Abstract:
This research was motivated by the deradicalization of ex-terrorist convicts. It requires understanding the development of radicalization and sociological aspects, e.g., community acceptance and rejection of ex-terrorist convicts. One of the efforts to return ex-terrorist convicts to the community is developing their potential in creative economic activities. This study aimed to evaluate entrepreneurship training for ex-terrorist convicts to improve their creative economy management skills. The research approach employed in this study is a descriptive evaluation of the implementation of entrepreneurship training for ex-terrorist convicts to develop creative economy management abilities, which is specifically designed for them. This research novelty is training ex-convicts as a form of self-development and a solution for them to be entrepreneurs; besides, they can readjust to society according to the rules and norms that apply. In this study, the data sources were ex-terrorist prisoners chosen randomly to participate in entrepreneurship training designed beforehand. According to the study results, the entrepreneurship education model is suitable for developing the entrepreneurial spirit of the creative economy and national insight as a deradicalization strategy with multiple economic, social, and cultural benefits. Ex-terrorist convicts are occupied with economic activities, accompanied by increased national awareness. Their public acceptance, on the other hand, will increase.

Abstract:
This research was motivated by the discovery of information about ex-drug convicts at Class IIB Padang prison who returned to drug convicts after repeating the same incident. The purpose of this study was to analyze the influence of labels on the behavior of ex-convicts in drug cases. This study uses Howard Becker's stigma theory. The approach used is qualitative according to the type of case study. Research informants were identified through a purposive sampling method with the following criteria: Class IIB Padang prison, former drug convicts, families of ex-drug convicts, and communities where former drug convicts live. Data was collected through observation, interviews and document study. Data validity test includes reliability, transferability, reliability and control tests. Miles and Huberman's interactive analytical model was used for data analysis. The results showed that social stigma influenced the behavior of ex-drug convicts, such as feelings of fear of conforming, drug abuse and uncontrollable emotions.

Abstract:
This research is motivated by the large number of data found on drug convicts with juvenile offenders in the Class IIB Padang state detention center from Koto Tangah District which always changes every period. With these changes, it is evident that many of the juvenile convicts with repeated criminal acts, and have just been sentenced to detention in the Padang Class IIB State Detention Center. However, the freedom of the juvenile ex-convicts of drug cases makes it difficult for them to adapt, and get labels from society. This labeling aims to analyze the label of society towards adolescent ex-convicts of drug cases, and the impact of the label on the behavior of adolescent ex-convicts of drug cases. This study uses the theory of labeling and George Herbert Mead's socialization theory. The approach used is qualitative with the type of case study research. Research informants were determined using a purposive sampling technique with criteria for subsidy services for prisoners at the Padang Class IIB State Detention Center, juvenile ex-convicts in drug cases with the age of 12-21 years, families of juvenile ex-convicts in drug cases, and the community around the residence of juvenile ex-convicts. drugs. Data was collected using observation, interviews, and documentation studies. The data validity test includes credibility, transferability, dependability, and conformability tests. Analysis of the data using the interactive analysis model of Miles and Huberman. The results of the study show that the labeling of society on juvenile ex-convicts of drug cases is divided into two forms; First, the labeling of names (makaw, lelek, sakaw, maele, meang, and paisok). Second, the labeling of people's attitudes (parusuah, sampah masyarakaik, and pakak badak). Community labeling has an impact on the behavior of adolescent ex-convicts of drug cases, such as feelings of fear to adapt, repeat drug use, and uncontrolled emotions.

The deradicalization programs conducted by BNPT and other stakeholders have been running since the enactment of Undang Undang Nomor 5 Tahun 2018 as a starting point for changing the paradigm of handling terrorism in Indonesia. Terrorism convicts are then assessed, rehabilitated, re-educated, and reintegrated. The program also runs outside the prison for ex-terrorism convicts so that they can back to the community. However, some ex-convicts return to commit terrorist crimes, so preventive measures are needed, especially in term of strategic intelligence measures to prevent this. This paper uses a qualitative approach with case study research. Data collected through interviews as primary data and supported by secondary data derived from official government documents and other journal articles. The case study on the application of the intelligence strategy is explained in the handling of ex-convict P in Solo Raya, in which the intelligence strategy implemented is able to monitor the movement of ex-convicts, help integrate into society and be able to help officers communicate with ex-convicts who are still closed

AbstractRasmusen (1996) has shown that inmates not only suffer public penalties but also economic and social stigma. In this article, we analyse the economic consequences of imprisonment which can be identified as lower wages and difficulty in re-entering the labour market. Analysing data from a German survey, we find that having been in prison reduces the probability of finding a job and that the total time sentenced to imprisonment reduces both labour market opportunities and earnings. The penalty is worst for those who have committed murder.

