Abstract:
Abstract Traffic violations are important factors that increase the risk of road accidents. Therefore, targeted and appropriate policy measures to improve compliance with road traffic regulations need to be developed. The purpose of this study is to determine the level of compliance of road users and strategic concepts of law enforcement that are able to improve compliance of road users and traffic safety. Secondary data used in this study were obtained from Polrestabes Bandung. The existing data shows that, in the past 10 years, traffic accidents that occurred in the City of Bandung have claimed the average death toll of 200 people per year. Overall, a single measure of law enforcement has proved insufficient to substantially reduce the risk of accidents in the long run. Law enforcement strategies that combine several policies to improve compliance of road users are generally more efficient. Keywords: traffic safety, traffic accidents, law enforcement, road user compliance Abstrak Pelanggaran lalu lintas merupakan suatu faktor penting yang meningkatkan risiko kecelakaan di jalan. Karena itu, langkah-langkah kebijakan yang tepat sasaran dan tepat guna untuk meningkatkan kepatuhan terhadap peraturan lalu lintas jalan perlu dikembangkan. Tujuan studi ini adalah untuk mengetahui tingkat kepatuhan pengguna jalan dan konsep strategis penegakan hukum yang mampu meningkatkan kepatuhan pengguna jalan dan keselamatan lalu lintas. Data sekunder yang digunakan pada studi ini diperoleh dari Polrestabes Bandung. Data yang ada menunjukkan bahwa dalam kurun waktu 10 tahun terakhir kecelakaan lalu lintas yang terjadi di Kota Bandung telah merenggut korban meninggal rata-rata 200 orang per tahun. Secara keseluruhan, ukuran penegakan hukum tunggal terbukti tidak cukup untuk secara substansial mengurangi risiko kecelakaan dalam jangka panjang. Strategi penegakan hukum yang menggabungkan beberapa kebijakan untuk meningkatkan kepatuhan pengguna jalan umumnya lebih efisien. Abstract:
The cornerstone of cartel enforcement in the United States and elsewhere is a commitment to the lenient prosecution of early confessors. A burgeoning game-theoretical literature is ambiguous regarding the impacts of leniency. I develop a theoretical model of cartel behavior that provides empirical predictions and moment conditions, and apply the model to the complete set of indictments and information reports issued over a 20-year span. Statistical tests are consistent with the notion that leniency enhances deterrence and detection capabilities. The results have implications for market efficiency and enforcement efforts against cartels and other forms of organized crime. (JEL D43, L12, L13, K21)

Abstract:
How do multilateral institutions influence the strategic choices and actions of international managers? This paper addresses the question by exploring the impact of the World Trade Organization's (WTO) decision-making process on multinational enterprises (MNEs). We discuss the three phases of the WTO decision-making lifecycle - the formulation of trade rules, the implementation of those rules, and the enforcement of the rules – and propose a strategic adjustment framework for understanding how companies alter their strategies and structures in response to the WTO's rules and operations. We argue that the increased relevance of multilateral rules and enforcement mechanisms – embodied in the WTO - is an important influence on MNE strategies and structures because of the increasing embeddedness of the WTO in national levels of regulation. We illustrate this through examples taken from the pharmaceutical, textiles and sugar industries sectors that have witnessed substantial multilateral regulation.

Abstract:
This paper shall examine the role of gender and type of vehicle most frequently used by road users (car and motorcycle) in relation to their awareness and attitude towards traffic enforcement. These two factors, namely role of gender and vehicle type, have not been fully understood especially in the context of enforcement efforts. The study includes analysis of survey data from a perception study on OPS Raya Aidilfitri 2016 traffic enforcement during festive season. Nonparametric testing and mean analysis were performed to determine any association between gender and vehicle with visibility (awareness) and attitude toward enforcement activities. The findings suggest that road users specifically car drivers and motorcyclists moderately agree with the effectiveness of such enforcement efforts. Male respondents and car drivers were considerably more aware of enforcement activities compared to female respondents and motorcyclists. In addition, females were found to be more favourable in their attitude towards enforcement compared to males. Gender and vehicle use significantly influenced road users' awareness and attitude to enforcement. Thus, the authority and agencies involved in traffic enforcement should consider strategies to incorporate these variables in order to increase effectiveness of enforcement efforts. For instance, enforcers may consider placing enforcement signage and conduct roadside checks in more strategic locations to increase visibility to road users.

