Abstract:
This article will focus on exploring gender and sexuality within the law school. Largely silent from Twining’s ‘grand tour’, these two areas are now key parts of the law school landscape, having become firmly established as key elements of law school discourse and legal scholarship in the years since Blackstone’s Tower was published. The Blackstone’s Tower of Twining’s imagination was, Twining suggested, ‘holding up a mirror to a familiar world’, and it was a world that made only passing reference to gender and no reference to sexuality. Feminism is mentioned twice in 244 pages, whilst queer—still emergent within legal scholarship in 1994—is not referenced at all. A once radical and vital text can perhaps appear antiquated to today’s readers. Yet, this should not be regarded as a criticism of the text but rather a reflection of how the law school and legal scholarship has transformed since 1994. Whether in the number of gender and/or sexuality and law courses that now permeate through the UK law school, or the extraordinary growth first of feminist scholarship and more recently queer scholarship, the law school has been profoundly impacted by socio-legal shifts in gender and sexuality research. This is scholarship that does not merely serve as ‘another’ theory or an addendum to jurisprudence, for these theories have offered the ability to reshape the very architecture of the law school and to re-imagine Blackstone’s Tower for what it is and what it can be. Abstract:
On 24 May 2017, a historical landmark for the LGBT movement was achieved in Taiwan. The courts delivered Interpretation no. 748, which declares that the legal regulation in the Civil Code disallowing two individuals of the same sex to marry is unconstitutional and that the law should therefore be amended within two years. While the legal arguments at the constitutional level seem settled, discussions regarding sexuality, family and tradition triggered by the debate about same-sex marriage are continuing. Drawing on feminist and queer scholarship, I advocate turning the spotlight from the ‘subversive’ homosexual to ‘normative’ heterosexuality. In addition, through the theoretical lens of interactionism on sexuality, this study investigates a quotidian but controversial topic emerging in the debate: gendered familial appellations. Using transcripts of public hearings as research data, I discuss how the practice of employing gendered familial appellations based on the idea of the heterosexual family becomes an issue in the debate. Through an analysis of the matter, I argue that the heteronormative social order embedded in everyday interactions within the context of Taiwan society is revealed. This heteronormativity is not only gendered and hierarchically heterosexual but also ethnocentric in nature.

Abstract:
Though sex, gender, and sexuality have been subject to ongoing forms of state scrutiny and, therefore, concern surveillance studies scholars—one can think of McCarthy and the policing of homosexuality and the current forms of homophobia and cisgenderism structuring bathroom, sport, and “Don’t Say Gay” laws in the US—there is a glaring lack of attention paid to the violent (colonial) state, legal, and medical projects that surveil intersex people’s body-minds with the (eugenic) goal of eradicating intersex variations to make sex, gender, and sexuality “legible,” dyadic. There is a lack of attention paid to intersex issues in mainstream media as well as from surveillance studies scholars. As a result, as scholars reflect backward over the decades of scholarship in surveillance studies in this anniversary issue of Surveillance & Society, we posit that it is time to use the refined tools surveillance studies offers in service of opposing the often-ignored ongoing surveillance—and killing project—of intersex people’s unique sex traits. In doing so, we focus our attention on surgical interventions, medical photography, and the reproductive technology preimplantation genetic diagnosis. These three case studies offer a sampling of the various ways intersex variations are surveilled and eradicated, and, therefore, signal the importance of integrating intersex issues into feminist surveillance studies. To conclude, we address how intersex activists find each other and propel their activism—activism that combats the surveiling and regulating nature of state and medical-sanctioned interphobia—into the mainstream via information and communication technologies. And yet, there remains so much work to be done. We end on the cautionary note that the ways that intersex activists’ work is routinely stymied and undermined by state and medical forces must be considered.

Abstract:
In global labour markets, migrant workers are mainly found in precarious, low-status/low-wage occupations in undeclared work and the underground/informal sector of the economy which demands a low paid, uninsured, mobile, temporary and flexible workforce. This article argues that migrant women are mostly employed as domestic workers in various countries that demand precarious, low-status/low-wage service workers and personal services. Feminist scholarship on migration underlines, that social constructions of gender and racial stereotypes drive men and women into specific roles and therefore dictate their experiences. Social constructions of gender cannot be considered separate from social constructions of class, gender, race, ethnicity, and sexuality; female migrants are disassociated from family relationships, community associations, solidarity networks, and become susceptible to discrimination based on race and ethnicity, class and gender in the reception countries. This article provides an intersectional review of research on domestic work, healthcare and community networks in Greece (1990-2018). Intersectionality produces assumptions set in women’s race and ethnicity, projecting unequal labour rights among sexes in Greece. Gender, race and ethnicity subject women to obedience, susceptibility and exploitation, confining them to domestic work, and low-paid jobs without social rights. Last but not least, this article suggests that ethnic background and unstable legal residence status works as a mechanism of control and suppression, which in turn force female migrants to accept low wages, refrain from demanding healthcare services and from seeking support from migrant community associations. Employers confiscate their documents, monitor them and threaten to report them to the authorities, thus institutionalising exploitation, leading to forceful application of discipline, consent, subordination, obedience and dependency of domestic workers.

