The US-Jordan free trade agreement and Jordan's terms of World Trade Organization accession introduced Trade-Related Aspects of Intellectual Property Rights (TRIPS)-plus rules to the country's intellectual property (IP) law. This paper examines the benefits and consequences of TRIPS-plus rules and reports numerous negative consequences. In particular, data exclusivity, a TRIPS-plus rule, delayed generic competition for 79 per cent of medicines launched by multinational pharmaceutical companies between 2002 and mid-2006, which otherwise would have been available in an inexpensive, generic form. The public health system and individuals, owing to a lack of generic competition, had to pay higher prices for new medicines. There have been no benefits from introducing strict IP rules in Jordan. There has been nearly no foreign direct investment by drug companies into Jordan between 2002 and mid-2006 to develop medicines with local companies. TRIPS-plus rules have not encouraged Jordanian generic companies to engage in research and development for medicines. Finally, new product launches in Jordan are only a fraction of total product launches in the United States and the European Union and are unaffordable for ordinary people. TRIPS-plus rules contributed to a 20 per cent increase in medicine prices between 2002 and 2006. Higher medicine prices will strain Jordan's public health system and require significant out-of-pocket expenditure that will harm the poorest.

Abstract:
Arab countries have adopted market economy principles and pursued policies designed to strengthen their economies. The cornerstone of Arab countries' long-term economic objectives has been to increase trade and support economic growth via regional and global integration. To this end, Arab countries are attempting to broaden their engagement in the multilateral trading system by joining the World Trade Organization (WTO). In addition, some Arab countries entered into trade arrangements with the United States (U.S.) to foster economic development, attract investment, and develop peaceful relationship. These trade agreements carry several implications for local economies.The purpose of this paper is to examine the implications of the trade agreements signed between the U.S. and Arab countries on the economic and legal regimes of the latter. The paper will proceed in two main parts. The first part analyzes the preferential trade arrangement known as "Qualifying Industrial Zones" created between the U.S on the one hand and Jordan, Israel, and Egypt on the other hand. It discusses the general rules of qualifying industrial zones program and the impact of these zones on local production and employment. The second part discusses trade agreements concluded between the U.S. and Arab countries. The emphasis will be on the U.S.-Jordan Free Trade Agreement as it is considered the template for future agreements signed between the U.S. and other Arab countries. The paper analyzes the most important provisions of the U.S.-Jordan Free Trade Agreement and their implications. Then, the paper will analyze trade agreements between the U.S. and other Arab countries. The paper argues that, while current trade programs between the U.S. and those Arab countries analyzed in the paper required difficult reforms in their domestic laws and led some negative consequence, on balance; these trade programs increased trade and created employment opportunities.

Abstract:
The international trade of Pakistan is highly concentrated on a few goods and markets. This study investigates macroeconomic behaviour of trade flow and explores potential trade markets for Pakistan using an augmented gravity model on a large panel of 47 cross-sections from 1980 to 2013. The result of standard gravity variables shows consistent findings with statistically significant t-statistics, whereas augmented variables reveal that relative price has a positive impact with lower price elasticity. The result of binary variables shows that Pakistan’s trade is more with countries having the same language, whereas lower trade is observed with bordering countries. The result of South Asian Free Trade Agreement (SAFTA) revealed ineffectiveness of regional integration on the creation of trade for Pakistan, whereas, bilateral free trade agreements (BFTAs) have created considerable trade. The finding of trade potential revealed exhausted potential with major trading partners and there is a need for greater trade diversification from exhausted to potential countries. It has higher untapped potential with Nepal, Iraq, India, Philippines and Jordan, respectively, in Asia, whereas European countries have the highest potential. The results concluded that Pakistan can diversify its trade from exhausted to potential countries through individual BFTAs and multilateral free trade agreements. South Asian countries should address their disputes and revisit SAFTA aiming to improve regional trade and growth.

Abstract:
This paper explores whether business law reforms in Arab countries have contributed to their economic development, business legal environment and integration into the international market. Using Jordan as an example, it explores the role of law in economic development in the region. The analysis finds that the Jordanian legal reform has led the country to participate in international markets, by incorporating international legal norms into its own legislation. This legislative reform has also contributed to economic development, allowing Jordan to join the World Trade Organization and enter into Free Trade Agreements, such as those with the United States and the European Union. In addition, the paper shows that other Arab countries, such as Saudi Arabia, that reformed their business regulations led them to join the World Trade Organization and to be ranked amongst the top 25 countries worldwide on their business ease. In contrast, other Arab countries which lack law and its enforcement have been reported to be the worst places in the Middle East to do business. As a result this paper suggests that the Arab Middle Eastern countries should continue in reforming their legal system to make it less rigid for business, to create more jobs, increase productivity and ultimately achieve economic growth.

AbstractIn 2004, Morocco, Tunisia, Egypt, and Jordan signed the Agadir Agreement (AA), a free trade agreement with intention of encouraging closer cooperation in trade. The AA came into force in 2007 and relies on the EU's rules of origin. Contrary to existing explanations, which suggest that the little impact of the AA on intraregional trade is a result of the local political elites in the agreement and of weak state institutions, this article amends the concept of isomorphic mimicry to shed some light on the ineffectiveness of the AA. It claims that instead of acting as a vehicle for regional integration, the AA generated two capability traps: premature load bearing and the reproduction of the structural weaknesses of Arab Mediterranean economies. As a result, the AA does not act as an instrument of intraregional cooperation and inclusive growth.

The paper provides an overview of laws and regulations for the protection of data submitted by pharmaceutical companies for the purposes of obtaining marketing approval for a drug in Member States of the World Trade Organization, which must comply with intellectual property provisions set in the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS). Article 39.3 of the agreement requires countries to protect undisclosed test or other data against unfair commercial use but not the adoption of exclusivity periods to protect such data. In general terms, today all developed countries have implemented an array of data exclusivity provisions with specific periods of protection, whereas most developing and least developed countries have often adopted language similar to that of Article 39.3. There are exceptions to this, mainly those countries that have negotiated free trade agreements with the United States such as Chile, Morocco and Jordan, and others that have agreed to adopt periods of exclusivity under pressure from other governments and industry groups. Furthermore, trade agreements have gradually broadened the scope of the protection thus undermining generic competition and therefore consumers' access to more affordable drugs.

After Israel and the US entered their free trade agreement in 1985, the parties realized that this FTA could be leveraged to support regional peace by fostering economic cooperation between Israel and its neighbours. The idea was to allow goods produced in certain industrial zones, which resulted in substantial economic cooperation between Israel and the other parties, as qualifying for preferential treatment under the Israel-US FTA. Ultimately, two Qualifying Industrial Zone (QIZ) agreements were signed: one between Israel, the US, and Jordan, and the second between Israel, the US, and Egypt. This article outlines the background and rules of these QIZ agreements within the larger framework of the Israel-US FTA. Many manufacturers invest large amounts of money in creating and promoting three-dimensional objects (TDOs) for their products because the appearance of the product plays a significant role in its recognition them by buyers compared to the product names and logos. It is arguable as to whether TDOs are registrable in Jordan as three-dimensional marks (3D trademarks) and would therefore be protected under Trademarks Law No. 34, 1999 and its amendments, and/or protected under Industrial Designs and Industrial Models Law No. 14, 2000. Jordan amended Trademark Law No. 33, 1952 by the Trademark Law, No. 34, 1999 and repealed Patents and Designs Law No. 33, 1953, and enacted Industrial Designs and Industrial Models Law No. 14, 2000, in compliance with Article 25 (2) of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), which states: ‘Members shall be free to meet this obligation through industrial design law or through copyright law’. However, according to Article (1) of TRIPS, ‘Members may, but shall not be obliged to, implement in their law more extensive protection than what is required by this Agreement, provided that such protection does not contravene the provisions of this Agreement.’ Unfortunately, TRIPS does not expressly mention three-dimensional trademarks in Article (15) or in any other Article, nor examined their connection with industrial designs.

Purpose Customs risk management has been widely recognized as a powerful tool to balance between trade facilitation and revenue maximization. However, most customs administrations worldwide, particularly in developing countries, are suffering from a lack of experience and knowledge to assess their risk management systems for revenue protection (RP). Customs risk management has a very limited legacy in the literature. Academic research is quite scarce and very limited, although its relevance to customs administrations. This paper aims to identify the key risk profiles and indicators that contribute to the protection of customs revenue and investigate the role of these risk profiles and indicators on customs RP using the case of Jordan Customs. Design/methodology/approach This study adopts a panel data approach by using the case of Jordan Customs. Data were collected from the risk targeting and selectivity system at Jordan Customs for the year 2019, a total of 600 observations. Findings The findings show that all risk targeting criteria except random selectivity (RS) and HS code have a significant positive association with RP. The findings also revealed that RS is an effective tool to prevent traders with fraud and offenses history from a prediction of targeting patterns and to assess the traders’ compliance and make sure their declarations are free from fraud or offenses. Moreover, the findings of this study indicate that customs administrations should adopt alternative programs such as authorized economic operator and post clearance audit as an effective means to measure and improve compliance. Research limitations/implications The main contribution of this study lies in proposing a model to assist customs administrations in assessing the performance of risk management systems to protect revenue. This model provides a comprehensive conceptualization and explanations necessary for numerous aspects of risk management projects and it assists to predict the outcomes based on formulated indicators. Practical implications This study provides guidelines for risk analysts on how to identify and assess the key risk profiles and indicators that effect on maximizing the detection of revenue leakage and to obtain interpretable and predictable results. In addition, the findings of this study will assist customs administrations in supporting revenue collection, minimizing uncertainty, allocating resources more effectively to target high-risk consignments, while simplifying the procedures for the safe consignments. Originality/value This paper is of significant value because it is one of the preliminary studies that empirically identify the risk indicators/profiles that contribute to the protection of revenue and investigate the predictive power of these risk indicators/profiles as a key predictor to protect customs revenue.

Abstract:
This proposed study aims to examine how debt financing affects the working capital management (WCM) efficiency of firms in eight selected MENA countries over the period 2016-2020. This study discusses different theories of debt financing which include the trade-off theory, the pecking order theory, the market timing theory, and the agency theory (i.e., the agency theory of debt, equity, and free cash flow). Particularly, the study addresses how short-term debt, long-term debt, and total debt influence WCM efficiency. We hypothesize that there are positive relationships between the short-term debt (measured by the current ratio), the long-term debt (measured by the long-term debt to total assets ratio), and the total debt (measured by the total debt to total assets ratio) toward WCM (measured by cash conversion cycle). Firm’s specific characteristics such as the firm type, the firm size, firm’s sales growth, and tangibility were used as control variables for WCM. To achieve the study objectives, a sample of 718 non-financial listed companies on stock exchanges in countries of Bahrain, Egypt, Jordan, Kuwait, Oman, Qatar, Saudi Arabia, and UAE will be used over the period 2016-2020. Secondary quantitative data will be collected from the annual financial statements of firms. The multiple regression model will be used to test the study hypotheses. This proposed paper originally contributes to the extant literature in several ways. First, there were limited studies of WCM in the MENA context and the current study provided a new insight that has not been investigated before in the MENA region. Thus, it bridges the gap in the literature. However, the majority of extant WCM literature emphasized the relationship between efficient WCM and firms profitability. Moreover, this paper contributes to developing efficient WCM practices and strategies that improve the financial performance of listed companies in the MENA region

Many Middle Eastern governments are seeking to liberalize their trade policies. There is a desire to abandon policies based on import substitution through protectionism, and instead concentrate on export promotion. Advisors from the World Bank and the International Monetary Fund (IMF) urge governments to be less interventionist, and to create an environment where the provate sector can have freer rein. It is hoped that private entrepreneurs can revitalize the economies, and play a major role in emport promotion. Egypt, for example, has had an open door policy since 1974 following the years of government intervention and control under Nasser. Syria has also liberalized its import regime, and would like to encourage private sector exports, and Ba'thist socialist ideology has been less emphasized in recent years.

