This thesis outlines a proposal from an explicitly religious standpoint of the key dimensions of peacebuilding, focusing particularly on mediation and facilitation as a primary task. What is the value of such a study? My initial responses in the paragraphs which follow are made at the broadest possible level: the desperate need for effective peacebuilders in a world torn by violence and the potential for religiously-based peacebuilders to fill that need. I then support this response by examining other reasons for the study: the current inadequacy of religious response to conflicts, the danger of manipulation of religious leadership by other actors, and potential for the insights of religiously-based actors to contribute to the over-all practice of peacebuilding and diplomacy. In addressing the latter question I outline my own understanding of the meaning of "religion", an understanding whose impact on the broad question of peacebuilding I explore throughout the chapters which follow.

Resumo: O presente trabalho debruça-se sobre a prática da comunicação nas missões católicas da Congregação do Espírito Santo no Planalto Central angolano, território dos Ovimbundu, do período que vai de meados do século XIX ao período pré-Guerra de Libertação do século XX. O principal material empírico utilizado são as traduções de gêneros da oralidade em umbundu (provérbios, contos e adivinhas) para o português e de materiais doutrinários católicos (catecismos, liturgias) do português para o umbundu. Com base nesses registros, procura-se vislumbrar o processo de disputa simbólica que deu origem à convenção de significação estabelecida a partir da relação entre os diversos agentes envolvidos no contexto missionário
Abstract: The present work focuses on the practice of communication in the Catholic missions of the Congregation of the Holy Spirit located in the Central Highlands of Angola, territory of the Ovimbundu, from mid-19th century to pre-Liberation War 20th century. Its empirical material consists basically of translations of oral genres from Umbundu into Portuguese (proverbs, tales, conundrums) and Catholic doctrinal material (catechisms, liturgies) from Portuguese into Umbundu. ENGLISH ABSTRACT: The aim of this study is to gain understanding of the perceptions and experiences of divorced women in the postdivorce phase, with specific reference to rural divorcees. During intervention with divorced women the social worker ought to be informed about the needs of divorcees, as well as be skilled to deal with the trauma of divorce. It is therefore necessary to understand how women experience the post-divorce process. The Systems, Ecological, Strengths and Feminist Perspectives are used as a frame of reference to understand the adaptation of divorced women. First, a study of relevant literature is undertaken which presents a broad review of the process of divorce; divorce as a mourning process, as well as the influence of divorce on the women and children. Attention is also devoted to literature on the adaptation of women in the post-divorce phase. Second a qualitative, phenomenological research subject is chosen to explore the experiences and perceptions of divorced women’s adaptation during the post divorce-phase. Factors which obstruct adaptation, as well as factors which stimulate personal growth, came to light during the empirical research. Four themes unfolded from the research. The first theme relates to tension: tension regarding finances; tension regarding health; tension arising from the overloading of roles and tension resulting from the relationship with the ex-husband, as well as how divorce is experienced int the rural areas. The second theme deals with spirituality: divorce as a spiritual crisis; deepenig spirituality; spirituality in the shaping of identity and facilitating to a large extent the mourning process. In the third theme various sources of support are discussed, while the fourth theme focuses on the positive side of divorce, namely personal growth. The before mentioned themes contain the challenges divorced women experience during the post-divorce phase. Recommendations focus on post-divorce intervention which are aimded to relief stress, strengthen spirituality, to obtain knowledge of supportsystems in the community, and also to stimulate the process of personal growth.
AFRIKAANSE OPSOMMING: Hierdie studie het ten doel om geskeide vroue se persepsies en ervarings van hul aanpassing in die post-egskeidingsfase te verstaan, met spesifieke verwysing na die plattelandse geskeide vrou. Tydens intervensie met geskeide vroue behoort die maatskaplike werker vaardig en goed ingelig te wees ten opsigte van die behoeftes wat geskeides ervaar, daarom is dit noodsaaklik om te verstaan hoe geskeide vrouens die proses ervaar. As praktykraamwerk is die Gesinsisteem-, Ekologiese, Sterkte- en Feministiese Perspektief gebruik om die aanpassing van geskeide vroue te verstaan. Eerstens is ‘n literatuurstudie onderneem wat ‘n breë oorsig oor die proses van egskeiding, egskeiding as rouproses asook die invloed van egskeiding op die vrou en kinders bied. Aandag is ook gegee aan die aanpassing van die vrou in die postegskeidingsfase. Tweedens is ‘n kwalitatiewe, fenomenologiese navorsingsontwerp gekies om die ervarings en persepsies van vyf geskeide vroue uit verskillende plattelandse dorpe se aanpassing in die post-egskeidingsfase te eksploreer. Faktore wat die aanpassing strem, asook faktore wat persoonlike groei stimuleer, het uit die empiriese navorsing na vore gekom. Vier temas het uit hierdie navorsing ontspring. Die eerste tema hou verband met spanning: Finansiële spanning, spanning oor gesondheid, spanning wat ontstaan uit die oorbelading van rolle, spanning oor die verhouding met die gewese man, en die plattelandse ervaring. Die tweede tema handel oor spiritualiteit: egskeiding is ‘n spirituele krisis, dit bring spirituele verdieping, spiritualiteit help met identiteitsvorming en fasiliteer in ‘n groot mate die rouproses. In die derde tema word verskeie ondersteuningsbronne bespreek, terwyl die vierde tema ook die positiewe kant van egskeiding uitlig, naamlik persoonlike groei. Bogenoemde temas vervat die behoeftes wat geskeide vroue tydens die aanpassingsperiode na egskeiding ervaar. Aanbevelings het gefokus op postegskeidingsintervensie wat daarop gemik is om spanning te help verlig, spiritualiteit te versterk, ondersteuningsnetwerke in die omgewing te ken en die proses van persoonlike groei te stimuleer.

