Les indemnités de fin de contrat, qu’elles résultent de la loi ou de la volonté contractuelle, sont nombreuses et variées et malgré leur importance pratique aucune étude d’ensemble ne leur avait été consacrée en droit privé. Cette thèse se propose de les étudier conjointement pour en dresser une typologie et en déterminer le régime juridique. La première partie traite de la variété des indemnités, qu’elles soient légales (VRP, agents commerciaux, gérants-mandataires, bail commercial ou rural) ou conventionnelles (indemnité d’anéantissement unilatéral ou de dédit). Il est démontré que l’indemnité de fin de contrat représente le prix d’une liberté contractuelle retrouvée permettant la sauvegarde de l’équilibre économique du contrat. Les contreparties sont en revanche différentes. Elles constituent un encadrement du droit d’anéantir le contrat unilatéralement ou offrent le droit de se dédire, c’est-à-dire de ne pas exécuter le contrat en tout ou partie. La seconde partie est consacrée au régime juridique des indemnités. Il en résulte une liberté contractuelle orientée in melius au profit du créancier de l’indemnité légale. Ainsi que le constat d’un contrôle judiciaire insuffisant s’agissant des indemnités conventionnelles. Ce faisant, il est proposé des modifications législatives tant concernant les indemnités légales par l’octroi d’une indemnité de fin de contrat au profit des distributeurs-revendeurs, que s’agissant des indemnités conventionnelles par la consécration explicite de la validité du dédit conventionnel ainsi que l’élaboration d’un contrôle judiciaire du montant des indemnités conventionnelles excessives sur le modèle de la clause pénale<br>Termination benefits, whether as a result of the law or the contractual will, are numerous and varied and despite their practical importance no comprehensive study had been dedicated to this topic in private law. This thesis proposes to study them jointly to establish a typology and to determine the legal regime. The first part deals with the variety of allowances, whether they are legal or conventional. It is shown that the termination benefit represents the price of a restored contractual freedom with a view to securing a fair balance of interests. The counterparties are, on the other hand, different. They provide a legal framework for the right to annihilate the contract unilaterally or offer the right to withdraw, that is to say, not to execute the contract in whole or in part. The second part is devoted to the legal system of allowances. The result is a contractual freedom directed in melius to the benefit of the creditor of the legal indemnity. As well as the finding of insufficient judicial review in respect of conventional allowances. In this regard, legislative amendments are proposed, both with regard to statutory allowances by granting a termination payment to reseller distributors, as well as conventional allowances by the legal consecration of the validity of conventional withdrawal as well as the development of a judicial review of the amount of excessive conventional allowances, built on the model of the penalty clause

Cette etude est consacree a l'analyse de la theorie de l'abus de droit comme moyen de cantonner le droit de resiliation unilaterale. Elle s'articule autour de deux axes. Est tout d'abord demontree la place prepoderante et toujours croissante qu'occupe en droit positif le concept d'abus de droit, puis, a travers l'etude des criteres de ce dernier, est mis en exergue l'evolution de la notion de contrat. Il en ressort que les tribunaux cherchent aujourd'hui a moraliser le droit subjectif en prenant en compte le comportement adopte par l'auteur de la rupture. Si ce comportement a pu faire naitre une quelconque confiance chez son partenaire, et que celle-ci ait ete ensuite bafouee, les juges, dans l'exercice de leur pouvoir moderateur, n'hesitent plus a sanctionner, par reference a la notion d'abus de droit, l'auteur de la rupture en engageant sa responsabilite. Il faut en conclure que si la notion d'abus de droit empeche la technique juridique de se retourner contre les fins qu'elle pretend servir, c'est parce qu'elle prend en compte a present la notion de confiance legitime<br>This study is devoted to analysing the theory of the "abus de droit" as a mean to confine, within certain limits, the right to unilateral termination. It is centred on two axes. Firstly, it demonstrates the prepoderant and still growing place of the concept of "abus de droit", and, throughout the study of its criteria, it emphasizes the evolution of the notion of contract. It results from this study that law courts seek today to moralize not only the implementation but also the containt of subjective right, taking into consideration the behaviour of the originator of the termination. If this behaviour induced his partner to trust him, and if he afterwards flouted this confidence, the judges, in the exercice of their moderating power, do not hesitate any longer to sanction, by reference to the notion of "abus de droit", the originator of the termination, by pledging his responsibility. This study concludes that if the notion of "abus de droit" prevents the juridical technic to turn against the aims that it claims to serve, it is because it presently takes into accout the notion of legitimate reliance

