Abstract:
Arbitral awards are easier to enforce across borders than court judgments, through the New York Convention, and this is one of arbitration’s key advantages compared to court litigation. In the European Union, however, this comparative advantage has been lost since the Brussels I Regulation Recast provides for the enforcement of judgments throughout the Union without the need for a local exequatur, whilst arbitral awards still require enforcement proceedings in each country. This article submits that arbitration must catch up and proposes a limited amendment to the recast Regulation, providing that arbitral awards issued in the European Union are capable of enforcement throughout the Union on the basis of a single exequatur in the jurisdiction of the seat. Resumen: En el Auto del TSJ de Murcia de 12 de abril de 2019 se acuerda conceder al exequatur en España de un laudo arbitral dictado en Colombia, solicitado por la parte demandante Productos Florida, S.A. Los motivos de denegación del exequatur que son alegados por la parte demandada, AMC JUICES, S.L y que son objeto de análisis son: a) Sentencia arbitral no obligatoria para las partes o que ha sido anulada o suspendida por una autoridad competente del país en que, o conforme a cuya Ley, ha sido dictada esa sentencia (art. V.1.e) Convenio de Nueva York de 1958); b) Reconocimiento o ejecución del laudo arbitral contrarios al orden público del Estado requerido (art. V.2.b) Convenio de Nueva York de 1958). En definitiva, la postura de los tribunales españoles en relación con el Convenio de Nueva York de 10 de junio de 1958 sobre el reconocimiento y ejecución de las sentencias arbitrales extranjeras, es la de favorecer el reconocimiento y ejecución de laudos arbitrales, de manera que sólo rechazan el exequatur de un laudo arbitral por motivos muy claros y evidentes.Palabras clave: laudos arbitrales extranjeros, convenios arbitrales, reconocimiento y ejecución, exequatur, Convenio de Nueva York de 1958, Ley española de Arbitraje de 2003. Abstract:
In most cases, an arbitral award rendered by a competent arbitration tribunal will be voluntarily performed by the parties to the dispute. Notwithstanding, if the debtor fails to fulfil his obligations mentioned in the award, the creditor has a right of action to bring this certain award before a foreign court in order to file a petition for the recognition and enforcement. The foreign court, after examining the award and attached evidences, can recognize and enforce the mentioned award provided that it does not exceed the limitation time described in the current applicable law of the enforcing country. Nonetheless, pursuant to United States’ laws, the creditor has an additional right of action, namely the right to petition for a "double exequatur". In the nature of the "double exequatur", the creditor will first request the court residing at the arbitral locality to recognize the effectiveness of the arbitral award. He will then bring the decision of this court before a respective court of another country in order to seek an exequatur. The case of See transport versus Navimpex, admired as a distinguished feature of the "double exequatur", has been the eminent and typical example of the United States' jurisdiction in this field.

The most important amendments to the Brussels I Regulation adopted on 12 December 2012 are presented and discussed. The amendments concern: 1) arbitration, 2) external situations, 3) choice-of-court agreements, and 4) abolition of exequatur. Compared to the Commission's ambitions, only modest, but probably useful compromises were achieved in respect of arbitration and external situations. For exclusive choice-of-court agreements, an efficient and sophisticated provision based on the Commission's ideas was adopted, and the Commission's primary goal, to abolish exequatur, was also successfully achieved.

La modificación de sentencias dictadas en países extranjeros sigue siendo una cuestión que no está definitivamente resuelta por nuestros tribunales. Hay dos cuestiones problemáticas. La primera de ellas es la duda acerca de la necesidad de solicitud de exequatur previo a la modificación de las medidas recogidas en una sentencia extranjera. La segunda es la falta de aplicación de las normas de competencia judicial internacional y su sustitución por normas de competencia judicial interna. Este auto muestra otra confusión que es otorgar la competencia para modificar las medidas de una sentencia extranjera al juez que dictó el exequatur.

While the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards has applied in Romania since 1961, domestic courts conduct the exequatur procedure almost exclusively under applicable Romanian law, namely Law 105/992. A party seeking the recognition and enforcement of a foreign arbitral award in Romania should thus rely on the New York Convention, but should be equally prepared to follow the more specific procedural steps of Law 105/1992. This article sketches a roadmap through the exequatur procedure in Romania, by looking into the domestic legal framework and the local courts’ practice, and by comparing the provisions of the New York Convention with their counterparts in Romanian law.