Abstract:
Using a stress and coping framework, this study examines the role of religious coping in the divorce adjustment process. This study utilizes three waves of data from a longitudinal study of divorcing mothers with young children. The primary analyses examine the role of religiosity in the divorce appraisal process, as well as the influence of both positive and negative religious coping on divorce appraisal, depression, and changes in religiosity. The study also explores how changes in divorce appraisal and religiosity influence change in depression over time. The results indicate that higher rates of negative religious coping are linked to more negative divorce appraisal, higher levels of depression, and declines in religiosity. In contrast, positive religious coping is associated with increases in religiosity over time. Additionally, findings show that changes in divorce appraisal predict changes in depression, but this relationship is moderated by one’s level of religiosity.

Marriage is neither a Jewish nor a Christian invention. Both religions have one thing in common: their origin is traced back to the God of the Bible, who is also the Creator of the universe. While Christianity does not hesitate to trace its origins to Judaism, Judaism perceives it as a perversion of its heritage. Christian ethics have a rich Jewish background. Actually, the very founders of Christianity were Jewish. Jesus and Paul were, first and foremost, Jews. The former was neither a Christian nor did he intend to start a new religion apart from the Jewish faith. He only perceived himself as a Jewish revivalist, and the long-awaited Messiah. The latter was a Jew who got converted to Christianity. The first four books of the New Testament are an attempt, by both eyewitnesses and their disciples, to present a record of the words and deeds of the historical Jesus. Paul interprets the God's plans of salvation as fulfilled in the Jesus of Nazareth. This research paper attempts to compare the teachings of both Paul and Jesus on marriage and divorce. Christian marriage is a marriage in which both partners are Christian believers. Jesus' teaching is generally addressed to a homogenous JeWish Christian community, with few excerptions in the Markan and Lukan versions. In view of Christian marriages, the Law of Christ seems to be binding upon both partners. A problem arose when the Gospel crossed the borders of Palestine into the Gentile lands. Paul became the instrument used by God to put the universality of the Gospel into practice. The issue of mixed marriages comes into place in the Pauline community. In such unions, the Law of Christ would be binding on only one partner, namely, the believer. The apostle finds himself now faced with a real life situation in which there is no direct command of the Lord. His churches looked up to him for answers. Like marriage, divorce is neither Christian nor non-Christian, although many scholars would have us think in terms of their being Christian or non-Christian. Between what is ethically right and wrong, is the twighlight zone of the acceptable or the unacceptable. For the Jew, divorce was custom. The Gentile world also had its own rules governing marriages, which were no better than those held by Jews. Jesus (the synoptics) quotes no code of law for or against the practice of divorce. He bases his argument on the natural order of things - that is, God's original plan at creation. Marriage may be perceived as a pre-fall divine institution, and divorce a post-fall divine concession. In speaking about marriage, Jesus speaks in terms of principles: marriage was meant to be a permanent bond. Man's sinfulness necessitated a compromise on the part of God: to allow for divorce. We propose that the synoptics speak about the ideal. The state of affairs which Jesus propagates is not practical, and cannot be fully realised in the present age of fallen man. Conversely, Paul deals with the practical - the realistic as opposed to the ideal. His teaching reflects the problems of applications in a rather heterogeneous context. The whole law of God reflects the relativised will of God. In Christianity, Jesus seems to be the first person to relativise the very Law of God. In order for us to fully comprehend the perfect will of God, we need to look beyond the code of law, to that state of absolute perfection. The state which man cannot attain in this present life, where sin and the devil are still at large. This seems to have been the approach applied by Jesus in answering questions on marriage and divorce. In the whole record of Jesus' ministry, nowhere was a called to resolve a real marital problem. We thus propose that What Jesus he gives is only a theoretical framework which requires further analysis before it can be applied to real life situations. We also propose both Jewish and Gentile ethical principles need to be readjusted and reinterpreted before they can be adopted into Christianity. The socio-historical context of both the writer and readers will play an important role in our quest for the link between the Pauline and synoptic perspectives on marriage and divorce. The gulf between the ideal and the real seems to be as wide as one between justice and mercy. The following questions raise some of the major concerns in this research: Are there any links between Paul and Jesus (synoptics) on marriage and divorce? If Jesus speaks about the ideal in his absolutist attitude, is there any link between the ideal and the real; between principle and practice?

