Full textThis study examined the experiences of bilingual parents who have a child with a disability, during two points in the special education process, eligibility and IEP. This study was designed to interpret parents’ experiences using Ecological Systems Theory (Bronfenbrenner, 1979) and Social Dominance Theory (Sidanius & Pratto, 1999) in order to draw conclusions as to if parents provide informed consent.
The population included nine parents of students with disabilities. The parents all identified as Hispanic, native Spanish speakers, and as a primary caretaker of the child with a disability. Basic qualitative research (Merriam, 2009) was conducted, and study data was collected by a semi-structured interview protocol. The interviews were conducted by the researcher, or a qualified Spanish speaker if needed. Data was transcribed, and analyzed using qualitative analysis to determine emerging themes.
The study’s results provided evidence on parents’ perceptions on the special education process impact their provision to provide informed consent. Parents perceived they were involved in the special education process, they used relationships with others to find support in the special education process, and they perceived barriers to participating in the special education process. Analysis of these findings on parental perceptions during the IEP process reveal that bilingual parents are not providing informed consent. Recommendations that can be implemented at a teacher, school, or policy level are made.

Full textIn early spring 2021, the Swedish government presented a bill that would entail amendments to the Transplantation Act. Since there is an organ shortage in Sweden, the purpose of the bill is to enable more donations. One of the proposals is the removal of the family consent which means that relatives will no longer have the right to refuse donation from a deceased relative when the willingness to donate is unknown, also known as a hard opt out system. This would make Sweden the third country in the world to implement such a donation system. There are few previous studies which examine the economic aspect of removing the family consent. The purpose of our thesis is to analyze such a systemic change in Sweden through a CBA. In addition to our CBA, we conduct a survey to analyze certain non-monetary effects. We also seek to analyze whether the attitude towards organ donation has changed since the most recent survey was conducted in 2015. The results show a more positive attitude towards organ donation in our study compared to earlier research. In the main calculation, the monetarily valued effects of a removal of the family consent presents net savings of SEK 427 million. Given that the non-monetary effects do not add up to a cost of more than SEK 427 million, a removal of the family consent is a profitable measure from a CBA perspective. The sensitivity analysis presents several alternative calculations where the monetary effects provide a net saving in all of them, which indicates a robust result in our main calculation. Even though our calculations indicate that a removal of the family consent leads to a net saving, we cannot determine if it is the most cost-effective measure. Previous studies suggest that there is no evidence that the removal itself leads to more donated organs and that structural changes can be at least as significant, if not more so. We recommend that additional comparative studies with countries that have a high proportion of donors should be conducted. This would help with the evaluation of which measures would be the most cost-effective in Sweden.

Full textOBJECTIVE: To analyze the frequency of submission of the research protocol to the Institutional Research Board and application of Informed Consent Form related to a clinical trial entitled “Treatment of Patients with Ewing Sarcoma Family of Tumors: A study of the Brazilian Cooperative Group”. METHODS: Retrospective cross-sectional study. Through patient records were performed an analysis of the regulatory proceeding and the signing of the Informed Consent Form by 180 patients from 16 institutions. RESULTS: Ten of the sixteen centers submitted the Protocol to the local Institutional Review Board. Regarding the Informed Consent Form, 161 of 180 patients and/or their legal representatives consented and signed the Form applied by the researcher. Of these, 123 signed the consent form specific to the protocol and 38 signed an institutional form. Regarding the date the consent form was signed, 141 of 161 patients signed it after receiving information about the trial and before starting treatment. CONCLUSION: Most of the participating institutions had a structure adapted to welfare and were not familiar with the ethical, legal and regulatory systems involved in a project like this.