Archaeological “checks” of classical writers Written sources and material culture in Southern ScandinaviaThe writings of classical authors have rarely been used in the study of Southern Scandinavian prehistory during the last 50 years. This is primarily because of their misuse in the early part of the 20th century and the professionalisation of archaeology after the Second World War. As the interests of archaeology have moved from a local to a regional scale this situation has changed. However, there has been no theoretical or methodological discussion of the relationship between written sources and material culture in Southern Scandinavia in the past 10-15 years, despite the employment of a wide selection of sources in studies of material culture. This is problematic since much research suggests that great theoretical and methodological care is needed in approaching this problem. Through the study of three examples, the basics of a methodology for studying prehistoric societies such as that existing in Southern Scandinavia during the Iron Age will be laid down. The three examples are: Pytheas the Massaliot and his journey to the amber island of Abalus, a comparison between exchange at the Gudme-Lundeborg ‘emporium’ with Roman-Indian trade and the historical-archaeological emergence of “the Danes”. Written sources and material cultureThe relationship between written sources and prehistoric archaeology is ambivalent. There is nothing like a reference to a written source to enliven a dry treatise! However, a direct relationship between written and archaeological sources is rare. But an archaeological interpretation is pieced together using information from many sources, and given the close relationship with historical science it is not prima facie feasible to leave out historical sources in archaeological treatises. The anthropology of antiquity is also important here since it considered the northern Barbarians to be wilder and more hot-headed and, conversely, more just and free, the further they lived from the Graeco-Roman centre of the world. Similarly, the southern and eastern Barbarians were said to be lazy and live under tyranny – a reference to the climate in which they existed. In light of this, the use of written sources relative to the archaeological record presupposes a careful consideration of textual and historical context (fig.1). The interrelation of the written sourcesThe interrelation of the sources may best be described as an equation containing an abundance of unknowns. Overall we can distinguish two main groups of sources: mythological, such as those concerning the myths of the Hyperboreans and of Apollo, and factual historical-ethnographic. The oldest factual source is undoubtedly the fragments of “On the Ocean” by Pytheas the Massaliot, mainly surviving in Strabo and Pliny. Pytheas was followed by a number of lost Hellenistic authors. In the 1st century AD, Pomponius Mela, Pliny and Tacitus all concerned themselves to some degree with lands now recognised as being in Southern Scandinavia, as did Claudius Ptolemaeus in the mid-2nd cen- tury AD. This latter work was, however, based on a compilation produced no later than c. 110 AD by Marinus of Tyros. After Claudius Ptolemaeus there is no direct mention of Southern Scandinavian prior to the 6th century AD writers of Jordanes and Prokopios.Historiographical surveyIn the early days of archaeology, J. J. A. Worsaae, Oscar Montelius and Sophus Müller considered archaeology, to a greater or lesser degree, to be part of historical science, albeit with certain specific core objectives related to material culture. It was only with the arrival of Johannes Brøndsted that archaeology thought itself able to ‘check’ the written sources against the archaeological record. This trend became more pronounced in the latter part of the 20th century as the developments of the 1930s and 1940s were denounced, and processual archaeology reigned supreme from the early 1960s onwards. Ulla Lund-Hansen’s study of Roman imports in Scandinavia changed the situation somewhat and since then teleological projects, like Fra Stamme til Stat in Denmark, the Borre project in Norway and the Svealand project in Sweden, have dominated archaeological research into the Iron Age of Southern Scandinavia. Simultaneous with these developments, other researchers have pointed out the complexity inherent in using a combination of written sources and material culture. More especially, they have shown that Germania libera, a common denomination of non-Roman Germania, is a historiographic misnomer as well as Germania magna and Germania transrhenana, none of which is mentioned in the sources. All this leads to the need for an evaluation of the relationship between written sources and the archaeological record in order to provide a sound basis for a future methodology. Pytheas the Massaliot and the NorthIn international research there is no doubt that Pytheas’ visit to Abalus, the amber island, and Ultima Thule far to the north was a real historical event. This has been questioned somewhat by Scandinavian archaeologists on the basis of, as I see it, incorrect readings of the written sources and the lack of any direct evidence of such a journey. Such evidence should, however, not be expected to exist from a single journey and the surviving fragments are sufficient to enable a few archaeological-historical suggestions to be made. For example, identification of the amber island as the former island of Thy in Northwest Jutland, and the idea of amber as fuel as being reminiscent of its use in conjunction with burial rites.The Romans in India and in Scandinavia – an analogy?Southern Scandinavia takes up no more than a few lines in Claudius Ptolemaeus’ geographical treatise of the 2nd century AD. Despite this, the meagre information offered has, in recent years, been used in conjunction with the rich sites of Gudme- Lundeborg and Himlingøje to argue for close contacts with the Roman Empire. This trade has been perceived as being analogous to that between Roman Egypt and India. This conclusion is shown to be wrong by a comparison of the archaeological records of Southern Scandinavia and India, and by considering the continuity of sources on India against the fragmentary state and diminishing number of the sources relating to Southern Scandinavia. For example, there are abundant finds of amphorae from India and none from South Scandinavia, and there is at least one major work on Romano-Indian exchange and only fragments relating to the Romano- German equivalent. The ethnogenesis of the DanesIn the first half of the 6th century AD the Danes are mentioned three times in written sources. Although we will most probably have to disengage completely Jordanes’ creation myth of the Goths from the usual link to the assumed but unproven Gothic migration from Sweden around the turn of the era, this is still an important source. Accordingly, the contemporary archaeological record indicates the appearance of a polity in Southern Scandinavia fairly likely to be connected with the Danes, and maybe even a pax Danorum of the 6th –8th centuries AD. Cultural historical fragmentsIt has been shown that it is possible both to falsify and to qualify archaeological interpretations using written sources. It has been demonstrated that Pytheas the Massaliot’s journey was a real historical event, backed up by archaeological evidence. It has also been shown that the Roman imports at Gudme-Lundeborg and Himlingøje do not seem to reflect trade equivalent to that between Rome and India. A direct comparison of the material and historical evidence seems to exclude that possibility. Furthermore, sources from the 6th century AD, together with the material culture, strongly suggest the appearance of a polity centred on the Danes and demonstrate that there is no inherent connection between Jordanes’ Gothic creation myth and the assumed Gothic migration. Methodologically it seems clear that material culture and written sources must be evaluated separately in order to judge the potential for synthesis. Only after careful consideration of the pros and cons can an argument be proposed. A major conclusion is that some modern archaeological interpretations of material culture are based partly on anachronistic readings of the relevant written sources. Accordingly, while there is positive confirmation that the written sources, even those referring to the Early Iron Age of Southern Scandinavia, may be of use in the study of prehistory, there is also a warning that this is not always the case. AbstractThe Qualified Industrial Zone (QIZ) model of border-located, duty and quota-free industrial regions is a policy tool designed to capitalize on cross-border cooperation to facilitate post-conflict normalization. Using mixed methods, this study presents and evaluates the implementation of the 1996 US initiated Israel-Jordan QIZ agreement and its social, economic and political impact, contributing to broader debates regarding the potential and limitations of post-conflict normalization through trade preference agreements. The Israel-Jordan QIZ framework no longer functions due to multiple circumstances. Yet there are lessons to be gained from the mechanisms of the QIZ implementation which contributed to the only minimal realization of its anticipated potential. We found that economic brokerage fostering trade and industry cross-border cooperation can serve one-sided economic interests while minimizing spillover to political or social realms, contrary to original intentions. The QIZ experience demonstrates the importance of self-motivation of each of the parties regarding specific cooperative ventures in realizing the potential of cross-border cooperation.

Abstract The space of tensors of metric curvature type on a Euclidean vector space carries a two-parameter family of orthogonally invariant commutative nonassociative multiplications invariant with respect to the symmetric bilinear form determined by the metric. For a particular choice of parameters these algebras recover the polarization of the quadratic map on metric curvature tensors that arises in the work of Hamilton on the Ricci flow. Here these algebras are studied as interesting examples of metrized commutative algebras and in low dimensions they are described concretely in terms of nonstandard commutative multiplications on self-adjoint endomorphisms. The algebra of curvature tensors on a 3-dimensional Euclidean vector space is shown isomorphic to an orthogonally invariant deformation of the standard Jordan product on $3 \times 3$ symmetric matrices. This algebra is characterized up to isomorphism in terms of purely algebraic properties of its idempotents and the spectra of their multiplication operators. On a vector space of dimension at least 4, the subspace of Weyl (Ricci-flat) curvature tensors is a subalgebra for which the multiplication endomorphisms are trace-free and the Killing type trace-form is a multiple of the nondegenerate invariant metric. This subalgebra is simple when the Euclidean vector space has dimension greater than 4. In the presence of a compatible complex structure, the analogous result is obtained for the subalgebra of Kähler Weyl curvature tensors. It is shown that the anti-self-dual Weyl tensors on a 4-dimensional vector space form a simple 5-dimensional ideal isometrically isomorphic to the trace-free part of the Jordan product on trace-free $3 \times 3$ symmetric matrices.

