Abstract:
Arbitral awards are easier to enforce across borders than court judgments, through the New York Convention, and this is one of arbitration’s key advantages compared to court litigation. In the European Union, however, this comparative advantage has been lost since the Brussels I Regulation Recast provides for the enforcement of judgments throughout the Union without the need for a local exequatur, whilst arbitral awards still require enforcement proceedings in each country. This article submits that arbitration must catch up and proposes a limited amendment to the recast Regulation, providing that arbitral awards issued in the European Union are capable of enforcement throughout the Union on the basis of a single exequatur in the jurisdiction of the seat. Resumen: El Auto de la Audiencia Provincial de Madrid de 9 de marzo de 2018 aborda en sede de exequatur el intenso debate que existente sobre la delimitación de competencias entre los Juzgados de Primera Instancia y los Juzgados de lo Mercantil. Resumen: En el Auto del TSJ de Murcia de 12 de abril de 2019 se acuerda conceder al exequatur en España de un laudo arbitral dictado en Colombia, solicitado por la parte demandante Productos Florida, S.A. Los motivos de denegación del exequatur que son alegados por la parte demandada, AMC JUICES, S.L y que son objeto de análisis son: a) Sentencia arbitral no obligatoria para las partes o que ha sido anulada o suspendida por una autoridad competente del país en que, o conforme a cuya Ley, ha sido dictada esa sentencia (art. V.1.e) Convenio de Nueva York de 1958); b) Reconocimiento o ejecución del laudo arbitral contrarios al orden público del Estado requerido (art. V.2.b) Convenio de Nueva York de 1958). En definitiva, la postura de los tribunales españoles en relación con el Convenio de Nueva York de 10 de junio de 1958 sobre el reconocimiento y ejecución de las sentencias arbitrales extranjeras, es la de favorecer el reconocimiento y ejecución de laudos arbitrales, de manera que sólo rechazan el exequatur de un laudo arbitral por motivos muy claros y evidentes.Palabras clave: laudos arbitrales extranjeros, convenios arbitrales, reconocimiento y ejecución, exequatur, Convenio de Nueva York de 1958, Ley española de Arbitraje de 2003. Abstract:
In most cases, an arbitral award rendered by a competent arbitration tribunal will be voluntarily performed by the parties to the dispute. Notwithstanding, if the debtor fails to fulfil his obligations mentioned in the award, the creditor has a right of action to bring this certain award before a foreign court in order to file a petition for the recognition and enforcement. The foreign court, after examining the award and attached evidences, can recognize and enforce the mentioned award provided that it does not exceed the limitation time described in the current applicable law of the enforcing country. Nonetheless, pursuant to United States’ laws, the creditor has an additional right of action, namely the right to petition for a "double exequatur". In the nature of the "double exequatur", the creditor will first request the court residing at the arbitral locality to recognize the effectiveness of the arbitral award. He will then bring the decision of this court before a respective court of another country in order to seek an exequatur. The case of See transport versus Navimpex, admired as a distinguished feature of the "double exequatur", has been the eminent and typical example of the United States' jurisdiction in this field.

Abstract:
The most important amendments to the Brussels I Regulation adopted on 12 December 2012 are presented and discussed. The amendments concern: 1) arbitration, 2) external situations, 3) choice-of-court agreements, and 4) abolition of exequatur. Compared to the Commission's ambitions, only modest, but probably useful compromises were achieved in respect of arbitration and external situations. For exclusive choice-of-court agreements, an efficient and sophisticated provision based on the Commission's ideas was adopted, and the Commission's primary goal, to abolish exequatur, was also successfully achieved.

La modificación de sentencias dictadas en países extranjeros sigue siendo una cuestión que no está definitivamente resuelta por nuestros tribunales. Hay dos cuestiones problemáticas. La primera de ellas es la duda acerca de la necesidad de solicitud de exequatur previo a la modificación de las medidas recogidas en una sentencia extranjera. La segunda es la falta de aplicación de las normas de competencia judicial internacional y su sustitución por normas de competencia judicial interna. Este auto muestra otra confusión que es otorgar la competencia para modificar las medidas de una sentencia extranjera al juez que dictó el exequatur.