Resumen: Exequatur de una sentencia de Conaky República de Guinea, en la que los padres renuncian a la patria potestad de su hija menor, con objeto de que, al reconocerla en España, sus tíos, que viven en España, ejerzan la tutela respecto a la niña que vive en Barcelona. En primera instancia, se deniega porque se estima contraria al ordenamiento jurídico español, que no reconoce la posibilidad de renunciar, por parte de los progenitores, a su patria potestad. Por su parte, la Audiencia provincial de Barcelona estima parcialmente el recurso y considera que debe reconocerse, por no considerarla contraria al orden público español. Abstract:
Arbitration is a method of resolving civil disputes other than in a general court based on an arbitration agreement and made in writing by the disputing parties. For international arbitral awards, there are several requirements that must be met before the decision can be applied for execution and obtain an exequatur in Indonesia, one of which is that the decision does not conflict with public order. However, in several court decisions in Indonesia, this requirement became one of the judges' arguments against the implementation of the decision. The questions in this study are (i) what are the judges' considerations in rejecting the application for the exequatur of an international arbitral award? And (ii) what are the legal implications governing the implementation of international arbitral awards in realizing fair legal certainty? The research method used is the socio-legal method. The results show that the judge's legal considerations regarding what is meant by “public order” among judges also vary. In addition, several articles in Law no. 30 of 1999 is the base of uncertainty regarding the implementation of the international arbitration award in Indonesia which has implications for the collapse of legal certainty in the implementation of the international arbitration award.

Resumen: El artículo 10.1 de la Ley 14/2006 establece la nulidad de los contratos de gestación por sustitución en España. La Instrucción de la DGRN de 5 de octubre de 2010 diseña un mecanismo para recibir resoluciones extranjeras que establezcan filiaciones mediante gestación por sustitución en un registro civil consular. La instrucción exige que la filiación venga determinada por una sentencia judi­cial. The Rule requires that the filiation will be determined by a court ruling. ABSTRACT: The paper discusses the possibility of recognition and enforcement in Brazil through rogatory letter of interim relief granted by foreign arbitrators and arbitral tribunals. As such, it analyses the historical evolution of rogatory letters focusing mainly on the possibility to grant exequatur to those providing for executory measures. The paper then addresses the changes brought forth by the recent amendment to Brazil’s Code of Civil Procedure. Coming to arbitration, it analyses if the concepts previously established are compatible with arbitration. At last, the paper concludes that interim relief granted abroad by arbitral tribunals are enforceable in Brazil by means of rogatory letters.

The negotiations are likely to end during the second half of 2012. The Commission focuses on four subjects. The results of the Kluwer Research showed that, despite Paris being one of the most popular arbitration seats, French courts were the least likely to recognize and enforce an arbitral award, but also those with the highest number of vacated arbitral awards. The article analyses these results and offers some possible justifications for them. Concerning the enforcement and recognition procedures, the study only included reasoned decisions. The specificities of the French procedure however result in most of the decisions not being reasoned (the exequatur procedure is an ex parte procedure, only orders refusing the enforcement are reasoned) and the decision of the Court of Appeal dismissing an application to set aside an award (for awards rendered in France) has the effect of automatically enforcing the award. Therefore, analysing only reasoned decisions is not representative of the French courts’ approach. The article also analyses the grounds invoked by the claimants and their respective success rates, especially in comparison with other jurisdictions. Concerning the annulment procedures, France ranks as the country with the highest number of vacated awards. Indeed, while reviewing the number of annulment actions initiated in recent years before the Paris Court of Appeal, we concluded that the number of actions has doubled, with around 25% of successful annulment actions. As to the grounds for annulment relied upon by the claimants and their respective rates of success, the Kluwer Research revealed that the most relied upon grounds in France (authority not in accordance with the law and violation of public policy) were also the most successful ones. The concept of public order is ambiguous and difficult to determine its exact scope, and its content varies according to the circumstances of each time and place. Thus, what is considered public order in one country is not considered so in another, this is according to the economic, political and social variants. This system is considered as a restriction to the exequatur of foreign decisions in case they violate the public order prevailing in the country of implementation. In any case, the public order differs its role between internal private relations and international private relations; where based in the first, to ensure that there is no voluntary deviation from the provisions of jus cogens in the judge's country, while in international private relations, it is used to exclude the implementation of decisions issued by various foreign courts before the judge's state. When nationals have recourse to foreign jurisdiction or arbitration outside the country of enforcement, this is due to the presence of a foreign element and the exequatur to the foreign judgment was rejected in the executive form. Hence the importance of public order to consider it as an objective condition for the enforcement of foreign judgments, which is automatically raised by the enforcement judge. Or encourage the parties to defend their interests to the conflict. The purpose of this study is to clarify the ambiguity and limitations of public order, and try to mitigate them, by finding effective ways to preserve the rights of individuals established or have been decided by a foreign decision, by answering the following problem: Is it palatable to find a unified concept of public order regardless of the various texts and references of the issuing country of the decision in relation to the country of implementation of this foreign decision?.

