Full textThe purpose of this study was to understand how the change of an Official Designation influences wine consumers‟ buying attitude, i.e., have consumers noticed the recent change from “Ribatejo” to “Tejo” and in what way does it affect their wine buying decision. In light of this change it was also studied how the supplied information modifies consumers‟ behavior. Wine is a product characterized by various attributes (brand, price, grape variety, etc.) being the Region of Origin amongst the main ones relatively to the buying decision because it‟s a source of information to the consumer in regard of the product‟s quality. A test took place at a wine store in which the sales were registered and analyzed in order to obtain the necessary conclusions. It was concluded that the change of the Official Designation was accompanied with the lowering of prices. Consumers also preferred the Geographical Indication “Ribatejo” relatively to “Tejo” although the increasing supplied information level attenuated these preferences though without statistical significance because of the price effect that became bigger than all the other factors.

Full textGeographical Indication, a particularly specific distinguishing sign, experienced throughout the XIXth and XXth centuries, under specially scattered national legislations, joint conventions or bilateral agreements, even under the contentious use of legal means to combat unfair competition, different types of useful but limited protection. These latter, supported by the intervention of the European Community, had however the advantage of contributing to make a specific dedicated section emergence possible in the Trip's agreement. This text coming from the Marrakech Agreements which established in 1994 the World Trade Organization (WTO), recognizes in fact the Geographical Indications as an independent law of Intellectual Property. It allows them to rely on a definition and a legal system, and bind the different members of the WTO to their recognition and protection. In asserting a principle of liberty in the implementation of this new system which, contrary to the other rights of Intellectual Property, and particularly of marks, does not apply to a preexisting system, this Agreement has not resulted in a uniform effect but heterogeneity of national situations. In special cases, these situations may have led to a knowledgeable mix or substitution of concepts, particularly because of the Geographical Indications integration into preexisting systems of Intellectual Property such as certification marks. Beyond the recognition of the Geographical Indication definition in these texts, the existence of two types of protection, simple and additional, has also practical consequences on these different integrations

Full textThe adoption of Geographical Indication (GI) certification represents, among other aspects, a way of innovation and a market advantage. Once studies on this area are recent and few in Brazil, this research had as objective to verify the historical, cultural and economic perception of the actors involved in the production chain of Pelotas sweets in relation to the adoption of Geographical Indication certification. The major promotion of Pelotas sweets is through a fair called Feira Nacional do Doce (FENADOCE), which aims at promoting the sweets culture of the region of Pelotas/RS to the country as well as abroad. The fair also plays a significant economic, cultural and historical role. The case study was carried out through a field research with primary data collection by means of search forms applied to Pelotas sweets consumers and to producer companies, that is, 3 producers that have the GI stamp, 3 associated producers without the IG and 3 producers out of the association, all of them that participated in the fair, 21st FENADOCE, between May 31st and June 2nd, 2013. The results reveal that the consumers with more knowledge about geographical identification are more inclined to pay more for a certified sweet. However, the cost plays a secondary role since the consumers are more influenced by the taste and the beauty of the sweets displayed on the shop windows of the sweets stores. In this sense, the geographical identification is seen not only as a historical and cultural review of the traditional sweets heritage, but also, as a quality assurance stamp. Therefore, with this study we can conclude that the adoption of the IG certification brought to the confectioners recognition and commercial success. The consumers started to be sure of consuming a product that maintains the characteristics of its original recipes and, of course, the unmistakable flavor of Pelotas sweets.
A adoção da certificação de Indicação Geográfica (IG) representa, entre outros aspectos, uma forma de inovação e de diferenciação de produtos. Tendo-se em vista que os estudos nessa temática são ainda muito recentes e escassos no Brasil, esta pesquisa objetivou verificar a percepção histórica, cultural e econômica dos atores envolvidos na cadeia produtiva dos Doces de Pelotas em relação à adoção da certificação de IG. A maior divulgação dos Doces de Pelotas é através da Feira Nacional do Doce (Fenadoce), que visa promover a cultura doceira da região de Pelotas/RS para todo o país e exterior. O estudo de caso realizou-se através de pesquisa de campo com coleta de dados primários por meio de formulários aplicados aos consumidores de Doces de Pelotas e às empresas produtoras, ou seja, três produtores que possuem o selo de IG, três produtores sem certificação associados e, ainda, três produtores fora da associação, que participaram da feira, durante a 21ª Fenadoce, entre os dias 31 de maio e 2 de junho de 2013. Os resultados revelaram que os consumidores com maior conhecimento sobre indicação geográfica estão dispostos a pagar mais por um doce certificado. No entanto, a variável preço acaba desempenhando um papel secundário, pois os consumidores são mais influenciados pelo paladar e pela beleza dos doces expostos nas vitrines das docerias. Nesse sentido, a indicação geográfica é percebida não apenas como um aparato ao resgate histórico-cultural da herança dos doces tradicionais, mas também como mais um selo de garantia de qualidade. Sendo assim, pode-se concluir com este estudo que a adoção da certificação de IG trouxe às doceiras da região reconhecimento e sucesso comercial. Os consumidores passaram a ter certeza de estar consumindo um produto que mantém rigorosamente as características de suas receitas originais e, é claro, o sabor inconfundível do Doce de Pelotas.

Local products, recognized as Geographical Indications, are strongly related to the nature, the people, the culture and traditions. From such perspective, they show up as tools to promote the sustainability of the regions where products are made and as an alternative to differentiate and promote local products. This work has been motivated by the studying economic, environmental and social dimensions of sustainability in the development of the collective strategy underway in beekeeping in the western region of Paraná, especially by its contribution to the consolidation of the Geographical Indication. In the case under study, the Geographical Indication was recognized in July 2017 as Indication of West of Paraná product. Coofamel is the representative entity of Apis Africanizada and Jatái bee honey producers from that region. For this purpose, questionnaires were applied to the president of Coofamel and to representatives of partner institutions. These surveys in the field aimed to know the support of partners and beekeepers for the sustainability of the Geographical Indication. Also from a questionnaire, information about the cooperative member's perception about the influence of the cooperative on the dimensions of sustainability and collective actions has been raised. As a main result, a significant support from the regional entities in the promotion of agriculture with low environmental impact has been identified. Along with the supporting entities, beekeepers promote actions to recover degraded areas, by planting native plants, conserving natural resources and biodiversity, among other actions. It has also been noticed that the contribution of the partners and the union of beekeepers made it possible to build and adapt beneficiation structures, to qualify production in the field and in the processing, as well access to the marketplace and to innovation, essential factors for the economic sustainability of the collective initiative. The results showed that the collective action established in beekeeping in the West of Paraná provided greater involvement of the family of producers with the activity and in the promotion of community quality of life. Honey producers in the region have made partnerships with other producer associations, establishing interaction and socialization with actors not only in beekeeping, but in other activities as well. The strengthening of associativism allowed the exchange of information among beekeepers to improve the honey production process. The trainings promoted by the partner entities enabled beekeepers to escape from clandestine commercialization and to offer a safe product for their own consumption and for the marketplace. Thus, collective action has also contributed to the social dimension of sustainability. In view of the above, it is concluded that the strong institutional support contributes strongly to the sustainability and consolidation of the Geographical Indication. However, there was a trend in the increase in the number of cooperative members and the presence of “associated riders”, those who only want to take advantage of the collective effort without making any contribution. Among the recommendations, the attention has been given to Coofamel´s communication with its members in order to ensure the consolidation of the Geographical Indication
Os produtos de origem reconhecidos como Indicações Geográficas guardam forte relação com a natureza, as pessoas, a cultura e as tradições. Nessa perspectiva, surgem como ferramentas para promoção da sustentabilidade das regiões onde se encontram e como alternativa de diferenciação e promoção dos produtos locais. O que motivou realizar esse trabalho foi estudar as dimensões econômicas, ambientais e sociais da sustentabilidade no desenvolvimento da estratégia coletiva em curso na apicultura da região Oeste do Paraná, em especial sua contribuição para a consolidação da Indicação Geográfica. No caso em estudo, a Indicação Geográfica foi reconhecida em julho de 2017 como Indicação de Procedência Oeste do Paraná. A Coofamel é entidade representante dos produtores de mel de abelhas Apis Africanizada e Jatái dessa região. Para tanto, foi aplicada entrevista estruturada ao presidente da Coofamel e questionário junto aos representantes de instituições parceiras. Esses levantamentos no campo objetivaram conhecer o apoio dos parceiros e dos apicultores para a sustentabilidade da Indicação Geográfica. Também a partir de um questionário, levantaram-se informações sobre a percepção dos cooperados a respeito da influência da cooperativa nas dimensões da sustentabilidade e das ações coletivas. Como principais resultados, observou-se um significativo apoio das entidades regionais na promoção de agricultura com baixo impacto ambiental. Em conjunto com as entidades apoiadoras, os apicultores promovem ações de recuperação de áreas degradadas com plantio de plantas nativas, conservação dos recursos naturais e da biodiversidade, entre outros. Foi constatado também que a contribuição dos parceiros e a união dos apicultores possibilitaram construir e adequar estruturas de beneficiamento, qualificar a produção no campo e no processamento, o acesso ao mercado e à inovação, fatores essenciais para a sustentabilidade econômica da iniciativa coletiva. Os resultados demonstraram que a ação coletiva estabelecida na apicultura no Oeste do Paraná proporcionou maior envolvimento da família dos produtores com a atividade e promoção da qualidade de vida da comunidade. Os produtores de mel da região firmaram parcerias com outras associações de produtores, estabelecendo interação e socialização com atores não só da apicultura, mas de outras atividades. O fortalecimento do associativismo permitiu a troca de informações entre os apicultores para melhorar o processo de produção do mel. As capacitações promovidas pelas entidades parceiras possibilitaram aos apicultores sair da clandestinidade na comercialização e ofertar um alimento seguro para o próprio consumo e para o mercado. Assim, a ação coletiva trouxe contribuições também à dimensão social da sustentabilidade. Diante do exposto, conclui-se que o forte apoio institucional contribui fortemente para a sustentabilidade e para a consolidação da Indicação Geográfica. No entanto, foi observada uma tendência no aumento do número de cooperados e a presença de associados carona, aqueles que querem apenas tirar benefício do esforço coletivo sem prestar sua contribuição. Entre as recomendações, colocou-se a atenção da Coofamel com a comunicação dos associados de forma a assegurar a consolidação da Indicação Geográfica.

