Abstract:
A Knowledge Graph (KG) is a semantically organized, machine readable collection of types, entities, and relations holding between them. A KG helps in mitigating semantic heterogeneity in scenarios that require the integration of data from independent sources into a so called dataspace, realized through the establishment of mappings between the sources and the KG. Applications built on top of a dataspace provide advanced data access features to end-users based on the representation provided by the KG, obtained through the enrichment of the KG with domain specific facets. A facet is a specialized type of relation that models a salient characteristic of entities of particular domains (e.g., the vintage of wines) from an end-user perspective. In order to enrich a KG with a salient and meaningful representation of data, domain experts in charge of maintaining the dataspace must be in possess of extensive knowledge about disparate domains (e.g., from wines to football players). From an end-user perspective, the difficulties in the definition of domain specific facets for dataspaces significantly reduce the user-experience of data access features and thus the ability to fulfill the information needs of end-users. Remarkably, this problem has not been adequately studied in the literature, which mostly focuses on the enrichment of the KG with a generalist, coverage oriented, and not domain specific representation of data occurring in the dataspace. Motivated by this challenge, this dissertation introduces automatic techniques to support domain experts in the enrichment of a KG with facets that provide a domain specific representation of data. Since facets are a specialized type of relations, the techniques proposed in this dissertation aim at extracting salient domain specific relations. The fundamental components of a dataspace, namely the KG and the mappings between sources and KG elements, are leveraged to elicitate such domain specific representation from specialized data sources of the dataspace, and to support domain experts with valuable information for the supervision of the process. Facets are extracted by leveraging already established mappings between specialized sources and the KG. After extraction, a domain specific interpretation of facets is provided by re-using relations already defined in the KG, to ensure tight integration of data. This dissertation introduces also a framework to profile the status of the KG, to support the supervision of domain experts in the above tasks. Altogether, the contributions presented in this dissertation provide a set of automatic techniques to support domain experts in the evolution of the KG of a dataspace towards a domain specific, end-user oriented representation. Such techniques analyze and exploit the fundamental components of a dataspace (KG, mappings, and source data) with an effectiveness not achievable with state-of-the-art approaches, as shown by extensive evaluations conducted in both synthetic and real world scenarios.

Abstract:
This study investigated how teachers interpret their own pedagogy as a result of teaching within and through an immersive educational simulation. It explored Australian secondary teachers' beliefs about the role of technology within Economics and Business education, together with the challenges and disruptions faced when teaching in this unique learning environment. This qualitative study adopted a Grounded Theory approach to reveal the pedagogical complexities of teaching with such disruptive technologies. A new signature pedagogy, titled emergence pedagogy, was offered as a theoretical model to describe the transformation of pedagogical practice when teaching within an "in-world" and "out-world" environment.

Abstract:
This study examines Canadian works of fiction that contain historical trial narratives and that enact an adversarial trial of their own for an implied reader who acts as 'appellate judge.'' Included are four Canadian novels published after 1970 that fictionalize the circumstances leading to notorious criminal trials: Margaret Atwood's Alias Grace (1996), Lynn Crosbie's Paul's Case: The Kingston Letters (1997), and Rudy Wiebe's The Temptations of Big Bear (1973) and The Scorched-Wood People (1977). They represent commentaries on the justice or injustice done to convicted murderer Grace Marks (whose trial took place in 1843), to rebel Cree chief Big Bear and Metis leader Louis Riel (1885), and to serial rapists and killers Karla Homolka and Paul Bernardo (1993, 1995).
Each work reproduces excerpts from the original trial yet also represents a response to the historical trial's unfolding. This adversarial response takes the form of a trial-like narrative (or counternarrative) that engages with the original trial. Consequently each of these works is what I call a 'trial novel' that raises fundamental questions about justice and citizenship.
Chapter One analyzes Atwood's Alias Grace and lays bare the fictional constructs included in a trial narrative. Chapter Two looks at Crosbie's Paul's Case and pits the judicial system's claim to sober neutrality against a more populist version of justice based on affect and revenge. Finally, Chapter Three, which is devoted to Wiebe's novels, studies the conflict of normative universes implicit in trials for treason and posits that rebel nomoi are as coherent as the dominant ones that quash them.
Three communities are implicit in these novels and enter into a debate with one another: at the core of each work is a historical community of persons (the accused, attorneys, the judge, jurors, and members of the Canadian public) mobilized around an actual crime. This original community and its judgment provide the inspiration for the fictional community of the novel, which grapples with its own version of the crime and trial. Finally, an imaginative community of readers deliberates upon the questions raised both by the original trial and by the 'trial novel'.

Abstract:
The biblical story of Saul in 1 Samuel contains evidence of a tragic vision which has two central features. First, tragic themes are introduced and developed by means of multiple repetitions or typescenes in which the subsequent account emphasizes the tragic nature of the events described in the first. Second, the development of tragic themes is facilitated by the portrayal of the deity's ambivalence in enduring two kings simultaneously, terrorizing Saul with an evil divine spirit and sending a good spirit on David. The tragic vision in the Saul narrative has been perceived by Alphonse de Lamartine, and his drama Saül: Tragédie is an attempt to dramatize the events of 1 Samuel. The significant similarities and differences in plot and characterization between Lamartine's drama and the biblical narrative draw attention to the tragic themes in the anterior text and offer a new conception of Saul's suffering in the posterior text. Lamartine has borrowed from Greek tragic form as well as 1 Samuel for thematic materials and tragic devices. The deity is off-stage, as in much Greek drama, but the characters infer divine intervention in human affairs. Thomas Hardy also became fascinated with the story of Saul and in The Mayor of Casterbridge he has structured the relationship between Henchard and Farfrae on the relationship between Saul and David. There are similarities in both plot events and in characterization, but the most significant departure from the biblical material is the absence of the deity, which colours the tragic vision very differently, and idea of the supernatural is also of great significance in the novel. Hardy's novel displays evidence of the influence of Greek tragedy in plot and in theme. Also crucial to the novel are the role of fate and the sociological theme.

