AbstractIn November 1876, two Oneida Indians, Abram Elm and Lewis Doxtator, were arrested for voting illegally in the twenty-third congressional district election in New York. Their trial was held the next year in a federal court in the Northern District of New York, the same venue where Susan B. Anthony had been tried and convicted on a similar charge four years earlier. This essay focuses on the significance of the historically neglected United States v. Elm case, its origins, why the decision was rendered, and its short-term and long-term impact. Importantly, United States v. Elm has cast a long shadow over Supreme Court decisions—from the time of Elk v. Wilkins in 1884 right up to City of Sherrill v. Oneida Indian Nation in New York in 2005. In going to the polls, the two Native Americans were not trying to deny their Oneida identity; they saw themselves as dual citizens advocating a different course of resistance.

Until recently, the German courts did not regard the contract of suretyship as subject to the precepts of commutative justice. This attitude prevailed even when the contract was unduly burdensome for the surety. A startling decision of the Federal Constitutional Court from October 1993 has changed the legal position. It enjoined the civil courts, when applying the general provisions of the BGB (such as the “contra bonos mores” clause), to pay due attention to the guarantee of the autonomy of private individuals, as enshrined in art 2 I of the Basic Law. Such autonomy is not always consistent with unrestricted freedom of contract. The civil courts are thus bound to intervene in unusually burdensome contracts where there is inequality of bargaining power. The present article analyses the general background and the consequences of this decision. It examines the way in which the Federal Supreme Court now deals with contracts of suretyship by close family members. Moreover, it draws attention to significant changes in judicial attitude concerning two related problems which have also resulted in increased protection of the surety: the tightening up of the judicial control of so-called declarations of purpose; and the stricter attitude adopted by the Federal Supreme Court towards the form requirement for suretyship contracts prescribed by the BGB.

Scotland is said to enjoy an economy rich in intellectual property (“IP”), but reported decisions from the Court of Session in IP matters are rare. This article analyses a new dataset of Court of Session IP actions compiled from court records for the period from 2008 to 2014, alongside a survey and interviews conducted among Scottish legal practitioners working in the field of IP. The research provides insights into the Court of Session's IP caseload, parties and their sectors, the subject matter of claims and remedies sought. This article discusses key themes emerging from the research data against the broader context of civil justice reform and jurisdictional competition between the Scottish, English and other courts.

Private enforcement through private party litigation is to play a central role in the enforcement of the European Community competition rules. However, there has so far been little case-law in the national courts to explore in detail the range of issues concerning the award of remedies for breach of the competition rules, principally arts 81 and 82 of the EC Treaty. This article considers the particular position of a cocontractor seeking to claim damages in unjustified enrichment in respect of a contract which is prohibited by art 81 and illegal. The Scots law position on the general question of recovery of damages with regard to an illegal contract is discussed, together with some recent English cases involving a breach of art 81. The article looks at the development of Community jurisprudence laying down the requirement for national courts to provide legal redress and to ensure the effectiveness of Community law. Finally, it considers the recent ruling by the European Court of Justice in Courage v Crehan on a reference from the Court of Appeal.

While the origins of Scots law's unique “not proven” verdict in criminal cases are well-documented, there has been no systematic examination of its use and interpretation over time. Although the verdict has frequently been the subject of controversy in the courts, legal journals or public debate, analysis of it has tended to be sporadic and focused on specific controversies arising at given points in time. As a result, discussions about the verdict's future are often cyclical, meaning that the debate tends to repeat itself rather than advancing over time. This article fills this gap in the literature. Based on a comprehensive review of sources including (but not limited to) judicial statistics, court decisions, periodical literature and Parliamentary debates, it charts the evidence on the use of the not proven verdict by juries, the approach of the courts, and debates both on how the verdict should be interpreted and whether it should be retained.

The Environmental Liability Directive (ELD) focuses on remediating environmental damage. To assess environmental damage it uses existing assessment systems, and the constructs that are at the centre of these systems. One of these is ‘ecological status’ in the context of the Water Framework Directive (WFD). The ELD refers to the WFD with respect to what ‘water damage’ concerns, without specifying what it means and it offers no threshold for when deterioration is significant enough to count as ‘water damage’. A definition of ‘water damage’ is developed, based on the European Court of Justice’s latest rulings, which clarify when the deterioration of a body of water is so significant that it passes from ‘deterioration’ under the WFD, to ‘water damage’ under the ELD.

