Abstract:
Confidentiality is considered an integral component of medical practise, yet there has been debate within the medical community as to whether there should be exceptions to the obligation to protect patient’s confidences. In the cases involving medical patients with deadly sexually transmittable disease like HIV/AIDS, physicians feel caught between two basic principles – keeping of medical confidentiality and public safety. Bioethicists would favour breaking of confidentiality when the public safety and the life of someone are endangered. However, considering the complexities and discrimination in connection with HIV/AIDS in Nigerian context, many would be tempted to discourage the notification of partners who risk being infected, through the moral obligation of 'duty to warn', but some others would argue that not notifying people of such threat to life would only help in spreading the virus to ignorant partners of an index patient. I argued that there is an overridden utilitarian principle to save others from harm, but some others cite the negative effects the breaking of medical confidentiality would have on the healthcare system as a reason not to favour partner notification. Nevertheless, people would appreciate the value of breaching confidentiality in HIV/AIDS related cases when various forms of discrimination and stigmatisations are criminalised and policies to protect the fundamental rights of people living with HIV/AIDS (PLWHA) are strictly adhered to.

Abstract:
Emergency management agencies and government authorities increasingly use social media to warn the public of emergencies. The aim of this thesis is to provide clarification where there is uncertainty about liability, and to address concerns as to how the law will be applied. It does this by examining the responsibility of those entities to warn. It considers whether they are likely to be held legally accountable for their acts or omissions when using social media. The thesis also seeks to provide good practice principles for the use of emerging communication technologies.

Douadjia, Menad. "Le conseil patrimonial immobilier : essai sur le devoir de conseil et l'opération de vente d'immeuble." Electronic Thesis or Diss., Tours, 2023. http://www.theses.fr/2023TOUR1002.

Full text
Abstract:
Until now, as far as I know, no particular work has been carried out on real estate advice in French law. This thesis is intended for in particular to an overall study of the duty of advice in real estate matters. The objective of this thesis is to demonstrate the independence of the duty of advice and to prove its autonomy as a legal concept. The main difficulty lies in its definition. Traditionally referred to as a higher level of information and presented as a different level of warning, which is also considered a level of information. This duty is essentially characterized by the exclusive quality of its debtor who must be a professional specialized in a specific field relating to real estate. Therefore, we cannot speak of such duty apart from this quality. At first sight, this work is limited to the operation of sale of building. As such, the debtor is required to direct and guide his client, whether in the context of a main contract for the sale of property, the source of the duty to advise, or a contract for the provision of services, which has as its main objective the conclusion of a contract for the sale of real estate. In theory, the definition of the duty of advice, in particular that inherent in the sale of real estate, seems to be clear and precise. In practice, all the difficulty lies in determining its boundaries that distinguish it from other degrees of information. To do this research works, it was first proceeded to a preliminary analysis of the judgments of the Court of Cassation, which demonstrates the different dimensions of this duty according to its extensible content and its variable intensity. This analysis has made in evidence the constant function of the duty of advice which can be fortified more and more because of its essence. This process then made it possible to determine the main criteria that characterize this professional’s duty and examine its scope in the different stages of the building sale. This same process allows to wonder about the emergence of an autonomous conception of the duty of advice which may change its dimension when it covers all real estate matters

Garvey, Kim V. "Learning Online during Active Duty and after Separation| Gulf War Veterans' Experience." Thesis, Barry University, 2017. http://pqdtopen.proquest.com/#viewpdf?dispub=10680599.

Abstract:

Higher education has a long-standing relationship with veterans. Under the auspices of federal funding such as the 1862 Morrill Land-Grant Act and the 1944 GI Bill, scores of veterans and active duty personnel have used their educational benefits to earn a college degree. In the 21st century, the 2009 enhancements to the post-9/11 GI Bill amounted to $53 billion in education benefits for servicemembers and their families. In addition, the military is increasing its education plan for servicemembers to include more frequent and more specialized training since the demands of 21 st century warfare requires agile tactical teams to be able to act independently from large troop mobilizations or command centers. Both higher education and the military are increasingly gravitating toward online learning. Therefore, Gulf War II-era student veterans—individuals who served after 9/11—are more likely than any previous student veteran cohort to have undergone extensive military education by the time they return to civilian life and pursue college degrees. Although Gulf War II-era student veterans pursue educational opportunities as much or more than earlier cohorts, they also struggle with transitioning to civilian life.

