Abstract:
Recently, there has been increasing recognition that the Responsibility to Protect principle (R2P) and refugee protection are inextricably linked and conceptually connected. The question remains, however, whether the link between the two protection frameworks can provide a basis for the protection of prima facie refugees fleeing mass atrocity crimes. This article identifies that prima facie refugees have the right to protection irrespective of where they arrive. It finds that the prima facie provision is one that exists under international refugee law and is highly relevant to the R2P principle. R2P facilitates a framework of prima facie protection, but it must include the political and legal norms of R2P and international refugee law. The article argues that expanding the idea of R2P and refugee protection as an interlinked agenda offers a protection-oriented framework to address the protection needs of prima facie refugees fleeing mass atrocity crimes.

Latar belakang dan tujuan: Terdapat dua peringkat perbicaraan kes jenayah syariah yang berkaitan dengan pemakaian darjah pembuktian iaitu pada akhir kes pendakwaan dan kes pembelaan. Peruntukan undang-undang yang tidak jelas berkaitan darjah pembuktian di akhir kes pendakwaan telah menyebabkan pemakaian darjah pembuktian yang tidak seragam. Kajian ini bertujuan untuk menganalisis pemakaian prima facie sebagai darjah pembuktian di akhir kes pendakwaan jenayah syariah. Selain itu, kajian ini juga cuba untuk mengenalpasti faktor-faktor yang mendorong kepada pemakaian prima facie bagi kes jenayah syariah di negara ini. Metodologi: Data diperolehi melalui bahan-bahan dokumentasi seperti statut perundangan, kes-kes yang dilaporkan dan yang tidak dilaporkan. Di samping itu, kajian ini telah menemubual enam orang pengamal undang-undang syariah yang berpengalaman luas yang terdiri daripada empat orang hakim syarie, seorang pendakwa syarie dan seorang peguam syarie bagi mendapatkan penjelasan dan pandangan. Data dan maklumat yang diperolehi dianalisis menerusi instrumen analisis kandungan secara kritis dan kritikal. Dapatan Kajian: Dapatan penulisan mendapati pemakaian prima facie bagi kes jenayah syariah adalah tidak sesuai dan kurang tepat. Ini kerana frasa prima facie tidak diperuntukkan dalam undang-undang dan hukum syarak. Sumbangan: Hasil kajian ini penting dalam memberikan penjelasan kepada pengamal undang-undang syariah supaya darjah pembuktian yang sesuai dengan prinsip syariah dapat di aplikasi pada akhir peringkat pendakwaan kes jenayah syariah bagi menggantikan pemakaian prima facie selaras dengan kehendak undang-undang dan roh prinsip jenayah syariah. ABSTRACT Background and Purpose: There are two stages in the trial of shariah criminal cases related to the application of the degree of evidence, namely at the end of the prosecution case and the defense case. There is an ambiguity in the provision of laws with regards to the burden of proof at the end of prosecution case. This paper aims to analyze the prima facie application of the degree of proof at the end of the prosecution case in the shariah criminal justice. Besides, this paper aims to identify the factors of the prima facie application in the shariah criminal cases in the country. Methodology: Data were obtained through documentation materials such as statutes, reported cases and unreported cases. Six experienced shariah law practitioners including four shariah judges, a shariah prosecutor and a shariah lawyer were interviewed to obtain their view and clarifications. The data were analyzed using a critical and analytical content analysis approach. Findings: The study found that prima facie used in the shariah criminal cases was inappropriate and inaccurate as the meaning of prima facie has never been clearly clarified by shariah law. Contributions: The findings of this study are useful in guiding shariah law practitioners so that a degree of proof that is in accordance with shariah principles can be applied at the end of the criminal prosecution stage to replace prima facie application in accordance with the legal requirements and the spirit of the principles of shariah criminal justice. Abstract:
