Abstract:
The paper examines international documents (conventions and other treaties, declarations, resolutions of the United Nations General Assembly and other acts), which show transitional moments when and how organizational and legal measures to improve the state of the environment began to appear in the field of international cooperation on the environment. Based on their analysis, the author concludes that in the course of the formation and development of international cooperation in the field of the environment, measures to improve its condition and rational use of natural resources are increasingly recognized as one of the main ways to maintain the ecological balance. The concept of international cooperation in the field of rational environmental management has been formulated. It is proposed to understand it as a system of organizational and legal measures taken by the world community and its members to improve the state of the environment, which, among other things, includes the rational use of natural resources, improvement, restoration of the environment and other measures to enhance the sustainability of ecological systems as a whole.

Abstract:
Proponents of the environmental peacemaking approach argue that environmental cooperation has the potential to improve relations between states. This is because such cooperation facilitates common problem solving, cultivates interdependence, and helps to build trust and understanding. But as of now, very few cross-case studies on environmental peacemaking exist. Furthermore, much of the available literature understands peace in negative terms as the mere absence of acute conflict. This article addresses both shortcomings by studying the impact of international water cooperation on transitions toward more peaceful interstate relations. To do so, we combine information on positive water-related interactions between states with the peace scale, a recent data set measuring the degree of positive and negative peace between states. For the period 1956–2006, we find that a higher number of positive, water-related interactions in the previous ten years makes a shift toward more peaceful interstate relations more likely. This is particularly the case for state pairs that are not in acute conflict with each other.

To what extent has the North American Free Trade Agreement contributed to strengthening and deepening international environmental management in the Americas? Should the system be broadened to incorporate other nations? While a complete answer to these queries is currently beyond reach, there should be little doubt that NAFTA has influenced and continues to influence the direction of environmental management in North America and the hemisphere at large. The agreement has spawned a series of new institutions that are already reshaping current practices and that have considerable promise for broadening the range of international commitments to environmental management in the Americas. The most prominent and most relevant of these is the Commission for Environmental Cooperation (CEC).

The strengthening of global integration processes necessitates the development of cross-border regions and the intensification of cross-border cooperation in the field of environmental management, which determines the relevance of this study. This issue is particularly relevant for the Arctic region, where the start of large-scale development of natural resources, development of territories and the creation of new transport routes require the development of environmental management principles that would ensure economic development, preservation of the lifestyle of indigenous people and the preservation of biodiversity. The article examines aspects of the legal characterization and regulation of natural resources’ treatment that are jointly owned or geographically located in two or more states. It is shown that political, social, sociological and economic prerequisites impose on the principles of such cooperation. Until now, the problem of joint management and use of natural resources and products of their processing remains unresolved. It is proposed to create interstate commissions, as well as concessions, as the basis for the development of natural resources’ joint use. The leading direction in the development of the situation is interstate cooperation on the biosphere’s conservation.

The article examines the legal framework for environmental security in the context of globalization. Attention is focused on interstate cooperation in the field of health security. Particular attention is paid to the relationship and correlation of international and national legal acts. The task to unite the efforts in the international community for ensuring the safety of the human environment is being actualized. In modern conditions, the depletion of natural resources and the adverse effects of environmental degradation are an obstacle to sustainable development. Negative trends are recognized land degradation, loss of biodiversity, lack of drinking water, droughts, desertification, aggravating new problems. It is concluded that it is necessary to carry out a set of measures to preserve the environment. Issues related to the rational use of natural resources, seas, oceans, freshwater resources, mountains and forests and protection of wild flora and fauna require solutions within the international community. The importance of international cooperation and consolidation of resources to combat desertification, drought and land degradation is increasing. The international community in the field of environmental protection should be focused on the prevention and limitation of harmful effects on the environment, the rational use of international natural resources and the protection of unique natural objects through conservation from human economic influence. Changes are required in the environmental policies and legal frameworks of states. Consolidation is required by the resources of both government agencies and civil society, including youth, trade unions, the media, academia, the private sector and others.

This paper reviews the game-theoretic literature on collaborative environmental management. It begins with a survey of static models of international environmental agreements (IEAs), comparing their underlying assumptions and their results. Extensions of the basic model to allow for both adaptation and mitigation, and for transfer payments are considered. We review the various concepts of coalitional stability, such as internal and external stability and far-sighted stability in the noncooperative strand, and the gamma core concept in the cooperative strand. The network approach to cooperation building is reviewed. We next survey extensions of IEA theory to dynamic models with stock pollutants, allowing membership status to change over time. Finally, dynamic cooperative games of pollution with transfer payments that take place over time are discussed.

