Abstract: The Republic of Albania ranks as a potential candidate country of the European Union. In order to become a candidate country, Albania agreed to ensure that its existing laws and future legislation shall be gradually made compatible with the acquis communautaire. In 2008, the Albanian legislator made an attempt to fulfil this obligation in the field of consumer law replacing the old Consumer Protection Act (CPA) 2003 by the new CPA 2008, which aims at a full implementation of the European directives on consumer protection law. The CPA 2008 constitutes a great improvement to the legal situation in Albania and marks an important step towards European Union accession. Nevertheless, the CPA 2008 did not implement all the directives to a full extent. Moreover, the relationship between the specific provisions on consumer protection in the CPA 2008 and the more general provisions on contract law in the Albanian Civil Code is not clear. This article first provides an outline of the past developments and recent regulations on consumer protection law in Albania and then illustrates the need of further harmonization between the CPA and the Albanian Civil Code. Résumé: L’Albanie est un potentiel pays candidat à l’Union européenne. Afin de devenir un pays candidat, l’Albanie a accepté de rendre sa législation, présente et future, compatible avec l’acquis communautaire. En 2008, le législateur albanais tenta de remplir cette obligation en matière de protection des consommateurs, en remplaçant l’ancienne loi sur la protection des consommateurs (datant de 2003) par une nouvelle législation visant à transposer complètement les directives européennes sur la protection des consommateurs. La loi sur la protection des consommateurs de 2008 est un pas important en direction d’une adhésion à l’Union européenne. Néanmoins, elle n’a pas transposé l’ensemble des directives dans toute leur étendue. Cet article donne dans un premier temps un aperçu des développements passés et des réglementations récentes en matière de protection des consommateurs en Albanie. Il démontre ensuite le besoin d’une plus grande harmonisation entre la loi sur la protection des consommateurs de 2008 et le Code civil albanais.

Abstract:
Albania’s EU integration has been an important part of politics of all Albanian governments after 1990s. This process has been considered not only as a means for being a part of the United Europe, but a factor for achieving the stability in the country, economic development, strengthening democracy. Diplomatic relation between Albania and the EU were established since 1991, but Albania’s European perspective was ensured only in 1999, by signing the Stabilization and Association Agreement. Since 1999 onwards the Albanian governments have been working for fulfilling the membership criteria to European Union, though the process has been a long and problematic one. Nowadays (2019) Albania expects the EU to open the negotiations for the EU membership process. Through this descriptive-analytical study, we will shed light into the most important moments of the Albanian process toward the European integration; policies followed from both parties, attitudes of the Albanian politics, encountered difficulties, problems and achieved successes. The study relies on the many documents from EU and Albanian institutions such as studies, analyses, interviews with political personalities, Albanian and European researchers and analysts. The study aims to analyze the “long and difficult” path of Albania towards EU, focusing on what has been achieved and the future challenges.

Abstract:
The recognition of transparency as an essential element of good governance is very important for new democracies because it leads to greater public support for their governments' economic and political decisions. This has been clearly understood by the countries in the Western Balkans which following the fall of communism entered a path of rapid democratization struggling to be opened and transparent. This paper explores transparency and open government in Albania looking at how the Albanian legal administrative framework and practices guarantee the principle of transparency in decision-making and the role the EU in complying with this principle. It introduces the concept of 'transparency through integration' as a model which encapsulates the transparency developments in Albania and Western Balkans and looks at how transparency can be transformed from a principle of good governance to a legalistic instrument holding a place in the hierarchy of legal norms. This research focuses on how transparency becomes part of a policy paradigm which can transform a country's politics from secretive and authoritarian to transparent and democratic. In addition, it suggests that the EU has a role to play as a transformative power to induce positive reforms and improve transparency in the decision-making in Albania.

Abstract:
Abstract Albania is one of the new democracies in the South-Eastern Europe which hopes to be granted the status of membership to the European Union. Since June 2014, Albania is a candidate for accession to European Union, after it fulfilled the requirements based on Stabilization and Association Agreement the negotiations of whom started in 2003 and was signed in 2006. Even though the formal application of Albania is dated in 2009, the country has undergone through a difficult process in order to fulfill the pre-requirements especially in the justice system in Albania. The level of corruption is considered the main problem which was highlighted also in the other Progress Reports of Albania and it is still considered to be an important impediment to Albanian accession to EU. Differently from the other progress reports, in the progress report 2016 (Albania 2016 Report), there are noted some improvements consisting mainly in the adoption of a set of constitutional amendments which was the starting point to thorough justice reform. Even though initially such process was faced with the severe diversion of opinions of Albanian main parties, they finally reached an agreement with the recommendations provided by the Venice Commission at the Council of Europe. The report considers as a positive step the newly adopted law on the re-evaluation of judges, prosecutors and legal advisors. Another positive aspect of the law is the re-evaluation (vetting) based on 3 criteria: integrity through assets assessment, background assessment (inappropriate links with organized crime) and professional competence. Such improvements weren’t sufficient enough to permit to Albania to start negotiations with EU as there are still many obstacles to overcome.

