Abstract:
This essay reads George Eliot's Daniel Deronda (1876) in dialogue with mid-Victorian debates on British nationality law, illuminating the larger questions of nationality and community that Eliot considered throughout her career. The 1860s, the decade in which the novel is set, witnessed a transformation in the law of subjecthood that culminated in the Naturalization Act (1870). In the lead up to the act, officials reconsidered the doctrine of “indelible allegiance” and debated whether and how the legal status of a subject should reflect an individual's choice and commitments. In the novel, Eliot approaches these issues by examining nationality as an individual experience in addition to a philosophical issue. For example, although both Sir Hugo Mallinger and Mordecai Cohen are British subjects, Mordecai's identity as a Jew conflicts with his legal status—to his great distress. Eliot uses Mordecai's proposal for a Jewish state to engage with an alternative form of national identity: one in which legal identity aligns with cultural and ethnic indices. In tackling these issues, Eliot exposes the complications and contradictions of national identity, showing how nationality law functions as a battleground for larger conflicts over the fate of nationality, both in Britain and beyond.

<p>Les autores de l’article, professionals que han hagut de fer front a una població trencada pel dolor i la ferida dels atemptats i la mort o l’empresonament del grup de joves que els van cometre, reflexionen sobre la seva experiència de treball i els seus aprenentatges. Els atemptats les ha obligades a qüestionar-se tot el que havien estat fent fins aleshores en matèria d’acollida i integració de les persones migrades que viuen a Ripoll. Des del “què ha fallat” inicial, fins al “què podem fer a partir d’ara”. I en aquesta anàlisi els joves hi són especialment presents. Les autores expliquen l’estudi de camp que començar a fer després dels atemptats i al que hi van dedicar dos anys i mig i més de 1.000 entrevistes. Així mateix, presenten la metodologia ICERT ideada per elles mateixes i les accions dutes a terme. Assenyalen els 9 factors de risc que han identificat i les estratègies de treball comunitari que han començat a desenvolupar amb l’objectiu de treballar amb tots els agents de la comunitat i donar espai als diferents discursos, amb una actitud d’escolta oberta i disposició al diàleg.</p>

Abstract:
Obedience was one of the fundamental principles of community life in monas­teries in the first centuries. Based on the analysis of the texts of St. Pachomius’ and St. Basil’s legislation, the article addresses the issue of different correlations taking place within the framework of monastic obedience. The texts of the Rule of St. Pachomius as well as of the Asketikon of St. Basil the Great show that in the ceno­bitical life there was a close relationship between obedience to God, to His word, to the rule of life, to superiors, and, to some extent even to all brothers. Sacred Scripture was considered the primary, or even the only, rule of life for the ceno­bites. Both the Pachomius and Basil in their Rules put a strong accent on obedience to God, which, in practice, was realized in keeping His commandments. The main role of superiors was to lead the brothers to the fullness of salvation. They were to do it with care and responsibility. The analysis of the texts on superiors found that they indicated that the superiors had the obligation to be the first in keeping the God’s commandments as well as in obeying the Rule and the precepts of the elders. Obedience to superiors was understood as being the same as obedience to God, but was dependent according to the way the superiors fulfill their dutes of preaching the word of God and living their lives in agreement to their teaching.

As a first shot, one might say that environmental ethics is concerned distinctively with the moral relations that exist between, on the one hand, human beings and, on the other, the non-human natural environment. But this really is only a first shot. For example, one might be inclined to think that at least some components of the non-human natural environment (non-human animals, plants, species, forests, rivers, ecosystems, or whatever) have independent moral status, that is, are morally considerable in their own right, rather than being of moral interest only to the extent that they contribute to human well-being. If so, then one might be moved to claim that ethical matters involving the environment are best cashed out in terms of the dutes and responsibilities that human beings have to such components. If, however, one is inclined to deny independent moral status to the non-human natural environment or to any of its components, then one might be moved to claim that the ethical matters in question are exhaustively delineated by those moral relations existing between individual human beings, or between groups of human beings, in which the non-human natural environment figures. One key task for the environmental ethicist is to sort out which, if either, of these perspectives is the right one to adopt—as a general position or within particular contexts. I guess I don't need to tell you that things get pretty complicated pretty quickly.