Abstract:
Drawing on field work at three different juvenile justice organizations, this dissertation explores the joint problems of interpretation and coordination in the face of problems marked by moral ambiguity and practical uncertainty. The author draws on array of research from a wide array of social and cognitive sciences to examine the relationship between knowledge and cognition, on the one hand, and coordination of action, on the other. Based on this work, the author proposes a more expansive, multidimensional model of cognition made up of four interconnected dimensions: conceptual, practical, emotional, and coordinating. This model allows us to better understand how people may coordinate their actions with others despite a lack of shared conceptual understanding of the problem at hand. The author then presents separate case studies of the three organizations, exploring these themes in further detail. In the case of the juvenile delinquent treatment center, Berkshire Farm Center and Services for Youth, the author examines how formal organizational processes and standards help coordinate the practices of the administration and clinical staff, on the one hand, and the teachers and child care workers, on the other, despite their fundamentally different understandings the boys’ problems and how to deal with them. In the second case, on the sentencing process at a State’s Department of Juvenile Justice, the author details how the formal, ritualized nature of the sentencing meetings allows for various professionals to express conflicting rationales for a given sentence simultaneously. In the third case, the author explores how the introduction of formalized practices, standards, and measures helps overcome the practical confusions, emotional conflicts, and differences in conceptual understanding between street workers and case managers that nearly derailed the efforts of the pilot gang intervention program, StreetSafe Boston. Taken together, these three case studies suggest that the strength of an organization’s formal bureaucratic features comes in part from the fact that they facilitate coordination without the need to resolve conflicts and contradictions in substantive interpretations, which may be a troubling but necessary accomplishment in the face of a problem rife with moral ambiguity and practical uncertainty.

Le roman postcolonial relève de l’interprétation de l’Histoire inhérente à l’écrivain d’origine africaine. En l’absence de sens acceptable pour les intéressés, la fiction interroge et met en exergue les aspects occultés de l’Histoire. L’étude s’attache à mettre en évidence des grilles de lecture autres qu’occidentales permettant de comprendre l’Histoire immédiate, thématique de plus en plus marquée chez les romanciers contemporains de Côte d’Ivoire. L’on se propose d’analyser la façon dont les romanciers ivoiriens des années quatre-vingt-dix à nos jours problématisent le thème de l’Histoire, comment ils l’intègrent à la trame narrative et pourquoi. La gestion d’une Histoire européo-centrée est un exercice délicat mais essentiel pour sortir de l’impasse. Les écrivains cherchent à doter leur peuple d’une Histoire à l’africaine ; Histoire compliquée par le colonialisme. L’étude vise à montrer comment cette évolution correspond à une urgence pour les auteurs : ceux-ci tentent en effet, à travers l’écriture romanesque, de trouver des réponses à la fragilisation des structures étatiques et de conjurer le spectre de la guerre civile amorcée par l’instrumentalisation du concept de l’Ivoirité. L’analyse porte sur les représentations mentales et culturelles, et l’on interrogera les catégories littéraires de façon à rendre compte de la façon dont elles induisent une vision de l’Histoire
The postcolonial novel is linked to the interpretation of History inherent to the african native writer. Without any acceptable understanding for the people concerned, fiction examines and brings out various occulted aspects of History. This study' s purpose is to underline some ways to interpret History other than from a western point of view, allowing the understanding of present History, a theme more and more present with contemporary Ivorian novelists. We propose to analyze the way Ivorian novelists, from the 90's until today, are treating History and how and why they integrate it into their fiction. The management of a european-centered History is a touchy but essential exercise to break the deadlock. Writers are willing to give their people an african History, complicated by colonialism. The study's goal is to show how this development is an urgency for the authors: in fact they try, through fiction, to find answers to the weakening of state structures and to ward off the specter of civil war initiated by the manipulation of the concept of "Ivoirité". The analysis focuses on the mental and cultural representations and we will go through the various literary categories, in order to summarize the way they induce a vision of History