La fin du contrat de franchise a diverses causes. Les causes d'extinction peuvent être ordinaires : l'arrivée du terme, la résiliation unilatérale lorsque le contrat est conclu sans terme ou encore la résiliation bilatérale. L'extinction du contrat peut encore résulter de circonstances extraordinaires. Sont des causes d'extinction extraordinaires la résiliation du contrat pour inexécution, la survenance d’un cas de force majeure, l'exécution de la clause de hardship ou encore l'atteinte portée à l'intuitus personae. La fin du contrat de franchise entraîne la liquidation du lien contractuel et donne parfois lieu à un éventuel engagement de la responsabilité de la partie auteur d'une rupture fautive. En outre, elle peut déclencher la prise d'effet d'obligations post-contractuelles : obligation de non-concurrence, obligation de non-réaffiliation, obligation de confidentialité, obligation de reprise des stocks et, enfin, obligation de payer une indemnité dite de clientèle<br>The termination's causes of a Franchise Agreement are generally classified into ordinary causes and extraordinary causes. Ordinary causes include the end of the contractual term without renewal, rescission by either party and bilateral termination. Regarding extraordinary causes, they include the unilateral termination of the agreement due to any event of Force Majeure or hardship or affecting the intuitus personae. Les clauses de fin de contrat illustrent l’importance de la liberté contractuelle. La pratique s’est emparée de cette période de l’« après-Contrat » sous le contrôle de la jurisprudence, dans le relatif désintérêt du législateur.Les fins du contrat sont diverses. La fin peut être retardée par le biais de la prorogation du contrat. La fin peut être prématurée : elle peut être une fin brutale et définitive par le biais de la clause résolutoire, la continuité de ce qui était par l’arrivée du terme extinctif, ou encore la venue de quelque chose de nouveau par le biais d’une clause de caducité. La fin peut n’être qu’un passage vers un autre contrat par le biais de la reconduction. Il en ressort un flou théorique nécessitant une construction juridique. Il peut être proposé de scinder le temps de l’après-Contrat en trois temps. Le premier temps, les parties satisfaites de leur relation vont chercher à la faire perdurer. Les clauses de fin de contrat ont alors pour finalité la préservation de la pérennité du lien contractuel entre les parties. La deuxième période porte sur les modes d’extinction du contrat. La sortie de la relation contractuelle est devenue un enjeu important nécessitant le recours à différents mécanismes juridiques tels que la clause de dédit, la condition résolutoire ou encore la clause résolutoire.La troisième période peut être désignée comme la période de liquidation du passé contractuel comprenant deux séries de clauses : celles liquidant le passé contractuel (notamment la clause de non-Concurrence et la clause de confidentialité) et celle s’intéressant à l’avenir post-Contractuel. La fin du contrat doit être distinguée de la clôture de la relation contractuelle désignant la cessation de toutes les obligations post-Contractuelles et de leurs conséquences. Le droit de mettre fin à une relation contractuelle comprend deux aspects : le droit de résilier un contrat à durée indéterminée et le droit de refuser de renouveler un contrat à durée déterminée. Son existence est incontestable à l’égard de l’ensemble des contrats de distribution, y compris ceux qui revêtent la qualification de mandat. Néanmoins, son exercice est encadré par la théorie de l’abus lorsque le titulaire de ce droit subjectif manque à un devoir moral du maintien temporaire de la relation contractuelle. Dans cette hypothèse, laresponsabilité civile du titulaire du droit est engagée sur le fondement de la notion de faute.Toutefois, ce même titulaire peut être contraint de payer une indemnité même en absence de toute faute commise de sa part : telle est l’hypothèse de l’indemnité de fin de contrat prévue au bénéfice d’une partie des distributeurs. Cependant, il ne faut pas interpréter cette indemnité comme une remise en cause de ce droit subjectif. En effet, cette indemnité trouve sa justification dans les éléments étrangers à ce droit. Comme d’autres pays de l'Europe de l'Ouest, les Pays Bas ont été témoins d'une hausse de l'âge moyen de sa population active. Depuis quelques années, ces changements ont incité le gouvernement Néerlandais à revoir l'imposition sur les plans de préretraite dans le privé et à repousser l'âge légal de départ à la retraite. En même temps, les entreprises demandent aux employés d'être de plus en plus employables pour pouvoir compenser la perte de sécurité de l'emploi à vie. Bien qu’il y ait beaucoup de stéréotypes sur les motivation et capacité des travailleurs seniors, ces employés vont devoir travailler plus longtemps et sont plus susceptibles de changer d'emploi et à continuer à se développer.Le but de cette étude était d'examiner comment les contenus des relations employeur/employé, conceptualisés à travers le contrat psychologique, influencent certaines intentions de carrières liées à l'employabilité, pour un échantillon d'employés âgés entre 45 ans et 55 ans et actifs sur le marché du travail néerlandais. Un deuxième but était d'étudier comment les stéréotypes influencent cette relation.Notre model de recherche a été conceptualisé par une étude quantitative dans laquelle environ 1100 employés ont participé. Nous avons trouvé que les incitations déficit/excès et le niveau d'accomplissement de dimensions de contrats psychologiques spécifiques avaient différentes relations avec les intentions de carrières des participants et que le fait de s’identifier comme étant un travailleur âgé avait un effet modérateur sur quelques unes de ces relations<br>Like other Western European countries, the Netherlands has witnessed an increase in the average age of its working population. Since a few years these changes have incited the Dutch government to review the taxation of private early retirement schemes and to push back the legal retirement age. At the same time companies are asking employees to be ever more employable, so that they can compensate for the loss of lifelong employment security. Although there are many stereotypes about the motivation and capabilities of older workers, these employees will now have to work longer and are more likely to change jobs and to continue developing themselves.The goal of this study was to examine how the contents of the employer-employee relationship, conceptualized through the psychological contract, influence two employability-related career intentions for a sample of employees aged 45-55 and active on the Dutch labor market. A second goal was to study how stereotypes influence this relationship.Our research model was realized through a quantitative study in which almost 1100 employees participated. We found that deficient/excess inducements and the level of fulfilment of specific psychological contract dimensions had different relationships with the career intentions of participants and that the seeing oneself as an older worker had a moderating effect on some of these relationships

La part qu'occupent les contrats dans l'activité juridique de l'administration augmente considérablement. Il s'agit de démontrer que le contentieux de la fin du contrat, liée à sa formation est un droit à la recherche d'un nouvel équilibre contractuel, essayant de concilier des intérêts souvent antagonistes. Les contestations qui peuvent s'élever à propos de cette situation contractuelle sont susceptibles de donner lieu à des procédures multiples, ce qui peut expliquer la diversité du contentieux de la fin du contrat et aussi sa complexité. Parallèlement au contentieux du droit commun des conventions, se développe un contentieux devant le juge de l'excès de pouvoir qui permet aux tiers de cerner le contrat. Le contentieux de la passation des contrats pose un délicat problème d'équilibre. Le juge s'y trouve partagé entre le souci de préserver la stabilité du rapport contractuel et la nécessité d'assurer le respect de la légalité. Une évolution du contentieux de la fin des contrats vers plus de pragmatisme quant aux nécessités pratiques de l'action administrative peut dès lors être envisagée. Il paraît indispensable de reconstruire le droit qui régit ce contentieux. Il s'agit de garantir la stabilité des relations contractuelles en cherchant un nouvel équilibre satisfaisant ces deux principes largement antinomiques que sont le principe de légalité et le principe de sécurité juridique<br>Contracts have significantly increased their share in the legal activity of the French Civil Service (Administration). The thesis aims at demonstrating that the litigation of the contract termination, concerning the settig up of the contractual agreement, is a branch of law searching for fairer contractual relationship, trying to reconcile often antagonistic interests. Legal disputes that may arise from this contractual situation are likely to give rise to multiple procedures, which may explain the diversity in the litigation of the contract termination and also its complexity. Litigation before the administrative judge (le juge de l'exces de pouvoir) has developed in parallel to the litigation of the civil contract law, allowing third parties to delimit/define the contract. Litigation concerning the signing of the contract is posing a delicate problem of balance. The judge is facing the dilemma of preserving the stability of the contractual relationship and the necessity of ensuring law enforcement. An evolution of the litigation concerning null and void contracts may be contemplated in a move toward more pragmatism encompassing the practical necessities of the administrative action. It seems absolutely necessary to re-build the legal framework governing this litigation. Ensuring the stability of contractual relationships whilst searching for a new balance matching these by far opposite principles, respectively being the law enforcement and the legal security, is at stake

