Full textPrivate property which is given over to public use is subjected to particular attention today due to its lare increase. The drawbacks of the regulations governing public property added to the financial difficulties of individuals have, in fact, increased the outsourcing movement of property given over to public use. This very phenomenon, in connection with the notion of public property, revives the debate between functional and organic theories. The former rejects the nature of public property given to property that doees not satisfy the organic criterion, that-it-to-say, not being the property of a public person. The latter focuses its definition on the giving over of the property to public use. From this perspective, the organic criterion is not a defining element, it's the giving over of the property to public use which is exclusively taken into consideration. Capitan's note concerning the Commune de Barran judgement in 1933 forms the symbol of this theory. From the perspective of the increase in private property given over to public use, the functional theory is in principle more attractive. Nevertheless, should this theory be retained ? The study of how private property is given over to public use and the regulations governing surch private property given over to public use allows us to find an answer to this question. The outcome is that the organic criterion, if this does no exist in the form of public property, maintains a large effect on the giving over public property to private use. This means abandoning the adoption of a solely functional conception, but it leads to questioning the forms that govern the organic criterion in adminstrative property law

Full textIn Europe in recent years the value of property has been enhanced in law as well as bolstered by judicial decisions benefitting ownership and assets. This transformation of property results in grouping together material rights, societal values, basic interests and human development. Consequently, the exclusive right to peaceful enjoyment of property and guaranteed legal provisions have been converted into a bundle of rights and extensive patrimonial duties which are in turn tempered by constitutions and treaties. Substantially guaranteed by the European Union and the Council of Europe, this body of rights has limited the scope of public authorities in the implemenation of their policies. Whereas the promulgation of new laws on property rights are foreseen as imminent, laws are nonetheless being extended into new fields such as scientific innovations and social rights. This confirms the rule that no owner can ignore the social implications of his assets

Full textThere are few areas - environmental, cultural, social, or even economic - that are not examined through the prism of the commons. This new interest in the commons can be explained by the significant evolution of the 21st century society, which questions the right of ownership. However, the analysis shows that, whatever the period, the modern model of property rights - public or private - is always characterized by the exclusive control of the property by its owner. In the current context of social change, this model has its limits and appears inadequate for certain needs.At the same time, the debate on the commons has gained momentum. For some academics, the commons appear to be able to provide a response to the inadequacy of the right of ownership, within the framework of a necessary legal evolution. The commons are the subject of debate in academic circles, but are still ignored by French law and are not subject to any legal definition. However, they are addressed by the law of certain foreign states. They are also addressed by many disciplines, first and foremost economics. The thinking of Elinor Ostrom, winner of the Nobel Prize in Economics for her work on the subject, is fundamental. Because of these particularities, a specific research methodology has been set up, combining conceptualism and empiricism.A legal theory of the commons was thus proposed. What characterizes the commons is their allocation - to the production, preservation, and distribution of collective utilities - within the framework of collective governance. This allocation conditions the appliable law, of a new kind, and confers rights and obligations other than the traditional ones. In this respect, the commons constitute a new legal category

Full textPublic domain is a central notion of public ownership. Because of the protective function that stems from its system, it has always focused the attention of both doctrine and the legislator. Along with “private domain”, public domain is one of the two subsets of state property. This duality was confirmed in 2006 by the general code on public property. Far from ending the debate, the coming into effect of the code highlights the fragility of the criteria identifying the public domain. Comparing applicable norms to the state of doctrine shows that implementing the criteria of identification of property and commissioning is not easy. These difficulties are consubstantial to the notion. Nevertheless, the necessity of creating economic value that transcends the whole matter, further accentuates their denaturation. Far from challenging the criteria and categories that result from it, the study leads to a renewed reading of the property relations exerted over this domain. Seen from a value perspective, the public domain should be viewed as a sum of utilities. Abandoning an exclusive conception of property law thus makes it possible to restore coherence to identifying the notion

Full textFirst term of most legal dictionnaries, abandonment does not, so far, have a unified definition. No author has looked closely at this indeterminate (vague) concept, probably discouraged by both the magnitude of its scope and the various legal characteristics which are conferred to it. Misunderstood, ignored, misunderstood, and often wrongly used, the concept of abandonment raises questions about its legal determination. The first part of the study tends to promote a unified conception of this notion for the sole purpose of shedding light on a precise definiton of abandonment in private law. To achieve this, it is suggested, firstly, to reject a broad interpretation of the concept of abandonment, by delinking with all legal situations which are wrongly called "abandonment", and, secondly, to adopt a restrictive approach of this concept, by recognizing that there is a possibility of abandonment restricted to children with established and known filiation and to tangible appropriated objects and that it is, with regards to the identified assumptions, a legal act. More specifically, abandonment will be defined as a unilateral legal act by which the author performs a material act of remittance in view of waiving a right that binds him to the object of the abandonment. The second part of the thesis highlights the acceptance of the unified conception of the notion of abandonment by private law. The study of the conditions for realization of abandonment reveals the urgent need for the regulation of this act, notwithstanding the field in which it is performed. An abandonment must only be made in a place intended for that purpose. The legal mechanism of abandonment also reveals that it differs from other legal unilateral acts of abdication, to the extent that, firstly, the extinguishment of the right may be surrendered immediately or may be deferred, and secondly, the legal consequences will occur with respect to the object of the abandonment. Finally, the study focuses on the punishment for abandonment, when it was made outside a regulatory framework