This research analysed the use of interpretation services to address the communication challenges faced by Congolese asylum seekers at the refugee reception office in Cape Town. It examined the language challenges of Congolese asylum seekers, the role of the interpreters in addressing these challenges and the perceptions of refugees and home affairs officials about the quality of services provided by interpreters. It also discussed the implications for the outcome of Congolese applications for asylum. This project was framed around Bell and Reiss’s theories of translation and the general communication model. Community interpreting and interpreting studies complimented these theories because all of them focus on the intricacies of interpreting messages and the implications for meaning making, especially in the case of oral accounts. The research design was a case study and its unit of analysis was a company called Zeenab, Remy, Gerald, and Buba (ZRGB) Interpretation, Translation and Social Services, which has for years been the main provider of interpretation services to the department of home affairs in Cape Town. Since this project was a case study, it adopted a qualitative approach and used qualitative methods such as interviews, observations, focus group discussions and document analysis to collect data from respondents. These methods were suitable for this project because they provided unrestricted space for Congolese refugees and home affairs officials to express their views about the interpretation services and the implications thereof. All interviews took place in Cape Town between June and July 2016. The duration of interviews ranged from 25-65 minutes and the total number of respondents was 18. The researcher used a thematic analysis approach to organise, analyse and interpret the data collected from participants. This process involved coding, defining and naming and penetrating themes, searching for multiple meanings embedded in the data. After interpreting the data, this research revealed firstly that the main challenge of Congolese asylum seekers was to communicate their experiences consistently and accurately in English language. Secondly, asylum seekers blamed the rejection of their applications for asylum on the poor quality of interpretation services provided by ZRGB. Thirdly, asylum seekers had different impressions of the role of interpreters in the refugee determination process. In terms of scholarly contributions, this study hopes to shed light on the communication challenges that francophone asylum seekers and refugees face during the application and interviewing process. In addition, it can contribute to the existing body of knowledge on the politics of asylum and the acquisition of refugee identity in post-apartheid South Africa.

Le procès civil est le cadre traditionnel de réalisation de la justice des particuliers, et les règles qui le gouvernent se trouvent synthétisées dans les 24 premiers articles du CPC qui en énoncent les principes directeurs. Ces derniers organisent la répartition des charges processuelles entre les différents acteurs du procès, et déterminent ainsi l’essentiel de l’office du juge qui est construit autour du modèle contentieux du procès civil, taillé pour le juge du fond. Cependant, ce modèle subit des atténuations pour des raisons principalement d’équité ou de diligence, alors même que l’affaire qui est soumise au juge relève de la matière contentieuse. Dans la procédure gracieuse et dans celle de cassation, c’est la nature de la mission confiée au juge qui justifie parfois les atténuations apportées à ces principes, et parfois même leur effacement. Par ailleurs, l’action du juge à l’égard de ces principes directeurs va aussi dans le sens de leur adaptation aux évolutions juridiques et socio-économiques. Elle se traduit essentiellement d’une part, par une recherche d’effectivité de ces principes que le juge civil français n’hésite plus à rattacher à des normes supérieures, et d’autre part, par une recherche de leur efficience par le biais des techniques d’interprétation. Si dans le premier cas les phénomènes d’internationalisation et de constitutionnalisation du droit permettent d’expliquer une telle action, dans le second, se pose la question de la légitimité de la démarche. Notre pensée est que le juge d’aujourd’hui est aussi un juge gestionnaire dans un contexte d’accroissement de la demande de justice et de raréfaction des ressources allouées à la justice
Civil trial is the traditional framework where justice of individuals is usually delivered, and the rules which govern it are synthesized in the first 24 articles of the code of civil procedure which set out the guiding principles. The latter organize the sharing of procedural responsibilities between the different actors of the lawsuit, and determine the main part of the office of the judge built around the contentious model of the civil proceedings, cut for the ruling on the judges of the affairs. This model undergoes legal mitigations, mainly for reasons of equity or diligence, even though the case which is submitted to the judge is a matter of the contentious material. In the submission for an out-of-court settlement and that of the appeal to the supreme court, it is the nature of the mission entrusted to the judge who sometimes justifies the mitigations brought to these guiding principles, and sometimes even their disappearance. The action of the judge towards these principles also goes to the direction of their adaptation to evolutions so legal as Socio-Economic. It is essentially translated on the one hand, by a research for effectiveness of these principles which the judge does not hesitate to connect with superior standards, and on the other hand, by a research for their efficiency by means of the technique of interpretation. If in the first case the internationalization and constitutionnalisation explain such an action, the second case raises itself the question of the legitimacy of such an approach. Today’s judge is also a manager, especially in an increasing context of justice request and rarefaction of the resources assigned to the judicial administration

Une disposition du nouveau code de droit canonique, promulgue en 1983, confie aux eveques la mission de discerner les nouveaux dons de vie consacree, et rappelle que seul le siege apostolique peut approuver de nouvelles formes de vie consacree. L'enjeu de ce texte est important au moment ou les communautes nouvelles se multiplient. En france, et naissent a la vie juridique. Le recours aux regles d'interpretation fixees par le code de droit canonique, pour determiner le sens du canon 605, laisse apparaitre que le legislateur supreme de l'eglise catholique, en meme temps qu'il a elargi la notion de vie consacree, a cree un instrument de centralisation. Une enquete realisee aupres de tous les eveques de france, et de toutes les "communautes nouvelles" permet de constater qu'en dehors du phenomene de mixite, les communautes dites nouvelles sont hantees par le modele religieux. Le canon 605 du code de droit canonique ne sera "utile" que si le siege apostolique, face aux besoins nouveaux de l'eglise, admet la consecration d'hommes ou de femmes maries, et permet la creation de communautes regroupant des fideles appartenant a tous les etats de vie
A clause of the new code of canon law promulgated in 1983 entrusts to the bishop the mission of discerning new gifts of consecrated life, and recalls that the apostolic see alone may approve new forms of consecrated life. Important question are at stake here at a time when new communities are multiplying in france, and coming into being legally. The interpretation of canon 605 according to the rules laid down by the code of canon law shows that, while broadening the notion of consecrated life, the supreme legislator of the catholic church has created an implement of centralization. A survey carried out among all the bishops of france and all the "new communities" leads to the finding that aside from the phenomenon of mixity, these communities which are said to be new are haunted by old patterns, particularly that of religious life. Canon 605 of the code of canon law will be "of use"only if the apostolic see, confronted with the new needs of the church, admits the consecration of married men and women, and allows the establishment of communities made up faithful belonging to all states of life

