Abstract:
This chapter examines the pervasiveness and importance of enlargement in the history of European integration. It first considers the principles, conditions, and instruments of enlargement before discussing the roles of various institutional actors and the candidate states. It then shows how, faced with the likelihood of large-scale Central and Eastern European accession, the European Union extended the requirements for membership to include the candidate countries' democratic credentials and economic competitiveness. The first enlargement included Britain, Denmark, and Ireland, followed by Greece, Spain, and Portugal, the European Free Trade Association, the Central and Eastern European countries, Cyprus, and Malta. The chapter also explains how the EU has developed a variety of strategies to deal with growing differences among the member states' socio-economic situations and policy needs without formally resorting to a division of its membership in concentric circles, core and peripheral groups, or alternative frameworks.

Abstract:
This introductory chapter discusses the basic characteristics of three legal instruments: the Brussels Regulation, Lugano Convention, and Hague Convention on Choice of Court Agreements. Together, the three instruments constitute a package governing jurisdiction and the recognition of judgments in wide areas of civil and commercial litigation. However, these instruments do not all have the same legal nature. Brussels 2012 is a regulation of the European Union — the equivalent of legislation — and it applies as such in the Member States. Lugano and Hague are both international agreements and consequently form part of the international legal system. But since the European Union is a Party to them — the Member States (except Denmark) are not — they also form part of the EU legal system.

Abstract:
The chapter scrutinizes how German and Danish unions are navigating the increasingly integrated slaughterhouse industry, based on a case study of a large Danish multinational slaughterhouse company with operations in both Denmark and Germany. The German slaughterhouse industry is highly affected by increasing fragmentation of production and the widespread use of low-paid workers often posted from Eastern Europe, which the Danish multinational company utilizes to lower its production costs. The Danish slaughterhouse workers’ union was more successful in safeguarding workers’ wage and working conditions and preventing labour market segmentation, while their German peers faced much more precarious work. These differences are explained by the vast differences in the unions’ power resources in the two systems. Danish unions were in a much stronger position in terms of membership, where unionization remains a social custom, with stronger collective agreements and local representation compared with the German union.

This chapter examines private international law rules that govern orders concerning children, including orders determining with whom a child shall live or with whom he may have contact. It first considers the rules governing the jurisdiction of the English courts as regards parental responsibility matters, the choice of law rules applied, and the different provisions for the recognition and enforcement of parental responsibility and related orders made elsewhere. In particular, it discusses orders granted in another European Union Member State, except Denmark; orders granted in another Contracting State to the 1996 Hague Protection Convention; and orders granted in Scotland and Northern Ireland. It also analyses the relevant provisions of the Child Abduction and Custody Act 1985 and common law rules before concluding with an overview of other important developments including the 1996 Hague Convention and the Council of Europe Convention on Contact concerning Children.

Abstract:
Reconstructing Solidarity is a book about unions’ struggles against the expansion of precarious work in Europe, and the implications of these struggles for worker solidarity and institutional change. The authors argue against the ‘dualization’ thesis that unions act primarily to protect labour market insiders at the expense of outsiders, finding instead that most unions attempt to organize and represent precarious workers. They explain differences in union success in terms of how they build, or fail to build, inclusive worker solidarity, in countries or industries with more or less inclusive institutions. Where unions can limit employers’ ability to ‘exit’ from labour market institutions and collective agreements and build solidarity across different groups of workers, this results in a virtuous circle, establishing union control over the labour market. Where they fail to do so, it sets in motion a vicious circle of expanding precarity based on institutional evasion by employers. The book builds its argument on comparative case studies from Belgium, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Poland, Slovenia, Sweden, and the United Kingdom. Contributors describe the struggles of workers and unions in diverse industries such as local government, music, metalworking, chemicals, meatpacking, and logistics.

This chapter provides an overview of issues relating to the jurisdiction of the English courts. It begins with a discussion of jurisdiction under the Brussels/Lugano system, focusing on four different sets of rules: the rules contained in the Brussels I Regulation as amended in the Brussels I Recast, the EC/Denmark Agreement, the Brussels Convention, and the Lugano Convention. It then considers jurisdiction under the rules contained in a modified version of the Brussels I Regulation, as well as jurisdiction under the traditional English rules (whether the English courts have power to hear the case; whether the court will decline jurisdiction or stay the proceedings. or restrain foreign proceedings; and whether there is a limitation upon the exercise of jurisdiction). The chapter also examines jurisdiction under the rules in the Hague Convention on Choice of Court Agreements 2005, ratified by the European Union on behalf of all the Member States.

Abstract:
This chapter examines the jurisdiction of the English court and the choice of law process in proceedings for divorce, judicial separation, and annulment of marriage, and the extent to which the decrees of foreign courts in such matrimonial cases are recognised in England. It discusses similar rules which have been introduced in relation to same-sex marriage and civil partnership. Finally, the chapter considers the powers of the English court to grant financial relief and to recognise foreign maintenance orders. The Domicile and Matrimonial Proceedings Act 1973 introduced new uniform grounds of jurisdiction for matrimonial proceedings. These grounds were based on the policy that at least one of the parties, whether husband or wife, applicant or respondent, should have a sufficient connection with England to make it reasonable for the English court to deal with the case and likely that the divorce would be recognised in other countries. The Brussels II bis Regulation imposes uniform jurisdictional rules throughout the European Union (except Denmark, which did not participate in the adoption of the Regulation) and provides for almost automatic recognition of divorces, annulments, and separations granted by the courts of the Member States.