The purpose of the article is to explore the process of joining Albania to the European Union in the mainstream of the lands of the Western Balkans became members of the united Europe. The preconditions and development of the process of formation of European integration in the Republic of Albania analyzed. Is undertaken an attempt at the analysis of the real possibilities of Albania to be taken in the European Union and the interest of this integrated association to maintain double-sided cooperation with Albania, in spite of the absence of necessary economic, political and other bases for its adoption in the European Union. Special attention is given to the domestic and foreign policy developments in the Republic of Albania, which directly influenced Albania’s cooperation with the European Union before and after the beginning of the active euro-integration dialogue. Special emphasis made on an overview of the most important issues and problematic moments on determining the start of the EU accession negotiation process with Albania. The methodology of the research based on the principles of systemicity, authenticity, historicism, logics. General scientific (analysis, synthesis, generalization) and special-historical (historical-typological, historical-system) methods have been used. The scientific novelty is that for the first time the European integration of Albania studied separately from other countries of the Western Balkans. The studies concluded that Albania’s desire to join the European Union linked to its desire to stabilize the country, modernize the domestic political system, improve the economic situation, facilitate the solution of social problems, participate in the mechanism of redistribution of financial resources, to enhance its political status by taking advantage of the benefits of membership in this organization. As for the EU’s position, official Brussels is pursuing a rather restrained and balanced policy of expanding its borders.

Abstract:
Postcolonialism has always concerned itself with the conditions in former colonies of European maritime empires. However, based on current frameworks defining imperialism and the post-colonial condition, the erstwhile Soviet Union could be classified as a colonial power. Its aggressive annexation of nations and paranoid control of information and education systems are reflective of colonial practices. Nevertheless, the Eurocentrism inherent in the culture of its former members prevents them from acknowledging their postcoloniality. Albania is one such nation. Not only was it a province of the Ottoman Empire for centuries but also a satellite state of the Soviet Union. Although Albania broke away from the USSR in the 1960s, it remained under the aegis of Soviet ideology as its nationalist dictator Enver Hoxha was a staunch Stalinist. This created unique cultural conditions which eminent Albanian writers like Ismail Kadare could not help but represent in their works. The post-Soviet space, including Albania, shows a number of symptoms of postcoloniality which are a direct consequence of Soviet imperialism. This paper will explore the postcoloniality of the post-Soviet space and analyse its symptoms in Stalinist Albania. In this context, it will also briefly examine the orientalist frameworks often employed by the West in its dealings with the ambiguous Europeanness of East and Central European nations.

The choice between modern nation-building and integration into supranational European and Euro-Atlantic structures remains a strategic challenge for the Balkan countries. Success in solving this problem of predominantly mono-ethnic Croatia and Slovenia has not yet become a model to follow. Serbian and Albanian national issues cannot be resolved. Serbia's defeat in the Balkan wars of 1991–1999 over the creation of a "Greater Serbia" led to the country's territorial fragmentation. Two Albanian national states emerged in the Balkans. Attempts to create a union of Kosovo and Albania could turn the region into a whirlpool of ultra-nationalist contradictions. The European Union has started accession negotiations with Albania, Bosnia and Herzegovina, the Republic of Northern Macedonia, Serbia and Montenegro. The success of these negotiations depends on the readiness of the EU and the ability of these Balkan states to adopt European norms and rules. The accession of all Balkan nation-states to the European Union must finally close the "Balkan window" of the vulnerability of the united Europe. Nation-building in the Balkans on the basis of ethnic nationalism sharply contradicts the purpose and current values of the European integration process. For more than three decades, the EU has been pursuing a policy of human rights, the rule of law, democracy and economic development in the Balkans. The region remains vulnerable to the influences of non-European geopolitical powers: the United States, Russia, Turkey, and China. The further scenario of the great Balkan geopolitical game mainly depends on the pro-European national consolidation of the Balkan peoples and the effectiveness of the European Union's strategy in the Balkans.