Abstract:
This thesis proposes a propensity and opportunity model for tax practitioner preparation compliance. The model integrates the existing empirical tax practitioner compliance knowledge into a theoretical framework through an adaptation of Nagin and Paternoster’s (1993) individual differences and rational choice framework. The premise of this thesis is that preparation non-compliance occurs when there is both a will (propensity) and a way (opportunity). One of the most compelling findings was discovered through the development of the preparation compliance variable. Rather than a unitary construct with simple linear relationships with other variables, it was found that practitioners form distinct and very different clusters of preparation compliance. Four practitioner clusters were revealed. The Duteous cluster of practitioners exhibited the most virtuous approach to preparation practice and had the highest level of compliance within their clients’ tax returns. The Contingent cluster reported an intermediate commitment to compliant practice and client return compliance that was contingent on transaction visibility. The Aggressive cluster held the least compliant approach to preparation practice and reported the highest level of non-compliance within their clients’ returns. The Outlier cluster was an extreme version of the Aggressive pattern of results. While these groups clearly represent different levels of compliance (depicted in this thesis as the teardrop of practitioner compliance with a compliant base (Duteous) and non-compliant tip (Outliers)), gone was the assumption of compliance linearity. In its place was the knowledge that the practitioner population is not homogeneous, but instead comprises distinct practitioner types. Support was found for the propensity and opportunity model in the prediction of practitioner teardrop cluster membership. Both the higher-order constructs of propensity and opportunity were significant in the prediction of cluster membership at each ascending level of the teardrop. However, the features of propensity and opportunity that differentiated the lower teardrop practitioners were different to those that differentiated the upper teardrop practitioners. In differentiating between the Duteous and Contingent clusters, the propensity construct was characterised by an appetite for risk and power (lower for the Duteous), coupled with stronger commitment to business best practice and to the identity of being a competent practitioner among the Duteous. Opportunity was characterised by a perceived likelihood of success in preparing non-compliant returns and higher ambiguity of clients’ tax affairs, coupled with the perception of lower likelihood of detection for non-compliance. Different aspects of propensity and opportunity assumed importance in differentiating between the Contingent and Aggressive clusters. Propensity was characterised by a lack of preparation ethics and opportunity by ambiguity of clients’ tax affairs. These results have important implications for the regulation of tax practice. Tax authorities must recognise that there are multiple distinct groups of practitioners who hold different propensities and perceive different opportunities for non-compliance. Thus, the drivers and obstacles found for the population as a whole will not uniformly apply to sub-groups within that population. As such, the teardrop clusters require tailored regulatory strategy for optimal preparation compliance.

Abstract:
Obstruction of the tear outflow system can occur anywhere along its course from the tear lake to the inferior meatus of the nose. Surgical techniques designed to relieve this functional or complete obstruction have been available for a long time. Toti of Italy described the dacryocystorhinostomy (DCR) procedure in 1908 as a treatment modality for obstruction of the nasolacrimal duct. His technique did not make use of mucosal flaps. Dupuy-Dutemps of France, on the other hand, encouraged the use of flaps. He recommended suturing together the nasal mucosal and lacrimal sac flaps. The success rate of the operation improved dramatically. Today the external DCR procedure makes use of modifications of both of these historically described procedures. In recent years, intranasal DCR has enjoyed renewed popularity. This procedure had been performed by Lester Jones and others for years but was dropped because the success rate was 80% at best. Although the use of endoscopic techniques and laser technology has been advocated by some authorities, the success rate (approximately 70%) with relatively short-term follow-up has limited its acceptance. More recently, Javate and associates reported a series of patients undergoing endoscopic DCR with the radiofrequency Ellman unit. Their reported success rate of 90% compared favorably with a 94% success rate in 50 age-matched patients undergoing external DCR with a follow-up of 9 months. This rate also compares favorably to the present authors’ success rate of approximately 95% in uncomplicated cases undergoing external DCR and a similar rate with the endoscopic approach without use of a laser. Therefore, the laser does not appear to offer any significant advantage over more traditional intranasal approaches, and the cost may actually be a financial disincentive to its use. The benefit of mitomycin continues to be debated. You and associates performed a prospective study showing favorable long-term success rates with the use of mitomycin. On the other hand, Liu and associates performed a prospective study that demonstrated no benefit. While the DCR works well for lacrimal sac or nasolacrimal duct obstruction, it does not address obstructions of the puncta and canaliculi.