A claim before the Syariah court aims to either attest one's right or interest over a particular matter or defend such interest against the claiming party. At this juncture, the onus of proof lies with the party initiating the claim. In the context of Syariah Criminal Law, a Syarie Prosecutor has the discretionary power to bring a criminal claim against the accused in cases pertaining to Syariah offences, be it criminal or matrimonial, should there exist a strong qarinah that successfully establishes a prima facie case. However, there has been a lack of guidelines in proving prima facie in cases relating to matrimonial offences. Therefore, this study examines the methods of establishing prima facie based on qarinah in matrimonial cases, particularly in cases decided by the Syariah Courts of Selangor. For data collection, the researchers employ qualitative methods through analysis of legal documents, case files from the Syariah Court, and its ratio decidendis. The findings of this study show that matrimonial offences are considered criminal offences under the Islamic Family Law (State of Selangor) Enactment 2003. Hence, a case is considered a strong establishment of qarinah, sufficient to indicate prima facie for matrimonial offences, enabling the Syarie Prosecutor to prosecute the accused. Despite that, the qarinah itself must reach the degree of confidence, or al-zan al-ghalib, and not at the level of assumption, doubt, and waham. The authors believe this study may open doors to further discussions on Islamic Family Law, specifically in proving a prima facie case for matrimonial offences. Sesuatu dakwaan yang dilakukan di Mahkamah Syariah, pada asasnya bertujuan untuk menuntut hak atau kepentingan terhadap sesuatu perkara, ataupun bertujuan mempertahankan kepentingan tersebut daripada pihak yang mempertikai. Beban pembuktian terhadap sesuatu pendakwaan terletak atas pihak yang mendakwa. Dalam konteks jenayah di Mahkamah Syariah, seorang Pendakwa Syarie boleh mendakwa Orang Kena Tuduh (OKT) dalam kes yang melibatkan jenayah syariah atau kesalahan matrimoni apabila wujud qarinah yang kuat (prima facie). Justeru, kajian ini bertujuan menganalisis pembuktian prima facie berdasarkan sabitan qarinah dalam kesalahan matrimoni di Mahkamah Syariah Selangor. Permasalahan kajian ialah tiada panduan bertulis bagi proses membuktikan kes prima facie dalam kesalahan matrimoni. Objektif kajian ialah menganalisis pembuktian prima facie dalam kesalahan matrimoni. Bagi tujuan pengumpulan data, pengkaji telah menggunakan kaedah kualitatif iaitu kaedah analisis dokumen, fail-fail Mahkamah Syariah serta alasan penghakiman. Dapatan kajian menunjukkan bahawa kesalahan matrimoni merupakan jenayah di bawah Enakmen Undang-undang Keluarga Islam (Negeri Selangor) 2003 (EUKIS 2003) yang tertulis sebagai kertas pertuduhan dan fakta kes dan menjadi sabitan qarinah yang kuat (prima facie) bagi seorang Pendakwa Syarie untuk mendakwa OKT. Kesimpulan kajian ialah qarinah dalam kertas pertuduhan dan fakta kes merupakan beban bukti ke atas Pendakwa Syarie untuk mewujudkan kes prima facie terhadap kesalahan OKT. Namun begitu, qarinah tersebut mesti mencapai tahap yang yakin atau al-zan al-ghalib, bukan pada tahap zan, syak dan waham. Kajian ini memberi implikasi kepada penerokaan ilmu Undang-undang Keluarga Islam khususnya dalam membuktikan kes prima facie terhadap kesalahan matrimoni selain daripada kes jenayah syariah.

Abstract:
This article explores Pontano’s funerary tempietto in Naples as a building in which inscribed text supplants the public functions normally accomplished through figural art. According special attention to the twelve sententiae which form the bulk of the exterior inscriptions – the facciate parlanti – the author highlights the uniqueness of placing a collection of ancient maxims on public display and demonstrates how Pontano’s printed gallery actively promotes dialogue with its visitors, embracing conversation, exchange and, ultimately, introspection as much as it celebrates the virtues of the deceased. While all of the sententiae draw from ancient literature and are consonant with Pontano’s moral treatises, only one, “know yourself” derives from the facade of a known building: the Temple of Apollo at Delphi. Combined with the chapel’s physical source in a Greek-styled freestanding cenotaph for Herodes Atticus’ wife, Anna Regilla, on the Via Appia, such a conceptual source from ancient Greek thought underscores the Greek, Socratic, Neoplatonic, conversational, and communicative contexts in which Pontano desired his tempietto to be read.