Due to historical grievances, Armenia and Turkey experience severe international conflicts and do not maintain diplomatic ties. Yet, as a vestige of the Soviet period, when Armenia was not an independent country, both nations share the Arpacay/Akhuryan Dam, and riparian cooperation exists at the local level. We observed that local cross-border water institutions are authorized to manage the dam and do so via polycentric management principles. We suggest that such a devolved model of governance facilitates this unique cooperation. Furthermore, there is a positive relationship between private management of water resources in such areas and the ability to sustain cooperation. However, so far, the positive impacts of this cooperation on improving international relations have been little, if any. We suggest that what makes cooperation possible in this context also inhibits its expansion to broader peacebuilding. We also suggest that increased localization of management, coincident with improved relations, maximizes cooperation potential.

Economic theorists of international environmental cooperation and regime theorists who focus on the environment ask the same two basic research questions: why does international environmental cooperation emerge in some cases, but not in others, and why is cooperation wide and deep in some cases, but not in others? Unfortunately, the two schools of thought do not collaborate much in their respective attempts to answer these and related questions. Instead, mutual neglect is the general rule. This paper explores how regime theory can learn from the findings of the economic theory of international environmental cooperation and vice versa, and it examines the prospects for reciprocal learning. An exploitation of mutual learning opportunities is likely to lead to a more comprehensive understanding of international environmental cooperation, and it can ultimately result in better policy advice.

AbstractUnder what conditions should epistemic institutions (institutions that provide policy-relevant scientific advice) be integrated into international legal institutions – for example, the Conference of the Parties to the United Nations Framework Convention on Climate Change? Following work in law and economics on the theory of the firm, this article argues that where states will not implement environmental policies absent a collective decision to do so, greater hierarchical control of epistemic institutions by legal institutions may be necessary to ensure the credibility and availability of a usable scientific record. Hierarchy creates credibility because it allows all states necessary for cooperation in the legal institution to oversee the production of the scientific record that provides the basis for international legal rules. Hierarchy thus enhances the effectiveness of international law as a coordination tool, even at the expense of the autonomy of the scientific process. By contrast, where collective action is not necessary because states will unilaterally regulate an environmental problem once scientific uncertainty has been reduced, epistemic and legal institutions should be fragmented to ensure the unbiased production and dissemination of scientific information. In such situations, the credibility of the scientific record is demonstrated by decentralized adoption of science-based regulation.

The problems of the state environmental processes managing have become international in nature in the last decade due to the increasing importance of the environmental paradigm in the general context of analyzing the consequences of rapid economic growth, the need to transition to a "green" and low-carbon economy and ensure the quality of residents’ life. The internationalization of environmental process management involves global trends, indicators, management technologies and their synchronization with internal (national) processes. Based on a comparative analysis of the key macroeconomic and environmental indicators of China and the United States, the authors identify the problems that have arisen in the Chinese environmental management practice and propose directions and forms for improving environmental management based on its internationalization. It was determined that the priority measures for the Chinese government are: 1) the concentration of the national environmental management system at the primary territorial management link level - the municipality; 2) use existing cooperation platforms to strengthen international exchange and cooperation between the Chinese government and other countries on environmental management issues; 3) training and retraining of personnel taking into account the fact that modern international systems stimulate technologies for unifying the collection and processing of environmental data; 4) the need to optimize the budget expenditures structure and the development of "green finance" technologies; 5) basing the environmental management system of the territory on the control of industrial and nonindustrial pollution. The conclusion of the authors about the need for significant detail in the disclosure of environmental pollution information by enterprises is important. The authors believe that in the process of internationalization and improvement of China's environmental management, the existing information platforms of international cooperation should be more actively used in order to strengthen international exchange and cooperation. It is also important to take into account that modern information systems stimulate technologies for unifying the collection and processing of environmental data.