Full textHow does the Conseil constitutionnel apprehend the family? This question leads to study the relationship between constitutional law and family, whose mutual igorance seems acquired. A positivist and analytic approach of the jurisprudence of the Conseil constitutionnel however illustrates that this apparent mutual disinterest is not grounded. Family is an institution protected and protective according to positive constitutional law; the latter prescribes to protect the family and also prescribes to the family to protect. Constitutionnal law prescribed after all to build family. This question leads to study the legislative concretizations of the constitutional norms concerning family. This study illustrates the techniques used by the Conseil constitutional in its judicial review. The study also emphasizes the fact that this concretization protects, but also sometimes threatens, the recognition, the development and the unity of the family. The realization of the constitutional law leads after all to a legislative construction of the family. This question leads finally to observe that family consists more in the legal construction of an object than in the construction of a legal object. The concretization of constitutional norms concerning family illustrates in effect a “familial pluralism”, which contributes to reveal the dynamics of the legal construction of the family

This doctoral thesis aims to extend and contribute to the literature on corporate governance and innovation, offering empirical evidence on the influence of boards of directors on this strategy. Also, this study seeks to compare if there are differences between the impact of boards on innovation considering family and non-family firms. To do so, we collected data of 86 Spanish firms of innovative sectors during the period between 2003 and 2014. The findings reveal the positive influence of gender diversity of boards on innovation; in the specific case of family firms, this positive influence seems lower but finally it was not proved significant. In addition, the results show that non-duality works worse than duality for innovation; it was proved for both, family and non-family firms, although the results were worse for family companies. Regarding independent directors, they exert a negative influence on innovation, which is even stronger in the case of family firms. Finally, board size does not exert any kind of influence on innovation, considering both, family and non-family companies.

Full textAgricultural advisory approaches enabling producers' capacity building are the center of interest of many development actors, especially in developing countries. Management Advice for Family Farms (MAFF – Conseil à l'exploitation familial / CEF) is a management advice approach, based on learning methods and decision support tools, helping producers to evolve on their strategic thinking. The aim of this research is to analyze the evolution of producers' strategic management through MAFF. We chose to analyze the learning processes induced by MAFF by characterizing the evolution of strategic thinking for nineteen producers in Southern Bénin. We consider the evolution of strategic thinking as a complex, non linear and recursive process, similar to a learning process. The evolution of strategic thinking is identified through the evolution of producer's proactivity through MAFF, proactivity being defined as the combination of producers' strategic vision (including their perceived source of change) and the strategic actions undertaken to reach this strategic vision. In order to describe the producers' situation before MAFF, we chose to focus on three main levels: their proactivity, their activity systems (including their resources for different types of capitals) and their planning practices for the management of their farm. From an interpretativist point of view, we analyzed producers' speech and representations, and the changes their spontaneously attributed to MAFF after one year of participation. The results of this research show first that the three levels of characterization of the producers' situation before MAFF started (proactivity, activity system and resources, planning practices) are not directly linked. This work also shows the evolution of producers' proactivity through MAFF in a limited time (one year), mainly by changing their perception on their perceived constraints and resources, revealing flexibility, changing their vision of the future and their perception of their power on their environment and change. Finally, those results substantiate the recursivity of the learning process, proactivity profile before MAFF being the main influence factor of strategic thinking building during this first year of participation to MAFF. Those results open new research perspectives, to analyze this strategic thinking building process on the longer term, the analysis of the persistence of proactivity, and the link between proactivity, performance and the sustainability of producers' projects. Those results also raise questions at the operational level, on the inclusivity of advisory approaches, on the adaptation of methods and tools to trigger this strategic thinking building, and on the necessary capacity building for all advisory system professionals, to comprehend the various dimensions of the producers' learning processes and to take into consideration producers' strategic thinking

Full textDuring the development of this research, we found that the largest number of companies in our country are family businesses, which even represent 60% of our GDP, we have also found in the information from different sources that the life span of these companies tends to be very short or to find in the path of their development crises that have not been overcome or that have led to stagnation of their growth. For this reason, we decided to consider the hypothesis that the presence of the board of directors in a family business, together with the number of its employees, is related to the sales of the same. To this end, we took a non-probabilistic sample of family businesses of different sizes in which we evaluated the presence of variables such as the directory, generations, family council and years of operation. Finally, we evaluated these variables in a quantitative approach; in which we obtained that effectively the directory and the number of workers in the family business it is related statistically and in a significant way with its sales.