S’interroger sur la distinction entre le recours en annulation et exequatur, c'est poser la question du régime juridique applicable à chacun de ces mécanismes de contrôle de la sentence arbitrale. Ces derniers paraissent, par hypothèse, différenciés puisqu’ils relèvent de deux catégories de procédures que le droit français ne confond pas : les voies de recours et l’exequatur. L’application des règles du droit processuel français commande donc en principe de ne pas confondre le recours en annulation, qui est une voie de recours, avec l’exequatur. Or, s’il est bien une notion qui innerve tous les pans du droit français de l’arbitrage international, c’est celle d’« autonomie ». Il en résulte que malgré la référence expresse à des notions bien connues du droit commun - i.e 1’exequatur et la voie de recours pour le recours en annulation -, celles-ci paraissent recevoir une acception spéciale en droit français de l’arbitrage international. Gommant les différences qui séparent traditionnellement les voies de recours de l’exequatur, le droit français de l’arbitrage international semble à bien des égards confondre le recours en annulation et l’exequatur. Émerge ainsi l’idée que les sentences arbitrales font l’objet d’une procédure de contrôle unique. Une confusion certaine entre le recours en annulation et l’exequatur existe en droit français de l'arbitrage international, elle est à l’origine de nombreuses incertitudes. Pour remédier à ce constat, l’étude propose l’application aux sentences arbitrales des règles du droit commun, relatives aux voies de recours et à l’exequatur
Questioning the distinction between action for annulment and exequatur raises the question of the legal regime applicable to each of these mechanisms for reviewing arbitral awards. By their very nature, these mechanisms appear to be distinct given that they fall into two categories of procedures that French law does not conflate: « voies de recours » (judicial remedies) and exequatur. The application of the rules of French procedural law therefore requires, in principle, to distinguish between the action for annulment, which is a « voie de recours », and exequatur. However, if there is one notion that underlies all aspects of French international arbitration law, it is that of “autonomy”. The result is that, despite the express reference to well-known notions of French procedural law- i.e., exequatur and « voie de recours »- a special meaning appears to be ascribed to those notions under French international arbitration law. By erasing the differences which traditionally separate the « voies de recours » from exequatur, French international arbitration law seems in many respects to conflate the action for annulment and exequatur. Thus emerges the idea that arbitral awards are subject to a single review procedure. This confusion is at the origin of numerous uncertainties. To overcome this situation, the study proposes to apply the rules of French law relating to « voies de recours » and exequatur, to arbitral awards

Analizuojamas ES valstybių narių teismu jurisdikcijos nustatymo reglamentavimas, taip pat teismu sprendimu pripažinimo bei vykdymo taisyklės. Aptariami atvejai, kuomet teismu sprendimai pripažįstami bei vykdomi be exequatur procedūros. Dėmesys skiriamas ir centrinių institucijų bendradarbiavimo klausimu analizei. Darbe nagrinėjamos Briuselio IIa Reglamento galiojimo laike, erdvėje ir asmenų atžvilgiu problemos, kadangi jų tinkamai neįvertinus galimi netinkami šio ES teisės akto taikymo atvejai. Pabrėžiama, jog Briuselio IIa Reglamento netaikomas Danijai. Analizuojama Briuselio IIa Reglamento įtaka Lietuvos civiliniam procesui, akcentuojant, jog Briuselio IIa Reglamentas sudaro realias galimybes tam tikrus ES valstybių narių teismų sprendimus pripažinti vykdytinais ir juos vykdyti Lietuvoje be exequatur procedūros. Aptariamas Briuselio IIa Reglamento ir LR CPK juridinės galios klausimas.
In Master‘s thesis “The Council Regulation (EC) No. 2201/2003 concerning jurisdiction and the recognition and enforcement judgements in matrimonial matters and the matters of paternal responsibilities, repealing Regulation (EC) No. 1347/200, and its influence to Lithuanian civil procedure“ the reasons of the enactment of this EU legal act, its purposes, the scope of regulation and its influence to Lithuanian civil procedure is analyzed. The reglamentation of jurisdiction of EU member states courts, as well as the rules of the courts decisions recognition and enforcement are analyzed. Specified issues, when the courts‘ decisions are recognized and enforced without exequatur procedure. Some attention is put on the analysis of the cooperation of the central institutions. In the thesis the problems of the application of the Regulation to the persons, its validity in time and space are analyzed, because the ascertation of these questions is important for proper application of this Regulation. It is emphasized, that the Regulation is not applied to Denmark. The influence of Brussels’ IIbis Regulation to Lithuanian civil procedure is analyzed, emphasizing that Brussels’ IIbis Regulation constitute real opportunities some EU members states decisions recognize and enforce in Lithuania without exequatur procedure. The question of legal power of Brussels’ IIbis Regulation and Lithuanian code of the civil procedure is analyzed.

La presente tesis de investigación titulada “El principio de reciprocidad negativa y la afectación de derechos en el proceso de exequatur”, tiene como objeto determinar el grado de afectación que ocasionaría la aplicación del principio de reciprocidad en el exequatur. Por ello se ha estructurado de la siguiente manera: en el primer capítulo se definirá al exequatur y se dará a conocer los tipos de efectos que surtirá este procedimiento judicial al reconocer alguna sentencia extranjera; en el segundo capítulo, se precisara en que consiste el principio de la reciprocidad positiva y negativa, y la diferencia de ambas; y por último, en el tercer capítulo, se establecerá una propuesta normativa con el fin de que el artículo 2103 del Código Civil peruano, en la cual establece el principio de la reciprocidad negativa sea modificado para que los derechos de las partes intervinientes no sean vulnerados al momento que se aplique este principio. El determinar los efectos que ocasionaría a las partes procesal el principio de reciprocidad negativa en el exequatur se debe hacer un correcto análisis a este principio para que de ciertas maneras los derechos de las partes no sean vulnerados.