AbstractThe teaching of critical race, feminist, and queer theory generally, and of LGBT rights specifically, has developed into a discrete, contested, and politicised area of teaching in English law schools and beyond. While there is some academic discussion on the personal and political significance of ‘promoting LGBT rights’ within law schools, less considered is how ‘LGBT rights’ are shaped by the emotions of legal academics and how these emotions circumscribe what we imagine LGBT rights can and/or should mean in law and critical legal study. To illustrate this dynamic, this paper uses critical race, feminist, and queer scholarship alongside work in the emerging field of Law and Emotion to articulate the ‘emotional grammar’ of teaching a Gender, Sexuality and Law unit at an English law school. Turning to autoethnography, I use my emotional experiences as a methodological tool to explore how emotions co-constitute the pedagogical, political, scholarly, and personal registers of LGBT rights as a descriptive, critical, and normative pursuit. In doing so, I use ‘emotional grammar’ as a novel way to map how emotions structure legal pedagogies invested in pursuing LGBT rights. Emotional grammar illustrates how emotions structure: (1) the articulation of LGBT rights as an object of study in law; (2) the pursuit of law to secure the rights of LGBT people; and (3) the shape of legal critique relating to LGBT rights.

Abstract:
Ubiquitous in airports, border checkpoints, and other securitised spaces throughout the world, full-body imaging scanners claim to read bodies in order to identify if they pose security threats. Millimetre-wave body imaging machines—the most common type of body scanner—display to the operating security agent a screen with a generic body outline. If an anomaly is found or if an individual does not align with the machine’s understanding of an “average” body, a small box is highlighted and placed around the “problem” area, prompting further inspection in the form of pat-downs or questioning. In this complex security regime governed by such biometric, body-based technologies, it could be argued that nonalignment with bodily normativity as well as an attendant failure to reveal oneself—to become “transparent” (Hall 295)—marks a body as dangerous. As these algorithmic technologies become more pervasive, so too does the imperative to critically examine their purported neutrality and operative logic of revelation and readability.Biometric technologies are marketed as excavators of truth, with their optic potency claiming to demask masquerading bodies. Failure and bias are, however, an inescapable aspect of such technologies that work with narrow parameters of human morphology. Indeed, surveillance technologies have been taken to task for their inherent racial and gender biases (Browne; Pugliese). Facial recognition has, for example, been critiqued for its inability to read darker skin tones (Buolamwini and Gebru), while body scanners have been shown to target transgender bodies (Keyes; Magnet and Rodgers; Quinan). Critical security studies scholar Shoshana Magnet argues that error is endemic to the technological functioning of biometrics, particularly since they operate according to the faulty notion that bodies are “stable” and unchanging repositories of information that can be reified into code (Magnet 2).Although body scanners are presented as being able to reliably expose concealed weapons, they are riddled with incompetencies that misidentify and over-select certain demographics as suspect. Full-body scanners have, for example, caused considerable difficulties for transgender travellers, breast cancer patients, and people who use prosthetics, such as artificial limbs, colonoscopy bags, binders, or prosthetic genitalia (Clarkson; Quinan; Spalding). While it is not in the scope of this article to detail the workings of body imaging technologies and their inconsistencies, a growing body of scholarship has substantiated the claim that these machines unfairly impact those identifying as transgender and non-binary (see, e.g., Beauchamp; Currah and Mulqueen; Magnet and Rogers; Sjoberg). Moreover, they are constructed according to a logic of binary gender: before each person enters the scanner, transportation security officers must make a quick assessment of their gender/sex by pressing either a blue (corresponding to “male”) or pink (corresponding to “female”) button. In this sense, biometric, computerised security systems control and monitor the boundaries between male and female.The ability to “reveal” oneself is henceforth predicated on having a body free of “abnormalities” and fitting neatly into one of the two sex categorisations that the machine demands. Transgender and gender-nonconforming individuals, particularly those who do not have a binary gender presentation or whose presentation does not correspond to the sex marker in their documentation, also face difficulties if the machine flags anomalies (Quinan and Bresser). Drawing on a Foucauldian analysis of power as productive, Toby Beauchamp similarly illustrates how surveillance technologies not only identify but also create and reshape the figure of the dangerous subject in relation to normative configurations of gender, race, and able-bodiedness. By mobilizing narratives of concealment and disguise, heightened security measures frame gender nonconformity as dangerous (Beauchamp, Going Stealth). Although national and supranational authorities market biometric scanning technologies as scientifically neutral and exact methods of identification and verification and as an infallible solution to security risks, such tools of surveillance are clearly shaped by preconceptions and prejudgements about race, gender, and bodily normativity. Not only are they encoded with “prototypical whiteness” (Browne) but they are also built on “grossly stereotypical” configurations of gender (Clarkson).Amongst this increasingly securitised landscape, creative forms of artistic resistance can offer up a means of subverting discriminatory policing and surveillance practices by posing alternate visualisations that reveal and challenge their supposed objectivity. In his 2018 audio-video artwork installation entitled SANCTUM, UK-based American artist Zach Blas delves into how biometric technologies, like those described above, both reveal and (re)shape ontology by utilising the affectual resonance of sexual submission. Evoking the contradictory notions of oppression and pleasure, Blas describes SANCTUM as “a mystical environment that perverts sex dungeons with the apparatuses and procedures of airport body scans, biometric analysis, and predictive policing” (see full description at https://zachblas.info/works/sanctum/).Depicting generic