Abstract:
Marriage law in England and Wales is a historical relic which reflects a bygone age. Successive governments have made a series of progressive but ad hoc reforms, most notably the introduction of civil partnerships and same-sex marriage. However, this has resulted in a legal framework which is complex and controversial, especially in relation to religion. Different rules apply to different religions and some of the legal requirements indirectly discriminate against some religions that do not have a tradition of marriages occurring in a place of worship. This leads to the problem of unregistered religious marriages where the couple have a religious marriage but do not comply with the requirements to make it legally binding and so on relationship breakdown they do not have the rights that legally married couples enjoy. Moreover, unlike many jurisdictions English law does not recognise weddings conducted by humanist or independent celebrants as being legally binding. This book provides the first accessible guide to how contemporary marriage law affects religion and identifies pressure points particularly in relation to non-religious organisations and unregistered religious marriages. It reveals the need for the consolidation, modernisation and reform of marriage law and sets out proposals for how the transformation of these laws can be achieved.

Abstract:
This chapter discusses sex and the beginning of sexual activity. It develops a theory of virtue and virtue ethics which focuses more on the character of the sexual agent than on the acts the agent does. A virtuous character learned in a community of origin, it is argued, will impel a person to acts of sexual virtue and avoidance of acts of sexual vice. Three virtues are advanced as primary for virtuous sexual activity: love, justice, and chastity. Also considered is the relationship between the phenomenon of cohabitation and marriage, and nuptial cohabitation, that which is premised on the commitment to marry, is presented as a first step on a journey that will eventually end in the cohabiting couple’s marriage. The chapter concludes by proposing for cohabiting couples a period of ritual betrothal sanctioned and guaranteed by the community in which they are expected to learn virtue.

Abstract:
This chapter examines the extent of gay rights activists' success in framing the gay marriage debate and in producing their preferred images for the news media. It first describes the linguistic and visual devices that news entities relied upon to represent gay and lesbian couples as “deserving” of marriage. It then explores how markers of gender, class, race, lifestyle, and sexuality were deployed to construct the human face of gay marriage and goes on to discuss the ways in which gay marriage ceremonies were ritualized and symbolized in news narratives. It also shows how “poster couples” selected by news producers and gay rights activists were legitimated in news narratives, but were also cast as “different” from the more “radical” community of non-married gays, relegating particular LGBT and queer identities to the margins. The chapter concludes by considering how news stories and images work together to produce new forms of gay desire.

Abstract:
This book contains an analysis of the experience of married life by men and women in Christian medieval Europe c. 900–1300. The focus will be on the social and emotional life of the married couple rather than on the institutional history of marriage. The book consists of three parts: the first part (Getting Married) is devoted to the process of getting married and wedding celebrations, the second part (Married Life) discusses the married life of lay couples and clergy, their sexuality, and any remarriage, while the third part (Alternative Living) explores concubinage and polygyny as well as the single life in contrast to monogamous sexual unions. Four main themes are central to the book. First, the tension between patriarchal family strategies and the individual family member’s freedom of choice to marry and, if so, to what partner; second, the role played by the married priesthood in their quest to have individual agency and self-determination accepted in their own lives in the face of the growing imposition of clerical celibacy; third, the role played by women in helping society accept some degree of gender equality and self-determination to marry and in shaping the norms for married life incorporating these principles; fourth, the role played by emotion in the establishment of marriage and in married life at a time when sexual and spiritual love feature prominently in medieval literature.

Abstract:
The churches of the Anglican Communion discussed issues of sex and gender throughout the twentieth century and into the twenty-first century. Arguments about gender focused on the ordination of women to the diaconate, priesthood, and episcopate. Debates about sexuality covered polygamy, divorce and remarriage, and homosexuality. In the first decade of the twenty-first century, these debates became intensely focused on homosexuality and were particularly fierce as liberals and conservatives responded to openly gay bishops and the blessing and marriage of same-sex couples. By the second decade of the twenty-first century, the sex and gender debates had become less acrimonious, the Anglican Communion had not split on these issues as some feared, but the ‘disconnect’ between society and the Church, at least in the West, on issues such as the Church of England’s prevarication on female bishops and opposition to gay marriage, had decreased the Church’s credibility for many.

Abstract:
This chapter examines the figure of the householder (gṛhastha), the lynchpin of the dharma system, occupying the second stage of the codified āśrama system. It first considers the word gṛhastha and notes that it has made its way into the dharma literature from Middle Indo-Aryan and heterodox religious circles. This terminological discontinuity suggests that there is also conceptual discontinuity between the Vedic married head of household and the householder depicted in the dharma texts. Since the householder must be married, the chapter then treats the institution of marriage: who and when to marry and the types of marriage as found in the dharma texts, as well as the marriage ceremony itself. It then turns to the legal and ritual obligations of the married couple, including the dissolution of the marriage by death or other means.

