal as possible will support the welfare of the people own Tambakroto District. Abstract:
Geographical indications and designation of origins is an industrial property right describing a product originated from any region or attributable to any region due to its quality, reputation or other characteristics. Particularly, the geographical indications (GI) provide information about the raw material or final products’ geographical roots to consumers and characterize the degree of its quality. Two types of GI were defined: Protected Designations of Origin (PDO) and Protected Geographical Indication (PGI). On the other hand, the products that cannot be registered as a designation of origin or geographical indication could be registered as Traditional Speciality Guaranteed (TSG) products specialty guaranteed if it can be proven that the product is on the traditional market for at least 30 years. The main goal of this research is to examine Turkey’s current status about labelled geographic agricultural material with a comparative statistic overview.

This paper studies the network structure of geographical indication agricultural products in the field of e-commerce in Sichuan Province, and discusses the joint mechanism of geographical indication brands based on network structure. Taking the geographical indication products as the node, the consumer’s purchase behavior is the connection relationship, and the network structure of the geographical indication products is analyzed from the perspective of consumer behavior, and then the regional brand creation is based on this.This paper constructed a product——product network——brand alliance——regional brand geographical indication agricultural product regional brand creation path. The paper focuses on the resource dependent brand joint behavior based on individual interests, and the joint behavior of geographically dependent brands based on the perspective of regional interests. When the brand joint starting point is based on individual interests, it will tend to choose resource-based agricultural product brands that have strong commodity-related strength and can bring the greatest consumer transformation to themselves; when the brand joint starting point is to promote the regional-based regional economy, it will tend to start from the cluster-based brand alliance, emphasizing the development of a good geographical indication agricultural product brand to promote the development of a geographically-improved GI brand.

Abstract:
The intrinsic importance and value of geographical indications and their special characteristics, which, if protected, would have far-reaching economic, cultural and even political benefits, would justify the need to protect them. The present study descriptively-analytically examined the legal protection of geographical indications nationally and internationally and identified gaps in the protection of signs in Iranian law. The results showed that recognizing a geographical indication, whether through registration, court, administrative decision or other means, is not sufficient to realize the potential benefits of protecting a geographical indication. Also, although protecting a geographical indication is essential, it is not the only condition for its success. Also, although there are several ways to protect a geographical indication in theory, even ancillary laws such as the "Fight against Unfair Competition" and the "Consumer Protection Act" and other similar rules and regulations are among these valuable intellectual assets. They protect. However, there are limitations to their protection in practice, largely due to the wide variety of protection systems associated with these symptoms. It was also observed that despite special rules in some countries and territories with geographical indications, including Iran, there is still no global consensus and a single legal authority to support these indications at the international level fully. Therefore, it is necessary to create a comprehensive geographical indication design for a geographical indication to effectively create brand equity for a product or positively impact rural development or the preservation of traditional knowledge, traditional cultural expressions, or biodiversity.

The research aimed at describing the legal protection concept geographical indication in supporting the economic right of geographical indication holders, the contribution of geographical indication in improving the prosperity of geographical indication holders, and the legal protection of the economic rights of geographical indication about the use of a sign that is similar to a registered geographical indication. This research encompasses the normative legal analysis and empirical research methods. The first problem statement used the normative legal research method, which analyses how the legal protection concept of geographical indication supports the economic rights of geographical indication holders. The empirical research method was used for the second problem statement, which analyses how registered geographical indication contributed to improving the prosperity of geographical indication holders and was also used for the third problem, which analyses the legal protection of the economic rights of geographical indication holders about the use of a sign that is similar a registered geographical indication. The research results indicate the following: (1) the legal protection concept of geographical indication that is integrated into the law of trademark and geographical indication has not supported the economic rights of geographical indication holders, either from the substance aspect or with regards to the stipulated legal sanction; (2) the economic rights of geographical indication holder relation to production monopoly right, sign use, and product marketing has not contributed to the improvement of their prosperity; (3) the legal protection of the economic rights of geographical indication holders about the use of a sign that is similar to a registered geographical indication is still weak, both in the private and public legal enforcement aspects.

The Geographical Indication is an instrument of protection to products and services that have intrinsic value. The cities of Bento Gonçalves, Flores da Cunha, Monte Belo do Sul, Farroupilha, Paraty, Urussanga, Salinas and Abaíra are highlights in the Brazilian agricultural sector. These regions have territorial demarcations with a Geographical Indication certification, where the producers live in the same region and can sell their own products with this seal of quality. An analysis has as a starting point the following study problem: Is the success of the implementation of a Geographical Indication linked to the development of the region? The results showed that only the Gross Domestic Product per capita is not sufficient to prove a record of Geographic Indication was actually implemented successfully in a certain region or not, however it can be observed that in the developed regions the trend is much higher.

