Abstract:
This edited volume is based on the European Law Institute’s (ELI) project ‘Rescue of Business in Insolvency Law’. The project ran from 2013 to 2017 under the auspices of the ELI and was conducted by Bob Wessels and Stephan Madaus, who were assisted by Gert-Jan Boon. The study sought to design (elements of) a legal framework that will enable the further development of coherent and functional rules for business rescue in Europe. This includes certain statutory procedures that could better enable parties to negotiate solutions where a business becomes financially distressed. Such a framework also includes rules to determine in which procedures and under which conditions an enforceable solution can be imposed upon creditors and other stakeholders despite their lack of consent. The project had a broad scope, and extended to consider frameworks that can be used by (non-financial) businesses out of court, and in a pre-insolvency context. Part I of this book, the ELI Instrument as approved by the ELI Council and General Assembly, features 115 recommendations on a wide variety of themes affected by the rescue of financially distressed businesses, such as the legal rules for professions and courts, treatment and ranking of creditors’ claims, contract, corporate and labour law as well as laws relating to transaction avoidance. Part II consists of national reports that sketch the legal landscape in 13 States and of an ‘Inventory Report on International Recommendations from Standard-Setting Organisations’, both of which provided insight for the drafting of the Instrument. This volume is designed to assist those involved in a process of law reform and those setting standards for soft law in the business rescue context.

While some commentators claim that the rules of State responsibility are irrelevant in applying the European Convention on Human Rights, the rules of State responsibility operate on the completely contrary assumption that they fully apply in the human rights context. The jurisprudence of the European Court of Human Rights sits somewhere between these two positions. In some cases, the State responsibility rules have not been applied, such as when the Court developed a novel ‘acquiescence or connivance’ rule to hold a third State responsible for the acts of another State on its territory (El-Masri) despite Article 16 of the Articles on State Responsibility (ARSIWA); or refused to apply Article 7 of the Articles on the Responsibility International Organisations (ARIO) (Behrami). Nevertheless, more recent cases show that the Court is more fully applying the rules on State responsibility, pulling back from some of its earlier departures (Kotov; Al Nashiri).

Brozo, el payaso tenebroso (the creepy clown)—a misogynistic, alcoholic, coarse, and marginal character—is one of the most popular and influential “journalists” in Mexico. His show, El Mañanero, has been broadcast on Mexican TV since 2000, when the 71-year regime of the Partido Revolucionario Institucional (PRI) ended. Chapter 4 analyzes the carnivalesque role of Brozo as a subversive and profane court jester able to confront with impunity the elites at the heart of the Mexican power de facto: Televisa, one of the biggest media conglomerates in the world, which has a problematic adhesion to political power. Connecting with the Mexican tradition of clowns and satiric underdogs, this chapter also examines Brozo’s media performance and discursive configuration in relation to the history of institutionalized corruption and violence against journalists in Mexico.

This chapter looks briefly at the way judges are recruited in France and how and to what degree this is reflected in their way of reasoning and style of argument. It outlines the requirements for admission to the profession of being a judge in France and the methods adopted for training them. This outline is confined to professional judges, but it should be noted that, in France, commercial and employment cases are adjudicated at the first instance by lay judges. Further, judges in the administrative courts are not included in the teaching and training processes provided for by the École Nationale de la Magistrature (ENM). Administrative judges are recruited from the pool of high-ranking civil servants, many of them trained at the prestigious ENA (École Nationale d'Administration).