This article discusses the relation between the orchestral conductor’s performanceand the musical interpretativetraditionshaving as case study the 5th Symphony by PyotrIlych Tchaikovsky. It is fundamented on thinkers as Castagna (2008) on the score editions, Silva & Silva (2009) on tradition in musical performance and Laboisiése (2007) on musical interpretation. As the methodology, it were investigated twelve editions of the score object of this study, twelve representative recordings thereof, among which, renowned conductors such as Claudio Abbado, Bernstein and Karajan, as well as prepared and presented by the author with the Youth Symphony Orchestra of the State of Goiás. The conclusions point that the tradition of musical performance can have a major influence on the conductor in contemporary times and therefore requires a reflection on the break or not paradigms established by the tradition of the art of orchestral conducting in canonical works.
O presente artigo discutea relação entre a performance do maestro na contemporaneidade e as tradições interpretativas musicais tendo como estudo de caso a 5ª. Toma-se como fundamentos teóricos os pensadoresCastagna (2008) sobre as edições de partitura, Silva & Silva (2009) sobre tradição na performance musical e Laboissiére (2007) sobre interpretação musical. Foram investigadasdoze ediçõesda partitura da obra objeto deste estudo, doze gravações representativas da mesma, dentre as quais, de renomados maestros como Claudio Abbado, Bernstein e Karajan, além de preparada e apresentada por esse autor junto à Orquestra Sinfônica Jovem do Estado de Goiás. Constatou-se quea tradição da performance musical pode ter uma grande influência sobre o maestro na contemporaneidade e, portanto, exige-se uma reflexão sobre a quebra ou não de paradigmas estabelecidos pela tradição da arte da regência nas obras canônicas orquestrais.

La litterature cubaine connait, depuis la revolution castriste de 1959, deux versants contradictoires. Les livres ecrits dans l'ile ont peu de choses a voir avec ce qui s'est fait a l'exterieur. La thematique, les formes d'ecriture, les objectifs sont radicalement differents. Guillermo cabrera infante, severo sarduy et reinaido arenas ont marque de leur empreinte l'ensemble de la creation litteraire en exil. Les prises de position politiques des uns et des autres, parfois ouvertement exprimees, parfois simplement insinuees, sont venues s'ajouter aux oeuvres de fiction, leur conferant un sens different. Dans la plupart de leurs ecrits, cependant, la litterature s'est maintenue intacte, fuyant l'engagement, dans une tentative de recuperation totale de la memoire des origines. Ce qui a ete perdu. La havane, la sensualite particuliere de l'ile, est devenu l'objet d'une quete permanente. Mais tous ont cru, au depart, aux possibilites offertes par la revolution. Ils ont adhere a certains de ses principes, ecrit des textes de soutien, participe a son evolution et a ses errements. Ce passe etait trop encombrant, vu a l'aune de leur evolution posterieure. C'est pourquoi le silence est venuse substituer a la critique d'eux-memes, en construisant une veritable dichotomie entre ce qui etait elabore a l'interieur de l'ile et ce qui est publie en exil. Ce travail pretend saisir, a travers les meandres des textes et des publications, les constantes, les particularites et les contradictions de ces trois ecrivains, dont la place dans la litterature cubaine, difficilement conquise, a ouvert la voie a d'autres expressions moins tragiques, moins tourmentees, davantage tournees vers le present que vers la memoire.

L’analyse des interactions entre la science et le droit dans les procédures d’établissement des faits est une thématique ancienne en droit international. Pourtant, la technicisation de la société et la complexification des connaissances scientifiques invitent à une relecture de cette question. La comparaison des différentes pratiques fait apparaître que les interactions entre le praticien du droit et les scientifiques en matière d’établissement des faits correspondent à un modèle de co-établissement des faits, et ce, quelle que soit la forme que prend la participation du scientifique en droit. Le praticien du droit et le scientifique combinent leurs compétences pour établir les faits. Leur coopération ne se limite pas à une procédure d’établissement des faits. Bien au contraire, dépassant les frontières d’une procédure, leurs échanges se répercutent dans les procédures d’établissement des faits créant ainsi une résonance du fait co-établi. Toutefois, l’existence d’une coopération entre eux n’exclut pas un contrôle de la connaissance ainsi forgée – contrôle nécessaire au maintien de l’identité de la pensée juridique. Il appartient alors au praticien du droit de vérifier la relevance du fait co-établi avant de l’intégrer à son établissement des faits
The analysis of interaction between science and international law in establishing facts is an ancient thematic and yet the societal technicization and the complexity of modern scientific knowledge lead us to study this question with a new and deeper reflection. The comparison of different practices revealed that interaction between scientists in fact-finding and the legal practitioners correspond to a model of co-establishment of the facts, and this, regardless of the form of the scientists’ participation. Their skills are combined to determine the existence of the fact in law. This cooperation is not limited to a fact-finding procedure. On the contrary, it goes beyond the borders of a procedure ; and their exchanges are reflected in procedures for establishing the facts thus creating a resonance of the co-established fact. Nonetheless, if the judicial system reveals itself to be a system open towards scientific knowledge, it organises its relationship with science so as to maintain its own identity. It is therefore up to the legal practitioner to verify the relevancy of the fact co-established before its integration into the establishment of facts