Abstract:
Christian missionaries and clerics played an important, if difficult, role in the political campaign to promote monogamy and fertility in the Caribbean. Sex was big business in the Caribbean, where a hotel/prostitution industry catered to military men and island residents alike. Moreover, interracial liaisons provided opportunities for social advancement to women of African descent. Although Methodist missionaries at first tolerated polygamy among their enslaved converts, as the demographic problems in the region became politically urgent they sought increasingly to promote Christian marriage and discourage fertility control. Free women of color who resented the constraints of concubinage found Methodism particularly appealing. Evolving management strategies on the Anglican-owned Codrington plantation illustrate the pressure that Afro-Caribbean mothers faced to abandon matrifocal patterns of residence. Incentives such as land and provisions that had once been given to mothers gave way, by the 1830s, to rewards directed toward either couples or fathers.

Full text
Abstract:
This chapter shows that the Grotton–St. Ange family was the most important political and military family in Upper Louisiana for the half century between 1720 and 1770. Louis St. Ange de Bellerive first came to prominence under the sponsorship of his father, Robert Grotton St. Ange. Shortly after Robert Grotton St. Ange's marriage to his second wife, Élisabeth Chorel, in 1718, the couple and Robert's two sons by his first wife, Pierre and Louis, headed west to establish the St. Anges as a leading family in the Illinois Country. This chapter traces the history of the Grotton–St. Ange family in the Illinois Country and looks at the expeditions of Étienne Veniard de Bourgmont, the first white man to ascend the Missouri River valley in 1714 and the one who built Fort d'Orléans. It also considers the presence of the St. Ange family at Fort d'Orléans, where Louis St. Ange de Bellerive replaced Robert Grotton St. Ange as commandant.

Goldberg, Abbie E., and Adam P. Romero, eds. LGBTQ Divorce and Relationship Dissolution. Oxford University Press, 2018. http://dx.doi.org/10.1093/med-psych/9780190635176.001.0001.

Full text
Abstract:
This is the first comprehensive and interdisciplinary volume on divorce and relationship dissolution among LGBTQ people. With the goal of informing policy, practice, and future research, the volume gathers and expands current knowledge on: LGBTQ people’s relationship and dissolution patterns, the divorce and child custody rules and processes that now apply to many LGBTQ families, and the surrounding political and cultural environment in the United States. Among the fascinating lines of inquiry explored are: What factors contribute to relationship stability and well-being among LGBTQ people, and what factors lead to instability and strife? How do stigma and prejudice impact LGBTQ relationships in terms of risk of, or resilience against, dissolution? How does access to the legal institution of marriage and parenthood impact same-sex couples’ stability? What unique issues do LGBTQ people who are separating or divorcing face in the context of navigating custody of their children? What are the unique dissolution issues for transgender people, LGBTQ people leaving previous heterosexual relationships, and those whose relationships end due to the death of a partner? How do gender, race/ethnicity, immigration status, economic status, and other characteristics intersect with such issues? How can therapists and lawyers sensitively and effectively assist LGBTQ people who are experiencing relationship dissolution and its aftermath? This book attends to the empirical, demographic, personal, and legal experiences of LGBTQ individuals experiencing divorce and dissolution, and is an exciting resource for scholars, students, and practitioners in a wide range of fields, including law, psychology, social work, sociology, and political science.

James, Carolyn. A Renaissance Marriage. Oxford University Press, 2020. http://dx.doi.org/10.1093/oso/9780199681211.001.0001.

Full text
Abstract:
Drawing extensively on unpublished archival sources, this book analyses the marriage of Isabella d’Este, one of the most famous figures of the Italian Renaissance, and her less well-known husband, Francesco Gonzaga, ruler of the small northern Italian principality of Mantua (r. 1484–1519). It offers fresh insights into the nature of political marriages during the early modern period by investigating the forces which shaped the lives of an aristocratic couple who, within several years of their wedding, had to deal with the political challenges posed by the first conflicts of the Italian Wars (1494–1559) and, later, the scourge of the Great Pox. The study humanizes a relationship that was organized for entirely strategic reasons, but had to be inhabited emotionally if it was to produce the political and dynastic advantages that had inspired the match. The letter exchanges of Isabella and Francesco over twenty-nine years, as well as their correspondence with relatives and courtiers, show how their personal rapport evolved and how they cooperated in the governance of a princely state. Hitherto examined mainly from literary and religious perspectives and on the basis of legal evidence and prescriptive literature, early modern marriage emerges here in vivid detail, offering the reader access to aspects of the lived experience of an elite Renaissance spousal relationship. The book also contributes to our understanding of the history of emotions, of politics and military conflict, of childbirth, childhood, and family life, and of the history of disease and medicine.