Pour lutter contre la pénibilité de leur périple et éviter l’ennui, ils décident de converser. S’ensuit un échange de plus de 200 pages autour de leur destination, de leur parcours personnel respectif, de la société de l’époque au sein duquel viennent s’intercaler des récits à vocation plus ludique. Telle est l’intrigue de El Pasajero, advertencias utilísimas a la vida humana, œuvre citée par bon nombre de spécialistes du Siècle d’Or qui s’attachent tous à saluer ses qualités littéraires et à laquelle aucune étude littéraire de fond n’a été consacrée. Comment expliquer un tel paradoxe? El Pasajero propose un caléidoscope de la société de l’époque, d’où l’orientation sociologique de la plupart des études réalisées sur ce texte. La mauvaise presse de son auteur connu pour son tempérament peu amène et pour son opposition à Cervantès, a pu y contribuer également de manière plus tangentielle. Enfin et surtout, la richesse textuelle, littéraire et idéologique de El Pasajero peut avoir freiné certaines ambitions analytiques. Le texte de Figueroa est d’une nature profondément hybride, il se caractérise par un oscillement perpétuel entre inspiration italienne, accents décaméroniens, emprunts transtextuels et substrat folklorique hispanique. Il joue sur la porosité des frontières entre réalité et fiction pour élaborer un texte dont tous les éléments semblent dialoguer et entre lesquels le lecteur passe comme sur les pierres d’un gué. En fin de compte, El Pasajero est un véritable laboratoire d’expérimentation littéraire où affleurent traditions littéraires ancrées et propositions d’écriture plus innovantes. Ce dialogue perpétuel est décisif dans l’œuvre : au-delà d’un premier dialogue évident entre les personnages, le texte en propose d’autres en filigrane, entre les formes et les genres littéraires. Ils fonctionnent comme autant d’éléments structurants au sein de cette œuvre pensée comme un lieu de passage où se mêlent expérimentations littéraires et réflexions sociétales. El Pasajero peut parfois laisser le lecteur perplexe, c’est un fait. Il fait, néanmoins, partie de ces textes qui fascinent et qui n’ont pas encore révélé tous leurs secrets. Une chose est certaine : El Pasajero ne laisse pas indifférent et mérite qu’on lui consacre une étude de fond. C’est ce que se propose de faire cet ouvrage…

This GSoD In Focus provides a brief overview of the global state of democracy at the end of 2019, prior to the outbreak of the pandemic, and assesses some of the preliminary impacts that the pandemic has had on democracy globally in 2020. Key findings include: • To address the COVID-19 pandemic, starting in March 2020, more than half the countries in the world (59 per cent) had declared a national state of emergency (SoE), enabling them to take drastic temporary (and in most cases necessary) measures to fight the pandemic. These measures have included in most cases temporarily curbing basic civil liberties, such as freedom of assembly and movement, and in some cases postponing elections. • International IDEA’s Global Monitor of COVID-19’s Impact on Democracy and Human Rights finds that more than half the countries in the world (61 per cent) had, by the end of November 2020, implemented measures to curb COVID-19 that were concerning from a democracy and human rights perspective. These violated democratic standards because they were either disproportionate, illegal, indefinite or unnecessary in relation to the health threat. • Concerning developments have been more common in countries that were already non-democratic prior to the pandemic (90 per cent) and less common, although still quite widespread, in democracies (43 per cent). • The democracies that have implemented democratically concerning measures are those that were already ailing before the pandemic. More than two-thirds were democracies that were either backsliding, eroding or weak prior to the pandemic. • Almost a year since the first outbreak of COVID-19, the pandemic seems to have deepened autocratization in most of the countries that were already non-democratic. However, in at least 3 of those countries (Belarus, Kyrgyzstan, Thailand), the pandemic has also tapped into existing simmering citizen discontent and may have been the tipping point in unleashing massive protest waves demanding democratic reform. The pandemic has also seemingly deepened democratic backsliding processes and exposed the democratic weakness and fragility of new or re-transitioned democracies (Malaysia, Mali, Myanmar, Sri Lanka). In a few cases, the pandemic has also exposed countries that showed no apparent sign of democratically ailing prior to the pandemic, but where concerning democratic developments have occurred during the pandemic and which risk seeing a significant deterioration in their democratic quality as a result (i.e. Argentina, El Salvador). • The aspects of democracy that have seen the most concerning developments during the pandemic are freedom of expression, media integrity, and personal integrity and security. However, the freedoms that have been restricted across most countries are freedom of movement and assembly. Another core democratic process that has been heavily affected by the pandemic is the electoral, with half the elections scheduled between February and December 2020 postponed due to the pandemic. • The pandemic has also shown democracy’s resilience and capacity for renovation. Innovation through accelerated digitalization has occurred across most regions of the world. And democratic institutions, such as parliaments, courts, electoral commissions, political parties, media and civil society actors, have fought back against attempts at executive overreach and democratic trampling or collaborated to ensure effective responses to the pandemic. The review of the state of democracy during the COVID-19 pandemic in 2020 uses qualitative analysis and data of events and trends in the region collected through International IDEA’s Global Monitor of COVID-19’s Impact on Democracy and Human Rights, an initiative co-funded by the European Union.
