Abstract:

Botanical gardens are bio-diverse flora-based natural attractions. Visitors to two prominent Malaysian botanical gardens were surveyed about their preferences for human oriented gardens’ landscape designs.There were significant differences in the preferences for garden landscapes with poorly maintained man-made structures and jungle-like garden landscapes(National Botanical Gardens), and the Japanese garden landscape (Penang Botanical Gardens) among Malays, Chinese and Indians (p<0.10). Abstract:

Even though heritage gardens have been preserved successfully in Japan, these gardens, especially the ones in Tokyo, have been surrounded by modern high-rise buildings that have entered the scenery of the gardens dramatically. This situation has become an issue from the perspective of cultural heritage preservation. This paper aimed to define the effect of modern buildings on a Japanese heritage garden called Hama-rikyu Gardens in the context of user perception by a questionnaire on site. Results indicated that the modern buildings should be eliminated from the scenery of the garden in the future since the participants preferred unspoiled views. eISSN: 2398-4287 © 2018. The Authors. Abstract:

This paper introduces a joint program between the University of Malaya and Kuala Lumpur City Hall undertaking the Therapeutic Sensory Stimulation Garden at University of Malaya Medical Centre to promote an inclusive society through sensory therapy. Good universal design practices of sensory gardens visited in the UK, Singapore, and Hong Kong is highlighted. Outcomes showed that users’ engagement with the landscape features promotes positive developments in social behaviours. In contrary, it proved a limited partnership between practitioners, researchers, authorities and users as well as non-availability of design guidelines for these gardens. Abstract:

This paper engages the users’ behaviour, their perceptions of use in sensory gardens and the reality faced by practitioners designing for these gardens, based on case-studies in the United Kingdom. Further investigation will be undertaken at Al-Bukhary International University in Malaysia once the completion of the country’s first sensory garden. Interview outcomes showed practitioners concurred on the design aspects that encourage the use of the area while the school staff had no strong views on the aesthetic value. Observation results showed pathway layout encourages behaviour, use and time spent in sensory areas. These outcomes are a significant argument in the conclusion.2398-4295 © 2016. The Authors. Abstract:

Investigation approach to migrants adaptation process in host countries has always been placed specific, in order to understand the whole connections to all aspect of life. In Melbourne, community gardens have been a place where immigrants start their interaction with others. The literature argues that the gardens can foster social inclusion, while at the same time providing space to preserve their cultural identity. This paper will investigate the adaptation of migrants within the garden setting, by considering the extent to which cultural practices in gardening affect their ability to adapt to the host country (Australia). The findings confirm a complex relationship between historical garden practices/culture and the reality of practices in the community gardens. Abstract:

Before the pandemic, residents in the Klang Valley tend to prioritize indoor living space to outdoor. This study analyzed the importance of outdoor green space in residential buildings. It consists of two objectives; to identify the type of home pocket gardens used and to evaluate the significant impact of home pocket gardens on the quality of life (QOL) during the pandemic. A survey was conducted using a five-point Likert scale and distributed to three housing communities within the Klang Valley. The learning opportunities that take place in the garden functions as a window of knowledge, a platform to build better understanding beside aroused cognitive skills during visitation. This study is aimed to identify the potential of Putrajaya Botanical Garden as a learning environment. The finding showed the male respondents rated higher than the female in all attributes associated with experiential learning at the garden. Abstract:

The purpose of the article is to examine the relationship between a so-called "garden leave" clause and a post-termination restraint of trade clause in employment contracts, in view of the decision in Vodacom (Pty) Ltd v Motsa 2016 3 SA 116 (LC). The Labour Court grappled with the question of whether the enforcement of the garden leave provision impacts on the enforcement of a post-termination restraint of trade clause. Enforcement of both these types of clauses may be problematic. It can result in unfairness if an employee ends up being commercially inactive for a long period. The author argues that garden leave has a direct effect on the enforcement of a post-termination restraint of trade clause. Accordingly, a restraint of trade will be enforced only if the employer's proprietary interest requires additional protection beyond what is achieved under the garden leave clause.

Abstract:

Auditory deterrents such as the Roo-Guard® sound emitters (Shu-Roo Australia Pty Ltd) have been used to keep kangaroos off crops and airstrips. We tested the efficacy of the Roo-Guard® Mk II sound emitter in deterring tammar wallabies (Macropus eugenii) from a known source of food on Garden Island, Western Australia, where up to 400 tammars are killed yearly by vehicles. The device was not effective in deterring the tammars from the food even when an alternative source of food was available. It was concluded that the Roo-Guards in their present form are not suitable to keep tammars off the roads of Garden Island.