This paper reports on a study that uses a novel methodology, the minimal part identification task, in order to probe the relationship between morphosyntax and interpretation. English, Korean and Mandarin Chinese differ from one another with regard to the count/mass distinction. Building on prior research but using a new methodology, this study examines whether speakers of these three languages also differ in how they interpret count vs. mass nouns. The findings, while uncovering some language-specific effects of morphosyntax, point to the importance of universality, and suggest that interpretation drives morphosyntax rather than the other way around.

Hom pretén estudiar la transcendència que efectivament tenien els greuges que es presentaven a la Cort General de Catalunya a l'Edat Moderna. Si bé des dels postulats que poden considerar-se tradicionals de la historiografia -il.lustrada i romàntica-, hom els ha anat atribuint un paper Cabdal en el desenrotllament de les sessions de les diverses reunions de cort, la consulta de la documentació n'oferia un grau de divergència notable, l'estudi del qual calia no negligir.

S'inicia la memòria amb la constatació que els greuges de cort catalans no són una realitat aïllada en el món europeu occidental, sinó que s'insereixen en el conjunt de mecanismes -amb funcions que podem considerar similars-que les Assemblees dels diferents territoris del món europeu occidental han anat articulant al llarg de la seva història devant de la presència de la institución monàrquica. Amb tot, s'adverteix que dintre d'aquesta gran categoria en què s'insereixen, els greuges de cort presenten trets distintius que els confereixen una fesomia pròpia.

L'estudi de la Cort General com a marc institucional natural en què es plantegen els greuges permet d'analitzar els tràmits i les diferents atribucions de l'assemblea i de les vies de gràcia i de justícia de l'assemblea, que es destaquen particularment.

S'analitzen les normes (constitucions i capítols de cort, sobretot) que regulen aspectes de la satisfacció dels greuges, tant si han estat compilades de les diferents edicions de les Constitucions i altres drets de Cathalunya, com si no ho han estat. Quant a aquest segon grup mereixen una atenció especial, i en són objecte d'estudi, dos tipus de documents fins ara pràcticament negligits -atès que no es publicaven- en aquelles aproximacions que s'han fet a la vida de la institució.

En primer lloc, la suplicació que els estaments presenten al monarca comunicant-li els provisors que cada braç ha escollit, per tal que el monarca nomeni els seus; de l'altra, el document on ho fa, la provisió subsegüent. Endemés, és en aquest pas el punt on el monarca delega el seu poder, amb la col.laboració de la cort, per tal que els jutges de greuges coneguin de les reclamacions presentades.

En segon lloc, el capítol del donatiu. Ultra delimitar el concepte de donatiu (o també servei, oferta, subsidi), l'import que es concedeix al monarca i en quins terminis ha de ser recaptat, s'estudien les relacions entre el donatiu i la legislació de la cort, i, és clar, entre el donatiu i els greuges (i, doncs, també entre la legislació i els greuges).

Després d'una aproximació detallada als particulars sentenciats en les corts celebrades des del 1503 fins a 1537, s'analitza la competència per a resoldre els greuges, el concepte de greuge de cort i es delimita el concepte de greuge particular -objecte de 'l'estudi- per distinguir-lo del de greuge general, i els casos en què és o no és procedent de presentar-ne. L'estudi dels diversos tràmits que acompanyen les actuacions posterios al nomenament de la comissió de proveïdors de grueges i una aproximación als aspectes del procés que s'instrueix per a resoldre'ls, precedeixen l'estudi de la sentència de greuges. Dita sentència presenta la peculiaritat que és concebuda com una sentència única dictada conjuntament per tota la comissió de proveïdors, en cada una de les reclamacions presentades i resoltes n'esdevè un dels múltiples capítols que la formen. Es fa una anàlisi del tràmit d'execució de sentència, per comprovar la trascendència efectiva de dit instrument, la qual permet aclarir els desfasaments que es produeixen entre la publicació de la sentència i el pagament -efectiu- de les quantitats que hi eren fixades.

