Full textThe french and quebecer's systems of child's protection have separated the principte of the enacing of protection based on one and only institution. The child's protection system is double and implicate a convergent action of administrative and judicial institution. The domain of the intervention is different in france and in quebec. These countries are agreed and recognize. The necessity of the intervention of local authorities and law's courts when the welfare, security and development of the child is in changer. The comparative study has proved that it could be aduled on other wean that the part of system is based on the concept called "dejudiciarisation" which privilege the precedence of social action before the jurisdiction thowever, in the two systems, the news foots have to be consdered by social welfare services and juridictions. The united nations conventioin of the child heralding the new area in the development of the children's rights. They have to tatk into account the right of the child to be heared in the proceedings and welfave of the child with child's parents

Full textA comparative study between French and Quebec Law reveals that under French Law, less importance is given to the protection of the child than to his rights. Apart from specific procedures such as youth protection or penal procedures, access to justice for minors is still limited. The minor may only address the tribunal individually in exceptional circumstances. The right to be heard, recognized under the January 8th, 1993 Act, is still not applied properly. Quebec Law has found a balance between the protection a child needs and the exercice of his rights. The diversity of the systems developed under Quebec Law enables the child's access to the tribunal while preserving his interests

Full textAs regards child protection, speech of participation of the minor in his own protection is to consider this one like a subject of active right and not only like one object of protection. In this direction, the International Convention of the Children's rights affirmed the capacity of the child to be taken part in his own protection, guaranteed by its right to the expression. Consequently, the child to be protected is not simply any more perceived like a vulnerable human being requiring a State aid (passive subject of right), before the placement, during and after this one. The minor is recognized as a citizen in becoming ( active subject of right) to which a series of rights are conferred such as the right to take part in the decisions which relate to it according to its age and its degree of understanding, the right to freedom to think, of conscience and religion or the right to reach information diversified and aiming at promoting its wellness physics, mental and social. Accordingly, it is by the means of the exercise of its rights that the protected child can become the actor of his own protection

Full textThe scientific development of HIV/AIDS cannot be told without its legal aspect. Indeed, the pandemic has raised many questions in terms of law, which led to the adoption of numerous legislations. Thus, the "serophobia", result of the powerlessness of medicine and science regarding this disease that seemed inexorable and of the fear due to the uncertainty about its origins and prophylaxis, has been followed by drastic reactions and an anathema thrown on certain populations. However, this medical scourge, that also became a social one, has permitted to fight against some injustices. Indeed, while since the nineteenth century, the response to an epidemic was very authoritarian, HIV/AIDS has changed the game and introduced a new concept of control of the latter, different from the classic design. A new perspective consisting of a more global thinking, was then introduced. From this, the respect for individual rights was no longer regarded as being contrary to public interest, but as a necessary element of public health. Therefore, after having been a Pandora's box for human rights violations, the response to HIV/AIDS has become, increasingly, a way to fight against the legal, traditional or religious national obstacles to the implementation of a legal protection equal to all. But despite this progress, some populations remain highly vulnerable to the infection. Thus, the scientific and legal story of HIV is far from over

Full textOn a daily basis, populations are exposed to a complex mixture of air pollutants such as fine particulate matters, sulphur dioxide and nitrogen dioxide that have been associated with a range of health effects namely respiratory and cardiovascular effects. Emitting sources’ distribution, landscape characteristics (i.e. infrastructure, topography) and thus the complex mixture of air pollutants and populations’ exposure vary greatly in space and time. This thesis aimed to document social inequalities in exposure to industrial air emissions of pollutants and associations between daily exposure to these pollutants and cardiovascular mortality in vulnerable populations living near these sources. Thus, using an ecological design, we analyzed Pearson’s correlations between deprivation level (using four indicators) of 2,189 primary and secondary Quebec schools and their exposure to industrial emissions in a radius of 2.5 to 7.5 km. Our results suggest inequalities in exposure to industrial air emissions at school in children. These associations were not consistent among all four indicators of deprivation. Besides, using a case-crossover design, we evaluated the associations between exposure to industrial air pollutants using both emission exposure estimates and sensor levels and deaths from cardiovascular diseases in the elderly living near industrial sources (<7.5 km). We found no convincing evidence of association. Our results varied greatly which could be caused by the limits of our study related to estimating exposure. Further studies using improved exposure estimates are necessary to support our findings.
