AimsTo reach 80% adherence to DVANI (Driving and Vehicle Agency Northern Ireland) guidance in acute inpatients ward, T&F HospitalBackgroundThis is a scale-up of a previous successful QI project on driving and Attention Deficit Hyperactivity Disorder in Belfast Trust. According DVLA's guidance for medical practitioners on the current medical standards of fitness to drive, patients with certain mental health diagnosis are required to inform DVLA of their diagnoses and refrain from driving. Different factors are considered in order to determine patients’ fitness to drive. According to DVLA and GMC, it is medical professionals’ responsibility to advise patients to inform DVLA/DVANI of their mental health diagnosis. It is the patient's legal duty to notify DVLA/DVANI of their diagnosis. Patients can be fined up to £1000 if they failed to inform DVANI of their medical condition.MethodOutcome: Completeness of driving advice given to consecutive patients discharged from T&F hospital from April 2019 to early August 2019 in %Process: Document clearly in electronic and written notes on following - (1) has driving status been asked (2) has patient been advised to inform DVA if required (3) has patient been advised likely how long he/she is to refrain from driving forBalancing: increased the time of reviews, increased numbers of consultant reports requested from DVAResult4 cycles have been completed. Cycle 1 – baseline and review guidance; Cycle 2 – medical staff education and developed driving advice pathway and patient leaflet; Cycle 3 – admin staff was involved for putting driving advice pathway in admission pack; Cycle 4 – medical staff was educated again regarding importance of documenting electronically. Clear changes were seen after cycle 3 showing an increase of mean of 25% completeness of driving advice to over 90%.ConclusionIt is the legal duty of patients to notify DVANI of mental health diagnosis, however it is the responsibility of medical professionals to advise patients to do so. This QI project has shown improvement in the completeness of driving advice given. Further cycles are to be completed to obtain patient feedback.

In the social constitutional state, the administration’s mandate is not limited to making legal and expedient decisions. According to § 25 of the German Administrative Procedure Act and parallel provisions in social, tax and procurement laws, the office administrators are obliged to advise the individual to a certain extent on the exercise of their rights, whereby the requirement of legality and expediency is at least to some extent supplemented by a requirement of optimization. The present contribution will discuss the justification, the regulatory context, and the extent of the duty to provide advice, as well as the consequences of insufficient or incorrect advice. The institution of official advice is interesting for the discipline of administrative law as it stands at the interface of civil law and administrative law (substantive and procedural), and therefore, is able to reconstruct its dogmatic form on the basis of the “doctrine of legal relations”. Finally, the official duties to advise exemplify how administrative procedural law deals with information risks – a hitherto neglected component of general information administrative law.

This essay explores the role of strategic ignorance in relation to access to legal advice in England and Wales, drawing on the work of Linsey McGoey (2012; 2019; 2020), taking areas of extreme shortage of immigration and asylum legal advice as an example of the wider phenomenon in access to justice. It argues that there is a misplaced belief in market-based procurement to meet advice needs, which leads to a failure to collect evidence to understand whether the market does in fact achieve this. This avoidance of evidence about market functioning and the relationship between demand and provision is facilitated by fragmentation of both policy and operational responsibilities, leaving large gaps for ignorance, in which the accounts and concerns of advice-users are dismissed as not credible. It argues that, in failing to collect adequate evidence about the functioning of the market, the Lord Chancellor is ignoring a statutory duty to secure the availability of legal aid. Abstract 794The article addresses the issue that is widely discussed in Germany and other jurisdictions: can the management of a company use AI applications in its decision-making process without violating its fiduciary duties? The lack of transparency in conventional AI applications conflicts with the fiduciary duty to check the plausibility of external expert advice (in Germany known as the ISION principles). This tension can be partly resolved by using explainable AI (XAI). In this work, we review the basic principles of machine learning and XAI and discuss them in the legal context.

