Abstract:
This article evidences multiple ways in which judicial precedent is used in different legal systems. It shows that: a) precedent is currently used, one way or another, in every legal system but its use differs in each legal system and frequently it is used differently even between courts of the same legal system; b) a comparative analysis under the methodology hereby proposed would provide useful tools in order to address how to “treat like cases alike”. The main aim of this research is to set the conceptual framework for an adequate understanding and study of the doctrine of precedent. To do this, some dimensions of the doctrine of precedent will be added to those enumerated by Michele Taruffo and analyzed not only theoretically, but also under concrete examples of how they work in different legal systems —both of common law and civil law.

The article deals with the main features and characteristics of judicial precedent in the Roman-German law system in comparison with the “classical” precedent — a source of Anglo-Saxon law. Among the features of the system of judicial precedent in the Roman-German law are the following: ambiguity of the phenomenon of precedent and its continental doctrine and concepts; secondary and dual nature of the precedent over other sources of law of that legal family; selective attitude to different branches of law; diversity of the legal basis of precedents in different countries and differentiated approach to the recognition of legal effect of precedents. The technical and legal aspects of a precedent in the system of the Roman-German law, in particular the special nature of the publications of decisions of the higher courts and others are pointed out. The main features and characteristics of judicial precedent and its doctrine in the Roman-German law are disclosed by the example of case law of Germany, France, Spain, Italy and some other countries.

Abstract:The different role played by case law and the historical and conceptual differences between the doctrines of precedent in common law and civil law traditions are important determinants of judicial creativity. In this article, we consider a hybrid version of stare decisis, called by the French name of jurisprudence constante, adopted by mixed jurisdictions. Unlike stare decisis, which allows a single precedent to establish case law, the doctrine of jurisprudence constante links the recognition of a judge-made rule to the existence of a consecutive line of decisions affirming the same legal principle. We develop a model to consider the effects of this doctrine on the social costs arising from judicial error and uncertainty in case law. We further consider the effects of these alternative doctrines of precedent on judicial creativity and ideological bias in judge-made law.

Abstract:
The doctrine of precedent is one of the most distinctive features of the modern common law. Understanding the operation of precedent is important for our theorizing about the nature of law, since any adequate theory must be compatible with the practice. In this paper I will explore the conventional view of precedent endorsed by practitioners and many legal philosophers alike. I will argue that for all its attractions, it provides a distorted view of the nature of precedent. The distortion grows out of the basic assumption that precedents create rules, and thus that the common law can be understood as a form of rule-based decision-making. Instead, the common law is a form of case-by-case decision-making, and the doctrine of precedent constrains this decision-making by requiring later courts to treat earlier cases as correctly decided. The relevance of earlier cases is not well understood in terms of rules—they are better understood as a special type of reason.

Conflicts between domestic precedents and subsequent decisions of the European Court of Human Rights have resulted in the lower courts following prior domestic decisions even when convinced that they will be overruled on appeal. The standard interpretation of the decision of the House of Lords in Kay v Lambeth holds the lower courts to domestic precedents that are manifestly inconsistent with the subsequent Strasbourg jurisprudence and admits only the most limited exception. This paper advances an alternative approach to the relationship between the domestic courts' obligations under the Human Rights Act 1998 and the doctrine of precedent by analysis of the nature of the doctrine of precedent and the reasons offered by Lord Bingham in his leading judgment in Kay. This analysis is then extended and applied to two recent cases in which the lower courts have considered themselves bound by a decision of the UK's highest appeal court that fails to give due effect to the applicants' Convention rights.

Apresenta a doutrina dos precedentes vinculantes, presente nos países do </span><em><span style="font-family: Times New Roman; font-size: medium;">common law</span></em><span style="font-family: Times New Roman; font-size: medium;">, que nunca tiveram a ilusão de que os limites do intérprete estariam contidos no próprio texto normativo, mas para verificar de que modo a mesma foi pensada a dar coerência e segurança jurídica ao sistema. Pretendeu-se, sob o método de pesquisa bibliográfica comparada enfrentar temas relativos à força vinculante dos precedentes, quer seja do ponto de vista horizontal ou vertical, a distinção entre </span><span style="font-family: Times New Roman; font-size: medium;">precedentes persuasivos e vinculantes, bem como a possibilidade de erro no julgamento a justificar sua superação ou manutenção. The article also presents the doctrine of binding precedent, as in common law countries, who have never had the illusion that the interpretation of Law has limits in the normative text itself, but to know how the system was thought to provide consistency and legal certainty. This article uses comparative constitutional literature to tackle issues relating to the binding force of precedents, either horizontal or vertical, the distinction between persuasive and binding precedents, and the possibility of error in judgment to justify its overruling or maintenance. On the other hand, it examines the distinction between following a precedent because it is a precedent or because of a known experience and exposed the justifications for the use of the binding precedents, such as consistency, uniformity of law, legal certainty and efficiency.</p><p> </p>