Full textCoffee presents itself as a commodity of great impact in the agricultural production and basis of exportation of Brazil, and the states of Minas Gerais and São Paulo are important in this context. However, even though Brazil is a global reference regarding coffee production, when it comes to the production of specialty coffee with higher added value, its full acceptance by the greatest consuming markets is still a challenge. In this context, the adoption of Geographical Indications (GI) is presented as an important indicator for a region to be formally recognized in the condition of producer of differentiated coffees. Therefore, it\'s perceived that the participation of the State and other involved agents is fundamental in this process. It\'s important to understand such situation through the perspective of the institutional theory, considering the role of all stakeholders, just as the inducers of isomorphism present in the organizational field. In this way, the present study aimed at empirically studying these relations. For that, in-depth interviews, documental analyses and observation were conducted with varied segments of the agents present in the field, with emphasis on three coffee producing regions: Noroeste de Minas and Matas de Minas, in the state of Minas Gerais, and Alta Mogiana, in the state of São Paulo. All three regions were selected for being the most representative and most convenient for the universe of specialty Brazilian coffees and their high relative degree of institutional development, considering that two of the areas (Noroeste de Minas and Alta Mogiana) already have Geographical Indication (GI), and the third (Matas de Minas) is currently in the process of adopting it. The results of the research indicate a long-lasting experience of the production activity in Brazil, where the institutionalization of an organizational field is presented as a key variable for the enhancement of the coffee markets for the present economical situation, which privileges differentiated quality and consumption experiences. The universe of specialty coffees is, therefore, much more a locus of construction and development of a culture than of the mere production and consumption of a commodity

The protective character against possible counterfeits or imitations, and the aggregation of value to a product are the main purposes of the geographical indication (GI). Moreover, the benefits attributed to its implementation may surpass the commercial level of the producer and enhance the development of the territory, and as well to increase receptive tourism and enhance the cultural heritage. This thesis aims to analyze the effectiveness of the geographical indication as a catalyst instrument for sustainable rural development of the territory, from the perspective of the social actors involved. The method used for the research development was the study of multiple cases, with an exploratory and descriptive purpose in two distinct areas of cheese production: the municipality of Serro, in Minas Gerais State, and in Celorico Beira, Portugal, where the Serra da Estrela cheese is produced. In the period from December 12th, 2015 to April 30th, 2016, in Portugal, and from 22th to 29th, 2016, in Serro - Minas Gerais, there were many research activities. Among them, non-participant observations, photographic records, informal conversations, application of semi-structured interviews with the actors involved in the proposed thematic, technical visits to cheese production units and cultural museums, festivals and fairs related to cheese, all within the geographical boundary of the surveyed geographical indications. The information of applied interviews was analyzed using a content analysis group of techniques, under the perspective of Bardin (2004). The results revealed that in both cases studied, the existence per si of a geographical indication is not capable of promoting sustainable development of the territory, since other factors such as the role of producers, social management in decision making, and a consistent social capital are key to the success of GIs in adding value to the certified product and improving the quality of life for the producers. The Protected Designation of Origin Serra da Estrela cheese, although well known by its quality and tradition, proved to be ineffective in promoting sustainable rural development in the Portuguese territory investigated. The analysis of the effectiveness of the geographical indication of the cheese from Minas studied was not feasible, since the correspondent seal has not yet been implemented. Then, it is responsibility of all social actors presented in this research to transform the current panorama and to make their respective geographical indications true catalyst tools in the sustainable development of their territories.

Ademais, os benef?cios atribu?dos ? sua implementa??o podem tanto transpassar as porteiras do produtor e potencializar o desenvolvimento do territ?rio, quanto incrementar o turismo receptivo e a valoriza??o do patrim?nio cultural. Este trabalho de tese tem como objetivo analisar a efetividade da indica??o geogr?fica como um instrumento catalisador do desenvolvimento rural sustent?vel do territ?rio, sob a ?tica dos atores sociais envolvidos. O m?todo utilizado para o desenvolvimento da pesquisa foi o estudo de casos m?ltiplos, com o prop?sito explorat?rio e descritivo, em dois territ?rios distintos de produ??o queijeira: o munic?pio do Serro, produtor do Queijo do Serro, em Minas Gerais, e o concelho de Celorico da Beira, onde se produz o Queijo da Serra da Estrela, em Portugal. As informa??es das entrevistas aplicadas foram analisadas por meio do conjunto de t?cnicas da an?lise de conte?do, sob a perspectiva de Bardin (2004). Os resultados revelaram que, em ambos os casos estudados, a exist?ncia por si s? de uma indica??o geogr?fica ? incapaz de promover o desenvolvimento sustent?vel do territ?rio, pois outros fatores, tais como, o protagonismo dos produtores, a gest?o social nas tomadas de decis?es e um capital social consistente s?o fundamentais para o sucesso da IG, ? agrega??o de valor ao produto certificado e ? melhoria da qualidade de vida dos produtores. A Denomina??o de Origem Protegida Queijo Serra da Estrela, apesar de sua reconhecida qualidade e da tradi??o que j? possu?a, mostrou-se pouco efetiva na promo??o do desenvolvimento rural sustent?vel no territ?rio portugu?s investigado. Full textO objectivo desta dissertação é investigar se a indicação geográfica pode representar um instrumento de suporte ao desenvolvimento socioeconómico e humano das artesãs da Associação para o Desenvolvimento da Renda Irlandesa de Divina Pastora – ASDEREN, que trabalham com a renda irlandesa. Como metodologia, utiliza-se um estudo de caso baseado em entrevistas a três grupos diferentes de rendeiras e depoimentos de representantes de algumas instituições, públicas e privadas, que têm ou possam vir a ter interface com a ASDEREN. Fica demonstrado que as peças feitas de renda irlandesa precisam alinhar-se a necessidades e gostos dos consumidores sem perder a autenticidade e a originalidade. Capacitar novas artesãs e aperfeiçoar as habilidades das demais são mecanismos que auxiliam a actividade, apesar de não serem suficientes para garantir sua sustentabilidade. É necessário que haja maior impacto da renda irlandesa nos rendimentos familiares, do que se conclui que a indicação geográfica poderá cumprir um papel importante, vinculando os produtos artesanais ao seu território de origem – no caso, Divina Pastora (Sergipe) – e, assim, atraindo clientes interessados neste diferencial. Todavia, para alcançar resultados eficazes, as parcerias da ASDEREN com algumas instituições devem continuar, aliadas à vontade política de promover programas que fortaleçam a renda irlandesa na comunidade e auxiliem no processo de desenvolvimento socioeconómico e humano. Tudo isso em conformidade com a perspectiva de expansão das capacidades do economista Amartya Sen, na qual as próprias pessoas devem decidir o tipo de vida que desejam levar.
This study investigates whether geographical indication may represent an instrument to support socioeconomic and human development of women who are members of the Association for the Development of the Irish Lace from Divina Pastora – ASDEREN and work with Irish lace. The methodological framework consists of a case study based on interviews with three different groups of Irish lace artisans as well as with representatives of public and private institutions which are or might be involved with ASDEREN. This work shows that products made of Irish lace need to be in line with customers’ needs and tastes, maintaining their authenticity and originality at the same time. Capacity building of new artisans and development of experienced artisans’ skills are considered mechanisms which may foster the activity, although they are not sufficient to guarantee its sustainability. Irish lace shall increase its contribute to family income; in this case geographical indication could play an important role by linking handicraft products to their place of origin – Divina Pastora (Sergipe) – and thus leading to attract more customers interested in the differentiated nature of these products. However, in order to achieve effective results, the cooperation among some institutions with ASDEREN should continue along with public policies focused on strengthening the production of Irish lace within the community and supporting the process of socioeconomic and human development. All of this shall be in accordance with the economist Amartya Sen’s capability approach, empowering people to live their lives the way they wish.