Full textIf it is understandable that the multiplicity of angles of analysis amounts to exclude any single or summary definition of the family, this does not preclude trying to grasp this reality that the family is. Given the growing interest of the European Union (E.U) for the family, the E.U has been selected as the study framework of our research on the European family. Since the E.U is both a geographical area composed of twenty- eight Member States and an entity with legal personality, reflect on the European family in the European Union requires to do it in both members States of the E.U and the E.U itself. If we can’t define the European family, can we at least apprehend it, that is to grasp it by the spirit ? This is what we decided to do by putting in perspective the different approaches of the European family adopted by the different legal systems involved in the E.U.We need to focus our attention both on what the European family is in fact and as a legal object by studying the different ways it is modeled by laws. The various family laws of the Member States of the E.U and the various interventions of the E.U in family matters are so many means for us to apprehend the European family allowing us to reveal the existence of points of convergence and common values. But the research on the European family conducted in the E.U framework can’t ignore the existence of a bicephalous Europe because the conception that the E.U has of family is enriched by the jurisprudence of the European Court of Human rights ( ECtHR ) and remains in become given the legacy it receives from the construction of the meaning of the notion of "family life" in the case law of the ECtHR

Full textIn this thesis we consider several aspects of parameter estimation for statistics and machine learning and optimization techniques applicable to these problems. The goal of parameter estimation is to find the unknown hidden parameters, which govern the data, for example parameters of an unknown probability density. The construction of estimators through optimization problems is only one side of the coin, finding the optimal value of the parameter often is an optimization problem that needs to be solved, using various optimization techniques. Hopefully these optimization problems are convex for a wide class of problems, and we can exploit their structure to get fast convergence rates. The first main contribution of the thesis is to develop moment-matching techniques for multi-index non-linear regression problems. We consider the classical non-linear regression problem, which is unfeasible in high dimensions due to the curse of dimensionality. We combine two existing techniques: ADE and SIR to develop the hybrid method without some of the weak sides of its parents. In the second main contribution we use a special type of averaging for stochastic gradient descent. We consider conditional exponential families (such as logistic regression), where the goal is to find the unknown value of the parameter. Classical approaches, such as SGD with constant step-size are known to converge only to some neighborhood of the optimal value of the parameter, even with averaging. We propose the averaging of moment parameters, which we call prediction functions. For finite-dimensional models this type of averaging can lead to negative error, i.e., this approach provides us with the estimator better than any linear estimator can ever achieve. The third main contribution of this thesis deals with Fenchel-Young losses. We consider multi-class linear classifiers with the losses of a certain type, such that their dual conjugate has a direct product of simplices as a support. We show, that for multi-class SVM losses with smart matrix-multiplication sampling techniques, our approach has an iteration complexity which is sublinear, i.e., we need to pay only trice O(n+d+k): for number of classes k, number of features d and number of samples n, whereas all existing techniques have higher complexity

Abstract: The present study is based on the study of the shared guardianship of children in the light of the brazilian normative system in force, ascertaining its compatibility with the principle of the best interest of the child and the adolescent, as a way of providing a joint responsibility between the parents in the creation and education of minor and non-emancipated children. Due to the transformations faced by society, it is becoming increasingly common to break marital ties, often involving conflicts involving grievances and resentments between the spouses; however, it is worth noting that the separation refers only to conjugality and never to parenthood. Thus, parental authority, which concerns the rights and duties inherent to the parents in relation to the children, will remain with both parents even if one of them does not reside with the offspring. In view of these situations, it is necessary to apply the judicial custody that may be unilateral, that is, only one of the parents is designated as guardian, who will be responsible for the daily life of the children, residing with them; Or shared custody, which consists of the joint responsibility of the parents to their children, keeping their residence in the home that suits them best. There are difficulties in the application of shared custody, especially with regard to its obligation, after the advent of law n. 13.058/2014. In order for the correct application of joint custody to occur, a minimum of respect and proper commu... (Complete abstract click electronic access below)