En matière d’interprétation juridique, le rôle du juge se déroule entre le fait et le droit. Le juge est chargé non seulement d’analyser et de déterminer les éléments factuels, mais il a aussi, pour objectif, d’exercer la qualification du fait et d’appliquer les règles de droit. C’est la raison pour laquelle l’interprétation juridique est en générale divisée en deux aspects : l’interprétation du fait et celle du droit (ou de la loi). L’interprétation du contrat participe, en principe, au premier aspect. Précisément, la loi, en tant que règle générale et abstraite, est l’expression de la volonté générale, alors que le contrat n’est que la traduction de plusieurs volontés particulières. Le projet de cette thèse cherche à analyser les problématiques provoquées par la théorie et la pratique de l’interprétation du contrat : dans quelle condition le juge peut-il exercer son pouvoir d’interprétation du contrat ? Interpréter un contrat, c’est interpréter la commune intention des parties ou plutôt interpréter un rapport contractuel intégré dans la vie sociale et économique ? L’interprétation du contrat peut-elle combler les lacunes du contrat ? Les règles d’ordre public peuvent-elles devenir le fondement de l’interprétation du contrat ? La correction du contenu du contrat a-t-elle besoin de participation de l’interprétation du contrat ? La recherche des problématiques exposées ci-dessus détermine, en effet, l’intérêt du projet de cette thèse. Théoriquement, le travail de thèse défie la définition traditionnelle de l’interprétation du contrat, en glosant de nouveau sur le sens et l’esprit des règles classiques d’interprétation, et en analysant le rôle des règles d’ordre public dans l’interprétation du contrat. In terms of the legal interpretation, the role of the judge takes place between the facts and the law. The judge is not only charged with analyzing and determining the factual elements, but he also aims to exercise the qualification of the fact and apply the rules of law. This is why legal interpretation is generally divided into two aspects, i.e. the interpretation of the fact and that of the law. The interpretation of the contract, in principle, belongs to the first aspect. More precisely, the law, as general and abstract rule, is the expression of the general will, while the contract is only a translation of several individual wills. This dissertation analyzes the issues aroused by the theory and practice of the interpretation of the contract: In what condition can the judge exercise his capacity of interpretation of the contract? Should the interpretation of the contract aim exclusively at the common intention of the parties or aim not only at the will of the contracting parties but also the internal and external objective elements of the contract? Can the interpretation of the contract fill in the lacunas of the contract? Can the rules of public order become the foundation of the interpretation of the contract? Does the correction of the content of the contract need the participation of the interpretation of the contract? The research of the above mentioned issues determines, in fact, the interest of the plan of this dissertation. Theoretically, the work of this dissertation challenges the traditional definition of the interpretation of the contract, by annotating again the sense and the spirit of the classic rules of interpretation, and analyzing the role of the rules of public order in the interpretation of the contract. In practice, the work of this dissertation is founded on a profound research of the functions of the interpretation of the contract in the judiciary activities

This research presents a reception analysis of LoveLife's 'HIV: face it' billboards by youth aged 12 - 17 years old, LoveLife's target audience for the campaign under scrutiny. The study sought to find out whether the intended audience derived the same meanings from the billboards as they were initially intended by LoveLife; whether the target youth regard themselves as audience of the communicated campaign; and to assess whether LoveLife billboard producers have succeeded in communicating the intended message to the readers of the billboards. To achieve this, the study adopted a qualitative method of data collection by conducting two focus group discussions. One focus group was selected from a rural school in KwaZulu Natal and another one from an urban school of the same province. Participants were all youth between the ages 12 - 17 years old. The circuit of culture was used as the theoretical framework. The circuit of culture is a composition of certain moments in the communication process namely: representation, identity, production, consumption and regulation [see diagram. 1]. For the purpose of this research only one moment of the circuit, namely representation was adopted. Representation is an essential part of the process through which meaning is produced and exchanged between members of a culture. It involves the use of language, signs and images that stand for or represent things. Findings from the study show that respondents assigned different meanings to LoveLife billboards. LoveLife's messages are not being decoded by the target audience in the initially intended manner. A majority of the respondents negotiated meaning in an attempt to understand what LoveLife is trying to communicate because the billboards' objectives are not straightforward. The study also found that urban dwellers identified more closely as audiences for the LoveLife billboards than rural dwellers.

The construction dispute is an ancient issue, probably since the time of Hammurabi Code or even earlier. Nowadays, these issues have increasingly been a common social phenomenon in public works, and contribute to a major portion to legal practice. Existing studies regarding public works disputes and claims have drawn on small-scale cases to the exclusion of other cases and few have met the requirements of statistical tests. This study performs an investigation of a total of 400 cases of civil litigation in which owners lost their disputes in Taiwan High Courts and branches between 1999 and 2008. Category analysis coding is used to construct a Log-linear model for judgment decisions; this model is augmented by Multiple Correspondence Analysis to reduce judicial opinions of over 4 million words to a two-dimensional figure, allowing for visual interpretation and identifying specific cases for qualitative examination. The primary findings were: (1)the Government Procurement Law has contribute to shortening litigation times; (2)professional engineering agencies are easily involved in lawsuits, (3)the judgment affirmed of the First Instance review of court houses in different regions are different; (4)the social science methods provide a new channel for construction disputes research.