Abstract While geographical indications show geographical origin, trade marks show commercial origin. Therefore, it is possible to say that both geographical indications and trade marks have distinctive character. Indeed, when an application is filed to register a geographical indication as a trade mark, an important question is whether the sign is distinctive enough. In such cases, the distinctive character of these commercial and geographical ‘signs’ can overlap and intersect with each other. In this article, the intersection and relationship between geographical indications and trade marks will be evaluated by considering two different scenarios. In the first one, the trade mark application precedes the registration of the geographical indication, while in the second the application for the geographical indication is filed before the conflicting trade mark. The analysis is carried out by taking into account various provisions of the Turkish Industrial Property Code (IPC), the judicial practice of the Turkish Court of Cassation and international regulations. In this context, the relationship between several absolute grounds for refusal in such a situation and which of these provisions is the most applicable will be examined. In particular, an attempt will be made to explain the role of the absolute ground for refusal regulated in the new Turkish Industrial Property Code for the first time, namely that signs containing or consisting of a geographical indication cannot be registered as a trade mark (Art. 5.1(i)).

However, due to the mixed legislative mode of Trademark Act, which includes TrademarkAct,Regulations on the protection of geographical indications andAdministrative measuresfor geographical indications of agricultural products, there are conflicts and confusion in the legal provisions, which is not conducive to the development of geographical indications in China. This paper discusses the protection mode of geographical indications in European Union, the United States and other countries, analyzes the advantages and disadvantages of special law protection, Trademark Act protection and anti-unfair competition law protection mode, and puts forward suggestions that China should adopt special law protection to make better use of China’s rich geographical indication resources in the way of strong protection.

A trademark may constitute a geographical indication and this will result in a conflict between the protection of trademarks and geographical indications. In this article, I will discuss the cancellation of a trademark that constitutes a geographical indication. Trademarks in Jordan can be cancelled through Trademark Law or the Geographical Indications Law. However, there are several differences between the cases of cancellation under the Trademark Law and the Geographical Indications Law. These will be discussed in this article, especially as both Laws have special requirements regarding the persons who are entitled to file the application of cancellation, its grounds, submission period and the application process.

The research method used is normative juridical using secondary data. The law can be one of the tools to protect the regime of Geographical Indications by way of registration as regulated in Law Number 20 of 2016 concerning Marks and Geographical Indications. Article 53 reads: "Geographical Indications are protected after Geographical Indications are registered by the Minister". The main function of law is to protect the interests that exist in society. According to Roscou Pound, there are three interests that must be protected by law, namely: public interest, individual interest and interest of personality. Many local Indonesian assets have not been protected by Geographical Indications and very vulnerable to being exploited by irresponsible parties, one of which is cybersquatting crime by registering a website address on the internet using the name of a geographically indicated product without the right as the legal owner then selling the domain name for expensive price causing losses for local Indonesian assets that have not been registered with Geographical Indications. The problem of this research: How is the legal protection on local assets that have not yet registered as Geogragraphical Indication from cybersquatting crime. The purpose of this research is to find out the legal protection of unregistered local asset as geographical indication product from cybersquatting. The legal research method used is the normative legal research method using the statutory approach and the conceptual approach. The result of the research is the protection of local assets from cybersquatting crimes that have not been protected by Geographical Indications is protected under Article 23 of the ITE Law and for every person whose rights are violated due to cybersquatting crimes, they have the right to file a lawsuit to cancel the unauthorized use of domain names by other parties.

The sample in this study is a non-random sampling method with sample subjects are: Komunitas Perlindungan Indikasi Geografis Salak Pondoh Sleman (KPIG-SPS) community. Primary data used in this research were collected directly in the field through field research, and secondary data collected from the literature study.

Abstract One form of intellectual property that tries to offer legal protection for the origin of a good, commodity, animal, etc. is a geographical indication. In the waterways of Riau Province, there is a species of catfish called Kuansing’s Pangasius kunyit. It is identified as a geographical indication potential of the Kuantan Singingi Regency based on information collected by the Indonesian Communal Intellectual Property National Data Centre. This study aims to investigate the possibility of Kuansing’s Pangasius kunyit being protected as a geographical indication and the efforts made by the local government to support the advantages of Kuansing‘s Pangasius kunyit through geographical indications. This investigation relates to the law. A conceptual methodology is used. The local government was required to support the program in order for Kuansing’s Pangsius kunyit to be certified as a geographical indication.