Suggérée à l'analyse de la jurisprudence rendue sur le thème de la flexibilité du contrat, la théorie générale de l'objectif économique du contrat a pour point de départ l'identification d'un premier objectif : l'exploitation commune de clientèle. Parce que le caractère commun de l'exploitation traduit l'existence d'objectifs identiques aux parties, cet objectif de nature économique s'inscrit, en effet, comme celui du contrat, support juridique de sa réalisation. Présent au sein de conventions diverses, il n'est, du reste, pas isolé. La mise en évidence d'autres types d'objectifs économiques construits sur ce même modèle permet ainsi une conceptualisation de la notion. La réalité de l'objectif économique du contrat laisse alors présager de sa possible réception par le Droit. Sa reconnaissance demeure toutefois subordonnée à sa disponibilité, d'une part et à son utilité, d'autre part. Distinct sans pour autant être autonome des conditions de validité que sont la cause et l'objet, l'objectif économique ne saurait davantage s'identifier à l'économie de la convention. Apte à siéger aux côtés de ces notions, l'objectif offre, en outre, de nouvelles perspectives. Indissociable de la notion d'intérêt commun économique, il en constitue le révélateur, justifiant ainsi que tous les contrats marqués par sa présence soient reconnus comme étant d'intérêt commun. Fondement d'une ouverture du domaine de l'intérêt commun, l'objectif permet encore d'étendre le bénéfice du droit à une indemnité compensatrice et de reconnaître l'existence implicite des obligations d'adaptation et de renégociation hors la sphère du mandat d'intérêt commun. La notion aurait donc sa place en Droit positif<br>The analysis of the case law relating to the flexibility in contract suggests the general theory of the economic goal of the contract. This theory comes from the identification of a first objective: the common exploitation of a clientele. Since the common nature of exploitation conveys the existence of identical objectives for the parties, this economic goal becomes the objective of the contract, legal mean of its fulfillment. This goal can be found in many agreements and is not isolated. The presentation of other types of economic goals built on the same pattern allows a conceptualization of the notion. The existence of the economic goal of the contract suggests its possible receipt by the Law. However its recognition is conditioned both by its transferability and utility. The economic goal must be distinguished from the validity conditions such as consideration and subject matter, although it is not independent from these conditions. This goal is also different from the economy of the convention. Besides these notions, the economic goal offers new perspectives. Profoundly linked to the notion of common economic interest, it appears as its revealing and justifies that each contract should be qualified as a common interest contract. The economic goal is the ground for the opening of the scope of common interest and enables to extend the benefit of a right to a pecuniary relief and to acknowledge the implicit existence of obligations to adapt and renegotiate, apart from the common interest mandate. This notion should thus find its place in positive law

Participant d'une nature mixte, contractuelle par sa source, juridictionnelle par son objet, la transaction permet ainsi aux parties de terminer une contestation née ou prévenir une contestation à naître. Elle présente une utilité remarquable pour la matière administrative. La transaction, notion de droit civil empruntée par le juge administratif, a donné lieu à des interprétations prétoriennes diverses. Le droit n'étant pas figé, le juge administratif, sous couvert d'une philosophie propre, a oeuvré pour la préservation de ses intérêts en se détachant progressivement des principes civils du contrat de transaction. L'expression de « transaction administrative » vise le fait que la transaction est conclue par ou au nom d'une personne publique. Celle-ci peut cependant être un contrat de droit privé ou un contrat administratif. Certes, l'expression « matière administrative » peut être entendue au sens large et au sens strict. Le contentieux de la transaction est en plein essor. Depuis longtemps déjà le droit public emprunte les règles civiles du contrat de transaction relevant de régimes juridiques différents. Des difficultés sérieuses subsistent cependant. Aussi, il convenait de démontrer pourquoi et comment le juge administratif a entrepris une clarification de l'état du droit de la transaction en matière administrative. The term "administrative transaction" refers to the fact that the transaction is entered into by or on behalf of a public entity. This can however be a private contract or an administrative contract. Admittedly, the term "administration" can be interpreted broadly and narrowly. Litigation of the transaction is booming. Has long been public law borrows the civil rules of contract transaction subject to different legal regimes. Serious difficulties remain. Also, it was necessary to demonstrate why and how the administrative judge undertook a clarification of the law of the transaction in administrative matters. The aim of the thesis is to investigate the topic of semantic under-determinacy, i.e. the failure of the semantic content of certain expressions to determine a truth-evaluable utterance content. In the first part of the thesis, I engage with the problem of setting apart semantic under-determinacy as opposed to other phenomena such as ambiguity, vagueness, indexicality. As I will argue, the feature that distinguishes semantic under-determinacy from these phenomena is its being explainable solely in terms of under-articulation. In the second part of the thesis, I discuss the topic of how communication is possible, despite the semantic under-determinacy of language. I discuss a number of answers that have been offered: (i) the Radical Contextualist explanation which emphasises the role of pragmatic processes in utterance comprehension; (ii) the Indexicalist explanation in terms of hidden syntactic positions; (iii) the Relativist account, which regards sentences as true or false relative to extra coordinates in the circumstances of evaluation (besides possible worlds). In the final chapter, I propose an account of the comprehension of utterances of semantically under-determined sentences in terms of conceptual constraints, i.e. ways of organising information which regulate thought and discourse on certain matters. Conceptual constraints help the hearer to work out the truth-conditions of an utterance of a semantically under-determined sentence. Their role is clearly semantic, in that they contribute to “what is said” (rather than to “what is implied”); however, they do not respond to any syntactic constraint. The view I propose therefore differs, on the one hand, from Radical Contextualism, because it stresses the role of semantic-governed processes as opposed to pragmatics-governed processes; on the other hand, it differs from Indexicalism in its not endorsing any commitment as to hidden syntactic positions; and it differs from Relativism in that it maintains a monadic notion if truth.<br>Scopo della tesi è indagare il tema della sottodeterminazione semantica, ossia il fenomeno per cui il contenuto semantico di un'espressione non determina un contenuto passibile di valutazione per i propri proferimenti. The aim of the thesis is to investigate the topic of semantic under-determinacy, i.e. the failure of the semantic content of certain expressions to determine a truth-evaluable utterance content. In the first part of the thesis, I engage with the problem of setting apart semantic under-determinacy as opposed to other phenomena such as ambiguity, vagueness, indexicality. L’expression de la « bilatéralisation du cautionnement » suggère que ce dernier ne serait plus un contrat unilatéral par lequel seule la caution s’oblige. Dans un premier temps, l’étude de cette hypothèse permet de revenir sur le critère de l’unilatéralité du cautionnement, afin d’en proposer une définition et d’examiner dans quelles conditions ce caractère unilatéral peut varier. La démarche entreprise à l’endroit de la qualification du cautionnement se prolonge ensuite dans le but de vérifier ce qu’il reste du régime du contrat unilatéral en la matière. Il apparaît ainsi que le cautionnement est toujours un contrat unilatéral, et que le droit continue de le traiter comme tel. Dans un second temps, l’étude propose d’analyser la qualification et le régime des sujétions légales et prétoriennes qui sont à la charge de la plupart des créanciers cautionnés depuis une trentaine d’années. En droit du cautionnement, les sujétions légales sont des incombances, une qualification puisée dans les droits suisse, allemand, et belge. En droit commun, le créancier est assujetti par le devoir de bonne foi, de loyauté ou encore de cohérence comportementale, qui exprime la force obligatoire du cautionnement mais ne révèle aucune obligation contractuelle à proprement parler. Quant au régime de l’assujettissement du créancier, il est guidé par la déchéance en droit du cautionnement, et par la responsabilité civile en droit commun. En somme, ce n’est pas le caractère unilatéral du cautionnement qui change, mais les éléments qui en font douter qui doivent être appréhendés autrement, dans la théorie du droit des obligations comme dans la pratique du procès<br>The expression « bilatéralisation du cautionnement » (« Bilateralisation of Suretyship ») implies that the contract of Suretyship is no longer a unilateral contract whereby the Surety is the only obliged party.. First, the study of this hypothesis enables to reexamine the criterion of the unilateral feature of the suretyship contract, in order to propose a definition and to examine in what conditions this unilateral feature may vary. The approach chosen for the characterization of the suretyship is then carried on, in order to verify what is left from the regime of unilateral contracts in the domain of suretyships. It appears that suretyship is always a unilateral contract, and that French law continues to treat it that way.. Second, the study is carried on by the analysis of the characterisation and the regime of the legally- and judicially-imposed duties on the beneficiaries of a suretyship for thirty years. In suretyship law, the legal duties are « incombances », a norm inspired from the laws of Switzerland, Germany and Belgium. In civil law, the creditor is bound by the duty of good faith, loyalty or even behavioral consistency, which all exprès the binding power of the contract of suretyship but hide no contractual obligation per se, strictly speaking. As for the régime of duties imposed upon the creditor, it is dominated by the sanction of forfeiture in suretyship law, and by civil liability in civil law. In the end, changes do not affect the unilateral aspect of the suretyship contract ; they should alter the way we approach the elements that cast a doubt on it, be it in the law of obligations of in the judicial practice