The Gumuz society in Ethiopia has been neglected and almost forgotten by the previous rulers of Ethiopia. It is not surprising therefore to see that the majority of the population of Ethiopia have no knowledge about the Gumuz society. This society was not exposed to education until the arrival of the missionaries at the end of 1950's. When Christianity was introduced, the Church did not do enough in helping Christians to distinguish between the Gumuz traditional and the Christian marriage practices, the former which denies some male members of the community the possibility of getting married. Marriage is contracted by exchanging girls. Thus, unless a man has a sister to exchange he is not going to get married. There is an assumption that a man may get a girl from one of his extended families, but that is not always possible. He may or may not get a girl. Therefore the man will end up without getting married. The introduction of Christianity made it possible for every member of the Gumuz people to get married by allowing them to marry from the neighbouring tribes. However, it introduced another side effect. Christians were not able to differentiate between the Gumuz traditional and Christian marriage practices. This dissertation studies the traditional and the Christian marriage practices of the Gumuz society and of the Ethiopian Evangelical Church Mekane Yesus (the EECMY). According to the Gumuz society, marriage is believed to be (Okka) God given. To get married is to obey okka, to accept what God has given, and to have as many children as possible in order to increase the population of the Gumuz tribe. Failure to get married is a crime against traditional beliefs and practices. Furthermore, this dissertation provides the way the Gumuz society understands divorce. Among the Gumuz society divorce does not concern only one family. Both family members and extended families are affected. Since marriage is performed as indicated earlier on by exchanging girls, if a person divorces his wife he has to expect that his sister will divorce her husband which will disturb the whole extended family relationships. Realizing the risk, every married persons in the Gumuz society is conscious about divorce. This attitude brings the rate of divorce to a low level. This dissertation sees the need for counselling and appeals for a therapeutic approach by putting emphasis on contextual family therapy, a therapeutic process which is constructed with maximal concern for its relevance to the cultural context in which it occurs. For example, the problems related to exchanging girls, marriage between the Gumuz and the neighbouring tribes, the issue of divorce, and so forth, are not problems which can be discussed only with individuals or a family member, it needs the inclusion of extended families as well as multigenerational processes. This therapeutic process is capable of providing a contextual approach by looking at the system of the family. I recommend the therapists to have a grounding in the general principle of family life and to get familiar with the way families operate as a social system. The dissertation hopes to create awareness among therapists with basic theories of family systems which enable them to get knowledge of a causes for dysfunctional behaviour within the families, and to equip them with therapeutic skill. This is paramount.