To investigate the international development status and hot trends in the field of environmental security management in recent years, the published the environmental security management literature from 1997 to 2021, which was retrieved from Web of Science, with VOSviewer as the main and CiteSpace as the auxiliary, through the cooperation network of authors, scientific research institutions, and countries. The keywords were visualized by clustering, time zone analysis, and burst analysis. A total of 7596 articles were retrieved, forming six main clustering labels, including 28,144 authors. The research hotspots are from the fields of personal health, society, agriculture, ecological environment, energy, and sustainable development, as well as the development of internet environmental safety management, such as big data, Bayesian networks, and conceptual frameworks. Through cluster analysis, the cooperation of major research teams and scientific research institutions and the cooperation and development between countries were analyzed. The cooperation between scientific research institutions in various countries is relatively close. The United States currently occupies a dominant and authoritative position in this field. China has cooperated more closely with the United States, Britain, Australia, and India.

The establishment of international environmental institutions is often predicated on the assumption that cooperation is politically feasible and that regime formation is viable. However, the provision of many environmental services remains vulnerable to asymmetries in interests that impede both cooperation and adaptation. We examine governance structures that internalize externalities under asymmetrical conditions aggravated by abrupt and/or significant changes in political circumstances (in this context, the eruption of political violence which, in this article, we refer to as political variability). We analyze the change over time in Israel's strategies for stream and river rehabilitation undertaken as a response to continued runoff of wastewater from Palestinian territories. We find that abrupt political changes that negatively affect relations among the parties undermine the foundations for cooperative solutions. In the Israeli-Palestinian case, Israel has responded by adopting a position of “unilateral environmentalism.” Such a non-cooperative policy was deemed the best possible option for addressing the transboundary pollution problems, in stark contrast to the model of cooperation that underlies most IEAs. Yet, we find that while unilateral environmentalism may safeguard a country's immediate political and environmental interests, it also entails various risks in the medium and long term.

Global environmental governance is growing increasingly complex and recent scholarship and practice raise a number of questions about the continued feasibility of negotiating and implementing an ever-larger set of global environmental agreements. In the search for alternative conceptual models and normative orders, regional environmental governance (REG) is (re)emerging as a significant phenomenon in theory and practice. Although environmental cooperation has historically been more prevalent at the regional than at the global level, and has informed much of what we know today about international environmental cooperation, REG has been a neglected topic in the scholarly literature on international relations and international environmental politics. This introduction to the special issue situates theoretical arguments linked to REG in the broader literature, including the nature of regions, the location of regions in multilevel governance, and the normative arguments advanced for and against regional orders. It provides an overview of empirical work; offers quantitative evidence of REG's global distribution; advances a typology of REG for future research; and introduces the collection of research articles and commentaries through the lens of three themes: form and function, multilevel governance, and participation.

We investigate in this paper the optimal timing of cooperative agreements dealing with the harvesting, utilisation or management of marine fish resources. We formulate the optimal timing problem as a two-player dynamic differential game model where both players, e.g. harvesting countries, consider the timing of the agreement as a strategic decision parameter. In other words, the initialisation of the environmental agreement will be subjected to negotiations. The game begins by a period during which the players negotiate on the cooperative agreement. During this period the players optimize their fishing unilaterally, that is, they play a non-cooperative game taking into account that they will enter a cooperative fishery some time later. It is up to the players to decide when they wish to initiate cooperation. We show that there are several possibilities where cooperation is never an option for at least one of the countries. In other cases immediate cooperation may be optimal for both countries. Between these extreme cases is the possibility of some delay in entering cooperation. The determinants of willingness to cooperate in the game include unit costs of harvesting, discount rate, maximum fishing efforts, initial stock size, biological growth rate, carrying capacity and division of profits.

Abstract:
The article reveals the essence of international principles of corporate governance in terms of forming effective relationships with clients, shareholders, suppliers, the public, state and local authorities. It was determined that the international principles of corporate governance are: protection of shareholders’ rights; ensuring the equal treatment of shareholders, recognizing the rights of interested parties provided by law and encouraging active cooperation between the company and interested parties in creating welfare, jobs and ensuring the financial stability of the enterprise; ensuring timely and accurate coverage of information on all the most important issues related to the joint-stock company; ensuring strategic management of the company, effective supervision of the activities of executive directors, as well as reporting to the company and shareholders. A detailed analysis of the characteristics of the principles of corporate governance according to various systems was carried out, which proved that the principles of corporate governance of the Organization for Economic Cooperation and Development were adapted for countries in which there is a movement towards a market economy in order to cover various existing governance models. A comparison of international and national principles of corporate governance was made. The analysis of the application of the principles of corporate governance in the practice of management of Ukrainian corporations was carried out. It was determined that the principles of corporate governance that do not apply to modern enterprises include the following: participation of shareholders in decision-making, transparent capital structure, effective functioning of corporate control markets, equal treatment of owners of shares of the same type, participation of interested persons in the management of the corporation, access of interested parties persons to internal corporate information, high quality and reasonableness of information, annual audit by the auditor, the same attitude of the board to all shareholders.

