Full textEuropean cities are often presented as a model of sustainability for their capacity to reconcile social cohesion with economic prosperity. However, high environmental impact and persistence in social inequalities raises questions about the capacity of European urbanism to be sustainable in the future. This work analyses moderate and radical approaches to urban sustainability in Europe with the aim of assessing which has the most potential making European cites social and environmentally sustainable. The analysis focuses on the UK using a nuanced empirical base at different spatial scales. The analysis includes national trends in environmental impact, regional trends in material welfare, a study of the development strategy the Swansea City Region and an experiment in neighbourhood regeneration. The main argument is that European cities require a structural transition – and not just strategic adjustment – to become truly sustainable.

Full textThis doctoral thesis relates to the debate on the role of initiative and public participation in the political and social economy of Leon Walras.In the first part the analysis focuses on the philosophy of August Walras who laid the foundation of a real scientific approach to the political and economic theory of property and community in the 19th century. Leon Walras elaborates his own project of political and social economy through a new contribution to a triple vision offering an entire insight by three sciences (pure, applied and social economics). The role of personal initiative and public participation in the political economy of Leon Walras will be revealed through: the redistribution theory and the production theory known as the first and second social question. The second part, following the logic of the thesis, proposes concrete examples in order to understand Walras' theory model as well as to study the topicality of these terms. The importance conferred on public participation will be explored in the works of Leon Walras on intellectual property, nationalization of land and railroad

Full textThe benefits due to a sustainable global economy are included in the range of values protected by international law; starting from this consideration, the principal scope of the research is to analyze the points of contact between economic interests and non-economic values, which have always been considered as inconsistent. In this perspective, it is necessary to examine the multilateral system regime within the World Trade Organization (WTO) and then, to study the provisions contained in the Free Trade Agreements (FTAs) concluded at a regional and/or at a bilateral level. During the twentieth century, international trade law has radically changed because of the institution of the WTO in 1995; one of the main innovations of the multilateral trading system is the new dispute settlement mechanism managed by the Dispute Settlement Body (DSB). The thesis analyzes, more in general, the competences of the WTO, which are all addressed to the aim of promoting a full international trade liberalization, through the removal of obstacles to trade and the prohibition of protectionist or discriminatory national measures. However, because of the globalization and the growing participation of developing countries in economic relations that the need of a greater consideration for non- economic values arises. Among the most debated issues, the one relating to the influence that the progressive elimination of any form of obstacle to trade liberalization has on the protection of fundamental rights at work in an individual dimension, as much as in a collective one, assumes great importance; that is because work represents a primary factor in the productive process and, in general, in global economy. As widely observed in this dissertation, the debate relating to the possibility of an inclusion of a social clause in WTO law, in order to achieve the integration of the “core labour standards” within the multilateral system, as established by the International Labour Organization’s (ILO), is characterized by some critical points and tendentially conducts to poor results because of the structural limits within the WTO. More specifically, developing countries, which represent the majority of the members of the Organization, have never agreed on the adoption of a restrictive legal framework with specific limits, like non- trade values. Starting from these considerations, the thesis comes to the conclusion that beyond the progress made thanks to the role played by the interpretative activity of the WTO panels and its Appellate Body in attempting to integrate non-economic values into the multilateral system, other alternative solutions have been identified at a regional and bilateral level. Among the solutions mentioned, it is interesting to consider the provisions contained in the North American Agreement on Labour Cooperation, a Side Agreement in social matters adopted in the context of the Free Trade Agreement between USA, Canada and Mexico in 1992 (NAFTA); this last FTA will be replaced by the US-Mexico-Canada Agreement (USMCA), a new agreement signed on November, the 30th, 2018 and currently just ratified by the Parties. In the same context, the dissertation takes into account the Dominican Republic-Central American Free Trade Agreement (CAFTA-DR), that is a free trade agreement within the meaning of which the United States have undertaken a legal action against Guatemala in 2010, based on the alleged violation of the core labour standards; in particular, the proceeding represents the first case in absolute in the practice of a social clause application within a FTA, in which the panel has examined a range of important labour law issues. On the basis of these considerations, the research shows that although it seems to be easier to find an equilibrium between economic interests and non- economic values at a regional or bilateral level, we should not exclude future progress within WTO, thanks to the encouraging interpretative activity made by the panels and the Appellate Body.