Abstract:
The objective of this research study is to investigate the problems of the divorced Christians within the Anglican Diocese of Kirinyaga in Kenya. A selection was made of some the divorced Christians in this diocese who even after their separation and divorce remained in the Church. The divorced Christians in this study were observed to have many more problems than ordinary Christian people. Their failure to survive their marriage made them feel desperate, tending towards a sense of personal failure. It was hypothesized that divorcees experience being sidelined in the Church, thus causing them physical and psychological emotions which affect them and label them as people who are unpardonable. Jack Dominian (1979), in search of information leading to the breakdown of marriages, has observed that the Christian Churches' teaching on sexuality and marriage has been a factor contributing indirectly to the breakdown of marriages and specifically to divorce. He also confirmed that another important contributing factor is the background of the partners. With this in mind the Christian Churches will want to do everything possible to save marriages. Therefore, the Churches have to be properly prepared and equipped for undertaking the challenges involving in building a worthy marriage. At the end of this research study the emphasis on marriage counselling is appealed to as a worthy tool to guide people towards a stable marriage. The dissertation commences with chapter one as an introduction which defines the objectives, motivation and the hypothesis to be tested. The literature review is tabled and is followed by definition of the terms so as to make the reader familiar with their usage. Finally, the chapter closes with the structure of the study. Chapter two deals with the methodology, explaining the sample and the development of the tool. The survey and all procedures are explained. Chapter three is divided into three parts. Part one introduces Agikuyu marriage and divorce, part two brings a theological review of divorce problems in the scriptures and part three brings a challenge to the missionary endeavours in the Anglican Diocese of Kirinyaga. It deals with the tensions created by the efforts of the Western missionaries and the Church as they came up against the African traditional heritage. Chapter four brings out the results of the methodological work. Hypothesis analysis is done and the interpretation given. The findings are given for and against the hypothesis. Discussion of the findings is done and then a conclusion is made. Chapter five is divided into three parts. First, a few ideas arising from the findings are discussed at length.The second part is the way forward which suggests possible ways in dealing with divorcees and enhancing a stable marriage. The final part carries the concluding remarks as a summary of the research study.

This study began from the pain of a woman going through divorce and experiencing invisibility in the church. Through conversations with divorced people in a small research group and a participatory research process, the study brings together the narratives of literature, narrative therapy and pastoral care to challenge the dominant discourses of divorce and its influence and effects on people's lives and the communities in which they live and worship. From the study has grown a healing ministry with people who are divorced, which has begun to tum around their experience of invisibility and isolation into an experience of community, inclusion and care.

Self-knowledge unavoidably implicates and, in the end, it must presume correspondence. How, indeed, can a self even be posited in the absence of a corresponding other? While the triunity of God reveals a dialectic of unity and correspondence, the human self has ever struggled, within traditions as seemingly diverse as ancient Hellenism and the sundry schools of modern philosophy and psychology, against the presumption that “autonomous self” might not be fatally contradictory. On the other hand, with the lens of orthodox Christology properly affixed, God, self, and others may finally be seen as they truly are. Christ is the revealer of mysteries, the reconciler of God and humanity, and the One in whom all the treasures of (self-)knowledge and wisdom are found. Christian self-knowledge, then, presumes the believer’s ethical correspondence—to God-in-Christ and, through Christ, with fellow believers by means of faith expressing itself in love. When sought in Christian caregiving contexts, this Christ-mediated knowledge of self, over time, counters and undermines the countertherapeutic expression of dissociation and its ethical corollary, self-deception.

This dissertation critically reflects the problem of divorce and remarriage within the North Eastern diocese of the Lutheran Church in Tanzania. A problem which has become rampant in the whole church. The situation became apparent to me as I was ministering in different parishes in the area of the research for five years. Divorcees are not accorded the full membership in the church because of their divorce status.Their failed marriages and criticism from church members makes them feel out of place in their own churches. They feel desperate, tending towards a sense of personal failure. The Shambala traditional customs whereby divorcees and/or remarried people are looked upon as outcasts make things even worse. Divorcees, makomanyumba 1., have no place in the Shambala Christian community. The goal of this dissertation therefore is to address divorcees' crisis through counselling. Many of these people are members of the church. I feel the church needs to face the biggest challenge to alleviate divorcees' crisis through counselling. I believe sincere pastoral care and counselling within the Lutheran Church in Tanzania will bring about healing, support, reconciliation and restoration of the hurt and deprived people, in this sense, the divorcees. Estardt (1997) believes that pastoral support is one of the services that persons committed to the church have the right to expect. He sees pastoral counselling as a relationship in which the minister assists the client in dealing with the difficulties, frustrations and tragedies of life. It is for this sense a new model of pastoral care and counselling is suggested for whole church. The model in which pastors in parishes are not the only solitary sources of counselling. The new model suggests that both trained and untrained laity is a good source for pastoral care and counselling. If these sources are fully utilised in parishes, a minister's counselling work might well be assisted, enhanced and improved by the parishioners. This qualitatively oriented Practical Theology research journey, informed by postmodernism and social constructionism, was based on a narrative enquiry into the healing and renegotiation of identity of five "faithful spouses" post infidelity and divorce. These conversations occurred within a small group context, where narratives were spoken and witnessed (pastoral therapeutic gatherings), and were aimed at enabling the participants to remember and re-author preferred identities and new ways of being. This dissertation attempts to bring together the narratives of the participants, the literature, narrative therapy and pastoral care. My research curiosity was prompted by my mother's experience of divorce, and by the myriad number of conversations I have had with both "infidels" and "faithful spouses" in my pastoral practice. This research journey examines the process of co-creating, along with my fellow travellers (research participants), a viable model of divorce recovery in the face of infidelity and divorce.