Abstract:
This study aimed to investigate the experiences of ex-convicts after incarceration. The study utilizes a qualitative approach, employing in-depth interviews with five participants who were released from prison for committing a crime. The interviews were conducted in a semi-structured format and focused on the participants’ experiences of re-entry into society, including their employment, housing, relationships, and mental health. The data were analyzed using thematic analysis, identifying common themes across the participants’ experiences. The findings suggest that the re-entry process for ex-convicts is a challenging experience, characterized by a range of barriers and obstacles. Participants reported difficulty in finding stable employment and housing, often facing discrimination and stigma due to their criminal record. They also reported strained relationships with family and friends and struggles with mental health. The study highlights the need for support services to assist ex-convicts in their transition back into society, including employment and housing assistance, mental health services, and community-based support networks. The findings also call for broader social change to address the stigmatization and discrimination faced by ex-convicts, promoting a more inclusive and accepting society. Overall, this research provides valuable insights into the experiences of ex-convicts after incarceration, contributing to a better understanding of the challenges they face and the support they need to successfully reintegrate into society.

Abstract This article aims to present some of the results of our investigation on prisoners’ conversion into Evangelical churches, amongst (ex)convicts in Piura, a Peruvian Northern city and in Lima. Our objective is to research highly debated and understudied topics about this type of process of conversion: whether it is an individual process or a strategy to gain protection from the church in a dangerous surrounding (Algranti)? Which changes do (ex)convicts undergo through conversion, especially in ways of enacting virile masculinity, a very important feature of gang members and of Evangelical churches? Many (ex)convicts’ religious careers oscillate between extremes, from delinquency to strict church discipline, until some of them may stabilize. We argue that in spite of conversion and apparent changes in behaviors, the social religious imaginary (Morello), especially in terms of ideals of masculinity, remains almost unchanged, based on relations of power, fights and domination. (Ex)convicts pass from a “perverse” version of masculinity to a “virtuous” one (Fuller). For them, the ideal of femininity remains rooted in submissive women.

Abstract. This paper discusses the maqashid asy-syari'ah study of former corrupt convicts as candidates for legislative members. Specifically, it tries to dissect the reasons why corrupt convicts are allowed to become candidates for members of the legislature and examine the Maqashid Asy-Shari'ah regarding the permissibility of corrupt convicts to become candidates for legislative members. By using a literature study approach. The results of this study indicate that it is permissible for former corrupt convicts to nominate themselves as legislature members. Based on the large value of maslahah contained when it is allowed for former corrupt convicts to re-run as legislative members representing electoral districts where the community has been harmed and betrayed by the ex-convicts. This benefit is not only in the position of ex-convicts as individual Muslims or as individual citizens, but the benefits include the stability of the culture of social life in society and the maintenance of a legal system that is following ideal legal as well as in the context of realizing the principles of justice in society.

The majority (53%) of 62 Baltimore area employers surveyed were willing to hire an ex-offender described in a hypothetical scenario. Employers’greatest apprehensions concerned ex-offenders’ people skills and their customers’ discomfort if customers knew that an ex-convict worked for them. Also, the data show that employers’willingness to take advantage of a program with subsidized wages and their fear of being victimized were related to their degree of social contact with ex-convicts. These findings suggest that ex-offenders would benefit from programs enhancing people skills and that employerswith greater familiarity with ex-convicts can more easily dismiss negative stereotypes about this population.

Abstract Prior research showed us that ex-convicts often experience difficulties obtaining legal employment. Yet, employment is especially salient for ex-convicts as employment is related to lower recidivism rates. Therefore, a better understanding of the employment opportunities of ex-convicts is important for society. The current study uses a field experiment to gain insight into the employment opportunities of this group. A total of 1174 application letters and cv’s were sent to potential employers. All potential employers received two applications: one mentioned a conviction and one did not mention a conviction. The two applicants only differed on their conviction, they had similar qualifications, had the same gender and ethnical background. The results showed that employers overall were consistent in their reaction towards individuals with identical qualifications. For women, a conviction showed to have significant influence on the employers’ reaction. In general, applicants with a non-western minority background received less positive reactions regardless the criminal record. These results seem to imply a multiple stigma for ex-convicts. Being a woman and having a non-wester minority background can result in diminished employment opportunities.

Abstract:
Using in-depth interviews, this study examined the social upbringing, subjective experiences and coping mechanisms of Mexican origin ex-convicts before and after their incarceration. Overall, our participants experienced multiple structural disadvantages prior to and following incarceration. Many grew up in environments with little social control—lacking good parenting or role models—and embedded in communities of concentrated poverty and criminality. Many also disclosed their struggles to survive, lack of positive influences and legitimate/constructive coping mechanisms. Contrary to public stereotypes that Mexican origin ex-convicts are hardcore criminals, many were convicted of non-violent drug-related charges and the majority aspired to a crime-free future. To reduce recidivism and minimize future re-offending, we suggest that clinical practitioners, social service providers and policy planners address the aforementioned needs and challenges that contributed to ex-convicts getting in trouble with the law to begin with.

The issue of successfully reintegrating ex-prisoners into society is a critical one. To assess the process of successful reintegration, we interviewed five male ex-convicts about their past versus present lives. Their responses were coded for self-oriented (agency) and community-oriented values. We found a shift away from “unmitigated” agency, toward community values from past to present, and also an integration of agency with community similar to that found in moral exemplars. This increase in integration was not found in a demographically matched control group. The transitions exemplified in these ex-convicts’ narratives help define potential paths for successful reintegration into society.