mannequins that stand in for the digitalised rendering of the human forms that pass through body scanners, the installation transports the scanners out of the airport and into a queer environment that collapses sex, security, and weaponry; an environment that is “at once a prison-house of algorithmic capture, a sex dungeon with no genitals, a weapons factory, and a temple to security.” This artistic reframing gestures towards full-body scanning technology’s germination in the military, prisons, and other disciplinary systems, highlighting how its development and use has originated from punitive—rather than protective—contexts.In what follows, we adopt a methodological approach that applies visual analysis and close reading to scrutinise a selection of scenes from SANCTUM that underscore the sadomasochistic power inherent in surveillance technologies. Analysing visual and aural elements of the artistic intervention allows us to complicate the relationship between transparency and recognition and to problematise the dynamic of mandatory complicity and revelation that body scanners warrant. In contrast to a discourse of visibility that characterises algorithmically driven surveillance technology, Blas suggests opacity as a resistance strategy to biometrics' standardisation of identity. Taking an approach informed by critical security studies and queer theory, we also argue that SANCTUM highlights the violence inherent to the practice of reducing the body to a flat, inert surface that purports to align with some sort of “core” identity, a notion that contradicts feminist and queer approaches to identity and corporeality as fluid and changing. In close reading this artistic installation alongside emerging scholarship on the discriminatory effects of biometric technology, this article aims to highlight the potential of art to queer the supposed objectivity and neutrality of biometric surveillance and to critically challenge normative logics of revelation and readability.Corporeal Fetishism and Body HorrorThroughout both his artistic practice and scholarly work, Blas has been critical of the above narrative of biometrics as objective extractors of information. Rather than looking to dominant forms of representation as a means for recognition and social change, Blas’s work asks that we strive for creative techniques that precisely queer biometric and legal systems in order to make oneself unaccounted for. For him, “transparency, visibility, and representation to the state should be used tactically, they are never the end goal for a transformative politics but are, ultimately, a trap” (Blas and Gaboury 158). While we would simultaneously argue that invisibility is itself a privilege that is unevenly distributed, his creative work attempts to refuse a politics of visibility and to embrace an “informatic opacity” that is attuned to differences in bodies and identities (Blas).In particular, Blas’s artistic interventions titled Facial Weaponization Suite (2011-14) and Face Cages (2013-16) protest against biometric recognition and the inequalities that these technologies propagate by making masks and wearable metal objects that cannot be detected as human faces. This artistic-activist project contests biometric facial recognition and their attendant inequalities by, as detailed on the artist’s website,making ‘collective masks’ in workshops that are modelled from the aggregated facial data of participants, resulting in amorphous masks that cannot be detected as human faces by biometric facial recognition technologies. The masks are used for public interventions and performances.One mask explores blackness and the racist implications that undergird biometric technologies’ inability to detect dark skin. Meanwhile another mask, which he calls the “Fag Face Mask”, points to the heteronormative underpinnings of facial recognition. Created from the aggregated facial data of queer men, this amorphous pink mask implicitly references—and contests—scientific studies that have attempted to link the identification of sexual orientation through rapid facial recognition techniques.Building on this body of creative work that has advocated for opacity as a tool of social and political transformation, SANCTUM resists the revelatory impulses of biometric technology by turning to the use and abuse of full-body imaging. The installation opens with a shot of a large, dark industrial space. At the far end of a red, spotlighted corridor, a black mask flickers on a screen. A shimmering, oscillating sound reverberates—the opening bars of a techno track—that breaks down in rhythm while the mask evaporates into a cloud of smoke. The camera swivels, and a white figure—the generic mannequin of the body scanner screen—is pummelled by invisible forces as if in a wind tunnel. These ghostly silhouettes appear and reappear in different positions, with some being whipped and others stretched and penetrated by a steel anal hook. Rather than conjuring a traditional horror trope of the body’s terrifying, bloody interior, SANCTUM evokes a new kind of feared and fetishized trope that is endemic to the current era of surveillance capitalism: the abstracted body, standardised and datafied, created through the supposedly objective and efficient gaze of AI-driven machinery.Resting on the floor in front of the ominous animated mask are neon fragments arranged in an occultist formation—hands or half a face. By breaking the body down into component parts— “from retina to fingerprints”—biometric technologies “purport to make individual bodies endlessly replicable, segmentable and transmissible in the transnational spaces of global capital” (Magnet 8). The notion that bodies can be seamlessly turned into blueprints extracted from biological and cultural contexts has been described by Donna Haraway as “corporeal fetishism” (Haraway, Modest). In the context of SANCTUM, Blas illustrates the dangers of mistaking a model for a “concrete entity” (Haraway, “Situated” 147). Indeed, the digital cartography of the generic mannequin becomes no longer a mode of representation but instead a technoscientific truth.Several scenes in SANCTUM also illustrate a process whereby substances are extracted from the mannequins and used as tools to enact violence. In one such instance, a silver webbing is generated over a kneeling figure. Upon closer inspection, this geometric structure, which is reminiscent of Blas’s earlier Face Cages project, is a replication of the triangulated patterns produced by facial recognition software in its mapping of distance between eyes, nose, and mouth. In the next scene, this “map” breaks apart into singular shapes that float and transform into a metallic whip, before eventually reconstituting themselves as a penetrative douche hose that