This study was to evaluate the effectiveness of interpretation of volunteer interpreters of the Black-faced Spoonbill Conservation Association in Tainan County. Since interpretation is place-specific, semi-constructed interviews were used to establish “index of professional competence of volunteer interpreters in the Black-faced Spoonbill Conservation Association in Tainan County.” Based on the index, a questionnaire was later constructed with four sections to measure: the improvement of visitors’ knowledge after interpretation, the changes of visitors’ behavior, as well as levels of importance and satisfaction that visitors hold towards the volunteer interpreters, and raise of conservation behavior intention. At the third bird-watching pavilion in the Black-faced Spoonbill Conservation Area in Tainan County in February, 2006, 236 questionnaires were distributed before and after interpretation to determine changes in knowledge, attitudes and behavior of visitors. The findings were as following: (1) The visitors’ knowledge was significantly different before and after interpretation, and knowledge augmentative range is 19.6%. (2) Visitors’ behavior at the bird-watching pavilion might change after interpretation of the volunteers Interpreters. (3) IPA was applied on 16 items, four of which focusing on “professional knowledge” factors all fell in the second quadrant of “continue to keep”, indicating visitors’ approval of the professional knowledge of the volunteer interpreters. As to “interpretative skills”, the item “temperament and self-confidence of the interpreter” fell in the first quadrant of “strengthen an improvement”, while the items “interaction with visitors before interpretation” as well as “suitable wear of clothing and badge” fell in the fourth quadrant of “supplied excessiveness.” The other seven items fell in the third quadrant of “initiative sequence lower”. (4) Range of visitors’ knowledge gained and level of satisfaction that visitors have for the volunteer Interpreters (interpretive skills, professional knowledge) showed negative correlation, significantly. (5) Range of visitor's knowledge gained was significantly negatively correlated with conservation behavior intention (conservation concept, conservation behavior). (6) Level of satisfaction visitors hold toward the volunteer interpreters and conservation behavior intention showed significantly positive correlation. The research also proposed suggestions for the administration of Black-faced Spoonbill Conservation Area and Black-faced Spoonbill Conservation Area Association to provide as references for volunteer interpreters as well as promoting better recreation experiences and quality of interpretation for visitors.

Modern legal theory rests on a premise that in revealing a legal concept we are revealing reality. This traditional (Kantian) approach is reflected most acutely in legal positivism. The position of the legal positivist is that of law as constitutive of facts. The fact is our description of relations in the world. We should see immediately that in understanding the fact we should understand how this fact is presented to us. To comprehend the meaning of a fact we must understand the relation of language and reality. The question concerning the legal fact is the question of origin. It comes in response to the question "Why?" For there to be a legal fact there must already be an issue. It is understanding what is an issue and how we express this issue that is the mark of an "expert." An example of the positivist approach to legal reasoning is Ann Gardner [1987]. Gardner is confronted by Hart's positivism that we verify legal norms through legal language. That is to say, that the descriptions found in legal text are what verify our apperceptions of the legal real. She concludes that hard cases cannot be resolved in expert systems. If we accept Hart's premise then Gardner's conclusions are correct. This paper is to reject the positivist premise. This paper sets out legal language as an artifact of the legal institution. If language is an artifact, we must recognize that language is a product of the social world and not a means of representing the social world. From this, it is apparent that we must go beyond the language of the discourse not only to uncover the basis of legal norms but most especially to uncover a basis for building expert systems. This requires that we move from an epistemological basis for knowledge to an ontology of law. The thesis rests on two premises: first that we cannot represent knowledge in computerized legal databases useful for legal reasoning without a practical rationality, and secondly that modern legal jurisprudence, inter alia legal positivism and legal realism, has been unable to explain contradictions within the doctrinal discourse thus it is unable to provide a practical structure of rationality. We conclude that legal positivism cannot be the basis for expert systems in law. The paper is divided into two sections. The first section sets out a philosophical basis for legal understanding. This thinking will draw heavily on Wittgenstein, Heidegger and Merleau-Ponty. It is to put into perspective the conditions necessary for understanding to exist. We examine the social construction of reality. This will lead to a critique of the current mode of representational thinking and the reasoning within institutional practice. In the second section, we will consider the actual computational application of legal knowledge in connection with a "deep structured" approach to legal reasoning. Legal action brings to attention the transparency of human involvement with the world. It is then that we become aware of what we do. Our involvement is an issue. This "shock of recognition" is when meaning is revealed. This enables the Kantian concepts of intentionality and freedom which presuppose our involvement in the world. We will conclude that knowledge representation and expert systems require a sound practical foundation. Positivism proves an inadequate foundation in its attempts to capture the reality of the legal situation. We argue that if an expert system in law is to be of practical value, it must be based on a practical rationality. A theory of actions provides such a coherent basis upon which to develop models of reasoning within computer based systems.