Es clou l'estudi amb una valoració de la institució i amb la preceptiva relació de conclusions, ultra els apèndixs documentals i el repertori bibliogràfic requerits.
The purpose of the research is to analyze the institution of the "gravamina" (claims, grievances, petitions; i.e., in Catalan "greuges") presented to the king in the Catalan parliamentary assembly meetings mainly during the 16th Century, focusing the research in those claims issued by private individuals instead of those considered of general interest that lead to some types of law (i.e. the so called "Constitucions y altres drets de Cathalunya"), where are complied under the abolished dispositions section, but also in the proceedings of each assembly, as far as in every reunion it was neede to renew the commitment between the subjects and the king, and, equally, to rule the way the claims should be treated; for this purpose, it was usted the "capitol del donatiu" (the chapter of the subsidy) and the delegation of power from the king and the assembly to the commission in charge of the claims.

It is also shown that the largest part of private claims is not based upon what the largest part of private claims is not based upon what we should consider "gravamina" (grievances, or claims, or petitions) in a true sense of the word, but it claims lying mainly on salary debts from king to his officers, or on similar cases related to other king's debts, instead of the type of claims that many 19th Century historians (some of them Catalan)m would have liked them to be. A short description of those "gravamina" sentenced between 1503 and 1537 can be found in chapter IV.

The research has its sources and bibliography and two appendixes; the first one including the most interesting documents found related to the matter; the second one, listing all the private individuals that presented claims in the Catalan assembly during the 16th Century and reached a verdict.

For centuries the United States has received waves of immigrants. In fact, many scholars would argue that America is a nation of immigrants. At the height of foreign migration to the US - late nineteenth, early twentieth century - many of America's Northeast cities became gateways or ports-of-entry for generations of immigrants. Upon arrival in these gateway cities, most immigrants, but particularly low-income immigrants, could rely upon the existence of the port-of-entry neighborhood - a neighborhood in which the affordability of the housing stock afforded recent migrants the opportunity to live in close proximity to someone with whom they shared a common culture, experience, and language. After World War II, however, the US rapidly expanded, and with this expansion came the destruction of many port-of-entry neighborhoods. In fact, because many port-of-entry neighborhoods were often situated in more economically depressed urban communities, under programs like Urban Renewal they were labeled "slums," which hastened their decline. Today, many port-of-entry neighborhoods are still under assault. In more recent times, however, the economy - rapid gentrification and stronger real estate markets - has replaced Urban Renewal. This has caused many low-income immigrants to seek alternative affordable housing solutions for themselves and their families. One area of the real estate market that some immigrants have chosen to occupy has historically been home to different waves of low-income individuals: public housing. Public housing has experienced many different types of residents; newly arrived immigrants present themselves as a new group. This thesis is a case study of a current example of the process by which a recent immigrant group, Haitians, has transformed two public housing developments in Cambridge, MA - two of the oldest government housing developments in the US: Washington Elms and Newtowne Court. I use archival and face-to-face interview data to answer two questions: Is public housing becoming a port-of-entry neighborhood for recent immigrants? (in this case, for Haitians) and, if so, what does it mean for Housing Authorities across the nation to take on the role of housing immigrants, particularly those in traditional port-of-entry cities? I find that as was the case in the old port-of-entry neighborhood, the availability of low-cost housing - in this instance public housing - provides low-income immigrants the opportunity to create new port-of-entry communities.