Purpose Loyalty of customers is an essential factor influencing the development of geographical indication products industry. The purpose of this paper is to construct a model to detect factors influencing customers’ loyalty on geographical indication products. With analysing four teas, i.e., Lu’an Gua Pian, Huoshan Huangya, Huangshan tribute chrysanthemum and Yuexi Cuilan, this paper measures the factors strengthening consumers’ loyalty and examines how much impact these factors have. Design/methodology/approach This paper is characterised as an exploratory research using the grey incidence analysis model and data are obtained by questionnaire survey. Findings In general, result of the analysis indicates that customer’s attitude towards its producing areas, perceived quality and cognition of the protection of geographical indications are the important factors that influence their loyalty towards geographical indication products. Detailed rank of their power that goes from highest to lowest is: customer’s attitude towards its producing areas, perceived quality and cognition of the protection of geographical indications. It also shows that the method of grey incidence analysis is adaptable to evaluate factors affecting consumers’ loyalty, which can make the result more persuasive and objective. Originality/value The authors construct a model from three aspects: customer’s attitude towards the producing areas of geographical indication products, the perceived quality and cognition of the protection of geographical indications. On the basis of this model, the authors analyse the factors which influence customer’s loyalty with grey incidence analysis.

Purpose: Geographical indications (GIs) are considered a type of brand that is shared by companies in the same sector in order to highlight the origin of a product and have its quality recognized. They have been widely used in the wine sector. This study aims to verify whether geographical indications can be considered an internal resource that generates competitive advantage for the Brazilian wine sector. Furthermore, it also aims to: i) understand the purpose of creating a geographical indication; ii) understand the process of creating the geographical indication and the procedure for authorizing its use; iii) understand what are the unique intangible results obtained by a geographical indication; iv) check the vision of the future concerning the geographical indication.Design/methodology/approach: It was conducted in-depth interviews with government agencies, associations, and winegrowers in Rio Grande do Sul/Brazil.Findings: Therefore, GI projects can be resources that are difficult to copy or replace, building knowledge, identifying terroirs, and redefining production practices.Originality/value: It can lead to the achievement of sustainable competitive advantage with increased exports and differentiated products in the market.

The formulation of the problem in this research is how is the trademark legal law for Geographical Indications in the case of Toraja coffee and Gayo coffee registered by other countries? How is the legal settlement of the Violation of Brand Geographical Indications carried out by other Countries against Toraja coffee and Gayo coffee?The specification of this study is Descriptive Analysis. The approach is a normative juridical approach using secondary data obtained through library studies. The data is then analyzed qualitatively and presented in a qualitative descriptive form. Based on the results of research and analysis, answers can be obtained: 1) Legal protection against Toraja coffee and Gayo coffee registered by other countries, namely by registering the trademark to the Director General of Intellectual Property Rights and after obtaining a Geographical Indication certificate from the Director General of Intellectual Property Rights, the geographical indication of a product's brand it gets strong protection. 2) Legal settlement of brand violations and geographical indications of the brand of Toraja coffee and Gayo coffee are litigation methods carried out through the Commercial Court institution, for Toraja Coffee to be carried out at the Ujung Pandang Commercial Court and Gayo Coffee at the Medan Commercial Court.

Various tourism trends have appeared with developing technology. One of them is gastronomy tourism. It is necessary to determine the factors which affect the development of this type of tourism for supply determinants to be successful in marketing activities. Products registered with geographical indication are considered to be one of these elements. In this direction, the purpose of the study is to determine the effects of local food and local products registered with geographical indications on the development of gastronomy tourism. Bolu, which is one of the Turkey’s cities, was selected as implementation area. Data were collected from effective tourists, who visited Bolu, or potential tourists, who have a possibility of visiting Bolu, via questionnaire technique, and 391 questionnaires were reached. Data were solved using statistical package program. Multivariate regression analysis was used to determine the effect of the products registered with geographical indication. According to the research results, the most effective element on the development of gastronomy tourism is local products registered with geographical indications with an impact rate of 60%. The effect of local foods, registered with geographical indication, is 37.7%.