This thesis looks at how relevant 2 Corinthians 5:18-21 and Romans 5:1-11 is for bringing about reconciliation between victims and offenders in serious crime. Their relevance is discussed in the light of a psychological model of rape trauma and recovery and the real experiences of rape victims and rape offenders. The crime of rape is used and examined paradigmatically for serious crime as a whole. I contend in this thesis that reconciliation between victims and offenders, in serious crime, can promote healing, especially if it is done through careful mediation.

This thesis takes as a starting point the societal change in Germany with its concomitant economic risks for substantial parts of the population. Evangelical churches in Germany have yet to react to this change. While the relationship between social work and mission has been a point of widespread discussion within the evangelical movement internationally, it fails to have any impact on local churches. The question is thus: how can a mission-oriented church benefit from Christian social reform movements? Transformative as well as holistic understandings of mission have already yielded an enlarged vision of mission as encompassing social justice. But how about a missiological paradigm which is practically translatable into cultural and social relevance as far as the local church’s vision for becoming an agent of societal change/reform is concerned? When interpreted missiologically, mediation can be such a useful paradigm, as its essence is conflict as a constant anthropological signifier of human/divine distance on the one side and God’s purpose of redemption as reflected in the church’s mission on the other. Thus mediation could be called a category of the missio dei. This practical implementation into the church’s work as being relevant for its community is reached by reverting to the sciences of social work, namely the concept of community development. As mediative community work, this approach will add to the profile of a mission-oriented church as determined to serve a holistic vision of the gospel. At the focus is thus the immediate social environment of a local church, in which it can trigger spiritual, personal, social, cultural and economic processes of transformation. In the social context of Germany this way of expressing the missiological drive of a local church seems to be a hopeful avenue, since the social and economic risks are likely to remain and are threatening a large percentage of the population with social marginalisation. It is here that the economy of community work will be furnishing useful aspects to help a mission-oriented church develop its mediative-communal thrust into its immediate social context in order to proclaim God’s redemptive purpose.
Ausgangspunkt dieser Arbeit ist die Beobachtung des gesellschaftlichen Wandels in der Bundesrepublik Deutschland samt seiner sozialen und ökonomischen Risiken für weite Teile der Bevölkerung. Eine Antwort auf diesen Transformationsprozess ist seitens der evangelikalen Kirchen in Deutschland ausgeblieben. Die Frage nach der Verhältnisbestimmung zwischen sozialer Arbeit und Mission ist in der evangelikalen Bewegung zwar international breit diskutiert worden, doch hat sie kaum Wirkung auf die Praxis der örtlichen Gemeinden in Deutschland gezeigt. Bearbeitet wird daher die Fragestellung, wie eine missionarisch orientierte Gemeinde in ihrem Sendungsauftrag Initiativen christlicher Sozialreformen umsetzen kann. Transformative und ganzheitliche Missionskonzepte haben bereits ein erweitertes Missionsverständnis hervorgebracht, welches die soziale Gerechtigkeit als missionarischen Auftrag mit einschließt. Die Frage stellt sich nun nach einem missionstheologischen Paradigma, welches praktisch in eine kultur- und gesellschaftsrelevante Tätigkeit einer missionalen Gemeinde umgesetzt werden kann, durch die sie zu einem Träger einer christlich geprägten Sozialreform wird. Das Paradigma, das hierfür erarbeitet und missionstheologisch gedeutet wird, ist das der Mediation. Sie offenbart in ihrem Wesen zum einen den Konflikt als anthropologische Konstante und somit die Distanz zu Gott und zum anderen die Heilsabsicht Gottes, die sich im Missionsauftrag an die Gemeinde widerspiegelt. So stellt sich die Mediation als Kategorie der missio dei dar. Die konkrete Umsetzung dieses Paradigmas in eine die Gesellschaft gestaltende Arbeit gelingt durch die Hinzuziehung des Arbeitsprinzips der Gemeinwesenarbeit aus der Sozialarbeitswissenschaft. In Form einer mediativ-gemeinwesenorientierten Arbeit gibt sie einer missional ausgerichteten Gemeinde die Möglichkeit ihren Sendungsauftrag mit einem umfassenden Heilsverständnis umzusetzen. Dabei steht der unmittelbare Sozialraum der lokalen Kirchengemeinde im Fokus des Interesses, in dem geistliche, persönliche, soziale kulturelle und ökonomische transformative Prozesse eingeleitet werden können. Bezugnehmend auf den Kontext der Bundesrepublik Deutschland erweist sich diese Art den Sendungsauftrag umzusetzen als hoffnungsträchtig, da die sozialen und ökonomischen Risiken in Zukunft weiter bestehen werden und ein nicht unerheblicher Teil der Bevölkerung bereits als sozial ausgegrenzt ist. Hier gibt insbesondere die Gemeinwesenökonomie Anhaltspunkte, wie eine mediativ-gemeinwesenorientierte missionale Gemeinde in ihrem Sozialraum den Heilswillen Gottes verkündigen kann.