This paper aims to analyze the issues concerning the implementation of binding precedent in Malaysian cases, and propose a re-evaluation of the binding precedent doctrine. The qualitative approach was employed to indicate the issues related to the doctrine of binding precedent by analyzing relevant cases. These cases were selected to propose the re-evaluation of the binding precedent doctrine as practiced by the Malaysian dual-judicial system. The main issue to be discussed regarding the doctrine of binding precedent is interference by the Civil Court on Islamic matters and Syariah Court decisions, which lead to inconsistency in judgments, even after the amendment of Article 121(1A) of the Federal Constitution. This study proposes that the application of binding precedent should be re-evaluated to ensure that the principles of justice are upheld. Court judges should decide cases based on merit, and only use previous judgments as guidance for present and future cases.

Courts resolve individual disputes and create principles of law to justify their decisions and guide the resolution of future cases. Those tasks present informational challenges that affect the whole judicial process. Judges must simultaneously learn about (1) the particular facts and legal implications of any dispute; (2) discover the doctrine that appropriately resolves the dispute; and (3) attempt to articulate those rules in the context of a single case so that future courts may reason from past cases. We propose a model of judicial learning and decision making in which there is a complicated relationship between facts and legal outcomes. The model has implications for many of the important questions in the judicial process, including the dynamics of common law development, the path-dependent nature of the law, and optimal case selection by supervisory courts.

The debate on how to understand the legal figureof “jurisprudence” is still relevant in Constitutional Law and, in general, in the Theory of Law, in countries where the legal system follows Civil Lawand also in those that are under Common Lawsystems.The Peruvian Constitutional Procedure Code has introduced in its Preliminary Title two figures that are related to constitutional jurisprudence: the jurisprudential doctrine and the constitutional binding precedent.In the present article, the author makes an approach to both figures from the theory of the sources of Law. She presents an overview on how the “production of Law” is understood in doctrine, and on how the constitutional jurisprudence could take a place in this order, taking into account the form in which the role of the Judge is considered.

Bien qu’en théorie étrangère à notre modèle juridique, la notion de précédent n’est plus un tabou pour lesacteurs juridictionnels qui osent enfin « parler » d’une pratique jusqu’alors restée officieuse, voire hérétique dans notre tradition juridique. Attentifs à la réception et au respect de leurs décisions, les juges suprêmes français ont relancé la réflexion autour du précédent. S’inscrivant dans un questionnement global sur la fonction de juger, le recours au précédent exprime une certaine représentation de l’art de juger. Dès lors, il convient de s’interroger sur les raisons qui conduisent les juges suprêmes français à y faire référence en dépit des interdits historiques et théoriques. Manifestation de la mémoire du juge, la référence au précédent est inhérente à la fonction de juger ce qui explique que le juge y ait recours. Ancré dans son passé et acteur de son temps, le juge peut alors affirmer son propre pouvoir et s’arracher à la représentation traditionnelle de son office. En convoquant son précédent, le juge convoque sa loi source de son propre pouvoir, lui permettant en retour de s’imposer comme un être conscient de lui-même et de son pouvoir normatif
Although foreign to our legal model, the rule of precedent is no longer a taboo for judicial actors who finally dare to speak of a practice hitherto remained unofficial and even heretical in our legal tradition. Attentive to the reception and respect for their decisions, the French supreme judges have revived the debate around the precedent. As part of a global questioning of the judicial function, use of precedent expresses a certain representation of the art of judging. Therefore, it is necessary to examine the reasons that lead French supreme judges to refer to their precedent in spite of the historical and theoretical prohibited. Judge’s memory manifestation, the reference to the precedent is inherent in the judicial function which explains that the judge would resort. Rooted in its past and actor of his present, the judge can assert his own power and break away from the traditional representation of his office. By calling its precedent, the judge summoned the source of his power law, enabling it in turn to establish itself as a conscious being of himself and of its normative power

