Abstract:
Chapter 14 concerns formulas for measuring expectation damages for breach of a contract for the sale of goods. If the buyer breaches one of three formulas may be used to measure the seller’s damages. If the seller resells the goods she should normally be entitled to the difference between the resale price and the contract price. If the seller does not resell the goods she should normally be entitled to recover the difference between the market price of the goods and the contract price. A third formula is based on the seller’s lost profit, measured by the difference between the seller’s variable costs of performance and the contract price. If the seller breaches one of three formulas may also be applied. If the goods are defective the buyer can recover damages for the defect. If the seller fails to deliver the goods the buyer can either cover and sue for cover damages or not cover and sue for market-prices damages. A buyer cannot sue for lost profits as direct or general damages, but can sue for lost profits if it was reasonably foreseeable when the contract was made that if the seller failed to deliver the goods the buyer would incur the lost profits.

Abstract:
Chapter 15 concerns formulas for measuring expectation damages for contracts to provide services, including breaches by both service-purchasers and service-providers. In case of breach by service-purchasers one formula is based on the service-provider’s lost profit. Under an alternative formula the service-provider is entitled to the contract price minus the out-of-pocket costs remaining to be incurred by the service-provider at the time of breach. Although these two expressions look very different they are algebraically equivalent and yield the same amount of damages. In case of breach by the service-provider the core formulas for measuring damage to the service-purchaser involve either cost-of-completion or diminished-value damages.

Chapter 13 concerns the building blocks of formulas to measure expectation damages: replacement cost, market price, resale price, diminished value, and lost profits. Replacement-cost damages are based on the difference between the contract price and the actual or imputed cost of a replacement transaction. Resale-price damages are based on the difference between the contract price payable by a breaching buyer and the price the seller received on resale to a third party. Diminished-value damages are based on the difference between the value of the performance that a breaching seller rendered and the value of the performance that she promised to render. Lost-profit damages are based on the difference between the price a breaching buyer agreed to pay and the seller’s variable costs.

This book considers the early development and reception of what is today the most widely professed Christian conception of Christ. The development of this doctrine admits of wide variations in expression and understanding, varying emphases in interpretation that are as striking in authors of the first millennium as they are among modern writers. The seven early ecumenical councils and their dogmatic formulations are crucial way stations in defining the shape of this study. It argues that the scope of previous enquiries, which focused on the declaration of the Council of Chalcedon in AD 451 that Christ was one Person in two natures, the Divine of the same substance as the Father, and the human of the same substance as us, now seems excessively narrow and distorts our understanding. Daley sets aside the Chalcedonian formula and instead considers what some major Church Fathers—from Irenaeus to John Damascene—say about the person of Christ.

Deuterium fusion in a small field-ionization device is described. The small rate of deuterium fusion observed in the deuterium-muon version of the hydrogen molecule-ion is discussed. A simplified description is offered of the tokamak reactor filled with deuterium or deuterium-tritium molecular gases. The potential power output of such devices, neglecting any role of plasma instabilities, is estimated roughly by scaling in temperature and density the formula for fusion in the Sun’s core provided in Chapter 4. If it can be achieved, deuteron fusion would qualify as a renewable energy process given the large supply of deuterons in the sea. In this Chapter we build upon what we learned about fusion in the Sun with the hope of applying the same process on Earth.

On the basis of the Regional Formula, Pepsu was merged with the Punjab and the new state was inaugurated on 1 November 1956. The other provisions of the Regional Formula were diluted or indefinitely delayed. Apart from the ‘Save Hindi’ agitation, Master Tara Singh differed widely with Nehru on three major issues. The first related to their understanding about the number of seats to be given to the Akali candidates. The second issue was the defection of Gian Singh Rarewala to join the Congress before the decision of the Akali Dal in favour of merger. The third issue was Nehru’s all-out support to Partap Singh Kairon despite serious charges of misuse of office. By October 1958, the Regional Formula was dead so far as Master Tara Singh was concerned.

