Full textThe paper aims to explore possible spaces to reform the criminal discipline of end-of-life choices, expecially after the recent legislative and jurisprudential developments, both in Italy and beyond. The research focused, first of all, on the evolution of the Italian discipline in terms of murder with the consent of the victim and contribution to others’ suicide. Through a historical investigation, which begin with an investigation about the legal doctrine and the legislation of the 18th century and developed above all through the preparatory work of the Zanardelli and Rocco codes, the underlying reasons for the criminal policy on this point and the critical points on which the doctrine has focused are highlighted. The analysis of the criminal offenses in force is accompanied by an examination of the jurisprudence of the last twenty years, which has greatly contributed to "updating" the protection offered to the so-called "weak subjects" and to resolve the conflicts between legal assets at stake, taking note of the evolution of scientific knowledge and the emergence of unimaginable scenarios for the legislator of 1930. Nevertheless, research has shown that, even after the revolutionary ruling n. 242/2019 of the Constitutional court about art. 580 of the criminal code, there are still strong critical issues due to the application of outdated rules, deemed inadequate if compared with today's social context, and to textual formulations which may contribute to the emergence of interpretative difficulties. As a result of these assessments, some crucial aspects were identified for a possible legislative reform and it was considered appropriate to also explore the choices made by other European systems, in order to identify good practices from which to draw inspiration. In light of the knowledge acquired thanks to the comparative analysis, the paper finally puts forward some reform proposals, also referring to the bills already filed in Parliament, and acknowledges the pending referendum proposal for the partial abrogation of the art. 579 c.p. (on the admissibility of which the Constitutional Court will rule on February 15, ie after the delivery of the final paper).

Full textIn the ‘70s, the topic of nutrition started to have a prominent role in Sociology as a new subject of study. Our meals have unattended consequences on all aspects of human and non-human life: it will be enough to think about the implications of the choice of a meal instead of another affecting the lives of people and the environment. In this frame, the diffusion of veganism in the last two decades has drawn attention to the need for an analysis. Exploring a minority eating practice is necessary to reflect on the role human beings have taken in this world, but also to reason on the ethical and political dimensions. The foundation of this article is the reflection on the relationship we have with animal otherness. What directs our focus is the perspective of the adoption of veganism as a driving force that leads social actors to question what is “taken for granted” and the capability of individuals to build their new identity and networks. Food strongly affects social relations: it will suffice to think about the tension rising when we find someone who eats in a different way from ours, or how a particular eating style can condition the choice of friends, partners and, sometimes, job. Vegans literally embody the resistance to the assertiveness of meatist culture. Vegans also lead to a reflection on the consumption of animals: they promote new meanings of food and of the relationship between humans and animals, making man closer to compassion and empathy. Boycotting the production of “capitalistic misery” by means of micro-political actions vegans implement, means to found a new order. The meaning of vegan ethics is associated with the rejection of the speciesist privilege and the construction of new habits, to collaboration and participation, to the shaping of new, empathy-based society.

Full textThis thesis aims to examine the topic of the end of life, with specific reference to assisted suicide and euthanasia. After highlighting the clear distinction between refusal of medical treatments, suicide aid and euthanasia, we focus, first of all, on the analysis of Act no. 219/2017, which recognizes the maximum extent to therapeutic self-determination in the context of physician-patient relationship. Secondly, the subject of assisted suicide is examined, focusing on the jurisprudence. Subsequently, assuming a comparative perspective, a broad analysis of the disciplines of medically assisted death of various States is examined. Finally, the issue of euthanasia is analyzed, focusing in particular on post-euthanasia organ donation, on the risk of the slippery slope and on the need to protect vulnerable individuals.