Full textA proteção por Indicação Geográfica (IG) tem sido considerada uma ferramenta estratégica de mercado para as organizações comerciais em todo o mundo, trazendo diferenciação de produtos e serviços em relação à concorrência, em um contexto de maior exigência por parte dos consumidores, os quais estão dispostos em adquiri-los pela singularidade, tradição e garantia do modo de produção local. A Lei de Propriedade Industrial brasileira nº 9.279/96 define que a IG é classificada em duas modalidades: Indicação de Procedência (IP) e Denominação de Origem (DO). Diversos estudos sobre IG já foram realizados no Brasil e no mundo descrevendo conceitos, aplicações e casos de sucesso das IG, ressaltando o desenvolvimento e valorização de regiões após conseguir o registro de suas áreas produtoras por IP ou DO. Mas quando se trata de mapeamento de produtos potencias para futuras IG, em setores de grande importância para a economia brasileira, como o agronegócio, observa-se que existe uma lacuna nesse tipo de estudo no Estado de Sergipe, mesmo com a atuação do Ministério da Agricultura, Pecuária e Abastecimento (MAPA) em nível nacional. Considerando que a laranja produzida no Território Sul Sergipano é um produto de destaque na economia do Estado e de representatividade no cenário nacional, este estudo objetiva identificar o potencial que a laranja produzida nessa região possui para ser protegida por IG. O trabalho caracteriza-se como um estudo de caso exploratório de natureza qualitativa. Para atingir os objetivos e responder ao problema de pesquisa, dados foram coletados por meio de pesquisa bibliográfica, documental e realização de entrevistas com 5 (cinco) especialistas em citricultura do Sul sergipano. Esses dados foram tratados e classificados em categorias para análise de conteúdo. O estudo conclui e apresenta elementos que indicam ser a laranja do Sul sergipano um produto com potencial para IG, pois possui história e cultura ligadas ao território, é conhecida e comercializada no estado e fora dele, o que pode configurar uma IP, e também possui qualidades de sabor diferenciadas, por ser cultivada em uma região com características únicas de clima, solo e temperatura, segundo especialistas, o que pode configurar uma DO. Essa região de características únicas se estende até algumas cidades do Nordeste da Bahia. O estudo ainda apresenta um mapa com as áreas de plantio com potencial para demarcação da IG. A implantação de uma IG no Sul Sergipano pode ser uma saída para a retomada de crescimento e desenvolvimento da citricultura na região, organizando produtores para conseguir o registro no INPI e melhorando a gestão dos negócios. Todavia, isso só pode ocorrer se os produtores estiverem unidos e comprometidos com a IG e contando com o engajamento dos governos Federal, Estadual e Municipal e instituições a eles ligadas, como MAPA, Embrapa, Emdagro, Sebrae e apoio da Universidade.

Full textIn Brazil, the search for the certification related to the geographical origin by agribusiness has been increasing significantly. In this paper, we present a revision of the literature which deals with food quality, wine and wine with Geographical Indication (GI), besides a brief approach on the Geographical Indications (GIs) in Brazil and over the world. As a method of work, we conducted a survey among consumers that were members of Brazilian Wine Associations in order to identify their perception towards the Geographical Indications (GIs) for a better comprehension of this device as a strategic tool in distinction of products. We can state in this study that the associate consumer sees the GI in wines as a quality agent very much related to the uniqueness of the product, to the region or country of origin, but not as the agent that will mostly influence in the final purchase decision. Still, according to the interviewed Brazilian associates’ perception, the foreign GIs are more reliable than the national ones and fewer consumers really know about the national GIs when compared to the foreign ones. We understand, after all, that wines with GI have to be presented as an option of high quality fine wine, the one which inspires the consumer’s confidence and brings out the uniqueness, tradition and history of the producing region.

In 2012 the Porto Digital (Digital Port or Digital Harbour), defined as Arranjo Produtivo Local de Tecnologia da Informa??o e Comunica??o (a Local Production Arrangement for Information Technology and Communication) located in Bairro do Recife/PE, received the first geographic indication in the service sector, a tag often conceded to food products. However, it is important to know if this process shall extend its positive effects beyond producers and providers, adding value to the material and immaterial cultural patrimony of the region. Considering that the Porto Digital is a relevant object to advance the discussions on the potentials, limitations and challenges to geographical indications as a tool to territorial development, this work will combine description and analysis of the particularities of the only geographical indication tag in the service sector in Brazil and the attempt to turn it into an instrument to understand geographic indications in a broader and more generalized manner, drawing criteria and hypotheses which could be helpful for future studies in the area. Therefore, this research will (a) analyze the regulatory framework protecting the GIs, the intervening institutions and their roles; (b) reconstruct the process of transformation of Bairro do Recife, from an old business harbor to a modern digital port; (c) understand the association between the process of urban transformation and the process of valuing the cultural patrimony of the territory, crowned by the acknowledgement of the geographic name ? the so-called Porto Digital; (d) characterize the constitutive and organizational aspects of the pre-acknowledgement of the Porto Digital?s GI: the actors involved and their justifications, the composition of the members of the GI, the delimitation of the area, the regulation of the use and the structure of control; (e) point out the similarities and singularities of the case with studies on Brazilian geographical indications.

Full textGeographical indications and designations of origin are distinctive signs with high economic, social and cultural values. Firstly, these names are an important source of income for producers, then they are a quality guarantee for consumers, and finally, they are a tool for rural development of their country of origin and also of protection of its cultural and culinary heritage. Therefore, the legal protection of these names is paramount. To this end, the legislator of the European Union has prescribed, in the European Regulation n° 510/2006 on the protection of geographical indications and designations of origin, formal and substantives rules on the recognition and the protection of these names with ample details. In Lebanon, the Ministry of Economy and Trade has prepared a draft law on the protection of geographical designations largely inspired by the European Regulation. In this context, the agricultural, social and economic characteristics of the country must be taken into account by the Lebanese legislator. Moreover, the reputation of this kind of designations exceeds in principle the national borders of the country of origin. Thus, these designations are now a critical issue in the context of international trade negotiations especially in terms of the agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) which is the reference in this domain

Full textFor a long time, geographical indications have developed as the first trade marks. As the commercial relations become more intensive and complex, geographical indications and trade marks has become two different categories of signs, the registration, protection and usage of which is governed by the rules of intellectual property law. Nonetheless, even though geographical indications and trade marks are different institutes of industrial property law, they coincide in a majority of aspects. First of all, the fore-mentioned signs used in commercial environment coincide in the attributed functions, i.e. both of them perform the functions of distinguishing goods or services, identification of the source of origin, identification of quality and information of customers. In addition to the considered coincidence, geographical indications and trade marks are similar, since both of them must have a distinctive character; furthermore, their forms of expression and term of protection are in coincidence. All above similarities implying a relation between geographical indications and trade marks may determine confusion in the market and infringements of the exclusive rights of industrial property; therefore, legal mechanisms intended for the regulation of the registration, protection and usage of the considered signs have been established to keep the balance between the interests of customers and producers and holders of exclusive rights. The intellectual property protection ensures the ownership and rights to creators and other producers of intellectual goods and services in what concerns to the elements of knowledge and information. The geographical indication, is a constituent part of the intellectual property rights, it protects goods or services with characteristics attributed to their geographical origin, such as reputation, quality and tradition. The main goal of this work was to verify the perception of the Brejo Paraibano cachaça producers with regard to obtaining the geographical indication seal. The case study methodology was applied to achieve the goal. The research data was collected and analyzed through qualitative research techniques, such as interviews and documentary analysis. The research targeted the producers of cachaça from the Brejo Paraibano micro region. The methodological instrument used in the data analysis process was the content analysis in three chronological poles: pre-analysis; exploration of the material; treatment of the results, inference and interpretation. With regard to the results, it was possible to verify that the researched sugar cane mills produce cachaça in the traditional way, preserving its identity, even when seeking modernization through technology. The producers highlight this identity and claim that consumers attribute quality to the product as a result of belonging to that specific territory. The producers also mention that there is a differential for the characteristics peculiar to the region. It was clearly observed the producers interest in obtaining the geographical indication seal to add value to the product and to strengthen the whole sector. Even though the producers do not possess an in-depth knowledge about the topic, they believe that the Brejo Paraibano micro Region has the necessary attributes for recognition. In order to achieve that, it is essential that producers and actors involved in the process cooperate with each other. However, the region's culture is not favorable to cooperation, being necessary a process to raise awareness among producers. Finally, the study aimed to contribute to the enrichment, enhancement and dissemination of the geographical indication theme in Brazil, with the intention to contribute to the protection of regional culture and tradition.
A proteção da propriedade intelectual garante a titularidade e o direito a criadores e outros produtores de bens ou serviços de natureza intelectual, referindo-se a elementos de conhecimento e informação. A indicação geográfica, parte constituinte da propriedade intelectual, protege bens ou serviços com características atribuídas a sua origem geográfica, como reputação, qualidade e tradição. Este trabalho teve como objetivo verificar a percepção dos produtores de cachaça do Brejo paraibano com relação à obtenção do selo de Indicação Geográfica. Para alcança-lo, aplicou-se a metodologia de estudo de caso. Assim, os dados foram coletados através de pesquisa qualitativa, mediante entrevistas e análise documental. Os sujeitos da pesquisa foram os produtores de cachaça da microrregião do Brejo paraibano. Já o instrumento metodológico utilizado no processo de análise de dados foi a análise de conteúdo, em três polos cronológicos: pré-análise; exploração do material; tratamento dos resultados, inferência e interpretação. No que se refere aos resultados, foi possível verificar que os engenhos pesquisados produzem cachaça de maneira tradicional, preservando a identidade, mesmo quando buscam a modernização por meio da tecnologia. Os produtores exaltam essa identidade e afirmam que os consumidores atribuem qualidade ao produto por pertencer a esse território, eles também demonstram que existe diferencial referente a características peculiares a região. Ficou claro o interesse dos produtores em obter o selo para agregar valor ao produto e fortalecer o setor, mesmo não dispondo de conhecimento aprofundado sobre o tema, eles acreditam que o Brejo possui atributos para o reconhecimento. Para isso, é fundamental que os produtores e atores envolvidos no processo estejam dispostos a cooperar entre si. No entanto, a cultura da região não é favorável à cooperação, sendo necessário um processo de sensibilização junto aos produtores. Por fim, o trabalho buscou contribuir com o enriquecimento, valorização e disseminação do tema no Brasil, com a intenção de colaborar com a proteção da cultura e tradição regionais.

