Abstract:
L'objet de la these est la mesure de la specificite des polices generales et speciales en droit administratif francais. La premiere partie porte sur les caracteres de la competence de police generale et sur ceux de la competence de police speciale et verifie que ces deux appelations recouvrent deux realites juridiques differentes. Ainsi la police generale apparait fondee sur une norme implicite d'habilitation: l'ordre public general, qui lui confere certaines caracteristiques (caractere conservateur, liberal et general de l'habilitation, pour agir dans la mesure necessaire a la satisfaction de l'ordre). La police speciale est toujours fondee sur un texte expres ayant au moins une origine legislative. Elle manifeste l'affirmation de la puissance publique dans les limites du principe de specialite. La deuxieme partie porte sur la specificite du regime de chaque competence. Elle demontre que les polices ne presentent pas une specificite totale l'une par rapport a l'autre et que l'exercice de la police dans son ensemble voit sa specificite s'amenuiser par rapport au reste de l'activite administrative. On remarque ainsi une faible specificite des decisions de police, que le controle juridictionnel de la legalite est largement adapte a la nature de chaque police et qu'il s'est maintenue une relative specificite du regime de la responsabilite
The aim of the thesis is to evaluate the specificity of general and special polices in french administrative law. The first part studies the characteristics of the competence of general police and those of the competence of special police, and acertains that these two expressions represent two different legal realities. Thus the general police appears to be based on an implicit standard of empowerment general public order, which gives it certain characteristics (the conservative, liberal and general character of the empoverment, to act insofar as the preservation of order requires). The special police is always based on an explicit text, which has at least a legislative origin, it represents the assertion of public power within the limits of the principle of specialty. The second part deals with the specificity of the regime of each competence. It shows that the polices do not present an entire specificity (with respect to one an other) and that the exercise of the police as a whole sees its specificity diminish with respect to the other administrative activities. Therefore we notice a small specificity in the decisions of the police, that the jurisdictional control of legality is amply suited to the nature of each police and that a relative specificity of the regime of responsability is maintained

La tesi di ricerca analizza uno dei problemi più rilevanti: l’elusione fiscale sulla fiscalità diretta effettuata a livello europeo, tra l'uso abusivo delle libertà europee. Il punto di partenza è lo stato della legislazione fiscale nell'Unione Europea come conseguenza della difficoltà di raggiungere una vera e propria armonizzazione giuridica come risultato del cosiddetto veto fiscale. L'origine del cosiddetto ostacolo è la mancanza di un interesse fiscale comune tra gli Stati membri. La politica fiscale è un’area strategica per tutti gli Stati, quindi è impossibile legiferare accontentando tutti. Questa situazione costituisce un ostacolo al processo di integrazione giuridica ed economica e allo sviluppo del Mercato Interno, è per questo motivo che la Corte di giustizia europea, attuando in qualità di uno dei principali attori in quello che viene chiamata l'armonizzazione negativa e in pro di tale integrazione regionale, è valutato quelle libertà verso una interpretazione protezionista. Questa interpretazione protezionista è quella impiegata dagli operatori economici come strumento abusivo verso il quale eludere il complimento della norma fiscale nazionale. In questa situazione e con il fine di ottenere un sistema fiscale giusto, vero ed efficace, considerammo che il modo migliore per affrontare queste pratiche non è altro che attraverso l'uso della dottrina sul divieto del abuso del diritto europeo elaborata dalla Corte di giustizia, permettendo agli Stati membri di legiferare disposizioni che limitino l'esercizio delle libertà europee. Il problema dell'impiego della riferita teoria come strumento anti-elusivo si trova nella natura giuridica di essa. Questa è stata qualificata come principio interpretativo e non come un principio generale del Diritto Europeo, quindi se vogliamo utilizzarla come strumento anti-abuso bisognerà essere codificata negli Ordinamenti nazionali sotto forma di clausola generale anti-abuso mediante cui consentire all'autorità tributaria corrispondente ad agire di conseguenza. Codificazione che dovrà essere conforme al Diritto Europeo.
This thesis examines one of the most important problems in the tax arena: tax avoidance on direct taxation at European level, through the abuse of fundamental freedoms. The starting point is the state of tax law in the European Union as a consequence of the difficulty of reaching a real legal harmonization in this area as a result of the so-called veto. The origin of this obstacle is the lack of a common fiscal interest between Member States. Fiscal policy is a strategic area for all States, so it is impossible to legislate pleasing everyone. This remains an obstacle to the legal and economic integration process and development of the Internal Market. For this reason, the European Court of Justice, as a major player in what is called negative harmonization, has estimated those freedoms through a protectionist interpretation. This protectionist interpretation is that one used by taxpayers as an abusive instrument to elude the compliment of national tax regulations. In this situation and with the aim of obtaining a fair, real and effective tax system, we considered that the best way to deal with these practices is through the use of the doctrine on the prohibition of the abuse of European law adopted by the Court of Justice, allowing Member States to legislate provisions which restrict the exercise of the European freedom. The problem of the use of that theory is its legal nature. It was qualified as a principle of interpretation and not as a general principle of European law, so if we want to use it as anti-abuse provision, it must be codified in the national legal systems as a general anti-abuse rule according to the requirements established by the European Court in the aforementioned doctrine.