This study focused on eldest siblings face of mother’s differential treatment of perception and interpretation, and the perception and interpretation of the meaning presented. The researcher observed the pair of the sister-sister and mother interaction at home for about seven months, and the siblings aged 12 years old (sixth grade) and 8 years ole (second grade). Through the eldest siblings views and positions to understand that the eldest siblings face of mother’s differential treatment of perception and interpretation. First, the results were discussed the eldest siblings face of mother’s differential treatment of perception and interpretation in 〝be deprived of the to choose〞, 〝position is not unfair〞, 〝breach of contract〞, 〝double standard of reward and punishment〞. On the other hand, the perception and interpretation were discussed in development, personal characteristics, the traditional view of value and family functioning. Second, the findings propose that mother interventioned to siblings conflicts was promoted the eldest siblings feelings unfair.

Abstract:
This dissertation constitutes a fresh interpretation of Exodus 34:29-35 and analyzes how the passage is used in both the Old and New Testaments. Chapter 1 is a historical overview of how this passage has been interpreted through the centuries. Chapter 2 provides an exegetical discussion of Exodus 32-34, which makes up the context of the passage in question. Chapter 3 argues that the primarily exegetical problem within this passage, the identification of the meaning of the verbal form of "qrn," is resolved by the recognition that it means "to shine" or "emanate light/rays" as opposed to "had horns" or other interpretations. The function of the entire phrase--"the skin of his face shone"--is fourfold: as a reminder or extension of Yhwh's presence at Sinai, to distinguish Moses in terms of status, to communicate Yhwh's "goodness," and to transition from the rebellion narrative in chapters 32-34 to the building of the tabernacle in 35-40. Knowing the function of the phrase sheds light on the concomitant matter of Moses' veil ("masweh"), which is more akin to a scarf than to a mask, and which functions simply to hide Moses' face when he is uninvolved with his role as mediator because his face was frightening and disturbing to the Israelites. The exegetical study in chapter 3 culminates in an explanation of the theology of Exodus 34:29-35, focusing on God's presence, glory, grace/compassion, and life/light. This thesis is developed in chapter 4, which shows that how certain OT passages highlight the image of a shining face as a theological metaphor for grace and compassion. Many later biblical texts (e.g., Num 6:24-27, portions of the Psalter and the book of Daniel) also echo this language in prayers and songs. In addition, idiomatic expressions about the "face" or the brightness of the face are found in some extrabiblical sources and ANE inscriptions, which confirm and validate the interpretation in chapter 3. Three further texts are examined with relation to the role of Sinai theophanies (1 Kgs 19), the "veiling" of God's presence in the future (Hab 3:1-4), and images of God's eschatological glory (Isa 60:1-5, 19-20). Chapter 5 applies the OT study to the NT, where special attention is given to three passages: the narrative of the transfiguration of Jesus in Matthew 17:1-8, Paul's statements in 2 Corinthians 3:7-18 about the old and new covenants, and the prologue to John's Gospel in John 1:1-18. Chapter 6 summarizes the study and concludes the work.

This exegesis combines theory and art practice to interrogate the idea that self-portraiture by women artists can be positioned, and interpreted, as a practice that strategically intervenes in the politics of representation, gender and identity. The focus of this study is the face. The represented female face is identified as a site that is both problematic and dynamic for women artists. The face involves two contradictory traditions of representation for women. It is generally used in portraiture and self-portraiture to indicate the presence of the individual, the 'subject'. However, the female face has more often been represented as a de-individualised site, the object. When a woman artist attempts to make a self-portrait she must, therefore, re-negotiate the relationship between object and subject in order to make room for her own representations of subjectivity. In this study I closely analyse how other women artists have employed their faces in their self-portraits. I also provide insights into my own practice of self-portraiture through the use of a commentary, which follows my thoughts and decisions throughout the art making process. I link the art works to theoretical debates concerning feminist art history, faciality and subjectivity. By inter-weaving praxis and theory in this way the study provides a new perspective on these debates.

This Master Degree Thesis compares Kožík's novels Na křídle větrného mlýna and Neklidné babí léto with the extant correspondence, which is used in different ways in both novels. The starting point was extensive research, which provided a precise undertanding of the author's intentions. The goal was to find out how the author forms the characters and their relationship using sources, especially the correspondence. At the same time this thesis delineates the difference between facts and fiction with an example of Kožík's novels.

This study investigated the relationship between student ratings of teaching and the mindfulness attributes of teaching assistants in freshmen courses consisting mostly of discussion. Regression analyses were run to determine whether teaching assistant data (n = 19), related to their teaching efficacy, trait mindfulness, mindfulness practices, self-compassion, and teacher concerns, were predictive of student ratings of teaching assistants' combined scores on three concatenated Likert-scale evaluation items--the teaching assistant is kind and respectful of me, is patient with my questions, and is receptive to my questions. As modeled, there was no significant relationship between these teaching assistant characteristics and the components that were examined. A subset of the population (n = 6), participated in follow-up interviews. A comparative and interpretative analysis of the interview data followed, which examined the teaching assistant narratives using the following variables as filters--teaching efficacy, trait mindfulness, mindfulness practices, self-compassion, and teacher concerns--in addition to the metacognitive constructs of Knowledge of Cognition and Regulation of Cognition. Overall, the interview component of the study found that teaching assistants who could better articulate their teaching processes and instructional goals reported purposefully engaging in the internal and external dialogic processes of instruction. Moreover, interview analysis suggests that teaching assistant evaluations were a poor means of assessing instructional skills, aptitude, or performance. In addition, while the tools used in this study, the Five Facet Mindfulness Questionnaire, the Mindfulness Process Questionnaire, the Self-Compassion, Scale, the Teacher's Sense of Efficacy, and the Teacher's Concerns Checklist, might reliably assess attributes of good instructors, they do not appear to capture the whole essence of one's instructional narrative. Whether it is through interviews, or intricate scenarios, instructional evaluation, especially when its purpose is to improve instruction, should have a qualitative and reflective component.