Changes in the tourism sector are the reasons for the development and implementation of adequate approaches to formation of unique enogastronomic tourist routes, related to the use of geographical indication system as a means of individualizing subjects of tourism. Currently, there are counterfeit tourism products labeled with well-known names of geographical regional objects. The significance of the geographical indications in enogastronomic tourism becomes increasingly apparent in terms of intense competition between the regions in the country and on the international tourism market. The objective of the research was to develop theoretical and methodological foundations, scientific and practical recommendations for creating a formation approach to enogastronomic tourist routes based on the geographical indication system. In the research, we used the comprehensive method- ological approach, based on the application of the following research methods: generalization and systematization (to determine the essentials of geographical indications); calculation and analytical (to analyze the conditions of geographical indications registration); process approach (for development of new enogastronomic tourist routes); program-targeted approach (for the algorithm of formation of enogastronomic tourist routes); tabular methods (for presentation of the material). We analyzed the definition of «ethnographic tourism», identified the key problems of registration of geographical indications in Ukraine, proposing a formation approach to enogas- tronomic tourist routes based on the system of geographical indications. In our study, we considered using the European experience in the effective implementation of geographical indications in the Ukrainian regions. The formation approach to enogastronomic tourist routes based on the geographical indications system is proposed, which allows combining national history and culture, traditions of preparing local dishes and drinks, presenting them as a complex tourist product of a certain region.

Geographical Indication (GI) identifies a good/product as originating in a particular region, where a particular quality of the good is attributable to its place of origin. GI will help Jammu and Kashmir producers differentiate the uniqueness of the products from similar competing products, establish brand and goodwill of local products, fetch premium price for such products, and increase sales/export by protecting reputation of the products. The essence of GIs is that specific geographic locations yield product qualities that cannot be replicated elsewhere. GI-registered product is produced using the GI technology. The purpose of this paper is to investigate the status of the geographical indication in the state of Jammu and Kashmir as well as its prospect. The state has so far brought six of its ethnic and region specific products under geographical indication. All of these products belong to only one product category i.e. Handicrafts. The state has huge panorama of using geographical indication for its unique and famous ethnic and region specific products. However, lack of knowledge about intellectual property rights is not giving proper value and recognition to the geographical indication in the state.

The objective of this study is to map articles that present models for determining the territory size of Geographical Indications (GIs), a relevant factor for the management of GIs that is poorly explored in studies on the subject. The study was undertaken as a systematic mapping study (SMS), whose main objective is to identify accessible facts about a given research topic, which is also the most suitable approach when aiming to analyze the state of the art of a subject with little evidence available in the literature. Using the Scopus and Web of Science databases, in which 671 results were found, and the StArt tool to select the articles, 652 articles were excluded (30 duplicates and 622 that did not meet the inclusion criteria established in the systematic mapping protocol). Then, after a complete reading of the texts of the 19 remaining articles, 14 were excluded. Thus, this study included only five articles in which GI size models were developed, the oldest of which was published in 2007 and the most recent in 2021. We therefore conclude that few studies are available in the literature on this theme.

This article discusses the subject of Geographical Indication and level of centrality, by using the hierarchization of municipalities from the Brazilian Northeast region as a tool for discussion and analysis. This article is mainly aimed at hierarchizing municipalities from the Brazilian Northeast region by taking into account their respective contributions to the development of non-public service products between 2002 and 2017, considering five geographical subdivisions (microregion, mesoregion, State, region and country) in the perspective of identifying the level of centrality and a relationship with Geographical Indications. This work is characterised as an exploratory-descriptive research with a quali-quantitative approach, having analysed data from the Automatic Recovery System (SIDRA, in Portuguese) from IBGE (the Brazilian Institute of Geography and Statistics) and considering 1,792 municipalities from the Brazilian Northeast. The results indicate that among the 1,792 municipalities included in the study, 1,028 (57.4% of all municipalities studied) observed an increase to their scores. In addition, the main changes that took place in these municipalities between 2002 and 2017 included the increase in the homogeneity in the region, when regarding the profile of participation in the development of non-public service products from higher geographical subdivisions. With that, it can be stated that the non-public service sector creates a level of hierarchy in the municipalities from the Brazilian Northeast in terms of their volumes, corroborating the assumption drawn in this work that the spatial layout of cities has an effect on the centralities of places, with the territory and its centrality level having an impact on Geographical Indications, as the quality and standardization of products/services represent the result of the combined effort and actions carried out by some groups of local producers in certain territories. This highlights the relationship between this group and the local tradition, typicality and culture, as well as with the physical and climate aspects of the territory, which contributes to its local development.