Анализ наиболее вредоносных вирусных фитопатогенов на предприятиях защищенного грунта показывает, что проникновение новых видов с семенами и готовой продукцией из других регионов и стран подвергает производство томата большому риску. Главная проблема выявления заражения длительный инкубационный период для вирусных болезней и необходимость инструментальных методов идентификации патогена. Достижения в области иммунологического и молекулярного анализа вирусов растений позволяют технически обнаруживать большое число новых видов и биотипов, сводя проблему диагностики к вопросу экономической целесообразности такого анализа. Для того, чтобы определить минимальный набор диагностируемых видов, необходимо оценить разнообразие вирусов, поражающих томат, и риск их распространения в тепличных хозяйствах Российской Федерации. Авторы анализируют ранее опубликованные данные по зараженности томата в мире и РФ для определения наиболее опасных вирусов, которые могут нанести существенный ущерб производству томата. Если учитывать число видов и наносимый ущерб, то на первых местах находятся ДНК-вирусы семейств Geminiviridae (включая род Begomovirus) и РНК-вирусы родов Tobamovirus, Cucumovirus и некоторых других. Среди вирусов с максимальным потенциальным риском бегомовирус желтой курчавости листьев томата (TYLCV). Проблемы, вызываемые бегомовирусами, в том числе TYLCV и его многочисленными локальными вариантами, связаны в первую очередь с распространением биотипа B табачной белокрылки. Он способен размножаться на широком круге растений и служит своеобразным аккумулятором вирусов может переносить около 100 различных видов. Вирус коричневой (бронзовой) морщинистости плода (ToBRFV, род Tobamovirus) был обнаружен в 2015 году в Иордании, и представляет значительный риск для всего производства томатов РФ. Поскольку противовирусные препараты недоступны, стратегии борьбы с ними основываются на генетической устойчивости растений, уничтожении переносчиков и на карантинных мерах по предотвращению заболеваний, а также на дезинфекции теплиц. Расширение международной торговли растительными продуктами повысило риск ввоза новых вирусов в растительные экосистемы с идеальными условиями для заражения растений, развития вирусов и их сохранения в течение круглого года. Изменение климатических условий может способствовать успешному распространению привнесенных вирусов и их переносчиков в экосистемы открытого грунта.Analysis of the most harmful viruses pathogenic for tomato in greenhouses shows that the spreading of new species occurs with seeds and fruits from other regions and countries, and exposes tomato production to a great risk. Long latent period for virus diseases and the need for instrumental methods of pathogen identification are the main problem for identifying the pathogen and source of infection, and decision making for its control Advances in the field of immunological and molecular analysis of plant viruses allow technically a detection of a number of virus species and biotypes, reducing the problem of diagnosis to the question of economic feasibility of such work. In order to determine the minimum set of diagnosed virus species, the diversity of viruses that infect tomatoes and the risk of their spreading in greenhouses in the Russian Federation as assayed. We analyzed some previously published data on tomato viruses across the world and the Russian Federation to determine the most harmful viruses that can cause significant damage to tomato production. Taking in account the number of species and the damage caused, the first places are hold by DNA viruses Geminiviridae (including genus Begomovirus), and RNA-virus genera Tobamovirus, Cucumovirus and some others. Among the viruses with the highest potential risk is the tomato leaf yellow curl virus (TYLCV). Problems caused by begomoviruses, including TYLCV and related species are primarily associated with the spread of the tobacco whitefly biotype B. It is able to reproduce on wide range of host plants and serves as reservoir of viruses it can a vector for about 100 species. Tomato brown rugose fruit virus (ToBRFV, genus Tobamovirus) was discovered in 2015 in Jordan, and represents a significant risk for the entire production of tomatoes in the Russian Federation. Antiviral pesticides are not available, and control strategies rely on genetic resistance or phytosanitary measures to prevent diseases, or on eradication of diseased crops and vectors, and greenhouses sanitation. Increasing international travel and trade of plant materials enhances the risk of introducing new viruses and their vectors into production systems. In addition, changing climate conditions can contribute to a successful spread of newly introduced viruses or their vectors to agro-ecosystems in areas that were previously free of those viruses.

<p style='text-indent:20px;'>The Jordan–Moore–Gibson–Thompson (JMGT) equation is a well-established and recently widely studied model for nonlinear acoustics (NLA). It is a third–order (in time) semilinear Partial Differential Equation (PDE) with a distinctive feature of predicting the propagation of ultrasound waves at <i>finite</i> speed. This is due to the heat phenomenon known as <i>second sound</i> which leads to hyperbolic heat-wave propagation. In this paper, we consider the problem in the so called "critical" case, where free dynamics is unstable. In order to stabilize, we shall use boundary feedback controls supported on a portion of the boundary only. Since the remaining part of the boundary is not "controlled", and the imposed boundary conditions of Neumann type fail to saitsfy Lopatinski condition, several mathematical issues typical for mixed problems within the context o boundary stabilizability arise. To resolve these, special geometric constructs along with sharp trace estimates will be developed. The imposed geometric conditions are motivated by the geometry that is suitable for modeling the problem of controlling (from the boundary) the acoustic pressure involved in medical treatments such as lithotripsy, thermotherapy, sonochemistry, or any other procedure involving High Intensity Focused Ultrasound (HIFU).</p>

Introduction Eating is one of the most quintessential activities of human life. Because of this primacy, eating is, as food anthropologist Sidney Mintz has observed, “not merely a biological activity, but a vibrantly cultural activity as well” (48). This article posits that the current awareness of climate change in the Western world is animating such cultural activity as the Slow Food movement and is, as a result, stimulating what could be seen as an evolutionary change in popular foodways. Moreover, this paper suggests that, in line with modelling provided by the Slow Food example, an increased awareness of the connections of climate change to the social injustices of food production might better drive social change in such areas. This discussion begins by proposing that contemporary foodways—defined as “not only what is eaten by a particular group of people but also the variety of customs, beliefs and practices surrounding the production, preparation and presentation of food” (Davey 182)—are changing in the West in relation to current concerns about climate change. Such modification has a long history. Since long before the inception of modern Homo sapiens, natural climate change has been a crucial element driving hominidae evolution, both biologically and culturally in terms of social organisation and behaviours. Macroevolutionary theory suggests evolution can dramatically accelerate in response to rapid shifts in an organism’s environment, followed by slow to long periods of stasis once a new level of sustainability has been achieved (Gould and Eldredge). There is evidence that ancient climate change has also dramatically affected the rate and course of cultural evolution. Recent work suggests that the end of the last ice age drove the cultural innovation of animal and plant domestication in the Middle East (Zeder), not only due to warmer temperatures and increased rainfall, but also to a higher level of atmospheric carbon dioxide which made agriculture increasingly viable (McCorriston and Hole, cited in Zeder). Megadroughts during the Paleolithic might well have been stimulating factors behind the migration of hominid populations out of Africa and across Asia (Scholz et al). Thus, it is hardly surprising that modern anthropogenically induced global warming—in all its’ climate altering manifestations—may be driving a new wave of cultural change and even evolution in the West as we seek a sustainable homeostatic equilibrium with the environment of the future. In 1962, Rachel Carson’s Silent Spring exposed some of the threats that modern industrial agriculture poses to environmental sustainability. This prompted a public debate from which the modern environmental movement arose and, with it, an expanding awareness and attendant anxiety about the safety and nutritional quality of contemporary foods, especially those that are grown with chemical pesticides and fertilizers and/or are highly processed. This environmental consciousness led to some modification in eating habits, manifest by some embracing wholefood and vegetarian dietary regimes (or elements of them). Most recently, a widespread awareness of climate change has forced rapid change in contemporary Western foodways, while in other climate related areas of socio-political and economic significance such as energy production and usage, there is little evidence of real acceleration of change. Ongoing research into the effects of this expanding environmental consciousness continues in various disciplinary contexts such as geography (Eshel and Martin) and health (McMichael et al). In food studies, Vileisis has proposed that the 1970s environmental movement’s challenge to the polluting practices of industrial agri-food production, concurrent with the women’s movement (asserting women’s right to know about everything, including food production), has led to both cooks and eaters becoming increasingly knowledgeable about the links between agricultural production and consumer and environmental health, as well as the various social justice issues involved. As a direct result of such awareness, alternatives to the industrialised, global food system are now emerging (Kloppenberg et al.). The Slow Food (R)evolution The tenets of the Slow Food movement, now some two decades old, are today synergetic with the growing consternation about climate change. In 1983, Carlo Petrini formed the Italian non-profit food and wine association Arcigola and, in 1986, founded Slow Food as a response to the opening of a McDonalds in Rome. From these humble beginnings, which were then unashamedly positing a return to the food systems of the past, Slow Food has grown into a global organisation that has much more future focused objectives animating its challenges to the socio-cultural and environmental costs of industrial food. Slow Food does have some elements that could be classed as reactionary and, therefore, the opposite of evolutionary. In response to the increasing homogenisation of culinary habits around the world, for instance, Slow Food’s Foundation for Biodiversity has established the Ark of Taste, which expands upon the idea of a seed bank to preserve not only varieties of food but also local and artisanal culinary traditions. In this, the Ark aims to save foods and food products “threatened by industrial standardization, hygiene laws, the regulations of large-scale distribution and environmental damage” (SFFB). Slow Food International’s overarching goals and activities, however, extend far beyond the preservation of past foodways, extending to the sponsoring of events and activities that are attempting to create new cuisine narratives for contemporary consumers who have an appetite for such innovation. Such events as the Salone del Gusto (Salon of Taste) and Terra Madre (Mother Earth) held in Turin every two years, for example, while celebrating culinary traditions, also focus on contemporary artisanal foods and sustainable food production processes that incorporate the most current of agricultural knowledge and new technologies into this production. Attendees at these events are also driven by both an interest in tradition, and their own very current concerns with health, personal satisfaction and environmental sustainability, to change their consumer behavior through an expanded self-awareness of the consequences of their individual lifestyle choices. Such events have, in turn, inspired such events in other locations, moving Slow Food from local to global relevance, and affecting the intellectual evolution of foodway cultures far beyond its headquarters in Bra in Northern Italy. This includes in the developing world, where millions of farmers continue to follow many traditional agricultural practices by necessity. Slow Food Movement’s forward-looking values are codified in the International Commission on the Future of Food and Agriculture 2006 publication, Manifesto on the Future of Food. This calls for changes to the World Trade Organisation’s rules that promote the globalisation of agri-food production as a direct response to the “climate change [which] threatens to undermine the entire natural basis of ecologically benign agriculture and food preparation, bringing the likelihood of catastrophic outcomes in the near future” (ICFFA 8). It does not call, however, for a complete return to past methods. To further such foodway awareness and evolution, Petrini founded the University of Gastronomic Sciences at Slow Food’s headquarters in 2004. The university offers programs that are analogous with the Slow Food’s overall aim of forging sustainable partnerships between the best of old and new practice: to, in the organisation’s own words, “maintain an organic relationship between gastronomy and agricultural science” (UNISG). In 2004, Slow Food had over sixty thousand members in forty-five countries (Paxson 15), with major events now held each year in many of these countries and membership continuing to grow apace. One of the frequently cited successes of the Slow Food movement is in relation to the tomato. Until recently, supermarkets stocked only a few mass-produced hybrids. These cultivars were bred for their disease resistance, ease of handling, tolerance to artificial