This empirical study analyses whether and how the Imbusa initiation rite is used to construct ‘subordinate femininities’ among married Bemba women of Zambia. Imbusa initiation rite is very significant for Bemba and Zambian women despite the many changes that have significantly altered their religio-cultural practices. It is something that makes every parent proud of their daughter because it is more or less a public declaration that they have raised their daughter with good morals as understood by Bemba people. This study has used two frameworks, first, African women theologies because African women theologies draw their sources from rites, rituals, songs, proverbs, riddles and so on. Secondly, I used status construction within social psychological theory because those with authority in groups define the outcomes and expectations of their group. For instance, banacimbusa among the Bemba people determine what should comprise the teachings in Imbusa and how an initiated woman has to behave in marriage. Utilizing mixed methods, the aim was to understand women’s views about ways in which the Imbusa rite contribute to the identity of Bemba and other Zambian women in marriage. I have proposed a framework for a life-giving marriage; first the need for banacimbusa who are gender sensitive in their teachings; second, African feminist Imbusa pedagogy, teachings that equip women for dialogue in marriage. And third, a holistic approach to sexuality in marriage.

This dissertation investigates the problem of significance conflict resolution as a meaningful ministry of the Church in ecclesial, social and political conflict. Recognising the fact that conflict has been an experience of humankind since the beginning of time the research focuses on the Church's role in socio-political conflict during the years of the National Party rule in South Africa. A number of theological and practical questions arise from the problem of conflict and its resolution in relation to the Church. The question is raised: does conflict resolution as a concept and strategy have a credible theological content. In order to explore this problem the dissertation first develops a theology of conflict. The theology of conflict forms the basis for a theology of conflict resolution. The thesis is that conflict, inherent in all human experience, is not good or evil. Rather it has the potential for destruction and transformation. It is the transformatory possibility that needs to be promoted. The thesis examines conflict resolution strategies of leading theorists and practitioners and tests them as viable approaches to be adopted by the Church. However it finds that conflict resolution will be accepted as a role of the Church if it can be formulated in convincing theological principles. An analysis of reconciliation and conflict resolution focuses on the way reconciliation is perceived in the political context. It then probes the theological relationship between reconciliation and conflict resolution. Reconciliation is more than conflict resolution. The scope of reconciliation includes (a) the initiative of God, (b) addressing the predicament of alienation, brokenness and distress ( c) through the Cross and Resurrection of Jesus Christ the Mediator (d) who reconciles the universe to God. However, conflict resolution has an indispensable role in the reconciliation process. Through the ministry of conflict resolution the Church facilitates confrontation between individuals or groups and contributes towards transformation in relationships where there is conflict. The thesis then probes the possibilities for conflict resolution to be an integral part of of on-going pastoral ministry in the belief that pro-active conflict resolution is a source of social and ecclesial transformation.

Des conflits peuvent surgir entre ces deux ordres, notamment lors du divorce des parties. Une brève présentation du droit québécois du mariage et du divorce ainsi que des droits religieux catholique, musulman et juif permet d’effectuer des comparaisons entre ces droits et d’identifier un certain nombre de points de jonctions normatifs. Des voies permettant d’harmoniser les deux univers normatifs sont explorées, dans une perspective de droit préventif: l’adaptation du contrat de mariage civil et du processus de la médiation familiale et la rédaction des ententes entre conjoints.
Married couples with strong religious beliefs must respect two parallel legal orders : the state order and the religious order. Conflicts can arise between these two orders, in particular when the parties divorce. A brief presentation of Quebec’s marriage and divorce laws and catholic, muslim and jewish religious law allows comparison between these systems of law and reveal some normative jonction points. In a preventive law perspective, ways to harmonize these two normative universes are explored : arrangement of the civil marriage contract, of the family mediation’s processus and of the writing of the agreements between partners.