The purpose of this exploratory, qualitative study was to explore the intersection of military education, postsecondary education, online learning, and transitioning in one context. The overarching research question was: What are the lived experiences of student veterans who have engaged in online learning in two capacities: (a) during active duty within the military education system, and (b) after separation within higher education? The study employed Knowles, Holton, and Swanson’s adult learning theory and Schlossberg’s transitioning theory. The study used a phenomenological approach to examine the lived experiences of Gulf War II-era student veterans who have engaged in online learning while on active duty and after separation. A purposeful sample of 16 student veterans was used, and open-ended interviews were conducted to answer the research questions. Using the Modified Van Kaam method of data analysis proposed by Moustakas (1994), the interview data yielded 14 emergent themes.

The study revealed that participants had different experiences with online learning during their active duty service than they did as civilian student veterans in public colleges and universities. Participants found that the military education system’s online courses were repetitive, but they had clear objectives and structures. Failing online military courses was nearly unheard of and could lead to direct reprisal or loss of life. As civilians, many found online learning to be overwhelming and alienating. College online courses were of better quality but were easier to fail. Participants also reported that online learning was not a direct part of their transitioning experience, but their prior experience with it had provided them basic technological literacy that was useful. The research findings were reflective of transitioning theory but did not fully support adult learning theory. The findings suggest that a deep-rooted military persona or identity is probably developed by active duty military personnel and that such an identity is likely related to a military-specific learning style that does not align to traditional andragogy within higher education (e.g. group versus individual learning). The findings also posit that a new theory should be developed that centers on military learners, their styles and their unique system of postsecondary education.

Abstract:
Large-scale humanitarian crises in foreign countries raise the question of whether or not other countries have a duty to alleviate that suffering. In extreme cases, humanitarian intervention, that is: military intervention for the purpose of alleviating human suffering, is sometimes advocated as the morally required course of action. This thesis suggests that while the international community has a general moral responsibility to prevent and ameliorate humanitarian crises there is no simple duty of military humanitarian intervention. Hitherto, the question has typically been treated as a matter of either moral or legal principle. This thesis argues that empirical factors, which affect the international community's ability to carry out interventions effectively, have not been given their due weight in the debate. On the basis of evaluations of international responses to crises in Somalia and Rwanda, 1992 - 1994, it is suggested that a range of factors undermine the efficacy of humanitarian interventions. These factors include the impact of state interests, the effects of domestic politics in intervening states and, contrary to expectations, the role of humanitarian considerations in decision making on intervention. By showing the limitations of a simplistic view of a duty of humanitarian intervention the thesis seeks to contribute to reconciling idealism with realism in international crisis-responses. Based on sound moral and political judgment military interventions in humanitarian crises would hopefully be less ambitious and ultimately more effective.

Mann, Fraser David. ""It's duty boy" : masculinities, masculine subjects and their representation in the twentieth century American war novel." Thesis, University of Leeds, 2015. http://etheses.whiterose.ac.uk/10641/.

