Abstract:
This chapter provides an overview of the legal framework of set-off in the Czech Republic both outside and within the context of insolvency. In the Czech Republic, set-off rights are regulated exclusively by statutory law. General regulations on set-off arrangements are laid down in Sections 1982–1991 of the Czech Civil Code. Other laws relevant to set-off are the Business Corporations Act, the Capital Markets Act, the Financial Collateral Act, and the Act on Insolvency. The chapter first examines set-off between solvent parties, taking into account general regulations, specific regulations under the Business Corporations Act, contractual set-off involving multiple parties, and special regulatory regimes governing set-off in the Czech Republic. It then considers set-off between insolvent parties before concluding with an analysis of set-off issues arising in the cross-border context.

Abstract:
This chapter examines Rome’s changing financial structure between the second and first centuries BC, arguing that early Roman financial intermediaries provided a mechanism for the creation of money beyond the available supply of precious metals, serving to expand Rome’s total money supply. Rome’s argentarii functioned like modern deposit bankers in a number of ways, and the money-multiplier effect of deposit banking would have enabled significant commercial expansion. But, by the mid-first century BC and as a result of Mithradates VI’s invasion of the province of Asia, and the ensuing credit crisis at Rome in 88 BC, things had changed. There were probably fewer banks in existence, with smaller balance sheets, and the main providers of credit had become ‘aristocratic financiers’ providing credit to fellow members of the elite, rather than argentarii. This development could have had a negative impact on the wider Roman economy, or, at least, could have prevented it from reaching its full potential.

Abstract:
This book offers a close study of the rapidly evolving politics of LGBT rights in postcommunist Europe, where social attitudes have historically marginalized the issue and where the legacy of weak civil society has handicapped activism in general. What happens in societies such as these when increased exposure to transnational institutions such as the European Union and the minority-rights norms that they promote brings new visibility to LGBT issues? Is activism boosted by the infusion of resources from transnational networks? Or does transnational pressure bring backlash, inflaming antigay attitudes and driving activism underground? This study uncovers and explains the surprising divergence in the organization of LGBT activism in postcommunist Europe, focusing on Poland and the Czech Republic from the late 1980s through 2012. Hungary, Slovakia, and Romania form additional case studies. It argues that domestic backlash against transnational rights norms has been a primary catalyst for organizational development in the region’s most robust LGBT movements. It offers a comparative framework of broader relevance describing the conditions under which transnational pressure and domestic politics may interact to build robust activism, or not. This theorization offers resolution for a striking puzzle of LGBT politics in the countries examined: Why is the most organized and influential activism often found in societies where attitudes toward homosexuality are least tolerant? The book uses a multimethod research design drawing on field interviews, original sources, and participant observation to process trace how the framing of homosexuality and the organization of LGBT activism change in historical time.

Abstract:
Historically, the role of professionals specialized in occupational health and safety (OHS) has emerged from the need to protect employers working in major risk industries such as nuclear plants and large-scale chemical industries in Europe. More recently, a few studies highlighted that the range of activities linked to safety management responsibilities includes monitor and prepare reports, inspection and auditing, regulatory compliance, emergency response, incident investigation, hazard and risk assessment, and training. Additionally, there are some supplementary non-safety related duties, such as including environmental responsibility. Considering that work-related musculoskeletal disorders (WRMD) are a major burden worldwide, adding up to 1.3 billion cases, more than 100 million years loss of disability-adjusted life years and that such disorders are common causes of disability and sick leave, this topic is highly relevant to OHS professionals. In EU Member States for which data are available, a large majority of all workers report complaints related to musculoskeletal disorders as their most serious work-related health problems. The percentage of workers reporting such complaints as their most serious health problem ranges from 40 % in Luxembourg to 70 % in Czech Republic and Finland. Furthermore, more than half of workers with musculoskeletal disorders reported taking time off work in a 12-month period. In the EU, 26 % of workers with musculoskeletal long-lasting disorders, that is lasting over 3 months, combined with other health problems report more than 8 days of absence per year. Higher Education Institutions (HEI) have a key role in disseminating and increasing accessibility to the most up-to-date evidence available regarding the impact and management of musculoskeletal disorders, to facilitate translation of knowledge to implementation in practice. This way, the Knowledge Alliance Prevent4Work for Preventing Work-Related Musculoskeletal Disorders has elaborated this document with the most recent and relevant knowledge within the topic. HEI that offer courses within OHS as well as graduation and post-graduation courses for health professionals that work within the area, may benefit from the recommendations presented here.
