Full textThis work aims to study the fortune and circulation in the Veneto region of the "Fatti di Cesare" with a critical edition of the unpublished "Zesarie batalie romane" of the ms. Oxford, Bodleian Library, Canonicianus Italicus 136. The first part of this work offers a careful examination of the numerous Italian vernaculars of the Faits des Romains, with an extensive discussion of all the bibliography on the issue and a comprehensive review of the various manuscripts, together with a check on the tradition of the French text. The second part focuses on the manuscript tradition of the "Fatti di Cesare", one of the most widespread and successful vernaculars of the "Faits des Romains", distinguished by being an abbreviated version of the French text that enjoyed, between the 14th and 15th centuries, a consistent circulation, also attested in northern Italy and, in particular, in the Veneto region. A recensio of the entire manuscript tradition was then carried out through the collation of suitably selected loci criciti, allowing a precise classification of the numerous codices of the "Fatti di Cesare", an indispensable operation, pending a critical edition of the text, in order to study, from a textual perspective, its circulation in the Veneto region. It has thus been possible to identify the origin of the" Zesarie batalie romane" – fifteenth-century adaptation in Venetian dialect of the "Fatti di Cesare" –, whose study has been dedicated to the third and last part of this work. The edition of the text was preceded by some notes on the language of the "Zesarie batalie romane", with a study of handwriting, phonetics and morphology, As is the common norm in the edition of ancient Venetian texts, the critical text was presented according to prudently interpretative criteria, considering the peculiarities of the manuscript, which testifies, in its specificity, to a precise willingness to reuse the material of the "Fatti di Cesare" in Veneto region. By the way, in order to the readability of the text, we do not renounce to correct it where necessary. Every single intervention on the text has always been considered, pointing out the lesson of the manuscript in a special apparatus, so as to allow the constant reconstruction of the original facies. The critical edition of the Zesarie batalie romane, which is published here for the first time, is therefore an important acquisition for the study of the Italian vernaculars of the Faits des Romains, allowing us to appreciate the complex ways of receiving, circulating and reusing over the centuries of such a significant text in the history of vernaculars in Italy.
L’objectif principal de ce travail a été d’étudier la fortune italienne des "Faits des Romains" et, notamment, leur réception en Vénétie; mon étude est complétée par l’édition critique des "Zesarie batalie romane" du ms. Oxford, Bodleian Library, Canonicianus Italicus 136, jusqu’alors inédites. Celles-ci constituent une transposition en vernaculaire vénitien librement adaptée d’une version toscane des "Faits des Romains" connue sous le nom de "Fatti di Cesare" et dotée d’une grande fortune même hors de Toscane, devenant la source de beaucoup d’autres textes. Dans la première partie de ce travail, je présente un examen attentif des nombreuses traductions italiennes des "Faits des Romains". Sur la base de mes enquêtes, conduites à partir d’une discussion approfondie de toute la bibliographie existante sur la question et d’une analyse des différents témoignages manuscrits, aussi bien français qu’italiens, je propose une nouvelle classification de toutes les versions italiennes des "Faits des Romains". La deuxième partie est centrée sur la tradition manuscrite des "Fatti di Cesare". À partir d’une nouvelle recognitio codicum des "Fatti di Cesare", qui m’a permis de dénombrer 49 manuscrits survivants de cette tradition, parmi lesquels deux manuscrits jamais mentionnés auparavant, j’ai d’abord étudié d’un point de vue matériel la diffusion et la circulation de ce texte dans différents espaces et époques. J’ai ensuite procédé à une recensio codicum de toute la tradition manuscrite, qui, grâce à une collation pour loci critici choisis, m’a permis de classer avec précision les nombreux manuscrits des "Fatti di Cesare", opération indispensable, en attendant l’édition critique du texte, pour en étudier même dans une perspective textuelle sa circulation en Vénétie. La troisième partie de ce travail a été finalement dédiée à l’étude des "Zesarie batalie romane". L’édition du texte a été précédée de quelques annotations sur la langue du texte avec une étude de la graphie, de la phonétique et de la morphologie. A cause de la stratigraphie linguistique de ce texte, caractérisée par un diastème dans lequel la patine linguistique du vénitien se superpose à la langue primaire du modèle toscan, il n’a pas toujours été possible d’isoler avec certitude les éléments attribuables au système primaire ou secondaire. De plus, en raison de la datation du ms. Canonicianus Italicus 136, à savoir l’année 1454, il était légitime d’y attendre, également au niveau du système linguistique vénitien-padan, un degré plus ou moins élevé de phénomènes typiquement toscans, et pour cette raison superposable au système linguistique de l’antigraphe toscan. Pour tout cela, j’ai décidé de proposer une analyse linguistique de nature purement descriptive, qui sans viser une analyse linguistique complète, peut présenter un examen attentif des phénomènes les plus importants retraçables dans le texte. Le texte critique a été présenté, comme d’ordinaire pour l’édition des anciens textes vénitiens, selon des critères prudemment interprétatifs, qui, tout en tenant compte des particularités du manuscrit Canonicianus, ne renonce pas à intervenir là où cela est nécessaire pour une meilleure lisibilité du texte. Naturellement, j’ai rendu compte de chaque intervention dans un apparat, où j’ai toujours indiqué la leçon du manuscrit, afin de permettre aux lecteurs la reconstruction constante de la facies original. L’édition critique des "Zesarie batalie romane", qui est publiée ici pour la première fois, est donc une acquisition importante pour l’étude des versions italiennes des "Faits des Romains", nous permettant d’apprécier les méthodes complexes de réception, de circulation et de réutilisation au cours des siècles d’un texte qui a connu un tel succès tout au long du Moyen Âge.