causes the mannequin to spasm and vomit a pixelated liquid. Its secretions levitate and become the webbing, and then the sequence begins anew.In another scene, a mannequin is held upside-down and force-fed a bubbling liquid that is being pumped through tubes from its arms, legs, and stomach. These depictions visualise Magnet’s argument that biometric renderings of bodies are understood not to be “tropic” or “historically specific” but are instead presented as “plumbing individual depths in order to extract core identity” (5). In this sense, this visual representation calls to mind biometrics’ reification of body and identity, obfuscating what Haraway would describe as the “situatedness of knowledge”. Blas’s work, however, forces a critique of these very systems, as the materials extracted from the bodies of the mannequins in SANCTUM allude to how biometric cartographies drawn from travellers are utilised to justify detainment. These security technologies employ what Magnet has referred to as “surveillant scopophilia,” that is, new ways and forms of looking at the human body “disassembled into component parts while simultaneously working to assuage individual anxieties about safety and security through the promise of surveillance” (17). The transparent body—the body that can submit and reveal itself—is ironically represented by the distinctly genderless translucent mannequins. Although the generic mannequins are seemingly blank slates, the installation simultaneously forces a conversation about the ways in which biometrics draw upon and perpetuate assumptions about gender, race, and sexuality.Biometric SubjugationOn her 2016 critically acclaimed album HOPELESSNESS, openly transgender singer, composer, and visual artist Anohni performs a deviant subjectivity that highlights the above dynamics that mark the contemporary surveillance discourse. To an imagined “daddy” technocrat, she sings:Watch me… I know you love me'Cause you're always watching me'Case I'm involved in evil'Case I'm involved in terrorism'Case I'm involved in child molestersEvoking a queer sexual frisson, Anohni describes how, as a trans woman, she is hyper-visible to state institutions. She narrates a voyeuristic relation where trans bodies are policed as threats to public safety rather than protected from systemic discrimination. Through the seemingly benevolent “daddy” character and the play on ‘cause (i.e., because) and ‘case (i.e., in case), she highlights how gender-nonconforming individuals are predictively surveilled and assumed to already be guilty. Reflecting on daddy-boy sexual paradigms, Jack Halberstam reads the “sideways” relations of queer practices as an enactment of “rupture as substitution” to create a new project that “holds on to vestiges of the old but distorts” (226). Upending power and control, queer art has the capacity to both reveal and undermine hegemonic structures while simultaneously allowing for the distortion of the old to create something new.Employing the sublimatory relations of bondage, discipline, sadism, and masochism (BDSM), Blas’s queer installation similarly creates a sideways representation that re-orientates the logic of the biometric scanners, thereby unveiling the always already sexualised relations of scrutiny and interrogation as well as the submissive complicity they demand. Replacing the airport environment with a dark and foreboding mise-en-scène allows Blas to focus on capture rather than mobility, highlighting the ways in which border checkpoints (including those instantiated by the airport) encourage free travel for some while foreclosing movement for others. Building on Sara Ahmed’s “phenomenology of being stopped”, Magnet considers what happens when we turn our gaze to those “who fail to pass the checkpoint” (107). In SANCTUM, the same actions are played out again and again on spectral beings who are trapped in various states: they shudder in cages, are chained to the floor, or are projected against the parameters of mounted screens. One ghostly figure, for instance, lies pinned down by metallic grappling hooks, arms raised above the head in a recognisable stance of surrender, conjuring up the now-familiar image of a traveller standing in the cylindrical scanner machine, waiting to be screened. In portraying this extended moment of immobility, Blas lays bare the deep contradictions in the rhetoric of “freedom of movement” that underlies such spaces.On a global level, media reporting, scientific studies, and policy documents proclaim that biometrics are essential to ensuring personal safety and national security. Within the public imagination, these technologies become seductive because of their marked ability to identify terrorist attackers—to reveal threatening bodies—thereby appealing to the anxious citizen’s fear of the disguised suicide bomber. Yet for marginalised identities prefigured as criminal or deceptive—including transgender and black and brown bodies—the inability to perform such acts of revelation via submission to screening can result in humiliation and further discrimination, public shaming, and even tortuous inquiry – acts that are played out in SANCTUM.Masked GenitalsFeminist surveillance studies scholar Rachel Hall has referred to the impetus for revelation in the post-9/11 era as a desire for a universal “aesthetics of transparency” in which the world and the body is turned inside-out so that there are no longer “secrets or interiors … in which terrorists or terrorist threats might find refuge” (127). Hall takes up the case study of Umar Farouk Abdulmutallab (infamously known as “the Underwear Bomber”) who attempted to detonate plastic explosives hidden in his underwear while onboard a flight from Amsterdam to Detroit on 25 December 2009. Hall argues that this event signified a coalescence of fears surrounding bodies of colour, genitalia, and terrorism. News reports following the incident stated that Abdulmutallab tucked his penis to make room for the explosive, thereby “queer[ing] the aspiring terrorist by indirectly referencing his willingness … to make room for a substitute phallus” (Hall 289). Overtly manifested in the Underwear Bomber incident is also a desire to voyeuristically expose a hidden, threatening interiority, which is inherently implicated with anxieties surrounding gender deviance. Beauchamp elaborates on how gender deviance and transgression have coalesced with terrorism, which was exemplified in the wake of the 9/11 attacks when the United States Department of Homeland Security issued a memo that male terrorists “may dress as females in order to discourage scrutiny” (“Artful” 359). Although this advisory did not explicitly reference transgender populations, it linked “deviant” gender presentation—to which we could also add