Full textThe freedom of speech takes place in differents domains, and receives protection from the national constitutions and international conventions. However, concerning the commercial domain, the question of its protection may be asked. The recognition of a constitutional and conventional protection of the commercial speech is the result of many turnovers Court, but still remains disputed by some doctrine. To devote the commercial speech as a constitutional right can not only strengthen its protection, but also to create a connection between economy and the consitutional rights. Indeed, the economic nature of the commercial speech is in the middle of the discussions which it is the object, and causes it to be confronted on the one hand with the other constitutional rights, and on the other hand with the right of intellectual property and of new technologies. The presence of the commercial speech in these reflects the spread of the constitutional rights in the whole law. Finally, the recognition of this new constitutional right, under both civil and economic rights, highlights a revitalisation of the classifications' typologies of the constitutional rights

Full textThe EU institutional practice grants a special treatment to liberal professions in the fields of competition and internal market law. This practice, however, suffers a lack of consistency insofar as it follows a case-by-case approach and has never been studied in a systemic way.This research identifies the elements characterizing these activities and offers a proper definition of “liberal professions”, which can be useful for the European institutions to rationalize their actions. Also, since the convergence of public and private interests - which is typical of this market - produces tensions between competition rules and fundamental rights, the liberal professions may well be regarded as a paradigm of the principle of social market economy. This finding can, therefore, give a theoretical justification for the special treatment accorded to them at European level

Full textUn premier travail d'anthropologie historique propose alors de soumettre l'option financière à une "anamnèse" qui remonte à Babylone pour revenir à Amsterdam (17ème siècle) avec une étape par la Grèce de Thalès et Aristote. L'option s'avère alors relever d'un espace social solidaire d'un ordre politique et religieux.
Néanmoins, le caractère trans-historique de ce "Phénix financier" laisse inexpliquée la spectaculaire transformation quantitative et qualitative subie par les produits dérivés contemporains sur les marchés organisés comme sur les marchés de gré à gré. La thèse s'attache alors à suivre le travail d'in-scription comptable et de pré-scription cognitive et formelle (ou juridque) qui sous-tend les transactions à base d'instruments financiers conditionnels. Cette dé-scription du produit donne alors à voir plusieurs modalités concrètes du processus de mondialisation financière.
Au terme de cette analyse, l'écriture collective du produit s'avère fondamentalement prise en charge par "la théorie financière moderne". Ce paradigme financier fait alors l'objet d'une analyse plus attentive sur les relations -descriptives et prescriptives- qu'il a entretenu avec le marché réel au fil de son avénement. A partir d'une mise en évidence de la double spéculation pratique et théorique sur la "volatilité" (qu'ont eu à couvrir ces options), la thèse conclut alors sur la consécration mutuelle et auto-référencielle opérée par la théorie et le marché. Cettte double consécration exprime un visage fondamental du nouvel ordre social, politique et moral de l'option financière moderne.

Full textThird-country nationals have become veritable subjects of the EU Law. Nevertheless, their protection is fragmented by the increasing categorization of their status, in consequence of their fact and juridical situation. The emergence of a common standard of protection of fundamental social rights based on the EU regulations and policies may be however noted. Thus the coordination of social security systems applies explicitly to the regular staying third-country nationals. EU social regulations and directives also apply to those persons when the nationality condition is not specified. The same situation is also considered on the non-discrimination principle field. Then, this common standard of protection can offers a base to the development of a social status that is an attribute of the social citizenship, materialized by the social participation in the community. This social status could come itself the foundation of the construction of a truly European status dedicated to the regular staying third-country nationals. It could contribute to the realization of the European Council Tampere's objective to give a fair treatment to those persons. It could also contribute to the reinforcement of their integration at the member States community. It consists in a social integration, by the practice of fundamental social rights like working, funding social security, or getting involved with trade unions representation

Full textTourism has become a social, cultural and economic phenomenon. However, the impact of tourism on a long-term economy growth remains ambiguous, especially for small island economies (SIE).This thesis seeks to identify the fundamentals of tourism specialization as a sustainable source of growth for a SIE. On the one hand, it has led us to redefine the main components of tourism as a social and economic activity and to clarify how tourism contributes to the economic growth. On the other hand, this thesis reveals the ambiguity of the relationship between tourism and growth. It provides new explanations for a more virtuous tourism growth model and more adapted to the global tourism market.The results of the introduction of tourism into a Romer's model of endogenous growth and those of a threshold regression model applied to a sample of SEI call into question the hypothesis of linearity between tourist specialization and economic growth. The thesis demonstrates the end of a model of intensive tourist development. It concludes that tourism is a sustainable source of growth for an SIE, when intelligence and agility constitute the leitmotif of a sustainable, multi-stakeholder tourism strategy