As the Sentencing Commission revives after years without a quorum, a top priority should be to address a statutory duty that has been neglected since the Commission’s inception: the mandatory obligation under 28 U.S.C. § 994(g) to make recommendations regarding the Bureau of Prisons’ execution of Guidelines sentences. Since the effective date of the Sentencing Reform Act, the federal prison population has tripled, spurred on by Bureau of Prisons’ policies and practices that stint on or completely abandon ameliorative sentencing statutes. These administrative positions, implemented with no input from the Commission, effectively increase time individuals spend in prison serving Guidelines sentences, often generating unwarranted disparities among similarly situated defendants. With new Commissioners and a new Bureau of Prisons Director, now is the time for the Commission to make eleven recommendations to the BOP to use existing statutory authority to increase community corrections and reduce time in prison. The statutory bases for administrative action by the BOP cover prerelease custody (18 U.S.C. § 3624(c)), the residential drug abuse program (18 U.S.C. § 3621(e)), sentence calculations for pretrial custody credit (18 U.S.C. §§ 3585(b), 3584(a), and 3624(b)), compassionate release (18 U.S.C. § 3582(c)(1)(A)(i)), the boot camp, or shock incarceration, program (18 U.S.C. § 4046(a) and 28 C.F.R. § 524.31(b)), and earned time credits under the First Step Act (18 U.S.C. §§ 3632(d) and 3624(g)). Each of the proposed statutorily-based recommendations will ameliorate the overuse of prison while promoting rehabilitation and saving taxpayer money.

Jusqu’à ce jour, le conseil patrimonial immobilier n’a pas fait l’objet de travaux particuliers, à notre connaissance, en droit français. Cette thèse est dédiée plus particulièrement à une étude d’ensemble du devoir de conseil en matière immobilière. L’objectif est de démontrer l’indépendance du devoir de conseil, c’est-à-dire de prouver son autonomie en tant que notion juridique. La principale difficulté réside dans sa définition. Traditionnellement qualifié comme un degré plus poussé du devoir d’information et présenté comme différent du devoir de mise en garde, ce devoir se caractérise essentiellement par la qualité exclusive de son débiteur qui doit obligatoirement être un professionnel spécialisé dans un domaine spécifique ayant trait à l’immobilier. Par conséquent, en dehors de cette qualité, un tel devoir de conseil ne se retrouve pas. De prime abord, ce travail est limité à l’opération de vente d’immeuble. A ce titre, le débiteur est tenu d’orienter et de guider son client que ce soit dans le cadre d’un contrat principal de vente d’immeuble, source du devoir de conseil, ou d’un contrat de prestation de service, qui a pour objectif principal la conclusion de la vente d’immeuble. En théorie, la définition de ce devoir de conseil semble être claire et précise. En pratique, toute la difficulté réside dans la détermination de ses frontières qui le distinguent des autres degrés de l’information. Pour mener ces travaux de rechercher, il a été procédé d’abord à une analyse des arrêts de la Cour de cassation qui démontrent les différentes dimensions de ce devoir en fonction de son contenu extensible et de son intensité variable. Cette analyse a mis en évidence la fonction constante du devoir de conseil qui se fortifie en raison de son essence. Ce procédé a permis ensuite de déterminer les critères principaux qui caractérisent ce devoir du professionnel et d’examiner sa portée dans les différentes étapes de la vente d’immeuble. Ce procédé permet de s’interroger sur l’émergence d’une conception autonome du devoir de conseil qui changerait de dimension lorsqu’il porte sur toute la matière immobilière
Until now, as far as I know, no particular work has been carried out on real estate advice in French law. This thesis is intended for in particular to an overall study of the duty of advice in real estate matters. The objective of this thesis is to demonstrate the independence of the duty of advice and to prove its autonomy as a legal concept. The main difficulty lies in its definition. Traditionally referred to as a higher level of information and presented as a different level of warning, which is also considered a level of information. This duty is essentially characterized by the exclusive quality of its debtor who must be a professional specialized in a specific field relating to real estate. Therefore, we cannot speak of such duty apart from this quality. At first sight, this work is limited to the operation of sale of building. As such, the debtor is required to direct and guide his client, whether in the context of a main contract for the sale of property, the source of the duty to advise, or a contract for the provision of services, which has as its main objective the conclusion of a contract for the sale of real estate. In theory, the definition of the duty of advice, in particular that inherent in the sale of real estate, seems to be clear and precise. In practice, all the difficulty lies in determining its boundaries that distinguish it from other degrees of information. To do this research works, it was first proceeded to a preliminary analysis of the judgments of the Court of Cassation, which demonstrates the different dimensions of this duty according to its extensible content and its variable intensity. This analysis has made in evidence the constant function of the duty of advice which can be fortified more and more because of its essence. This process then made it possible to determine the main criteria that characterize this professional’s duty and examine its scope in the different stages of the building sale. This same process allows to wonder about the emergence of an autonomous conception of the duty of advice which may change its dimension when it covers all real estate matters