Abdulmutallab’s tucking of his penis—with threats to national security (Beauchamp, Going Stealth). This also calls to mind a broader discussion of the ways in which genitalia feature in the screening process. Prior to the introduction of millimetre-wave body scanning technology, the most common form of scanner used was the backscatter imaging machine, which displayed “naked” body images of each passenger to the security agent. Due to privacy concerns, these machines were replaced by the scanners currently in place which use a generic outline of a passenger (exemplified in SANCTUM) to detect possible threats.It is here worth returning to Blas’s installation, as it also implicitly critiques the security protocols that attempt to reveal genitalia as both threatening and as evidence of an inner truth about a body. At one moment in the installation a bayonet-like object pierces the blank crotch of the mannequin, shattering it into holographic fragments. The apparent genderlessness of the mannequins is contrasted with these graphic sexual acts. The penetrating metallic instrument that breaks into the loin of the mannequin, combined with the camera shot that slowly zooms in on this action, draws attention to a surveillant fascination with genitalia and revelation. As Nicholas L. Clarkson documents in his analysis of airport security protocols governing prostheses, including limbs and packies (silicone penis prostheses), genitals are a central component of the screening process. While it is stipulated that physical searches should not require travellers to remove items of clothing, such as underwear, or to expose their genitals to staff for inspection, prosthetics are routinely screened and examined. This practice can create tensions for trans or disabled passengers with prosthetics in so-called “sensitive” areas, particularly as guidelines for security measures are often implemented by airport staff who are not properly trained in transgender-sensitive protocols.ConclusionAccording to media technologies scholar Jeremy Packer, “rather than being treated as one to be protected from an exterior force and one’s self, the citizen is now treated as an always potential threat, a becoming bomb” (382). Although this technological policing impacts all who are subjected to security regimes (which is to say, everyone), this amalgamation of body and bomb has exacerbated the ways in which bodies socially coded as threatening or deceptive are targeted by security and surveillance regimes. Nonetheless, others have argued that the use of invasive forms of surveillance can be justified by the state as an exchange: that citizens should willingly give up their right to privacy in exchange for safety (Monahan 1). Rather than subscribing to this paradigm, Blas’ SANCTUM critiques the violence of mandatory complicity in this “trade-off” narrative. Because their operationalisation rests on normative notions of embodiment that are governed by preconceptions around gender, race, sexuality and ability, surveillance systems demand that bodies become transparent. This disproportionally affects those whose bodies do not match norms, with trans and queer bodies often becoming unreadable (Kafer and Grinberg). Abstract:
Unlike some current discourse on automediality, this essay eschews most of the analysis concerning the adoption or modification of avatars to deliberately enhance, extend or distort the self. Rather than the automedial enabling of alternative, virtual selves modified by playful, confronting or disarming avatars we concentrate instead on emerging efforts to present the self in hyper-realist, interactive modes. In doing so we ask, what is the relationship between traumatic forms of automediation and the affective impact on and response of the audience? We argue that, while on the one hand there are promising avenues for valuable individual and social engagements with traumatic forms of automediation, there is an overwhelming predominance of suffering as a theme in such virtual depictions, comingled with uncritically asserted promises of empathy, which are problematic as the technology assumes greater mainstream uptake.As Smith and Watson note, embodiment is always a “translation” where the body is “dematerialized” in virtual representation (“Virtually” 78). Past scholarship has analysed the capacity of immersive realms, such as Second Life or online games, to highlight how users can modify their avatars in often spectacular, non-human forms. Critics of this mode of automediality note that users can adopt virtually any persona they like (racial, religious, gendered and sexual, human, animal or hybrid, and of any age), behaving as “identity tourists” while occupying virtual space or inhabiting online communities (Nakamura). Furthermore, recent work by Jaron Lanier, a key figure from the 1980s period of early Virtual Reality (VR) technology, has also explored so-called “homuncular flexibility” which describes the capacity for humans to seemingly adapt automatically to the control mechanisms of an avatar with multiple legs, other non-human appendages, or for two users to work in tandem to control a single avatar (Won et. al.). But this article is concerned less with these single or multi-player online environments and the associated concerns over modifying interactive identities. We are principally interested in other automedial modes where the “auto” of autobiography is automated via Artificial Intelligences (AIs) to convincingly mimic human discourse as narrated life-histories.We draw from case studies promoted by the 2017 season of ABC television’s flagship science program, Catalyst, which opened with semi-regular host and biological engineer Dr Jordan Nguyen, proclaiming in earnest, almost religious fervour: “I want to do something that has long been a dream. I want to create a copy of a human. An avatar. And it will have a life of its own in virtual reality.” As the camera followed Nguyen’s rapid pacing across real space he extolled: “Virtual reality, virtual human, they push the limits of the imagination and help us explore the impossible […] I want to create a virtual copy of a person. A digital addition to the family, using technology we have now.”The troubling implications of such rhetoric were stark and the next third of the program did little to allay such techno-scientific misgivings. Directed and produced by David Symonds, with Nguyen credited as co-developer and presenter, the episode “Meet the Avatars” immediately introduced scenarios where “volunteers” entered a pop-up inner city virtual lab, to experience VR for the first time. The volunteers were shown on screen subjected to a range of experimental VR environments designed to elicit fear and/or adverse and disorienting responses such as vertigo, while