Abstract:
This paper argues for a dilemma: you can accept liberalism or immigration restrictions, but not both. More specifically, the standard arguments for restricting freedom of movement apply equally to textbook liberal freedoms, such as freedom of speech, religion, occupation and reproductive choice. We begin with a sketch of liberalism’s core principles and an argument for why freedom of movement is plausibly on a par with other liberal freedoms. Next we argue that, if a state’s right to self-determination grounds a prima facie right to restrict immigration, then it also grounds a prima facie right to restrict freedom of speech, religion, sexual choice and more. We then suggest that the social costs associated with freedom of immigration are also costs associated with occupational choice, speech and reproduction. Thus, a state’s interest in reducing these costs gives it prima facie justification to restrict not only immigration but also other core liberal freedoms. Moreover, we rebut the objection that, even if the standard arguments for a prima facie right to restrict immigration also support a prima facie right to restrict liberal freedoms generally, there are differences that render immigration restrictions – but not restrictions on speech, religion, etc. – justified all things considered. In closing, we suggest that the theoretical price of supporting immigration restrictions – viz., compromising a commitment to liberal principles – is too steep to pay.

A Revista do Instituto de Direito Constitucional e Cidadania (IDCC) apresenta, neste ato, seu v. 6, n. 2. Há três anos seguidos e ininterruptos, a revista é publicada semestralmente, embora sua origem seja bastante antiga, remontando às publicações realizadas ainda em 2005. O IDCC é fruto de um ideário academicamente elevado. Ao longo de quase 20 anos, constituiu-se em um privilegiado espaço de reflexões, estudos e debates acadêmicos inovadores. Nessa trajetória no tempo, merece destaque a realização de 41 cursos de Pós-Graduação Lato Sensu, 19 Congressos de abrangência nacional e 17 encontros científicos. Tudo isso gerou publicações de livros, revistas, anais e cadernos de resumos, ficando registrada, assim, boa parte do vasto trabalho realizado. Ao longo desses anos, o Instituto foi reunindo em seu entorno um número expressivo de destacados juristas do Brasil e do exterior, alguns dos quais com atuações marcantes da Pós-Graduação Stricto Sensu e na própria CAPES (área do Direito). Diante da imensa contribuição acadêmica recebida, o IDCC enaltece os seus Membros Honorários: Alberto de Paula Machado (OAB Nacional), Carlos Mário da Silva Velloso (STF), Dalmo de Abreu Dallari (USP), Flávio Pansieri (ABDConst), Francesco Rubino (Itália), Francisco Rezek (STF), Gonçalo de Melo Bandeira (Portugal), José Augusto Delgado (STJ), J. Desse modo, a revista tem recebido contribuições científicas importantes de pesquisadores de diversos estados da Federação e do Distrito Federal. O intercâmbio de conhecimentos e o diálogo com os mais variados núcleos de estudos e pesquisas contribuem para a democratização do conhecimento científico. Nesse contexto, as revistas científicas cumprem papel de extraordinária importância para disseminação do conhecimento científico produzido. Увага до інституту доказування з урахуванням обставини «prima facie» пов'язане з тією фундаментальною роллю, яку вона продовжує грати в міжнародному правосудді, така практика Європейського суду з прав людини направлена на справедливу організацію судової системи, коли