Depuis 1921, date a laquelle kaluza elabora une theorie unitaire pentadimensionnelle, qui realisait une unification des champs gravitionnel et electromagnerique; les essais de construire une theorie unitaire, au sein d'une structure geometrique pour l'univers de dimension superieure a quatre, se sont multiplies. Cette voie a ete confirmee par l'apparition de la theorie de supergravite. Des lors, il fallait regarder tous les parametres de la relativite generale classique dans des varietes pseudoriemanniennes de dimension arbitraire. Ce travail s'inscrit dans cette demarche. Nous avons generalise les tenseurs de bel et robinson en dimension arbitraire. Nous avons precise que ces tenseurs sont distincts, ils coincident, si, et seulement si, l'espace est d'einstein de dimension quatre. Nous avons trouve que ces deux tenseurs sont conservatifs quelle que soit la dimension de l'espace. Cela represente la premiere partie du travail. Dans la deuxieme partie, nous avons trouve les conditions d'integrabilite d'un systeme de deux equations de type de dirac, pour un spin eleve en utilisant l'isomorphisme entre l'algebre exterieur et l'algebre de clifford

Abstract:
Ci sono esempi unici e variegati di costruzioni in pietra a secco nella regione mediterranea, il cui interesse, in Puglia (Italia) e attestato negli ultimi decenni, ha determinato un atteggiamento speculativo che ha permesso a queste architetture vernacolari di acquisire un notevole valore economico. Di conseguenza, oltre alle azioni supportate dai regolamenti comunali e dagli strumenti di pianificazione sia locale che regionale, è necessario individuarne il valore culturale e le peculiarità, tutte necessarie per attuare politiche consapevoli per una corretta tutela e conservazione. Ci proponiamo in particolare di concentrarci sul rilievo di queste architetture all'interno di questo contributo, un argomento trascurato di una certa complessità, al fine di proporre una serie di riflessioni che supportino l'attività di coloro che intendono intervenire su questi manufatti. Infatti, la loro componente plastica e l'unicità morfologica permettono loro di fondersi con sculture che richiedono l'utilizzo di metodologie e tecnologie moderne e raffinate per la loro documentazione. Abstract:
Through its specific multiple uses, the electronic information technology constitutes an authentic current teaching means, producing a new revolution in education, compared to the one achieved by the invention of printing. Its apparition suggests a reconsideration of the didactic methods and strategies, of teaching style, of the projection and development of the instructive-educational act for the Physical Education in higher education. This is all the more evident if we take into consideration the combination: computer (means: information technology) - course in an electronic format (method) - individual activity (type of organization). When we are referring to the first way of inserting the computer in the curriculum, it is strictly associated to the notion of means; ulteriorly, it becomes a didactic strategy, being combined with other elements. The theoretical course model suggested in this paper constitutes an electronic document, with properties that are imposed by the current standards and demands of the IT users. In this sense, the electronic format desired for the structuring, accessibility, use, and management of the curricular content has been chosen according to the following criteria: &#61485; accessible and viable presentation; &#61485; immediate accessibility; &#61485; ease of use; &#61485; accessible Internet presence; &#61485; easy to find and encapsulate the content; &#61485; modularization and an arborescent structure of information. For this, the format Adobe Portable Document Format (PDF) has been chosen, which is very popular, very accessible, and tested over a long period of time by thousands of users. One of its main elements is the navigation tree (the arborescent structure - of dependencies) of the information (contents), called in the Reader: Bookmarks. Also, another main element in the presentation of information is the presentation panel for the actual content of the electronic course, allowing the specification of various attributes for the personalization of the e-course: page rolling, the physical position inside the e-course (the number of the current page, and the total number of pages), the visualizing format (the number of pages presented simultaneously). Il paesaggio urbano contemporaneo, governato dal movimento e dalla trasformazione, produce disorientamento. La velocità delle reti assorda la città, lacera e segmenta la campagna e il binomio oppositivo urbano/rurale non si presenta più in quanto tale. In diverse aree del nostro paese, però, in particolare lì, dove la rete dei flussi e delle infrastrutture, del mercato e dell'economia globale, che alterano la fisionomia locale della città e del territorio, si dirada, si nascondono dei territori meno illuminati, spazi aperti, di rallentamento, di silenzio, di sopravvivenza di campagna e agricoltura, di resistenza alla crescita lineare e senza senso dell'urbanizzazione (Lanzani, 2011, pag. 20). Sono territori densi di natura e di storia nei quali si stanno verificando fenomeni emergenti, indizi, che disegnano le traiettorie per una prospettiva di cammino differente, ormai necessario, anche per la pianificazione urbanistica contemporanea: nuove forme dell'abitare, dinamiche di insediamento neo rurali, nuove economie legate alla terra, processi di riterritorializzazione, rielaborazione del rapporto tra uomo e natura, una vera e propria svolta etico-culturale. Partendo dalla consapevolezza di vivere ed agire in un delicato equilibrio “sistema-mondo” a cui ogni realtà locale è connessa, nell’articolo si analizza il fenomeno dei nuovi abitanti a Luogosanto, piccolo Comune dell’Alta Gallura, in Sardegna. Fenomeno che richiede un'impostazione metodologica basata sull'osservazione attenta, infatti, si tratta, in buona sostanza, di associare un’analisi più generale a un’indagine di dettaglio che può arrivare addirittura alla ricerca della singola esperienza di vita, necessaria a tracciare le linee per il progetto di territorio.