The thesis deals with one major issue of how the amaXhosa authors reflect change and transition in the lives of their characters in the period under consideration. This change pertains both to the socio-politico-economic life of the people concerned and the contents of the books and the style of the authors' writings. The study is ground-breaking in that it goes beyond common dissection of the structural elements of the books to a synthetic study of their themes, subject matter, character portrayal and setting. The primary aim is to give a holistic overview of the changing culture of the black people against the backdrop of subjugation and transformation. Chapter 1 contains all the formal preliminary information such as aim, method, context, relevance and topicality of study. Chapter 2 anchors the study in the newspaper age as a solid foundation for the amaXhosa literature. Chapter 3 is an overview of the beginnings of literary endeavours among the amaXhosa and how they reflect the impact of socio-economic pressures in the lives of the people. Chapter 4 further illustrates the impact of education and Christianisation on the blacks as well as growing political awareness among the authors. Chapter 5 focuses on culture-clash among the amaXhosa as a result of the alienating influence of both the church and the school. Chapter 6 highlights changes in society at the height of oppression under the previous political dispensation. Chapters 7 and 8 reflect the authors' thinking and how they depict changes in post-apartheid South Africa while Chapter 9 focuses on the role of Language Boards in restricting freedom of writing and expression during the apartheid years. Chapter 10 is a general conclusion that encapsulates the main points of the thesis.

Diese Masterarbeit handelt von Transzendenzmomenten angesichts des Anderen und nimmt damit Bezug auf einen der einflussreichsten Philosophen der Gegenwart, Emmanuel Levinas. Philosophiegeschichtlich bildet der linguistic turn den Kontext dieses Diskurses. So wird der Wandel im Denken, der mit dem linguistic turn einhergeht, anhand verschiedener philosophischer und theologischer Essays reflektiert und auf das Problem der Gewalt im Prozess des Erkennens hin zugespitzt. In Diskussion mit den Schriften Dietrich Bonhoeffers leistet diese Arbeit hinfort einen Beitrag zum systematisch-theologischen Diskurs über Gottesoffenbarung in zwischenmenschlichen Beziehungen und über Ethik. In Auseinandersetzung mit Levinas und Bonhoeffer baut diese Arbeit eine Brücke zwischen postmodernem, dekonstruktivistischem Denken und der fortwährenden theologischen Aufgabe, Gottes Sein mittels menschlicher Sprache Ausdruck zu verleihen.
This master thesis is about moments of transcendence in face of the other by means of one of the most important philosophers in our days, Emmanuel Levinas. The philosophically based historical context is represented by the term linguistic turn which marks a change of thinking within the 20th century. To outline this change the thesis brings several philosophical and theological essays up for discussion which leads to the problem of power in the process of recognition. Bringing up Dietrich Bonhoeffer’s writings, this research will make a contribution to the systematic-theological discourse about God revealing himself within relationships and about ethics. Furthermore it builds a bridge between postmodern anti-constructivist thinking and the continual theological task of using human language to explore God’s being.

Die bestaande drieledige genreklassifikasiesisteem maak nie voldoende voorsiening vir tekste waarin die grense tussen feit en fiksie opgehef word nie. Die toename van sodanige hibriede tekste noodsaak dus ‘n uitbreiding van tradisionele genrekategorieë tot ‘n vierde, naamlik dié van literêre niefiksie. Dié ondersoek poog om vrae rondom literêre niefiksie te beantwoord met verwysing na De plaag: het stille knagen van schrijvers, termieten en Zuid-Afrika (2001) van David van Reybrouck. Dié teks dokumenteer Van Reybrouck se ondersoek na die bewering dat Maurice Maeterlinck die termietnavorsing van Eugène Marais sonder erkenning oorgeneem het. Tydens sy navorsingsreis maak Van Reybrouck kennis met die verwikkeldhede van ‘n postapartheid Suid-Afrika en verwoord sy reiservaring met behulp van metafore uit die entomologie. Die resultaat is dat De plaag ‘n hibriede karakter vertoon wat versoenbaar is met die kriteria vir literêr-niefiksionele tekste.
This study attempts to explore the nature of literary nonfiction (the fourth genre). The existing tripartite classification system does not make adequate provision for texts where the borders between nonfiction and fiction are transcended. A marked increase in such texts therefore necessitates an expansion of the traditional genre categories to accommodate a fourth, namely that of literary nonfiction. De plaag: het stille knagen van schrijvers, termieten en Zuid-Afrika (2001) by David van Reybrouck will serve as point of departure to explore the genre of literary nonfiction. The said text documents Van Reybrouck’s investigation into the alleged plagiarism by Maeterlinck of Marais’ research on termites. Van Reybrouck’s travels expose him to the complexities of a post-apartheid South Africa, which he expresses by using metaphors derived from the field of entomology. The result of this process is that De plaag displays a hybrid character which complies with the criteria for literary nonfiction.