Over the past decade, there has been renewed interest in and commitment to resolving the endemic problem of statelessness, most clearly exemplified by the United Nations High Commissioner for Refugees’ Global Action Plan to End Statelessness 2014-24, which sets out to end statelessness by 2024. Despite the plethora of recent attention to questions of citizenship, its converse, the problem of statelessness and its effect on children, has not been adequately investigated. This paper attempts to delineate the causes of childhood statelessness in particular and to analyze the international legal framework for reducing and preventing it. It examines how statelessness is created, how it persists and why it brings with it the deprivations it does. It then subjects the customary and modern international legal norms governing childhood statelessness and enforcement strategies at Global level to close scrutiny and identifies the clearly discernible drawbacks and road blocks. It concludes with suggestions, inter alia, to make the jus soli citizenship a mandatory default clause in the citizenship laws of every country, to further prioritize birth registration and data collection and to strengthen the UPR process and reporting procedure.

Abstract:
The recent crisis of 2008-2009 induced by widespread financial fraud, demands a rethinking of the role of corporate governance in each country. My research focuses on whistleblowing – the third party enforcement strategy based on those who report questionable corporate governance or accounting incidents both to outside authorities and in house - as a regulatory strategy to prevent financial fraud, from both an economic and a comparative perspective. More precisely, it aims at better understanding the structure and the function of whistleblowing regulations in the U.S. system, with the further goal of considering whether such regulations would work in the Italian corporate legal system. Despite the absence, in the Italian legal system, of corporate whistleblowing provisions, seems possible to figure out several duties of disclosure of corporate irregularities for internal watchdogs and a widespread use of the voluntary corporate whistleblowing strategy that offer the intuition that could be useful insert corporate mandatory whistleblowing provisions also in the organizational set up regulation.

Abstract:
Senior law enforcement leaders are looking for leadership training strategies to develop future law enforcement leaders. The purpose of this single case study was to explore U.S. law enforcement leaders' training strategies to develop future leaders. The sample was comprised of 18 senior Northern Virginia executive law enforcement leaders who have leadership development strategies currently in use. The conceptual framework for this study was human capital theory. The data collection process included semistructured interviews, a review of training documentation, and direct observation related to leadership development. Based on methodological triangulation of the data sources and analysis of the data, 3 emergent themes were identified. Recruitment, retention, and mentoring surfaced from recruiting officers for managerial leadership positions. Training and technology grew out of the need to optimize training resources and incorporate new training solutions. Strategic partnerships stemmed from the opportunities for partnering and joint training exercises with other law enforcement organizations. Although this was a single case study, the findings of this study have utility for other, similar contexts. Specifically, these findings suggest that including leadership training strategies in training programs may contribute to social change by providing other law enforcement leaders with the training strategies that result in safer communities.

Abstract:
As an FBI Agent leading the FBI National Executive Institute (NEI) I met a number of law enforcement leaders who, after becoming the chief their police department, related that they thought they knew what the chiefs’ job was until the first day they took that position. Contemporaneously, I learned from one of my NEI students, who had also attended the Army War College (AWC), that the AWC strategic leadership courses educated Colonels before they became Generals. These seminal events gave me the idea to provide the NEI with studies on strategic leadership in law enforcement. The outcome of a preliminary literature search evidenced a paucity of research for strategic leadership involving law enforcement executives and suggested the need for a study. The chiefs of police in the Major Cities Chief (MCC) Association were an appropriate population for such research since a wealth of wisdom resided in them. This study was aimed at determining what their experience taught them about two global questions that guided the inquiry: (a) What is the meaning and value of strategic leadership for law enforcement officials in today’s world, and (b) What is the developmental process involved in transitioning from tactical to strategic leader. A mailed instrument was used to gather data, including asking who the participants considered the best strategic leaders in the MCC. Ten chiefs were thereby peer-selected for face-to-face interviews that augmented, gave more richness, and more depth to the data. Findings suggest that while strategic leadership is still in process and escapes a finite definition, it includes a big picture, systems/contingency view of dealing with issues rather than incidents, continuous lifelong learning for themselves through assignments, reflection, and education, but also involves developing their followers through mentoring and delegation. This study found that the MCC perceive themselves as strategic leaders. Their transitional process of becoming a strategic leader included mentors, conflict, courage to stick with right decisions, integrity, and political perspective. Further statistical analysis and study is recommended comparing these data with other leadership studies to give a more distinct definition of and a model for strategic leadership both in law enforcement and the general population.

