Full textThis research aims at exploring the relationship between the free movement of services within the internal market and the need to protect the fundamental social rights at national level. To this extent, our purpose is to identify the role of the EU regulation on services in ensuring a smooth cohabitation between EU economic policies and national social goals. Following the adoption of the Treaty of Lisbon, the EU has shown a new approach which aims not only at keeping a high level of competitiveness, but also at establishing a social market economy. The contradiction between the implementation of the single market and the preservation of domestic welfare policies shall therefore be analysed in the light of the social oriented approach enshrined in this new EU legal framework. The need to reconcile social and market values which inspires the concept of social market economy should guarantee that the exercise of EU freedoms of movement does not prejudge the substance of social rights. Before studying the causes and effects of this potential legal conflict it seems essential to make a brief analysis of the rules provided under EU law in order to ensure the proper functioning of the internal market for services (Part I). The second part of the research will then be focused on the effects of the internal market rules on solidarity. In this context we will examine how, according to a recent case-law of the ECJ, the economic freedoms of circulation, as a priority of the market, may jeopardize the national social rights. These rulings of the EU courts have put in discussion the European integration process in respect of the constitutional traditions relating to employment law and has shown the unstable balance between a border-less market and the aspiration of a social economy at European level.

Full textThis work studies the interactions between market power, inequality, and welfare in a dynamic, general equilibrium framework. Doing so requires departing from two building blocks of the neoclassical general equilibrium model: the representative agent paradigm and perfect competition. The aim of the first chapter is to understand whether market power affects the distributions of wealth and income among households. Results suggest that a relatively simple extension of the Aiyagari model, namely oligopolistic competition with endogenous firms’ dynamics, is successful at reproducing the wealth and income distributions observed in the U.S. Additionally, an increase in concentration in the markets for final goods, due to an increase in entry costs, leads to a lower labor share and a higher profit share of income. These dynamics, in turn, imply higher income inequality. Importantly, these trends are broadly in line with those observed in the U.S. in the last thirty years. The second chapter extends the framework developed in chapter one to study the role of the dividend income tax as a redistributive tool. The analysis considers alternative redistribution regimes. The main finding is that a reduction of the dividend income tax rate, from the US Status Quo, is associated with a social welfare loss. A lower dividend income tax rate implies lower transfers to households. From a welfare point of view, this is particularly costly for poor households. Furthermore, a reduction in transfers forces households to save more for precautionary reasons. To do so, wealth poor households must sacrifice consumption. Given the high concentration of wealth, this implies that the majority of the population suffers a welfare loss.

Full textThe present thesis deals with two main phenomena: financialization and digitalization. The first chapter aims at empirically investigating the determinants of corporations' Surplus Wealth (a measure of market power) and the impact of financial investments on capital investment decisions. Overall, additional evidence on shareholders' value orientation is provided; on average, realized financial profits seem to be beneficial to both physical and intangible capital investment, whilst current financial investments appear to generate a trade-off effect (not for monopolists operating in the IT sector). The second chapter develops a theoretical agent-based model combining endogenous growth (K+S model) and financial frictions (CATS model) together with a market for corporate bonds where firms can both issue and purchase bonds. IT intangible capital is assumed to be the channel through which innovation propagates and its specific advertising properties stemming from artificial intelligence are able to foster liquidity accumulation, which is boosted when financial investments begin to play a role. Simulations suggest that, from a macroeconomic perspective, companies' purchase of corporate bonds is not beneficial to employment, technological progress and growth, except for the case where liquidity invested in bonds is beyond a common threshold across firms but at the cost of higher bankruptcy risk and Ponzi positions.

Full textThe work analyses the so-called Sharing Economy and its implications in civil law, outlining the development over time and its salient features through the original framework proposed by the European Commission – in the exploratory opinion on New Sustainable Economic Models – and by the Parliamentary Intergroup on Technological Innovation, who wrote the Sharing Economy Act. The study examines several well-known electronic platforms, paying particular attention to the ‘worthiness’ profiles emphasized by the legislator to encourage activities that contribute to a more sustainable consumption through the sharing of goods. The functional approach to the phenomenon bases on solidarity among users the rationale of special treatment for operations falling within the ‘Sharing Economy’, still invoked without real uniformity of views. The role of the electronic platform in the context of negotiation between users is analyzed by relating the actual impact on their agreement to its liability provided by law according to the principle of Net Neutrality. Looking at the agreement concluded between users in the context of the platform, it is supported the qualification as a ‘contract’ according to Articles 1321 et seq of the Civil Code, differing from the doctrinal options that consider them merely friendly or ‘pure courtesy’ agreements. It implies the applicability of contract law and the enhancement of the substantial profile which identifies functional links between contracts, determining their regulation and liability issues. Within the framework of the so-called Digital Economy, it is highlighted the value of the personal interaction between users, making it crucial for the validity and the diachronic regulation of individual relationships. Making a comparison between the American ‘Relational Contracts’ and the Italian ‘Long-term Contracts’, it is underlined the similarity and the differences concerning the ‘Sharing Contracts’, connoted by own distinctive features which link them to an economy in which the peculiarities of the operators have assumed new importance, bringing the Sharing Economy closer to an ‘Intimate Economy’. In light of the value assumed by the personal relationship between users, it is also discussed the degree of freedom given to the subjects in the choice of the counterparty, considering the principles of equality and equal treatment in the context of virtual communities. Concerning the AirBnb platform, there is a reconstruction of some discriminatory episodes reported by users to examine provisions of the anti-discrimination legislation and its application in balance with the right to choose the contractual counterparty. Lastly, by enhancing the factual profile of the transactions concluded online, it is proposed a distinction based on the evaluation of the concrete circumstances depending both on the trading methods set by the platform and on the users’ sharing of goods. Thus, the applicability of the prohibition of discrimination – and the consequent invalidity of the contract – is recognized in all the cases in which there is not effective sharing of goods with an unjustified discriminatory effect for the user. Following the express provision of Article 3 of Directive 2000/113/CE, the prohibition of discrimination is inapplicable to transactions concerning private and family life, which is involved exclusively in cases where users share their residential property with others.

Full textObiettivo del presente lavoro è analizzare il mercato delle rendite in Italia per valutarne lo sviluppo e identificare gli eventuali elementi che lo ostacolano e proporre spunti per il loro superamento. Nella prima parte vengono descritte le tipologie di rendita, i regimi previdenziali quale quello a prestazione definita e quello a contribuzione definita, la natura del sistema previdenziale e in particolare integrativo e aggiuntivo e come il sistema della previdenza complementare si sia sviluppato in alcuni contesti nazionali. Analizzeremo quindi il mercato delle rendite prima dell’inizio delle riforme della previdenza di base e complementare in Italia. La seconda parte è dedicata alla descrizione delle riforme della previdenza di base a partire dal 1992 per concludersi con gli ultime correttivi imposti dal Governo Monti e di quelle della previdenza complementare dal 1993 al 2007 anno in cui parte l’adesione al sistema con il conferimento del TFR attraverso il silenzio-assenso. Nell’ultima parte completeremo l’analisi del mercato partendo dall’esperienza internazionale verificando quali sono i mercati più sviluppati per poi ritornare sul mercato domestico e valutare la reale consistenza del mercato. Segue una analisi della domanda e dell’offerta da cui si sviluppano alcune valutazioni su quali siano gli elementi realmente ostativi dello sviluppo e quali le ipotesi su cui lavorare alfine di sviluppare sia la domanda l’offerta di rendite vitalizie in Italia.