Full textDuring the last years in Latin American there have been researches that identifythe family business inside their scope of study, contributing some data thatconfirm their important presence and role in the economy of several countries(Poza E. (1995); (Khulman, 1996) (Kajihara, 1998); (Davis J. A., 2006).Dominican Republic is not the exception, as explained by Van der Linde & Bello(2001); in the country exists a solid family business network in its first andsecond generations, with some big companies on their third, statement thatproduces evidence to develop an interest and need to prevent the mortality ofsuch companies. The practice that is modeled in the family business to achieve their intergenerationalsurvival is succession, understood as a process that culminates withthe decision making of a new successor leader who will have the company underhis/her command (Chua, Chrisman, & Sharma, 1999); (Chrisman, Chua, &Sharma, 2003).What we usually call “decision making” is a process that is applied to everydaysituations in the management of organizations, which turns complex andintricate in the context of family business. Thereon Basly S., (2005) made acomparison between family and non-family businesses proposing a logic ofdecision making different in each one, and highlighting the dominant dimension, process, speed and assumptions in which the decision is sustained. This studysuggests that family businesses are not governed by the normative model of decision making, assertion that gave us a clue to step into the subject ofrationality and decision making in the family business.Citing Simon (1955) the purpose of all constructions of an approximaterationality is to give materials for the development of a theory of the behavior ofdecision making individuals in the context of an organization. Nonetheless andopposite, we have the paradox that if we assume the type of overall rationality ofthe classical theory, the problems of the inner structure of the company, orwhatever organization it is, disappear almost completely

Full textLong appeared as a ‘’good student’’ of African continent, as a model of democracy – with a religious life free of violence, which blends harmoniously orthodox religious, heretics and non-Muslims – the year 2012 marked a turning point in the history of Mali. Thanks to the crisis, the segmentation of Malian Islam, although having peacefully exercised previously, will manifest in an unprecedented violence, with arms. Revealing, both, the limits of democracy, the withering away of the state, some critical social ills, significant shortcomings in the governance, the crisis of the year 2012 also unveiled new types of connections, linking the Islamic sphere to the politic. These links are dominated by the omnipresence, Islamic influence in the political sphere. Religious movements derive their influence from their ability to express and produce policy, combined with their strong anchor near to the population, through significant social works. This Islamic dynamic in the Malian political public space, will be exploited by the political elites, making Muslim elites partners, particularly in election periods

Full textSubject of confrontations regularly bring up to date in the 20th century, the production of pedagogical discourses on sexuality within the school institution does not reach consensus. The school does not manage to constitute a pedagogical monopoly on sex education. Although biological knowledge concerning human reproduction has found its place in the curriculum since 1968, sex education, made optional in 1973, then compulsory in 1998, escapes part of the educational system for the benefit of competing associations for the imposition of legitimate family morality. From hygienist mobilizations against syphilis to the fight against AIDS, through the promotion of marriage or contraception to prevent abortion, it is a question of studying in this thesis the process of elaboration of this educational skill. By combining classroom observations, biographical interviews and the analysis of archives, the investigation thus seeks to reconstruct the configurations where invented, formalized and disseminated this educational challenge, the inseparable policy of expanding a school. of State and the recomposition of the family movement

Full textThe present research aims at analyzing the scope of private autonomy of individuals regarding Inheritance Law. The study is based on the efficiency of pre-nuptial agreements by which couples are able to elect the inheritance order through the regime of separation of assets. The relevance of the study resides in the current legal order which ordinarily imposes assets to be held by both parties and, thus, according to the Brazilian Civil Code, the widower is considered to be entitled to them. The possibility of mitigating such legal rule is critically analyzed in order to make way for the parties will as it has been explicitly manifested in life. Therefore, the work is structured into introduction, two chapters of development and ends with the final considerations. Preceded by the introduction, which explains the reasons that led to research on the topic, chapter 2 examines the concept of private autonomy as a fundamental prerogative of individuals in Family Law and also as a mean to achieve the principle of Human Dignity. Consequently, it is verified that the pre-nuptial agreement can be considered as an instrument of the will of the parties and their autodetermination regarding the economic aspects of marital life Following, chapter 3 analyzes the regime of conventional separation of assets reveals the legal system that grants full autonomy for spouses, for which it is examined since it historically arose. Once it is identified the spirit of incommunicability of assets, it has to be verified how to apply it in Inheritance Law. Bearing that in mind, the situation of the spouse is investigated according to the Brazilian legal system, since the promulgation of the Civil Code in 1916 - when they were in third line in succession – until the current days as a necessary heir. Furthermore, the research examines the Brazilian court`s decisions regarding the subject matter. Finally, the will of the parties as a source of Law is presented as a possible solution to the problem at stake. In light of that, the parties could be considered bound to the pre-nuptial agreement, avoiding the condition of necessary heir to the remaining spouse.

