Kuipers, Matthijs. A Metropolitan History of the Dutch Empire. NL Amsterdam: Amsterdam University Press, 2022. http://dx.doi.org/10.5117/9789463729918.

Full text
Abstract:
This book analyses popular imperial culture in the Netherlands around the turn of the twentieth century. Despite the prominent role that the Dutch empire played in many (sometimes unexpected) aspects of civil society, and its significance in mobilising citizens to participate in causes both directly and indirectly related to the overseas colonies, most people seem to have remained indifferent towards imperial affairs. How, then, barring a few jingoist outbursts during the Aceh and Boer Wars, could the empire be simultaneously present and absent in metropolitan life? Drawing upon the works of scholars from fields as diverse as postcolonial studies and Habsburg imperialism, A Metropolitan History of the Dutch Empire argues that indifference was not an anomaly in the face of an all-permeating imperial culture, but rather the logical consequence of an imperial ideology that treated ‘the metropole’ and ‘the colony’ as entirely separate entities. The various groups and individuals who advocated for imperial or anti-imperial causes – such as missionaries, former colonials, Indonesian students, and boy scouts – had little unmediated contact with one another, and maintained their own distinctive modes of expression. They were all, however, part of what this book terms a ‘fragmented empire’, connected by a Dutch imperial ideology that was common to all of them, and whose central tenet – namely, that the colonies had no bearing on the mother country – they never questioned. What we should not do, the author concludes, is assume that the metropolitan invisibility of colonial culture rendered it powerless.

Full text
Abstract:
This chapter is about civil law in Indonesia, which is archaic and unsuited to contemporary needs. It begins by discussing the problematic influence of Dutch colonial law in this area—in particular, the Civil Code and Commercial Code, both 19th century Dutch-language texts—before explaining the operation of Article 1365 of the Civil Code, the main source of civil liability (tort) in Indonesia. After covering vicarious liability and agency, the chapter provides a summary of contract law, including the elements of a valid contact, performance, termination, and material and immaterial damages. It also deals with formal requirements, including notarisation and rules that require some contracts to be in Indonesian. It concludes with an account of consumer, e-commerce and construction contracts, to which particular rules apply.

Butt, Simon, and Tim Lindsey. The Constitutional Court. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780199677740.003.0005.

Full text
Abstract:
Indonesia’s Constitutional Court, established in 2003, is often called a model of judicial reform for other courts in Indonesia and throughout parts of Asia. It reviews statutes against the Constitution, hears disputes about elections and between state organs, and decides presidential impeachment motions brought by the national legislature. This chapter shows that this court started strongly, performing its functions professionally and commanding respect from the government and citizens, despite having no enforcement powers. It even managed to push the formal boundaries of its jurisdiction and, in our view, began to ‘make law’, thereby usurping a legislative function. However, recent corruption scandals and poorly reasoned decisions have undermined its credibility and threaten its future viability.

Full text
Abstract:
This chapter focuses on the performing arts of four main musico-lingual groups in Bangka, South Sumatra: the Malays, the Suku Lom forest-dwellers, the Suku Sekak sea-boat-dwellers, and the Chinese Indonesians. According to some performing artists and community elders, today's Malay people are descendants of former Bangka Malay chiefdoms, while the Suku Mapur or Suku Lom people are animists who prefer to live in relative isolation in the forests. The Suku Sekak people are also animists who prefer to live in boats at sea when the weather permits. The Bangka Malays, the Suku Lom, and the Suku Sekak speak varieties of Malay, while the Chinese Indonesians normally speak varieties of Hakka or Hokkien in addition to Malay. To understand how Bangka's four musico-lingual subgroups came into being as well as their musical arts, the chapter examines the history of foreign exploitation of their tin and cash crops by the sultans of Palembang (seventeenth–eighteenth centuries), Britain (1812–1816), Holland (ca. 1817–World War II), and Indonesia (1949 to present).

Remmelink, Willem, ed. The Invasion of the South: Army Air Force Operations, and the Invasion of Northern and Central Sumatra. Translated by Willem Remmelink. Leiden University Press, 2021. http://dx.doi.org/10.24415/9789087283667.

Full text
Abstract:
Between 1966 and 1980, the War History Office of the National Defense College of Japan (now the Center for Military History of the National Institute for Defense Studies) published the 102-volume Senshi Sōsho (War History Series). The present book completes the trilogy of English translations of the sections in the Senshi Sōsho series on the Japanese operations against the former Dutch East Indies (Indonesia). The first volume (The Invasion of the Dutch East Indies, 2015) details the army operations, the second volume (The Operations of the Navy in the Dutch East Indies and the Bay of Bengal, 2018) the navy operations, and this third volume the army air force operations. The three volumes provide an unparalleled insight into the Japanese campaign to capture Southeast Asia and the oil fields in the Indonesian archipelago in what was at that time the largest transoceanic landing operation in the military history of the world. It was also the first time in history that air power was employed with devastating effect over such enormous distances, posing complex technical and logistical problems.

Li, Tania Murray, and Pujo Semedi. Plantation Life. Duke University Press, 2021. http://dx.doi.org/10.1215/9781478022237.

Full text
Abstract:
In Plantation Life Tania Murray Li and Pujo Semedi examine the structure and governance of Indonesia's contemporary oil palm plantations in Indonesia, which supply 50 percent of the world's palm oil. They attend to the exploitative nature of plantation life, wherein villagers' well-being is sacrificed in the name of economic development. While plantations are often plagued by ruined ecologies, injury among workers, and a devastating loss of livelihoods for former landholders, small-scale independent farmers produce palm oil more efficiently and with far less damage to life and land. Li and Semedi theorize “corporate occupation” to underscore how massive forms of capitalist production and control over the palm oil industry replicate colonial-style relations that undermine citizenship. In so doing, they question the assumption that corporations are necessary for rural development, contending that the dominance of plantations stems from a political system that privileges corporations.
