This article on social movement unionism in Japan examines the particular ways in which labor unions form coalitions when undertaking disputes that concern the dismissal of blue-collar temporary agency workers. The triangular employment arrangement nullified the right of labor unions that represent the temporary agency workers to bargain with the user corporations. Against this predicament, labor unions formed alliances by flexibly negotiating the divisions that exist among labor. Labor unions in Japan are largely grouped under national labor federations and by their ties to political parties. Labor unions formed coalitions within the federation boundaries but also found creative ways to bridge across federation membership in an effort to rebuild its associational power. Civil society groups served as a glue that drew in unions across national federation memberships.

Abstract:
The proposed article deals with the basic principles of labour law, which are the basis of labour law. An analysis of the principles first formulated in the legal literature, to one extent or another subsequently accepted by the science of labor law, which found legal fixation in the labor code of the Russian Federation, was carried out. Based on the analysis of the content of individual continuity and new principles of labor law, their relationship is shown, the preservation of continuity elements during updating. Some inaccuracies made by the legislator when forming a list of modern principles of labor law are shown. To eliminate them, it was proposed to amend Art. 2 of the Labor Code of the Russian Federation.

The authors analyze the points of view of scientists and practitioners on the differentiation of labor and civil legal relations. The conclusion is made: labour and civil legal relations, both in the XIX and in the XXI centuries, must be distinguished by objective criteria. In cases of fake transactions, for example, civil contracts or paid services, it is theoretically more reasonable to apply to the court with claims about the application of the consequences of the invalidity of fake transactions (paragraph 3 of Article 166 of the Civil Code of the Russian Federation) and the conclusion of an employment contract from the moment of the actual occurrence of labor relations (paragraph 5 of part 2 of Article 16 of the Labour Code of the Russian Federation), indicating the mandatory terms of the employment contract (part 2 of Article 57 of the Labour Code of the Russian Federation)

Abstract:
The article analyzes certain provisions of the Labor Code of 1922, which determined the vector of development of labor legislation in the period of changing political, economic and social conditions. The need for adopting the Labor Code in 1922 was caused by the transition of the Soviet state to a new economic policy. Since 1922, an accelerated process of updating labor legislation began. Some of the norms underlying the Labor Code of 1922 and the Labor Code of 1971 have been reflected and developed in the current Labor Code of the Russian Federation, e.g., the rules on terminating employment contract by parties’ agreement, differentiation in the legal regulation of labor, labor discipline, and others. The article investigates the legal position of the Constitutional Court of the Russian Federation, which had an important impact on the development of sectoral legislation, including, on recognizing part 1 of Article 392 of the Labor Code of the Russian Federation regarding the period for applying for moral damage compensation as contradicting the Constitution. Explaining the provisions of labor legislation, the Supreme Court of the Russian Federation also pays attention to the enforcement of provisions on compensation for moral damage in labor disputes. The article analyzes amendments to Article 263 of the Labor Code of the Russian Federation, allowing to conclude that those labor law norms continue to be updated.

Currently at the forefront in the development of labour legislation beyond the introduction of professional standards, namely directly regulatory, information provision and decision of issues of legal regulation, improvement of the existing system of qualification requirements to the employees about what will be discussed in this scientific article. Due to the fact that Russian labour legislation does not contain many of the concepts, terms, procedural provisions and the order of introduction of qualification requirements for employees upon hiring, determining work func tions and stuff that is hampering the implementation of main goals and tasks of labour legislation. From July 2016 in Russia, the time has come for professional standards, entered into force article 195.1-195.3 of the Labor code governing the professional standards of the Ministry of labor of Russia (Federal law No. 122-FZ of 2.05.2015). From that time the workers have to regularly confirm their professional satisfaction. In the existing handbooks and the literature requirements for workers is often inaccurate and infrequently updated, and it directly is an important gap to resolve which applied to professional standards, detail of which will be discussed in this scientific article.

