- Das Folterverbot und das Verbot unmenschlicher oder erniedrigender Behandlung aus Art. 3 EMRK gelten absolut; die so genannte „Rettungsfolter“ ist mit der Konvention unvereinbar. - Für den Wegfall der Opfereigenschaft reicht die Verurteilung der Polizeibeamten, welche die unmenschliche Behandlung angeordnet und durchgeführt haben, nicht aus. Relevant sind weiterhin die Höhe der Bestrafung, die Angemessenheit disziplinarischer Maßnahmen sowie die Dauer eines vom Beschwerdeführer aufgrund der unmenschlichen Behandlung eingeleiteten Amtshaftungsverfahrens (Große Kammer). - Die Verwertbarkeit der mittelbar aufgrund der unmenschlichen Behandlung gewonnenen Beweise wird im Rahmen des Art. 6 EMRK geprüft. Allerdings besteht die Möglichkeit, dass auch im Rahmen des Art. 3 EMRK der Ausschluss der Verwertung missbräuchlich erlangter Beweise notwendig werden kann. - Die Verwertung von Beweismitteln, die infolge einer Art. 3 verletzenden Maßnahme gewonnen wurden, wirft stets schwerwiegende Fragen in Bezug auf die Fairness des Verfahrens auf. Die Ablehnung der Fernwirkung von Beweisverwertungsverboten verstößt aber nicht per se gegen Art. 6 EMRK. Zulässige, für eine Verwertbarkeit sprechende Kriterien sind das fehlende Beruhen der Verurteilung auf dem missbräuchlich erlangten Beweismittel und die hypothetische Möglichkeit der rechtmäßigen Beweismittelgewinnung. Eine klare Entscheidung zur von der deutschen Rechtsprechung durchgeführten Abwägung der Schwere des Grundrechtsverstoßes mit der Schwere des begangenen Verbrechens trifft der EGMR nicht.

Abstract:
This paper presents a comprehensive study to estimate the total torque losses which contribute to the hydro-mechanical efficiency in external gear machines (EGMs). A study of these losses at different operating conditions is an important design factor in prototyping many positive displacement machines to achieve efficient and reliable designs. Although semi-empirical models for the description of the steady-state behavior of positive displacement machines accounting for both volumetric and torque losses are available in literature, their fidelity is often based on the availability of reliable experimental data. In the case of EGMs, it is difficult to consider intricate operating features such as the micro-motion of the different components in these generic models. A numerical evaluation of these special features in an EGM using dedicated models for EGMs can potentially contribute to an accurate prediction of the hydro-mechanical efficiency of a given design. In the present work, different sources of the torque losses are methodically determined for a reference EGM unit through various numerical models which were previously developed and validated in the authors’ research team. The cumulative predictions of the torque losses from the different simulation models are then validated against the corresponding measured experimental torque losses at various operating conditions for the reference EGM unit.

A novel Fluid-Structure-Thermal Interaction (FSTI) model for modeling of the lateral lubricating gaps between gears and lateral bushes in External Gear Machines (EGM) is presented in this study. Pressure compensated lateral bushes are key design elements for efficient operation of EGMs for high pressure hydraulic applications. The axial balance of these elements determines their actual position during operation, with significant implications on the effective sealing capabilities of the displacement chambers and on the losses from viscous friction. The FSTI model presented in this paper is the first model of the lateral lubricating interface in EGMs capable of considering the heat transfer, thermal effects in the fluid film and solid components as well as thermo-elastic deformation of the solids. These capabilities, alongside a fluid flow solver and a stress/deformation solver for solid components due to pressure loads, enable prediction of the film thickness in the lateral gaps in EGMs considering thermo-elastohydrodynamic lubrication (TEHD) for the first time. In the present study the formulation of the novel FSTI model and detailed results are discussed with a particular focus on understanding the implications of thermal and TEHD effects.

This paper presents an approach for the evaluation of the effects related to the behavior of the journal bearings on the operation of external gear machines (EGMs). In EGMs journal bearings usually support shafts of both gears. The prediction of their instantaneous axis of rotation is a key feature of EGMs, affecting the displacing action of the inter-teeth volumes and the leakages at the tip of each tooth. Past approaches presented in the literature for the evaluation of the radial micro-motions of the gears are based on classic simplified models for the hydrodynamic journal bearings based on steady-state solutions of the fluid film neglecting important hydrodynamic effects due to film squeeze — which can be relevant in case of significant radial loads variations — or they concentrate the focus of the study on the journal bearing itself regardless of the impact on the global machine operation. This work presents a CFD model coupled with a rigid model for the evaluation of the radial motions of the journal that permits to overcome the above-mentioned limitations of the existing approaches of study. The paper details the proposed model, in particular as concerns the CFD approach to solve the film flow and its coupling with a previously developed model (HYGESim) developed by the authors’ team for the evaluation of the overall operation of the EGM, used also to find the instantaneous loads on the gears. The potentials of the proposed approach are shown for the case of a pump for high pressure applications. For this case the results show how it is necessary to have a detailed approach for the evaluation of the journal bearings for a correct evaluation of the overall EGM behavior. In particular, the importance of hydrodynamic squeeze effects are shown, by comparing the model prediction with those given by the commonly used simplified steady-state approach. The comparison of simulation results with experimental data is also shown as pertain to pump case wear associated to the break in process.

Abstract:
In pressure compensated external gear machines (EGMs), lateral lubricating interfaces exist between floating lateral bushings and gears. These interfaces are primarily responsible for supporting the high pressure bearing loads in these gaps and promoting good operating efficiencies of these units. A fully coupled fluid-structure-thermal interaction lateral gap model has been developed previously in the authors’ research team which considers this highly coupled physical phenomena to predict the lubrication performance of the interface under full film as well as mixed film conditions. In the current work, capabilities of the lateral gap model are utilized in studying the impact of the variations in surface finishes on the performance of a commercially available EGM chosen for this study. Lateral plate designs of varying surface roughness are chosen for the same EGM unit, to analyze their influence on the lubricating performance of the unit. Detailed surface profile measurements were carried out on these lateral plates under study to determine precise inputs to the lateral gap model. Resulting numerical simulations from the gap model over different operating conditions are used to examine the significant performance features associated with the lateral interface which are affected by such surface variations. Furthermore, the paper compares the simulated leakages obtained directly from the lateral gap model for each of the lateral plate designs, with corresponding experimental data over a wide range of operating conditions.

Abstract:
This work presents an approach for evaluating the cavitating conditions encountered in the lateral lubricating interfaces which exist between floating lateral bushings and gears in external gear machines (EGMs). Previous work in the authors’ research team had resulted in the development of a full fluid-structure-interaction (FSI)-EHD lubricating model for the lateral lubricating gaps, which was also validated against experiments. However, such a model uses a very simplified and approximate approach to consider aeration or cavitating conditions in the lubricating gap, where the pressures are simply saturated to a constant minimum value during their solution whenever they cross a minimum threshold. This subsequently results in numerically unstable predictions of pressure when substantial cavitating regions are encountered while also violating mass conservation laws. To overcome these issues, this paper presents a stable mass conserving cavitation algorithm by implementing the universal Reynolds equation in the existing FSI-EHD model which is applicable for both full film and cavitating conditions and has been found to be applicable in several other tribological interfaces. Such a method offers to predict the onset and shape of the cavitating regions without the need for considering complex bubble dynamics. After outlining the formulation and implementation of the new cavitation algorithm, this paper also presents simulations of a commercially available EGM, where using this cavitation algorithm was found to predict realistic pressure distributions in the lubricating interface while also maintaining the stability of such a complex lubricating gap model for EGMs.