Dans cet exercice, on essayera de produire une véritable théorie locale ou spéciale du précédent judiciaire pour Colombie. Compte tenu de la profonde transformation du rôle de la jurisprudence contentieuse administrative au cours des dernières années, abandonnant son rôle indicatif et assumant une valeur normative de précédent judiciaire, il est nécessaire d'analyser le précédent contentieux administratif d'après la culture des opérateurs juridiques en Colombie, les fondations doctrinales et jurisprudentielles de l'existence du précédent en Colombie et les objectifs du Code de Procédure Administratif.Ce travail a pour but de tester l'hypothèse selon laquelle en Colombie, les juges du contentieux administratifs et les autorités administratives, afin d'identifier et d'appliquer rationnellement le précédent judiciaire contenu dans les arrêts d'unification Jurisprudentielle du Conseil d'Etat pour résoudre les cas qui viennent à leur connaissance, devraient appliquer des critères théoriques et pratiques d'une théorie locale du précédent, jusque-là Inexistante. Pour cela, on souhaite montrer que cette théorie devrait aborder (i) les contributions théoriques à la doctrine transnationale du précédent judiciaire et les flux légaux ayant donné lieu à la figure de précédent en Colombie, (li) la base théorique et constitutionnelle du respect pour le précédent en Colombie ainsi que (iii) les objectifs de la création des « arrêts d’unification jurisprudentielle » dans la loi 1437 de 2011
This dissertation produces a local or special theory of judicial precedents for Colombia. Public case law in Colombia has departed from its prior persuasive role and has acquired a normative value as judicial precedent. Given the deep transformation of the role of public case law in recent years, it is necessary to analyze the judicial precedents in light of the Colombian legal culture, the doctrinal and jurisprudential foundations of the existence of the precedent in Colombia and the objectives• pursued by the Code of Administrative Procedure. This work aims to test the hypothesis that public authorities and public law judges in Colombia should apply theoretical and practical criteria of a local theory of the precedent, hitherto nonexistent. The latter is necessary for them to identify and rationally apply the judicial precedents contained in the unification rulings of the Council of State (Conseil d'Etat) to solve the cases that come to their knowledge. This theory should address (i) the theoretical contributions to the transnational doctrine of the judicial precedent and the legal flows that gave rise to precedents in Colombia, (ii) the theoretical and constitutional basis for respecting precedents in Colombia as well as (iii) the objectives of law 1437 of 2011 when creating unification rulings of the Council of State

A modulação temporal de efeitos como técnica de decisão possibilita ao Supremo Tribunal Federal a mitigação dos efeitos retroativos da declaração de inconstitucionalidade, ao mesmo tempo em que resguarda o princípio da supremacia da Constituição. Nos casos em que há mudança de jurisprudência, atua como importante mecanismo de salvaguarda das legítimas expectativas dos jurisdicionados na estabilidade dos julgados do Tribunal Constitucional. Em ambas as hipóteses, concretiza o princípio da segurança jurídica, inclusive na sua vertente subjetiva, a proteção da confiança legítima e assegura a melhor realização dos interesses públicos, próprios de uma sociedade pluralista.
The prospective doctrine as a decision technique makes possible the mitigation of the retroactive effects of the unconstitutionality declaration to the Brazilian Federal Supreme Court, at the same time it protects the Constitution supremacy principle. In cases with statement of overruling precedents, it plays an important role in protecting the legitimate expectations of the citizens in the stability of the Constitutional Court precedents. In both cases, it enforces the principle of legal certainty, including its subjective aspect, the legitimate confidence protection and it assures the best fulfilment of the public interests that are typical of a pluralist society.