Full textSince the original project, the European Union has extended its borders, integrated new territories, new political traditions and has taken a new geographic form. Its borders "undefined" moved, the area giving way to an open space. But this evolution did not alter the nature of questions relating to its identity, the existence of a European society, the identification of "peoples" to their new European political Community and the emergence of a european public space.The issue of the European identity is that despite all measures deployed by supranational institutions (harmonization process, homogenization and convergence), it remains an abstract concept whose expression and rooting in the social sphere are still superficial. The European Union is indeed a community of citizens, the rights are codified by successive treaties, but it remains a community whose identity is still uncertain.Although the European identity concerns a range of questions that must be considered concurrently - enlargement, border issues, political-institutional hybridity, we will analyze it mainly through the prism of European citizenship and the Charter of Fundamental Rights. The following question will therefore be asked : European citizenship and the Charter of Fundamental Rights will they contribute to emerge or even consolidate a European identity?

Full textThe powers and enforcement methods used by the french economic control authorities constantly changed since the beginning of the 00s. In many aspects, these new prerogatives and approach have raised concern, as the amount of sanctions imposed to the operators exploded. One of the problems relies in the fact that, willing to foster a quicker and more effective public action, the legislator accepted to give more autonomy to the authorities, especially vis a vis the courts and judges. Thus facilitating the concentration of powers in the sole hands of the control authorities, which in many branches of economical regulation, are now able both to prosecute and impose penalties. However, since 1992, a growing array of fundamental rights have been attributed to the economic operators as legal persons, especially the right to have a fair trial, and to have access to legal recourse. The aim of our research, is to determine how the equilibrium between the law enforcement and the respect of this fundamental rights could be improved. After analysing the different hard spots in the procedures of the french authorities regarding fundamental rights, several solutions are proposed, classified in two categories: Upstream, the measures that could be taken to improve the legal security of economic operators in France ; The more targeted measures to be taken regarding the major hard spots in the authorities powers and procedures

Full textUn premier Chapitre détaille les effets économiques et environnementaux attendus des mécanismes de stockage et d'emprunt de quotas sur un marché de permis d'émissions négociables. Plus spécifiquement, vis-à-vis des provisions adoptées dans l'EU ETS, nous étudions les effets de la restriction du transfert de quotas stockés ou empruntés entre les Phases I et II sur les changements de prix du CO2. Nous montrons statistiquement que les bas niveaux de prix du CO2 enregistrés jusqu'à la fin de la Phase I sont expliqués par la restriction du transfert de quotas inter-périodes, au-delà des principales explications proposées par les observateurs de marché.
Un deuxième Chapitre développe une étude originale des fondamentaux du prix du carbone, introduit depuis le 1er Janvier 2005 en Europe. Nous soulignons le role central joué par l'évènement annuel de conformité 2005 imposé par la Commission Européenne, qui sert de révélateur des positions nettes courtes/longues des installations en quotas par rapport à leurs émissions vérifiées. Le résultat principal de cette étude met en évidence le fait que les fondamentaux du prix du CO2 liés aux marchés des énergies et aux évènements climatiques non-anticipés varient en fonction des évènements institutionnels. Par ailleurs, nous montrons l'influence de la variation de la production industrielle dans trois secteurs couverts par l'EU ETS sur les changements de prix du CO2 en menant une analyse par décomposition, étendue par pays.
Un troisième Chapitre s'intéresse aux stratégies de gestion des risques liés à la détention de quotas de CO2. Nous proposons une méthode utilisée sur les marchés d'action pour recouvrer les changements dans l'aversion au risque moyenne des investisseurs. Cette étude indique que, sur la période considérée, l'aversion au risque est plus élevée sur le marché du carbone que sur les marchés d'action, et que le risque est lié à une structure de prix strictements croissants après l'évènement de conformité 2006. En lien avec le Chapitre 1, nous évaluons enfin comment le stockage de quotas peut être utilisé comme un outil de gestion des risques, pour faire face à l'incertitude politique sur un marché de quotas. Nous détaillons une règle optimale de partage des risques, et discutons du principe de mutualisation du risque lié à l'échange de quotas quotas entre agents.
Nos travaux témoignent des difficultés rencontrées suite à la création du marché européen du carbone pour atteindre un signal prix cohérent avec des réductions d'émissions effectives par les industriels. Cependant, dans un contexte institutionnel mouvant, ces inefficiences ne semblent pas avoir été reportées vers la période 2008-2012.