Le rôle du juge d'exéquatur sera déterminant pour illustrer la transition de la pratique juridictionnelle. En effet, c'est le pouvoir de celui-ci qui va déterminer le sort de cette pratique envers les décisions émanant des États tiers. Outre les conventions élaborées dans le cadre européen, la convention de Bruxelles du 27 septembre de 1968 et le règlement européen n° 44/2001, ainsi que le règlement Bruxelles II, Bruxelles II bis et les accords de partenariat, ne seront pas à l'abri de notre recherche. The extension process of communitarisation will certainly have implications outside the European Union. Recognition of third decisions by the French judge will now be influenced by the application of European principles and values. This study will focus on the fate of the conditions required in France for the third decisions. The role of the judge will determine exequatur to illustrate the transition from legal practice. Indeed, it is the power of it will determine the fate of this practice to decisions from other States. In addition to the conventions developed in the European context, the Brussels Convention of 27 September 1968 and this Regulation No. 44/2001 (also Brussels II and Brussels II bis) and the partnership agreements, will not be immune to our research. In other words, we want to measure the development of European private international law, particularly in terms of mutual legal assistance on the outside. The extension process of communitarisation will certainly have implications outside the European Union. Recognition of third decisions by the French judge will now be influenced by the application of European principles and values. This study will focus on the fate of the conditions required in France for the third decisions. The role of the judge will determine exequatur to illustrate the transition from legal practice. Indeed, it is the power of it will determine the fate of this practice to decisions from other States. In addition to the conventions developed in the European context, the Brussels Convention of 27 September 1968 and this Regulation No. 44/2001 (also Brussels II and Brussels II bis) and the partnership agreements, will not be immune to our research. In other words, we want to measure the development of European private international law, particularly in terms of mutual legal assistance on the outside. The goal is to give the European international private law a universal dimension

Abstract:
The article covers a topic of an unconditional automatic recognition of foreign judgments within the European Union. Thus far, a different method in case of foreign judgments has been used. Certain regulations of the EU require exequatur and contain grounds for refusal of recognition and in certain regulations both the exequatur and grounds for refusal of recognition have been abolished. First, the paper deals with the principle of mutual trust (what mutual trust is and in what to trust). Subsequently, the article points out the differences between the principle of mutual trust and the principle of mutual recognition. Finally, it discusses the notion of automatic recognition in the context of free movement of judgments within the EU.

Abstract The service of documents plays a key role in the major phases of a civil claim and rapid and reliable mechanisms for service are essential in promoting effective free movement of judgments in Europe. Due and timely service of the document instituting the proceedings is necessary to ensure that the rights of the defence are preserved, which in turn is a prerequisite for trans frontier enforcement of the resulting judgment. Reliable service of documents during the course of the proceedings is also the only way of ensuring that the parties can present their cases effectively. Enforcement of the resulting judgment may not be permissible unless the judgment has been served, and also the order for exequatur. Finally, service of the various orders that form part of the procedure for execution may also need to be effected across borders in some cases.

The service of documents is crucial for the smooth initiation and operation of cross-border civil and commercial proceedings. Cross-border service of documents raises the issues on effectiveness and efficiency of proceedings together with the effective right to access a (foreign) court in terms of the language used and the effective possibility of appearing before a court. In response, international judicial cooperation in the service of documents was established and operated for decades, starting with the Hague 1965 Service Convention. The importance of proper service of documents also comes from the fact that it is a condition to recognise and enforce the final foreign judgment in different domestic, European, and international legislations. The abolition of the exequatur procedure in the context of the EU legislation in civil matters points toward an even greater need for harmonisation, which seeks to be achieved through the Service of Documents Regulation. The changes in individual lives and business operations affected by digitalisation have also led to the need for the modernisation of judicial cooperation. The Service of Document Regulation underwent the recast procedure and entered into force on 1 July 2022. It has brought novelties, given the introduction of mandatory electronic communication between the agencies and facilitating electronic and direct service. The significant changes concern the e-Codex as the mean of communication; electronic service; electronic signature of deeds, documents and forms; and assistance in address enquiries. The paper assesses the implication of using ICT in the service of documents and, at the same time, addresses whether the changes are fully up with the fast-growing general technological advancement since it seems that the implementation level still depends on the Member States.