законодавчо регламентовані і дотримувані на практиці гарантії пропорційні законним очікуванням суспільства. Le espressioni facciali svolgono un ruolo importante nelle interazioni sociali, comunicando informazioni sullo stato d’animo e le intenzioni di chi le esprime. La maggioranza della letteratura sulla percezione delle emozioni ha preso in esame i volti emotivi isolandoli dal contesto, assumendo che essi siano di per sé sufficienti a veicolare, in maniera non ambigua ed indipendente dal contesto, le manifestazioni emotive (Calder et al., 1996; Smith et al., 2005) . Tuttavia, nella vita reale è assai raro osservare espressioni emotive isolate da un contesto e molti studi recenti che coinvolgono partecipanti adulti indicano che il contesto nel quale le espressioni emotive sono inserite svolge un ruolo essenziale nella loro percezione (Aviezer et al., 2017; Wieser et al., 2014). In particolare, negli adulti, è stato mostrato come varie forme di contesti emotivi e sociali (ad esempio, emozioni espresse tramite gestualità corporee e scene visive, fattori sociali intrinseci o precedenti esperienze sociali) modulano il riconoscimento, la valutazione e l’elaborazione neurale delle espressioni facciali (Aviezer et al., 2017; Iidaka et al., 2010; Jack et al., 2012; Pickett et al., 2004; Righart & De Gelder, 2006). Alcuni studi suggeriscono che anche nei primi anni di vita i fattori contestuali svolgano un ruolo nella percezione delle emozioni (citazioni). Tuttavia, la ricerca in questo ambito è estremamente scarsa e prende in esame una gamma di contesti fortemente limitata e selettiva. Questa tesi di dottorato ha quindi l’obiettivo di fornire un quadro più completo sull’influenza del contesto nell’elaborazione delle espressioni facciali nel corso dello sviluppo, esaminando gli effetti di diversi contesti sulla percezione, e sul riconoscimento delle espressioni facciali nei bambini in età infantile prescolare e scolare. La prima parte di questa tesi prende in esame i segnali emotivi contestuali, verificando come la presenza di altre emozioni nel contesto possa modulare la percezione emotiva. I risultati mostrano che, in bambini di 12 mesi, sia i volti emotivi (Capitolo 1), sia le espressioni emotive cinematiche (Capitolo 2) presenti nel contesto influenzano la percezione delle emozioni, modulando il comportamento visivo e l’attività neurale dei bambini. La seconda parte della tesi si concentra sugli effetti contestuali suscitati da circostanze sociali nei bambini in età infantile, prescolare e scolare. I risultati mostrano che le situazioni contestuali di inclusione ed esclusione influenzano l’elaborazione neurale delle espressioni facciali negli infanti di 13 mesi (Capitolo 3), e il loro riconoscimento nei bambini di 5 anni, ma non nei bambini di 7 e 10 anni (Capitolo 4). La tesi nel suo complesso fornisce evidenze empiriche che dimostrano gli effetti contestuali generati da diverse situazioni emozionali e sociali (ad esempio, volti e azioni che esprimono una emozione nel contesto, inclusione ed esclusione sociale) in infanti e bambini, ed agiscano a diversi livelli dell’elaborazione delle espressioni emotive facciali (ad esempio, neurale e comportamentale). Inoltre, i risultati suggeriscono che questi effetti contestuali varino in funzione dell’età dei bambini(ad esempio, il Capitolo 4 mostra come gli effetti contestuali fossero presenti solo in bambini di 5 anni). Riassumendo, nelle prime fasi dello sviluppo il contesto sembra svolgere un ruolo chiave nella percezione delle espressioni facciali.