The work of Raymond Queneau, who is usually regarded as avoiding making political statements, presents a fruitful case for examining how a civilian writer critiques the transmission of news of war through formal procedures. In poems that explore civilian witnessing and reception of war news, the figure of a solitary reader hunched over a newspaper during a political crisis appears at the same time as Queneau experiments with forms drawn from classical rhetoric (like the progymnasmata, a handbook of rhetorical exercises) and with journalistic formulae (like the fait divers). Close examination of Exercices de style, along with a series of poems Queneau wrote about the Munich Agreement, reveals he developed tropes and schemes that convey obliquity, self-interruption, and repetition as ways of articulating the civilian experience and critiquing the narrative framing of war news.

Luca Giuliani evaluates Laocoon as an ‘analytical tool’ for twenty-first-century classical archaeology. In doing so, he returns to some of the same literary case studies that so engrossed Lessing 250 years ago—and none more so than Homer’s Iliad. By probing Lessing’s theories of the respective workings of art and text, and exploring them in the context of ancient depictions of the Iliad (especially seventh- and sixth-century BC vase-paintings), the chapter explores both the virtues and the problems of Lessing’s account. As Giuliani argues, this historical perspective can help us formulate the analytical importance of Lessing’s framework; at the same time, the perspective of ancient art can help us see how Lessing’s text is as much a treatise against as about the visual arts.

Stimulus without debt for any economically advanced country with its own central bank is the same as for the United States. In the eurozone there is one central bank, the European Central Bank (ECB), but many member countries, each with its own national government and legislature for setting government spending, tax rates, and fiscal stimulus. This chapter proposes that under a stimulus-without-debt plan for the eurozone, the ECB would use a formula to determine the transfer it would give to the treasury of each national government in a recession, just as the US Congress has used a formula to determine the federal transfer it gives to the treasury of each state government in a recession and also for nonrecession programs.

Teoreticieni de film, scriitori sau profesionisti activi in lumea filmului au scris despre posibilitatea de a privi scenariul ca forma literara. George Garrett, poet si romancier, noteaza in introducerea unui volum de scenarii: „Aceasta remarcabila colectie de scenarii ar putea foarte bine sa reprezinte o veritabila manifestare a literaturii secolului 20”. Scriitorul Sam Thomas considera ca este important sa „recunoastem si sa admitem ca scenariul pentru film, in cele mai reusite forme ale sale, poate si ar trebui sa fie considerat literatura in aceeasi masura ca un roman sau o piesa de teatru de mare insemnatate”. Regizorul rus Andrey Tarkovsky afirma exact contrariul: „Nu privesc scenariul ca pe un gen literar. Intr‑adevar, cu cat un scenariu este mai cinematografic, cu atat mai putin poate pretinde un statut literar de sine statator, in maniera in care o piesa de teatru o poate face atat de des. Si noi stim ca in practica niciun scenariu nu a fost vreodata la nivelul literaturii”. Paul Schrader, scenarist la „Raging Bull” si „Taxi Driver”, celebrele filme regizate de Martin Scorsese, a insistat spunand ca „eu nu sunt un scriitor. Sunt scenarist, adica jumatate de regizor”. Iar regizorul suedez Ingmar Bergman admitea ca „Filmul nu are nicio legatura cu literatura”. In 1984, Gary Davis, teoretician de film, citat de Stevan Maras, scrie: „desi anumite sectii de critica si de literatura engleza incep sa studieze filmul dintr‑o perspectiva literara, nimeni nu prea stie ce sa faca cu scenariul”.

I discuss the philosophical significance of the generic confusions in Jack London’s novel The Sea-Wolf (1904). Drawing on a generous array of genres and scenarios, London asks his prospective reader to try and make sense of this complexity, either as “the superficial reader” of the sea romance or as “the deeper reader,” who is promised “the bigger thing lying underneath.” But what exactly is that bigger thing, the philosophical message, hidden by the generic complexity of the narrative, which will eventually necessitate a kind of deus-ex-machina authorial intervention when the sea romance is jeopardized by the demonic superman (and rapist) Wolf Larsen. By way of conclusion, I discuss the existential dilemma that London faced in The Sea-Wolf and in most of his work its philosophical formula articulated in Jules de Gaultier’s bovarysme and the war against reality, the Medusa-Truth.

