Abstract:
AbstractThis RCD analyzes the Alabama Supreme Court’s recent answer to two certified questions sent to the court from the Eleventh Circuit. The questions involved whether a pharmaceutical company’s duty to warn included a duty to provide instructions about how to properly mitigate for warned of risks, and if the pharmaceutical company had such a duty could a plaintiff recover if their physician would have prescribed the same drug but just changed their monitoring scheme. The Alabama Supreme Court answered both questions in the affirmative, expanding the causation standard in failure to warn claims.

Abstract:
Now in its second decade of existence, the psychotherapist's “duty to warn” is no longer a disreputable novelty. It is established law in an increasing number of jurisdictions, and equally important, it is believed to be law by most psychotherapists in most jurisdictions in the United States. This article asks why the duty to warn was created and why it thrives, relating the development of the phenomenon to social, psychological, and legal pressures felt by the judges who made the decisions.

Abstract:
The author examines the tort law surrounding manufacturers’ post-sale duty to warn consumers of product risks or defects. Using examples and possible scenarios, the author argues that liability based on inadequate warnings at the point of sale should not be imposed if the risk could be neither known nor anticipated. The author also addresses post-sale failure to warn and recall.

Abstract:
Objective There exist, in many jurisdictions, confusion and uncertainty with regard to the legal duty of pharmacists to warn their patients of the potential risks of their medication. Review of the legal evolution of this duty in one state with recent experience is instructive. Data Sources Published opinions of the Tennessee Court of Appeals. Conclusions The cases are consistent with the idea that if the pharmacist warned about risks that had a reasonably foreseeable potential of occurring, then there would be no liability.