ripening techniques, and display consistency, rather than any culinary values such as taste, aroma, texture or variety. In contrast, the vine ripened, ‘farmer’s market’ tomato has become the symbol of an “eco-gastronomically” sustainable, local and humanistic system of food production (Jordan) which melds the best of the past practice with the most up-to-date knowledge regarding such farming matters as water conservation. Although the term ‘heirloom’ is widely used in relation to these tomatoes, there is a distinctively contemporary edge to the way they are produced and consumed (Jordan), and they are, along with other organic and local produce, increasingly available in even the largest supermarket chains. Instead of a wholesale embrace of the past, it is the connection to, and the maintenance of that connection with, the processes of production and, hence, to the environment as a whole, which is the animating premise of the Slow Food movement. ‘Slow’ thus creates a gestalt in which individuals integrate their lifestyles with all levels of the food production cycle and, hence to the environment and, importantly, the inherently related social justice issues. ‘Slow’ approaches emphasise how the accelerated pace of contemporary life has weakened these connections, while offering a path to the restoration of a sense of connectivity to the full cycle of life and its relation to place, nature and climate. In this, the Slow path demands that every consumer takes responsibility for all components of his/her existence—a responsibility that includes becoming cognisant of the full story behind each of the products that are consumed in that life. The Slow movement is not, however, a regime of abstention or self-denial. Instead, the changes in lifestyle necessary to support responsible sustainability, and the sensual and aesthetic pleasure inherent in such a lifestyle, exist in a mutually reinforcing relationship (Pietrykowski 2004). This positive feedback loop enhances the potential for promoting real and long-term evolution in social and cultural behaviour. Indeed, the Slow zeitgeist now informs many areas of contemporary culture, with Slow Travel, Homes, Design, Management, Leadership and Education, and even Slow Email, Exercise, Shopping and Sex attracting adherents. Mainstreaming Concern with Ethical Food Production The role of the media in “forming our consciousness—what we think, how we think, and what we think about” (Cunningham and Turner 12)—is self-evident. It is, therefore, revealing in relation to the above outlined changes that even the most functional cookbooks and cookery magazines (those dedicated to practical information such as recipes and instructional technique) in Western countries such as the USA, UK and Australian are increasingly reflecting and promoting an awareness of ethical food production as part of this cultural change in food habits. While such texts have largely been considered as useful but socio-politically relatively banal publications, they are beginning to be recognised as a valid source of historical and cultural information (Nussel). Cookbooks and cookery magazines commonly include discussion of a surprising range of issues around food production and consumption including sustainable and ethical agricultural methods, biodiversity, genetic modification and food miles. In this context, they indicate how rapidly the recent evolution of foodways has been absorbed into mainstream practice. Much of such food related media content is, at the same time, closely identified with celebrity mass marketing and embodied in the television chef with his or her range of branded products including their syndicated articles and cookbooks. This commercial symbiosis makes each such cuisine-related article in a food or women’s magazine or cookbook, in essence, an advertorial for a celebrity chef and their named products. Yet, at the same time, a number of these mass media food celebrities are raising public discussion that is leading to consequent action around important issues linked to climate change, social justice and the environment. An example is Jamie Oliver’s efforts to influence public behaviour and government policy, a number of which have gained considerable traction. Oliver’s 2004 exposure of the poor quality of school lunches in Britain (see Jamie’s School Dinners), for instance, caused public outrage and pressured the British government to commit considerable extra funding to these programs. A recent study by Essex University has, moreover, found that the academic performance of 11-year-old pupils eating Oliver’s meals improved, while absenteeism fell by 15 per cent (Khan). Oliver’s exposé of the conditions of battery raised hens in 2007 and 2008 (see Fowl Dinners) resulted in increased sales of free-range poultry, decreased sales of factory-farmed chickens across the UK, and complaints that free-range chicken sales were limited by supply. Oliver encouraged viewers to lobby their local councils, and as a result, a number banned battery hen eggs from schools, care homes, town halls and workplace cafeterias (see, for example, LDP). The popular penetration of these ideas needs to be understood in a historical context where industrialised poultry farming has been an issue in Britain since at least 1848 when it was one of the contributing factors to the establishment of the RSPCA (Freeman). A century after Upton Sinclair’s The Jungle (published in 1906) exposed the realities of the slaughterhouse, and several decades since Peter Singer’s landmark Animal Liberation (1975) and Tom Regan’s The Case for Animal Rights (1983) posited the immorality of the mistreatment of animals in food production, it could be suggested that Al Gore’s film An Inconvenient Truth (released in 2006) added considerably to the recent concern regarding the ethics of industrial agriculture. Consciousness-raising bestselling books such as Jim Mason and Peter Singer’s The Ethics of What We Eat and Michael Pollan’s The Omnivore’s Dilemma (both published in 2006), do indeed ‘close the loop’ in this way in their discussions, by concluding that intensive food production methods used since the 1950s are not only inhumane and damage public health, but are also damaging an environment under pressure from climate change. In comparison, the use of forced labour and human trafficking in food production has attracted far less mainstream media, celebrity or public attention. It could be posited that this is, in part, because no direct relationship to the environment and climate change and, therefore, direct link to our own existence in the West, has been popularised. Kevin Bales, who has been described as a modern abolitionist, estimates that there are currently more than 27 million people living in conditions of slavery and exploitation against their wills—twice as many as during the 350-year long trans-Atlantic slave trade. Bales also chillingly reveals that, worldwide, the number of slaves is increasing, with contemporary individuals so inexpensive to purchase in relation to the value of their production that they are disposable once the slaveholder has used them. Alongside sex slavery, many other prevalent examples of contemporary slavery are concerned with food production (Weissbrodt et al; Miers). Bales and Soodalter, for example, describe how across Asia and Africa, adults and children are enslaved to catch and process fish and shellfish for both human consumption and cat food. Other campaigners have similarly exposed how the cocoa in chocolate is largely produced by child slave labour on the Ivory Coast (Chalke; Off), and how considerable amounts of exported sugar, cereals and other crops are slave-produced in certain countries. In 2003, some 32 per cent of US shoppers identified themselves as LOHAS “lifestyles of health and sustainability” consumers, who were, they said, willing to spend more for products that reflected not only ecological, but also social justice responsibility (McLaughlin). Research also confirms that “the pursuit of social objectives … can in fact furnish an organization with the competitive resources to develop effective marketing strategies”, with Doherty and Meehan showing how “social and ethical credibility” are now viable bases of differentiation and competitive positioning in mainstream consumer markets (311, 303). In line with this recognition, Fair Trade Certified goods are now available in British, European, US and, to a lesser extent, Australian supermarkets, and a number of global chains including Dunkin’ Donuts, McDonalds, Starbucks and Virgin airlines utilise Fair Trade coffee and teas in all, or parts of, their operations. Fair Trade Certification indicates that farmers receive a higher than commodity price for their products, workers have the right to organise, men and women receive equal wages, and no child labour is utilised in the production process (McLaughlin). Yet, despite some Western consumers reporting such issues having an impact upon their purchasing decisions, social justice has not become a significant issue of concern for most. The popular cookery publications discussed above devote little space to Fair Trade product marketing, much of which is confined to supermarket-produced adverzines promoting the Fair Trade products they stock, and international celebrity chefs have yet to focus attention on this issue. In Australia, discussion of contemporary slavery in the press is sparse, having surfaced in 2000-2001, prompted by UNICEF campaigns against child labour, and in 2007 and 2008 with the visit of a series of high profile anti-slavery campaigners (including Bales) to the region. The public awareness of food produced by forced labour and the troubling issue of human enslavement in general is still far below the level that climate change and ecological issues have achieved thus far in driving foodway evolution. This may change, however, if a ‘Slow’-inflected connection can be made between Western lifestyles and the plight of peoples hidden from our daily existence, but contributing daily to them. Concluding Remarks At this time of accelerating techno-cultural evolution, due in part to the pressures of climate change, it is the creative potential that human conscious awareness brings to bear on these challenges that is most valuable. Today, as in the caves at Lascaux, humanity is evolving new images and narratives to provide rational solutions to emergent challenges. As an example of this, new foodways and ways of thinking about them are beginning to evolve in response to the perceived problems of climate change. The current conscious transformation of food habits by some in the West might be, therefore, in James Lovelock’s terms, a moment of “revolutionary punctuation” (178), whereby rapid cultural adaption is being induced by the growing public awareness of impending crisis. It remains to be seen whether other urgent human problems can be similarly and creatively embraced, and whether this trend can spread to offer global solutions to them. Abstract:
The term “coffee palace” was primarily used in Australia to describe the temperance hotels that were built in the last decades of the 19th century, although there are references to the term also being used to a lesser extent in the United Kingdom (Denby 174). Built in response to the worldwide temperance movement, which reached its pinnacle in the 1880s in Australia, coffee palaces were hotels that did not serve alcohol. This was a unique time in Australia’s architectural development as the economic boom fuelled by the gold rush in the 1850s, and the demand for ostentatious display that gathered momentum during the following years, afforded the use of richly ornamental High Victorian architecture and resulted in very majestic structures; hence the term “palace” (Freeland 121). The often multi-storied coffee palaces were found in every capital city as well as regional areas such as Geelong and Broken Hill, and locales as remote as Maria Island on the east coast of Tasmania. Presented as upholding family values and discouraging drunkenness, the coffee palaces were most popular in seaside resorts such as Barwon Heads in Victoria, where they catered to families. Coffee palaces were also constructed on a grand scale to provide accommodation for international and interstate visitors attending the international exhibitions held in Sydney (1879) and Melbourne (1880 and 1888). While the temperance movement lasted well over 100 years, the life of coffee palaces was relatively short-lived. Nevertheless, coffee palaces were very much part of Australia’s cultural landscape. In this article, I examine the rise and demise of coffee palaces associated with the temperance movement and argue that coffee palaces established in the name of abstinence were modelled on the coffee houses that spread throughout Europe and North America in the 17th and 18th centuries during the Enlightenment—a time when the human mind could be said to have been liberated from inebriation and the dogmatic state of ignorance. The Temperance Movement At a time when newspapers are full of lurid stories about binge-drinking and the alleged ill-effects of the liberalisation of licensing laws, as well as concerns over the growing trend of marketing easy-to-drink products (such as the so-called “alcopops”) to teenagers, it is difficult to think of a period when the total suppression of the alcohol trade was seriously debated in Australia. The cause of temperance has almost completely vanished from view, yet for well over a century—from 1830 to the outbreak of the Second World War—the control or even total abolition of the liquor trade was a major political issue—one that split the country, brought thousands onto the streets in demonstrations, and influenced the outcome of elections. Between 1911 and 1925 referenda to either limit or prohibit the sale of alcohol were held in most States. While moves to bring about abolition failed, Fitzgerald notes that almost one in three Australian voters expressed their support for prohibition of alcohol in their State (145). Today, the temperance movement’s platform has largely been forgotten, killed off by the practical example of the United States, where prohibition of the legal sale of alcohol served only to hand control of the liquor traffic to organised crime. Coffee Houses and the Enlightenment Although