Full textO agronegócio tem importante contribuição no superávit da balança comercial brasileira. A União Européia e os Estados Unidos estão entre os principais destinos dos produtos agrícolas, com uma participação de 31,4% e 14,2%, respectivamente. Os consumidores, principalmente europeus, têm se mostrado motivados em exigir maior transparência em relação aos produtos agroalimentares, devido à própria natureza destes produtos e às freqüentes crises alimentares. Assim, torna-se importante a segmentação de mercado baseado em informações sobre origem do produto e/ou processo de produção para diferenciação e agregação de valor, pois sistemas agropastoris baseados em escala e vinculados à produção de commodities se enfraqueceram frente a estes mercados. Dentro deste contexto, uma alternativa de desenvolvimento para certas regiões é considerar especificidades regionais/locais do território como determinantes de sua identidade, base do conceito de indicações geográficas. Este cenário possibilita uma oportunidade para os produtores localizados na APA do Ibirapuitã, historicamente a região está vinculada à pecuária, decorrente do suporte dos campos naturais ao desenvolvimento desta atividade, que marcou a tradição, história e cultura do gaúcho. O meio natural, portanto, caracteriza atributos intrínsecos específicos para produtos provenientes deste, sendo um aspecto importante nas Indicações Geográficas. Deste modo, o sistema de indicações geográficas, seja utilizando uma abordagem de Indicação de Procedência ou Denominação de Origem, é uma alternativa de desenvolvimento pela perspectiva territorial da região. A mesma está inserida numa unidade de conservação reconhecida legalmente por suas características pecualiares vinculadas à localização no Bioma Pampa, o que legitima a atividade de produção animal extensiva. O desenvolvimento do protótipo de um sistema com uma base de dados georreferenciada ocorreu pela necessidade de obtenção, neste primeiro momento, da localização dos produtores em relação aos limites APA do Ibirapuitã e de dados sobre recursos sócio-econômicos, objetivando obter um conhecimento prévio da área em estudo. A extensão geográfica - característica da área - associada à complexidade e diversidade de características dos sistemas agrários requer, sempre que possível, o uso de instrumentos e tecnologias disponíveis ao levantamento e análise de informações, processo que pode ser facilitado com a utilização de imagens de satélites, aplicação de fichas de levantamento adequadas à região e pelo uso de técnicas estatísticas para o tratamento dos dados. Analisando sobre estes aspectos, os resultados preliminares do protótipo desenvolvido foram adequados aos objetivos propostos, pois possibilitou a facilidade de armazenamento e obtenção de resultados baseados na análise dos dados, além da facilidade de localização destes produtores em relação aos limites desta unidade de conservação. Finalmente, as indicações geográficas podem ser utilizadas, não apenas como instrumentos para acesso a mercados, mas também como uma ferramenta de desenvolvimento rural, no sentido da valorização dos territórios, principalmente para os pequenos produtores que possuem forte vinculação com o local de origem, história e cultura. Esta relação espaço-tempo oferece a riqueza de seu patrimônio natural e histórico-cultural, ou seja, sua tipicidade fundamental à diferenciação de sua produção. Esta abordagem permite proteger e valorizar a origem de um produto e/ou processos de produção, e convertê-las em fator de diferenciação e agregação de valor, além de garantir produtos identificados de acordo com parâmetros pré-estabelecidos no que se refere principalmente a questões ambientais, sociais e sanitárias, alternativa às novas barreiras presentes nas atuais negociações econômicas.

Full textAmong the main coffee producing areas in Brazil, there is the Circuito das Águas Paulista - CAP. Due to its soil and climate characteristics, temperatures between 13°C and 26°C and altitudes up to 1,400 m, the region consists of nine districts of the \"Serra da Mantiqueira\" and has great potential for producing high quality coffee. Thus, the objective of this study was to characterize the coffees of different cultivars of Coffea arabica L. produced in two altitude ranges of the CAP region from semi-structured interviews with farmers and physical, chemical and sensory analysis. The experimental design was completely randomized, based on the interaction between environment (two altitude ranges - below and above 1,100 m) and genetic (cultivars: Yellow Catucaí, Red Catuaí, Obatã, Mundo Novo, Yellow Bourbon, Yellow Icatu and Iapar). The results were submitted to ANOVA (F test) and Tukey test (p <0.05) (chemical and sensory analysis). In addition, the sensory data (SCAA and ADQ) were subjected to Hierarchical agglomerative clustering and Principal component analysis, and the analysis of frequency of ADQ quotes were submitted also to Cochran test. There were significant differences (p <0.05) between samples for all analyzes. Among the samples analyzed, five were classified as \"special\" (SCAA), with scores of up to 84.42 and all were classified as Gourmet (ADQ), highlighting the attributes: floral / fruity, acidity, sweetness and body pronounced, and nutty / hazelnut, highlighting the unique features of the CAP coffees. As for the cultivars, Obatã samples showed the highest scores (high quality); the Mundo Novo, intermediate notes, with the aroma pronounced and less astringency drink; and Yellow Bourbon, smaller notes. As for the altitude, there was influence on acidity, because of the samples grown below 1,100 m showed higher values of this attribute, however without negative interference proven in the final quality of the drink. In addition, it also influenced the caffeine, because the samples Yellow Catucaí, Red Catuaí, Obatã and Yellow Bourbon grown below 1,100 m showed higher values. The Yellow Bourbon showed higher levels of chlorogenic acids and the samples prepared by the wet method, higher trigoneline content, caffeine and chlorogenic acids (Yellow Catucaí and Obatã) in relation to dry ones, and higher and intermediate grades in analysis sensory (except for the Yellow Bourbon). In short, the CAP region has potential for production of specialty coffees, with unique characteristics, involving tradition, history, culture and environmental aspects. However, interference may have occurred in the production process of some of the samples analyzed in this study.

A emergência das Indicações Geográficas (IGs) deve ser compreendida dentro das transformações que têm afetado o setor agroalimentar na aurora do século XXI. No centro destas mudanças está a transição entre uma economia de escala para uma de escopo e a (re)valorização da dimensão espaço-territorial-local na lógica de (re) produção do capital. Isto tem levado os governos e os setores privados, em especial os ligados à produção familiar, a verem nas IGs uma ferramenta importante em projetos de desenvolvimento territorial. O objetivo desta pesquisa consiste em analisar o projeto de Indicação Geográfica para o Queijo do Marajó e seu uso como estratégia de desenvolvimento territorial para a microrregião geográfica do Arari-Marajó/PA. Para tanto, realizamos pesquisa bibliográfica, documental e de campo, tendo como recorte espacial os munícipios de Soure, Salvaterra e Cachoeira do Arari, no Marajó. Buscamos no método dialético os elementos que fundamentaram os procedimentos metodológicos utilizados nesta pesquisa. Como resultado, a pesquisa identificou que a assimetria socioeconômica e de poder entre os produtores de queijo apresentam-se atualmente como limitadoras ao uso da IG enquanto um instrumento de desenvolvimento territorial. A atenuação destas assimetrias perpassa pela elaboração de uma política pública em que se reconheça e valorize o saber-fazer do Queijo do Marajó, como um patrimônio coletivo do povo marajoara, fator fundamental na construção de uma concertação territorial que subsidie processos de desenvolvimento territorial.
The emergence of Geographical Indications (GIs) must be understood within the transformations that have affected the agrifood sector at the dawn of the 21st century. At the center of change lies the transition from an economy of scale to a scope and a (re)appreciation of the spatial-territorial-local dimension in the logic of (re)production of capital. This has led governments and private sectors, especially those linked to family production, to see GIs as an important tool in territorial development projects. The objective of this research is to analyze the Geographical Indication project for the Marajó’s cheese and its use as a territorial development strategy for the Arari-Marajó (PA) geographic microregion. In order to do so, we perform bibliographical, documentary and field research, having as spatial clipping the municipalities of Soure, Salvaterra and Cachoeira do Arari, at Marajó. The elements that grounded our methodological procedures were sought in the dialectical method. As a result, the research identified that socioeconomic and power asymmetry among cheese producers are currently limiting the use of GI as a tool for territorial development. The attenuation of these asymmetries runs through the elaboration of a public policy in which Marajó's cheese is recognized and valued as a collective patrimony of the people from Marajó, a fundamental factor in the construction of a territorial solution that supports the processes of territorial development.