L'élastine, composant majeur des fibres élastiques confère aux vaisseaux sanguins leurs propriétés élastiques et régule également l'homéostasie du système vasculaire en contrôlant des processus cellulaires, tels que la prolifération et la migration cellulaire. Chez l'homme, l'hémizygotie du gène de l'élastine est responsable d'une pathologie vasculaire obstructive, la sténose aortique supravalvulaire survenant de façon isolée ou associée au syndrome de Williams-Beuren. Chez la souris, l'absence totale d'élastine (Eln-l-) conduit à une létalité périnatale, liée à une occlusion progressive du système vasculaire. En revanche, le déficit partiel (Eln+I-) n'affecte pas la longévité des animaux Eln+/-, dont les artères présentent cependant des altérations mécaniques et structurales, caractérisées par une paroi plus rigide, non épaissie, contenant des lames élastiques plus fines mais plus nombreuses, ainsi qu'un calibre artériel réduit, visibles dès la naissance et conduisant au développement d'une hypertension adaptative. Le déficit en élastine protège les souris Eln+l- de certaines manifestations liées à l'âge (épaississement pariétal, altération de la fonction vasoconstrictrice) visibles chez les animaux Eln+/+ âgés et au contraire accélère le processus de perte d'élasticité et d'intégrité physique de la paroi artérielle, ainsi qu'une altération de la fonction vasorelaxante endothéliale. Cette étude témoigne que la fonction cardiovasculaire de l'adulte ainsi que son évolution au cours du vieillissement et en particulier la susceptibilité à développer des pathologies cardiovasculaires, dépendent étroitement des conditions initiales et notamment du bon déroulement de l'élastogenèse
Elastin the main component of elastic fibres corners on the blood vessels their elastic properties and is also a key regulator of cellular processes such as proliferation and migration for maintaining vascular homeostasis. 1 humans, hemizygosity of the elastin gene is responsible for an obstructive vascular disease, the supravalvula aortic stenosis, in its isolated form or associated with the Williams-Beuren syndrome. Ln the mouse, total absence of elastin (Eln-l-) leads to a perinatal death, due to the progressive occlusion of the vascular system. On the other hand, the partial deficit of elastin (Eln+/-) does not affect the longevity of the Eln+/- animais, whose arteries however present mechanical and structural deteriorations, characterized by a more rigid wall, but not thickened, containing thinner but numerous elastic lamellas and a sm aller arterial diameter, that are already evident at birth, and lead to an adaptative hypertension. The elastin deficit protects the Eln+/- mice tram several manifestations related to ageing (arterial wall thickening, vasoconstriction alteration) visible in tl Eln+/+ aged mice and on the contrary, accelerates the aging process of 1055 of elasticity and physical integri of the arterial wall, as weil as an alteration of endothelial vasorelaxant function. This study testifies that the cardiovascular function of the adult, like its evolution during ageing and in particular susceptibility to develop cardiovascular pathologies, depend closely on the initial conditions andin particular on the good course of the elastoaenesis

O Brasil está entre os países que mais exportam couro. O segmento de couro possui importante papel na contribuição do desenvolvimento econômico de várias cidades brasileiras. O estado de São Paulo é destaque na produção de couros, juntamente como o estado do Rio Grande do Sul. Neste processo ocorre o beneficiamento do couro, sendo repassado para indústrias que elaboram roupas, sapatos, acessórios, e diversos outros produtos. Essas organizações, denominadas de agroindústrias processadoras de couro, estão em busca de uma gestão eficiente, que contemple toda produção, visando o aumento do resultado financeiro, possibilitando a continuação da atividade. Para tanto, a redução de desperdícios e ganho na qualidade são requisitos fundamentais para essa gestão. Diante da carência de estudos, a presente pesquisa tem como objetivo geral diagnosticar por meio da Lean Supply Chain Management (LSCM) aspectos de melhoria na gestão do elo curtume da cadeia do couro do Oeste Paulista. A abordagem da LSCM sendo aplicada corretamente cumpre os requisitos buscados pelas organizações. Para atingir o objetivo da pesquisa, utilizou-se como método de pesquisa o estudo de caso do tipo múltiplo, com a condução de visitas in loco e aplicação de formulário em cinco Unidades de Pesquisa, caracterizando os portes das organizações, os tipos de processos que elas fazem, quais os elementos e pilares que mais precisam de suporte referente à abordagem empregada, quais as ferramentas utilizadas que se enquadram na LSCM e os benefícios e dificuldades da aplicação. Destacam-se como resultados da coleta de dados que os pilares da Gestão da Tecnologia de Informação, Gestão Logística e Melhoria Contínua são os que mais carecem de melhorias, necessitando empregar a tecnologia da informação na comunicação com os clientes, planejar a rede logística de distribuição, direcionar equipes de trabalho para melhoria contínua. Os planos de ação para elaborar como serão realizadas as ações supramencionadas são oportunidades de futuras pesquisas.
Brazil is among the countries that export the most leather. The leather segment plays an important role in the contribution of the economic development of several Brazilian cities. The state of São Paulo is prominent in the production of leather, along with the state of Rio Grande do Sul. In this process the leather is processed, being passed on to industries that manufacture clothes, shoes, accessories, and various other products. These organizations, called leather processing agroindustries, are in search of an efficient management that contemplates all production, aiming to increase the financial result, allowing the continuation of the activity. Therefore, waste reduction and quality gain are fundamental requirements for this management. In view of the lack of studies, the present research has as general objective to diagnose, through the Lean Supply Chain Management (LSCM), aspects of improvement in the management of the tannery chain link of the leather chain of Oeste Paulista. The LSCM approach being applied correctly meets the requirements sought by organizations. In order to reach the research objective, a multiple-case study was used as the research method, with the conduction of on-site visits and application of the form in five Research Units, characterizing the organizations' sizes, the types of processes that they do, which elements and pillars most need support regarding the approach employed, which tools are used that fit the LSCM, and the benefits and difficulties of the application. It is highlighted as results of data collection that the pillars of Information Technology Management, Logistics Management and Continuous Improvement are the ones that need the most improvement, needing to use information technology in communication with customers, to plan the distribution logistics network, to direct work teams for continuous improvement. The action plans to elaborate how the aforementioned actions will be carried out are opportunities for future research.