Albania was the only Eastern European country to exit from the Warsaw Pact and consequently become diplomatically isolated by its member states by late 1961. Such an event was the result of the continuous accusations exchanged between the Albanian and the Soviet Leaders, primarily between Enver Hoxha and Nikita Khrushchev. In the midst of the turbulent Soviet-Albanian relations, China offered its alliance to Albania which only worsened the situation. This study aims to illustrate how the curve of the Albanian-Soviet partnership changed over time, starting from the Stalin era and finishing with the Khrushchev era. More precisely, this study explains how Khrushchev’s decision-making concerning other countries, especially Yugoslavia, pushed the Albanian leaders into changing attitude towards the Soviet Union and make alliances with Mao Zedong. This dissertation explores how and to what extent EU conditionality can foster democratisation in a highly problematic case such as post-communist Albania. In order to examining the phenomena of democratisation in operational detail, the thesis delves into the sub-systemic level of democratisation focusing on two partial regimes - electoral regime and civil service system. The analysis follows on the rational choice premise that the domestic actors’ strategies of compliance depend on the structure of external incentives i.e. rewards and threats, that appeal to their interest. Our account on the impact of EU conditionality upon democratisation assumes that the likelihood of compliance depends on 1) the size of the rewards attached to conditionality; 2) the size of adoption costs; 3) the clarity of prescriptions and 4) credibility of reinforcement. The first part consists of developing a conceptual framework for assessing and explaining the impact of EU enlargement conditionality over democratisation processes. The second part explores the case of Albanian democratisation and the specific challenge it poses to the working of EU conditionality. The third part analyses the association between EU conditionality and reform seeking to identify whether the fortification of the EU conditionality coincides with a pattern-breaking change in each of the partial regimes of our choice. The thesis concludes that the EU was more successful to foster reforms in the area of electoral competition than public administration and civil service system. The EU seemed to push forward reforms by articulating clear prescriptions regarding the electoral competition; and advancing contractual relations with the country in function of electoral performance.

This study investigated whether EU Progress Reports measured the Copenhagen political criteria in a biased manner compared to independent indices. At stake is the credibility of the EU accession process and whether countries in the Western Balkans will seek partnerships with the EU or state-actors beyond the European peninsula. This is a case study of how well Albania and North Macedonia fared regarding the political criteria during 2014 and 2017. Each country was ranked against one another in order to find potential discrepancies between measurements from Progress Reports and independent indices. This paper did find evidence that suggests the European Commission disfavored North Macedonia and favored Albania. However, other results were inconclusive. The finding supported accession literature that has called into question the objectivity of the EU accession process.

Abstract:
During the term of 2010 we received a Minor Field Study scholarship from the Swedish International Development Cooperation Agency (Sida), which allowed us to do a two-month study in Tirana, Albania. The study examined one of Europe’s most common tools when it comes to assisting candidate countries, potential candidate countries, and neighbouring countries of the European Union: Twinning. The idea of Twinning is that the beneficiary country gets assistance from EU member state institutions in order to develop its own institutions, in terms of standards of quality and safety. We have observed a Twinning project structured in the form of a consortium between the Swedish Tax Agency and the French Tax Agency assisting the Albanian General Tax Directorate (GTD) in Tirana. The study highlights the relationship between the four different actors involved in the ongoing project (EU, Sweden, France and Albania) and Twinning as a working method. More specifically we investigated (A) the transition from an old to a new system and if any difficulties emerged in the process, (B) what necessary factors are needed for a successful Twinning project, and (C) how the actors’ different backgrounds affect the project. The result we gained from the field study shows that the transition towards a new system progresses well as long as the project follows the main principles of Twinning: partnership and cooperation. These two principles allow the Albanian GTD to direct the project and decide the direction of their Europeanization process. Twinning generates many positive aspects e.g. institutional understanding and friendship, and it brings the cooperating nations closer to each other. The difficulties that have emerged have been technical or when one of the actors has not followed the structure of the project. These difficulties are natural in the beginning of any project since structures and relations take time to establish. Three main qualities affect the outcome of this Twinning project: experience, flexibility and communication. Actors involved in the project have to be experienced, in form of personal as well as institutional experience. Besides, they have to be flexible since the project follows the development of society where unpredicted needs can emerge. Most importantly, communication has to be free from friction between the actors in order to maintain the partnership principle of Twinning. Our analysis shows that the outcomes of this Twinning project are mutually shaped between the actors involved. Therefore, the emphasis should be on personal abilities to mutually create a working structure that follows the principles of Twinning.

