Abstract:
This chapter considers defenders of conceptual engineering who have appealed to the idea that concepts have non-trivial functions, which ought to be preserved through the process of amelioration. Appeals to this idea in the work of Sally Haslanger, Ingo Brigandt, and Amie Thomasson are discussed. It is argued that although concepts might have interesting functions in a given context, the only invariant function of a concept is the trivial function of picking out its referent (i.e., the function of the concept of ‘tiger’ is to denote tigers). Hence, appeals to functions are not helpful for conceptual engineers.

Abstract:
‘Ventilator System Concept’ develops the idea that the equipment for mechanical ventilation is a ventilator system with six essential parts. Using a simple balloon model, it explains the operating principle and composition of a ventilator system, and it describes how the system generates intermittent positive airway pressure. The chapter ends by describing the conditions required for a ventilator system to function properly.

Abstract:
This chapter discusses the compliance function, a form of internalized law enforcement employed by corporations and other complex organizations to ensure that employees and others associated with the firm do not violate applicable rules, regulations or norms. It first examines compliance within a general theory of enforcement. It considers the concept of internal control, the development of the compliance function and its distribution among control personnel, and compliance programs, policies, and contracts within an organization. It then analyzes the oversight obligations of the board of directors and the management team including the chief executive officer, the chief financial officer, the chief compliance officer, the chief legal officer, and the chief risk officer. It also outlines the elements of a robust compliance program and concludes by considering internal investigations, whistleblowers, criminal enforcement, compliance outside the firm, and business ethics beyond formal compliance.

Abstract:
This article is an introduction to the concept of maritime archaeology. In the field of archaeology, the study of a shipwreck endeavors to reconstitute the original ship. Thus, nautical archaeology belongs to the larger domain of maritime archaeology. The study of shipboard artifacts and cargo comes before a structural analysis is possible. Therefore, one must know how to anticipate the expected results in order to take into consideration the ensemble of data. A ship is an assembly of elements closely linked together, which express their true role in their relation to the whole. This article explains the conception phase. Several operations are necessary to achieve construction of a ship. The conception phase must then lead to a realization phase. The realization phase must materialize, with the help of diverse processes or methods, the construction principles chosen for the structural and shape concept of the ship.

Titi, Catharine. The Function of Equity in International Law. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780198868002.001.0001.

Full text
Abstract:
A principle with a long pedigree, equity has been present in legal thought and in municipal legal systems since antiquity. Introduced in international legal decisions through claims commissions and arbitral tribunals, equity became progressively part and parcel of the international law mainstream. This book provides a systematic and comprehensive study of the legal concept of equity as it operates in contemporary international law, setting it on a new basis and dealing with some common misconceptions about it. In contrast with earlier studies on the topic, the book is informed by a body of judicial and arbitral case law that has never been so large and varied and it draws extensively on the prolific case law of investment tribunals, gaining insights from a valuable source that is typically ignored in public international law scholarship. From international cultural heritage law to the law on climate change, from maritime boundary delimitations to decisions on security for costs in investment arbitration, the relevance of equity is more far-reaching than has previously been conceded. As the importance of international law increases, continuously covering new domains, the value of equity increases with it. It is this new function of equity in the international law of the 21st century that this book explores.

Abstract:
Functional brain imaging is based on a set of assumptions. A clear appreciation of those makes it possible to form reasonable opinions regarding the potential range of application and the limits of the functional neuroimaging procedures. Exposition of these basic facts and assumptions is the primary goal of this chapter. A secondary goal is the juxtaposition of the basic concepts involved in them, such as the concept of “function,” “brain mechanism,” “neuronal network,” “activity,” and “activation”; drawing, in broad outline, a description of the methods of neuroimaging, their relative spatial and temporal resolution, and the type of neurophysiological effects each of them captures and renders in images.

Nickel, James W. Assigning Functions to Human Rights. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198713258.003.0009.

Full text
Abstract:
Theorists who assign functions to human rights often simply announce them as if they were obvious. Assigning a defining or typical function to a concept, artefact, or practice is not a straightforward empirical matter. It requires observation of uses and products, but also requires judgements of centrality and importance and uses selection criteria that can conflict. The first section of this chapter analyses the assignment of functions to artefacts, concepts, and practices and identifies some key methodological issues. The two following sections explore those methodological issues in the works of three philosophers who assign functions to human rights—James Griffin, John Rawls, and Charles Beitz. The conclusion suggests some ways in which the debate between proponents of “orthodox” and “political” conceptions of human rights can be improved.