AbstractThe article analyses various stages of the subsequent development of the international cooperation and of Ukrainian legislation aimed at facing the consequences of the explosion at Chernobyl nuclear power plant, on April 26, 1986. It is aimed to assess the impact of Chernobyl accident on law and policies in the field of environmental protection. The reaction to the Chernobyl accident gave in fact a boost to the evolution of international treaty law in various sectors (nuclear safety, emergency preparedness and response, environmental law) and, according to the Authors, contributed to the assertion in general international law of the right to environmental information.More than a thousand legal acts have been adopted in the Ukraine aimed at determining the safe management of the territories affected by Chernobyl accident. Notwithstanding the resulting nuclear contamination from Chernobyl accident still is a priority environmental problem. In this context, the Authors highlight the exceptional interest of the prospect opened by the Presidential Decrees of 2018 and 2019 on the rehabilitation of the territories affected by radioactive contamination. They represent a further important step towards the effective establishment of a biosphere reserve, in the perspective of the creation of a transboundary protected area with Belarus.

AbstractThe question of ownership—that is, who is included and excluded from policy processes—has become one of the most pressing issues in the global discourse on peace and conflict. While research shows that the inclusion of domestic actors is critical to success, broader international processes often neglect these actors. Focused on environmental peacebuilding—the sustainable management of natural resources in post-conflict settings—as an emerging area, this article employs qualitative content analysis (QCA) to study four core reports of the United Nations Environment Programme (UNEP)’s Environmental Cooperation for Peacebuilding Programme (2008–2015). The results reveal that the framing of environmental peacebuilding in these documents contributes to power inequalities being reinforced. The reports’ language suggests that, overall, UNEP favors international ownership of environmental peacebuilding. By contrast, local actors—both state and non-state—appear to be considered a risk in the context of natural resource management. This article discusses the implications of this lack of inclusion for peacebuilding practice.

This paper presents an innovative international cooperation project design in advanced manufacturing technologies (AMT) between Southeast University, Nanjing, Jiangsu Province, China and Concordia University, Montreal, Quebec, Canada. The project has been developed for the Special University Linkage Consolidation Programme that was one of the new initiatives included in a letter of intent signed by the Canadian Prime Minister and the Chinese Premier in 1994. The project covers a broad spectrum of engineering and technology management issues which are targeted to be helpful in China's present transition to a market economy. AMT in this paper includes not only the substantial body of knowledge regarding the design, fabrication, and assembly of goods but also management of these technologies with particular emphases on environmental issues and the human dimension (as they relate to manufacturing). The main objective of the project is human resource development and training to address the priorities and needs of a rapidly changing industry in the People's Republic of China by means of university/industry/government collaboration involving both Canadian and Chinese partners. The project aims to advance the knowledge of new manufacturing techniques, management methods, and product advantage with increased attention paid to the environment.

Attention is paid to the international nature of the problems associated with compensation for environmental damage, the inadmissibility of establishing territorial boundaries in the problem of environmental protection. The characteristic of the main international organizations related to environmental protection is given, the factors influencing the international cooperation in the field are analyzed. Particular attention is paid to the problem of developing the system of management in the field of environmental protection and bringing to civil responsibility of entities that cause damage to natural objects. The article justifies the necessity of strengthening international cooperation in a number of directions in the sphere of environmental protection, elaboration of a unified approach to the understanding of environmental damage and its structural components, as well as elaboration of unified rules at the international level for determination of the amount of compensation payments, exacted from the inflicter of damage and aimed at compensation for the environmental damage caused.