The thesis "Limitations of professional liability in relation to the professions of auditor, tax adviser and accountant with regard to the duty of confidentiality" focuses on a more detailed elaboration of the selected specific segment of professional liability of the given professions, on the legal and ethical obligations in the field of confidentiality and the possibility of its breaking. The introductory part of the thesis deals with confidentiality in terms of historical development and its importance in the present. Further, it outlines the area of moral and ethical responsibility, legal liability in general, and confidentiality as a specific duty. The concept of confidentiality of the professions of auditors, tax advisers and accountants represents the core of the presented work. The duty of confidentiality of the profession of auditors is significantly influenced by the public interest in the presented information in the form of opinion on the financial statements of the audited entities, and thus the possibilities of the legally supported breaking of this obligation are the most extensive, as evidenced by the amendment to the Act on Auditors, effective from 1 October 2016. The duty of confidentiality of the tax adviser has until recently been strictly defined on a legal basis. The change was brought by the Supreme Court's case law in November 2015, which by comparing the principally equivalent conditions for the exercise of legal liability in the area of confidentiality of the tax adviser and attorney, also deduces the similarities of competencies of both professions in cases of breaking the confidentiality. The accounting profession is not regulated by law, and therefore the confidentiality obligation is also not legally enforceable. However, professional certified accountants are required to comply with the Code of Conduct issued by the Professional Chamber. The final part of the thesis focuses on comparing the duty of confidentiality of the selected professions of auditors, tax advisers and professional accountants with the attorney-at-law profession.

Suretyships given in favour of banks are being challenged in the courts on the basis of equitable doctrines of unconscionable conduct, undue influence, or statutory provisions dealing with unfair conduct or unfair contract terms. This thesis is an enquiry into a bank's duties of disclosure or advice to an intending surety. Such an investigation also necessitates a study of the relationship between banker and customer, as the surety is quite often a customer of the bank as well, and, as a surety's obligation to the bank is an accessory obligation, the obligation is dependent on a valid principal obligation between the bank and the principal debtor - the customer. The face of modern banking has, however, changed dramatically and most major banks have become multi-functional. As a result, the banker-customer relationship may often be seen as a fiduciary relationship. A major problem brought about my multi-functioning banks is that of conflicts of interest between the bank and its customer. Furthermore, the banker-customer relationship is providing much more scope for lender liability than in the past. Various factors are currently having an impact on the law of contract, and this is expected to affect the legal policy makers in their assessments of whether a duty of disclosure of material facts exits or not. A surety has long been a favoured debtor in the eyes of the law, and the courts have developed a plethora of technical principles on which a surety can be relieved of his obligation. The escape routes of the surety, especially if he is a consumer as well, on the new grounds of public policy, unconscionability, good faith or unreasonableness, are growing. The results of these trends is the expected demise of suretyship as an acceptable, cheap form of debt security in the banking sector.

AbstractThe survey in the development departments shows a great need for structured advice during the development process including a strong interest in supporting consulting services. A competent supervision from an independent consultant from outside the respective area is recommended for achieving continuous documentation throughout the development process according to the duty of care. Most respondents would like to have a point of contact or personal contact person, who will always be on hand with competent technical or legal advice and assistance for any questions or problems that arise. In the case of a developer, guidance, sense and purpose for the benefit of the individual developer are primary motivations. This means that a structured guideline will only be used with conviction if it is perceived as an advantage. The author’s experience in connection with the processing of product liability cases lead to the following general questions as a consultant to the development process: 1. How carefully are the tasks of development, production and marketing implemented? 2. What is expected beyond the legal requirements? 3. Will possible damage be avoided or its effect reduced if another design is used? 4. How does the system behave in comparison to the competitors (other car manufacturers)? 5. Were preventive and comprehensible warnings made available to prevent possible damage? A final consulting concept (a checklist of 101 questions in Appendix B) provides guidelines and requirements.

AbstractIn this chapter, I will reflect on medical ethics after the Holocaust by focusing on the rights and responsibilities of the physician to uphold bioethical values in society—which must transcend cultural, professional, and institutional mores. Physicians can do so only if: (a) They are called back to the value of the human person and the physician’s primary duty to uphold his or her good. (b) They acknowledge the hierarchical structure of medical education and resist reflexively the temptation to succumb to its moral dictates. (c) They promote a vigorous right of conscientious objection (CO), so that, if the time comes, they can defend their call to heal even against external pressures from the state, scientific establishment, and/or culture. (d) Finally, they remember those who suffered in the Holocaust both to honor them, and to remind physicians of what the power of medicine has done to degrade dignity, and what it has the potential to do to advance the dignity of all human persons.