Muslims have a misunderstanding of the ideology of terrorism with the doctrine of jihad. The Islamic community does not have the power to understand their own religion, because there are people who give knowledge to themselves who are wrong about Islam, so that the community gets a misunderstanding about jihad. Terrorism is an event that worries all nations in the world, including Indonesia. Cases of terrorism have led to the emergence of government programs in an effort to deradicalize terrorists so that they no longer commit the same crimes. One of the efforts of the government and social welfare institutions is through the technical guidance program. The purpose of this study was to determine the response of former terrorist convicts to the assistance of the Insan Cita Foundation through the Bimbtek Program in Makassar City. The research method used is qualitative method. The results of the study indicate that the response of former terrorism convicts to the Insan Cita Foundation assistance through a technical guidance program in Makassar City, from a cognitive perspective, ex-terrorism convicts are able to recognize the program being followed. Then from the affective aspect, it can be seen with the feelings of former terrorism convicts who are quite satisfied with the technical guidance program. And from a conative perspective, ex-terrorism convicts have been able to determine their attitude about what to do after this technical guidance program is implemented. As for the mentoring stage, this research is more inclined to the facilitation stage because this program provides guidance and capital facilities for ex-terrorism convicts as program participants.

The right to be voted and to be elected is a human right guaranteed by the Constitution. However, there are limitations to implementation. Research on the implementation of the political rights of ex-convicts in the general election aims to address the problem; first, regulations on the rights of former corruption convicts to be elected in legislation. Second, Implementation of the rights of elected ex-convicts of corruption in the election after the decision of the Supreme Court in East Java. This research is empirical legal research or socio-legal research. The Data obtained through document studies and subsequently, the interviews analyzed with an existing legal theory with a statute approach and a case approach. Data analysis techniques are using inductive thinking patterns. The results of this study indicate that the political rights of ex-convicted corruption are guaranteed in article 28 letter D point 3 of the 1945 Constitution, and article 43 of Law No. 39 of 1999 concerning Human Rights and the Election Law, where everyone has the right to be elected and to vote in elections based on the principle of equality. However, in its implementation, there are several variants such as the General Election Commission which issued a regulation prohibiting ex-corruption convicts from running, even though the regulation was canceled by the Supreme Court. Likewise, some political parties consistently did not nominate members who have been exposed to corruption as a preventive measure in preventing corruption.

Abstract:
This article aims to re-investigate the Jihad movement of ex-terrorist convicts among the caregivers and teachers of the as-Salam Tahfidzul Quran Islamic boarding school in the Red Zone area of Bima-Dompu, Eastern Indonesia. This article focuses on two things by using a phenomenological qualitative approach, namely: (1) investigating the Jihad movement transformation of the ex-terrorist convicts among as-Salam Tahfidz Quran Islamic boarding school caretakers/teachers, (2) examining negative prejudice against as-Salam Tahfidzul Quran Islamic boarding school as "Terrorist School". The data in this article were collected using observation, participation, interview and documentation techniques which are analyzed inductively. The fieldwork on the study of religious movements in this article shows two significant results. First, the understanding and movement of Jihad for the ex-terrorist convicts among the caretakers/teachers of as-Salam Tahfidzul Quran Bima-Dompu Islamic Boarding School has changed and transformed Jihad from "taking up arms" to "Amar Makruf Nahi Mungkar" which pursued through education. Second, the increment of highly negative prejudice towards As-Salam Tahfidzul Quran Bima-Dompu Islamic Boarding School as a "Terrorist School" among the large community due to the lack of communication from the government to the community regarding the developments of the ex-convicts and the safety assurance of them being in the community after they have served their prison term. Through a significant academic analysis, this article draws a temporary conclusion that Bima-Dompu NTB is no longer a terrorist Red Zone area.

Abstract:
In the Philippines, ex-convicts face severe hurdles during reintegration, including public stigma, restricted work opportunities, insufficient support, and discriminatory behaviors, all of which impede a smooth return to society. This qualitative narrative case study investigates the psychological, social, and economic aspects of ex-convicts’ lives after jail. The Life Course Perspective is used as the study’s theoretical framework, acknowledging the importance of personal, societal, and historical elements in individual development. Six successfully reintegrated participants, each with a minimum five-year prison sentence, constituted the basis for in-depth interviews conducted in a quiet and secure atmosphere using snowball sampling. The study sought to explore ex-convicts’ issues, coping methods, life realizations, and viable therapeutic programs. The findings highlight the numerous challenges, such as societal stigma, economic constraints, and disrupted social bonds. Coping methods, which include spiritual rehabilitation and emotional acceptance, emerge as critical components of the reintegration process. Life realizations become transforming forces, characterized by a dedication to positive change and social contributions, which is frequently motivated by familial support and a desire to protect loved ones. For effective reintegration, the study underlines the importance of public acceptance, tailored interventions, and support networks. It finds that addressing these issues, as well as encouraging familial stability, boosting community involvement, and engaging employers, are critical to reducing recidivism and facilitating long-term rehabilitation. Recommendations urge for coordinated efforts from families, communities, and businesses, emphasizing the importance of a complete strategy to assisting ex-convicts on their path to successful society reintegration.