Dr Coyne explored case studies of strategic intelligence in the Criminal Intelligence Service Canada, Serious and Organised Crime Agency United Kingdom, Australian Crime Commission and the Australian Federal Police. This research study addressed the importance of succession planning for the organisations’ survival, which depends on the continuous supply of competent, experienced and well trained managers. It addresses the problem of determining the strategies that can be used by SARS Enforcement Port Elizabeth to manage succession planning effectively. To achieve this objective a comprehensive literature study was performed to determine the views on various succession planning models. The literature review serves as a model in the development of a guideline for SARS Enforcement Port Elizabeth management to manage succession planning. An interview was conducted with the Human Resource Manager and Middle management from the various departments who were requested to complete a questionnaire in order to determine the current practices of succession planning. The questionnaire was developed in accordance with the findings from the research. A pilot study was conducted to evaluate the relevance of the study to the problem questions and to evaluate whether the questionnaire will be easily understood. The answers of the respondents were analysed and compared to the findings of the literature study. The information obtained from the literature study and from the respondents resulted in various recommendations and conclusions.

This thesis considers two interrelated sources of blight in cities: so-called "problem properties" (PP), or properties in poor physical condition where owners have stopped performing basic maintenance, and tax-delinquent properties (TDP), where owners have stopped paying their property taxes. It focuses on how cities can be more effective in addressing PP and TDP both "before" (through proactive prevention) and "after" (through correction/collection) they emerge. Fundamentally, it argues that cities should recognize the relationship between PP and TDP, which often constitute the same properties, but, more importantly, both can be "liened up" and taken through foreclosure if their owners are truly unresponsive. These liens can be established through unpaid code violation fines and receivership liens, as well as unpaid taxes. This approach is based on the premise that cities want to receive as few properties as possible through foreclosure, because of the costs associated with holding excess land and buildings, but also want to avoid the "worst of the worst" PP and TDP becoming a blight on neighborhoods. Thus, if owners are going to refuse to correct severe code violations and/or delinquency, cities want to transfer properties to responsible owners as quickly as possible. Recognizing the links between PP and TDP enables cities to switch from a reactive to proactive approach in treating blight. This thesis also discusses barriers to addressing PP and TDP. It suggests that cities treat them through comprehensive "enforcement pathways" targeted to specific property and owner types. In particular, owners are divided into three groups: cooperative, non-cooperative, and "missing in action." This segmentation methodology recognizes that different properties present different enforcement challenges and require different strategies to return them to productive use. In addition, this thesis examines the three collection methods available to cities: public collection, contracted third-party servicing, and privatized collection (tax lien sales), and addresses a major limiting factor on tax lien sales: their dependence on private market demand. Finally, it examines how cities can be more effective in managing and disposing of their property inventories. To guide property usage and disposition timing, it suggests that cities establish a central property inventory that includes critical land and building characteristics, a property potential reuse scoring system, and a market model that segments neighborhoods and identifies spatial and temporal "inflection points." It also recommends that cities not take a "one size fits all" approach to their entire inventory, but rather select the disposition method, -- sheriff's sale/auction, RFP, third-party transfer, or land banking, -- that is most appropriate for the property type, (sub)market condition, and desired outcome(s). Finally, it outlines strategies to overcome under-management of public assets, weak markets, and financing challenges. To support the discussion about how to best manage delinquency and disposition, it includes detailed case studies of Philadelphia, New York City, and Boston.

