Abstract:
The protection of witnesses forms part of the core mandate of the Court. It is a crucial aspect of pre-trial and trial proceedings. The Statute divides institutional responsibilities among different organs (i.e. OTP, Registry, and Chambers), without clearly defining their roles. This Chapter re-visits this relationship and focuses on witness protection as an aspect of governance of the Court. It introduces Court practices, such as risk assessment or the ICC initial response system. It argues that the Court should rely on a comprehensive inter-organ approach in relation to protective measures. It shows that the Court is in need of increased support and cooperation from States Parties and other external actors in order to improve its protective capacity, including relocation. Promoting domestic capacity in the field of protective measures may be a possible way of improvement, but it would require sufficient expertise and neutrality.

This chapter focuses on salient internal and external supports and challenges situated within a broader lifespan development framework for queer (e.g., queer, lesbian, gay, bisexual) emerging adults (EAs). The authors review indicators of, and disparities in, well-being, as well as the role of romantic and sexual partners, parents, family, and peer support in promoting healthy development. Challenges to positive development for queer EAs such as school harassment, lack of health-supporting education, and discriminatory laws and employment practices are reviewed alongside recent advances in rights. Research and practice recommendations for how to further improve educational and legal contexts to support the well-being of queer EAs are discussed. The developmentally situated and positive view of queer EA thriving taken in this chapter allows for the appraisal of experiences and opportunities to better support, and combat barriers to, healthy development for queer populations.

Abstract:
This chapter argues for greater reluctance to launch humanitarian military interventions, without appealing to any inherent value in sovereignty or autonomous political community. Instead, it appeals to the likely consequences of such intervention—both within the target country and for international relations. Miller considers four types of candidate for intervention: stable tyrannies, unstable tyrannies, popular secessions, and ongoing large-scale killing and displacement. Only in the last of these should we be disposed to support intervention according to Miller, since the likely consequences that plague the other three types are here less challenging. Stable tyrannies are usually maintained because the regime has engineered a wide base of support among elites. External overthrow thus risks unleashing violent conflict between divided groups. In unstable tyrannies internally-driven regime change is preferable. Finally, in popular secession external intervention can stoke Great Power worries about spheres of influence and inspire military build-up.

Abstract:
This book investigates the history of the Association of Southeast Asian Nations’ (ASEAN) stance on external intervention in regional affairs. It asks when has ASEAN state resistance to sovereignty challenges succeeded, and when have they failed? ASEAN’s history of (non)resistance is understood in terms of a realist theoretical logic, focusing on the relationship between an ASEAN ‘vanguard state’ and selected external powers. A ‘vanguard state’ is defined as an ASEAN state that comes to the fore of the Association when it has vital interests at stake that it wishes to pursue. Whilst a state’s interests may vary, vital interests relate to state survival and the preservation of state sovereignty. Once a vanguard state has come to prominence, it will perform two major functions, which reflect an external balancing logic. The vanguard state will actively seek out an external power whose interests align with its own, and will seek to portray a united ASEAN front in support of its interests. Using case study analysis and drawing on a large amount of previously unanalysed material, this book contends that when an ASEAN vanguard state has interests that converge with those of an external power, it has an active and substantial role in resisting sovereignty violation.

The article explores five parts of Cartesian thought that include individualism, internalism, rationalism, universalism, and human exceptionalism demonstrating the philosophical and psychological theories of rationality. Ecological rationality comes about through the coadaptation of minds and their environments. The internal bounds comprising the capacities of the cognitive system can be shaped by evolution, learning, or development to take advantage of the structure of the external environment. The external bounds, comprising the structure of information available in the environment, can be shaped by the effects of minds making decisions in the world, including most notably in humans the process of cultural evolution. The internal constraints on decision-making including limited computational power and limited memory in the organism and the external ones include limited time push toward simple cognitive mechanisms for making decisions quickly and without much information. Human exceptionalism is one of the strands of Residual Cartesianism that puts the greatest focus on language and symbolic reasoning as the basis for human rationality. The invention of symbolic systems exhibits how humans deliberately and creatively alter their environments to enhance learning and memory and to support reasoning. Nonhuman animals also alter their environments in ways that support adaptive behavior. Stigmergy, an important mechanism for swarm intelligence, is the product of interactions among multiple agents and their environments. It is enhanced through cumulative modification, of the environment by individuals.

Abstract:
This chapter analyzes over-compliance in Brazil’s introduction of pharmaceutical patents in the 1990s. Extensive legislative deliberation and societal mobilization delayed and diluted this outcome, but could not prevent it. Brazil’s national pharmaceutical sector was able to tap into a network of social movements around the environmental and ethical dimensions of patenting to resist over-compliance. Yet, ultimately, the Executive secured over-compliance by using the country’s vulnerability to trade sanctions to mobilize exporters in support of this campaign. Comparative perspective reveals the conditional importance of external pressures and Executive preferences. Like Argentina, Brazil was subject to threats of trade sanctions and considerable intervention by the United States, and by mid-1990s both countries had Presidents that were committed to satisfying these external demands. What sets Brazil apart, however, was a different social structure that allowed the Executive and its societal allies to use these external pressures to build a broad coalition for over-compliance.

Abstract:
This chapter focuses on the European Court of Justice (ECJ). Like any court, the ECJ has faced constraints in its external context, including constraints imposed by national governments and national courts. But overall, the ECJ has benefitted from a remarkably benign external environment. The ECJ has found much support from key actors including national governments, national courts, and members of the European legal field. In recent years the ECJ faces contextual challenges in its relationship with member governments, national courts, and the European legal field. New member governments with fragile democracies and questionable commitments to the rule of law may increasingly test the extent to which they can defy or evade EU law without incurring a robust response. Moreover, the growth and diversification of the European legal field and the encroachment of EU law on increasingly sensitive policy areas is likely to provoke more intense criticism of the Court.