Die vorliegende Arbeit schlägt eine Brücke über den Graben zwischen dem normativ-ethischen Anspruch an die Lebenslänglichkeit einer Ehe und Gottes gnädigem Handeln gegenüber dem scheiternden Menschen. Anhand des Umgangs der Kirchen und Glaubensgemeinschaften mit Ehescheidung und Wiederheirat wird dieser Graben aufgezeigt. Es ergibt sich, dass die bestehende Spannung jeweils durch die einseitige Betonung von Norm oder Gnade aufgelöst wird. Die Grundlage für die Diskussion bilden das massgebende Eheverständnis sowie die Bestimmung des Verhältnisses zwischen theologischer Ethik und dem Konzept der Gnade als Handlungsprinzip Gottes. Darum werden in dieser Forschungsarbeit zuerst die theologiegeschichtlich gewachsenen Eheverständnisse und die unterschiedlichen Normen- und Gnadenverständnisse der römisch katholischen Kirche, der evangelischen Kirchen und der evangelikalen Gemeinschaften in Bezug auf den Umgang mit Scheidung und Wiederheirat untersucht. Aufgrund der herausgearbeiteten Übereinstimmungen und Unterschiede wird anschliessend anhand eines von der Vergebung ausgehenden Denkansatzes der Graben zwischen normativer Ethik und dem Konzept der Gnade überbrückt, die Spannung aber nicht aufgehoben. The present thesis bridges the gap between the normative-ethical standard of lifelong marriage on the one hand and God’s grace for men‘s failures on the other hand. Considering the practices of churches and communities with regard to divorce and remarriage, this gap is demonstrated. It is found that the associated tension is eliminated by an unilateral choice of either the normative aspect or the principle of grace. The basis for the discussion is provided by the relevant understanding of marriage and the determination of the relationship between theological ethics and grace as the principle of God's action towards mankind. Therefore, this thesis investigates the evolution of the theological understanding of marriage during history and the different understandings of norms and grace in the Catholic Church, the Protestant Church and the Evangelical Free Communities with regard to their handling of divorce and remarriage. Considering the resulting similarities and differences, I propose – building on the fact of God’s forgiveness – how to bridge the gap between normative ethics and the concept of grace without eliminating the obvious tension. Finally, possible consequences for how to handle divorce and remarriage by churches and communities are drawn.

The primary aim of the study was to explore the participants’ personal and professional experiences through an in-depth and sensitive inquiry. The data was collected from five participants using face-to-face, semi-structured interviews. The interviews were analysed using thematic analysis. The results of this study indicate that professionals experience various challenges when working with high-conflict separating and divorcing families. The participants also shared their perceptions regarding parenting plans. Further research on the challenges specific to drafting and implementing parenting plans with high-conflict separating and divorcing families in the South African context is recommended

Custody disputes have traditionally been considered a legal matter. More recent trends have seen the recognition of divorce and custody as both legal and psychological events. This necessitated the involvement of professionals of the helping services in custody recommendations. Such a multidisciplinary approach is currently taken by the Office of the Family Advocate, Pretoria, in disputed custody matters. It is suggested that the way in which the problem of custody is currently defined, is on a pragmatic level, and does not include a higher-order awareness as implied by an ecosystemic epistemology. Such an awareness denotes self-reflexivity, and calls for a more aesthetic emphasis. The dialectic between aesthetics and pragmatics is maintained by means of a descriptive look at the various systems involved in a disputed custody case. Adopting an ecosystemic epistemology is recommended, through the metaphor of mediation, as a further evolution of an already changing process.