És per això que analitza de forma exhaustiva les diverses negociacions politicofiscals que tingueren lloc entre la monarquia i la comunitat política del regne de València des de mitjan segle XIII fins a la dècada de 1360. Així, tot plegat, estudia la trajectòria d’unes transformacions estretament imbricades entre si: d’una banda, el progressiu desenvolupament de la pràctica parlamentària fins a esdevenir la principal forma de resolució de greuges entre els estaments i el monarca, i, d’una altra banda, l’evolució de la fiscalitat reial i local fins a donar lloc a uns sistemes fiscals generals i municipals que quedaren controlats pels dirigents estamentals. D’aquesta manera, mitjançant l’anàlisi d’aquells canvis, es determinen amb major detall les fases i les característiques del procés de configuració del pactisme al territori valencià.
The purpose of this thesis is to deepen the knowledge on the origins of Valencian pactism. In order to achieve that, it analyzes exhaustively the various political/fiscal negotiations that took place between the monarchy and the political community of the kingdom of Valencia from the mid-thirteenth century until the 1360’s. It is, therefore, a study on the history of transformations closely imbricated in each other: on the one hand, the gradual development of the parliamentary practice until it became the main way for resolving grievances between the king and the estates of the realm and, on the other hand, the evolution of the royal and local taxation to general and local fiscal systems that were controlled by the heads of the estates. Thus, by means of analyzing these changes, the different stages and characteristics of the configuration process of pactism in the kingdom of Valencia can be more precisely determined.

Le but principal de cette thèse était d'étudier les caractéristiques de la matière organique dissoute (MOD) dans le bassin versant de la Seine. Ce travail a été réalisé dans le cadre du programme de recherche PIREN-Seine. Les travaux présentés ici visaient plus particulièrement à identifier les sources de MOD et à suivre son évolution dans les zones d’étude. L’analyse des propriétés optiques (UV-Visible, fluorescence) de la MOD, couplée aux traitements PARAFAC et ACP, a permis de discriminer différentes sources de MOD et de mettre en évidence des variations spatio-temporelles de ses propriétés. L’axe Seine, en aval de Paris, a notamment été caractérisé par l'activité biologique la plus forte. La MOD du bassin de l’Oise a montré des caractéristiques plus "humiques", tandis que le bassin de la Marne a été caractérisé par un troisième type spécifique de MOD. Il a d’autre part été mis en évidence la présence de MODs spécifiques dans chaque zone pour les échantillons prélevés en périodes d’étiage, alors qu’une distribution homogène des composants a été obtenue pour l’ensemble des échantillons prélevés en période de crue.Le rôle environnemental des colloïdes naturels étant étroitement lié à leur taille, il a d’autre part été développé une technique analytique/séparative originale pour l’étude de ce matériel complexe, un fractionnement par couplage flux/force avec flux asymétrique (AF4). Le fractionnement par AF4 des échantillons a confirmé la variabilité spatio-temporelle en composition et en taille de la MOD d'un site de prélèvement à un autre et a permis de distinguer différentes sources de MOD colloïdale confirmant les résultats de l’étude de ses propriétés optiques
The main goal of this thesis was to investigate the characteristics of dissolvedorganic matter (DOM) within the Seine River catchment in the Northern part of France. ThisPhD thesis was performed within the framework of the PIREN-Seine research program. Theapplication of UV/visible absorbance and EEM fluorescence spectroscopy combined toPARAFAC and PCA analyses allowed us to identify different sources of DOM andhighlighted spatial and temporal variations of DOM properties. The Seine River wascharacterized by the strongest biological activity. DOM from the Oise basin seemed to havemore "humic" characteristics, while the Marne basin was characterized by a third specifictype of DOM. For samples collected during low-water periods, the distributions of the 7components determined by PARAFAC treatment varied between the studied sub-basins,highlighting different organic materials in each zone. A homogeneous distribution of thecomponents was obtained for the samples collected in period of flood.Then, a semi-quantitative asymmetrical flow field-flow fractionation (AF4) methodology wasdeveloped to fractionate DOM. The following optimized parameters were determined: across-flow rate of 2 ml min-1 during the focus step with a focusing time of 2 min and anexponential gradient of cross-flow from 3.5 to 0.2 ml min-1 during the elution step. Thefluorescence properties of various size-based fractions of DOM were evaluated by applyingthe optimized AF4 methodology to fractionate 13 samples, selected from the three sub-basins.The fluorescence properties of these fractions were analysed, allowing us to discriminatebetween the terrestrial or autochthonous origin of DOM