Basing on the accounts of Thucydides and Plutarch, the paper analyses the way Sicily and the proposed Athenian expedition to Sicily, as a strategic bridge to advance over Carthage, define Nicias and Alcibiades, and what they represent: old Athens, comprised of experienced rulers and devoted, thoughtful citizens, who retreat, aware of the madness and threat of disaster that will lead to the ruinous outcome of the civil war. Forced to join the expedition, Nicias, as the embodiment of this polis, will stay until the end, in a campaign with which he does not agree, trying to save his fellow citizens. Alcibiades together with what he represents are fighting fiercely for the realisation of a megalomaniacal dream that will bring fortune and power for their own advantage. While Nicias accepts the command out of duty and imitation, Alcibiades yearns for it. In this background, Sicily and Carthage, waving from afar with their wealth and promise of power, constitute the stimulus for action that ultimately destroys an Athens close to defeat. On the other hand, in the young Roman republic, Sicily and Carthage offer natural encouragement of the conquest and submission of their power, as an imperative of the logic of expansion, affirmation and survival of Rome as a nascent power. It is the generation of the old Roman nobility that claims Carthago delenda est.

Abstract As we have seen, the Stoics advise us to seek tranquility. They realized, however, that this recommendation is not, by itself, very helpful, so they went on to offer guidance on how best to attain tranquility. They advise us, to begin with, to practice the psychological techniques described in part 2 of this book. They also offer advice on specific aspects of daily living. They counsel us, for example, not to seek fame and fortune, since doing so will likely disrupt our tranquility. They warn us to be careful in choosing our associates; other people, after all, have the power to shatter our tranquility—if we let them. They go on to offer advice on how to deal with insults, anger, grief, exile, old age, and even on the circumstances under which we should have sex.

Abstract In perhaps the majority of cases the source of the duties of a financial adviser will arise from either or both the contractual regime and the statutory regime, including the Conduct of Business Sourcebook component of the FSA Handbook. However, there remain cases where the general principles of negligence have a role to play in establishing that the provider of advice or information is under a common law duty to take reasonable care and skill in respect of that activity. First, there is the question of duties to persons other than the immediate recipient of the information or advice. Secondly, there is the question whether persons other than financial advisers, and in particular, other than authorized persons under the Financial Services and Markets Act 2000 regime, may owe a duty to care at common law.

We propose a method that uses an emotion analysis for PBL education. The emotion analysis is a method of analyzing a person's emotions from the person's remarks or facial expressions. In this method, teachers understand the situation of students from the results of the emotion analysis and give accurate advice. PBL education often involves group activities. The students conducted groups discuss, propose ideas, select ideas, and make the products. However, not all students are able to participate in discussions and express their opinions. It is the teacher's duty to provide guidance to such students. Therefore, we propose the use of the emotion analysis techniques to identify and guide students who have problems, such as those who cannot participate in discussions. The method is possible for one teacher to grasp multiple groups at the same time and to help developing the students' ability to learn. Under COVID-19, face-to-face classes were restricted. Online classes using Zoom etc. have also been introduced in PBL education. In online classes, it is difficult to grasp the situation of students. This was a big difference from face-to-face classes. So we looked at ways to keep track of the situation for all students. This is because the gap between students who are willing to take classes and those who are reluctant to take classes has widened due to the shift to online classes. As a result of the adaption to the classes, the number of students who actively participate in the classes has increased. The effectiveness of the proposed method was confirmed.

Electrostatically-actuated MEMS mirrors are used in a variety of applications involving fast optical scanning, with endoscopic microscopy an area of particular interest for miniaturization of advance optical imaging systems. In this paper, analytical and experimental characterization of the dynamics and stability of a 1D torsional micro-mirror is described. The micro-mirror being studied is intended for use in biomedical imaging, in which operation strictly by duty-cycled square waves at one or more voltages can be convenient for practical mirror operation and/or control. Analysis focuses on a Hill’s equation approach to predicting stability regions of parametric resonance behavior when input is a duty-cycled square wave, using an approximation for nonlinear capacitance behavior of the mirror. An analytical approach is compared to experimental results. In results to date, analytical models show good agreement with stability predictions, particularly at small voltages, over the range of duty cycled excitations. Additionally, the paper explores how phase delay varies over a range of micro-mirror frequencies for a 50% duty cycle, also compared with experimental results, for potential use in feedback control.