Full textOlive oil is a vital component of the Mediterranean diet, hence Lebanese, owed to its well-known economic and nutritional value. Several environmental, agricultural, and technological factors play an essential role in defining olive oil's quality. In Lebanon, preliminary studies on the quality of extra virgin olive oil have shown that certain quality criteria exceed the International Olive Council's (IOC) standards. However, the causes of such non-conformities have not been clearly identified. Accordingly, ninety-six olive oil samples have been harvested from two seasons, processed using different extraction methods, and collected from eight locations (Akkar, Chouf, Hasbaya, Koura, Tyr, Nabatiyeh, Zgharta, and Hermel). These locations are identified by the European Union to have potentials for Protected Geographical Indications (PGI). In this perspective, and to meet the European framework's requirements, the analyzed oil will be subjected to conventional chemical analysis as suggested by the IOC and to ultra-fast analysis using 3D-front face spectroscopy (3D-FFFS) and ultra-flash gas chromatography (Ultra-FGC).A correlation between the fatty acid profile and the pedoclimatic conditions of the main olive growing regions in Lebanon was noticed. Three main pedoclimatic conditions, altitude, temperature, and relative humidity, were the major influencers and the reason for the distinctive fatty acid profile of the Lebanese olive oil. Lebanese areas with high altitudes, low average temperature, and low relative humidity have high oleic acid content. As for areas with lower altitudes, higher average temperature, and higher relative humidity, the fatty acid profile was characterized by linoleic, linolenic, palmitoleic, and palmitic acids. In addition to the environmental factors, agricultural ones, particularly the harvest date, had affected the chemical constituents of olive oil. The results obtained showed that the harvest date strongly influenced acidity and total polyphenols. A change in the fatty acid profile characterized by a higher linoleic and lower oleic content, an increase in ∆^7-stigmastenol exceeding the limit set by the IOC standards, and a dominating off-flavor compound (ethanol) was noticed as a result of delaying the harvesting time. Besides, two technological factors, particularly improper fruit storage, and bad hygienic practices, significantly affected olive oil’s quality parameters and fatty acid content.3D-FFFS and Ultra-FGC were used in-line with conventional analysis, and they both showed an undeniable performance. 3D-FFFS coupled with chemometric tools, namely multiple linear regression (MLR) applied on parallel factor (PARAFAC) scores and partial least squares (PLS), was tested on inconsistent qualities of olive oil samples to predict quality parameters. Twenty-two MLR models were generated, the majority of which showed a good correlation coefficient (R>0.7). A second model using PLS on the unfolded emission-excitation matrices was also conducted to improve the regression and assess whether the variability can be handled successfully. However, similar results, with a slight improvement over the MLR model, were obtained. As for Ultra Flash GC, it made it possible to identify, in only a few minutes (< 2 min), ethanol, (E,E)-2,4-decadienal (organoleptic defect), and 1-hexanol (fruity, grassy) as the main volatiles characterizing the Soury variety.This study offers the potential to disseminate an analytical control plan that links environmental aspects in Lebanon and cultivation/harvesting techniques to olive oil's resulting physicochemical characteristics. Such a matrix incorporating rapid analysis techniques will facilitate governance over the end product's final quality and, subsequently, conformity to IOC standards. O trabalho visa discutir as histórias de vidas e memórias associadas a produção da Renda Irlandesa de Divina Pastora (SE), com recorte temporal entre 2000 - 2017, período que culminaram a obtenção de dois títulos de grande importância para as rendeiras daquela região, sendo eles: o modo de fazer a Renda Irlandesa de Divina Pastora (SE) como Patrimônio Imaterial Brasileiro (2009) e a Indicação Geográfica (2012). No Brasil a Renda Irlandesa foi o sexto produto na categoria artesanato a receber a Indicação Geográfica (IG) na modalidade indicação de Procedência e em Sergipe no período da pesquisa o único a receber o título concedido pelo Instituto Nacional de Propriedade Industrial-INPI. O título recebido confere ao produto um destaque de qualidade, indicando que a região contemplada produz um produto ou serviço de qualidade, garantida por um selo fixado no produto, o processo de solicitação da IG exige o cumprimento de várias etapas e comprovação que os produtos e serviços prestados são característicos da região. No caso das rendeiras de Divina Pastora ainda não há nenhum trabalho que historicize o processo de solicitação da IG. Para dar fôlego a pesquisa, a metodologia aplicada se constituiu do método de análise de fontes históricas, onde foram analisados documentos como livros de atas da Associação para o Desenvolvimento da Renda Irlandesa (ASDEREN), o processo de solicitação de IG de Divina Pastora (SE), Ofícios e relatórios do Sebrae- SE referentes ao artesanato em renda de Divina Pastora, leis, decretos, documentação digital constante na Biblioteca Nacional, dentre outros documentos, além da realização de entrevistas semi-estruturadas, aplicação de questionários e análise dos dados coletados. Como resultado da pesquisa foram apresentados dados que relacionam a história das rendeiras protagonistas da atividade artesanal de bordar rendado denominado Renda Irlandesa no município de Divina Pastora (SE) e a titulação de IG concedida pelo INPI.

Full textGeographical indications (GI) are intellectual property institutions applicable to assets and services characterized by their place of origin (gathered, produced, or manufactured) and involve specific environmental, historical and socio-cultural issues. According to the Brazilian regulations, they are divided into two types: indication of origin and designation of origin. Several advantages are attributed to the GIs such as their use as a tool for legal protection (for both producer and consumer), as market tool for differentiation and unlocking value of registered and related products, as a mechanism of preservation (of natural, cultural and historical assets, both tangible and intangible), and as mechanism of social and economic development. In the latter meaning, the development of Tourism often figures as an emerging activity, to which is attributed the capability of intensifying issues such as generation of jobs and income, and the permanence of the rural population, the capability of reinforcing the geographical indications, or as factor to foster the interest in obtaining the GI. The geographical indications are set as public policies of intellectual protection aimed at sustainable development; however, it is important to consider the complex relations and variety of players existing in the territorial system resulting from their proposition. In this manner, the present work seeks to analyze the territorial system formed by the implementation of a geographical indication. The proposed research is to be fulfilled by means of the case study of a region with a cheese indication of origin (Serro, Minas Gerais), with a systemic, soft system methodology-based approach. This methodology proved the most indicated to understand complex systems which present multi-players and inter-relations, such as the object in perspective. These are exploratory-descriptive, quantitative and qualitative-biased research efforts. Data gathering involved document analysis, direct observation during visits to the studied region, interview (with 14 subjects), and questionnaire (that obtained 103 valid responses). The analysis was predominantly done by means of content analysis and descriptive statistics. The N-Vivo software was used in the content analysis and data triangulation, and the Visio software was used in the rich figure construction. Its main theoretical background is Public Policies and Territorial Development, although the proposal is interdisciplinary since it also includes subjects regarding Law and Tourism, among other. The territorial system formed by the implementation of a geographical indication is particular to each case. The one of Serro is characterized by the participation of local, regional, federal and international instances. The obtained results indicate that the registration of indication of origin on its own it is not enough to generate all the aspects of territorial development attributed to the GIs\' proposal. There are some elements of the territorial development that might have been stimulated by the registration process. They refer to aspects of human, economic and social capitals. Concerning touristic use of the GI, we found favorable attitude to activities related to cheese, also the existence of consumption, during and after the visit, although there is a lack of knowledge about the GI. Full textO tema da tese é a paisagem em sua especificidade vitícola, analisada como representação espacial no processo de construção do espaço geográfico da vitivinicultura e no uso da imagem da paisagem vitícola como imagem espacial dos vinhos das regiões das Indicações de Procedência (IP’s) Vale dos Vinhedos, Pinto Bandeira e Monte Belo, Brasil. O objetivo foi explicar a paisagem vitícola como representação espacial das regiões e analisar a imagem da paisagem vitícola como símbolo espacial para os vinhos das IP’s, cujas bases teóricas estão na Geografia Crítica e na Geografia Cultural. A organização do espaço geográfico das regiões das IP’s insere-se no contexto da colonização italiana, da qual a vitivinicultura é elemento cultural. O desenvolvimento da vitivinicultura regional levou à implementação de IP’s e ao uso de imagens de paisagens vitícolas, pelas associações de produtores, para construir o vínculo espaço/região-topônimo-vinho. A análise das paisagens das regiões revelou seis tipo e um subtipo em duas formas de paisagens vitícolas tradicionais e cinco tipos de paisagens vitícolas modernas, incluindo elementos emblemáticos naturais e construídos, entre os quais se destaca a Araucaria angustifolia e o uso do Platanus acerifolia para sustentar os vinhedos, herança da tradição vitícola etrusca. A análise das imagens de paisagens vitícolas usadas pelas associações evidenciou que há diferenças significativas sendo, a maioria, de paisagens vitícolas tradicionais. As associações das IP’s Vale dos Vinhedos e Monte Belo estabeleceram vínculos diretos entre espaço/vinho/paisagem, mas não IP Pinto Bandeira. A pesquisa evidenciou que a paisagem vitícola é um símbolo representacional do espaço regional e do vinho das IP’s Vale dos Vinhedos, Pinto Bandeira e Monte Belo.
The theme of this thesis is the landscape in its specificity vineyard analyzed as a spatial representation in the building process of the geographical area of viticulture growing and the use of image of vineyard landscape as spatial landscape of the wine of the regions of Geographical Indication (GI’s) Vale dos Vinhedos, Pinto Bandeira and Monte Belo, Brazil. The objective was to explain the use of vineyard landscape as spatial representation and the images of vineyard landscape as spatial symbol for the wines of GI’s. The theoretical sources to analyze are related to the Critical geography and with the Cultural geography. The organization of the geographic area of the regions of GI’s comes within the context of the Italian colonization process in which its culture was part of the cultivation of vines. The vineyard regional industry development took the conditions of implementation of GI’s, whose producers associations begun to use images of landscape wine to build wine-region-toponym. The landscape analysis revealed six types of traditional wine-growing landscapes and a subtype of landscapes and five types of modern wine landscapes, occurring in both natural and constructed features characteristic among these was the Araucaria angustifolia and the use of Platanus acerifolia in support of the vineyards, and is the Etruscan wine growing tradition. The analysis of the landscape vine images used by associations showed that there are significant differences; the most are images of traditional vine landscape. The association of GI’s Vale dos Vinhedos and Monte Belo established direct links of wine-region- landscape, but not IG Pinto Bandeira. The survey showed that landscape is a representational symbol of regional area and of the wine of GI’s from Vale dos Vinhedos, Pinto Bandeira and Monte Belo.