the presenter and researchers from Sydney University constantly smirked and laughed at their participants’ discomfort. We can only wonder what the ethics process was for both the ABC and university researchers involved in these broadcast experiments. There is little doubt that the participant/s experienced discomfort, if not distress, and that was televised to a national audience. Presenter Nguyen was also shown misleading volunteers on their way to the VR lab, when one asked “You’re not going to chuck us out of a virtual plane are you?” to which Nguyen replied “I don't know what we’re going to do yet,” when it was next shown that they immediately underwent pre-programmed VR exposure scenarios, including a fear of falling exercise from atop a city skyscraper.The sweat-inducing and heart rate-racing exposures to virtual plank walks high above a cityscape, or seeing subjects haptically viewing spiders crawl across their outstretched virtual hands, all elicited predictable responses, showcased as carnivalesque entertainment for the viewing audience. As we will see, this kind of trivialising of a virtual environment’s capacity for immersion belies the serious use of the technology in a range of treatments for posttraumatic stress disorder (see Rizzo and Koenig; Rothbaum, Rizzo and Difede).Figure 1: Nguyen and researchers enjoying themselves as their volunteers undergo VR exposure Defining AutomedialityIn their pioneering 2008 work, Automedialität: Subjektkonstitution in Schrift, Bild und neuen Medien, Jörg Dünne and Christian Moser coined the term “automediality” to problematise the production, application and distribution of autobiographic modes across various media and genres—from literary texts to audiovisual media and from traditional expression to inter/transmedia and remediated formats. The concept of automediality was deployed to counter the conventional critical exclusion of analysis of the materiality/technology used for an autobiographical purpose (Gernalzick). Dünne and Moser proffered a concept of automediality that rejects the binary division of (a) self-expression determining the mediated form or (b) (self)subjectivity being solely produced through the mediating technology. Hence, automediality has been traditionally applied to literary constructs such as autobiography and life-writing, but is now expanding into the digital domain and other “paratextual sites” (Maguire).As Nadja Gernalzick suggests, automediality should “encourage and demand not only a systematics and taxonomy of the constitution of the self in respectively genre-specific ways, but particularly also in medium-specific ways” (227). Emma Maguire has offered a succinct working definition that builds on this requirement to signal the automedial universally, noting it operates asa way of studying auto/biographical texts (of a variety of forms) that take into account how the effects of media shape the kinds of selves that can be represented, and which understands the self not as a preexisting subject that might be distilled into story form but as an entity that is brought into being through the processes of mediation.Sidonie Smith and Julia Watson point to automediality as a methodology, and in doing so emphasize how the telling or mediation of a life actually shapes the kind of story that can be told autobiographically. They state “media cannot simply be conceptualized as ‘tools’ for presenting a preexisting, essential self […] Media technologies do not just transparently present the self. They constitute and expand it” (Smith and Watson “Virtually Me” 77).This distinction is vital for understanding how automediality might be applied to self-expression in virtual domains, including the holographic avatar dreams of Nguyen throughout Catalyst. Although addressing this distinction in relation to online websites, following P. David Marshall’s description of “the proliferation of the public self”, Maguire notes:The same integration of digital spaces and platforms into daily life that is prompting the development of new tools in autobiography studies […] has also given rise to the field of persona studies, which addresses the ways in which individuals engage in practices of self-presentation in order to form commoditised identities that circulate in affective communities.For Maguire, these automedial works operate textually “to construct the authorial self or persona”.An extension to this digital, authorial construction is apparent in the exponential uptake of screen mediated prosumer generated content, whether online or theatrical (Miller). According to Gernalzick, unlike fictional drama films, screen autobiographies more directly enable “experiential temporalities”. Based on Mary Anne Doane’s promotion of the “indexicality” of film/screen representations to connote the real, Gernalzick suggests that despite semiotic theories of the index problematising realism as an index as representation, the film medium is still commonly comprehended as the “imprint of time itself”:Film and the spectator of film are said to be in a continuous present. Because the viewer is aware, however, that the images experienced in or even as presence have been made in the past, the temporality of the so-called filmic present is always ambiguous” (230).When expressed as indexical, automedial works, the intrinsic audio-visual capacities of film and video (as media) far surpass the temporal limitations of print and writing (Gernalzick, 228). One extreme example can be found in an emergent trend of “performance crime” murder and torture videos live-streamed or broadcast after the fact using mobile phone cameras and FaceBook (Bender). In essence, the political economy of the automedial ecology is important to understand in the overall context of self expression and the governance of content exhibition, access, distribution and—where relevant—interaction.So what are the implications for automedial works that employ virtual interfaces and how does this evolving medium inform both the expressive autobiographical mode and audiences subjectivities?Case StudyThe Catalyst program described above strove to shed new light on the potential for emerging technology to capture and create virtual avatars from living participants who (self-)generate autobiographical narratives interactively. Once past the initial gee-wiz journalistic evangelism of VR, the episode turned towards host Nguyen’s stated goal—using contemporary technology to create an autonomous virtual human clone. Nguyen laments that if he could create only one such avatar, his primary choice would be that of his grandfather who died when Nguyen was two years old—a desire rendered impossible. The awkward humour of the plank walk scenario sequence soon gives way as the enthusiastic Nguyen is