In this case, the polemic lies in the overlap between regulations number 7 of 2017 about General Elections and Regulation of Election Commission number 20 of 2018 about the nominations of DPR, provincial DPRD and Regency / city DPRD members. The core problem in the regulation is the limitation of political rights for ex-convicts (Croupier of Drugs, Sexual Crimes against Children and Corruption). Whereas the higher level regulation does not limit this. This research is a library research. Namely research that uses all sources of research from books, journals, articles, research, laws, and from the internet. After the sources are obtained and then analyzed using related theories. This research focuses on the normativity strategy that should have been carried out and applied by the general election commission in limiting former convicts in the 2019 general election. The normativity strategy that should be carried out by the general election commission on the limitation of convicted persons in general elections in Indonesia is the making of regulations relating to the submission of honesty to the public that those who nominate themselves as prospective legislative candidates are ex-convicts. One of the strategies that must be regulated in the regulation is, Submission to the public through social media, in this case the delivery must be regulated more stringently and in more detailed procedures, because it is feared that political actors whose status as ex-convicts only pay to one television station and get a certificate or proof. However, the provision of information is not broadcast on the television station, and so forth.

Criminals or convicts placed in detention centers or prisons with the provisions of the law actually aim to provide a deterrent effect and provide religious understanding so that after the detention period is over they can behave better and not make the same mistakes. However, many of them, after leaving detention, no longer have the trust of the local community where they come from, so that it is difficult for these ex-convicts to get jobs and do not have the skills to become entrepreneurs. This is what makes ex-convicts lose confidence and even repeat the same mistakes. The method of delivering learning material uses a participatory learning approach by providing material and implementing practices. The implementation of this community service activity was carried out at the Bengkulu IIB Prison which was attended by 30 convicts. The Community Service Implementation Team has provided motivation and tips for success for prisoners, conducted cosmetology and beauty training based on the use of domestic production technology, and introduced other alternatives for sources of income such as the manufacture and marketing of organic masks intended for women. convicts as provisions in improving their health. skills at the Class IIB Correctional Institution of the Bengkulu Ministry of Law and Human Rights. Therefore, the service team hopes that from this service the prisoners will gain alternative skills in welcoming the prisoner's free period later.

The research discusses the coping stigma mechanism by drug correctional clients at Class I Correctional Center South Jakarta. Research is a qualitative study and uses the method of unstructured interviews, which are conducted by interviewing narcotics correctional client and correctional supervisor who are directly related to correctional client in providing social guidance. Guidance provided to correctional clients is an effort of correctional institutions to achieve successful social reintegration. The social reintegration program in the penal system in Indonesia regarding planning assistance and supervision of criminals so that they stop committing crimes and can successfully return to the community. However, the results of the study indicate that stigma in the community towards ex-convicts still leads to negative stigma. As one of the extraordinary crimes, drugs abuse have a large impact and multi-dimensional against social, cultural, economic, and political. This makes former drug convicts more vulnerable to negative stigma in society. The results also showed that each correctional client had a different view of the stigma in the community regarding ex-convicts. Because they have different views on stigma, the coping stigma mechanism by the drug correctional client are also different. Stigma on ex-convicts in the community is seen as adversity. To overcome the adversity, correctional clients will go through resilience process including coping stigma mechanism. In the resilience process found support from the community and having a stable job will helps correctional clients overcoming the stigma given by the community.

This study investigates how and why the personal transformation occurred in former convicts in Indonesia. This study employs a qualitative approach with in-depth interviews and review of documents including social media as data collection instruments. Two former convicts serve as the research subjects, while five people among ex convicts’ family and friends serve as the research informants. To provide the study credibility, triangulation of data and resources was conducted, namely by examining data obtained from social media like YouTube that displays personal experiences some ex criminals who have transformed. Data were analyzed by using thematic analysis technique. The results showed that the process of personal transformation occurred throughout a long stage and did not occur shortly. It was also found that the personal factor (e.g. the understanding of personal experiences and social factors, especially intensive and prolonged interaction with religious leaders) was the main drive for personal change. The development of policies to combat terrorism in Indonesia shows the relationship between counter-terrorism and de-radicalization activities against ex-convicts. Currently, a fundamental and philosophical study of deradicalization is still needed. The views of Dahrendorf's conflict theory, and Berger Luckmann's theory of social reality construction, are seen through a paradigmatic study of critical theory. Axel Honneth's recognition theory as the third generation critical theory of the Frankfurt school is used to analyze the phenomenon of deradicalization in countering terrorism in Indonesia. Through the qualitative research format of multi-case instrumental case studies with in-depth interviews and involved observations of ex-convicts who have been able to have social independence, this study finds an emancipatory dialectic space in the phenomenon of deradicalization in Indonesia. The emancipatory dialectic space became a “new engagement” for the phenomenon of deradicalization of the ex-napiters.