tea has long been considered the beverage of sobriety, it was coffee that came to be regarded as the very antithesis of alcohol. When the first coffee house opened in London in the early 1650s, customers were bewildered by this strange new drink from the Middle East—hot, bitter, and black as soot. But those who tried coffee were, reports Ellis, soon won over, and coffee houses were opened across London, Oxford, and Cambridge and, in the following decades, Europe and North America. Tea, equally exotic, entered the English market slightly later than coffee (in 1664), but was more expensive and remained a rarity long after coffee had become ubiquitous in London (Ellis 123-24). The impact of the introduction of coffee into Europe during the seventeenth century was particularly noticeable since the most common beverages of the time, even at breakfast, were weak “small beer” and wine. Both were safer to drink than water, which was liable to be contaminated. Coffee, like beer, was made using boiled water and, therefore, provided a new and safe alternative to alcoholic drinks. There was also the added benefit that those who drank coffee instead of alcohol began the day alert rather than mildly inebriated (Standage 135). It was also thought that coffee had a stimulating effect upon the “nervous system,” so much so that the French called coffee une boisson intellectuelle (an intellectual beverage), because of its stimulating effect on the brain (Muskett 71). In Oxford, the British called their coffee houses “penny universities,” a penny then being the price of a cup of coffee (Standage 158). Coffee houses were, moreover, more than places that sold coffee. Unlike other institutions of the period, rank and birth had no place (Ellis 59). The coffee house became the centre of urban life, creating a distinctive social culture by treating all customers as equals. Egalitarianism, however, did not extend to women—at least not in London. Around its egalitarian (but male) tables, merchants discussed and conducted business, writers and poets held discussions, scientists demonstrated experiments, and philosophers deliberated ideas and reforms. For the price of a cup (or “dish” as it was then known) of coffee, a man could read the latest pamphlets and newsletters, chat with other patrons, strike business deals, keep up with the latest political gossip, find out what other people thought of a new book, or take part in literary or philosophical discussions. Like today’s Internet, Twitter, and Facebook, Europe’s coffee houses functioned as an information network where ideas circulated and spread from coffee house to coffee house. In this way, drinking coffee in the coffee house became a metaphor for people getting together to share ideas in a sober environment, a concept that remains today. According to Standage, this information network fuelled the Enlightenment (133), prompting an explosion of creativity. Coffee houses provided an entirely new environment for political, financial, scientific, and literary change, as people gathered, discussed, and debated issues within their walls. Entrepreneurs and scientists teamed up to form companies to exploit new inventions and discoveries in manufacturing and mining, paving the way for the Industrial Revolution (Standage 163). The stock market and insurance companies also had their birth in the coffee house. As a result, coffee was seen to be the epitome of modernity and progress and, as such, was the ideal beverage for the Age of Reason. By the 19th century, however, the era of coffee houses had passed. Most of them had evolved into exclusive men’s clubs, each geared towards a certain segment of society. Tea was now more affordable and fashionable, and teahouses, which drew clientele from both sexes, began to grow in popularity. Tea, however, had always been Australia’s most popular non-alcoholic drink. Tea (and coffee) along with other alien plants had been part of the cargo unloaded onto Australian shores with the First Fleet in 1788. Coffee, mainly from Brazil and Jamaica, remained a constant import but was taxed more heavily than tea and was, therefore, more expensive. Furthermore, tea was much easier to make than coffee. To brew tea, all that is needed is to add boiling water, coffee, in contrast, required roasting, grinding and brewing. According to Symons, until the 1930s, Australians were the largest consumers of tea in the world (19). In spite of this, and as coffee, since its introduction into Europe, was regarded as the antidote to alcohol, the temperance movement established coffee palaces. In the early 1870s in Britain, the temperance movement had revived the coffee house to provide an alternative to the gin taverns that were so attractive to the working classes of the Industrial Age (Clarke 5). Unlike the earlier coffee house, this revived incarnation provided accommodation and was open to men, women and children. “Cheap and wholesome food,” was available as well as reading rooms supplied with newspapers and periodicals, and games and smoking rooms (Clarke 20). In Australia, coffee palaces did not seek the working classes, as clientele: at least in the cities they were largely for the nouveau riche. Coffee Palaces The discovery of gold in 1851 changed the direction of the Australian economy. An investment boom followed, with an influx of foreign funds and English banks lending freely to colonial speculators. By the 1880s, the manufacturing and construction sectors of the economy boomed and land prices were highly inflated. Governments shared in the wealth and ploughed money into urban infrastructure, particularly railways. Spurred on by these positive economic conditions and the newly extended inter-colonial rail network, international exhibitions were held in both Sydney and Melbourne. To celebrate modern technology and design in an industrial age, international exhibitions were phenomena that had spread throughout Europe and much of the world from the mid-19th century. According to Davison, exhibitions were “integral to the culture of nineteenth century industrialising societies” (158). In particular, these exhibitions provided the colonies with an opportunity to demonstrate to the world their economic power and achievements in the sciences, the arts and education, as well as to promote their commerce and industry. Massive purpose-built buildings were constructed to house the exhibition halls. In Sydney, the Garden Palace was erected in the Botanic Gardens for the 1879 Exhibition (it burnt down in 1882). In Melbourne, the Royal Exhibition Building, now a World Heritage site, was built in the Carlton Gardens for the 1880 Exhibition and extended for the 1888 Centennial Exhibition. Accommodation was required for the some one million interstate and international visitors who were to pass through the gates of the Garden Palace in Sydney. To meet this need, the temperance movement, keen to provide alternative accommodation to licensed hotels, backed the establishment of Sydney’s coffee palaces. The Sydney Coffee Palace Hotel Company was formed in 1878 to operate and manage a number of coffee palaces constructed during the 1870s. These were designed to compete with hotels by “offering all the ordinary advantages of those establishments without the allurements of the drink” (Murdoch). Coffee palaces were much more than ordinary hotels—they were often multi-purpose or mixed-use buildings that included a large number of rooms for accommodation as well as ballrooms and other leisure facilities to attract people away from pubs. As the Australian Town and Country Journal reveals, their services included the supply of affordable, wholesome food, either in the form of regular meals or occasional refreshments, cooked in kitchens fitted with the latest in culinary accoutrements. These “culinary temples” also provided smoking rooms, chess and billiard rooms, and rooms where people could read books, periodicals and all the local and national papers for free (121). Similar to the coffee houses of the Enlightenment, the coffee palaces brought businessmen, artists, writers, engineers, and scientists attending the exhibitions together to eat and drink (non-alcoholic), socialise and conduct business. The Johnson’s Temperance Coffee Palace located in York Street in Sydney produced a practical guide for potential investors and businessmen titled International Exhibition Visitors Pocket Guide to Sydney. It included information on the location of government departments, educational institutions, hospitals, charitable organisations, and embassies, as well as a list of the tariffs on goods from food to opium (1–17). Women, particularly the Woman’s Christian Temperance Union (WCTU) were a formidable force in the temperance movement (intemperance was generally regarded as a male problem and, more specifically, a husband problem). Murdoch argues, however, that much of the success of the push to establish coffee palaces was due to male politicians with business interests, such as the one-time Victorian premiere James Munro. Considered a stern, moral church-going leader, Munro expanded the temperance movement into a fanatical force with extraordinary power, which is perhaps why the temperance movement had its greatest following in Victoria (Murdoch). Several prestigious hotels were constructed to provide accommodation for visitors to the international exhibitions in Melbourne. Munro was responsible for building many of the city’s coffee palaces, including the Victoria (1880) and the Federal Coffee Palace (1888) in Collins Street. After establishing the Grand Coffee Palace Company, Munro took over the Grand Hotel (now the Windsor) in 1886. Munro expanded the hotel to accommodate some of the two million visitors who were to attend the Centenary Exhibition, renamed it the Grand Coffee Palace, and ceremoniously burnt its liquor licence at the official opening (Murdoch). By 1888 there were more than 50 coffee palaces in the city of Melbourne alone and Munro held thousands of shares in coffee palaces, including those in Geelong and Broken Hill. With its opening planned to commemorate the centenary of the founding of Australia and the 1888 International Exhibition, the construction of the Federal Coffee Palace, one of the largest hotels in Australia, was perhaps the greatest monument to the temperance movement. Designed in the French Renaissance style, the façade was embellished with statues, griffins and Venus in a chariot drawn by four seahorses. The building was crowned with an iron-framed domed tower. New passenger elevators—first demonstrated at the Sydney Exhibition—allowed the building to soar to seven storeys. According to the Federal Coffee Palace Visitor’s Guide, which was presented to every visitor, there were three lifts for passengers and others for luggage. Bedrooms were located on the top five floors, while the stately ground and first floors contained majestic dining, lounge, sitting, smoking, writing, and billiard rooms. There were electric service bells, gaslights, and kitchens “fitted with the most approved inventions for aiding proficients [sic] in the culinary arts,” while the luxury brand Pears soap was used in the lavatories and bathrooms (16–17). In 1891, a spectacular financial crash brought the economic boom to an abrupt end. The British economy was in crisis and to meet the predicament, English banks withdrew their funds in Australia. There was a wholesale collapse of building companies, mortgage banks and other financial institutions during 1891 and 1892 and much of the banking system was halted during 1893 (Attard). Meanwhile, however, while the eastern States were in the economic doldrums, gold was discovered in 1892 at Coolgardie and Kalgoorlie in Western Australia and, within two years, the west of the continent was transformed. As gold poured back to the capital city of Perth, the long dormant settlement hurriedly caught up and began to emulate the rest of Australia, including the construction of ornately detailed coffee palaces (Freeman 130). By 1904, Perth had 20 coffee palaces. When the No. 2 Coffee Palace opened in Pitt Street, Sydney, in 1880, the Australian Town and Country Journal reported that coffee palaces were “not only fashionable, but appear to have acquired a permanent footing in Sydney” (121). The coffee palace era, however, was relatively short-lived. Driven more by reformist and economic zeal than by good business sense, many were in financial trouble when the 1890’s Depression hit. Leading figures in the temperance movement were also involved in land speculation and building societies and when these schemes collapsed, many, including Munro, were financially ruined. Many of the palaces closed or were forced to apply for liquor licences in order to stay afloat. Others developed another life after the temperance movement’s influence waned and the coffee palace fad faded, and many were later demolished to make way for more modern buildings. The Federal was licensed in 1923 and traded as the Federal Hotel until its demolition in 1973. The Victoria, however, did not succumb to a liquor licence until 1967. The Sydney Coffee Palace in Woolloomooloo became the Sydney Eye Hospital and, more recently, smart apartments. Some fine examples still survive as reminders of Australia’s social and cultural heritage. The Windsor in Melbourne’s Spring Street and the Broken Hill Hotel, a massive three-story iconic pub in the outback now called simply “The Palace,” are some examples. Tea remained the beverage of choice in Australia until the 1950s when the lifting of government controls on the importation of coffee and the influence of American foodways coincided with the arrival of espresso-loving immigrants. As Australians were introduced to the espresso machine, the short black, the cappuccino, and the café latte and (reminiscent of the Enlightenment), the post-war malaise was shed in favour of the energy and vigour of modernist thought and creativity, fuelled in at least a small part by caffeine and the emergent café culture (Teffer). Although the temperance movement’s attempt to provide an alternative to the ubiquitous pubs failed, coffee has now outstripped the consumption of tea and today’s café culture ensures that wherever coffee is consumed, there is the possibility of a continuation of the Enlightenment’s lively discussions, exchange of news, and dissemination of ideas and information in a sober environment. Abstract:
Introduction There is much to be said about house and home and about our media’s role in defining, enabling, as well as undermining it. […] For we can no longer think about home, any longer than we can live at home, without our media. (Silverstone, “Why Study the Media” 88) For lesbians, inhabiting the queer slant may be a matter of everyday negotiation. This is not about the romance of being off line or the joy of radical politics (though it can be), but rather the everyday work of dealing with the perception of others, with the “straightening devices” and the violence that might follow when such perceptions congeal into social forms. (Ahmed 107) Picture this. Once or twice a week a small, black, portable TV set goes on a journey; down from the lofty heights of the top shelf of the built in storage cupboard into the far corner of the living room. A few hours later, it is being stuffed back into the closet. Not far away across town, another small TV set sits firmly in the corner of a living room. Yet, it remains inanimate for days on end. What do you see? The techno-stories conveyed in this paper are presented through – and anchored to – the idea of the cultural biography of things (Kopytoff 1986), revealing how objects (more specifically media technologies) produce and become part of an articulation of particular and conflicting moral economies of households (Silverstone, “Domesticating Domestication”; Silverstone, Hirsch and Morley, “Information and Communication”; Green). In this context, the concept of the domestication of ICTs has been widely applied in Media Studies during the 1990s and, more recently, been updated to account for the changes in technology, household composition, media regulation, and in fact the dislocation of domesticity itself (Berker, Hartmann, Punie and Ward). Remarkable as these mainstream techno-stories are in their elucidation of contemporary techno-practices, what is still absent is the consideration of how gender and sexuality intersect and are being done through ICT consumption at home, work and during leisure practices in alternative or queer households and families. Do lesbians ‘make’ house and home and in what ways are media and ICTs implicated in the everyday work of queer home-making strategies? As writings on queer subjects and cyberspace have proliferated in recent years, we can now follow a move to contextualize queer virtualities across on and offline experiences, mapping ‘complex geographies of un/belonging’ (Bryson, MacIntosh, Jordan and Lin) and a return to consider online media as part of a bigger ICT package that constitutes our queer everyday life-worlds (Karl). At the same time, fresh perspectives are now being developed with regards to the reconfiguration of domestic values by gay men and lesbians, demonstrating the ongoing processes of probing and negotiation of ‘home’ and the questioning of domesticity itself (Gorman-Murray). By aligning ideas and concepts developed by media theorists in the field of media domestication and consumption as well as (sexual) geographers, this paper makes a contribution towards our understanding of a queer sense of home and domesticity through the technological and more specifically television. It is based on two case studies, part of a larger longitudinal ethnographic study of women-centred households in Brighton, UK. Gill Valentine has identified the home and workplaces as spaces, which are encoded as heterosexual. Sexual identities are being constrained by ‘regulatory regimes’, promoting the normalcy of heterosexuality (4). By recounting the techno-stories of lesbian women, we can re-examine notions of the home as a stable, safe, given entity; the home as a particular feminine sphere as well as the leaky boundaries between public and private. As media and ICTs are also part of a (hetero)sexual economy where they, in their materiality as well as textual significance become markers of sexual difference, we can to a certain extent perceive them as ‘straightening devices’, to borrow a phrase from Sara Ahmed. Here, we will find the articulation of a host of struggles to ‘fight the norms’, but not necessarily ‘step outside the system completely, full-time’ (Ben, personal interview [all the names of the interviewees have been changed to protect their anonymity]). In this sense, the struggle is not only to counter perceived heterosexual home-making and techno-practices, but also to question what kinds of practices to adopt and repeat as ‘fitting in’ mechanism. Significantly, these practices leave neither ‘homonormative’ nor ‘heteronormative’ imaginaries untouched and remind us that: In the case of sexual orientation, it is not simply that we have it. To become straight means that we not only have to turn towards the objects that are given to us by heterosexual culture, but also that we must “turn away” from objects that take us off this line. (Ahmed 21) In this sense then, we are all part of drawing and re-drawing the lines of belonging and un-belonging within the confines of a less than equal power-economy. Locating Dys-Location – Is There a Lesbian in the Home? In his effort to re-situate the perspective of media domestication in the 21st century, David Morley points us to ‘the process of the technologically mediated dislocation of domesticity itself’ (“What’s ‘home’” 22). He argues that ‘under the impact of new technologies and global cultural flows, the home nowadays is not so much a local, particular “self-enclosed” space, but rather, as Zygmunt Bauman puts it, more and more a “phantasmagoric” place, as electronic means of communication allow the radical intrusion of what he calls the “realm of the far” (traditionally, the realm of the strange and potentially troubling) into the “realm of the near” (the traditional “safe space” of ontological security) (23). The juxtaposition of home as a safe, ‘given’ place of ontological security vis a vis the more virtual and mediated realm of the far and potentially intrusive is itself called into question, if we re-consider the concepts of home and (dis)location in the light of lesbian geographies and ‘the production and regulation of heterosexual space’ (Valentine 1). The dislocation of home and domesticity experienced through consumption of (mobile) media technologies has always already been under-written by the potential feeling of dys-location and ‘trouble’ by lesbians on the grounds of sexual orientation. The lesbian experience disrupts the traditionally modern and notably western ideal of home as a safe haven and refuge by making visible the leaky boundaries between private seclusion and public surveillance, as much as it may (re)invest in the production of ideas and ideals of home-making and domesticity. This is illustrated for example by the way in which the heterosexuality of a parental home ‘can inscribe the lesbian body by restricting the performative aspects of a lesbian identity’, which may be subverted by covert acts of resistance (Johnston and Valentine 111; Elwood) as well as by the potentially greater freedoms of lesbian identity within a ‘lesbian home’, which may nevertheless come under scrutiny and ‘surveillance of others, especially close family, friends and neighbours’ (112). Nevertheless, more recently it has also been demonstrated how even overarching structures of familial heteronormativity are opportune to fissures and thereby queered, as Andrew Gorman-Murray illustrates in his study of Australian gay, lesbian and bisexual youth in supportive family homes. So what is, or rather, what can constitute a ‘lesbian home’ and how is it negotiated through everyday techno-practices? In and Out of the Closet – The Straight-Speaking ‘Telly’ As places go, the city of Brighton and Hove in the south-east of England fetches the prize for the highest ratio of LGBT people amongst its population in the UK, sitting at about 15%. In this sense, the home-making stories to which I will refer, of a white, lesbian single mother in her early 40s from a working-class background and a white lesbian/dyke couple in their 30s (from middle-/working-class backgrounds), are already engendered in the sense that Brighton (to them) represented in part a kind of ‘home-coming’ in itself. Helen and Ben, a lesbian butch-femme couple (‘when it takes our fancy’, Helen), had recently bought a terraced 1930s three-bedroom house with a sizeable garden in a soon to be up and coming residential area of Brighton. The neighbours are a mix of elderly, long-standing residents and ‘hetero’ families, or ‘breeders’, as Ben sometimes referred to them. Although they had lived together before, the new house constituted their first purchase together. This was significant especially for Helen, as it made their lives more ‘equal’ in terms of what goes where and the input on the overall interior decoration. Ben had shifted from London to Brighton a few years previously for a ‘quieter life’, but wished to remain connected to a queer community. Helen had made the move to Brighton from Germany – to study and enjoy the queer feel, and never left. Both full-time professionals, Helen worked in the publishing industry and Ben as a social worker. Already considering Brighton their ‘home’ town, the house purchase itself constituted another home-making challenge: as a lesbian/dyke couple on equal footing they were prepared to accept to live in a pre-dominantly straight neighbourhood, as it afforded them more space for money compared to the more visibly gay male living areas in the centre of town. The relative invisibility of queer women (and their neighbourhoods) compared to queer men in Brighton may, as it does elsewhere, be connected to issues of safety (Elwood) as well as the comparative lack of financial capacity (Bell and Valentine). Walking up to this house on the first night of my stay with them, I am struck by just how inconspicuous it appears – one of many in a long street, up a steep hill: ‘Most housing in contemporary western societies is “designed, built, financed and intended for nuclear families”’ (Bell in Bell and Valentine 7). I cannot help but think – more as a reflection on myself than of what I am about to experience – is this it? Is this the ‘domesticated lesbian’? What I see appears ‘familiar’, ‘tamed’, re-tracing the straight lines of heterosexual culture. Helen opens the door and orders me directly into the kitchen. She says ‘Ben is in the living room, watching television… Ben takes great pleasure in watching “You’ve been Framed”’. (Fieldnotes) In this context, it is appropriate to focus on the television and its place within their home-making strategies. Television, in its historical and symbolic significance, could be deemed the technological co-terminus to the ideal nuclear family home. Lynn Spigel has shown through her examination of the cultural history of TV’s formative years in post World War America how television became central to providing representations of family life, but also how the technology itself, as an object, informed material and symbolic transformations within the domestic sphere and beyond. Over the past fifty years as Morley points out, the TV has moved from its fixed place in the living room to become more personalised and encroach on other spaces in house and home and has now, in fact, re-entered the public realm (see airports and shopping malls) where it originated. At present, ‘the home itself can seen as having become … the “last vehicle”, where comfort, safety and stability can happily coexist with the possibility of instantaneous digitalised “flight” to elsewhere – and the instantaneous importation of desired elements of the “elsewhere” into the home’ (Morley, “Media, Modernity” 200). Importantly, as Morley confirms, today’s high-tech discourse is often still framed by a nostalgic vision of ‘family values’. There was only one TV set in Helen and Ben’s house: a black plastic cube with a 16” screen. It was decidedly ‘unglamorous’ as Helen pointed out. During the first round of ‘home-making’ efforts, it had found its way into a corner in the front room, with the sofa and armchair arranged in viewing distance. It was a very ‘traditional’ living room set-up. During my weeklong stay and for some weeks after, it was mostly Ben on her own ‘watching the telly’ in the early evenings ‘vegging out’ after work. Helen, meanwhile, was in the kitchen with the radio on or a CD playing, or in her ‘ICT free’ bedroom, reading. Then, suddenly, the TV had disappeared. During one of our ‘long conversations’ (Silverstone, Hirsch and Morley, “Listening”, 204) it transpired that it was now housed for most of the time on the top shelf of a storage cupboard and only ‘allowed out’ ever so often. As a material object, it had easily found its place as a small, but nevertheless quite central feature in the living room. Imbued with the cultural memory of their parents’ and that of many other living rooms, it was ‘tempting’ and easy for them to ‘accept’ it as part of a setting up home as a couple. Ben explained that they both fell into a habit, an everyday routine, to sit around it. However, settling into their new home with too much ‘ease’, they began to question their techno-practice around the TV. For Helen in particular, the aesthetics of the TV set did not fit in with her plans to re-decorate the house loosely in art deco style, tethered to her femme identity. They did not envisage creating a home that would potentially signal that a family with 2.4 children lives here. ‘The “normality” of [working] 9-5’ (Ben), was sufficient. Establishing a perceived visual difference in their living room, partly by removing the TV set, Helen and Ben aimed to ‘draw a line’ around their home and private sphere vis a vis the rest of the street and, metaphorically speaking, the straight world. The boundaries between the public and private are nevertheless porous, as it is exactly that the public perceptions of a mostly private, domesticated media technology prevent Helen and Ben from feeling entirely comfortable in its presence. It was not only the TV set’s symbolic function as a material object that made them restrict and consciously control the presence of the TV in their home space. One of Helen and Ben’s concerns in this context was that TV, as a broadcast medium, is utterly ‘conservative’ in its