Cette recherche vise à étudier l'efficacité des cours d'espagnol comme langue étrangère, à partir de la perception des étudiants d’espagnol comme langue d’origine. Pour atteindre les résultats et les conclusions obtenus, cette étude qualitative compte sur la participation des répondants hispaniques qui ont appris l'espagnol à la maison, à l'école primaire, au secondaire, au cégep et/ou au collège. Les participants ont répondu à un questionnaire qui leur a permis d'exprimer leur perception à l'égard des cours d’espagnol comme langue étrangère qu'ils ont pris au cours de leur étude primaire, secondaire ou supérieure. Les résultats de cette recherche indiquent que les élèves hispaniques ne sont pas intégrés dans les classes ELE, ce qui motive les participants à poursuivre l’étude de la langue espagnole. Comme expliqué par Gardner (1985) dans sa théorie du modèle socio-éducationnel, l’acquisition des langages intervient dans un contexte culturel spécifique et elle est influencée par la croyance populaire et les différences individuelles. Ces dernières sont intégrées dans le concept du motif d'intégration, qui est composé du sens de l'intégration, de l'attitude envers la situation d'apprentissage et de la motivation. Les réponses données par les participants dans cette étude peuvent être utiles à la conception et au développement de cours et de méthodes d’apprentissage de l’espagnol pour les hispanophones d’origine. En tenant compte de leurs points de vue, les étudiantes auraient un sens plus élevé de l’intégration, ce qui influence directement leur motivation et par le fait même leur processus d’apprentissage.
The purpose of this research is to study the efficiency of Spanish courses from a Heritage Learner’s perspective. This qualitative study examines Hispanics who have learned Spanish at home, in elementary school, in high school, in CEGEP and/or in university. The participants answered a questionnaire that allowed them to express their perception of the Spanish courses that they had taken in their past. The results of this research indicate that L1/L2 users are not integrated in the Spanish classes. Participants demonstrate a reduced sense of motivation for the continuation of these types of courses. Gardner (1985) explains in his socio-educational model theory that language acquisition occurs in a specific cultural context and is influenced by cultural beliefs and individual differences. The latter are integrated in the concept of integrative motive, which is composed of the integrativeness, the attitude toward the learning situation and motivation. The answers given by the participants of this study may be of great help in the design and development of Spanish courses and books for L1/L2 users. By considering their views, students would have a higher sense of integration; an important factor that motivates students to pursue the study of Spanish.
Esta investigación tiene como objetivo final estudiar la eficacia de los cursos de ELE desde la percepción de los usuarios de L1/L2, o aprendices de herencia. Para llegar a los resultados y las conclusiones obtenidos, se realizó un estudio cualitativo que contó con la participación de informantes de origen hispano que han aprendido el español en casa, en la escuela primaria, en la secundaria, en el Cégep y/o en la universidad. Los participantes contestaron un cuestionario que les permitió expresar su percepción con respecto a los cursos de ELE, cursos que habían tomado durante sus estudios primarios, secundarios o superiores. Los resultados de esta investigación demuestran que los estudiantes de L1/L2 no se encuentran integrados en las clases de ELE, hecho que desmotiva a los informantes para continuar en el estudio de la lengua española. Tal y como explica Gardner (1985) en su teoría del Modelo socioeducacional, la adquisición de lenguas ocurre en un contexto cultural determinado, y está influenciada por la creencia popular y por las diferencias individuales. Estas se encuentran integradas en el concepto de motivo integrador, que está compuesto por el sentido de integración, la actitud hacia la situación de aprendizaje y la motivación. Las respuestas dadas por los informantes pueden servir de ayuda para el diseño y la creación de cursos y métodos de español destinados a usuarios de L1/L2. Al tomar en cuenta sus opiniones, los estudiantes tendrían un sentido de integración más alto, hecho que influye directamente en la motivación de los mismos y, por tanto, en su proceso de aprendizaje.