Reformation of prison inmates is one of the most utmost functions of the Nigerian Correctional Service. The main focus of this study was to assess the perceived impact of vocational skills acquisition on reformation and reduction of recidivism by ex-convicts of Gombe Central Correctional Center, Nigeria. The study used 30 ex-convicts who were jailed between six months and eight years. The instrument used for data collection was structured questionnaire which was validated by specialized in measurement and evaluation, and reliability test conducted in Faculty of Education, University of Maiduguri. Data collected were analyzed using descriptive statistics, mean and standard deviation. The findings revealed that most of the ex-convicts were male, with informal education and age range of between 21 and 40 years. The respondents engaged more in carpentry (37%) and Welding (33%). The vocational skills acquired by inmates had great and positive impact on their reformation. The study therefore recommends that: there is need for the Nigeria Correctional Service authorities to introduce more vocational skills acquisition programmes in Gombe Central Correctional Centre; Collaborative provision should be made between the Nigerian Correctional Service (NCS) and other agencies as well as other Vocational and Technical Education (VTE) centres towards promotion of rehabilitation of prison inmates through vocational skills acquisition programme.

Being ex-convicts, they face several challenges, such as lack of employment opportunities and discrimination, which hinder successful parole reintegration. The parole system, however, can be used to implement reintegration strategies to create change. Despite the abundance of studies on how employers perceive ex-convicts, there needs to be more research on the success of their reintegration into the workforce and society. This paper employs scoping review methods by identifying the existing literature about the parole system in Malaysia and the successful reintegration strategies. This paper concludes that the Malaysian parole system has unique features through the strategies implemented toward the effective reintegration of parolees.

However, the Bawaslu (Election Oversight Body) allowed it and it is also supported by Yasonna Laoly, Minister of Justice and Human Rights of Indonesia, with the consideration that the regulations stipulated by PKPU contradict Law No. 7 of 2017 which states that ex-convicts are considered to have the same political rights as other citizens, a right guaranteed by the constitution. This study employs political contestation theory that explains the actions or processes that are disputed, for example ideological contestation on social policy, as well as political electoral theory that explains a system for making political decisions in which individuals gain the power to decide through competitive over people’s voices.

Group social guidance is a method of social work that aims to help individuals to improve their social functions through certain experiences within the group so that they are able to overcome the problems they face, whether problems involving themselves, their group and society. In providing guidance for drug convicts, group social guidance tends to be more effective than individual social guidance. The forms of group social guidance carried out in correctional institutions include general education, skills education, mental spiritual development, socio-cultural and work activities. The problems that were studied are how to apply group social guidance for drug convicts, what the benefits of the guidance are and whether there are obstacles it faces. The method used is empirical normative method. The results of the study concluded that (1) Group social guidance for drug convicts is carried out in collaboration with the Wahana Bhakti Sejahtera Foundation which specifically handles drug convicts and it has been running properly, implemented through spiritual group activities, sports, arts, legal awareness and work guidance. (2) Group social guidance activities show good results, as can be seen from the positive self-changes in drug convicts. (3) The obstacles are the limited infrastructure for development, drug convicts’ laziness in following guidance, the lack of application of values and the lack of active participation of the officers as social workers in conducting guidance. It is recommended to add facilities and infrastructure for medical therapy and social rehabilitation for convicts who are ex-drug users.

Crime in society's view is usually seen as closely related to the actions of men, so that crime is considered unusual if committed by women. This has an impact on the lives of female ex-convicts, often their gender as a woman is related to the traces of crime they have. The purpose of this study was to determine the social reality that forms of image representations of female ex-convicts in Ambon and to determine the impact of the image of female ex-convicts in Ambon in daily life. The theory used in this research is the construction of social reality theory, mass media, image, gender, and feminism. This study uses a descriptive qualitative research approach and case study research methods. The methods used to collect data are in-depth interviews, observation and literature study. The conclusion of this research is that the construction of social reality is something that is made by the community and disseminated externally so that it shapes people’s thoughts and behavior. This has an impact on thinking about women with a track record of criminality, thereby damaging the woman's self-image. Therefore, female ex-convicts are often faced with negative stigma and labeling and disrupting their daily lives. Tindak kriminalitas kerap dilekatkan dengan perbuatan laki-laki, sehingga kriminalitas dianggap tidak lazim jika dilakukan oleh perempuan. Hal tersebut berdampak pada kehidupan mantan narapidana perempuan. Tujuan dari penelitian ini adalah untuk mengetahui realitas sosial yang membentuk representasi citra mantan narapidana perempuan di Ambon serta untuk mengetahui dampak citra mantan narapidana perempuan di Ambon dalam kehidupan sehari-hari. Peneliti menggunakan teori konstruksi realitas sosial, media massa, citra, gender, dan feminisme. Penelitian ini menggunakan pendekatan penelitian kualitatif deskriptif dan metode penelitian studi kasus. Metode yang digunakan untuk mengumpulkan data adalah wawancara mendalam, observasi dan studi kepustakaan. Penelitian ini menyimpulkan bahwa konstruksi realitas sosial merupakan sesuatu yang dibuat oleh masyarakat dan disebarkan secara luas sehingga membentuk pikiran dan perilaku seseorang. Hal tersebut membuat pemikiran buruk tentang perempuan dengan rekam jejak kriminalitas sehingga merusak citra diri perempuan tersebut. Oleh karena itu mantan narapidana perempuan sering dihadapkan dengan stigma dan labeling negatif yang mengganggu kehidupannya sehari-hari.