It is attached indirectly to the principle of free competition by the elimination of private barriers to the free movement of economic activities. Thus, in the service of an immediate finality, transparency guarantees access to public procurements and, in the service of a mediate finality, it protects the market structures of public procurement. The general principle of transparency gives then rise to contracts of public order (contrats relevant de la commande publique) which take over public contracts. By extension, it is someone’s clear mental picture of an actual situation and the ability of judging the morality of such a situation is called conscience. When the outer world is the work environment and when the actual situations to deal with are work-related, what could be the role of consciousness and conscience? Could they interfere with work duties or the conduct of good industrial relations? The purpose of this thesis is to study the “issues of conscience” within the corporation, in a broad sense, through the relevant stakeholders’ perspectives – including employers, administrative authorities, workers, trade unions, or even staff representatives – in order to know when individual and collective consciousness and conscience can have a legal impact. One should ask oneself about the existence of a statutory regime for those “issues of conscience” in domestic, comparative and international laws. Some manifestations of consciousness and conscience are already well known, such as whistleblowing or conscience clauses, but some others still need to be provided with a legal framework

Full textIndivisibility and interdependence of human rights have been indicated in all international documents. Any divergence and classification can endanger their execution and globalization by limiting certain dimensions of the fundamental rights and freedoms. This convergence is tested by comparing the level of social religiosity and intangible rights using a legal and practical basis for the convergence between civil and political rights. Still, considering a brief history of the enactment of two international Covenants, it seems that divergence is an inevitable outcome of ideological and political differences. We can investigate the conditions of this divergence and the different positive nature of socio-economic rights by studying labor rights.Considering a commitment at a national level might lead to divergence and unfulfilled rights because of the non-obligatory nature of these international commitments and the positive nature of socio-economic rights. Therefore, it only brings to mind the principle of a half-binding non-discriminatory commitment regarding the socio-economic rights. Extending the scope of this principle beyond the national borders can guarantee the indivisibility of fundamental rights. However, the vague nature of socio-economic rights and restrictions, such as the reciprocity principle, emphasize on an objective need to establish the binding international commitments. This can be investigated with studying the pandemic health crisis caused by the spread of coronavirus worldwide.By comparing the religious freedom, labor and health rights, we find out that the binding commitments have been considered regarding negative rights at international levels. However, there must be an objective need to persuade the governments to consider similar measures and obligations with respect to socio-economic rights. In fact, the level of international obligations of the governments depends on the type and level of this objective need

The categories of analysis used therefore have specifically made it possible to carry out a microcomparisonin this area, that is to say, a comparison of the stakeholders in the school system, their functions,powers, duties and guarantees.The second part of this thesis is devoted to an analysis of the nature and scope of the right to education in bothcountries, and how it has been enshrined by judicial, legal and constitutional means, and thanks tosupranational standards.The third part of this thesis is devoted to a comparison of the transformation, in the light of changes occurringin the global arena, of institutions and public policies in each country with respect to education. This hasmade it possible to understand the role of international organizations in creating new universal standards, andhow these standards have been incorporated into domestic legislation. Finally, an analysis of the evaluation ofschool systems based on neoliberal indicators has been undertaken, which has made it possible to compare theorganization and management of education systems of both countries.The findings resulting from the observation of both legal systems have led to highlight the common principlesand foundations that exist in the Western world and that have facilitated the flexible harmonization ofinternational public law on education

Full textThe concept of universal jurisdiction comes from international criminal law. It designates the empowerment of national criminal courts to hear a case when all of its elements are located in another State. Despite a common belief, universal jurisdiction is not specific to "the worst" crimes. It is first and foremost a technique at the service of national judges in order to fight against the impunity of certain offenses. Its study from the point of view of labor law is justified by the interest that such a technique can arouse for people working for a transnational company or a global value chain and for whom there is no guaranteed access to a judge in case of violation of their rights at work. Indeed, they are exposed to a risk of denial of justice which stems, on the one hand, from the inability of local courts to hear a trial involving a company whose economic and political weight exceeds that of the judiciary and, on the other hand, the incompetence of any other judge. The mechanisms elaborated within the framework of corporate social responsibility no more than the regional instruments for the protection of human rights guarantee employees access to justice. The universal jurisdiction of the judge turns out to be a useful technique for these workers. But it is also an operational technique : not only does its characteristic elements coincide with the difficulties of access to justice for workers, but, moreover, it is already emerging in transnational social litigation