Two decades ago, Malaysian leaders had expressed their desire to have a garden design concept that can represent Malaysia. This study explores the Malaysian Garden Concept (MGC) branding from the perspectives of experts recognized by the National Landscape Department (NLD). This study applies a qualitative research method, in which researchers have interviewed respondents using specific effective techniques. The MGC is meant for public parks and designed for all uses but has some significant issues. The finding found that intensive promotion, marketing, and advertising can help implement the concept of Malaysian Garden in the future. Abstract:

Taiping Lake Garden (TLG) is one of the remaining British legacies located in Taiping, Perak. TLG is facing the transformation of English landscape environment, and diminishing the public appreciation on its historical value. This study aims to investigate the transformation of TLG’s historical value in the current environment, and to propose suggestions in promoting public awareness towards conserving the historical value in historic garden. This study has assessed the public awareness through a combination of survey and case study. The research on evaluating the biological efficiency of Lifeline, WS herbicide (glufosinate ammonium, 280 g/l), UPL Holdings Ltd, the Netherlands, was carried out in the field experiments in near trunk lanes of the apple garden. It’s established that Lifeline, WS with a three time application to fruit plants in a dose of 1,1 and 1,8 l/ha showed a high biological efficiency against perennial and annual weeds (100 %). By the time of harvesting near trunk lanes of the garden were free of weed plants, which was very important for harvesting. On the basis of the obtained data Lifeline, WS (glufosinate ammonium, 280 g/l) was included in the State List of Plant Protection Means and Fertilizers Approved for Use in the Republic of Belarus.

This study attempts to perceive the level of awareness of respondents’ towards green infrastructure (GI) component in Labuan housing area with objectives; (i) to analyze the existence of GI attributes in the study area and (ii) to examine the public preferences on these attributes. The questionnaire was distributed among the 386 respondents in housing area (1800 meter radius from the botanical garden). The findings implicate that Labuan Botanical Garden not only contributes to the enhancement of visual quality of the housing areas but also offers recreational and social interaction among the residents. Conducted are researches of dynamics of glutathione reduced form maintenance in the leaves of arboreal plants which grow in the zones of different level of contamination by industrial emissions of“Red Lead Factory” LTD and ArselorMittal Kryvyi Rig. For comparison, similar investigations were conducted in the intact Botanic Garden in s.c.t. Sofievka. Findings testify to absence of negative influence of industrial emissions and, thus, the arboretum of botanical garden also can be examined as conditional control. It was stated that it is set a few strategies of active oxygen forms and their metabolites deactivation, appearing in cells under action of environment negative factors. To our opinion, fluctuation of glutathione reduced form maintenance can examine as an index of plants stability, on which investigational species can be distributed on steady and moderato steady.

HOLBECK Hall Hotel stood on the cliffs at Scarborough with views over a lawn and rose garden to the North Sea. The undercliff below the hotel was owned by Scarborough Borough Council. Over the years, natural erosion of the coastline led to relatively minor landslips in the area. The Council engaged engineers to investigate them and remedial works were carried out in 1989, but in 1993 there was a massive landslip. The lawn and rose garden fell into the sea, and the ground under the seaward wing of the hotel collapsed so badly that the whole building had to be demolished. Its owner claimed damages from the Council, and Judge John Hicks Q.C., applying Leakey v. National Trust [1980] Q.B. 485, held the Council liable for breach of a “measured duty of care”. The Court of Appeal agreed that an occupier could be under such a duty to prevent danger to a neighbour’s land from lack of support due to natural causes, but held the Council not liable because it owed no duty in relation to latent defects which could only have been discovered by extensive geological investigation: Holbeck Hall Hotel Ltd. v. Scarborough Borough Council [2000] 2 W.L.R. 1396.

Since the 1970s, courtyard gardens with diverse scales and design configurations have been introduced in the planning of Malaysian public hospitals to enhance users’ experiences. This study explores the use of sensory gardens by observing the zones and how they are utilised by children with special educational needs. Methods applied were interviews, observation and behaviour mapping, which was used in conjunction with the affordance theory. Affordance was categorised by landscape furniture, soft and hard landscape in relation to three categories of activities: Sensory stimulation, physical and social skills. The findings had discovered continuous pathways that link the sensory garden to the site context, had easy access to the features, and had the highest number of user. This study also found that users spent a longer time in zones where sensory, rather than aesthetic value, was emphasised. Abstract:

Iranian garden has been known as a specific architecture in the whole world. Among all its special features, the geometrical structure of Iranian garden has always attracted the attention of architects and researchers. Nowadays, despite numerous studies on the Iranian gardens, the lack of geometrical studies and the extension of some old concepts have led to recognize the Iranian gardens based on a unique pattern in terms of geometry. This pattern has been known as an archetype and typifies the Iranian Garden Geometry as a quarter pattern. That it could not be a true hypothesis, because the impact of garden components on its structure has been neglected. Investigating geometric position of garden elements and their relationship with the general form of garden would provide more accurate theoretical basis for Iranian garden design. In addition, this approach could help experts to retrieve the ruined part of historical gardens. So far, extensive garden studies have been carried out more on the symbolic concepts, components introduction and typology according to times and locations. This article is the first attempt to study each common element’s geometry to realize how the spatial structures could be effective in the garden formation. This paper aims to recognize the architectural geometric logic of gardens based on library studies and field recordings.

Abstract:

Forsyth contracted with Ruxley Electronics and Construction Ltd and another company to build a swimming pool in his garden. The price agreed upon was some £70, 000. The contract provided that the maximum depth of the pool should be 7ft 6in (approximately 2.25m). After the work had been completed, Mr Forsyth discovered that the maximum depth was only 6ft 9in. When the builders sued him for the balance of the contract price, Mr Forsyth counterclaimed for breach of contract. The trial judge found that the shortfall in depth had not decreased the value of the pool. Mr Ruxley had to pay the full price, however, he was awarded £2,500 in damages for loss of amenity. This decision was overturned by the Court of Appeal, which held that it was not unreasonable to award as damages the cost of replacing the swimming pool in order to make good the breach of contract. The Court awarded some £21,000 in damages. The House of Lords restored the decision of the trial judge and awarded just £2,500 in damages.

Abstract:

This experiment investigated the effect of different container design on growth and development of Small-leaved lime (Tilia cordataMill.). Experimental plants acquired in the Netherlands were of standardized height 0.4 meters, with diameter of the root neck of 3–5 mm. To monitor the effect of different types of containers (“Air-Pot™” container – Bohemiaseed, s. r. o., Squared containers “Vet” – SINCO Ltd., Containers 50 Series MCI/MCC – round plastic nursery containers, “Air pot” garden bags – Arbo ® Standard, Poland) on the physiological and morphological parameters of plants, three types of nursery containers were selected with open ground as control variant. Statistically significant difference between fluorescence and time of measurement was also found. In the Small-leaved lime the container type did not affect chlorophyll content or chlorophyll fluorescence (Fv/Fm); plants grown in Containers 50 Series MCI/MCC showed a lower chlorophyll content compared to plants grown in “Air-Pot ™” containers. As reported in literature, Fv/Fm ratio is a reliable indicator of the occurrence of environmental stresses, including water stress, on air-pot bag for several woody and herbaceous species.

This case note is an analysis of Numsa obo Members v Elements Six Productions (Pty) Ltd [2017] ZALCJHB 35 (7 February 2017). The jurisprudence advanced in this case is pertinent to balancing the employer and employee’s rights in the context of collective bargaining. The worker’s right to strike is one of the rights entrenched in the South African constitution. In addition, this right to strike should not be directly or indirectly undermined without a just cause. The preamble of the South African Constitution seeks to redress the unjust laws of the past including those in the employment arena. Furthermore, unfair discrimination is also one of the prohibited practices which are sanctioned not only domestically but internationally as well in terms of the International Labour Conventions. This note contributes to the existing literature of labour law by critically analysing the decision reached by Tlhotlhalemaje J.

In order to explore the application methods and development potential of solar energy technology in facility agriculture, and to seek a solution to resolve problems existing in greenhouse production, such as high heating cost and serious environment pollution etc. , an experimental study was carried out on a solar energy combined coal-fired boiler heating system used for greenhouse. In this paper, with Kunming Trifecta Orchid Nursery Co. Ltd of Yunnan Flower Demonstration Garden for experimental research object, the general design and operation method for the system were introduced, and an experiment on operation performance and heating effect of the system was tested in Kunming. The results showed that whether it was sunny or cloudy, the system could make full use of solar energy, make the water temperature of heat preservation tank reach a certain expectation, and ensure the temperature requirements on different growing stages of phalaenopsis in greenhouse. So a theoretical basis is provided for the study on solar energy combined with coal-fired boiler heating system for greenhouse. Through economic analysis of the system, the results showed that this system had high economic value, energy saving and environmental protection performance.

In 1888, a first recreational area was created in Kuala Lumpur as a place for the British residents. Now, after more than 120 years this lake area still exists. Reintroducing the Sydney Lake Garden as the historical park is not about enhancing the colonial heritage but more on the history that this area once had.