EDF was only a few months old with the DDT agitation still under way in Michigan when a phone call arrived from Lorrie Otto, an environmental leader in Milwaukee, Wisconsin (Fig. 4.1). Lorrie explained that DDT was to be used for attempted Dutch elm disease control in Milwaukee, and she wanted EDF to come to Wisconsin and stop it. She had been reading about our fireworks on Long Island and in Michigan and figured some of that might be good for Wisconsin. Other considerations were also favorable about Wisconsin. The use of DDT leads to contamination of meat, eggs, milk, and other dairy products, and the dairy industry is large and important in Wisconsin. Agriculture was therefore split in that state: One component wanted to use DDT on crops and trees, while the dairy industry wished to avoid DDT contamination of its products. Agriculture would not present a unified force on behalf of DDT, as it would in most states. The environmental movement was unusually strong in Wisconsin, and Lorrie Otto pledged to EDF the statewide support of the Citizens Natural Resources Association (CNRA). CNRA would raise money and provide all additional logistic support that might be necessary during whatever proceedings might develop. If EDF was going to make a difference on the national scene, this seemed like an invitation not to be refused. So here was an opportunity to stir up trouble again with an increase in complexity and confusion. On October 2, 1968, EDF filed a lawsuit in Federal Court in Milwaukee that was quite similar to the one filed nearly a year earlier in Michigan. It sought to block the Michigan Department of Agriculture (MDA) from applying dieldrin in Michigan against Japanese beetles (same case, same application as postponed last year) and to stop Milwaukee from spraying DDT on its elm trees. The allegations were the same: both DDT and dieldrin would kill nontarget birds and mammals, and both would threaten reproduction of the Coho salmon in Lake Michigan hatcheries.

Abstract:
At that first meeting on October 6, 1967, the new trustees of EDF had voted to “proceed with caution,” given the precarious position of this essentially nonorganization with no assets. It was an easy motion and it passed unanimously, but before long caution was thrown to the winds when Lew Batts described an imminent planned application of the insecticide dieldrin in western Michigan. Intended to eradicate an alleged infestation of Japanese beetles, dieldrin was to be applied to 3,000 acres in Berrien County near Lake Michigan by the Michigan and United States Departments of Agriculture. Lew wanted EDF to stop them. We already knew something about dieldrin, a chlorinated hydrocarbon relative of DDT and an environmentally destructive material, more acutely (immediately) toxic than DDT. We knew it would kill birds and mammals and could damage fish. Furthermore, Lew Batts was connected with a Michigan foundation that had more money, but less arrogance, than we did. EDF was designed to litigate, and Batts’s organization certainly was not. He guaranteed the assembled new trustees of EDF that if we would tackle the Michigan Department of Agriculture (MDA) in court to block the dieldrin application, he would support the effort with $10,000. The fat was in the fire! EDF’s trustees voted to cautiously sue the Michigan Department of Agriculture, and anybody else if necessary, to prevent the dieldrin treatment. Furthermore, several communities within the Lake Michigan watershed in western Michigan were using DDT in an attempt to control Dutch elm disease, a futile exercise with which we were very familiar (Wurster DH et al., 1965). With both of these destructive chemicals contaminating the fish, it would be difficult to separate the effects of each chemical from the other. So we decided to sue not only MDA in connection with its proposed dieldrin application, but we would add as defendants nine cities in western Michigan within the Lake Michigan watershed that were using DDT (Fremont, Muskegon, Greenville, Rockford, Lansing, East Lansing, East Grand Rapids, Holland, and Spring Lake).