A circle of old dignitaries dominates the "conclave" center of political balance, helped by the conflicts at the heart of the council. These conflicts gave rise to clandestine meetings organised outside the municipal council and condemned by the authorities. From the existing hierarchy appears a group of families that manages to take possession of the most important positions in government, closely followed by a more numerous group taking part in the honors and banning all other families from power

Full textThe decline of family public order was emphasized many times. It ought to be restored today. Based on an inductive methodology aimed at determining its origins beyond art. 6 of the civil code, the nature of family public order became clearer. On a theoretical basis, it governs the relation between State and family. It is thus at the heart of family issues. Its functional nature, which is axiologic and unitary, strenghens its cohesion and provides for an answer to all questions relating to the norm's imperative implementation, to the unavailability of rights, to its sources pr its substance. On a substantive plan, the family public order's evolutions paved by quality and freedom rest on the internal layout of its individual and statutory significance which favour conservatism or family innovation depending on the balance achieved. This ideal public ordrer spreads out in the social area through the management of conflict and the subtle use of santions. It has many defenders and its implementation is achieved by the use of techniques aimaing at avoiding conflicts as well as a procedural-oriented approach of conflict and a negociated solution to disputes. The nullity which is not subject to a classical distinction, is just one of the possible options. The negative sanctions, such as the nonexistence, the cancellation and caducity complete the list of positive sanctions as various as forfeit and private penalties. Family public order as an inter-institutional order is absolutely not declening. It contributes on the contrary to he democratic preservation of the relevant family institution

Full textIn its initial version, the Convention for the protection of Human rights and fundamental freedoms doesn’t guarantee foreigners either a right of entry and residence on the territory of a Member State or a protection against an expulsion measure. However, since decisions concerning aliens police may infringe the right to respect for family life that the article 8 of the Convention protects, both european and french case-law admit that litigation on aliens police enters the scope of this article. To benefit from this protection, the foreigner must prove that the measure in question, taken by public authorities, constitutes an interference with his family life. Invasions of family life are accepted only if, in accordance with the law and seeking a rightful purpose aimed at in the second section of the article 8, they are necessary in a democratic society. Otherwise, public authorities have to make up for the disproportionate infringement, adopting the more suitable measure to realise or maintain the family unity on the french territory. Regardless of national law, which enables foreigners to enjoy a right of entry and residence in France or a protection against an epulsion measure, interested parties can obtain recognition of such rights on the basis of the article 8 of the European Convention. Foreigners can therefore equally put forward national law or Europena Huma, rights law

This study used paired-relationship qualitative interview to explore the perceptions of ventilator-dependent patients’ the closest family and patients’ primary nurses after signing DNR for patients at the respiratory care ward. Study samples were 22 families and 12 primary nurses from one regional level and one community level hospital, respectively in New Taipei city. A total of 44 audiotaped in-depth interviews with semi-structure interview guide were transcribed into interview information by using the method of content analyses. The themes derived from qualitative interviews of families‘ perceptions after signing DNR for ventilator-dependent patients were considering letting go, push for signature, feelings after signature, behavior of seeking for internal balance, and suggestions for well preparation for signing DNR for families. The themes from primary nurses interviews were rationally letting go, reasons for signing DNR, family feelings after signing DNR, family behaviors after signing DNR, suggestions of how to prepare for families to sign DNR. The different perceptions between families and primary nurses in this study were families’ struggling for letting go vs. nurses’ rationally letting go,families’ not perceived for financial burden vs. nurses’ heavy financial burden for families to support for ventilator-dependent patients, and families guilt and uncomfortable feelings vs. nurses’ recognizing that families still hope medication treatments if there was necessaries even they have signed DNR.The similar perceptions between families and nurses in this study were families’ usual patients visits after signing DNR and families need sufficient information regarding to DNR, especially from the medical teams. According to results of this study, the coverage fees and frequency for taking place of family consultation meetings of palliative care between medical teams and families that were reimbursed from National Health Insurance, especially the primary nurses must enlist in the medical team for consultation meetings. The concept of shared-decision making can be integrate into family consultation meetings of palliative care to ensure families full participation in the consultation meetings and their considerations have been throughly concerned by the medical team. Primary nurses should receive education training to well prepare for their knowledge and attitude toward DNR and the related issues in providing hospice and palliative care. Future research can further explore feelings from different family members to explore whether different levels of relationshops between family-patients.could have different perceptions after signing DNR.