Purpose of the study. A problem of assessing international labor migration in the past twenty years is a very topical issue in many countries around the world. The main problem of the study of labor migration is the lack of full and reliable information about this phenomenon. The main objective of this study is to assess the possibility of statistical assessment of external labor migration in the Russian Federation.Materials and methods. The article provides an overview of the international basic documents in the field of the organization of labor statistics of migrants, and also defines the concepts of labor migration and foreign employees from the point of view of international and Russian legislation. The sources of information were the data of the summary information on migration records of the Ministry of Internal Affairs of the Russian Federation, as well as microdata on the form 5-PERSONAL INCOME TAX of the Federal Tax Service of Russia. The main methods, used in the study are: methods of analysis and synthesis, methods of data measuring and aggregating, methods of working with microdata, analytical indicators of the dynamics, graphical and tabular method.Results and conclusion. Based on the study, several conclusions can be drawn. First, in the Russian Federation there are objective administrative sources of data on legal external labor migrants. Secondly, these sources are not harmonized and it is necessary to carry out methodological work on the harmonization of data and the construction of time series on the number of external labor migrants. Also, these services need to provide access to their information system to the Federal State Statistics Service to compile data on external labor migrants in various socio-demographic sections. Third, then the legal external labor migration to the Russian Federation increases every year and in 2017 amounted to about 108 million people, the main source countries are post-Soviet countries, and the high-ranking subjects of attraction are the cities of Moscow, St. Petersburg and Moscow Region.

Abstract:
Introduction: the procedure for communicating local acts of the employer to employees is regulated by the Labor Code of the Russian Federation in a very fragmentary way. The legislator is limited by the general norm of Paragraph 10 of Part 2 of Article 22 of the Labor Code of the Russian Federation, indicating that the employer is obliged to acquaint employees with the adopted local regulations directly related to their work, as well as several prescriptions regulating more specific issues. At the same time, the situation has become more complicated with the introduction of amendments to the Labor Code of the Russian Federation pertaining to the introduction of electronic document management at the employer. Research objectives: to identify defects in the legal regulation of the familiarization of employees with the employer’s local acts of and to make proposals for their elimination. Results: some defects in the legal regulation of the employee’s familiarization with the local acts of the employer have been identified. Among them is the absence in the Labor Code of the Russian Federation of a direct indication of the employer’s obligation to provide, at the request of the employee, local acts that regulate the employee’s activities. In addition, the amendments to the Labor Code of the Russian Federation introduced by Federal Law of October 22, 2022 No. 377-FZ, pertaining to the introduction of electronic document management, contradict the requirements of Article 62 of the Labor Code of the Russian Federation. The interpretation of the provisions of Article 22.1 of the Labor Code of the Russian Federation allows saying that the concept of “work-related documents” used in the paper also includes local acts the employee must be familiarized with under the signature. At the same time, in Article 62 of the Labor Code of the Russian Federation, this concept is used in a narrower sense, and does not include local acts that the employee gets acquainted with under the signature. Conclusions: it seems that the discovered discrepancy in the scope and content of the concept of “work-related documents”, in the author’s opinion, should be eliminated in favor of a broader interpretation proposed by Article 22.1 of the Labor Code of the Russian Federation.

Abstract:
The article is devoted to the study of the problem of the influence of the system of civil contracts arising from the provisions of the current Civil Code of the Russian Federation on the solution of the issue of the possibility of recognizing labor relations based on civil contracts. It means that Art. 19.1 of the Labor Code of the Russian Federation, the possibility of recognizing a relationship as labor is determined by the circumstances established in it, including the listing of the parties to the civil contract and its subject. In such conditions, it seems necessary to resolve the issue of giving preference to substantive requirements (signs of labor relations enshrined in Article 15 of the Labor Code of the Russian Federation) or formal requirements established by the provisions of Part 1 of Art. 19.1 of the Labor Code of the Russian Federation. The conclusion is substantiated that the influence of the system of civil law contracts and the related terminology of the Civil Code, which determines the parties and the subject of such contracts, on the decision of the possibility of recognizing relations as labor should not be taken into account when applying the current edition of Art. 19.1 of the Labor Code of the Russian Federation, and this article itself needs to be changed.

Abstract:
The article presents an analysis of situations in which civil law is applied in the regulation of labor relations. The authors note that civil law is applied in the regulation of labor relations in several cases. The most common situation is the reference rules provided for by the Labor Code of the Russian Federation itself, which directly provides for situations in which the courts can apply civil law rules when regulating labor relations. In some cases, if there is a gap in law, the courts apply the norms of the Civil Code of the Russian Federation when considering labor disputes, filling the gaps in the regulation of labor relations. In a number of cases, the Labor Code of the Russian Federation adopted civil law structures, although in this case it is no longer possible to talk about the application of civil law norms, since in the case of transferring these structures to the Labor Code of the Russian Federation, they become labor law norms. Also, in practice, there are situations when, simultaneously with labor relations, other relations arise, including civil law relations. In these cases, the courts also apply civil law. The authors describe these situations, give examples from judicial practice, and also propose ways to solve the defects arising in the regulation of labor relations.