The interview is the ideal opportunity for the job candidate to assess his/her fit with a potential employer. While much research from the recruiting literature shows that candidates' perceptions of PO Fit lead to important outcomes such as intentions to pursue a position and acceptance of job offers, fewer studies explore how such fit perceptions are formed. The current study utilized a policy capturing approach to model how individuals interpret and combine cues from the interview experience as they formulate their perceptions of PO Fit. The cues tested included interview question content and the contextual variables of interviewer behavior and interview process factors. College students read a series of interview scenarios where these cues were manipulated, and provided their reactions about PO Fit, as well as about fairness and the ultimate decision to pursue an employment relationship. Although values-related question content was predicted to be most influential in the determination of PO Fit, the contextual factors more strongly affected all outcomes. Furthermore, for many participants, the relationships between these contextual effects and the outcome variable (intention to continue in the selection process) were mediated by perceptions of PO Fit and fairness. Considerable intercorrelation among the three dependent variables was found, and could be attributed to limitations of the method employed or job seekers' generalized and non-focused reactions following interviews. Additional research is needed to further investigate PO Fit perceptions from interview stimuli; suggestions and implications are discussed.<br>Ph. D.

In this thesis, I examine definitions of fan activism in context of the assumption that Millennials are not politically active and that all online political engagement is superficial. I argue that the perception of political apathy is partially due to the fact that some of the most enthusiastic and intensive political work done by this generation is simply not picked up by conventional means. Some of this ‘hidden’ work is being accomplished by way of radical fanworks. Specifically, I examine Harry Potter fanworks and the ways in which they place marginalized identities at center stage, as well as the misogyny and homophobia that underlie the stigmatization and belittlement of fanworks. While many validate fan activism only when it engages with traditional political problems via traditional political means, I advocate for the validation of the cultural politics work done by fandom—of the purposefully transgressive narratives individuals create in defiance of typical cultural stories. To dismiss fandom is to dismiss a critical element of youth culture, and to dismiss the cultural politics of fandom in favor of traditional civic and political engagement by fandoms is to ignore the more radical positions being explored online.

This study investigates the techniques of contact angle measurement on fine coal particles. Two techniques, one direct and one indirect, have been investigated and modified.
In the direct contact angle measurement technique, high pressure is employed to compress the coal powder into a pellet and the artificial surface of the pellet is employed in the contact angle measurements. The contact angle versus time and versus drop size on the pellet surface are examined. In addition, the pellet properties and factors affecting the pellet properties are also studied. A pellet surface model and a method for contact angle correction are proposed.
In the indirect measurement, the contact angle is calculated from the penetration rate. The method is modified to employ high pressures to produce highly compact columns. The holding glass tube traditionally used for the column of powder is, therefore, no longer needed. The change in penetration behaviour of the liquid within such columns is investigated. The properties of the columns and the impact of the pressure applied in their formation on the rate of liquid penetration as well as other phenomena are studied. Les fins de concessions n'ont pas fait l'objet d'etudes approfondies, en depit de l'interet porte a ce type de contrats. Soumis a des influences contradictoires, le regime des fins de concessions retrouve sa coherence pour peu qu'il soit rappele qu'une obligation essentielle est mise a la charge des cocontractants : la continuite du service public. Ceci se verifie au stade de la fin normale du contrat, et de sa fin anticipee. Des caracteristiques presentees comme traditionnelles de la concession se revelent, en fait, n'occuper qu'une place justifiee par la continuite du service public, lui restant donc subordonnee. Ainsi en va-t-il en particulier de la notion d'intuitus personae ou de la maitrise du concedant sur son exploitation. La liberte des parties est elle-meme balancee par cette obligation essentielle, dont le juge devient le principal protecteur. L'existence du contrat de concession est ainsi preservee, mais cette rigidite est attenuee par la souplesse avec laquelle la convention peut evoluer. Le juge administratif joue alors un role qui n'est pas sans rappeler celui du juge judiciaire, apparaissant comme le protecteur du contrat. Les nouvelles contraintes imposees par le legislateur, par exemple sous la pression communautaire, ne remettent pas en cause cette perspective d'un regime aux grandes capacites d'adaptation.

Elle se compose d’une première partie sur le contexte historique de la période 1274-1323 et sur l’émergence de débats dans de nombreux centres intellectuels consacrés à l’héritage de la doctrine de Thomas d'Aquin. Elle s’attache pour cela à mettre en avant les différentes discussions qui apparaissent lors de la première réception des œuvres de Thomas d'Aquin : censures, polémiques entre dominicains et franciscains, apparition de législation sur la lecture des ses œuvres, etc. Le travail se poursuit, dans une seconde partie, avec l’étude plus approfondie de deux auteurs de la fin du XIIIe siècle ayant été qualifiés d’ « antithomistes » par l’historiographie contemporaine : Roger Marston, OFM, et Dietrich de Freiberg, OP. Computer simulation using the Discrete Element Method (DEM) has emerged as a powerful tool in studying the behaviour of particulate systems during powder flow and compaction. Contact law between particles is the most important input to the Discrete Element simulation. However, most of the present simulations employ over-simplistic contact laws which cannot capture the real behaviour of particulate systems. For example, plastic yielding, material brittleness, sophisticated particle geometry, surface roughness, and particle adhesion are all vitally important factors affecting the behaviour of particle interactions, but have been largely ignored in most of the DEM simulations. This is because it is very difficult to consider these factors in an analytical contact law which has been the characteristic approach in DEM simulations. This thesis presents a strategy for obtaining the contact laws numerically and a comprehensive study of all these factors using the numerical approach. A numerical method, named as the Material Point Method (MPM) in the literature, is selected and shown to be ideal to study the particle interactions. The method is further developed in this work in order to take into account all the factors listed above. For example, to study the brittle failure during particle impact, Weibull’s theory is incorporated into the material point method; to study the effect of particle adhesion, inter-atomic forces are borrowed from the Molecular Dynamic model and incorporated into the method. These developments themselves represent a major progress in the numerical technique, enabling the method to be applied to a much wider range of problems. The focus of the thesis is however on the contact laws between extremely fine particles. Using the numerical technique as a tool, the entire existing theoretical framework for particle contact is re-examined. It is shown that, whilst the analytical framework is difficult to capture the real particle behaviour, numerical contact laws should be used in its place.