Full textThe possession is a very important system in the roman law. It not only has passed trough almost the whole historic evolution of the roman law(from the XII Tavole to the codification of Giustiniano), but also has played a very important part in the formation of the system of the ownership and other rights of property in the roman law. Because of its particular position, many outstanding roman jurisconsult, suche as Labeone, Nerva, Paolo, Ulpiano, etc, have left many important works on this subject. And the results achieved by the modern jurists are numerous. However, in the research of giurisprudence and in the legislation of China it lacks detailed works and profound and comprehensive thoughts. This thesis started from the original works of the roman jurisconsults, with the reference of the positive results of the modern Romanists, giving a more o less comprehensive introduction of the roman theory of the possession. In the second part, it concerns the system of the possession in the modern Italian law, emphasizing the influence of the theory of the possession in the roman law. The last part of this thesis is about the system of the possession in the Chinese law. Although it is established in the Chinese law, with regard to its specific contents, it is obvious that there are many places to complete and consummate. In the future process of the improvement of the Chinese law, an excellent juristic tradition, like the roman law, and a mature system of legislation, like Italian legislation, could be very useful. In fact, this is the primary aim and the potential value of our study.

Full textOvids "Fasti" offers a commentary on the Roman public calendar and acutely stresses its transformations at the beginning of the Empire, with the introduction of new festivals celebrating Augustus and important members of his family. The poet doesn't have to submit to any "official discourse" : he is playing with the formal structure of the calendar, and his clever "montage" reveals essential "tensions" not only in the elegiac writing, but also in the public religion. The complex construction based on "sequences" enables Ovid to analyse the components of the divine status promised to the "princeps" after his death. The poet also mentions the rising and setting of the constellations, which are interpreted as signals of the dialogue between gods an men. Ovid wants to show how Augustus is manipulating celestial rhythms in order to come closer to the gods. His reflection about the apotheosis notices the birth of a dynasty, which will care about the transmission of the great imperial power. In the "Fasti", Ovid presents original ideas about politics and religion and shows a great literary talent. His poetic virtuosity doesn't impede his theological reflection, on the contrary, it represents a tool for his aetiological inquiry

Full textThe central problem of this research is dedicated to the vicarious liabilities which fall on a person who is different from the person causing the damage. Regarding this special liability, it is analyzed in this thesis by using the Roman jurists’ method. And through this method we can understand the variety of perspectives in the system and identify the better solution. Based on the analysis, I draw the reconstruction of the vicarious liability in Chinese law. Therefore, this thesis has the following structure: In the first part, the vicarious liability in Roman law is analyzed. The fundamental cases are the actio noxalis adversus paterfamilias for the harmful conduct of the person under the paterfamilias’s power, the actiones furti et damni adversus nautas caupones stabularios and the liability for the damage caused by the person who lacks the capacity. As to these cases, the Roman law has paid particular attention to the protection of victims. Thus, the Roman jurists prefer to seek the basis of the vicarious liability in objective criterions, that is the special relationship between responsible person and tortfeasor: in the actio noxalis adversus paterfamilias it is the relationship of potestas between paterfamilias and his children or servants, which is the paterfamilias’s role of support to all other components of his family; in the liability for the damage caused by the person who lacks the capacity it is the guardianship between guardian and ward, which is a form of custody, that is diligent attention; in the actiones in factum adversus nautas, caupones, stabularios it is the relationship of preposition between ship-owners, innkeepers, stable-owners, and their employees, that is the role of the above-mentioned responsible persons which do not exclude the personal liability for recovery. These objective criterions, leaving the imputation of fault or intent of those responsible persons, surpass the logical consistency of the relationship between the blame of conduct and punishment. Therefore, it develops the consideration of a role