surprised by his family’s discomfort with the idea of digitally recreating his grandfather.Nguyen next visits a Southern California digital media lab to experience the process by which 3D virtual human avatars are created. Inside a domed array of lights and cameras, in less than one second a life-size 3D avatar is recorded via 6,000 LEDs illuminating his face in 20 different combinations, with eight cameras capturing the exposures from multiple angles, all in ultra high definition. Called the Light Stage (Debevec), it is the same technology used to create a life size, virtual holocaust survivor, Pinchas Gutter (Ziv).We see Nguyen encountering a life-size, high-resolution 2D screen version of Gutter’s avatar. Standing before a microphone, Nguyen asks a series of questions about Gutter’s wartime experiences and life in the concentration camps. The responses are naturalistic and authentic, as are the pauses between questions. The high definition 4K screen is photo-realist but much more convincing in-situ (as an artifact of the Catalyst video camera recording, in some close-ups horizontal lines of transmission appear). According to the project’s curator, David Traum, the real Pinchas Gutter was recorded in 3D as a virtual holograph. He spent 25 hours providing 1,600 responses to a broad range of questions that the curator maintained covered “a lot of what people want to say” (Catalyst).Figure 2: The Museum of Jewish Heritage in Manhattan presented an installation of New Dimensions in Testimony, featuring Pinchas Gutter and Eva SchlossIt is here that the intersection between VR and auto/biography hybridise in complex and potentially difficult ways. It is where the concept of automediality may offer insight into this rapidly emerging phenomenon of creating interactive, hyperreal versions of our selves using VR. These hyperreal VR personae can be questioned and respond in real-time, where interrogators interact either as casual conversers or determined interrogators.The impact on visitors is sobering and palpable. As Nguyen relates at the end of his session, “I just want to give him a hug”. The demonstrable capacity for this avatar to engender a high degree of empathy from its automedial testimony is clear, although as we indicate below, it could simply indicate increased levels of emotion.Regardless, an ongoing concern amongst witnesses, scholars and cultural curators of memorials and museums dedicated to preserving the history of mass violence, and its associated trauma, is that once the lived experience and testimony of survivors passes with that generation the impact of the testimony diminishes (Broderick). New media modes of preserving and promulgating such knowledge in perpetuity are certainly worthy of embracing. As Stephen Smith, the executive director of the USC Shoah Foundation suggests, the technology could extendto people who have survived cancer or catastrophic hurricanes […] from the experiences of soldiers with post-traumatic stress disorder or survivors of sexual abuse, to those of presidents or great teachers. Imagine if a slave could have told her story to her grandchildren? (Ziv)Yet questions remain as to the veracity of these recorded personae. The avatars are created according to a specific agenda and the autobiographical content controlled for explicit editorial purposes. It is unclear what and why material has been excluded. If, for example, during the recorded questioning, the virtual holocaust survivor became mute at recollecting a traumatic memory, cried or sobbed uncontrollably—all natural, understandable and authentic responses given the nature of the testimony—should these genuine and spontaneous emotions be included along with various behavioural ticks such as scratching, shifting about in the seat and other naturalistic movements, to engender a more profound realism?The generation of the photorealist, mimetic avatar—remaining as an interactive persona long after the corporeal, authorial being is gone—reinforces Baudrillard’s concept of simulacra, where a clone exists devoid of its original entity and unable to challenge its automedial discourse. And what if some unscrupulous hacker managed to corrupt and subvert Gutter’s AI so that it responded antithetically to its purpose, by denying the holocaust ever happened? The ethical dilemmas of such a paradigm were explored in the dystopian 2013 film, The Congress, where Robyn Wright plays herself (and her avatar), as an out of work actor who sells off the rights to her digital self. A movie studio exploits her screen persona in perpetuity, enabling audiences to “become” and inhabit her avatar in virtual space while she is limited in the real world from undertaking certain actions due to copyright infringement. The inability of Wright to control her mimetic avatar’s discourse or action means the assumed automedial agency of her virtual self as an immortal, interactive being remains ontologically perplexing.Figure 3: Robyn Wright undergoing a full body photogrammetry to create her VR avatar in The Congress (2013)The various virtual exposures/experiences paraded throughout Catalyst’s “Meet the Avatars” paradoxically recorded and broadcast a range of troubling emotional responses to such immersion. Many participant responses suggest great caution and sensitivity be undertaken before plunging headlong into the new gold rush mentality of virtual reality, augmented reality, and AI affordances. Catalyst depicted their program subjects often responding in discomfort and distress, with some visibly overwhelmed by their encounters and left crying. There is some irony that presenter Ngyuen was himself relying on the conventions of 2D linear television journalism throughout, adopting face-to-camera address in (unconscious) automedial style to excitedly promote the assumed socio-cultural boon such automedial VR avatars will generate.Challenging AuthenticityThere are numerous ethical considerations surrounding the potential for AIs to expand beyond automedial (self-)expression towards photorealist avatars interacting outside of their pre-recorded content. When such systems evolve it may be neigh impossible to discern on screen whether the person you are conversing with is authentic or an indistinguishable, virtual doppelganger. In the future, a variant on the Turning Test may be needed to challenge and identify such hyperreal simulacra. We may be witnessing the precursor to such a dilemma playing out in the arena of audio-only podcasts, with some public intellectuals such as Sam Harris already discussing the legal and ethical problems from technology that can create audio from typed text that convincingly replicate the actual voice of a person by sampling approximately 30 minutes of their original speech (Harris). Such audio manipulation