Abstract:
This thesis sets out to investigate the possibility that the All China Federation of Trade Unions is capable of reform in the face of the development of capitalist employment relations. The thesis is centred on the examination of hitherto under-researched areas of ACFTU activity by researching the motivations, conditions and actors involved in three local-level pilot projects: collective bargaining, a trade union rights centre and enterprise-level trade union elections. The fieldwork is contextualised by historical summaries of the development of China‟s industrial relations and Party and trade union responses to labour unrest in both the state and private sectors since the establishment of the People‟s Republic in 1949. The results of my research demonstrate that it is no longer appropriate to refer to the ACFTU as a monolithic organisation. Furthermore, my argument departs from mainstream views of the organisation by locating the impetus for trade union reform in the challenge of increasingly sophisticated labour militancy from below, rather than reacting to orders from above. I conclude that while the pilot projects studied each have their own merits and qualifications, taken as a whole they prove that the ACFTU is capable of gradual reform from below. In the light of the improved relations between the ACFTU and the International Trade Union Confederation, this thesis speaks to this fact and aims to contribute to future engagements by expanding the knowledge on which dialogue and trade union exchanges must be based if they are to have any chance of success.

Abstract:
The thesis is an analytical study of the structure and activities of the International Transport Workers' Federation(ITF) from 1945 to 1965.It gives particular attention to the nature of the ITF's memberships, especially its expansion to the United States and to the Third World; to the ITF's political stance in a period of enormous international tension and to the interrelationship of both those factors. The ITF was founded in 1896 and there are few substantial transport workers' unions which are not yet affiliated. It has long been recognized as the most effective of all the international trade union organizations. The ITF made a significant contribution to the Allied war effort in the Second World War and its membership in every branch of the international transport industry took on great strategic importance during the Cold War. The thesis is based on original research, making special use of the ITF's extensive archives at the Modern Records Centre of the University of Warwick. There is a close and critical focus on the ITFs political engagement, exemplified by its controversial part in countering communist influence in European ports in the early 1950s at the time of the introduction of the European Recovery Programme (the Marshall Plan). This discussion is, however, set in the context of the ITF's structures and its broader social and industrial concerns, such as the defence of trade union and civil rights and assistance to transport workers' unions in the newly de-colonized developing countries. The conclusions draw out the main findings of the research and discuss the dearth of academic literature on the international trade union movement, and especially the almost total neglect of 'International Trade Secretariats', organizations such as the ITF which group together national trade unions in specific industries and services. On this basis, it surveys a poorly served theoretical field and outlines implications for future theoretical analysis.

Abstract:
This thesis is concerned with various aspects of transitional labour reallocation either between different labour market states, or between less and more efficient enterprises, or between formal and informal sectors. The possibility of irregular employment opportunities receives special attention in this work. The substantive material is arranged in three independent essays. The first, empirical study portrays the most important trends in labour reallocation in Russia, and presents analyses of two types. First, transition probabilities are studied, and some determinants of worker flows are identified using a multinomial logit modelling. Second, a survival analysis of the non-employed is conducted to reveal possible causes of growing stagnancy of unemployment and inactivity. The findings are contrasted with the stylised theory of labour reallocation in transition (Aghion and Blanchard, 1994). The directions in which theoretical modifications should be attempted in future research are suggested. The second and the third essays draw upon some of these suggestions and are aimed at making a contribution on the theoretical front. The second essay puts forward a development of the seminal model of transition from planned to market economy by Aghion and Blanchard (1994). We introduce an informal sector to show that its presence can generate the dynamics qualitatively different from the types considered in the previous literature on the topic. It is argued that convergence to qualitatively different steady states can help explain varying transitional experiences of East European countries and the former Soviet Union republics. Attention is drawn to policy implications of the model, in particular to the creation of conditions favourable for the development of the new private sector as opposed to informal private initiative. Finally, the third essay takes the issue of coexistence of formal and informal sectors in transition further to see if such duality is possible in the long run, and to discuss the role of the government in creating preconditions for it. The study draws on the standard framework of Pissarides (2000) of search in the labour market. It demonstrates that a long-run equilibrium with both formal and informal economies is possible under very mild assumptions. It is also shown that labour market imperfections can create a situation when reduction in informality may be detrimental to economic welfare. Although the foci of the essays differ, the issues raised therein are closely knit so that many threads can be drawn together. In the concluding chapter we discuss the main areas to which this thesis contributes, summarise the main findings, and make some suggestions for future research.