Abstract:
Judicial autonomy has suffered changes all through Colombian constitutional history, especially due to the expedition of the Political Constitution in 1991. This implies that the judge’s function was affected and suffered relevant changes, particularly in duties such as the motivation of judicial providences and the search for real justice in concrete cases. As a consequence of these relevant changes, now judges must pay special attention to the constitutional precedent and the charges imposed on them in order to avoid sanctions like the annulment of their judgments through the «vías de hecho» doctrine. These limitations and consequences were issued with the aim of protecting fundamental rights, and making the legal system dynamic and coherent.
La autonomía judicial ha sufrido transformaciones en la historia constitucional colombiana, aún más con la entrada en vigencia de la Constitución Política de 1991. Esto implica que la función del juez se ve afectada y sufre mutaciones relevantes, sobre todo en cuanto a sus deberes, como la motivación de las providencias y la búsqueda efectiva de justicia para el caso concreto. Nótese, entonces, que el juez debe observar con atención los precedentes constitucionales y las cargas que estos le imponen, so pena de incurrir en sanciones, como la cesación de efectos jurídicos del fallo a través de las así llamadas «vías de hecho». Dichas limitaciones y consecuencias fueron pensadas en clave de la máxima protección de los derechos fundamentales, la dinamización y la coherencia del sistema jurídico.

A prática da arbitragem comercial internacional tem se deparado, há pelos menos quatro décadas, com a problemática da extensão da cláusula compromissória a uma parte não-signatária, integrante do mesmo grupo de sociedades a que pertence uma das partes integrantes da convenção, em razão do comportamento adotado pela parte não-signatária nas fases de negociação do contrato, execução ou extinção. Nesse sentido, a prática da Corte Internacional de Arbitragem da Câmara de Comércio Internacional dos últimos trinta anos e reiteradas decisões judiciais em países de diferentes tradições jurídicas como a França, Suíça e Estados Unidos têm se manifestado favoravelmente a essa extensão subjetiva da convenção de arbitragem. O estudo da doutrina nacional e da jurisprudência do Superior Tribunal de Justiça sobre os grupos de sociedades e seus efeitos, e a análise detida de diversos precedentes do Superior Tribunal de Justiça e do Supremo Tribunal Federal sobre a homologação de sentenças arbitrais estrangeiras, revelam a compatibilidade da referida prática arbitral internacional com o ordenamento jurídico brasileiro.
The possibility of extending an arbitration clause so that it binds a non-signatory company which is a member of the same corporate group as one of the signatories, on the basis of the conduct of said non-signatory during the negotiation, performance and termination of the contract, has been an issue in international commercial arbitration for the past three decades. The precedents of the International Arbitration Court of the International Chamber of Commerce during the past thirty years, and judicial decisions in countries such as France, Switzerland and the United States have been favorable to the extension of the arbitral convention to non-signatories. Analysis of the work of Brazilian legal commentators and the case law of the Superior Court of Justice relating to the group of companies doctrine [teoria dos grupos de sociedades], as well as analysis of several precedents of both the Superior Court of Justice and the Federal Supreme Court on the recognition of foreign arbitral awards, indicates that the international arbitration practice of the ICC on the extension of the arbitral agreement to non-signatories is compatible with the Brazilian legal system.

Abstract:
This chapter considers an essential source of law in the English legal system: judicial precedent (or ‘case law’). This chapter discusses the rules and principles of the doctrine of judicial precedent, including how precedents are created, developed, and followed. The chapter considers the rule that forms the precedent—the ratio decidendi, or the reason for the decision—as well as the importance of other judicial statements that do not form part of those reasons—the obiter dicta. The principle of binding precedent is captured by the expression ‘stare decisis’ (stand by what is decided) and binding precedent relies on a hierarchy of courts. The hierarchy can help to establish whether a particular ratio decidendi binds a particular court and whether an appellate court is bound by its own previous precedents. The chapter is packed with case law examples and it also highlights the role of non-binding precedent which may still be deemed persuasive for a particular court. Again, the relationship between the English courts and the Court of Justice of the European Union (EU) and the European Court of Human Rights (ECtHR) is considered. Finally, the chapter considers how a court may avoid following a particular precedent by the process of overruling, distinguishing, or reversing.

Abstract:
Judge-made law to be found in the case law is governed by the doctrine of judicial precedent. The rule on which a case is decided is called the ratio decidendi and other statements of law not affecting the outcome of a case are termed obiter dicta. Whether one court is bound by the ratio decidendi of another court depends upon the position of the court in the hierarchy of the hierarchy of the courts. The doctrine of binding precedent is alternatively known as the doctrine of stare decisis. A precedent may be avoided by the processes of overruling, distinguishing and reversing. The relationship between the English courts and the Court of Justice of the European Union (EU) and the European Court of Human Rights is considered.