The Croatian constitution-maker’s dedication to the concept of a social state begets the state’s duty to care for public health. This duty is especially salient amid the SARS-CoV-2 virus pandemic. One would be well-advised to be watchful of the dangers that periods of crisis pose for the viability of liberal democracies: in Croatia, protective measures against the COVID-19 disease have been entrusted to the national Civil Protection Command in an initially illegal way. This was later on retroactively convalidated by legislative “patchwork” solutions. It is to be expected that the issue of such measures’ constitutionality will in the foreseeable future present itself on the Constitutional Court’s docket. This paper focuses on one of the most contentious measures - that of a ban on Sunday trade, particularly its implications for the economic constitutional rights such as the right of ownership and entrepreneurial freedom. Furthermore, the authors’ analysis of several Constitutional Court’s decisions from the time of the previous economic crisis will endeavor to anticipate the Court’s decisions in upcoming cases.

The environmental concerns officially aroused in 1970s made the control of the engine emissions a major issue for the automotive industry. The corresponding reduction in fuel consumption has become a challenge so as to meet the current and future emission legislations. Given the increasing interest retained by the optimal use of a Variable Valve Actuation (VVA) technology, the present paper investigates into the potentials of combining the VVA solution to CNG fuelling. Experiments and simulations were carried out on a heavy duty 6-cylinders CNG engine equipped with a turbocharger displaying a twin-entry waste-gate-controlled turbine. The analysis aimed at exploring the potentials of the Early Intake Valve Closure (EIVC) mode and to identify advanced solutions for the combustion management as well as for the turbo-matching. The engine model was developed within the GT-Power environment and was finely tuned to reproduce the experimental readings under steady state operations. The 0D-1D model was hence run to reproduce the engine operating conditions at different speeds and loads and to highlight the effect of the VVA on the engine performance as well as on the fuel consumption and engine emissions. Pumping losses proved to reduce to a great extent, thus decreasing the brake specific fuel consumption (BSFC) with respect to the throttled engine. The exhaust temperature at the turbine inlet was kept to an almost constant value and minor variations were allowed. This was meant to avoid an excessive worsening in the TWC working conditions, as well as deterioration in the turbocharger performance during load transients. The numerical results also proved that full load torque increases can be achieved by reducing the spark advance so that a higher enthalpy is delivered to the turbocharger. Similar torque levels were also obtained by means of Early Intake Valve Closing strategy. For the latter case, negligible penalties in the fuel consumption were detected. Moreover, for a given combustion phasing, the IVC angle directly controls the mass-flow rate and thus the torque. On the other hand, a slight dependence on the combustion phasing can be detected at part load. Finally, the simulations assessed for almost constant fuel consumption for a wide range of IVC and SA values. Specific attention was also paid to the turbocharger group functioning and to its correct matching to the engine working point. The simulations showed that the working point on the compressor map can be optimized by properly setting the spark advance (SA) as referred to the adopted intake-valve closing angle. It is anyhow worth observing that the engine high loads set a constraint deriving from the need to meet the limits on the peak firing pressure (PFP), thus limiting the possibility to optimize the working point once the turbo-matching is defined.

Given the constant increase in world energy demand, gas turbine operators are continuously looking for turbo-machinery improvements, both in terms of increased power and extended maintenance intervals, limiting, as much as possible, the downtime for upgrading. In 2006, GE Oil & Gas engineers launched the Power Crystal™ development program to enhance the output power or extend the maintenance interval of the MS5002C and D heavy duty gas turbines. This effort resulted in an upgrade kit potentially to be installed during a standard major inspection, which include a single crystal material 1st stage high pressure turbine blade and additional improvements, such as new coatings for combustor hardware and improved cooling of the 1st stage high pressure turbine nozzle and 1st stage high pressure turbine wheel. The upgrade kit was validated through an extensive test campaign, which included test-rig component tests in advance of the First Engine to Test (FETT). All critical-to-quality parameters of the gas turbine were investigated, such as turbine gas path component temperatures and stresses, performance and operability. This paper describes the background for the upgrade, discusses the new kit features, how the test program was built and conducted, and reports the experience accumulated on the gas turbine during the initial field operation.