"Employers, Unite!" argues that the anti-union campaign of Progressive-Era organized employers molded in crucial ways the shape of labor relations in the United States, and that to understand the development of ideas about work, business, and labor unions, we need to understand how these employers gained and wielded political and societal power.The study concentrates on the National Association of Manufacturers (NAM), which spearheaded what it termed the "open-shop'' campaign. Focusing attention on the unions' demand for the closed or union shop, the NAM shifted the debate over labor relations from workplace conditions to the legitimacy of unions as representatives of workers, identifying not employers but union leaders as the source of injustices.At the heart of the study is an analysis of over 100 active members of the NAM, organized through a relational database constructed with the help of recently digitized materials like local histories and biographical compendia. Besides basic information like company size or demographics, the database maps information about NAM members' social and political contacts. Substantial archival materials further ground the study's analysis of the NAM's structure and influence.Research on the membership has allowed me to uncover information that focusing on the leadership would not have revealed. For example, I have found that a high percentage of active NAM members were party activists and officials, mostly in the Republican party; their positions in the party hierarchy gave them influence over political nominations and Congressional committee appointments. Active NAM members also regularly had personal contacts to politicians ranging from governors to Senators; these contacts further bolstered the Association's power, enabling it to torpedo much of labor's legislative project.The study also compares the NAM to other business organizations, especially the National Civic Federation (NCF). The NCF promoted cooperation with moderate unions, a position which the NAM frequently and vehemently criticized. Rhetorical differences, however, masked an underlying agreement among businessmen regarding the undesirability of unions. The rhetorical disjuncture between the organizations served to constrain debate on labor relations: the NAM's stridency made the NCF appear genuinely progressive and thereby undercut other, more far-reaching critiques of existing workplace relations.

Elle analyse certains aspects de la stratégie politique et économique de L'AFL-CIO, elle étudie l'étendue des moyens mis en œuvre par la centrale pour atteindre ses objectifs, et cerne les limites de son champ d'action, afin d'éclairer l'évolution des rapports de force entre le gouvernement, le monde des affaires et le monde du travail et d'en tirer certaines constantes valables pour le mouvement syndical dans son ensemble. This thesis studies the extent and the limits of the power of the trade unions in the united states by analysing certain attitudes of the American labor federation, AFL-CIO, and of the various trade-unions affiliated to it over the years 1955 to 1979, that is to say during George Meany’s terms of office as president. It analyses certain aspects of the political and economic strategies of the AFL-CIO, studies the extent of the human and financial resources used by the federation to achieve its objectives, and defines the limits of its influence in order to throw light on the changing balances of power between the government, the business world and organized labor, thus identifying certain constants which hold good for the entire trade-union movement. The thesis shows, by describing the successes and failures of the AFL-CIO both at government and grassroots levels, how the union tried to achieve power, or at least to avoid a too great imbalance in its distribution. Finally, it offers an explanation of the present decline of the trade union movement throughout the whole industrialized world

This dissertation explores the boundaries of industrial unionism within and outside of the American Federation of Labor (AFL) in the struggle over what direction the American labor movement would take in the Progressive Era. The experiences of Iowa button worker and labor activist Pearl McGill in two nationally significant strikes between 1911 and 1912 enable us to see more clearly the nuances and ambiguities of these boundaries as industrial workers sought to build more inclusive unions. McGill’s advocacy for both the AFL-affiliated and industrially organized button workers in Iowa and the campaign of textile workers in Lawrence, Massachusetts, assisted by the Industrial Workers of the World (IWW), to organize on an industrial basis, shine a light on the conundrum faced by AFL leaders. The AFL and its craft union affiliates held fast to an anachronistic approach to organizing in an environment of rapid and technologically transformative industrialization in which the labor of women and ethnic and racial minorities was critical. The AFL’s early federal labor unions, for which Iowa button workers provide a case study, exemplify the strength of the impulse for unionization among mass production workers and show how AFL leaders fostered an institutional response to the growing demand for industrial unions while ensuring that craft unionists continued to dominate the AFL. The Women’s Trade Union League (WTUL) walked a fine, and sometimes precarious, line between its loyalty to the AFL and the demand of working women—notably in the garment and textile industries—for new, inclusive forms of organization. The strikes of women button workers and Lawrence textile workers illustrate the predicament faced by WTUL leaders. Pearl McGill’s short but prominent career as a youthful leader of the Muscatine button workers, a spokesperson for the WTUL, an advocate for women strikers, and a prominent activist with the IWW in Lawrence illuminates these tensions and the appeal of industrial unionism for young working women. This study elevates the importance of Progressive Era federal labor unions as a bridge connecting the local assemblies of the Knights of Labor of the 1880s to the industrial unions that would emerge in the 1930s. It examines the institutional history of the AFL and its bitter struggle with the Knights and establishes the link between the local assemblies of the Knights and the first generation of AFL-affiliated federal labor unions that provided a precedent for later industrial unions. The arc of industrial unionism in the United States can thus be seen as a long, interconnected movement rooted in the principles of general unionism embodied by the Knights and animated by the vital impulse for industrial unionism carried forward by industrially-organized workers of which Iowa button workers provide an important example.