Alguns proprietários de imóveis hospedam viajantes em suas próprias residências, compartilhando apenas parte do imóvel por um curto período. Junto com essa prática, existe a necessidade de um recurso que permita mensurar o consumo de energia quando o imóvel está sendo compartilhado. Dessa forma, o hóspede pagará apenas a energia consumida por ele. A dificuldade de entregar esse relatório de consumo é porque as casas possuem apenas um sistema geral de medição. Dessa forma, este artigo mostra o desenvolvimento de um sistema para monitoramento do consumo de energia elétrica para a hospedagem compartilhada. O sistema foi desenvolvido sob a arquitetura IoT (Internet of Things) utilizando a Fog e Cloud Computing. O Sistema é composto por um Smart Meter, e uma aplicação Web. Além da construção da arquitetura de medição inteligente, foi realizada a avaliação de desempenho com o objetivo de mostrar a capacidade do sistema de medir consumo de energia elétrica e ser usado como um recurso para proprietários em hospedagem compartilhada.

Eventos críticos urbanos precisam ser alertados eficientemente, por exemplo, através de uma notificação rápida. As redes veiculares (VANETs) são uma potencial alternativa, para apoiar a notificação das informações dos eventos críticos arbitrários, devido à sua ubiquidade nas cidades. Embora a dinamicidade das VANETs comprometa o processo de disseminação, as conexões entre veículos a partir dos interesses sociais dos usuários oferecem um modo para otimizar a troca de mensagens e a disseminação de dados. Este artigo propõe SOCIABLE, um sistema de disseminação robusta de dados de eventos urbanos críticos que atua numa rede SIoV. Ele baseia-se em comunidade de veículos com interesses comuns e/ou rotinas similares e na influência social dos veículos pela sua posição na rede, para a escolha dos veículos retransmissores. Numa análise comparativa no NS3 com o sistema MINUET, o SOCIABLE gerou menos 36,56% de mensagens transmitidas numa VANET densa e um pico máximo de atraso de 0,028s numa VANET esparsa, entregando dados de eventos críticos em tempo real e de forma robusta sem sobrecarregar a rede.

Abstract:
Physical exercise leads to a shortening of activated partial thrcnboplastin time (PIT) and euglobulin lysis time (ELT). Whether this activation causes in-vivo thrombin and plasmin action remains controversial however. 19 well trained long distance runners were examined 25 min (range 5-53) after termination of a 100 km race (post-race values) run in 577 min (457-755) and 5 days later after at least one day without physical exercise (control values). FPA, platelet factors and fibrin (ogen) split products (fragment E and BB 15-42) were measured with radioimnunoassays. ELT was assessed before and after venous occlusion (VO). The table gives mean values ±SD:Thrombin time, platelet count, platelet factor 4 and haematocrit did not change significantly. FPA was normal in all post-race samples and did not correlate significantly with the time lag between arrival and blood sampling, indicating that activation of blood coagulation in exhaustive physical exercise of long duration does not lead to in-vivo fibrin formation. Activation of fibrinolysis, however, results in circulating plasmin activity as demonstrated by the elevation of the fibrin (ogen) degradation products fragment E and BB 15-42. Since the polyclonal antibodies used in the latter assay crossreact with BB 1-42, these results alone do not allow to jjdge whether plasmin degrades fibrin or fibrinogen. However, lack of fibrin formation suggests fibrinogenolysis rather than fibrinolysis.

Abstract:
Four steer-induced rollover crashes were analyzed by calculating the local three-dimensional accelerations at hypothetical seat positions’ Emergency Locking [seat belt] Retractor (ELR). The method for calculating the local acceleration was described in a recent Society of Automotive Engineers (SAE) paper and assumed three-dimensional rigid body motion, recorded acceleration and recorded roll rates at the center of gravity. For a threshold of 0.7 g, results demonstrated that intervals in the vehicle’s response that may cause the ELR’s inertial sensor to move into a neutral zone were limited to localized high-magnitude negative vertical acceleration events during the rollover segment with a maximum calculated duration of 31.7 ms. Changing the threshold to 0.35 g reduced the interval count by 70 percent and maximum duration by approximately 50 percent. Results of the analysis were consistent with prior published research that noted limited and brief periods of instances in rollover crashes when the inertial sensor may be in a neutral zone. Calculating an interval that a vehicle’s response may allow a retractor to move into a neutral zone did not mean that a specific retractor will move into a neutral zone. To asses if a specific retractor will move into a neutral zone its performance should be analyzed. As identified in prior research, occupant kinematics analysis was necessary in determining whether an inertial sensor in a neutral zone during a rollover event will result in belt spool out. It is beyond the scope of the paper to include a complete analysis of occupants’ kinematics.