Facial expressions, by conveying information on individuals’ internal state and intentions, play an important role in social interactions. The idea that faces alone convey all the necessary information about the expresser’s emotional state in an unambiguous manner and independently of contextual factors was prevalent in the past decades (Calder et al., 1996; Smith et al., 2005) and drove the majority of literature on emotion perception to examine faces in isolation. Nonetheless, facial expressions are very rarely encountered in isolation in real life, and many recent adult studies indicate that the context in which they occur plays an essential part in their perception (for a review, see Aviezer et al., 2017; Wieser et al., 2014). Specifically, various forms of emotional and social context (e.g., emotional bodies or visual scenes, intrinsic social factors or past social experiences) were shown to have a significant influence on adults’ recognition, evaluation, and neural processing of facial expressions (Aviezer et al., 2017; Iidaka et al., 2010; Jack et al., 2012; Pickett et al., 2004; Righart & De Gelder, 2006). However, research investigating the influence of context on the processing of emotional faces in developmental populations is extremely scarce, and although it suggests that contextual effects are also present in infancy and childhood, only a small subset of contextual cues have been examined so far. Therefore, this doctoral dissertation aimed at providing a more comprehensive view of the influence of context on the processing of facial emotions at different developmental stages, by examining the effects of different contextual cues on the perception, neural processing and recognition of facial expressions in infants and children. The first part of this thesis focused on contextual emotional signals. Results indicated that the surrounding facial emotional context (Chapter 1) as well as emotional kinematics cues (Chapter 2) influenced 12-month-olds’ attention and neural processing of emotional faces. The second part focused on contextual effects elicited by social cues in infants and children. They showed that contextual cues of social inclusion and exclusion affected 13-months-old infants’ neural processing of emotional faces (Chapter 3) as well as 5-, but not 7- nor 10-years-olds’ recognition of facial expressions (Chapter 4). Altogether, this thesis provides evidence that contextual effects can be elicited by various types of emotional and social cues (i.e., surrounding emotional faces, emotional kinematics, social inclusion and exclusion) in infants and children, and affect different levels of the processing of emotional faces (i.e., neural and behavioral). In addition, it suggests that these contextual effects vary as a function of the developmental stage of the perceiver (e.g., contextual effects were present only in 5-year-olds in Chapter 4). Se ne esamina lo scostamento dal suo riferimento originario, la politica, attraverso un percorso cronologico e concettuale che parte dall'aristotelico zoon politikon per approdare al momento finale, ma non conclusivo, della democrazia rappresentativa, fatta oggi oggetto di critica per aver deviato dai suoi principi costitutivi. Al giudizio negativo che dall'istituzione democratica si estende all'intera politica quale forma costitutiva del potere è stato dato il nome generico di "antipolitica", scopo della tesi è quello di distinguere tra una sua, anche involontaria, "pars destruens" e una "pars construens" che ha invece lo scopo di richiamare la politica alla sua missione originaria di forma aggregativa interamente ed esclusivamente umana. La tesi termina con quello che non è soltanto un doveroso omaggio allo studioso Alessandro Biral, ma anche il recepimento e la condivisione di un approccio individuale al tema della politica che, se correttamente attuato, le consentirebbe di riappropriarsi della funzione educatrice assegnatale da Platone, e alla cosiddetta antipolitica di proporsi come valida alternativa alla sua versione corrotta e degenerata.

The epistemic justification has been a subject of investigation and analysis since the Ancient Greek time. Nowadays, this same subject has been object of deep study and attention in Epistemology. Thus, this paper focuses on the justification concept, as well on some of justification sources and the division between internal and external justification theories, the notion of “epistemic defeater”, the justification’s structural conditions and, last but not least, the understanding of the analysis of prima and ultima facie justification. The wider deepening of this research is connected with the prima facie and ultima facie justification critical investigation, visualizing how this terminology could be useful to understand the internalist/externalist debate.
A investigação e a análise relativa ao problema da justificação epistêmica são realizadas desde a Antiga Grécia, sendo a justificação um dos assuntos bem centrais no estudo da epistemologia contemporânea. Nesse sentido, este trabalho aborda inicialmente o conceito de justificação, algumas fontes de justificação para as crenças e algumas teorias da justificação epistêmica. Um pressuposto que deve ser levado em conta é que sempre a ideia de “justificação”, sobre a qual se trabalha aqui, é a de uma justificação falível. Posteriormente, a explanação aqui realizada se detém no estudo das condições estruturais da justificação, através da compreensão dos termos “prima facie” e “ultima facie”, bem como de “anulador epistêmico”. Esse relevante passo conduz para a análise propriamente dita da justificação epistêmica prima e ultima facie – que praticamente pode ser assinalada como a primeira sendo suscetível à anulação epistêmica, e a última com a suscetibilidade superada. O aprofundamento mais amplo desta pesquisa está relacionado a examinar criticamente alguns exemplos que aclaram o significado de ‘justificação prima facie’ e ‘justificação ultima facie’ na prática, compreendendo também como essa terminologia poderia ser vantajosa dentro do internalismo e do externalismo.