Full textDesde a Antiguidade os signos distintivos são utilizados para identificar e diferenciar a origem de bens, ou para indicar a propriedade de um produto, sua origem comercial ou geográfica. Verifica-se que, ao longo da história, tem havido avanço na construção e consolidação do uso desses signos no âmbito internacional, em especial, para o produto que mais tem sido identificado com sua origem: o vinho. Desta forma, o que se objetiva neste trabalho é verificar como tem-se dado tal avanço e quais resultados podem ser constatados no âmbito da proteção de signos distintivos de origem. Para isso, o texto é dividido em duas partes. Como introdução, analisa-se a evolução histórica do uso desses sinais, desde a Mesopotâmia, passando pela Grécia e Roma, onde se elaboravam os vinhos de Falernun, assim como o bronze de Corinto e o mármore de Carrara. Na Idade Média, tiveram origem a marca coletiva e a marca certificação, provenientes das corporações de ofício. Essa prática se expande com o Mercantilismo, consolida-se com a Revolução Industrial e modifica-se com a Revolução Francesa, que sinaliza o nascimento da marca individual para produtos e, posteriormente, para serviços. Com base nessa evolução, a primeira parte é dedicada a uma análise comparativa da evolução legislativa de tradicionais países vitivinícolas localizados na Europa – Portugal, França, Espanha, Itália, Alemanha e Inglaterra –, bem como de países oriundos do Novo Mundo Vitivinícola – Estados Unidos da América, Chile, Austrália e Brasil. O escopo é verificar o quanto a regulação interna desses países está harmonizada. A segunda parte busca examinar a evolução dos tratados internacionais com o propósito de compreender como eles têm regulamentado esses signos. Avaliam-se acordos bilaterais; acordos multilaterais, como a Convenção União de Paris, o Acordo de Madri, o Acordo Lisboa e o TRIPS; acordos regionais, como a Comunidade Europeia, MERCOSUL, TLCAN, CAN e possíveis acordos birregionais. A finalidade é ponderar se há harmonia entre suas concepções acerca da indicação geográfica e refletir sobre o possível desenvolvimento de suas negociações futuras. Como resultado, constatase que há certo equilíbrio entre as normas internas dos países analisados. Algums estabelecem a proteção de forma positiva, por meio do registro ou reconhecimento de “appellation d’origine controlée”, indicação geográfica, indicação de procedência, denominação de origem, área vitícola americana, marca coletiva e marca de certificação. Outros realizam a proteção de forma negativa, fazendo uso da repressão à falsa indicação de proveniência, com base no direito de concorrência e na proteção ao consumidor. Muitos combinam essas duas formas. Nos acordos internacionais, verifica-se uma evolução e um alargamento do conceito de indicação geográfica, o que abrange, harmonicamente, as definições dos países analisados. Todavia, os acordos bilaterais e regionais tendem a promover uma uniformização da definição e da forma de proteção desses signos. Como os acordos multilaterais têm sido permeados pelos acordos bilaterais e regionais, esses ciclos têm resultado em um avanço gradativo da consolidação da proteção aos signos distintivos de origem, embora não tenham alcançado uma uniformização no seu modo de proteção. Conclui-se que, nas negociaçoes internacionais em curso, especialmente na Rodada Doha, no âmbito da OMC, pode-se projetar avanço efetivo nesta consolidação, não no curto, mas no médio prazo, posto que é dessa forma que as relações internacionais, no âmbito da propriedade industrial, têm-se firmado nos últimos dois séculos.
Since ancient times, distinctive signs are used to identify and differentiate origin of goods, or to indicate ownership of a product, its commercial origin or geography. It appears that, throughout history, there has been some progress in the construction and consolidation of the use of these signs in the international arena, particularly for the product which more has been identified through its origin: the wine. In this sense, the aim of this work is to see how it has been given such advance and what results can be found under the protection of distinctive signs of origin. For this, the present study is divided into two parties. As an introduction, it is explored the historical evolution of the use of these signals, since the Mesopotamia through Greece and Rome, where the Falernun wines were elaborated, as well as the bronze of Corinth and the Carrara marble. In the Middle Ages, the collective brands and the marks of certification were created by the guilds. This practice was expanded with Mercantilism, consolidated with the Industrial Revolution and changed with the French Revolution, which indicates the birth of the individual mark of goods and, subsequently, of services. Based on this evolution, the first part of this paper is devoted to a comparative analysis of the legislative developments of traditional wine producing countries located in Europe - Portugal, France, Spain, Italy, Germany and Britain - as well as countries from New World wine - USA, Chile, Australia and Brazil. Our proposal is to verify how much the internal regulation of these countries is harmonized. The second part of this paper aims to examine the advancement of the international treaties, in order to understand how they have regulated the distinctive signs of origin protection and register. The bilateral agreements, the multilaterals agreements, such as the Paris Union Convention, the Madrid Agreement, the Lisbon Agreement and the TRIPS, and regional agreements such as the European Community, MERCOSUR, NAFTA, CAN, and possible bi-regional agreements were evaluated in this section. The intention is to evaluate whether there is an harmony between these conceptions of geographical indication expressed in these normative frameworks, and to reflect on the possible development of the future negotiations. As a result, it appears that there is some balance between the internal rules of countries analyzed. Some of them provide protection in a positive way, by register or recognition of the appellation d'origine contrôlée, geographical indications, indications of origin, denomination of origin, in the American viticulture area (AVA), collective marks and marks of certification. Others protect in a negative way, using repression mechanisms against the false indication of origin, based on competition law and consumer protection. Many combine these two forms. Besides, in the international agreements, there is an evolution and an extension on the concept of geographical indication, which covers, harmonically, the definitions of the countries examined. However, bilateral and regional agreements tend to promote uniformity of definition and forms of protection of these signs. As the multilateral agreements have been permeated by bilateral and regional agreements, such cycles have resulted in a gradual consolidation of the distinctive signs of origin protection; although they have not reached standardization in the form of protection. It concludes that, in the on going international negotiations, especially under the Doha Round in WTO, we can forecast effective progress in this consolidation, not in a short term but in a medium one. It is in this sense that international relationships between the industrial property arena have been based in the last two centuries.
Desde la antigüedad los signos distintivos se utilizan para identificar y diferenctar el orígen de las mercancías, o para indicar la propiedad de un producto, su origen geográfica. Parece que, a lo largo de la história, se ha avanzado en la construcción y consolidación del uso de estos signos en la arena internacional, especialmente para el producto que ha sido más identificado con su origen: el vino. Por lo tanto, el objetivo de que esta investigación es ver cómo se le ha dado tal avance y los resultados que se pueden encontrar bajo la protección de signos distintivos de origen. Para ello, el texto se divide en dos partes. A modo de introducción, se explora la evolución histórica de la utilización de estos señales desde la Mesopotamia hasta Grécia y Roma, donde se elaboraban los vinos de Falernun, como el bronce de Corintio y mármol de Carrara. En la Edad Media, los gremios deran origen a la marca colectiva y marca de certificación. Esta práctica se expande con el mercantilismo, consolidado con la Revolución Industrial. Con la Revolución Francesa hay un cambio de la marca colectiva y el nacimiento de la marca individual. Sobre la base de esta evolución, la primera parte desta exposición está dedicada a un análisis comparativo de la evolución legislativa de los vinos tradicionales produzidos en los países situados en Europa - Portugal, Francia, España, Italia, Alemania y Gran Bretaña -, así como los países del Nuevo Mundo Vitivinícolas - Estados Unidos de América, Chile, Austrália y Brasil. El ámbito de aplicación es verificar hasta que punto los reglamentos internos de esos países están armonizados. La segunda parte visa examinar la evolución de los tratados internacionales con el fin de entender cómo se han regulado estas señales. Serán evaluados los acuerdos bilaterales, los acuerdos multilaterales, como el Convenio de París, el Arreglo de Madrid, el Arreglo de Lisboa y el Acuerdo sobre los ADPIC, así como acuerdos regionales como la Comunidad Europea, el MERCOSUR, el TLC, la CAN y los posibles acuerdos bi-regionales. El estúdio consiste en examinar si hay armonía entre sus concepciones de la indicación geográfica y investigar el posible desarrollo de sus futuras negociaciones. Como resultado, parece existir cierto equilibrio entre las normas internas de los países examinados. Alguns hacen la protección de una manera positiva a través del registro o el reconocimiento de la denominación de orígen controlada, la indicación geográfica, la indicación de procedencia, la denominación de origen, la zona vitivinícola americana, la marca colectiva y la marca de certificación. Otros hacen la protección de una manera negativa, haciendo uso de la represión a la declaración falsa de orígen, sobre la base de la legislación sobre competencia y protección de los consumidores. Muchos combinan esas dos formas. De otro modo, en los acuerdos internacionales, existe una evolución y una concepción ampliada de la indicación geográfica, que cubre, armónicamente, las definiciones de los países examinados. Sin embargo, los acuerdos bilaterales y regionales tienden a promover la uniformidad de la definición y forma de protección de esos signos. Como los acuerdos multilaterales han sido permeados por los acuerdos bilaterales y regionales, esos ciclos se han traducido en un acercamiento gradual a la consolidación de la protección a los signos distintivos de orígen, aunque no han llegado a una uniformidad en la forma de protección. Llegamos a la conclusión de que, en las negociaciones internacionales en curso, especialmente en la Ronda de Doha en la OMC, podemos percibir un progreso real en esa consolidación, en definitiva, pero en un mediano plazo, ya que, así como ocurió en la relación internacional en el ámbito de la propiedad industrial, se ha consolidado en los últimos dos siglos.