This study extended previous research by applying Higgins (2007) theory of Regulatory Fit to the context of performance feedback. Participants worked on an in-basket task in two 30 minute segments. Following the first 30 minutes segment, they were given recommendations for improving their performance framed in a manner that either did or did not fit their motivational orientation. Hypotheses predicted that compared to instances of non-fit, conditions of regulatory fit between recommendation frame (Eager vs. Vigilant) and motivational orientation (Promotion vs. Prevention) would have a significantly greater, positive impact on the following three outcomes: 1) Variety and Frequency of Feedback Use, 2) Feedback Recall, and 3) Attitudes Following Feedback. Overall results supported this assertion. Participants in condition of regulatory fit engaged in a significantly greater variety of behaviors and did so more frequently than those assigned to non-fit conditions. And while the effect of regulatory fit on feedback recall was not significant, it did approach significance (p = .07) and produced a pattern of results consistent with the predictions of regulatory fit. Counter to previous research, regulatory fit did not have significant impact on Attitudes Following Feedback in the current study. Implications and suggestions for future research are discussed.<br>Ph. D.

Durant ces dix dernières années, l'utilisation de fils à haute limite élastique et l'accroissement de la productivité ont conduit à des conditions extrêmes de pressions et de vitesses dans l'opération de tréfilage de fils d'acier laitonné. Dans ces conditions, la maîtrise de la lubrification et de l'usure du contact entre le produit et l'outil devient fondamentale dans l'optimisation du procédé. Cette étude s'intéresse à la génération d'un film interfacial avec les émulsions employées pour lubrifier le contact. Le comportement rhéologique et l'adhérence aux parois dans la zone d'entrée du contact gouvernent les conditions de formation du film lubrifiant pénétrant dans l'interface. L'étude du comportement du lubrifiant dans cette zone soumise à un régime de lubrification élastohydrodynamique est un paramètre clé pour la compréhension de la lubrification du contact. Les mesures expérimentales effectuées à l'aide d'un tribomètre élastohydrodynamique et complétées par des analyses chimiques montrent que la transformation de la structure des phases organisées des émulsions de tréfilage au cours de leur utilisation est une condition nécessaire à la formation d'un film lubrifiant. Les propriétés rhéologiques de ce film sont évaluées à l'aide d'un modèle développé à partir de l'analyse de l'alimentation du contact. L'hypothèse d'intéractions électriques entre les particules lubrifiantes et les surfaces métalliques est avancée pour expliquer les conditions d'adhérence ou de glissement du film à la paroi des solides en contact. Enfin, Les mécanismes de formation du film lubrifiant et les phénomènes conduisant à sa rupture sont reliés au processus réel de tréfilage et en particulier à l'usure des filières, étudiée à l'aide d'essais in situ sur machine de tréfilage instrumentée. Cette étude montre que l'interaction entre les transferts sur la surface des outils et le lubrifiant est un paramètre clé dans la lubrification du contact et la réduction de l'usure. Une approche mécanique globale est développée et montre que le régime de lubrification évolue d'un régime plastohydrodynamique à un régime limite lorsque les conditions de contact sont plus sévères, dans les dernières passes du procédé. Enfin, à partir de ces diverses observations, des hypothèses sur les mécanismes d'usure des filières sont avancées<br>For the past ten years, the use of high tensile steel and the productivity requirements have les respectively to an increase in pressure and speeds in the drawing process of steelcord. The control of both lubrication and wear of the wire/die contact is a key point for the process optimisation. This study deals with built-up of the interfacial lubricating film in this high pressure contact lubricated with an emulsion. The rheological behaviour and the wetting properties of the lubricant in the inlet zone of the wire/die contact are important parameters. The inlet zone, where the lubrication regime is elastohydrodynamic, governs the formation of the lubricating film and the lubricant supply of the contact. The knowledge of the lubricant behaviour in this inlet zone is crucial to understand the lubrication in the drawing process of steelcord. This has been experimentally investigated with an EHL tribometer and chemical analyses of the lubricant film. It has been shown that a change in the physical structure of the lubricant due to ageing is a necessary condition to build-up a lubricant film. A model based on the analysis of the starvation process has been developed to evaluate the rheaological properties of the lubricant film formed on the contacting bodies. The adherence and slippage at the wall of the lubricating film is explained by electrical interactions between the metallic surfaces and lubricant particles. Both formation and breakage of the lubricating film are connected with the industrial process. The wear of the drawing die is studied in details with an instrumented drawing machine especially developed for this purpose. This study demonstrates that the interactions between the transfert layers observed on the surface of the drawing dies and the lubrication process. In the first step of the process, the lubrication regime appears to be essentially plastohydrodynamic. As the running conditions become more and more severe in the last steps of the process, a boundary regime is reached. Finally, hypothesis based on the different observations pointed out in this study are proposed to explain the wear mechanisms

In his text Invisible Cities, Italo Calvino (1974) describes the fictional city of Baucis, a land suspended in the clouds, in which humans maintain a purposeful and mysterious physical detachment from the earth. Calvino’s imagining of Baucis visualises a conceptualisation of humans as divorced from nature1; a lingering residue of the post-Enlightenment obsession with reason and progress that casts nature as separate from and inferior to humans. In the context of the current ecological crisis, in which the perpetual abuse of human and natural resources threatens the sustainability of the planet and all earthly life, reconsideration of the relationship between humans and the non-human natural world becomes profoundly relevant. An overview of contemporary environmental theory, undertaken in the first section of this text, suggests that the widespread understanding of nature as an inferior realm that lacks the full degree of human rationality or culture, is giving way to conceptualisations of the relationship between humans and nature that highlight the interdependence and interrelatedness of all living organisms and systems. Sustainability scholar Stacy Alaimo ( 2010: 15-16) states: At this point in time, with global climate change proceeding even more rapidly than was projected, we hardly have the luxury of imagining any expanse of land or sea as beyond the reach of humanly-induced harm. Matters of environmental concern and wonder are always “here,” as well as “there,” simultaneously local and global, personal and political, practical and philosophical. This concept of the interrelatedness of global economic, technological, social, cultural and ecological systems, is significant in conceptualising the role that humans play in ecological degradation and exploitation.