Full text
Abstract:
This thesis examines and explores twentieth century literary representations of American masculinity at war. It aims to demonstrate the manner in which American novels responding to the First and Second World Wars and the Vietnam conflict reflect symbolic, mythic and material anxieties regarding America‟s masculine identities. The thesis examines in particular the pervasive myth of the American Adam and its influence on behaviours, ideologies and narrative. Each text and each conflict operates under the influence of Adamic myth. I argue that prose fiction offers a space in which to scrutinise, engage and ultimately resist such mythic singularity. The incorporation of gender theory into such a study provides an original critical perspective with which to read crucial artistic responses to major events of the American twentieth century. Its central arguments engage with anxieties existing between ideological representations of hegemonic American masculinity and the graphic truth of experience for the corporeal and psychological subject. As well as thematic aspects of the literature, the thesis analyses shifts in narrative technique and the manner in which they reflect the growth and pluralising of wider narratives within the fields of modernism, American naturalism and postmodernism. The contemporary era is marked by commemoration and reflection regarding twentieth century conflict and by anxiety regarding the unstable post 9/11 world. In addition to this, there is resurgence in scholarly, political and popular interest in gender and its representation. These factors mean that this is a timely and vital study that reflects on literary history and current literary debates. The authors and their work in this thesis are considered in chronological order and cover a significant part of the American twentieth century. Chapter one examines John Dos Passos‟ Three Soldiers and Ernest Hemingway‟s A Farewell to Arms. Chapter two engages with two Pacific war novels; Norman Mailer‟s The Naked and the Dead and James Jones‟ The Thin Red Line. Chapter three explores post-war existential angst and early postmodernism in Joseph Heller‟s Catch-22 and Kurt Vonnegut‟s Slaughterhouse-Five. The final chapter offers analysis of Larry Heinemann‟s Close Quarters and Paco’s Story and Tim O‟Brien‟s Going After Cacciato and The Things They Carried.

Hare, Stephanie. "Duty, death and the Republic : the career of Maurice Papon from Vichy France to the Algerian War." Thesis, London School of Economics and Political Science (University of London), 2008. http://etheses.lse.ac.uk/2168/.

Full text
Abstract:
This thesis examines the career of Maurice Papon from his appointment as secretary-general of the prefecture of the Gironde in 1942, through his terms as a prefect in Morocco and Algeria, to the end of the Algerian War in 1962 when he was prefect of police in Paris. Throughout this period, Papon's career was marked by controversy: in the Gironde on account of his involvement in the detaining and deportation of Jews, which led to his conviction in 1998 for crimes against humanity; in North Africa on account of the use of torture and summary execution by units of the army within his jurisdiction; and in Paris on account of the harsh methods used by the police to suppress the Algerian nationalist movement. Papon, who was extensively interviewed for the thesis, regarded himself as a loyal civil servant who was simply doing his duty. The thesis carefully examines his relations to the State, his actions and the circumstances in which he carried them out. In doing so, it presents an historical portrait of Papon and the State which employed him, and an assessment of what both understood by the concept of a civil servant's duty to obey.

Abstract:
The growth sustainability requires dramatic changes to lower the natural resources consumption and the surroundings pollution, by recovery/remediation processes. The EU policy aims at the extended producers/suppliers responsibility, with effective charges on the products allowed to be put on the market, used and called-back, in view of the properly small impact and transparent lifecycle acknowledgement. This leads to «extensions» in designing the new offers with integrated monitoring and service functions. The design for the lifecycle eco-effectiveness is accomplishment, better qualifying the far-seeing companies according to the EU eco-policy. The idea is to reach the duty visibility, by the extended plug-and-play concept, based on series of integrated design options, assigning the structural and functional modules, for the operation monitoring, the reliability assessment and the impact appraisal. This instrumental setting includes intangible information/communication aids, to confer ambient intelligence abilities. This way, the on-process visibility is assured, and exploited for on-duty servicing and end-of-life processing. The example case chosen deals with the critical situation of the parts manufactured in plastics, which are deemed to represent most relevant portion in the cars to come. The following recovery options are possible: - the reuse of the reconditioned items, according to suitably assessed life-extension opportunities; - the recycling of the warn-out components, with the regeneration and reusing of the materials; - the thermal recovery of residual stuffs, within careful handling and pollution-safe warnings; - the reduction to registered ASR, automobile shredding residue, within the EU directives limits. The on-board information system includes, as innovative feature, the resort to identifying tags or labels, to be read and written through wireless links. The technology exploits cheap and compact supports, allowing the labelling of the component, from production, to lifecycle, with an identifying code. The RFID, Radio Frequency Identification Device, is privileged, as ideal means for the component traceability and the history, use modes/styles and cumulated issues storing.