A produção de doces na cidade de Pelotas, RS é antiga e tradicional, o que a tornou conhecida como a “Capital Nacional do Doce”. Ainda hoje, esta produção ocorre de forma artesanal e não existe uma forma sistemática de controle para assegurar a qualidade sanitária destes produtos. O Programa Alimento Seguro (PAS) tem a finalidade de reduzir os riscos de contaminação dos alimentos, reduzindo o risco das Doenças Transmitidas por Alimentos aos consumidores. Este estudo objetivou avaliar a qualidade dos doces tradicionais de Pelotas com selo de Indicação Geográfica (IG) quanto à composição centesimal, qualidade sanitária e interferência do PAS sobre estes parâmetros. Verificou-se a conformidade com a legislação vigente destas empresas aplicando check list. Foi realizada a avaliação sensorial dos doces tradicionais para verificar qual o preferido entre os consumidores. As caracterizações microbiológicas foram realizadas conforme as metodologias descritas em APHA (2001) e a composição centesimal conforme Adolf Lutz (2010). A avaliação microbiológica, em geral, apresentou resultados de acordo com a legislação vigente, exceto em três amostras. Após intervenção realizada, onde foram feitas adequações das condições higiênico-sanitárias da empresa B, foram coletadas novas amostras e foi possível a comprovação da influência positiva desta intervenção. O PAS influenciou positivamente com relação à melhoria das condições higiênico-sanitárias da empresa A, que possui o programa, além de auxiliar na identificação de pontos de controle necessários. Com relação à composição centesimal, estas diferem conforme a formulação, porém estas mudanças são amparadas pelo regulamento técnico dos produtores e o PAS não exerceu nenhuma influência, pois o fato de possuir o selo de IG já impõe regras para a produção dos doces e registro das matérias-primas utilizadas na fabricação.
The production of sweets in the city of Pelotas, Brazil is old and traditional, which became known as the "National Sweet Capital". However, this production occurs by hand and there is no systematic control to ensure the health quality of these products. The Safe Food Program (SAP) aims to reduce food contamination risks, reducing the risk of Foodborne Diseases consumers. This study aimed to evaluate the quality of traditional sweets of Pelotas Geographical Indication seal (IG) as to their composition, quality healthcare, and interference of PAS on these parameters. There was compliance with current legislation these companies applying checklist. Sensory evaluation of traditional sweets was performed to verify the preferred among consumers. The microbiological characterizations were performed according to methods described in APHA (2001) and the chemical composition as Adolf Lutz (2010). The microbiological evaluation, in general, was compared according to the current legislation, except in three samples. After the intervention performed, where adjustments were made of hygienic and sanitary conditions of the company B, were collected new samples and proof of the positive influence of this intervention was possible. PAS positive influence with respect to the improvement of sanitary conditions of the enterprise, which has the program, and help identify necessary control points. With respect to composition, they differ depending on the formulation, but these changes are supported by the technical regulation of producers and PAS did not exert any influence, because the possession of a GI seal already imposes rules for the production of sweet and recording raw materials used in manufacturing.

Full textThis thesis evaluates the economic impact of quality-related-to-origin policies using evaluation methods adapted to the specificity of such certifications, in particular, the spatial dimension. First, we analyze the effect of a Protected Designation of Origin (PDO) adoption on price and production costs of PDO milk producers in Franche-Comté using a Geographic Regression Discontinuity (GRD) design. Secondly, we use propensity matching methods to analyze regional heterogeneity in Auvergne, Rhône-Alpes, and Franche-Comté before focusing on the effect of the PDO adoption at a national level. Finally, we evaluate the effect of the adoption of a Protected Geographical Indication (PGI) on prices paid to Colombian coffee producers using synthetic control methods. Overall, we find that PDO and/or PGI adoption is associated with positive effects on farmers' economic performances. However, these effects are not homogeneously distributed

Full textO mercado de consumo incorporou com mais força uma antiga prática de atribuir a determinados produtos apreciações de valores que vão além da relação custo benefício. Este sistema de valoração é baseado na certificação da qualidade de produção, diferencial do produto acabado e nas propriedades que ligam respectivos produtos a um conjunto de saberes próprios de uma comunidade localizada geograficamente. A esta certificação denomina-se de Indicação Geográfica (IG), que podem ser sob a modalidade de Denominação de Origem (DO) ou Indicação de Procedência (IP). Neste sentido este trabalho objetivou analisar se o queijo de coalho de Nossa Senhora da Glória/SE, considerando as condições de produção e a percepção dos produtores, preenchem os requisitos básicos para uma obtenção de uma IG. A questão é se as fabriquetas de queijo de coalho do município pesquisado estão preparadas para a obtenção da IG, junto ao Instituto Nacional de Propriedade Industrial (INPI). A pesquisa é caracterizada como bibliográfica, de campo e estudo de caso, com base de análise quantitativa e qualitativa. Aplicou-se uma amostragem não probabilística por conveniência, utilizando o questionário estruturado e entrevista como instrumentos e aplicados na amostra de 24 fabriquetas de queijo de coalho. Os dados quantitativos foram tratados sob o método estatístico descritivo. Os resultados evidenciaram que as fabriquetas em sua parte são gerenciadas por homens (87,5%) e 91% com baixo nível de ensino. Evidenciou-se também que as fabriquetas em sua maioria (95,84%) não fazem parte de qualquer entidade representativa. Os proprietários (95,84%) mostraram que o saber-fazer do queijo foi transmitido de geração a geração. 70% destinam sua produção para os intermediários e, no mercado externo, maior parte ao Estado da Paraíba. Os resultados demonstram que 100% das fabriquetas se localizam geograficamente na zona rural e que estas (83,33%) desconhecem as normas e padrões sanitários estabelecidos pelo setor. Sobre as Boas Práticas de Fabricação (BPF’S), 98% responderam que não as conhecem e à estrutura da fabriqueta não atende as normas e padrões sanitários. Todos os proprietários nunca ouviram falar sobre a IG, porém tem interesse de fazer parte do processo de reconhecimento e registro de IG.

Full textThis thesis assumes that the externalities caused by lack of information about the safety of our food are caused mostly by lack of information, which characterizes a market failure, in which the latter cannot coordinate integration between the various players in this market, as producers and consumers, exporters and importers, what economists call the information asymmetry. Lack of information increases transaction costs, since consumers do not have access to perfect information about the products they consume, with damage costs will have to investigate the origin of the food they are buying. This theory also applies to the costs of informational asymmetry that producers face, since they also need to know about the origin and quality of inputs they use in production, so that the product certification and seed emerges as a solution to the problem of information asymmetry. According to the theoretical framework of New Institutional Economics, contracts assist in the reduction of transaction costs in the operation of an economy, and the informational asymmetry is one of these transaction costs, which causes a market failure. For this study we analyzed the possible certification as an inhibitor of such asymmetric information, since this is also a contract that the producers of some good firm with a public or private institution with a commitment to meet pre-established norms and that the information on the origin, quality, validity and other important features are exposed in the certification seal of the product, inspiring confidence for potential buyers of the product and possibly raising the value-added product. For this study examined the case of a possible certification of geographical indication for the bean seeds produced by an association of producers in the floodplains of river Javaés, arm of the Araguaia River, in the municipality of Lagoa Confusion in the state of Tocantins, where he addressed the potential economic benefits for producers and local economy of the region and the sustainability and environmental impacts that the intensive cultivation in tropical wetlands can cause to the ecosystem of that region.
Esta dissertação parte do pressuposto de que as externalidades causadas pela falta de informação sobre a segurança dos alimentos são causadas, na maioria das vezes, por falta de informações, o que caracteriza uma falha de mercado, na qual este último não consegue coordenar a integração entre os diversos atores neste mercado, como os produtores e consumidores, exportadores e importadores, o que os economistas denominam de assimetria informacional. A falta de informação faz aumentar os custos de transação, visto que o consumidor não tendo acesso à informação perfeita sobre os produtos que consomem, terão prejuízos com custos na investigação da origem do alimento que estão comprando. Essa teoria também se aplica aos custos da assimetria informacional que os produtores estão sujeitos, pois estes também precisam saber sobre a origem e qualidade dos insumos que utilizam na produção, desta forma a certificação dos produtos e sementes surge como solução para o problema da assimetria informacional. Segundo o arcabouço teórico da Nova Economia Institucional, os contratos auxiliam na redução de custos de transações presentes no funcionamento de uma economia, e a assimetria informacional constitui um desses custos de transação, o que causa uma falha de mercado. Para este trabalho analisamos a certificação como uma possível inibidora dessas informações assimétricas, já que também se trata de um contrato que os produtores de certo bem firmam com uma instituição pública ou privada com o compromisso de cumprir normas preestabelecidas e que as informações sobre a origem, qualidade, validade e outras características importantes estarão expostas no selo de certificação do produto, inspirando confiança para os potenciais compradores do produto e possivelmente elevando o valor agregado do produto. Para este estudo foi analisado o caso de uma possível certificação por Indicação Geográfica para as sementes de feijão produzidas por uma associação de produtores nas várzeas do rio Javaés, braço do rio Araguaia, no município Lagoa da Confusão no estado do Tocantins, onde se abordou os possíveis benefícios econômicos para os produtores e economia local da região e a sustentabilidade e impactos ambientais que o cultivo intensivo em várzeas tropicais pode provocar para o ecossistema daquela região.