Rozbor oficiálních stanovisek EU k rozšíření EU o země Západního Balkánu (Chorvatsko, Makedonie, Černá Hora, Albánie, BiH, Srbsko, nově Kosovo) ukazuje na zdrženlivost EU k vlastnímu aktu přijetí. Přes všechna prohlášení o vůli přijmout tyto země, tato vyjádření zůstávají spíše proklamací, bez vyhlášení konkrétních dat přijetí těchto zemí do společenství. Na rozdíl od Rakouska, která jako jediná země EU deklaruje co nejrychlejší rozšíření EU o země Západního Balkánu přímo ve vládním programu jako prioritu své zahraniční politiky. Motivace Rakouska je založena na důkladné ekonomické analýze situace, kdy Rakouské investice do těchto zemí jsou nejvyšší ze všech zemí EU. Mezi Rakouskem a zeměmi Západního Balkánu a Rakouskem probíhá čilý obchod i pohyb osob, na který ostatní země EU nejsou ještě připraveny. Překážkou rychlého přijetí se tedy jeví důvody povahy nikoliv ekonomické, ale politické. Evropská unie se shoduje na roku 2008 jako na roku klíčovém v přístupových jednáních. V době publikace této práce ovšem EU nebyla s to jako celek schválit nezávislost Kosova. Minimálně tento bod zůstává otevřen k dořešení v roce 2008 spolu s dalšími body týkajícími se příštího rozšíření. EU má v této chvíli (duben 2008) jasno, že favorizovanými kandidáty pro přístup jsou Chorvatsko, Makedonie a Albánie, zatím bez konkrétního data přístupu.

All’inizio del mese di luglio del 2015 prendono avvio a Valona i lavori previsti nell’ambito del progetto “Riabilitazione del porto di Valona”, finanziato dalla Cooperazione italiana con un contributo di oltre 15 milioni di euro a credito d’aiuto. Nella seguente Tesi di Laurea si analizza l’iniziativa che mira a modernizzare il complesso portuale della città in un’ottica di sviluppo integrato della regione, per supportare i crescenti flussi turistici e commerciali in entrata ed in transito. Il potenziamento del porto permetterà all’Albania di dotarsi di un porto moderno ed efficiente in linea con le normative UE, permettendo l’attracco di ben quattro navi contemporaneamente, con notevoli vantaggi sia a livello turistico che economico, principalmente nell’area Sud del Paese, ma in generale in tutta l’Albania. Si propone, progetta e dimensiona poi un ulteriore ampliamento futuro consistente nell’inserimento di un frangiflutti a massicciata con banchina interna atta ad accogliere navi Ro-Ro di dimensioni maggiori a quelle che attualmente possono attraccare nel porto. Se ne analizzano i vantaggi sia dal punto di vista materiale, ovvero in termini di protezione dal moto ondoso, che dal punto di vista economico, ossia come opera utile allo sviluppo commerciale e turistico del Sud dell’Albania. Il programma di riabilitazione e il progetto riguardante il frangiflutti mirano infatti a contribuire al piano nazionale dell’Albania di potenziamento delle infrastrutture e dei Trasporti marittimi e si inquadrano nelle previsioni di potenziamento di connessione degli Stati Balcanici alla rete TEN-T europea, rappresentandone, il porto di Valona, una delle possibili parti terminali sull’Adriatico. Si descrive inoltre come sviluppo del settore dei trasporti è considerato un catalizzatore per lo sviluppo economico, in quanto crea un potenziale di crescita stabilendo connessioni che non esistevano prima o migliorando la qualità delle connessioni esistenti.

The thesis examines the aspects of neo-Ottomanism in Turkish foreign policies toward three Balkan countries - Albania, Bosnia and Herzegovina and Kosovo -, focusing on the developments of the last decade. Turkey has become quite active in the Balkans and in these countries in the last few years, however, this activism is not without any antecendents. These areas were the core European territories of the Ottoman Empire and after the dissolution of this entity, Turkey still attached special importance to these countries, albeit during the Cold War relations were cooler. On the other hand, with the fall of the Iron Curtain, the rise of the AK Party to government position and Ahmet Davutoglu becoming Minister of Foreign Affairs in Turkey, the Balkans started to receive particular "limelight" in Turkish foreign policy. New ideas, expressions, approaches were incorporated into the forming self-confident and assertive foreign policy of Turkey. However, this new policy, referred to as neo- Ottomanism in many cases, infered criticisms too, from the West and from local politicians in the Balkans too. Abstract:
The paper examines the civil law codifications in twenty-two countries of Central Eastern Europe, in the area between Germany and Russia. It analyses the reasons for the emergence of major codifications in this area, where the decisive part was played by the 1811 General Civil Code, and notes the import of the French Code civil to parts of contemporary Poland and Lithuania. It considers the period between the World Wars, when many of the renewed and newly established states attempted to make their own codifications, which were successful only in Albania and Latvia. In the following section, he points to alternative conception of lawmaking and the concept of the legal system in the Soviet Union, forced by Vyshinsky, which resulted in the doctrine of separate branches of law denying the universal function of civil law. This concept was imported into the Soviet sphere of influence won in the Second World War. From 1990 onwards, a turn took place and new tendencies have not yet ended. Of these states, half have become members of the European Union, five others have the candidate status.