While the cost of health care rises in all public healthcare organizations, budgets for that care have remained the same or have decreased. This is most certainly true in correctional settings. Because pharmaceutical expenditures are a substantial percentage of a health care organization’s budget, medication utilization is closely scrutinized. Clinicians must consider the appropriateness, effectiveness, and safety of medications prescribed to incarcerated patients. The abundance of available drugs and the complex issues with respect to their safe and effective use make a sound program for maximizing rational drug use critical. This is a challenging task in jails and prisons that requires a reexamination of the treatments provided. This is not a process of arbitrarily limiting prescriber choices or their decision-making authority solely based on cost-saving incentives. Evidence-based, best practices that inform the development of, and adherence to, disease management guidelines and a preferred, restricted medication formulary enhances the quality, safety, and effectiveness of the care provided. This chapter details the process and procedures to develop, implement, and monitor prescription practice change by establishing an effective Pharmacy & Therapeutics Committee (P & TC). The chapter further addresses: the roles and responsibilities of a P & TC; P & TC decision-making processes; formulary development and modification; formulary process decision-making; medication therapy management guidelines; prescriber education; and data analytics to assist in monitoring outcomes, medication use, and prescriber adherence to P & TC policies.

Die westliche Demokratie ist heute jeder kritischen Diskussion entzogen. Sie scheint das politische Ziel der Geschichte zu sein. Ihre Legitimität in Zweifel zu ziehen, ist mit einem Denkverbot belegt. Weshalb aber führen die westlichen Demokrarien Angriffskriege, sei es einst in Vietnam oder in Jugoslawien? Warum können sich die Wähler in diesen Demokratien meist nur zwischen zwei politischen Parteien, zwei Lagern, zwei Politik-Optionen entscheiden? Wieso werden unverhohlene Verächter der Humanität ebenso toleriert wie ihre Protagonisten? Herbert Marcuses Antwort ist ebenso einfach wie – zumindest heutzutage – unerhört: weil die westliche, bürgerliche Demokratie formal ist und nicht an materiale humanitäre Prinzipien gebunden. Diese Grundthese erlaubt es Marcuse, das Schicksal der bürgerlichen Demokratie zu thematisieren und nicht schon vor der Untersuchung zu deren Apologeten zu verkommen. Marcuses Haltung zur bürgerlichen Demokratie ist, bei aller Schärfe der Kritik, sehr differenziert. Da Regierungsformen, auch wenn sie zu bestimmten geschichtlichen Zeiten triumphieren, sich immerfort wandeln und endlich sind, gilt es, eine historisch bestimmte Einstellung zu gewinnen. er empfiehlt, die formale, bürgerliche Demokratie zu verteidigen, da sie die größte Freiheit zur Durchsetzung materialer Demokratie gewährt. Abstract:
La histoplasmosis es una enfermedad causada por el hongo Histoplasma capsulatum y es sumamente endémica en algunas zonas de América del Norte, América Central y América del Sur, y también se notifican casos en algunos países de Asia y África. La histoplasmosis con frecuencia afecta a las personas que presentan deterioro de la inmunidad como las personas con infección por el VIH, en quienes el cuadro clínico más frecuente es la histoplasmosis diseminada. Los síntomas de esta enfermedad son inespecíficos y pueden ser difíciles de distinguir frente a las manifestaciones de otras enfermedades infecciosas, en especial la tuberculosis diseminada, lo cual complica su diagnóstico y tratamiento. La histoplasmosis es una de las infecciones oportunistas más frecuentes causadas por patógenos fúngicos en personas con infección por el VIH en la Región de las Américas y es posible que sea responsable de 5% a 15% de las muertes relacionadas con el sida cada año en esta Región. La finalidad de las presentes directrices es formular recomendaciones para el diagnóstico, el tratamiento y el manejo de la histoplasmosis diseminada en las personas con infección por el VIH. Aunque la carga de la enfermedad se concentra en la Región de las Américas, estas recomendaciones son aplicables a escala mundial. Las directrices se elaboraron conforme al manual de la Organización Mundial de la Salud (OMS) para la elaboración de directrices. El Grupo de Elaboración de Directrices formuló las recomendaciones finales a partir de la revisión sistemática de la bibliografía científica y el análisis crítico de la evidencia disponible, usando el método GRADE para la clasificación de la valoración, la formulación y la evaluación de las recomendaciones. Estas directrices se dirigen a los prestadores de atención de salud, los directores de programas contra el VIH, los responsables de formular políticas, las juntas consultivas nacionales sobre tratamiento y otros profesionales que participan en la atención de las personas con histoplasmosis diseminada o que corren el riesgo de contraerla.
