Full textThe events of February 1848, somewhat, a revolution, bestow a change in political regime, and subsequently to the "Droit Public", affecting the top of the state structure as a result: the "Assemblée nationale". The rules she creates in ordre to control its interest, its internal legality in fact, are evolving quite considerably during the Second Republic. No longer can the new elected people's representatives ignore the past, but instead they must use the French institutional experience to put in place efficient work methods, better adapted to the new deliberating organ. Drawn in by this rejuvenating process, the entire juridical structure is unified during 1848 and 1851. The "Règlement Intérieur": the principal source of internal legality is also influenced progressively altered in three different ways by improving its contents, the object, and its decisiveness. The effects are indeed contained inside the representative body; however, they also affect the institutional balance. Those two aspects will thrive until the December 2nd, 1851, State Coup: the Third Republic Regime and the Parliamentary right will deeply suffer, somewhat, conditioned by previous Constituting and legislative National Assemblies of the mid nineteenth century performances

Full textThe thesis examines - through a comparative approach - the first European realization of the maie direct universal suffrage, which takes place both under the Second French Republic and the Italian démocratie expériences (Venice, Rome, Tuscany). As far as public discourse and law are concemed, the thesis focuses onto the debates starting from the Thirties and the 1848-49's codifications. On the contrary, as far as the political expériences are concerned, it analyses the convocation of the French and the Roman Constituent Assemblies. Thus, this spécifie multidimensional approach allows an actual vérification of the collective aspect of the 1848-49's v te. Besides, it shows itself not as the resuit of the interaction between an arcaic society and political vision and some assumed modem institutions, but as the conséquence of a spécifie concept of the suffrage and as its tranformation into électoral rules. Yet, the protagonist of the whole process is not the individual elector, but a sort of "elector people", who is celebrated precisely because of both his wiseness and his natural inclination towards the best possible choice

Full textFar from being a purely theoretical work, writing a republican Constitution in the nineteenth century required its authors to adapt their ideological beliefs to political realities. The minutes of the writing committee for the Constitution of the second Republic, as well as the minutes of the Commissions des Trente, whose job it was to examine the various projects for the Constitutional Laws of 1875, allow us to identify the driving forces within the 1848 and 1875 Assemblées Constituantes. It has sometimes been suggested by historiography that the lack of institutional harmony under the second Republic served the personal ambitions of Louis-Napoléon Bonaparte and that the Constitutional Laws of 1875 were conceived purely as incidental measures designed to escape a temporary regime. However, the confrontation of these two supreme norms clearly shows a continuity of regime values. Indeed, a comparative study of these two nineteenth century republican Constitutions underlines their common traits. This may appear surprising as the second Republic has often been portrayed as a rational work drawing inspiration from the first French constitutional experiences, whereas the 1875 model is supposed to be of Orléaniste obedience. However, close scrutiny of the constitutional commission manuscripts as well as that of constituent debates for 1848 and the years 1871-1875 easily allows us to overcome that impression