content and as such, very much ‘straight speaking’. To paraphrase Helen – you can only read so much between the lines and shout at the telly, it can get tiring. ‘I like watching nature programmes, but they somehow manage even here to make it sound like a hetero narrative’. Ben: ‘yeah – mind the lesbian swans’. The employment of the VCR and renting movies helps them to partly re-dress this perceived imbalance. At the same time, TV’s ‘water-cooler’ effect helps them to stay in tune with what is going on around them and enables them, for example, to participate and intervene in conversations at work. In this sense, watching TV can turn into home-work, which affords a kind of entry ticket to shared life-worlds outside the home and as such can be controlled, but not necessarily abandoned altogether. TV as a ‘straightening device’ may afford the (dis)comfort of a sense of participation in mainstream discourses and the (dis)comfort of serving as a reminder of difference at the same time. ‘It just sits there … apart from Sundays’ – and when the girls come round… Single-parent households are on the rise in the US (Russo Lemor) as well as in the UK. However, the attention given to single-parent families so far focuses pre-dominantly on single mothers and fathers after separation or divorce from a heterosexual marriage (Russo Lemor; Silverstone, “Beneath the Bottom Line”). As (queer) sociologists have began to map the field of ‘families of choice and other life experiments’ (Weeks, Heaphy and Donovan), a more concerted effort to bring together the literatures and to shed more light on the queer techno-practices of alternative families seems necessary. Liz and her young son Tim had moved to Brighton from London. As a lesbian working single mother, she raises Tim pre-dominantly on her own: ‘we are a small family, and that’s fine’. Liz’s home-making narrative is very much driven by her awareness of what she sees as her responsibilities as a mother, a lesbian mother. The move to Brighton was assessed by being able to keep her clients in London (she worked as a self-employed communication and PR person for various London councils) – ‘this is what feeds us’, and the fact that she did not want Tim to go to a ‘badly performing’ school in London. The terraced three-bedroom house she found was in a residential area, not too far from the station and in need of updating and re-decorating. The result of the combined efforts of builders, her dad (‘for some of the DIY’) and herself produced a ‘conventional’ set-up with a living room, a kitchen-diner, a small home-office (for tele-working) and Tim’s and her bedroom. Inconspicuous in its appearance, it was clearly child-oriented with a ‘real jelly bean arch’ in the hallway. The living room is relatively bare, with a big sofa, table and chairs, ‘an ancient stereo-system’ and a ‘battered TV and Video-recorder’ in the corner. ‘We hardly use it’, Liz exclaims. ‘We much rather spend time out and about if there is a chance … quality time, rather than watching TV … or I read him stories in bed. I hate the idea of TV as a baby sitter … I have very deliberately chosen to have Tim and I want to make the most of it’. For Liz, the living room with the TV set in it appears as a kind of gesture to what family homes ‘look like’. As such, the TV and furniture set-up function as a signal and symbol of ‘normality’ in a queer household – perhaps a form of ‘passing’ for visitors and guests. The concern for the welfare of her son in this context is a sign and reflection of a constant negotiation process within a pre-dominantly heterosexual system of cultural symbols and values, which he, of course, is already able to ‘compare’ and evaluate when he is out and about at school or visiting friends in their homes. Unlike in Helen and Ben’s home, the TV is therefore allowed to stay out of the closet. Still, Liz rarely watches TV at all, for reasons not dissimilar to those of Helen and Ben. Apart from this, she shares a lack of spare time with many other single parents. Significantly, the living room and TV do receive a queer ‘make-over’ now and then, when Tim is in bed or with his father on a weekend and ‘the girls’ come over for a drink, chat and video viewing (noticeably, the living room furniture and TV get pushed around and re-arranged to accommodate the crowd). In this sense, Liz, in her home-making practices, carefully manages and performs ‘object relationships’ that allow her and her son to ‘fit in’ as much as to advocate ‘difference’ within the construction of ‘normalcy’. The pressures of this negotiation process are clearly visible. Conclusion – Re-Engendering Home and Techno-Practices As women as much as lesbians, Helen, Ben and Liz are, like so many others, part of a historical and much wider struggle regarding visibility, equality and justice. If this article had been dedicated to gay/queer men and their techno- and home-making sensibilities, it would have read somewhat differently to be sure. Of course, questions of gender and sexual identities would have remained equally paramount, as they always should, enfolding questions of class, race and ethnicity (Pink 2004). The concept and practice of home have a deeply engendered history. Queer practices ‘at home’ are always already tied up with knowledges of gendered practices and spaces. As Morley has observed, ‘space is gendered on a variety of scales … the local is often associated with femininity and seen as the natural basis of home and community, into which an implicitly masculine realm intrudes’ (“Home Territories” 59). As the public and private realms have been gendered masculine and feminine respectively, so have media and ICTs. Although traditional ideas of home and gender relations are beginning to break down and the increasing personalization and mobilization of ICTs blur perceptions of the public and private, certain (idealized, heterosexualized and gendered) images of home, domesticity and family life seem to be recurring in popular discourse as well as mainstream academic writing. As feminist theorists have illustrated the ways in which gender needs to be seen as performative, feminist and queer theorists also ought to work further on finding vocabularies and discourses that capture and highlight diversity, without re-invoking the spectre of the nuclear family (home) itself (Weeks, Heaphy and Donovan). What I found was not the ‘domesticated’ lesbian ‘at home’ in a traditional feminine sphere. Rather, I experienced a complex set of re-negotiations and re-inscriptions of the domestic, of gender and sexual values and identities as well as techno-practices, leaving a trace, a mark on the system no matter how small (Helen: ‘I do wonder what the neighbours make of us’). The pressure and indeed desire to ‘fit in’ is often enormous and therefore affords the re-tracing of certain trodden paths of domesticity and ICT consumption. Abstract:
Introduction In a 2019 report for the International Journal of Communication, Baym et al. positioned distributed blockchain ledger technology, and what would subsequently be referred to as Web3, as a convening technology. Riffing off Barnett, a convening technology “initiates and serves as the focus of a conversation that can address issues far beyond what it may ultimately be able to address itself” (403). The case studies for the Baym et al. research—early, aspirant projects applying the blockchain concept to music publishing and distribution—are described in the piece as speculations or provocations concerning music’s commercial and social future. What is convened in this era (pre-2017 blockchain music discourse and practice) is the potential for change: a type of widespread, broadly discussed, reimagination of the 21st-century music industries, productive precisely because near-future applications suggest the realisation of what Baym et al. call dreams. In this article, we aim to examine the Web3 music field as it lies some years later. Taking the latter half of 2021 as our subject, we present a survey of where music then resided within Web3, focussing on how the dreams of Baym et al. have morphed and evolved, and materialised and declined, in the intervening years. By investigating the discourse and functionality of 2021’s current crop of music NFTs—just one thread of music Web3’s far-reaching aspiration, but a potent and accessible manifestation nonetheless—we can make a detailed analysis of concept-led application. Volatility remains throughout the broader sector, and all of the projects listed here could be read as conditionally short-term and untested, but what they represent is a series of clearly evolved case studies of the dream, rich precisely because of what is assumed and disregarded. WTF Is an NFT? Non-fungible tokens inscribe indelible, unique ledger entries on a blockchain, detailing ownership of, or rights associated with, assets that exist off-chain. Many NFTs take the form of an ERC-721 smart-contract that functions as an indivisible token on the Ethereum blockchain. Although all ERC-721 tokens are NFTs, the inverse is not true. Similar standards exist on other blockchains, and bridges allow these tokens to be created on alternative networks such as Polygon, Solana, WAX, Cardano and Tezos. The creation (minting) and transfer of ownership on the Ethereum network—by far the dominant chain—comes with a significant and volatile transaction cost, by way of gas fees. Thus, even a “free” transaction on the main NFT network requires a currency and time investment that far outweighs the everyday routines of fiat exchange. On a technical level, the original proposal for the ERC-721 standard refers to NFTs as deeds intended to represent ownership of digital and physical assets like houses, virtual collectibles, and negative value assets such as loans (Entriken et al.). The details of these assets can be encoded as metadata, such as the name and description of the asset including a URI that typically points to either a file somewhere on the Internet or a file hosted via IPFS, a decentralised peer-to-peer hosting network. As noted in the standard, while the data inscribed on-chain are immutable, the asset being referred to is not. Similarly, while each NFT is unique, multiple NFTs could, in theory, point to a single asset. In this respect ERC-721 tokens are different from cryptocurrencies and other tokens like stable-coins in that their value is often contingent on their accurate and ongoing association with assets outside of the blockchain on which they are traded. Further complicating matters, it is often unclear if and how NFTs confer ownership of digital assets with respect to legislative or common law. NFTs rarely include any information relating to licencing or rights transfer, and high-profile NFTs such as Bored Ape Yacht Club appear to be governed by licencing terms held off-chain (Bored Ape Yacht Club). Finally, while it is possible to inscribe any kind of data, including audio, into an NFT, the ERC-721 standard and the underpinning blockchains were not designed to host multimedia content. At the time of writing, storing even a low-bandwidth stereo audio file on the ethereum network appears cost-prohibitive. This presents a challenge for how music NFTs distinguish themselves in a marketplace dominated by visual works. The following sections of this article are divided into what we consider to be the general use cases for NFTs within music in 2021. We’ve designated three overlapping cases: audience investment, music ownership, and audience and business services. Audience Investment Significant discourse around NFTs focusses on digital collectibles and artwork that are conceptually, but not functionally, unique. Huge amounts of money have changed hands for specific—often celebrity brand-led—creations, resulting in media cycles of hype and derision. The high value of these NFTs has been variously ascribed to their high novelty value, scarcity, the adoption of NFTs as speculative assets by investors, and the lack of regulatory oversight allowing for price inflation via practices such as wash-trading (Madeline; Das et al.; Cong et al.; Le Pennec, Fielder, and Ante; Fazil, Owfi, and Taesiri). We see here the initial traditional split of discourse around cultural activity within a new medium: dual narratives of utopianism and dystopianism. Regardless of the discursive frame, activity has grown steadily since stories reporting the failure of Blockchain to deliver on its hype began appearing in 2017 (Ellul). Early coverage around blockchain, music, and NFTs echoes this capacity to leverage artificial scarcity via the creation of unique digital assets (cf Heap; Tomaino). As NFTs have developed, this discourse has become more nuanced, arguing that creators are now able to exploit both ownership and abundance. However, for the most part, music NFTs have essentially adopted the form of digital artworks and collectibles in editions ranging from 1:1 or 1:1000+. Grimes’s February 2021 Mars NFT pointed to a 32-second rotating animation of a sword-wielding cherubim above the planet Mars, accompanied by a musical cue (Grimes). Mars sold 388 NFTs for a reported fixed price of $7.5k each, grossing $2,910,000 at time of minting. By contrast, electronic artists Steve Aoki and Don Diablo have both released 1:1 NFT editions that have been auctioned via Sotheby’s, Superrare, and Nifty Gateway. Interestingly, these works have been bundled with physical goods; Diablo’s Destination Hexagonia, which sold for 600 Eth or approximately US$1.2 million at the time of sale, proffered ownership of a bespoke one-hour film hosted online, along with “a unique hand-crafted box, which includes a hard drive that contains the only copy of the high-quality file of the film” (Diablo). Aoki’s Hairy was much less elaborate but still promised to provide the winner of the $888,888 auction with a copy of the 35-second video of a fur-covered face shaking in time to downbeat electronica as an Infinite Objects video print (Aoki). In the first half of 2021, similar projects from high-profile artists including Deadmau5, The Weekend, Snoop Dogg, Eminem, Blondie, and 3Lau have generated an extraordinary amount of money leading to a significant, and understandable, appetite from musicians wanting to engage in this marketplace. Many of these artists and the platforms that have enabled their sales have lauded the potential