Si l’encadrement juridique de cette utilisation se résume à un contrôle de police administrative, le législateur fait également référence à des opérations évoquant des pratiques contractuelles (transfert et cession). Or, le code civil fait obstacle, par des dispositions qu’il qualifie d’ordre public, à ce que les éléments et produits du corps humain fassent l’objet d’un droit patrimonial. Cette apparente contradiction conduit à s’interroger sur la nature juridique des éléments et produits détachés du corps humain à des fins scientifiques, éléments et produits qualifiés dans le domaine de la recherche de « matériel biologique humain ». These operations enable a movement of the components and products, between researchers, which is necessary to the sharing of knowledge and know-how in order to develop new drugs. If the legal framework of this use can be summarized to an administrative control, the lawmaker refers as well to some operations like contractual practices such as transfer agreement. Nevertheless, the Civil Code obstruct, by public policy rules, the components and products to be subject to a right of ownership. This apparent contradiction led to wonder about the legal nature of the components and products detached from the human body for a scientific use. Such components or products are termed in the research field as « human biological material ». The goal of my portraiture is not to convey physical likeness; superseding the imitation of appearance is psychological portrayal of the desires and disappointments of the sitter. Often, a fragmented sense of self is revealed – both in others and in myself – and I seek to depict the kaleidoscopic nature of individuals in their given situations. Possessing whimsical, playful elements as well as encounters with lack and longing, I create work to escape what in my life is unbearable as well as to finally embrace that which I cannot possibly escape.

Istället förlitar de sig på sina fans, och använder deras sociala mediekanaler för marknadsföringsändamål. Eftersom Tesla är ett modernt och tekniskt företag som får stor uppmärksamhet runt om i världen är det inte konstigt att människor finner företaget och deras produkter intressanta, därav har en fan-gemenskap vuxit kring upp företaget. Fandom är en kultur baserad på ett gemensamt intresse kring ett visst ämne eller en specifik sak. Kulturen är byggd på gemenskap och ett gemensamt intresse kring ämnet i fråga där fansen delar samma värden. Detta kommer göras genom att vi besvarar våra frågeställningar som innefattar hur fans och entusiaster framställer Teslas elbilar i sina egenproducerade filmer, samt vilka futuristiska konnotationer, symboler, ideologier, och myter som syns i dessa filmer. Med hjälp av semiotisk analys som metod kommer vi kunna tolka de olika tecken som förekommer i de utvalda filmerna, samt analysera dess innehåll på ett begripligt sätt för att sedan skapa en djupare förståelse kring vad man försöker förmedla. Studiens resultat visade att de föreställningar kring framtiden som förekommer i Project Loveday innefattar associationer till rymden och den teknik den bär med sig, samt att Tesla Motors besitter denna teknik och därmed kan ses som en del av framtiden.<br>Tesla is a multinational company which manufactures and sells electric cars among many other products and services. Instead they rely, and use their own fans and consumer’s media channels for marketing purposes. Since Tesla is such a modern and technological company which gets a lot of attention around the world, it is not strange that people find them and their products interesting. Therefore, a fan community has grown around the company. Fandom is a culture based on a mutual interest about a certain or specific matter. The culture is based on community, values and a shared interest in the subject. The purpose is primarily so share material with people with the same interest, not to profit on it. Tesla is aware that they have a strong fan community, which led them to launch “Project Loveday” – a project where their fans got the possibility to create their own Tesla commercials which later would be broadcasted and posted on Teslas own website. The purpose with this study is to obtain what Teslas fans and enthusiasts wants to communicate in their own produced movies in the “Project Loveday” campaign. This will be done by answering our questions of issue, which includes how fans and enthusiasts presents Teslas electric cars in their own produced movies, as well as what kind of futuristic connotations, symbols, ideologies, and myths that can be seen in these movies. By using semiotics as our choice of method we will interpret the different signs which occurs in the chosen movies, and analyze their content in an understandable manner regarding what they try to mediate. The result of the study shows that the perceptions about the future which occurs in “Project Loveday” includes associations to space, and the technique it brings along. It also shows that Tesla possesses this technique and therefore can be seen as a part of the future.

A circa un ventennio di distanza dalla questione de ara Victoriae (384), che vide contrapporsi il senatore pagano Simmaco (rel. 3) e il vescovo di Milano Ambrogio (epist. 73), si colloca il Contra Symmachum (o Contra orationem Symmachi secondo parte della tradizione manoscritta) di Aurelio Prudenzio Clemente. La sua peculiare configurazione in due libri di diseguale lunghezza e contenuto, la apparente divergenza fra gli scarni riferimenti cronologici interni al testo e la difficoltà riscontrata dalla critica nell’individuare l’avvenimento o la situazione che abbia motivato la composizione dell’opera sono solo alcune delle caratteristiche che rendono il Contra Symmachum un testo enigmatico. Soltanto il secondo libro dell’opera consiste in una confutazione metodica della relatio tertia di Simmaco; il primo presenta invece i tratti di un encomio dell’operato dell’imperatore Teodosio e di un’invettiva rivolta contro il culto delle divinità tradizionali di Roma, e per questo ha suscitato minore interesse da parte della critica.
Il presente lavoro ha lo scopo di fornire un testo criticamente rivisto, una nuova traduzione italiana e un commento linguistico-letterario, oltre che filologico, al primo libro del Contra Symmachum, per portare in luce gli aspetti che legano l’opera alla congerie culturale che ne ha motivato la stesura da parte di Prudenzio, con particolare attenzione al problematico rapporto con la poesia di Claudiano e Paolino di Nola.

Les réseaux de communication inter-machines font partie des grandes évolutions de l'informatique contemporaine. Ces réseaux évolutifs promettent une nouvelle gamme de services et une meilleure connaissance du monde qui nous entoure. Pourtant, ils subissent plusieurs limitations de par la nature même des nœuds qui les composent : un débit faible et une fiabilité réduite dues aux contraintes en termes de capacité de calcul et de mémoire, une durée de vie limitée, ainsi que des délais non bornés souvent causés par des taux de perte élevés. Ces mêmes problématiques constituent, depuis une quinzaine d'années, un frein au déploiement à large échelle des réseaux de capteurs dans le monde réel. De récents développements dans la théorie de l'information sont finalement en train de bouleverser l'ordre établi, donnant naissance à une nouvelle approche connue sous le nom de théorie du codage réseau. Cette nouvelle façon d'acheminer l'information transforme les méthodes d'exploitation, de gestion et même la compréhension des réseaux de communications actuels et futurs. C'est dans ce contexte, que nous proposons dans cette thèse d'étudier l'impact, les bénéfices et la faisabilité du codage réseau dans les réseaux de capteurs sans fil. L'objectif étant de montrer l'intérêt d'exploiter ses concepts pour les différents paradigmes propres aux réseaux inter-machines en général, et aux réseaux de capteurs en particulier. Il s'agit dans un premier temps d'évaluer les apports prospectifs du codage réseau, qu'il soit linéaire ou opportuniste, strictement en termes de performances (i.e., latence et débit). Dans une seconde partie, nous poursuivrons notre étude en traitant de l'impact du codage réseau sur la fiabilité des réseaux de capteurs, ces derniers étant caractérisés par l'absence de mécanismes de contrôle de flux de bout-en-bout. Dans une dernière contribution, nous explorons la faisabilité dans une plateforme réelle, d'un mécanisme de codage réseau contraint spécifiquement conçu pour les réseaux à faible débit. Ce code opportuniste, est centré sur l'optimisation mémoire et l'efficacité énergétique. Il permet à la fois, d'améliorer les performances du réseau mais aussi sa fiabilité. Nowadays actors within the business context are presented with a vast menu of different ideas which they can potentially adopt. This begs the question why actors choose to adopt a specific idea out of all the other available options. Our study explores the theoretical topic concerning travel of ideas, through the empirical context of leaders who practice extreme athleticism. The research question is: How and why do leaders adopt the idea of extreme athleticism? To answer this question, we assort several theoretical insights into six themes that are foremost predicated upon Scandinavian institutionalist contributions. The six themes are translation, previous practices, strategic purposes, fashion, legitimacy, and field, which is synthesised into a novel conceptual framework to help us understand how and why actors adopt an idea. The study is qualitative and collects data from 12 semi-structured interviews and 48 newspaper articles. Our main finding is that each of the six themes explored in this study are salient and helps us understand how and why actors adopt an idea, with a particular emphasis on the interplay between the intrinsic and extrinsic benefits. A suggestion for further research is therefore to develop and refine the conceptual model presented in this study.