AbstractTerrorism is one of the extraordinary crimes, creating terror based on ideological differences and misinterpreting religious teaching. This research focuses on the factors that influence a person to be involved in criminal acts of terrorism. The motivations can vary greatly and are affected by many factors, such as social, economic, religious, and political background. The research uses qualitative methods within the exploratory, investigative approach. The participants of the research are 36 terrorism convicts who are still serving their sentences. The research found that the terrorists were still dominated by males and members of JAD (Jamaah Anshorut Daulah). The background of the individuals is also varied, ranging from uneducated to bachelor or higher, unemployed to civil servants. The convicts who join a terrorist group have different reasons. However, several reasons generally stated by convicts involved in terrorist groups are a strong belief in a particular ideology or religion, hatred of certain groups or ideologies, and the urge to make radical changes in society. In addition, convicts may also be affected by factors such as poverty, injustice, and discrimination they experienced. The research also unveils that the convicts have regret for their previous acts.AbstrakTerorisme adalah salah satu kejahatan luar biasa yang menciptakan ketakutan berdasarkan perbedaan ideologi dan penafsiran yang salah terhadap ajaran agama. Penelitian ini berfokus pada faktor-faktor yang memengaruhi seseorang untuk terlibat dalam tindakan kriminal terorisme. Motivasi dapat bervariasi secara signifikan dan dipengaruhi oleh banyak faktor, seperti latar belakang sosial, ekonomi, agama, dan politik. Penelitian ini menggunakan metode kualitatif dengan pendekatan eksploratif dan investigatif. Peserta penelitian adalah 36 narapidana terorisme yang masih menjalani hukuman mereka. Penelitian menemukan bahwa teroris masih didominasi oleh laki-laki dan anggota JAD (Jamaah Anshorut Daulah). Latar belakang individu-individu ini juga beragam, mulai dari yang tidak berpendidikan hingga sarjana atau lebih tinggi, dari pengangguran hingga pegawai negeri. Narapidana yang bergabung dengan kelompok teroris memiliki alasan yang berbeda. Namun, beberapa alasan yang umumnya dinyatakan oleh narapidana yang terlibat dalam kelompok teroris adalah keyakinan kuat pada ideologi atau agama tertentu, kebencian terhadap kelompok atau ideologi tertentu, dan dorongan untuk membuat perubahan radikal dalam masyarakat. Selain itu, narapidana juga dapat dipengaruhi oleh faktor-faktor seperti kemiskinan, ketidakadilan, dan diskriminasi yang mereka alami. The dialectic between the political rights guaranteed by the Constitution which is firmly held by ex-convicts is very contrary to the teachings of morality taught by Immanuel Kant. The study of morality always prioritizes behavior based on inner truth, not because of external factors or in this case while the law allows, which makes humans far from the inner truth itself. This study uses a normative juridical law research with a legal approach and a conceptual approach. The results of this study indicate that the Constitutional Court's decision places the law above morality, by setting aside something that must be owned by the Regional Head, namely a balance between attitudes and behavior. Furthermore, according to the concept of democracy, the state actually has the right to totally limit the political rights of former convicts of corruption not to go forward again or to abolish them completely, in order to guarantee the integrity of the Government from corrupt actors in the future and also to make the law a function of deterrent effect and the last remedy in enforcement, but in fact the state does not implement it, the state prefers to give access to ex-corruption convicts to advance to become candidates for regional heads on the legal basis of this decision.

The comparative rate of women entering the formal correctional system and serving custodial sentences, both in prison and prison remand awaiting trial, is on the increase. This is accompanied by a similarly increasing number of women eventually exiting prisons annually. This study investigated the challenges influencing reentry of women ex-offenders in Nyeri County, Kenya. The study specifically investigated the effects of not addressing the challenges identified for women returning from prison in Nyeri County especially challenges connected to housing, employment, relationships, drug, and substance abuse as well as mental health after incarceration. This was a qualitative study adopting a phenomenological design. The site and respondents were purposively selected with snowballing being used to select the respondents to the point of saturation. This study made use of 41 women ex-convicts, 3 FGDs, and 9 key informants. Data were collected by use of semi-structured interview schedules. Results indicated that ex-offenders face various challenges upon release from prison. The effects of these challenges when not addressed the impact the individual self, their family, the community, and predisposed the ex-convicts to a high propensity for recidivism. Based on the findings it is suggested that the use of community corrections, adjusting prison training to market needs, and the use of victim-offender mediation can be better alternatives to incarceration.