Full textThe study of the evolution of the methods used by the French administrative judge is necessarily connected to the new priorities that were chosen regarding the carrying out of his functions. « Pass judgment and resolve disputes » remains the foremost mission of the administrative judge. Some of the aspects of his powers and duties have nevertheless grown in importance as part of a policy of strengthening his legitimacy.. Indeed , administrative courts increasingly take into account the persons subject to trial and they have focused the revitalization of the jurisdiction on the protection of fundamental rights, a favoured field for the dialogue of judges. Those strong orientations led to a deep reform of their techniques and methods of judgment. The French administrative judge is now fully in accordance with the requirements of administrative actions and the issues at stake. Whether it concerns reviews of legality or their outcome, those interventions are obviously efficient. Thanks to the powers he now detains, the French administrative judge brings an adequate response to the needs of modern justice and has once again taken up the tough challenge of self-reforming his functions

Full textEconomic competition requires the working relationship to evolve at the rate of the constraints the company undergoes. It implies adapting the employment conditions, such as remuneration, working time, professional duties or place of work. These adjustments can be made by the use of various legal, conventional or contractual mechanisms. Their utilization raises many questions. Answers must be provided. The ability of the French legal system to provide companies the tools to ensure their sustainability, even their development and, consequently, the preservation of employment, is at stake. Full textIn Law, the firm is the result of a complex amalgam of legal concepts (employment contract, legal personality, collective representation of workers, etc.). The systematic ordering of these ones is needed to perceive the coherence of the legal organization of that one. Guidelines emerge. Employment contract is the meeting of two parties whose interests are antagonists. But the release of the labor force of the employee, part of his person , and the sustainability of the contract require them to cooperate. This trend is reinforced by some mechanisms non implied by the nature of the employment contract. Are shared the control of the company (which involves the collective representation of workers) and of its benefits. Employees then become nearly considered as the stockholders are. The legal structure of the firm , however, is not fixed by dogma. Competing ideologies are shaping it. Some focus on purposes. The company is alternately used as a means for employment and for the will of the enterpreneur. Others focus on methods. Lawyers and economists try to organize the firm scientifically

Full textThis thesis aims to thoroughly investigate the relationship between public contracts and competition. Analysing the confrontation of public contracts with competition highlights that these contracts represent a market economy activity. This confrontation takes shape in both dimensions of the competition : inside and outside the contractual framework. The award and performance of public contracts have an impact on the market, leading to a reassessment of the distinction between public authority and undertakings. This confrontation entails amendments within the rules of law applicable to competition and public contracts. On the one hand, competition rules are adjusted towards more flexibility in order to take into account the general interest impregnating the contract or the presence of a public person ; on the other hand, they are also reinforced in order to better appreciate the behaviour of public persons. As for public contract law, it appears to be a supply law, complementary to competition law. The general interest that has traditionally permeated the public contract regime does not appear to have been weakened : competition is indeed one of its components that must be reconciled with others. Historical analysis also helps putting into perspective the disruption brought about by European Union law : since the 19th century, the French administrative judge had the means to guarantee competition in the public contractual framework

Full textSince the original project, the European Union has extended its borders, integrated new territories, new political traditions and has taken a new geographic form. Its borders "undefined" moved, the area giving way to an open space. But this evolution did not alter the nature of questions relating to its identity, the existence of a European society, the identification of "peoples" to their new European political Community and the emergence of a european public space. The issue of the European identity is that despite all measures deployed by supranational institutions (harmonization process, homogenization and convergence), it remains an abstract concept whose expression and rooting in the social sphere are still superficial. The European Union is indeed a community of citizens, the rights are codified by successive treaties, but it remains a community whose identity is still uncertain. Although the European identity concerns a range of questions that must be considered concurrently - enlargement, border issues, political-institutional hybridity, we will analyze it mainly through the prism of European citizenship and the Charter of Fundamental Rights. The following question will therefore be asked : European citizenship and the Charter of Fundamental Rights will they contribute to emerge or even consolidate a European identity?