Manga, or Japanese comic books, are one of the newest popular media imports from Japan to garner a sizable following in the U.S. Shortly before the establishment of an American manga publishing industry and the investment in resources to publish manga legally, fans calling themselves scanslators or scanlators (scan + translators) began translating Japanese manga themselves and distributing it to other fans through the Internet. This dissertation focuses on the manga importation process from several different angles, comparing within each the struggles and similarities between the actions and motives of scanslators and publishers. Comparing and contrasting the practices and norms of scanslators with those of the American manga publishing industry, this case study will provide insight into the ways that fans of transnational texts are involved in a system of global media flows whose paths are determined by legal, cultural, economic, and political forces.
This work focuses on three stages in the manga importation process: selection, translation, and distribution. This study is based on the textual analysis of trade journal articles and web sites, informed by interviews with scanslators and manga industry workers. I conducted interviews over a six-month period in 2008, focusing on two groups, the publishing company Tokyopop and the scanslation group "Paradise." I carried out follow-up interviews a year later. I supplemented these interviews with interviews from freelance manga translators. I demonstrate principles influencing the flow of other kinds of media across borders. Manga serves as a prime example of the rise and transformation of a genre in the book market, and more broadly as a form of media. This case also serves as a snapshot of a moment of change within the publishing industries as they move towards increased digitization.

The first problem that is analysed in this thesis is the possibility of the existence of a parity-odd trace anomaly in 4d in the presence of a curved background. We show some evidence by using Feynman diagram techniques that this anomaly is present in the theory of a free chiral fermion and that it has the curious feature of having a purely imaginary coefficient in Lorentzian signature.
We also analyse the theory of a free massive fermion in 3d. We compute two- and three-point functions of a gauge current and the energy-momentum tensor and, for instance, obtain the well-known result that in the IR limit we reconstruct the relevant CS action in the effective action. We then couple the model to higher spin currents and explicitly work out the spin 3 case. In the UV limit we obtain an effective action which was proposed many years ago as a possible generalization of spin 3 CS action. In the IR limit we derive a different higher spin action. This analysis can evidently be generalized to higher spins. We also discuss the conservation and properties of the correlators we obtain in the intermediate steps of our derivation.

Specifically I have been interested in the way in which certain exhibits facilitate powerful emotional responses from their viewers. I suggest that the curators of these kinds of exhibitions employ strategies which not only choreograph the displays but the viewers' bodies themselves as they move through them. As a case study of an experiential exhibition I focus on the District Six Museum where I have been part of its curatorial team since 1999. The work of curatorship that I have done at the Museum during the period of my registration for this degree constitutes part of this submission.

Concept drift detection, the identfication of changes in data distributions in streams,
is critical to understanding the mechanics of data generating processes and ensuring that data models remain representative through time [2]. Many change detection methods utilize statistical techniques that take numerical data as input. However, many applications produce data streams containing categorical attributes. In this context, numerical statistical methods are unavailable, and different approaches are required. Common solutions use error monitoring, assuming that
fluctuations in the error measures of a learning system correspond to concept drift [4]. There has been very little research, though, on context-based concept drift detection in categorical streams. This approach observes changes in the actual data distribution and is less popular due to the challenges associated with categorical data analysis. However, context-based change detection is arguably more informative as it is data-driven, and more widely applicable in that it can function in an unsupervised setting [4]. This study offers a contribution to this gap in the research by proposing a novel context-based change detection and adaptation algorithm for categorical data, namely Fine-Grained Change Detection in Categorical Data Streams (FG-CDCStream). This unsupervised method exploits elements of ensemble learning, a technique whereby decisions are made according to the majority vote of a set of models representing different random subspaces of the data [5]. These ideas are applied to a set of concept drift detector objects and merged with concepts from a recent, state-of-the-art, context-based change detection algorithm, the so-called Change Detection in Categorical Data Streams (CDCStream) [4]. FG-CDCStream is proposed as an extension of the batch-based CDCStream, providing instance-by-instance analysis and improving its change detection capabilities especially in data streams containing abrupt changes or a combination of abrupt and gradual changes. FG-CDCStream also enhances the adaptation strategy of CDCStream producing more representative post-change models.