The article deals with the historical and modern aspects of greening of international economic relations in the context of scientific approaches, theories and concepts. The peculiarities of the influence of natural and ecological factors on the development of society, nature management, economic interactions are determined. A retrospective review of scientific economic thought is presented in the context of interdisciplinary environmental context. The complexity of the process and phenomena of evolutionary changes in politics, economics and ecology are identified. Methodology of coverage of environmental and economic concepts includes different approaches: philosophical, psychological, biological, technical and economic. The mechanisms of greening are reflected in the areas of neo-Keynesianism, neoclassicism, institutionalism, globalism, post-industrialism. Environmental threats affect society in different ways, but stimulate change and transform economic systems. The intensification of the environmental crisis and global problems has led to the expansion of international activities, environmental policy, economic culture and environmental awareness. New formats of international contacts, coordination of market and social interests should be considered in the context of theories of environmentalism, greening of the economy, economic modernization, resource provision, environmental security. The formation of progressive models of social development involves international economic integration, the inclusion of national environmental policies in the international security system, promoting cooperation and cooperation between countries. development diplomacy is seen as a tool for consolidating countries in solving global problems, intensifying international integration in the field of environmental activities, greening trade and economic activities and international business. The field of research on the greening of international economic relations is constantly expanding in the context of security, cooperation, resource management.

International environmental negotiations often involve conflicts between developed and developing countries. However, considering environmental cooperation in a North-South dichotomy obscures important variation within the Global South, particularly as emerging economies become more important politically, economically, and environmentally. This article examines change in the Southern coalition in environmental negotiations, using the recently concluded Minamata Convention on Mercury as its primary case. Focusing on India and China, we argue that three key factors explain divergence in their positions as the negotiations progressed: domestic resources and regulatory politics, development constraints, and domestic scientific and technological capacity. We conclude that the intersection between scientific and technological development and domestic policy is of increasing importance in shaping emerging economies’ engagement in international environmental negotiations. We also discuss how this divergence is affecting international environmental cooperation on other issues, including the ozone and climate negotiations.

A game-theoretic model of territorial environmental production under Cournot competition is studied. The process is modeled as cooperative differential game. The stable distribution mechanism of the common cooperative benefit among players is proposed. We proved that the cooperative total stock of accumulated pollution is strictly less then the pollution under Nash equilibrium for the whole duration of the game. We design a stable Shapley value as a cooperative solution, which is time-consistent. The Shapley value is also strategic stable and satisfies the irrational-behavior-proofness condition. The numerical example is given.

International environmental cooperation is difficult because states disagree on burden sharing and have incentives to free ride. However, interested countries can promote future cooperation through unilateral action that induces technological change in and, thereby, shapes the preferences of foreign countries. How can the effectiveness of such unilateral action be improved? This article offers a game-theoretic analysis of the value of combining unilateral action with trade sanctions, or policies that force foreign exporters to comply with domestic environmental regulations. Trade sanctions can significantly improve the effectiveness of unilateral action, but only when (1) they induce clean technology adoption by exporters in targeted countries and (2) this reduces the cost of clean technology elsewhere in the economy through intersectoral technology spillovers.

The rapid upswing in the number of specialised international courts and tribunals (in areas such as trade, human rights, law of the sea, criminal justice and environment) can be perceived as an attempt by sovereign States to maintain the viability of ICTs in light of perplexity in international relations, growing recognition of peaceful co-existence, quest for institutionalised cooperation and emergence of some of the “common concerns of humankind”, as well as the “duty to cooperate”. The article has sought to make sense of the emergence of ICTs as the “New Environmental Sentinels” and what it portends for our common future. ABSTRACT Offshore oil and gas developing projects have been started on the Sakhalin shelf and the sea of Okhotsk. These large scale developing projects require multi-national cooperative spill response, then agreements for emergency occasions have to be ratified between neighbor countries under international schemes such as Northwest Pacific Action Plan (NOWPAP) initiated by United Nations Environmental Progamme. As of the moment, there are no diplomatic agreements concerning with oil spill response between stakeholder counties, then custom clearance and other international migration procedure will be an obstacle for exchanging both materials and professionals. A comparative analysis of oil spill contingency plans of Russia, Korea and Japan resulted in some clear differences in these countries approaches. The Korean National Contingency Plan explicitly determines the roles of an ‘on-scene coordinator’ who is a unique organizer for oil spill response. On the other hands, the same kind of Japanese plan does not even contain a word of such ‘on-scene coordinator’. For the Russian case, they have U. S. like Federal Emergency Management Agency, but allocation of roles between this agency and Ministry of Transport are still ambiguous.