Abstract For modern, light-duty engine applications, the development of improved operating strategies to expedite catalyst heating during cold-start operation is essential for further reduction of emissions and meeting of future regulations. The development of such strategies would benefit from numerical modeling tools capable of accurate prediction of charge preparation, combustion, and emissions formation at cold-start conditions. Traditional development of simulation tools has primarily focused on standard engine operating conditions, and, as a result, these tools have difficulty accurately capturing extreme behavior during cold-start operation such as extensive wall wetting due to fuel-spray impingement on cold cylinder surfaces, late combustion phasing to increase exhaust enthalpy, and continued oxidation of reactants in the exhaust system. A major objective of the multi-national-laboratory Partnership to Advance Combustion Engines (PACE) consortium is the development and evaluation of new modeling approaches for cold-start operation. In this paper, we present recent progress in simulating charge preparation in a light-duty, multi-cylinder, gasoline engine during cold-start relevant conditions as defined by the U.S. DRIVE Advanced Combustion and Emission Control (ACEC) Tech Team cold-start protocols for catalyst heating. We focus study on fuel spray and spray-wall interactions resulting in extensive film formation due to cold cylinder walls. Simulation results are evaluated at steady-state, cold-start relevant operating conditions. Predictions for film formation and composition with conventional (baseline) models are compared to results with new simulation tools and approaches developed under PACE including the Corrective Distortion Spray Model developed by Sandia National Laboratories, which accounts for non-spherical droplet shapes, and a new spray-wall interaction model developed by Argonne National Laboratory, which accounts for multi-droplet, non-uniform impingement. The current study expands on past studies validating these new submodels with spray-chamber experimental measurements to examine the impact they have on full engine CFD simulations.

<div class="section abstract"><div class="htmlview paragraph">The brake systems are given top priority by automotive OEMs in the development of medium and heavy commercial trucks and buses, which can carry increased loads. When trucks and buses are travelling at high speeds or crossing downhill, during braking operations, the friction faces (brake drum and liner) experience a significant rise in temperature due to the conversion of kinetic energy into heat energy within seconds. This lowers the friction coefficient at the interface, resulting in distortions, thermal cracks, hub grease burning, and overheating. Drum brake system designs must be improved and optimized to dissipate more heat from the brake drum assembly and prevent brake failure. Nowadays advance transient numerical simulations assist in the design, development and optimization of the brake system to visualize 3D flow physics and temperature variations throughout the brake duty cycles.</div><div class="htmlview paragraph">In the current study, different Cases of drum brakes to improve cooling efficiency are evaluated. Modifications are done by the addition of different fin shapes on drum brake and deflector on rear axle. These Cases are assessed for continuous braking cycles followed by extended cooling. Lattice Boltzmann-based solver EXA PowerFLOW is used to carry out simulations by demonstrating a fully integrated two-way coupling approach. This coupling helped in simulating larger duration of duty cycles for heavy commercial vehicles. In this coupling approach, flow simulations (PowerFLOW) are carried out to predict HTCs and other flow parameters for different vehicle speeds. These parameters are imported into a standard thermal solver (PowerTHERM), where different brake duty cycles are run by solving radiation and conduction in detail. All brake drum parts are meshed as solids and the actual rotation of the wheel and drum brake is considered to capture all modes of heat transfer in detail.</div><div class="htmlview paragraph">To evaluate the fins and deflector’s effect on cooling efficiency, numerous simulations are carried out. Different parameters like heat transfer coefficients (HTCs), flow rate via the ventilation slot, peak temperature attained during the duty cycles and cooling performance in an extended cooling cycle are used to compare these Cases. It has been found that brake drum with aerodynamically (curved angle) designed fins on drum surface shows relatively better results in terms of all the parameters mentioned above.</div></div>

The Mental Health Act 1983 has been criticised as being overly restrictive, with inadequate scope for patient choice and autonomy. The Government’s Draft Mental Health Bill proposes reforms to improve patient choice. A joint parliamentary committee report on the draft Bill recommended further changes to enhance choice, including a statutory duty to offer patients advance choice documents. Reports to date suggest that advance care planning could offer some benefits, but uptake can be low. Proposals to replace the Nearest Relative who has certain powers under the Act, with a Nominated Person of the patient’s choosing, have been widely welcomed. There are questions about operationalisation and safeguarding. Alongside the reforms, the Government is piloting ‘culturally appropriate advocacy’, which preliminary findings suggest could help advocates better support patients from ethnic minority backgrounds. The draft Bill removes learning disabilities and autism as grounds for detention under Section 3 of the Act. Stakeholders have raised concerns about unintended diversion to more restrictive pathways, such as the criminal justice system. A range of stakeholders share the view that careful implementation is needed to maximise the benefits of proposed reforms. The Government has not announced when the Bill will be introduced.