The impact of occupational stress on employees' health and work performance costs U.S. companies $300 billion annually; work-related stress is an issue for private security organizations all over the world. The purpose of this single case study was to explore strategies private security organizational leaders used to mitigate private security officers' occupational stress. The study participants were 4 leaders of a private security organization in Bahrain who had a minimum of 5 years of experience in the private security field and had addressed occupational stress successfully. The human capital theory was the conceptual framework used for this study. Data were collected using semistructured interviews and review of archival documents. Yin's 5-step data analysis plan was applied to the data to generate 4 themes: private security occupational stressors, occupational stress reduction practices, leaders-officers open communication, and health protection policies. The identification and development of job stressor mitigation strategies has multiple implications for positive social change including protecting employees' well-being and increasing their working performance, productivity, and business success. Improving work performance and productivity produces opportunities for employment and supports economic growth and community goodwill. The practices of a successful organization positively influence the society by providing jobs and capital investments, which can improve the quality of life in the community.

We run a large-scale natural field experiment to evaluate alternative strategies to enforce compliance with the law. The experiment varies the text of mailings sent to potential evaders of TV license fees. We find a strong effect of mailings, leading to a substantial increase in compliance. Among different mailings, a threat treatment which makes a high detection risk salient has a significant deterrent effect. Neither appealing to morals nor imparting information about others' behavior enhances compliance on aggregate. However, the information condition has a weak positive effect in municipalities where evasion is believed to be common. (authors' abstract)

Extensive research has highlighted the positive and exponential relationship between vehicle speed and crash risk and severity. Speed enforcement policies and practices throughout the world have developed dramatically as new technology becomes available, however speeding remains a pervasive problem internationally that significantly contributes to road trauma. This paper adopted a three-pronged approach to review speed enforcement policies and practices by: (i) describing and comparing policies and practices adopted in a cross-section of international jurisdictions; (ii) reviewing the available empirical evidence evaluating the effectiveness of various approaches; and, (iii) providing recommendations for the optimisation speed enforcement. The review shows the enforcement strategies adopted in various countries differ both in terms of the approaches used and how they are specifically applied. The literature review suggests strong and consistent evidence that police speed enforcement, in particular speed cameras, can be an effective tool for reducing vehicle speeds and subsequent traffic crashes. Drawing from this evidence, recommendations for best practice are proposed, including the specific instances in which various speed enforcement approaches typically produce the greatest road safety benefits, and perhaps most importantly, that speed enforcement programs must utilise a variety of strategies tailored to specific situations, rather than a one-size-fits-all approach.

The regimes for the control of weapons of mass destruction (WMD) are essential ingredients of the global order. Yet this order is currently in transition: the bipolarity of the Cold War has given way to a more complex, multipolar world order characterized by conflicts of interest and great power competition rather than cooperative security. This competition brings with it rising strategic uncertainties which endanger stability and have far reaching implications for WMD-related agreements. To better understand the implications of this changing global context for WMD arms control and disarmament measures this report looks at the past, present and future prospects for WMD-related treaties. The report begins by outlining four broad yet interlinked approaches to arms control and disarmament before considering how these have been applied to chemical, biological and nuclear weapons in the past and how these measures could be applied in the future.

Discussions of extremist ideologies naturally focus on how in-groups criticize and attack out-groups. But many important extremist ideological texts are disproportionately focused criticizing their own in-group. This research report will use linkage-based analysis to examine Siege, a White nationalist tract that has played an important role shaping modern neo-Nazi movements, including such violent organizations as Atomwaffen Division and The Base. While Siege strongly attacks out-groups, including Jewish and Black people, the book is overwhelmingly a critique of how the White people of its in-group fall short of Nazi ideals. Siege’s central proposition—that the White in-group is disappointing, deeply corrupt, and complacent—shapes its argument for an “accelerationist” strategy to hasten the collapse of society in order to build something entirely new. Finally, this report briefly reviews comparable extremist texts from other movements to draw insights about how in-group critiques shape extremist strategies. These insights offer policymakers and law enforcement tools to anticipate and counter violent extremist strategies. They also highlight less-obvious avenues for potential counter-extremist interventions and messaging campaigns.