technology will soon be available to anybody with the motivation and relatively minor level of technological ability in order to assume an identity and masquerade as automediated dialogue. However, for the moment, the ability to convincingly alter a real-time computer generated video image of a person remains at the level of scientific innovation.Also of significance is the extent to which the audience reactions to such automediated expressions are indeed empathetic or simply part of the broader range of affective responses that also include direct sympathy as well as emotions such as admiration, surprise, pity, disgust and contempt (see Plantinga). There remains much rhetorical hype surrounding VR as the “ultimate empathy machine” (Milk). Yet the current use of the term “empathy” in VR, AI and automedial forms of communication seems to be principally focused on the capacity for the user-viewer to ameliorate negatively perceived emotions and experiences, whether traumatic or phobic.When considering comments about authenticity here, it is important to be aware of the occasional slippage of technological terminology into the mainstream. For example, the psychological literature does emphasise that patients respond strongly to virtual scenarios, events, and details that appear to be “authentic” (Pertaub, Slater, and Barker). Authentic in this instance implies a resemblance to a corresponding scenario/activity in the real world. This is not simply another word for photorealism, but rather it describes for instance the experimental design of one study in which virtual (AI) audience members in a virtual seminar room designed to treat public speaking anxiety were designed to exhibit “random autonomous behaviours in real-time, such as twitches, blinks, and nods, designed to encourage the illusion of life” (Kwon, Powell and Chalmers 980). The virtual humans in this study are regarded as having greater authenticity than an earlier project on social anxiety (North, North, and Coble) which did not have much visual complexity but did incorporate researcher-triggered audio clips of audience members “laughing, making comments, encouraging the speaker to speak louder or more clearly” (Kwon, Powell, and Chalmers 980). The small movements, randomly cued rather than according to a recognisable pattern, are described by the researchers as creating a sense of authenticity in the VR environment as they seem to correspond to the sorts of random minor movements that actual human audiences in a seminar can be expected to make.Nonetheless, nobody should regard an interaction with these AIs, or the avatar of Gutter, as in any way an encounter with a real person. Rather, the characteristics above function to create a disarming effect and enable the real person-viewer to willingly suspend their disbelief and enter into a pseudo-relationship with the AI; not as if it is an actual relationship, but as if it is a simulation of an actual relationship (USC). Lucy Suchman and colleagues invoke these ideas in an analysis of a YouTube video of some apparently humiliating human interactions with the MIT created AI-robot Mertz. Their analysis contends that, while it may appear on first glance that the humans’ mocking exchange with Mertz are mean-spirited, there is clearly a playfulness and willingness to engage with a form of AI that is essentially continuous with “long-standing assumptions about communication as information processing, and in the robot’s performance evidence for the limits to the mechanical reproduction of interaction as we know it through computational processes” (Suchman, Roberts, and Hird).Thus, it will be important for future work in the area of automediated testimony to consider the extent to which audiences are willing to suspend disbelief and treat the recounted traumatic experience with appropriate gravitas. These questions deserve attention, and not the kind of hype displayed by the current iteration of techno-evangelism. Indeed, some of this resurgent hype has come under scrutiny. From the perspective of VR-based tourism, Janna Thompson has recently argued that “it will never be a substitute for encounters with the real thing” (Thompson). Alyssa K. Loh, for instance, also argues that many of the negatively themed virtual experiences—such as those that drop the viewer into a scene of domestic violence or the location of a terrorist bomb attack—function not to put you in the position of the actual victim but in the position of the general category of domestic violence victim, or bomb attack victim, thus “deindividuating trauma” (Loh).Future work in this area should consider actual audience responses and rely upon mixed-methods research approaches to audience analysis. Abstract:
This article examines the hitherto unquestioned consensus in Judaic studies that Judaism embraces a positive attitude towards sexuality. Grounded in the new scholarly trends of cultural and gender analysis as well as feminist critique and their impact on Jewish studies, it singles out four focal issues: sexuality in ancient rabbinic thought, to which the most scholarly attention has been directed; and issues in modern Halakhah that have just begun to inform scholarly research: the ethos of modesty and the construction of the female body; homosexuality and lesbianism; and reproduction and sexuality. The discussion reflects the tension between these two scholarly trends, and between the conceptual-theological stratum of Judaism and its reflection in the practical-legal sphere of Jewish law (Halakhah). This examination of Jewish attitudes towards sexuality, in light of the new scholarship, leads to the conclusion that although Judaism affirms sexuality, this cannot be grasped in a simple, superficial, or monolithic fashion.

Abstract:
This chapter introduces the social, historical, and political elements of 1980s immigration debates in both policy-making and popular culture. Drawing on scholarship in American Studies, Gender and Sexuality Studies, Race and Ethnic Studies, Critical Legal Studies, and Media Studies, it outlines the two central tropes in 1980s immigration debates that culminated with the passing of the Immigration Reform and Control Act of 1986, the “nation of immigrants” and “immigration emergency” tropes. It argues that in response to the civil rights and second-wave feminist movements, gendered Reagan-era discourse about Latin American, Asian, and white ethnic immigration was a crucial ingredient in the forming of the neoliberal idea of democracy. The history of immigration and popular culture is outlined, as is the book’s methodology, which blends feminist media studies with critical legal analysis to dialectally examine significant moments in immigration policymaking and contemporary popular culture.