International community has recognized the superiority and quality of original Indonesian products, as a result, some native Indonesian products are claimed by foreigners as their trademarks, for example Gayo Arabica Coffee and Toraja Coffee. Indonesia in providing protection is a bit behind in seeing the potential of its own region. The research problem is to examine the juridical claims of foreign companies against products with potential Indonesian Geographical Indications, and the settlement mechanism based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Research method used is normative juridical with a statute approach. Claim of foreign companies against products with the potential for Indonesian Geographical Indications is the use of Intellectual Property Rights without rights, based on the MUI Fatwa decision, this is an injustice that is unlawful. The legal settlement mechanism for foreign brand claims against products with potential Indonesian Geographical Indications based on Law Number 20 of 2016 concerning Marks and Geographical Indications is dependent on the violation of the claim, whether the party making the claim is in good faith or not. If at the time a sign is applied for registration as a Geographical Indication, a sign is used in good faith, the party can still use it for a period of two years, but if there is no good faith, it can take the mechanism of filing a lawsuit in the form of an application for compensation against the User of the Geographical Indication without rights.

Abstract:
Purpose The purpose of this paper is to advance our understanding of the links between the representativeness of the local community by those drafting and elaborating the specification of the geographical indication (GI), the market access and the use of the GI. Design/methodology/approach The present study followed a comparative research design, building upon primary data from the field works dealing with the elaboration and development of GIs worldwide, from legislations on the protection of GIs and from secondary data, i.e. literature dealing with the elaboration of the GI specifications at case level or national/international level. Findings The GI is permeable to a multitude of objectives and the management of controversies represent the “price of participatory democracy”, which still needs to be under the umbrella of the justice of peace, the State authority. Representativeness does not necessarily conduct to equity and fairness. It depends on the heterogeneity of the value chain, which might lead to the dilution of the GI specificity. Mandatory membership might not be always the best option Transparency to guarantee the producer’s group works for the common good is essential. Originality/value The controversies in the elaboration of the GI product specification are directly induced by the controversies in the management of the GI either by the collective organisation of producers or by the public authority. Issues such as representativeness, mandatory membership, transparency and heterogeneity of the value chain are deeply analysed to understand the functioning of GI producers associations and their limits. The state intervention as justice of the peace appears necessary.

It is determined under the conditions of modern development of the world economy there is a steady growth of international trade in goods and services that contain an innovative component and are protected by intellectual property rights. It is argued that this ensures the growth of exports of countries with developed market economies and forms a significant component of the national economies of their countries. The main purpose of this article is to study theoretical and practical aspects of functioning of the world intellectual property market. The main trends and features of development of the market for goods with a geographical indication are analyzed. It is noted that nowadays agricultural products of regional origin, which are in high demand due to their unique and original features, are becoming especially relevant. The growth of significance of certified local products and its influence on business development is determined. The main stages of regional branding of local traditional products are characterized and a mechanism for increasing Ukraine’s competitive position on the world market is proposed. The study analyzed the dynamics of indicators related to the use of industrial property in Ukraine, including geographical indications. As a result of the research the importance of economic functions of intellectual property is substantiated and it is proved that the use of its objects is aimed at increasing the competitiveness of an individual enterprise, organization and the State as a whole. The main focus is on the prospects for development and benefits of production of goods with the geographical indication “Melitopol cherry”. It is established that the wide use of means of individualization promotes creation of a healthy competitive environment in the conditions of market economy development. The advantages of using the geographical indication “Melitopol cherry” for Ukrainian producers are determined.

Abstract:
The purpose of this study is to analyze the form of legal protection rights for indications of origin in Indonesia based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications (Trademark and GI Law). Legal protection rights for indications of origin are inseparable from consideration of the economic value inherent in a property. Indications of origin are different from geographical indications, indications of origin are signs that indicate the origin of goods or services that are not identical to natural (geographical) factors. This research is a normative juridical using primary legal materials and secondary legal materials, as well as using prescriptive analysis methods.The results of the study show that legal protection can be provided in the form of preventive and repressive legal protection, however, the legal protection regulation of rights for indications of origin in Indonesia are still relatively very low. Protection of rights for indications of the origin arises with a declarative system that cannot be separated from the rights to the trademark. The right to the trademark is a prerequisite for being able to declare the right to an indication of origin. The period of protection of rights for indications of the following ten years of protection of trademark and can be extended again. Transfer of rights to indications of origin is impossible to do because it is attached to the rights to the trademark and is different from the non-transferability as a geographical indication. Violation of rights for indications of origin can be in the form of use of indications of origin by non-registered users of trademark has been registered with indication of origin. The firmness of the government to provide legal protection in the form of statutory rights for indications of origin is an absolute necessity. The government must be present to provide a regulation as a consequence of the legal state, which means that in carrying out all tasks and activities, it must be based on applicable law.