Disputes concerning care and contact arrangements for the minor children of divorcing couples present special challenges for professionals in the legal and psychological professions. Care and contact (custody) disputes, which are complex undertakings, are a point of debate in the professional arena in South Africa. Clinical psychologists are often included in the professional cohort that assists the high court, as the upper guardian of minor children, in the decision making process regarding contested care arrangements of children. This field is further challenged by the lack of training programmes and practice guidelines, the intense adversarial nature of disputes and litigation processes, as well as the increase in board complaints levelled against psychologists at the Health Professions Council of South Africa. These challenges contribute to the reluctance of psychologists to become involved in care and contact matters. This study therefore aimed first to explore the current practices and contributions of clinical psychologists in care and contact disputes in South Africa, and second to evaluate the procedures used by clinical psychologists to inform their recommendations to the court. In such matters, clinical psychologists adhere to the best interest of the child (BIC) principle. The final aim of the study was to identify and propose guidelines for a model of better practice. The study was guided by a Constructivist Epistemology and a Social Constructionist paradigmatic framework. A qualitative research approach was employed. Data were collected through face- to-face interviews with clinical psychologists and advocates and were analysed using Thematic Network Analysis of Attride-Stirling. The findings, which indicated that that the practices of psychologists are plenteous, revealed significant shortfalls in current practices. In addition, the findings designated that creating a universal model for care and contact evaluations to fit with the legal professions’ empiricist tendency poses a paradigmatic dilemma and a practical challenge. A position of observer-dependence and a reflective position on the part of the psychologist is instead indicated.

Despite the fact that many people in South Africa are affected by divorce, not much research is done on divorce recovery. This study on divorce recovery is shaped by a feminist theological perspective and a postmodem social constructionist discourse. As qualitative research, narrative group work was embarked on over a period of a year with five women who went through divorce. Through therapeutic letters different themes emerged. These themes formed the focus for each chapter and are enriched by relevant literature reflections. In the first chapter the stark reality of divorce in South Africa, the discursive positioning, epistemology and research methodology are discussed, and the stories of the participants are told. Divorce is deconstructed by the participants as resistance to patriarchy and not only an interpersonal crisis. The majority of claimants in divorce cases in South Africa are women. The dominant oppressive biblical discourse that divorce is always sin is reconstructed. An alternative religious discourse is co-constructed amongst the participants: that divorce under certain circumstances is God's will for women who are caught in humiliating and oppressive marriages. The various spheres of life that women reconstruct after divorce are discussed. These include: • practical matters such as the legal proceedings, housing and finances • emotional reconstruction where emotions such as fear. senses of guilt, and rage from a feminist perspective view are discussed. • reconstruction of social relations which includes aspects such as the relation with the former husband, family, new male friends and children • spiritual reconstruction which includes a feminist perspective on the Bible, sin, the will of God, and also a divorce ritual • the reconstruction of identity. Finally the five participants' reconsructed stories are told.

This research journey investigated the ways in which (1) the lives of adolescents have been influenced by parental divorce and subsequent remarriage, (2) exploring the relationships participants have with biological, nonresidential fathers and (3) to collaboratively present ways of doing family in alternative. Four adolescent girls took part in group conversations where they could were empowered to have their voices heard in a society where they are usually marginalized and silenced. As a result of these conversations a family game, FunFam, was developed that aimed to assist families in expanding communication within the family. Normalizing prescriptive discourses about divorce and remarriage were deconstructed to offer participants the opportunity to re-author their stories about their families. The second part of the research journey explored the problem-saturated stories that these four participants had with their biological, nonresidential fathers. They deconstructed the discourses that influenced this relationship and redefined the relationship to suit their expectations and wishes.

The challenges facing divorcees when it comes to pastoral care and counselling are among the toughest to face members of the Reformed Churches South Africa (RCSA) in the Vhembe District today. There are many people in South Africa who are experiencing the pain of being divorced. The RCSA in the Vhembe District are also faced with this challenge and it affects their doctrines and their practical ministries. These challenges also affect the pastors of the RCSA. The aim of this research is to investigate the challenges that divorcees face regarding pastoral care and counselling in the RCSA in the Vhembe District, Limpopo, South Africa in order to develop an approach to pastoral care and counselling to support divorcees so that they may learn to cope with their challenges. Caring and counselling for the divorcees is the primary mission of the church. The study utilised a qualitative, exploratory, descriptive, and contextual design to obtain data from the participants within the RCSA in the Vhembe District. A sample of 30 participants (divorcees) from the RCSA in the Vhembe District was used. Data were collected on an individual basis by means of unstructured interviews. The qualitative data were collected and analysed using the six steps of open coding proposed by Tesch in an effort to understand personal experiences of divorcees. The research used Graham Redding’s approach to establish trustworthiness. The study adhered to four criteria to assess the value of the findings of qualitative research, namely credibility, applicability, consistency, and conformability. The ethical considerations were taken into account. The findings of this study show that divorcees experience many challenges, and that Reformed pastors are not equipped and not doing enough to address those challenges. This research helps to enhance the quality of pastoral care and counselling to the divorcees within the RCSA in the Vhembe District. The findings and recommendations of the study are useful in guiding all Reformed pastors in providing pastoral care and counselling to divorcees.