Examining the adjustment efforts of this ex-convict uses the Looking Glass Self Theory from C.H.Cooley and the Stigma Theory from Erving Goffman. This research uses a case study approach in qualitative research. Research subjects were ex-convicts who were selected using apurposive technique. The study was conducted in Klakah District, Lumajang Regency with data collection techniques in the form of observation, interviews and documentation. Data analysis techniques using models from Miles and Huberman. Data validity test is done by the source triangulation method. The results of the research conducted by the author are the adjustment efforts made by ex-convicts to be able to return to the community environment will lead to positive and negative results, although it is difficult and requires a long time but the former drug can be accepted back by the community. By definition, an ex-convict is someone who has served and completed their sentence in a prison in accordance with the decision of the criminal court and for the sake of a sense of legal justice. The experience of being an ex-convict has a far-reaching impact on their lives both internally and externally. From the internal side, ex-convicts are insecure and have a borderline personality (emotional ups and downs very quickly). From the external side, families, churches, and communities reject their presence. Strong negative labeling of them (double punishment) makes them choose the safe path by withdrawing from the social environment. If ex-convicts are not properly trained, then the potential to become recidivists is very high. This study used qualitative research methods. The type of research used is a case study with a semi-structured interview technique method in order to obtain depth and sharpness of the truth of the results to be achieved. The object of the study was 18 ex-convicts consisting of 10 women and 8 men with an average age of 44.5 years with 90% of narcotics cases. Menyandang status sebagai mantan narapidana berdampak luas pada kehidupan mereka baik secara internal maupun eksternal. Labelisasi negatif yang kuat terhadap mereka (hukuman ganda) membuat mereka memilih jalan aman dengan menarik diri dari lingkungan sosial. Itulah sebabnya, mantan narapidana perlu mendapatkan pembinaan dengan metode yang tepat, jika tidak maka potensi menjadi residivis sangatlah tinggi. Penelitian ini bertujuan mengetahui efektifitas teori spiritualitas dari Dallas Willard dalam pembinaan spiritualitas mantan narapidana di Yayasan Pelangi Bisat Nusantara Karawaci. Penelitian ini menggunakan metode penelitian kualitatif dengan jenis penelitian studi kasus. Sedangkan metode yang digunakan adalah teknik wawancara semi terstruktur. Subyek penelitian berjumlah 18 informan yang terdiri dari 10 wanita dan 8 pria dengan usia rata-rata 44,5 tahun dengan 90% kasus narkotika. Hasil penelitian menunjukkan bahwa teori Spiritualitas Dallas Willard sangat efektif digunakan pada pembinaan mantan narapidana di Yayasan Pelangi Bisat Nusantara Karawaci. Alasannya adalah, teori tersebut sederhana dalam penerapannya dan tolak ukur yang digunakan sangat jelas. Penelitian ini diharapkan menjadi sumbangsih positif bagi komunitas, yayasan dan gereja yang memiliki keterpanggilan dalam melakukan pembinaan terhadap mantan narapidana.

In a recent development, the Nigeria Prison Service was renamed, “the Nigeria Correction Service”, a move that is designed to reorient the department along the lines of emergent demands of justice dispensation on the global scene. This study examined the extent to which the new Nigeria Correction Service can adjust to the laudable objective of repositioning itself for purposes of reformation and re-integration of the nation’s ex-convicts for a better Nigerian society. Data was obtained from secondary materials including books, periodicals, journals, newspapers, the internet, etc. Content analysis was adopted as the mode of analysis while the theory of social integration (Blau, 1960) was employed as the theoretical framework of the study. Findings revealed that the re-orientation of the “service” for purposes of reformation and reintegration of ex-convicts had long been taking place as many of such citizens had either acquired a good measure of education while in prison, learned various vocations, and even attained higher spiritual growths. The study suggested adequate funding to enhance the effort of the service in achieving its objectives.

Among the many peculiarities of early New South Wales was the absence of a police force to manage a population largely composed of convicted criminals. Instead, the early Governors were forced to employ trusted convicts and ex-convicts to act as watchmen and constables and police their fellows. This article explores the history of these neglected convict police in the context of the contemporary development of modern policing in the British world. Using a case-study of a crack-down on illicit distilling under Governor King in 1805–1806, I demonstrate that the convict police were both surprisingly effective and prone to corruption, reflecting the legacy of British policing traditions and the influence of reformist ideas.