In the face of content takedown and account suspensions on the biggest social media platforms, terrorist groups and their supporters have resorted to the use of file-sharing sites to ensure stable access to their propaganda. Amongst those to have employed this strategy are supporters of the so-called Islamic State (IS). Yet, while studies have repeatedly highlighted the key role that file-sharing platforms play in the dissemination of IS propaganda, there has been little investigation of the strategic considerations that may influence the choice of file-sharing sites from the many available. To address this, this report uses data gathered from 13 public IS Telegram channels over a 45-day period in July - September 2021 to assess three possible strategic considerations: the features offered by different file-sharing sites (such as data storage capacity, maximum upload size, and password file protection); a platform’s enforcement activity; and the ability to generate large banks of URLs quickly and conveniently. Based on these findings, the report proposes a four-pronged strategy to combat the exploitation of file-sharing sites by supporters of IS and other terrorist groups: remove terrorist content at the point of upload; impede the automated generation and dissemination of banks of URLs; disrupt the posting of these URLs on other platforms; and redirect users to other content and support services.

The past decade has witnessed a surge in international interest in the importance of tax morale. This is often defined, broadly, as taxpayer’s ‘non-pecuniary motivations for tax compliance’ (Luttmer and Singhal 2014: 150) – as a key component of strategies for strengthening tax compliance in lower-income countries. Whereas classic models of tax compliance focused on the importance of the threat of enforcement and the cost of compliance in shaping compliance, compliance decisions are also significantly shaped by non-pecuniary motivations. They can, for example, be an intrinsic commitment to paying taxes, expectations of reciprocity from government, or broader social norms. This has been reflected in growing interest in strategies for strengthening tax morale in order to encourage quasi-voluntary tax compliance (Prichard et al. 2019). A significant part of this literature has relied on surveys to measure taxpayer attitudes towards tax compliance (tax morale), and, in turn, to identify factors associated with higher or lower levels of reported tax morale.

Sexual assault is a violent crime that traumatizes individual victims and endangers entire communities. Every victim of sexual assault deserves an opportunity for justice and access to the resources they need to recover from this trauma. In addition, many perpetrators of sexual assaults are serial offenders who also commit other violent crimes, including armed robberies, aggravated assaults, burglary, domestic violence, and homicides, against strangers and acquaintances. Criminal justice agencies have the power to create a strategic, sustainable plan for an improved response to sexual assault that aligns with current best practices and national recommendations. In this document, we define an “improved response” as an approach that supports effective investigation and prosecution of sexual assault cases, holds perpetrators accountable, and promotes healing and recovery for victims of sexual assault. This guide will help prosecutor and law enforcement agencies create a process with milestones, goals, and suggested actions, all designed to support a successful and sustainable approach for addressing sexual assault cases. Improving the criminal justice system’s response to sexual assault ultimately improves public safety and promotes trust between criminal justice agencies and the communities they serve.

In recent years, innovative mobility and shifts in travel and consumption behavior are changing how people access and use the curb. Shared mobility—the shared use of a vehicle, bicycle, scooter, or other mode—coupled with outdoor dining, curbside pick-up, and robotic delivery are creating new needs related to the planning, management, and enforcement of curb access. This study examines curb planning and management from several angles, such as safety, social equity, and multimodal connections. This research employs a multi-method approach to identify the changing needs for curb space management and how to meet these needs through new planning and implementation policies and strategies. As part of this study, the authors conducted 23 interviews. Respondents were chosen to represent public, private, and non-profit sector perspectives. Additionally, the authors employed a survey of 1,033 curb users and 241 taxi, transportation network company (TNC), and public transportation drivers. The study finds that changes in mode choice and curbside use can result in a variety of impacts on access, social equity, congestion, device management, pick-up and drop-off, and goods delivery, to name a few. The curb also has the potential to be disrupted by emerging modes, such as robotic delivery vehicles (also known as personal delivery devices) and automated vehicles. As these emerging developments continue to impact the curb, it is becoming increasingly important for policymakers to have an appropriate framework for planning and managing curb space in urban areas.
