Abstract:
This chapter comments on Article 117 of the Rome Statute of the International Criminal Court. Article 115(a) of the Rome Statute declares that one of the two sources of the funds of the Court shall be assessed contributions made by States Parties. Article 117 recognizes the principle of differential assessment, using the United Nations scale of assessments as the model, but it does not impose a precise formula. The task of specifying the assessed contributions falls, by implication, to the Assembly of States Parties. Each year, the Assembly of States Parties adopts a resolution on the assessment. The most recent ‘[d]ecides that for 2015, the contributions of States Parties shall be assessed in accordance with an agreed scale of assessment, based on the scale adopted by the United Nations for its regular budget applied for 2013–2015, and adjusted in accordance with the principles on which the scale is based’.

Abstract:
This chapter comments on Article 114 of the Rome Statute of the International Criminal Court. Article 114 states that the expenses of the Court and the Assembly of States Parties, including its Bureau and subsidiary bodies, shall be paid from the funds of the Court. Article 114 has been described as an attempt to avoid a practice resulting from the United Nations Convention on the Law of the Sea whereby the Secretary-General pays for meetings of States Parties and other bodies out of the general budget. Thus, should the Secretary-General host meetings, any expenses incurred, for example for Secretariat services, must be paid by the Court, not the United Nations.

Abstract:
This chapter comments on Article 116 of the Rome Statute of the International Criminal Court. Article 116 allows the Court to receive and utilize, as additional funds, voluntary contributions from Governments, international organizations, individuals, corporations and other entities, in accordance with relevant criteria adopted by the Assembly of States Parties. This criteria is set out in the Financial Regulations and Rules, which specify that voluntary contributions must be ‘consistent with the nature and functions of the Court’. Amounts received by the Court in the form of voluntary contributions have been modest. For the year 2014, they totalled less than €600,000, almost all of this earmarked for special projects such as building legal expertise, cooperation, relocation, and seminars.

Abstract:
This chapter comments on Article 113 of the Rome Statute of the International Criminal Court. Article 113 establishes the legal significance and role of the Financial Regulations and Rules. Consist of thirteen articles, plus an Annex, the Regulations provide that the Assembly of States Parties is to ‘establish detailed financial rules and procedures in order to ensure effective financial administration and the exercise of economy’. The Rules describe themselves as being ‘in complement to, and limited by the Financial Regulations. They shall govern all the financial administration of the Court, except as may otherwise explicitly be provided by the Assembly of States Parties, or specifically exempted therefrom by the Registrar’.

Abstract:
This chapter comments on Article 118 of the Rome Statute of the International Criminal Court. Article 118 provides for appointment of an independent auditor to audit the records, books, and accounts of the Court, including its annual financial statements. The article, however, does not identify the body responsible for this task. Specific provision for the audit appears in the Financial Regulations and Rules, adopted at the first session of the Assembly of States Parties. They declare that the Assembly appoints the Auditor, which may be ‘an internationally recognized firm of auditors or an Auditor General or an official of a State Party with an equivalent title’. The Auditor is appointed for a renewable term of four years. The Court also has an Office of Internal Audit.

This chapter comments on Article 115 of the Rome Statute of the International Criminal Court. Article 115, in a sense, completes article 114, confirming that the funds of the Court are derived from the States Parties. Specifically, it states that the expenses of the Court and the Assembly of States Parties, including its Bureau and subsidiary bodies, as provided for in the budget decided by the Assembly of States Parties, shall be provided the following sources: assessed contributions made by States Parties; and funds provided by the United Nations, subject to the approval of the General Assembly, in particular in relation to the expenses incurred due to referrals by the Security Council.