Abstract Capturing the reservoir heterogeneity is crucial for optimizing field development. Lang-Lebah field is a Miocene carbonate platform with approximately 5 sq.km. in size and over 1 km in height with a high degree of heterogeneity in both vertical and horizontal directions. In this study, we conducted a seismic-based characterization to capture reservoir heterogeneity and then ran sequential gaussian simulation with a data from wells to build a static model for field development purpose. The method mainly comprises of four steps. The first step is to establish a relationship between reservoir properties (such as facie and porosity) to elastic properties (such as P- and S-wave impedances) to build conditional probability. The second step is running pre-stack inversion to derive P- and S-wave impedances as inputs for the third step. The posterior probability of each facie is determined through Bayesian classification using inverted impedances and the derived conditional probability as inputs. The last step is employing sequential gaussian simulation to build a static model using derived posterior probability of each facie and porosity cube. The static model encapsulates heterogeneity in terms of carbonate facie and reservoir properties. The observed heterogeneity is highly consistent with the understanding of geological model of this carbonate platform. The result shows lateral heterogeneity in each zone of high energy facies (such as reef margin) at the windward flank of the platform and low energy facies (such as lake) at platform interior. Thus, this result was elaborated for geological concept beyond the using well data alone. The result also shows a vertical succession from different carbonate reservoir deposit regarding to accommodation as carbonate build-out to a typical carbonate platform build-up continue to carbonate build-in. In addition, flooding event or surfaces, which is part of reservoir barrier, was also identified and included in this static model. The details of this successful novel study lay a fundamental work process for battling the challenge of gigantic carbonate characterization for field development. Because of this sophisticated model, we can properly plan the sequence of production and producing well targeting based on the derived reservoir heterogeneity resulting in enabling several Tscf of reserves and minimizing development costs.

Abstract Objective/Scope Facies distribution in the static model of carbonate reservoirs provides a framework for the distribution the other petrophysical properties. Lower Shuaiba (LSH) reservoir model in Field WU is aiming to provide improved facies distribution to improve STOIIP calculation and well placement/count. Lower Shuaiba reservoir is characterised by 5 lithostratigraphic cycles with different facies and rock types. These facies are consistent in the lower zones, however they are more variable in the top layers 1A (in the oil window). This layer is dominated by skeletal packstones, skeletal wackestones and thin beds of Rudist floatstones/rudstones as characterised from core data. These facies are comparable in their log responses and therefore cannot be differentiated with logs alone. However, they have different properties (Por, Perm) which have a great impact on STOIIP and well placement. Moreover, the Rudist-rich rock type is interpreted as an imbibed layer which adds more complexity to the reservoir model. Methods, Procedures, Process Two model scenarios were built based on the different facies distribution methods: (1) core-based method, which is limited for few wells and assuming lateral continuity of rock types between the wells; (2) capillary-based method, which uses the Saturation height function to predict the facies. This method uses the idea that facies differ in their capillary entry-height and thus will have different saturation responses. Whenever possible, these were then compared with core data. Results, Observations, Conclusions This new capillary-based model improved the volume estimation compared with the layer-cake model because of the improved mapping of the imbibed Rudist facie. The model allows ranking the proposed wells based on their facies distribution to maximise well production and reduce early water breakthrough. It also explains the anomalies in saturation/production (caused by facies distribution) in some of the existing wells. The study found that the anomalous high peak resistivity is associated with the imbibed Rudist layer (confirmed by log and production test) and should be avoided while drilling the horizontal section. It also highlighted the important of continuous appraisal in the area to add control points for the facies model. Novel or Additive Information The paleo Free Water Level (FWL) for Lower Shuaiba formation was determined based on the best fit between a core-based (drainage) saturation-height models and Archie log saturation. The FWL could not be identified on pressure plot due to the large scatter of pressure points which is typical for this low permeability /low mobility reservoir. Other factors such as wettability heterogeneities, fluid fill history and hysteresis makes it difficult to define the oil gradient and hence FWL. This FWL and saturation height function (SHF) were then used to predict the rock types, based on best match iterations between saturation log and saturation calculated by SHF.