for NFTs to address an alleged poor remuneration of artists from streaming and/or bypassing “industry middlemen” (cf. Sounds.xyz); the millions of dollars generated by sales of these NFTs presents a compelling case for exploring these new markets irrespective of risk and volatility. However, other artists have expressed reservations and/or received pushback on entry into the NFT marketplace due to concerns over the environmental impact of NFTs; volatility; and a perception of NFT markets as Ponzi schemes (Poleg), insecure (Goodin), exploitative (Purtill), or scammy (Dash). As of late 2021, increased reportage began to highlight unauthorised or fraudulent NFT minting (cf. TFL; Stephen), including in music (Newstead). However, the number of contested NFTs remains marginal in comparison to the volume of exchange that occurs in the space daily. OpenSea alone oversaw over US$2.5 billion worth of transactions per month. For the most part, online NFT marketplaces like OpenSea and Solanart oversee the exchange of products on terms not dissimilar to other large online retailers; the space is still resolutely emergent and there is much debate about what products, including recently delisted pro-Nazi and Alt-Right-related NFTs, are socially and commercially acceptable (cf. Pearson; Redman). Further, there are signs this trend may impact on both the willingness and capacity of rightsholders to engage with NFTs, particularly where official offerings are competing with extant fraudulent or illegitimate ones. Despite this, at the time of writing the NFT market as a whole does not appear prone to this type of obstruction. What remains complicated is the contested relationship between NFTs, copyrights, and ownership of the assets they represent. This is further complicated by tension between the claims of blockchain’s independence from existing regulatory structures, and the actual legal recourse available to music rights holders. Music Rights and Ownership Baym et al. note that addressing the problems of rights management and metadata is one of the important discussions around music convened by early blockchain projects. While they posit that “our point is not whether blockchain can or can’t fix the problems the music industries face” (403), for some professionals, the blockchain’s promise of eliminating the need for trust seemed to provide an ideal solution to a widely acknowledged business-to-business problem: one of poor metadata leading to unclaimed royalties accumulating in “black boxes”, particularly in the case of misattributed mechanical royalties in the USA (Rethink Music Initiative). As outlined in their influential institutional research paper (partnered with music rights disruptor Kobalt), the Rethink Music Initiative implied that incumbent intermediaries were benefiting from this opacity, incentivising them to avoid transparency and a centralised rights management database. This frame provides a key example of one politicised version of “fairness”, directly challenging the interest of entrenched powers and status quo systems. Also present in the space is a more pragmatic approach which sees problems of metadata and rights flows as the result of human error which can be remedied with the proper technological intervention. O’Dair and Beaven argue that blockchain presents an opportunity to eliminate the need for trust which has hampered efforts to create a global standard database of rights ownership, while music business researcher Opal Gough offers a more sober overview of how decentralised ledgers can streamline processes, remove inefficiencies, and improve cash flow, without relying on the moral angle of powerful incumbents holding on to control accounts and hindering progress. In the intervening two years, this discourse has shifted from transparency (cf. Taghdiri) to a practical narrative of reducing system friction and solving problems on the one hand—embodied by Paperchain, see Carnevali —and ethical claims reliant on the concept of fairness on the other—exemplified by Resonate—but with, so far, limited widespread impact. The notion that the need for b2b collaboration on royalty flows can be successfully bypassed through a “trustless” blockchain is currently being tested. While these earlier projects were attempts to either circumvent or fix problems facing the traditional rights holders, with the advent of the NFT in particular, novel ownership structures have reconfigured the concept of a rights holder. NFTs promise fans an opportunity to not just own a personal copy of a recording or even a digitally unique version, but to share in the ownership of the actual property rights, a role previously reserved for record labels and music publishers. New NFT models have only recently launched which offer fans a share of IP revenue. “Collectors can buy royalty ownership in songs directly from their favorite artists in the form of tokens” through the service Royal. Services such as Royal and Vezt represent potentially massive cultural shifts in the traditional separation between consumers and investors; they also present possible new headaches and adventures for accountants and legal teams. The issues noted by Baym et al. are still present, and the range of new entrants into this space risks the proliferation, rather than consolidation, of metadata standards and a need to put money into multiple blockchain ecosystems. As noted in RMIT’s blockchain report, missing royalty payments … would suggest the answer to “does it need a blockchain?” is yes (although further research is needed). However, it is not clear that the blockchain economy will progress beyond the margins through natural market forces. Some level of industry coordination may still be required. (18) Beyond the initial questions of whether system friction can be eased and standards generated without industry cooperation lie deeper philosophical issues of what will happen when fans are directly incentivised to promote recordings and artist brands as financial investors. With regard to royalty distribution, the exact role that NFTs would play in the ownership and exploitation of song IP remains conceptual rather than concrete. Even the emergent use cases are suggestive and experimental, often leaning heavily on off-chain terms, goodwill and the unknown role of existing legal infrastructure. Audience and Business Services Aside from the more high-profile NFT cases which focus on the digital object as an artwork providing a source of value, other systemic uses of NFTs are emerging. Both audience and business services are—to varying degrees—explorations of the utility of NFTs as a community token: i.e. digital commodities that have a market value, but also unlock ancillary community interaction. The music industries have a longstanding relationship with the sale of exclusivity and access tailored to experiential products. Historically, one of music’s most profitable commodities—the concert ticket—contains very little intrinsic value, but unlocks a hugely desirable extrinsic experience. As such, NFTs have already found adoption as tools of music exclusivity; as gateways into fan experiences, digital communities, live events ticketing and closed distribution. One case study incorporating almost all of these threads is the Deathbats club by American heavy metal band Avenged Sevenfold. Conceived of as the “ultimate fan club”, Deathbats is, according to the band’s singer M. Shadows, “every single thing that [fans] want from us, which is our time, our energy” (Chan). At the time of writing, the Deathbats NFT had experienced expected volatility, but maintained a 30-day average sale price well above launch price. A second affordance provided by music NFTs’ ability to tokenise community is the application of this to music businesses in the form of music DAOs: decentralised autonomous organisations. DAOs and NFTs have so far intersected in a number of ways. DAOs function as digital entities that are owned by their members. They utilise smart contracts to record protocols, votes, and transactions on the blockchain. Bitcoin and Ethereum are often considered the first DAOs of note, serving as board-less venture capital funds, also known as treasuries, that cannot be accessed without the consensus of their members. More recently, DAOs have been co-opted by online communities of shared interests, who work towards an agreed goal, and operate without the need for leadership. Often, access to DAO membership is tokenised, and the more tokens a member has, the more voting rights they possess. All proposals must pass before members, and have been voted for by the majority in order to be enacted, though voting systems differ between DAOs. Proposals must also comply with the DAO’s regulations and protocols. DAOs typically gather in online spaces such as Discord and Zoom, and utilise messaging services such as Telegram. Decentralised apps (dapps) have been developed to facilitate DAO activities such as voting systems and treasury management. Collective ownership of digital assets (in the form of NFTs) has become commonplace within DAOs. Flamingo DAO and PleasrDAO are two well-established and influential examples. The “crypto-backed social club” Friends with Benefits (membership costs between $5,000 and $10,000) serves as a “music discovery platform, an online publication, a startup incubator and a kind of Bloomberg terminal for crypto investors” (Gottsegen), and is now hosting its own curated NFT art platform with work by the likes of Pussy Riot. Musical and cross-disciplinary artists and communities are also exploring the potential of DAOs to empower, activate, and incentivise their communities as an extension of, or in addition to, their adoption and exploration of NFTs. In collaboration with Never Before Heard Sounds, electronic artist and musical pioneer Holly Herndon is exploring ideological questions raised by the growing intelligence of AI to create digital likeness and cloning through voice models. Holly+ is a custom voice instrument that allows users to process pre-existing polyphonic audio through a deep neural network trained by recordings of Holly Herndon’s voice. The output is audio-processed through Holly Herndon’s distinct vocal sound. Users can submit their resulting audio to the Holly+ DAO, to whom she has distributed ownership of her digital likeness. DAO token-holders steward which audio is minted and certified as an NFT, ensuring quality control and only good use of her digital likeness. DAO token-holders are entitled to a percentage of profit from resales in perpetuity, thereby incentivising informed and active stewardship of her digital likeness (Herndon). Another example is LA-based label Leaving Records, which has created GENRE DAO to explore and experiment with new levels of ownership and empowerment for their pre-existing community of artists, friends, and supporters. They have created a community token—$GENRE—for which they intend a number of uses, such as “a symbol of equitable growth, a badge of solidarity, a governance token, currency to buy NFTs, or as a utility to unlock token-gated communities” (Leaving Records). Taken as a whole, the spectrum of affordances and use cases presented by music NFTs can be viewed as a build-up of interest and capital around the technology. Conclusion The last half of 2021 was a moment of intense experimentation in the realms of music business administration and cultural expression, and at the time of writing, each week seemed to bring a new high-profile music Web3 project and/or disaster. Narratives of emancipation and domination under capitalism continue to drive our discussions around music and technology, and the direct link to debates on ecology and financialisation make these conversations particularly polarising. High-profile cases of music projects that overstep norms of existing IP rights, such as Hitpiece’s attempt to generate NFTs of songs without right-holders’ consent, point to the ways in which this technology is portrayed as threatening and subversive to commercial musicians (Blistein). Meanwhile, the Water and Music research DAO promises to incentivise a research community to “empower music-industry professionals with the knowledge, network and skills to do more collaborative and progressive work with technology” through NFT tokens and a DAO organisational structure (Hu et al.). The assumption in many early narratives of the ability of blockchain to provide systems of remuneration that musicians would embrace as inherently fairer is far from the reality of a popular discourse marked by increasing disdain and distrust, currently centred on NFTs as lacking in artistic merit, or even as harmful. We have seen all this talk before, of course, when jukeboxes and player pianos, film synchronisation, radio, recording, and other new communication technologies steered new paths for commercial musicians and promised magical futures. All of these innovations were met with intense scrutiny, cries of inauthentic practice, and resistance by incumbent musicians, but all were eventually sustained by the emergence of new forms of musical expression that captured the interest of the public. On the other hand, the road towards musical nirvana passes by not only the more prominent corpses of the Digital Audio Tape, SuperAudio, and countless recording formats, but if you squint and remember that technology is not always about devices or media, you can see the Secure Download Music Initiative, PressPlay, the International Music Registry, and Global Repertoire Databases in the distance, wondering if blockchain might correct some of the problems they dreamed of solving in their day. The NFT presents the artistic and cultural face of this dream of a musical future, and of course we are first seeing the emergence of old models within its contours. While the investment, ownership, and service phenomena emerging might not be reminiscent of the first moment when people were able to summon a song recording onto their computer via a telephone modem, it is important to remember that there were years of text-based chat rooms before we arrived at music through the Internet. It is early days, and there will be much confusion, anger, and experimentation before music NFTs become either another mundane medium of commercial musical practice, or perhaps a memory of another attempt to reach that goal.