Abstract:
Albania appears to provoke a new problem. The desire of young people to leave the country, as well as the strong focus on EU membership of the country as the greatest answer for their future and that of the country, has drawn academics to the topic. According to studies, young Albanians' trust in national institutions has fallen significantly. Based on these findings, the purpose of this study is to examine the factors, such as: perceived political situation, trust in the national situation and EU education programme, that contribute to a high degree of trust in EU institutions. From a methodological standpoint, the paper is based on the quantity approach, and the survey is the technique of data gathering. The survey was established as part of this research, and the categories for the analyses were determined by the theoretical foundation. A total of 212 people responded to the survey. The analytical model of the paper is based on authors Fukuyama and Putnam. They define trust as an expectation that evolves in a community as a result of regular and societal changes in common norms. This declaration served as the foundation for the entire project. Following the examination and processing of the data, as well as running a multiple linear regression, it was determined that a negative perception of the political situation, low level of trust in national institutions and high level of trust in the EU education programme contribute to the high degree of trust towards EU institutions.

In this study, international migration trends were evaluated in Turkey and European Union (EU) Candidate Transition Economies by means of data obtained from HDI Report developed by UNDP. The aim of this study is analyzing international migration trends in relation with other dimension of integration such as economics, social protection and social policy. In this study, the subject was carried out through comparative relation scanning model and literature model, the sample group was established EU candidate transition economies (Montenegro, The Former Yugoslav Republic of Macedonia, Serbia, Albania, Bosnia and Herzegovina) with Turkey. The research data was collected by means of data from HDI Report developed by UNDP. The findings from this study revealed that the population of Montenegro and Serbia among EU candidate transition economies less emigrated and more immigrated than other countries. It can also be concluded that the emigration trend of Turkey presents similar tendency with Montenegro and Serbia whereas immigration rate of Turkey is lower than the other countries except for Bosnia Herzegovina.

After the dispersion of the Soviet Union, the European Union embarked upon an intense relationship with the Central and Eastern European Countries. The transition into capital market and democratization of these countries had been supported by the Ministers of Foreign Affairs at the beginning of 1989 before the collapse of the Soviet Union System. The European Agreements were signed between the EU and Hungary, Poland, and Czechoslovakia on December 16th, 1991. 10 Central and Eastern Europe Countries became the members of the EU on May 1st, 2004. With the accession of Bulgaria and Romania into the EU on January 1st, 2007, the number of the EU member countries reached up to 27, and finally extending to 28 with the membership of Croatia to the EU on July 1st, 2013. Removing the Western Balkan States, Serbia, Montenegro, Albania, and Bosnia and Herzegovina from the scope of external relations, the EU included these countries in the enlargement process in 2005.The European Commission has determined 2014 enlargement policy priorities as dealing with the fundamentals on preferential basis. In this context, the developments in the Balkans will be closely monitored within the scope of a new approach giving priority to the superiority of law. The enlargement process of the EU towards the Balkans and whether or not the Western Balkan States will join the Union will be analyzed.

The global COVID-19 pandemic has transformed the world in 2020 and it has been recognized as the biggest stress test in the history of the European Union. The pandemic is inflicting high and rising human costs worldwide, and the necessary protection measures are severely impacting economic activity. As a result of the pandemic, the global economy had been projected to contract sharply by –3 percent in 2020, which is much worse than during the 2008– 09 Global financial crisis. In these difficult and challenging times, countries and societies need to adapt to the new situation while minimizing the negative social and economic implications. This paper discusses how different governments in the South East Europe region (Albania, Bosnia and Herzegovina, Croatia, Kosovo, Montenegro, North Macedonia and Serbia) have managed and dealt with the COVID-19 pandemic. A review of the current literature on COVID-19 is conducted. This paper should enable a better understanding of how different governments have faced the pandemic and how and to which extent they facilitated a proactive and timely approach towards crisis management. The objective of this study is to theorize a CAS (Complex Adaptive System) framework to evaluate the prevention, preparedness, response and crisis management and strategies used during the pandemic and assess the steps taken so far by the selected Southeast European transitional countries for tackling the COVID-19 crisis up to September 2020.