Sexual crime is a crime that is quite high in Indonesia which causes trauma, depression and death. A similar case which was quite shocking also occurred before in 2016, the murder and rape of a 14 year old girl by 14 perpetrators in Rejang Lebong Regency, Bengkulu. Based on the facts of the cases mentioned, acts of sexual violence against children may be committed by anyone, anywhere, with any mode or motive and in any scope. Based on the description that has been described, the authors formulate the problem, namely how the supervision is carried out by government officials and law enforcement against ex-convicts who commit sexual violence against children in Rejang Lebong Regency. The legal research method used, namely normative-empirical, is basically a combination of normative legal approaches with the addition of various empirical elements. Supervision is needed for ex-convicts in cases of sexual violence against children. Until now, there has not been found any systematic supervision of ex-convicts in cases of sexual violence against children in Rejang Lebong Regency, especially for perpetrators who have blood ties to the victims such as the victims' fathers, brothers, uncles and grandfathers. Supervision of ex-convicts in cases of sexual violence against children is important as an effort to prevent repetition of cases. Then considering the psychological condition of victims and perpetrators of crime, this supervision has an urgency to carry out.Kejahatan seksual merupakan kejahatan yang cukup tinggi di indonesia yang menyebabkan trauma, depresi hingga kematian. Kasus serupa yang cukup menggemparkan juga terjadi sebelumnya pada tahun 2016, pembunuhan dan pemerkosaan gadis 14 tahun oleh 14 pelaku di Kabupaten Rejang Lebong, Bengkulu. Berdasarkan fakta kasus yang telah disebutkan, tindak kekerasan seksual pada anak berkemungkinan dilakukan oleh siapapun, dimanapun, dengan modus atau motif dan dalam lingkup apapun. Berdasarkan uraian yang telah dijabarkan, penulis merumuskan masalah yaitu bagaimana pengawasan yang dilakukan oleh aparatur pemerintah dan penegak hukum terhadap mantan narapidana yang melakukan kekerasan seksual pada anak di Kabupaten Rejang Lebong. Metode penelitian hukum yang digunakan yaitu normatif-empiris ini pada dasarnya ialah penggabungan antara pendekatan hukum normatif dengan adanya penambahan dari berbagai unsur-unsur empiris. Diperlukan pengawasan terhadap mantan narapidana kasus kekerasan seksual pada anak. Hingga saat ini belum ditemukan adanya sistematika pengawasan terhadap mantan narapidana kasus kekerasan seksual pada anak di Kabupaten Rejang Lebong terutama bagi pelaku kejahatan yang memiliki ikatan darah terhadap korban seperti ayah, kakak, paman, dan kakek korban. Pelaksanaan pengawasan terhadap mantan narapidana kasus kekerasan seksual pada anak penting untuk dilakukan sebagai upaya pencegahan terhadap repetisi kasus. Kemudian mengingat kondisi psikologis korban dan pelaku kejahatan, pengawasan ini memiliki urgensitas untuk dilakukan.

Representation is imperative to help society comprehend what life is like after imprisonment. This qualitative study delves into the nuanced experiences of formerly incarcerated individuals, commonly referred to as ex-convicts, within the province of Davao del Sur. Through snowball sampling and in-depth interviews, we explored the challenges they faced, the consequences of these challenges, the coping mechanisms they employed, and the insights gained during their reintegration into society. Utilizing a phenomenological approach, the research uncovers three primary challenges faced by ex-convicts: (1) anticipated stigma and stigma management, the struggle to secure (2) emotional and material support, and (3) social readjustment and reintegration due to their preconceived detachment from society outside prison. Moreover, the findings indicate that former inmates experienced negative effects caused by their time in jail, leading to (1) emotional distress. However, the experience also served as a means for them to (2) restore their faith and become more (3) introspective in their thoughts and actions. Their coping mechanisms provided them hope and a positive mindset in overcoming the challenges they encountered, such as (1) social and spiritual, and (2) mindful acceptance of their current situation, which showed their resilience, faith, and as a repercussion of their violations. Furthermore, imprisonment became insightful learning to them to have a (1) stronghold between family ties and emotional support, as well as (2) renewed their faith in God. Consequently, government social reentry programs must be reinforced to help these individuals in many facets of their lives to promote resilient adjustments and prevent recidivism.

International law standards of building a social state and guaranteeing each person a decent life make it necessary to develop, at the level of Russian legislation, an institute of social support for low-income ex-convicts as part of the program of their social rehabilitation after release from a penal institution. The author analyzes the essence of social rehabilitation as a legal institution, the evolution of legal regulation of social rehabilitation methods in the Russian penitentiary practice. The institute of social rehabilitation of convicts released after serving their sentences is inter-agency in its essence; it is aimed at the identification and solution of the whole complex of social and economic problems of those inmates who potentially fall into the category of the poor (or who could become low-income citizens after release). It is also aimed at providing not only psychological, but also material social support to ensure their right to a decent life, reduce their risk of falling into the category of low-income (poor) people and help their overall social adaptation after release. The effectiveness of social rehabilitation measures determines if a convict chooses the law-abiding or the criminal model of behavior after release, determines their legal consciousness and, in the end, influences the level of repeat crimes. The author singles out and analyzes the contents of social rehabilitation of ex-convicts after release from places of confinement. In the context of ensuring the right of a convict to a decent life after serving a sentence, the author pays special attention to such a component of social rehabilitation as assistance in finding employment and housing in compliance with the legislation of the Russian Federation and the normative acts of the penitentiary system. The meaning of the term «social» in the collocation «social rehabilitation of convicts» is analyzed in its modern and historical aspect. The author shows the necessity of establishing an efficient state-controlled public system of social rehabilitation for persons who are released from places of incarceration in Russia. He also identifies key directions for improving the effectiveness of the penitentiary system by taking into account the humanistic values of the socio-cultural environment and the principles of international law norms when providing social support to low-income citizens who are in conflict with criminal law, as well as by overcoming their poverty and a negative attitude to them. The author presents arguments to prove the practical value of introducing new forms and methods of correctional influence on convicts that are alternative to criminal procedure coercion, of widening the scope of additional social, psychological and educational work with convicts in penitentiary legislation with the purpose of providing social rehabilitation for convicts and ensuring their right to a decent life after serving the sentence.