В работе дана оценка уровня преступности среди мигрантов в регионах Дальнего Востока России во втором десятилетии XXI века. Показано, что большинство преступлений на Дальнем Востоке совершают граждане из стран ближнего зарубежья, что объясняется преобладанием численности мигрантов данной категории над мигрантами из стран дальнего зарубежья. В зависимости от стран исхода мигрантов меняется структура преступности, а именно: граждане КНР, КНДР, Вьетнама в основном совершают преступления, связанные с нарушением экологического законодательства и в сфере экономической деятельности. Граждане СНГ чаще совершают преступления против жизни и здоровья, общественной безопасности и общественного порядка. Показатели преступности мигрантов в целом не влияют на меры региональной миграционной политики. Основная причина использования ограничений (запретов) на рынке труда в отношении мигрантов из стран СНГ — защита регионального рынка труда и предоставление рабочих мест для местного населения.

Abstract:
Scientifically substantiated personnel industry policy contributes to the implementation of an innovative development scenario, provides better results with reduced production costs, which determines the relevance of the studying. The main goal of the work was identified factors and indicators which have regulatory influence on the state and development of the personnel potential of the industry. Diagnostics of the labor potential of land reclamation by federal districts revealed leaders and outsiders of sectoral development. The studying made it possible to justify the steady trend of the shortage of reclamation personnel in comparison with the calculated indicators. Objective and subjective reasons and factors that hinder the effective using of the industry’s personnel potential are distinguished. The concept of industry’s labor potential is clarified. The studying of changes in labor productivity in agriculture has confirmed a twofold increasing in this indicator for the period from 2014 to 2018. Methodological approaches to the indicators of assessing the labor potential of the reclamation industry are substantiated. The groups of socio-economic indicators of the reclamation industry’s effectiveness are identified. The methodology for determining the quantitative characteristics of labor potential on irrigated lands is specified, which is depended on the area of irrigated lands. The labor potential of the reclamation industry in terms of staffing the industry is studied. The main positive and negative trends of the personnel policy and the labor potential’s formation of the agro-industrial complex’s reclamation sector of the Russian Federation are specified, the industry personnel policy is assessed as passive, which does not allow predicting the needs for industry personnel, evaluate staff activities and analyze personnel problems. Highlighted characteristic trends in personnel potential in the federal district and regions of the Russian Federation allow: to develop unified approaches to manage this industry development factor; to develop recommendations to improve the efficiency of advanced training and retraining of personnel in irrigated agriculture. The implementation of the recommendations will contribute to increase the efficiency of the managing the human potential’s process of irrigated agriculture at the level of federal, regional and municipal authorities of the reclamation sector of the agro-industrial complex of Russia.

Abstract:
The article reveals the features of the state mechanism for regulating labor migration in the Jewish Autonomous Region. It is noted that labor migration is an integral part of the economic development of the region. The purpose of the study is the peculiarities of solving the problems of optimizing the mechanisms for regulating labor migration in the Jewish Autonomous Region (JAO). The practical significance of the study is underscored by the growing resource requirements of the Jewish Autonomous Region. The importance of attracting labor migrants from the widest list of countries, to increase the exchange of experience and improve interethnic relations, the organization of programs to increase the flow of willing workers and promising employers, is highlighted. The scientific novelty of the research is in the designation of the latest methods and state programs aimed at improving the efficiency of the labor migration management mechanism. Every year, the number of migrants illegally staying on the territory of Russia is growing, and the authorities of the Russian Federation are trying to improve the methods of control of foreign citizens entering the country, which makes it easier, but at the same time more effective, to exercise control over migrants and distribute it in. areas such as the patent system, employee-to-employer linkage and simplified taxation.