Abstract:
A method has been developed for the prediction of the heat capacity of cargo containment system on LNG vessels during cool-down and warm-up. This is a critical step in the design of of the cargo machinery systems, such as high-duty compressor, warm-up heater, nitrogen generator, etc.. The program consists of two modes which include the calculation methods of cool-down and warm-up of the cargo tanks during a dry-out or ballast voyage. To verify the calculation procedure, a cryogenic simulation was carried out by using liquefied nitrogen on a 200m3 mock-up tank. It was found that the maximum simulation error was within 10% if the capacity of the related cargo machinery systems, and for the total time of cool-down and warm-up.

Abstract:
This paper will explore issues regarding the relationship between a Device Under Test (DUT)’s internal temperature and the ambient temperature that is generally reported on a calibration report. What exactly is this ambient temperature representing, and how does this temperature relate to the temperature of the DUT? Is it the temperature of a single probe on the far corner of the lab? Is it the average of several probes throughout the lab? For DUTs that are enclosed in a force-air cooled chassis, the ambient temperature should probably represent the temperature at the intake fan for the chassis. However, the internal temperature of the device could be higher, but by how much? And, how much will the internal temperature vary over the course of a calibration, especially if the calibration takes multiple hours? How will an operator know if the internal temperature is too high, possibly due to clogged fan filters or other issues with air-flow? What about the effect of adjacent high-power instruments, causing the local temperature around the DUT to warm-up above the ambient level? If the DUT includes its own internal temperature sensor, how should this be used during calibration, and are there any situations where this temperature should be reported along with the ambient temperature?

Abstract:
Friction data have been acquired from motored engine tests on four designs of light duty automotive diesel engines. The engines were all four-cylinder designs with a swept capacity around two litres (1.8l-2.2l). These are typically used in the small and medium car sectors of the European market. The test programme was aligned to cold start and warm-up conditions. The data cover temperatures at the start of motoring of −20°C and above, and motoring speeds covering 200 rev/min – 1000 rev/min. Most tests were carried out using 10W/30 oil. The breakdowns separated piston assembly, crankshaft assembly, valve train and auxiliary component contributions to friction mean effective pressure (fmep), from −20°C upwards, under quasi-steady thermal conditions. Under these conditions, during warm-up the variation of engine fmep exhibits a simple power law dependence on oil viscosity evaluated at the current bulk oil temperature. The dependence of component contributions on oil viscosity has been examined. The empirical coefficients and functions used in the engine friction model developed by Patton, Nitschke and Heywood (SAE 890836) have been modified to give an improved fit to the low speed, low temperature test data, whilst limiting the effect on predictions for fully-warm conditions. The quality of the predictions is illustrated. The degree to which the effect of design detail can be predicted and the scope to reduce friction levels through design are discussed.

Abstract:
Modern combined cycle gas turbines are highly flexible in their operation, concerning start up, load change and shut down. Heat Recovery Steam Generators (HRSG) arranged downstream of the Gas Turbine (GT) are forced to operate in such a way, that the gas turbine operation is not restricted by them. Therefore, they should be designed for a high cycling capability with typical values in the range of 200 to 250 cold starts, 1000 warm and 2500 hot starts for their typical 25 year life span. Cold starts are defined as a standstill period of over 120 hours, warm starts to a weekend shutdown and hot starts to an overnight shut down. AE Energietechnik GmbH (AE), a Babcock Borsig Power company has specialized in designing, erecting and commissioning vertical natural circulation multiple pressure stage HRSGs. The vertical design combines simplicity and low investment costs with performance reliability and high availability. In order to forecast the dynamic behaviour of such a HRSG, AE has supported the development of a dynamic simulation code at the Institute of Thermal Engineering (ITW) located at the Vienna University of Technology. This finite volume code enables the prediction of velocities, pressures and temperatures for several dynamic processes of the HRSG. In the present paper computational results of starts and load changes will be presented for a vertical natural circulation HRSG. Furthermore, several design optimization changes which where made in order to increase operational reliability and availability will be demonstrated. Finally, practical applications of already constructed HRSG will be discussed and conclusions will be drawn.