Despite the fact that the abolition of exequatur seems to have become the norm under the EU regulations dealing with monetary claims, all of the regulations that fall under this category still preserve some grounds for refusal of enforcement of judgments. One of the refusal grounds which remained, even in the regulations which otherwise abolished all possibility of refusal, is the ground of irreconcilability with another judgment. Despite its importance, this refusal ground can sometimes still be quite complex to interpret. This paper thus analyses the notion of ‘irreconcilable judgments’, clarifying the remaining difficulties in interpretation. Moreover, it compares the diverging solutions offered in different regulations, and ultimately proposes a potential reform.

The article is aimed at researching and evaluating compliance with the conditions for exercising procedural rights accessibility by foreign persons when issuing an exequatur by commercial court. By analyzing procedural legislation norms and practice, it was revealed that judicial communication peculiarities caused by the language barrier can lead to negative procedural consequences in the form of access to justice guarantees. The author proposes to organize the technical possibility of switching to viewing the Russian e-justice Internet pages in a foreign language. The article also substantiates the need to reimburse expenses for the interpreter services who was not involved in the case, while assisting a foreign person in exercising procedural rights outside the trial, but in connection with it. Similarly, it is proposed to reimburse the expenses of an attorney with knowledge of a foreign language, who performs the functions of an out-of-court interpreter.

The communitarisation of judicial cooperation in civil matters by the Treaty of Amsterdam marks a new epoch in the unification of law in Europe. The European law of conflict of jurisdictions is affected by this, too. On 1 March 2002 Council Regulation (EC) No. 44/2001 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters entered into force, thus replacing the European Convention of 27 September 1968 (the so-called Brussels Convention). However, the “re-enactment” of the Brussels Convention as a Community regulation is only the first move towards a profound change in the European law system of recognition, a change aimed at the abolition of the exequatur. In accordance with the principle of mutual recognition the objective is to create “freedom of movement for judgments” between the EU Member States (I). First this paper presents the procedure of recognition and enforcement of foreign judgments under the Brussels Convention as well as the modifications introduced by the new regulation (II), focussing on the catalogue of defences to recognition in article 27 of the Brussels Convention, which until now have had to be controlled ex officio by the judge responsible for the recognition of proceedings. Under the new regulation the test of defences to recognition is no longer applied ex officio but shifts to the appellate procedure (articles 43 and 45; III). The paper concentrates on the consequences of the new regulation for the equity of the procedure. Therefore problems resulting from the intended abolition of the exequatur are discussed (IV). Central features of the analysis are the ensuing curtailment of judicial review (and thus of legal protection) and the abolition of the ordre public test. The concludes that the latter cannot be given up as ultima ratio as long as there remain differences between procedural (and hence constitutional) standards in the EU member states, i.e. as long as there is no truly European judicial area (cf. Article 61 EC Treaty; V).

Serbian courts do not allow appeal on the points of law (as an extraordinary legal remedy) in the procedure for recognition of foreign judgments. The authors aim to examine the validity of this understanding by critically considering it from the perspective of regulations governing the issues of private international law, non-litigious procedure and civil procedure. In addition, the paper examines whether such a solution corresponds to a broader regulatory framework that includes constitutional and international norms, the purpose of applicable institutes, as well as the need to ensure full legal protection and facilitate international business transactions. The authors conclude that there are no legal obstacles to appeal on the points of law in the exequatur procedure, and that its admissibility would contribute to the improvement of international economic traffic and legal certainty.

El auto del TSJ de Madrid de 5 de mayo de 2022 permite estudiar diversos aspectos clave para otorgar o denegar el reconocimiento del laudo arbitral. El hecho de que la parte demandada se ausente tanto del procedimiento arbitral como del exequatur podría parecer que reviste importancia para activar el orden público internacional, pero, ¿realmente importa? Tal vez aquello que inclina la balanza en favor de la denegación es la posición que se le atribuye a la demandada y no su presencia, o existan otras causas. Por ello, hay que tener muy claro cuáles son las leyes aplicables a este procedimiento, qué lo diferencia de otros similares y qué debe contener el laudo para que el orden público internacional haga su aparición o no. Y todo ello se estudia en este trabajo.