Full textIn the context of the debate on approach towards geographical indication protection (the choice between sui generis or trademark regime), this thesis aims to deepen the reflection on what approach is needed for China. It asks one question: if it is true that the concept of terroir underpins the French and European sui generis regime of GIs, why does the sui generis regime, when transplanted in China, gets only a cold reception, despite of the fact that China is endowed with a large number of products with a strong tradition and anchored in the terroir of their place of origin? This question leads us to: retrace the history of how the notion of GIs, along with the sui generis laws governing them, emerged in Europe and was transplanted to China; demonstrate the extent to which the European approach is adopted in China, through conducting a comparative study of the laws in France, the EU and China; show the setback that the transplanted sui generis regime has suffered; analyze the reasons leading to this setback; and finally, loot at the option of the future of China’s sui generis regime. Our suggestion is that the status quo of the sui generis regime needs changing. China should give clear preference to the sui generis regime, as opposed to the regime of collective and certification marks

Full textA crescente competitividade observada em diversas atividades do setor primário exige das organizações e associações de produtores capacidade de planejamento, elaboração e execução de estratégias capazes de promover o alcance dos objetivos e metas organizacionais. A partir do entendimento que esse cenário competitivo eleva a Indicação Geográfica como uma estratégia de diferenciação, esse trabalho buscou mapear as condições potenciais de gestão e planejamento da produção frutífera no Assentamento Marrecas mediante solicitação de Indicação Geográfica para a Uva. A pesquisa de campo foi realizada em uma área de plantio de uva da variedade Benitaka para analisar as características físico-químicas do solo, além da coleta de dados dos parâmetros meteorológicos que podem interferir na qualidade das uvas, tais como temperatura e umidade relativa do ar, precipitação pluviométrica e insolação total, identificados a partir da visita à estação meteorológica convencional de São João do Piauí e complementada por informações no site do Instituto Nacional de Meteorologia [INMET]. Sob o ponto de vista da gestão, foram realizadas visitas ao Assentamento Marrecas para conhecer suas estruturas organizacionais e identificar o papel das associações na administração e comercialização da produção, buscando perceber a capacidade gerencial de uma futura Indicação Geográfica para a produção de uva. As informações obtidas revelam que a interação entre os fatores edafoclimáticos de São João do Piauí e a disponibilidade de recursos hídricos para irrigação proporcionam excelentes condições para uma produção de uvas diferenciada, apresentando potencial de certificação por Indicação Geográfica, seja Indicação de Procedência ou Denominação de Origem. Além disso, foi verificado que o associativismo representa uma estratégia de cooperação efetiva para melhorar as condições de concorrência dos produtores assentados, a exemplo da Associação do Produtores com Irrigação do Assentamento Marrecas [APIM], que desenvolve diversas atividades no âmbito da viticultura, como elaboração do planejamento anual da produção, comercialização e gestão dos recursos financeiros. A capacidade de planejamento, organização e liderança da APIM, somada a uma estrutura organizacional enxuta e eficiente, sinalizam a predisposição da associação para gerir a possível Indicação Geográfica da produção de uva.

Full textO trabalho realizado teve como objetivo levantar informações e características que pudessem demonstrar o potencial do aratu, pequeno crustáceo de cor avermelhada, que vive em manguezais e está incorporado à gastronomia do nordeste brasileiro, produzido em Santa Luzia do Itanhy/SE, para o registro de indicação geográfica. A indicação geográfica é um instituto jurídico que faz parte do mecanismo da propriedade intelectual, e se traduz em uma importante ferramenta na busca da proteção e valorização de bens vinculados a seu território de origem. Embora o termo indicação geográfica tenha um conceito jurídico recente, possui origem remota, já que desde tempos imemoriáveis os homens buscam por produtos e serviços advindos de determinada região. A indicação geográfica é matéria tratada no âmbito internacional e existem diversos tratados e acordos que versam sobre a matéria, sendo o principal deles o Acordo sobre Direitos de Propriedade Internacional relacionados ao Comércio (ADPIC). No Brasil, a indicação geográfica é regulamentada através da Lei número 9279/1996, em seus artigos 176 a 182, cabendo ao Instituto Nacional de Propriedade Industrial (INPI) estabelecer os procedimentos e condições relacionados ao registro. A indicação geográfica é um dos poucos instrumentos jurídicos do país capaz de proteger os saberes tradicionais, e agregar valor aos produtos advindos deste conhecimento, inserindo-os em diferentes nichos de mercado e assim contribuindo para o desenvolvimento rural sustentável. A pesquisa de campo concentrou-se no povoado Rua da Palha, situado na zona rural de Santa Luzia do Itanhy/SE e teve como foco a pesca do aratu, atividade protagonizada pelas mulheres, que a desempenham há gerações, através das práticas e conhecimentos tradicionais adquiridos por meio da ancestralidade. Embora ao longo da pesquisa tenham sido reveladas características que apontem a potencialidade do aratu para o registro de indicação geográfica, identificou-se, também, que para que essa possibilidade se viabilize, será necessário percorrer um longo caminho, que só poderá ser trilhado através do suporte governamental.

Full textGeographic Indications (GI s) do not have uniform treatment in the world-wide doctrine what is reflected in the diverse manifestations about it as demonstration of itself, therefore in each place the institute is treated as peculiar and unique. Even in only one country GI s have, many times, different treatments. We understand Law ex facto oritur jus (from the fact law is born) and from that, we create our agreement of what it is happening in the domain of the Geographical Indications. Geographical indication is a set of words that aims to transmit only one concept, but in fact, it apparently transmits two disconnected concepts that are not: 1 - Geographical indication is the official nomination of one certain place where a Good of the same name occurs and is typical, regional and peculiar with guarantee of origin and with traditional and recognized quality for the loyal, responsible and constant repetition. 2 - Geographic indication is the typical, regional and peculiar Good, with a certain name officially recognized as originating of a place, region or country, named differently but granting quality, reputation and characteristic recognized for the loyal, responsible and constant repetition. Geographic indication is for the target of this work the sort from which flows out the two types: Indication of Source (IS) and Appellation of Origin (AO). It must be noticed that in the same region or place the two types can coexist, that is, a same place can present Indication of Source and Appellation of Origin, depending. An Indication of Source is a local manifestation of more generic character; an Appellation of Origin is a local manifestation of very typical character and, consequently, more generous. Beyond these trouble makers factors there are others: the doctrine does not deal with and does not even mention the several internal classifications of quality that permeate a Geographical Indication and tint it; it insists only on the mention to Geographical Indication, Indication of Source and Appellation of Origin as if it was enough, without informing that almost always there is a proper qualitative internal system of each Geographical Indication, system that enlarges, accentuates or diminishes the classic divisions into Geographical Indication and its species Indication of Source and Appellation of Origin with which it always coexists, case by case
Indicações Geográficas (IG s) não têm tratamento uniforme na doutrina mundial o que se reflete nas diversas manifestações a respeito fazendo do tema uma demonstração de si mesmo, pois em cada lugar o instituto é tratado como peculiar e único. Mesmo dentro de um país as IG s têm, muitas vezes, tratamentos diferentes. Entendemos que em Direito ex facto oritur jus (do fato nasce o direito) e daí criamos nosso entendimento do que se passa no domínio das Indicações Geográficas. Indicação Geográfica é um conjunto de palavras que visa transmitir um só conceito, mas, na realidade, transmite dois conceitos aparentemente desconexos entre si, mas que não são: 1 - Indicação Geográfica é a nomeação oficial de um local certo em que se dá Bem do mesmo nome e que seja típico, regional e peculiar com garantia de procedência e com qualidade tradicional e reconhecida pela repetição leal, responsável e constante. 2 - Indicação Geográfica é o Bem típico, regional e peculiar, com nome certo e reconhecido oficialmente como originário de local, região ou país nomeado diferentemente, mas que lhe confere qualidade, reputação e característica reconhecida pela repetição leal, responsável e constante. Indicação Geográfica é para o escopo deste trabalho o gênero de que defluem as espécies Indicação de Procedência (IP) e Denominação de Origem (DO). Remarque-se que na mesma região ou local podem conviver os dois tipos, ou seja, um mesmo local pode apresentar IP s e DO s, dependendo. A IP é manifestação local de caráter mais genérico; a DO é manifestação local de caráter muito típico e, assim, mais generoso. Além destes fatores motivadores de confusão há mais outros: a doutrina não aborda sob nenhum prisma e nem sequer menciona as diversas classificações internas de qualidade que permeiam uma IG e dão-lhe matiz; insiste apenas na menção à IG, IP e DO, como se isto bastasse, sem avisar que quase sempre há sistema classificatório qualitativo interno e próprio de cada IG, sistema esse que expande ou acentua ou diminui as clássicas divisões em IG e suas espécies IP e DO com as quais sempre convive, caso a caso