that isn’t the punishment of conduct, but the compensation of damage. In short, in the system of non-contractual liability, the vicarious liability, which is based on the special relationship between responsible person and tortfeasor, plays a role of exception of the principle of fault that is the center of the system and is able to expand dynamically in any concrete and even new situation. This formulation of the Roman law is followed by the civil codes of the Roman law systems. Then, the vicarious liability in the civil codes of the Roman law systems is analyzed in the second part of the thesis. The analysis focuses mainly on the Italian civil code of 1865 and 1942, pointing also to the other countries’ civil codes. In the civil codes of the Roman law systems, besides the existence of some differences, we can find mainly two important points which are derived from the common model of Roman law. Namely: 1. in all of the civil codes, the vicarious liability refers to three main categories of cases: the guardian’s liability for the conduct of the person who lacks capacity; the liability of parents and their substitutes for the conduct of minors, the employer’s liability for the conduct of his employees; 2. in the system of non-contractual liability, the vicarious liability, based on the relationship between responsible person and tortfeasor, departs from the general principle of fault in order to protect the interest of victims. In the third part, the vicarious liability in the system of non-contractual liability in Chinese law is analyzed. The drafting of the vicarious liability in the Chinese law is only the result of comparing the precedents of civil codes of the Roman law systems, that is to say the success of similar points and the choice in the presence of differences. Finally, the vicarious liability in the system of the new law on non-contractual liability is set according to the following line: 1. the concept of ‘vicarious liability’ means that a special liability in which the person who is liable to compensation is not the one who has caused the damage to victim, but is a different subject; 2. such liability is configured in relation to three categories of cases based on fundamental relationships between the responsible persons and tortfeasors: the first is the category of the cases about the guardian’s liability for the conduct of ward based on the guardianship; the second is the category of the cases about the liability of parents and their substitute for the conduct of children based on the relationship of authority; the third is the category of case the employer’s liability for the conduct of the employee based on the relationship of preposition; 3. in the system of non-contractual liability, the vicarious liabilities, as the special cases, depart from the general principle of fault.

Full textThis work relates the characterization of materials inside Roman amphorae. It aimed to determine at once thewaterproofing material on the internal walls, but also to identify their content.In this way, different analytical tools were used as infrared spectroscopy (FT-IR) and gas chromatography (GC/MS).Several types of extraction were tested to optimize the results concerning for example the presence of wine (tartric andsyringic acids) or olive oil (oleic, palmitic, stearic acids,…).This preliminary work has been developed with reference Roman amphorae, i.e. whose content was known.In a second time, the obtained results were applied to case studies: amphorae « Dressel 1 type » dating from the endof the IInd century or the beginning of Ist century BC, with the stamp « Sestius ». They come from Cosa in Étrurie, thecurrent Tuscany.The first studied samples correspond to amphorae Dressel 1A of the wreck of Grand Congloué 2. The study with FT-IRindicated different bands concerning organic matter, as the chemical link O-H from carboxylic acid, C-H of themethylene group and C-O of the methyl ester. The study carried out by GC-MS showed diterpenoids, such asdehydroabietic acid and reten, which are diterpenic markers of Pinaceae family. Methyl ester by products were alsocharacterized. It reveals a pitch pyrogenically prepared from resinous wood (Pinus sp.). The extraction of the contentswas optimized and GS-MS technique was successfully applied. We observed the presence of tartric and syringic acids(main markers of wine) in the pitched internal walls surface, but also in the potsherd matter.Other samples come from amphorae Dressel 1C found in the archaeological site of the gaps of the « Verbe Incarné »in Lyon. To verify their contents with wine, the GS-MS technique was used. The obtained results seem to confirm thepresence of wine. Finally the last group concerns amphora shards coming from the Oppidum of Châteaumeillant.Among the studied samples, one of them was particularly interesting, revealing the presence of wine and sandaracresin (Tetraclinis articulata)