<div class="section abstract"><div class="htmlview paragraph">The need for even more efficient internal combustion engines in the road transportation sector is a mandatory step to reduce the related CO2 emissions. In fact, this sector impacts significantly on greenhouse gases worldwide, and the path toward hybrid and electric powertrains has just begun. In particular, in heavy-duty vehicles the full electrification of the powertrain is far to be considered as a really feasible alternative. So, internal combustion engines will still play a significant role in the near/medium future. Hence, technologies having a low cost to benefits (CO2 reduction) ratio will be favorably introduced in existing engines. Thermal management of engines is today a recognized area of research. Inside this area, the interest toward the lubricant oil has a great potential but not yet fully exploited. Engine oil is responsible of the mechanical efficiency of the engine which has a significant potential of improvement. A faster warm-up during a daily urban trip when the engine starts from a cold state is a good way to reduce fuel consumption (CO2 emissions) and also harmful emissions, which represent the most critical aspect in urban areas. Conventional oil warm-up takes several minutes to reach a thermal regime, during which inefficiencies related to the low oil temperature are significant.</div><div class="htmlview paragraph">In this paper, the relation between oil temperature and fuel consumption of a turbocharged diesel engine has been evaluated, matching a theoretical approach with experimental data. The oil warm-up has been registered during a homologation cycle when the engine was managed as light-duty propulsion system. Most part of the working conditions was done with the oil far from a thermal regime, demonstrating poor efficiency and high harmful emissions. Then, several strategies to speed up the oil warm-up have been investigated, characterizing the benefits in terms of CO2 emissions. Particularly, the use of a thermal storage available on board resulted effective, as well as an eventual heat recovery from exhaust gases which immediately reach a temperature level enough to heat up the oil.</div></div>

Abstract:
Thermal transients during start-up and shutdown of a heavy-duty gas turbine stress the hot gas path components and reduce their effective life due to low-cycle fatigue. Experience has shown that stress-related cracking and wear is more extensive on gas turbines in cyclic service that start and stop more frequently, than machines in baseload service that operate more continuously. The start-up schedules of most engines in peaking duty are generally designed to minimize the time to reach full load. Rapid loading is not a critical element for many gas turbine users, who would prefer alternate start-up schedules that could extend component life, by as much as a factor of three. It is the fuel controls that dictate thermal energy input to a combustion turbine during start-up and shutdown. Therefore, experiments performed on the rates of acceleration and deceleration led to modified fuel controls for a natural gas-fired combustion turbine (General Electric Model MS7001B), Unit 41 at the T. H. Wharton Plant of Houston Lighting & Power Co. The results may be generalized and applied to other gas turbines and control systems, using different fuels. Specific findings relate to quicker ignition, more gradual initial warm-up, a lower acceleration for a soft start, and lower deceleration during fired shutdown. Additionally, new minimum fuel settings enhanced running reliability during load-shedding operation with water injection for NOx control. The results are described and illustrated in detail to demonstrate the new start-up and shutdown sequence. Subsequently, one HL&P unit was permanently modified for check-out, and across-the-board updating of other units is planned.

Abstract:
The 1943 art exhibition at the Mountain View Officers’ Club (MVOC), Fort Huachuca, Arizona should be considered one of the most significant events in the intersection of American art, military history, and segregation. Organizers of the event, entitled Exhibition of the Work of 37 Negro Artists, anticipated it would boost soldiers’ morale because Fort Huachuca was a predominately Black duty station during WWII. This report provides a brief history of Black art in the early 20th century, biographies of the artists showcased, and provides information (where known) about repositories that have originals or reproductions of the art today. The following is recommended: the General Services Administration (GSA) investigate the ownership of the pieces described in this report and if they are found to have been created under one of the New Deal art programs to add them to their inventory, further investigation be performed on the provenance and ownership of Lew Davis’s The Negro in America’s Wars mural, for the rehabilitation of the MVOC that the consulting parties agree upon the scope of the reproduction of the art, and request archival full reproductions of the pieces of art found in the collection of the Howard University Gallery of Art.