Les Vibrations Induites par Frottement (FIV) sont un phénomène complexe qui surgit chaque fois deux surfaces subissent un glissement relatif. Pendant les dernières décennies, une quantité significative de œuvres expérimentales et numériques a traité des Vibrations Induites par Frottement, tandis que la simulation de l'excitation dynamique de contacts frictionnels a été toujours un vrai défi dans beaucoup de domaines de recherche industrielles. Dans ce cadre de recherche, ce travail est adressé à l'analyse des Vibrations Induites par Frottement, en développant des analyses en même temps expérimentales et numériques ; on propose une nouvelle approche numérique pour reproduire l'excitation dynamique locale du contact et son effet sur la réponse vibrationnel du système, sans augmentation significative des coûts de calcul. Le système mécanique, l'objet de l'analyse, est composé par deux poutres en acier en contact frictionnel dans un mouvement relatif ; la dynamique simple du système tient compte de la distinction entre la réponse de dynamique du système et l'excitation à haut débit venant du contact. Une campagne expérimentale paramétrique a été conduite pour analyser les effets de trois paramètres de contact principaux (la vitesse de glissement, la charge normale et la rugosité superficielle) sur la réponse du système vibrationnel, c'est-à-dire sur les vibrations induites. En parallèle, un modèle numérique a été mis en œuvre pour reproduire l'excitation dynamique locale du contact et son effet sur la réponse vibrationnel du système. Une nouvelle loi de friction a été présentée dans le modèle, proposant l'utilisation d'un terme provoquant une perturbation dans le coefficient de frottement pour simuler les effets de l'excitation au contact. Les inclusions de l'excitation dynamique locale, en raison des phénomènes de contact, par le terme de perturbation du coefficient de frottement, permettent de reproduire correctement les Vibrations Induites par Frottement sans présenter une représentation de la topographie superficielle réelle, qui a besoin d'un grand nombre d'éléments, économisant donc le temps de calcul. Des signaux différents pour le terme provoquant la perturbation ont été testés pour simuler correctement les vibrations mesurées. L'évolution du terme provoquant la perturbation récupérée par une méthode inverse a surligné les contributions spectrales différentes de l'excitation locale du contact. La comparaison entre les Vibrations Induites par Frottement mesurées et ceux simulés numériquement a montré une bonne corrélation, validant la loi de frottement proposée. Finalement, l'effet d'un changement de rugosité e de vitesse de glissement a été aussi simulé numériquement et corrélé avec les résultats expérimentaux<br>Friction-Induced Vibrations (FIV) are a complex phenomenon which arises each time two surfaces undergo relative sliding. During the last decades, a significant amount of experimental and numerical works dealt with Friction-Induced Vibrations, while the simulation of the dynamic excitation from frictional contacts has always been a real challenge to face in many industrial research areas. In this research framework, this work is addressed to the investigation of the Friction-Induced Vibrations, carrying on at the same time experimental and numerical analyses; a new numerical approach is proposed to reproduce the local dynamic excitation from the contact and its effect on the vibrational response of the system, without significant increase of the computational time costs. The mechanical system, object of the investigation, is composed by two steel beams in frictional contact during relative motion; the simple dynamics of the system allows for distinguishing between the dynamics response of the system and the broadband excitation coming from the contact. A parametrical experimental campaign has been conducted to analyse the effects of three main contact parameters (the relative sliding velocity, the normal load and the surface roughness) on the system vibrational response, i.e. on the induced vibrations. In parallel, a numerical model has been implemented to reproduce the local dynamic excitation from the contact and its effect on the vibrational response of the system. A new friction law has been introduced in the model, proposing the use of a perturbative term in the friction coefficient in order to simulate the effects of the contact excitation. The inclusions of the local dynamic excitation, due to the contact phenomena, by the perturbation term of the friction coefficient allows to correctly reproduce the Friction-Induced Vibrations without introducing a representation of the real surface topography, which usually needs a large number of elements, saving then computational time. Different signals for the perturbative term have been tested to simulate correctly the measured vibrations. The evolution of the perturbative term recovered by an inverse method allowed for highlighting the different spectral contributions of the local excitation coming from the contact. The comparison between the measured Friction-Induced Vibrations and the ones simulated numerically showed good correlation, validating the proposed friction law. Finally, the effect in a change of the sliding velocity and surface roughness have been simulated numerically too and correlated with experimental results

Facebook and Twitter are the two most common social networking sites used by intercollegiate athletic departments. Not only are these outlets used to foster two-way communication with fans, but they are also used as advertising and public relations tools.
The purpose of this study is to compare the Kansas State University of Intercollegiate Athletics’ social media objectives and content with the level of satisfaction among representatives of the K-State fan base. Is the athletic department producing the social media content that their fans want to see? In order to gain a better understanding of the nature of the study, in-depth interviews were conducted with various staff members in the K-State Department of Intercollegiate Athletics to determine the social media objectives and to gather their opinions on the content. From there, two focus groups were conducted to ascertain the level of satisfaction among K-State fans with the current content. One group consisted of students while the other group contained K-State alumni. Findings showed that fans were pleased with certain aspects (i.e. score updates on @kstategameday, conciseness of Twitter, videos, etc.) but wanted to see more of other items such as K-State trivia, behind the scenes footage and more on student-athletes.
The information gathered was then used to provide suggestions for future social media strategies within the K-State Athletics Department. The recommendations will help to enhance communication with fans and satisfy their social media needs as they relate to K-State Sports.

The principal theme of this thesis is the identification of additional factors affecting, and consequently to better allow, the prediction of soft contact lens fit. Various models have been put forward in an attempt to predict the parameters that influence soft contact lens fit dynamics; however, the factors that influence variation in soft lens fit are still not fully understood. The investigations in this body of work involved the use of a variety of different imaging techniques to both quantify the anterior ocular topography and assess lens fit. The use of Anterior-Segment Optical Coherence Tomography (AS-OCT) allowed for a more complete characterisation of the cornea and corneoscleral profile (CSP) than either conventional keratometry or videokeratoscopy alone, and for the collection of normative data relating to the CSP for a substantial sample size. The scleral face was identified as being rotationally asymmetric, the mean corneoscleral junction (CSJ) angle being sharpest nasally and becoming progressively flatter at the temporal, inferior and superior limbal junctions. Additionally, 77% of all CSJ angles were within ±50 of 1800, demonstrating an almost tangential extension of the cornea to form the paralimbal sclera. Use of AS-OCT allowed for a more robust determination of corneal diameter than that of white-to-white (WTW) measurement, which is highly variable and dependent on changes in peripheral corneal transparency. Significant differences in ocular topography were found between different ethnicities and sexes, most notably for corneal diameter and corneal sagittal height variables. Lens tightness was found to be significantly correlated with the difference between horizontal CSJ angles (r =+0.40, P =0.0086). Modelling of the CSP data gained allowed for prediction of up to 24% of the variance in contact lens fit; however, it was likely that stronger associations and an increase in the modelled prediction of variance in fit may have occurred had an objective method of lens fit assessment have been made. A subsequent investigation to determine the validity and repeatability of objective contact lens fit assessment using digital video capture showed no significant benefit over subjective evaluation. The technique, however, was employed in the ensuing investigation to show significant changes in lens fit between 8 hours (the longest duration of wear previously examined) and 16 hours, demonstrating that wearing time is an additional factor driving lens fit dynamics. The modelling of data from enhanced videokeratoscopy composite maps alone allowed for up to 77% of the variance in soft contact lens fit, and up to almost 90% to be predicted when used in conjunction with OCT. The investigations provided further insight into the ocular topography and factors affecting soft contact lens fit.

William Logsdail (1859-1944) was a Lincoln born artist. He is largely unknown to the general public and little has been written about him even though he was a successful and prolific artist during his lifetime, as contemporary accounts prove. This is the first comprehensive and modern scholarly account of this artist’s life and work. The thesis is comprised of two sections, plus an appendix of a full, annotated catalogue of the artist’s known works. Part I relates to Logsdail’s life, training and artistic achievements in relation to the cultural environments and circumstances under which he produced his work. The primary evidence for this has come from contemporary articles on the artist, and his own unpublished notebooks, written in later life, which contain details of his life, work and travels. Part II provides an analysis of the stylistic content of Logsdail's work, and of the artistic influences on it from the early stages of his career through to his later portrait works. His work here is considered primarily with regard to contemporary notions of Realism and Impressionism and, by extension of the latter, to 'modernity'. It also explores contemporary critical reviews of Logsdail’s work, both in terms of how it was understood within the wider artistic movements and trends of the time, and to assess Logsdail's contribution to late nineteenth/early twentieth century British art today. Furthermore, the thesis also assesses Logsdail’s portrait work as an area that has been hitherto neglected, thus providing a complete study of the artist, and adding to our understanding of British Portraiture at this time. Appendix I, William Logsdail: Catalogue Raisonné, provides an original catalogue of all known works. This is rare for a British artist of his time and in itself constitutes an original piece of research. This catalogue will hopefully provide a useful source for further research on the artist, his contemporaries, and on British art at that time.
